Good morning, all right, I'm dwight keene, I'm the chair of the news corporation commission joining me this morning, are my fellow commissioners I'm joined by uh commissioner susan duffy and commissioner andrew french good morning to both of you at this time. I will call to order this meeting of the kansas corporation commission on this february. 1St 2022 first matters before us this morning, for our consideration are pardon me 43 items on the consent agenda. uh Commissioners, have you had an opportunity to review uh the orders in these dots?

No questions I'll move approval of today's consent agenda. I second, the motion.

Very good, it's been moved and seconded. We approve the consent agent. Any further discussion hearing then we'll call the question. We have uh only one item before us on our noticed agenda and it is daca number 22-e kce-188-com.

Commissioners, on october 26 2021 dean, tollefson filed a formal complaint against energy kansas central thompson, alleged that for the last nine months his bill included demand a demand charge and according to tollefsen, under his residential peak management rate, he should not have a demand charge if his. If his peak demand was less than one kilowatt and his bills have reflected this. For the past nine years, tolleson requested uh credit for excess charges and a copy of his tariff.

On december 14th, the commission issued an order finding the complaint, the procedural requirements of kar 82 1220.

on december 20th, 2021 evergy, filed a motion to dismiss stating that there have been no violation of any law tariff or commission order, and that mr tollefson had misinterpreted his tariff, which applies a minimum bill in any month or one kilowatt is used and that mr tolson had in fact been being underbilled and not assessed the appropriate demand charge up until january of 2021 and that his billing is now correct.

Energy also included a copy of mr thompson's tariff in their motion to dismiss for his records on december 28 2021, the commission staff filed a report and recommendation which largely agreed with evergy agreeing that tollefsen had been billed properly and the complaint should be dismissed.

The below order agrees with staff and energy and grants the motion dismiss and I'm available for any questions.
