Item number two is discussion: impossible action regarding liquidated damages for 2021 street construction project, a third avenue from randolph street to boss, creek tj. You want to show.

So this was a project completed by jake's excavating that was completed after our completion date, so the project in the contract had a total of 80 working days.

Jake's first started work on april 19th and given those 80 working days, that would have resulted in a completion date of august 10th, and that is with two additional days that were for holidays july 4th and memorial day in which no work took place.

The actual completion date of the project was on october 11th, so per this contract that was signed with jake's. The city shall deduct one thousand dollars for each and every day that the contractor is late.

So between the dates of august 11th and october 11th, that's a total of 62 total days which results in liquidated damages of 62 000. So we.

Recommending that sixty two thousand dollars be withheld from the contract for liquidated damages.

Are you also asking for that additional amount for the two.

Bills, correct and then, in addition to the liquidated damages, um there are two instances when we had to have city crews come out and complete some work.

um Let's see, the first was on july, 7th when it was after a storm event, and we had to have our public works, guys come out and bring out some material and grade out the road, because there are a lot of ruts and cars were bottoming out and it was just unpassable that was on july 7th and that's for a total of 258 dollars and 34 cents, which includes time and also some material costs.

The second instance was on july 14th, when we had to have our sanitary crews come out with their vacuum truck and suck out one of the manholes which the lid was moved and then a bunch of debris fell in making that manhole clog up. So that was mostly for time and that total cost was 577.28 cents.

I I do not, uh I guess the one question just for the record tj has um has jake, contacted us at all or responded to anything at this point.

No I've had several communications back and forth just stating that these were going to be recommended to the board of public works. I also emailed him last week stating which days we're going to be recommending these. I have not gotten a response from him regarding any of these items.

I would make a motion to approve uh the liquidated damages in the amount of 62 thousand dollars, along with the two dpw invoices, one for 258 dollars and 34 cents on the second for 577.28 cents, be deducted from jake's. Next pay request.

And I will second that motion and confirm that uh the the two bills may be collected um according to paragraph 11, on page 19 of the contract. So that's perfectly permissible, so I second your motion.

Item number three is a portland cement concrete license for foreigner asphalt, sealers.
