Good morning this is chair, french, convening the regularly scheduled business meeting of the kansas corporation commission for today january 6, 2022 joined by my colleagues, commissioner duffy and commissioner keane good morning. Everyone we on today's agenda, have 27 consent, agenda items and one noticed item. We will begin with our consent agenda. Commissioners, you've had the opportunity to review all 27 items on the consent agenda. Let me ask at this time whether you have any questions or comments about those items. Aye consent agenda is approved. We will now move to our one noticed item. This is in docket number 21 kgsg, 332 gig, and it is a. It is a proposed order on kgs's motion to file limited rebuttal testimony. Our presenter for this item is mr brian pederton. Good morning, brian.

Yes, good morning, commissioners, on december 20th symmetry filed testimony from justin clapper in opposition to the financial plan settlement and on december 30th kgs filed a motion to file limited rebuttal. Testimony to address mr clapper's claims that kgs acted imprudently regarding its gas supplies during winter storm urie.

On january, 4th symmetry filed its opposition to kgs's motion to file limited rebuttal. Testimony.

Since kansas, gas bears the burden of proof as to whether the financial plan should be approved, and it would be beneficial to fully develop the record on the issue of whether kgs acted prudently during winter storm uri.

This order grants kgs's motion to file limited rebuttal testimony, but the the order also explains the commission shares symmetry's concerns over an abbreviated time frame uh to potentially request additional information in response to any rebuttal testimony.

Therefore, um the commission would limit kgs's response time to any discovery propounded uh by symmetry concerning the rebuttal testimony to only three days with that, I'm available for questions.
