I
sincerely
appreciate

You
know
sometimes
in
the
hustle
and
bustle
of
what
it
is
that
happens
around
here,
and
it
happens
through
the
course
of
the
years.

We
have
a
tendency
to
have
short
memories
of
things
that
went
wrong
things
that
generated
public
outcry
and
necessarily
generated
the
attention
of
the
general
assembly.
You'll
recall
just
a
little
over
two
years
ago,
a
lot
of
us
began
getting
phone
calls,
emails
texts
and
reading
newspaper
articles
from
outraged
citizens
of
the
commonwealths
of
the
commonwealth.
Excuse
me:
I
want
to
read
you
some
of
the
headlines
to
go
back
in
time.

However,
there
are
many
who
believe
the
power
to
pardon
should
remain
intact.
This
is
why
this
amendment
does
not
do
away
with
the
power
to
pardon.
It
simply
restricts
that
power
during
the
30
days
prior
to
an
election
and
then
between
a
gubernatorial
election
and
a
swearing
in
that
way.
If
a
governor
believes
in
a
pardon
strongly
enough,
he
or
she
can
stand
in
front
of
the
voters
or
have
their
party
stand
in
front
of
the
voters
to
decide
their
opinion
of
those
actions
there.

because
when
I
very
first
saw
this
bill,
I
was
like.
Oh
no,
not
this,
because
it
is
true
that
this
is
a
somewhat
of
a
knee-jerk
reaction
to
a
disaster
a
few
years
ago
and
I'm
trying
to
think
through
the
future
of
all
time.
What
is
in
the
best
interest
of
the
commonwealth.

would
like
to
see
a
better
way
to
do
the
goal:
that's
not
reactive
and
necessarily
limiting
the
governor's
constitutional
authority
in
this
area
and
not
others.
We've
got
boards
and
commissions
that
have
been
appointed.
We've
got
all
kinds
of
things
the
governor
does,
and
this
one
thing
we're
going
to
say:
no,
not
this,
I
feel
like
we
need
to
have
a
more
comprehensive
approach
to
this.
If
we're
going
to
actually
address
the
real
issues.

it

a
substantial
thing
to
to

change
the
constitution.
It's
not
something
I
do
lightly
and
I
don't
think
that
senator
mcdaniel
does
either.
But

what
we
did
see.
The
last
time
was
unconscionable
for
many
reasons,
one
it,
you
know,
put
some
dangerous
people
back
out
on
the
streets.

I
think
one
of
the
most
basic
forms
of
local
government
within
the
commonwealth
of
kentucky,
which
is
the
journal
system
in
our
justice
system,
something
that
comes
down
from
our
english
common
law
that
says
12
people
out
of
a
community
will
sit
in
judgment
of
a
person
for
a
crime
for
an
action
for
damages
to
see
if
someone
is
harmed
harmed
I
mean
we
were
not
set
up
as
a
kingdom
where
one
person
can
wholesale
reject
these
principles,
and
you
know
I'm
not
going
to
say
there's
not
a
time
when
a
pardon
is
not
necessary,
but
in
this
particular
case
you
know
we
we
need
to
preserve
our
our
heritage
and
in
our
traditional
english
commonwealth
law
and
journal
rights,
and
I
think
that
this
bill
goes
a
long
way
towards
preserving
those
important
rights
in
the
commonwealth.

the

bill
deals
with
garbage
collection
and
and
the
franchise
associated
with
that,
and
for
small
municipalities
or
municipalities
in
general.
This
is
a
klc
bill,
so
any
negative
parts
of
the
bill
or
anything
you
see,
I'm
just
going
to
direct
those
to
jd
cheney.

There's
a
bureaucracy
currently
in
statute
that
provides
a
bureaucratic
process
through
which
a
city
would
be
mandated
to
go
through
to
change
garbage,
garbage
carriers,
collection
collectors
and
that
was
initially
set
up
when
municipalities
were
taking
over
an
existing
private
business
there's
back
in
the
day,
there
was
a
lot
of
that
going
on,
and
so
the
script
has
been
flipped.

Basically.
So
now
you
have
a
lot
of
municipal
carriers
who
are
now
going
back
and
privatizing
municipal
service,
and
so
this
would
this
bill
would
simply
eliminate
that
bureaucracy
when
a
small
municipality
and
the
reason
jd
got
me
involved-
is
this
happened
in
flemingsburg
kentucky,
which
I
represent,
where
that
that
small
municipality
was
attempting
to
transition
to
a
private
operator
and
it
took
them.

The
bureaucracy
causes
an
extra
year
year
and
a
half
of
red
tape,
and
this
this
would
eliminate
that
the
citizenry
is
still
protected
because
even
if
they
change,
whoever
takes
over
they're
still
required
to
go
through
the
bidding
process.

Senator
senator
west
has
done
a
good
job.
I
mean
we.
We
supported
this,
where
we
were
displacing
private
providers
by
some
governmental
action
where
you
had
a
private
provider
come
in,
invest
a
lot
of
money,
a
lot
of
assets
and
resources
that
that
there
was
some
process
to
deal
with
that,
where
it
kind
of
looked
like
a
taking.
If
you
saw
the
inverse
so
this
was
originally
enacted
in
2017.
I
believe
we
said:
look,
that's
a
fair
process
to
do
that,
but
in
this
instance
we're
not
displacing
a
local
government's,
not
displacing
anybody.

The
law
is
requiring
something
that
does
not
need
to
be
done
because
there's
no
one
being
displaced
in
this
instance,
so
we
should
have
caught
that
in
2017
when
the
bill
went
through
originally,
but
we
did
not-
and
this
this
corrects
that
after
it
caught
some
of
our
members,
yeah.

feel
like
there's.

can't
possibly
be
the
only
person
because
I
used
to
deal
with
this
all
the
time
when
I
wasn't
a
senator
where
you
read
a
bill
and
you
read
it

times

you

committee

we
have
a
so-called
hearing
and
I've
not
heard
anything
that
helps
me
understand
this
bill
any
further,
and
I
don't
even
have
the
right
questions
because,
like
we
need
to
take
a
little
bit
of
time
here,

obviously
this
is
an
issue
that
supposedly
sounds
easy.

the
other
side
of
the
story,
and
I
haven't
heard
that,
and
I
don't
know
if
there
is
another
side
but
because
of
that
level
of
unclarity,
I
will
vote
yes
because
I
think
it's
probably
clear,

I

think
it's
clear.

think
we
need
to
be
more
cognizant
of
that
as
we
try
to
blow
through
committees.
