summarize
it

committee

and
let
them
review
it
in
greater
detail.
But
first
I
want
to
thank
you
for
that
letter
in
the
detailed
explanation
and
kind
of
the
the
reader's
digest
version
of
this
committee.
Members
is
that
the
contract
has
been
withdrawn
and
is
being
rebid.

And
I
was
wondering,
mr
chairman,
I
I
know
this
has
been
a
matter
of
interest
to
the
committee.
I
think
this
is
probably
our
third
or
fourth
appearance,
and
even
since
I
sent
the
letter
to
you
on
october
1st,
there
have
been
some
new
events
and
if
I
could
ask
your
indulgence
to
just
take
a
few
minutes
to
provide
you
with
a
little
chronology
and
an
update,
it
might
answer
a
lot
of
the
committee's
questions
or
or
at
least
inform
whatever
additional
questions.
There
are.
A
Most
certainly-
and
I
appreciate
that
you're
correct-
we
have
deferred
this.
I
think
this
is
the
third
month
that
has
been
deferred
and
obviously
it's
because
of
a
lot
of
interest.
A
lot
of
questions
about,
what's
going
on
here,
just
remind
the
committee
members
that
mr
harvey
is
new
to
his
position
and
he
kind
of
inherited
the
situation.
So
you
know
please
proceed.

And
thank

I
I
am
new
to
the
position,
and
so
there
are
certainly
going
to
be
some
gaps
in
my
understanding,
but
but
I
think
we're
developing
a
better
understanding
of
this
as
we
go
and
I
think
we're
getting
to
a
better
place
with
this.
With
this
contract
I
became
the
secretary
of
justice
cabinet
in
early
august
and,
as
I
think
all
of
you
know
at
that
point,
a
new
contract
for
toxicology
services
had
been
entered
into
and
was
implemented
on
july
1st.

When
I
came
on
board
and
began
to
learn
about
these
circumstances,
I
learned
that
there
were
well
over
200
specimens,
which
were
essentially
in
limbo,
because
the
old
vendor
had
possession
of
those
when
its
contract
expired
and-
and
I
think
in
some
cases
the
coroners
understandably
that
some
of
them,
I
think,
didn't
get
the
news
about
the
changeover
and
continued
to
send
specimens
to
the
old
contractor.

Of
course,
nothing
is
easy
and
that
required
us
to
enter
into
a
not
feasible
to
bid
contract
with
the
old
vendor
so
that
that
testing
could
be
completed.
We
were
able
to
do
that.
I
think,
through
some
excellent
work
by
folks
here
at
the
justice
department,
justice
cabinet
and
particularly
our
friends
at
the
finance
cabinet.
They
really
worked
hard
to
expedite
that
not
feasible
to
bid
contract
and
we
were
able
to
enter
that
within
just
a
few
days.

I'm
told-
and
I've
learned
this
information
just
yesterday,
that
the
testing
of
these
more
than
200
specimens
that
had
been
held
up
is
now
almost
complete.
I
think
there
are
only
two
specimens
that
have
not
been
fully
tested
and
I
think
in
those
cases
the
initial
testing
was
done
and
then
some
follow-up
was
ordered
so
for
all
practical
purposes.

That
testing
is
complete,
and
I
know
that
that
will
be
welcome
news
for
the
committee
and
particularly
for
those
members
who
had
constituents
that
were
that
were
held
up
by
this
during
this
during
the
process
of
of
trying
to
figure
this
out,
I
was
receiving
information
that
I
thought
was
perhaps
inconsistent
with
our
previous
understanding,
some
of
which
had
been
communicated
to
this
committee
and
specifically
during
this
process.

I
was
working
with
our
coroners,
as
well
as
the
office
of
the
state
medical
examiner,
and
I
also
had
occasion
to
speak
directly
with
some
of
the
families
that
were
involved
or
that
were
being
held
up
by
this
delay
in
testing
certain
of
these
specimens.

So
after
reviewing
that,
I
believe
that
I
have
a
better
understanding
of
the
correct
of
the
true
circumstances,
even
though
I
will
tell
you
that
this
can
be
confusing.
This
is
not
quite
as
simple
as
it's
just
placing
a
bid
for
number
two
pencils
where
it's
you're
talking
about
a
fungible
commodity.
It
can
be
a
little
more
confusing
than
that,
but
there
are
a
few
areas
for
which
I
would
like
to
provide
the
committee
updated
information.

The
the
emars
data
is
a
little
bit
confusing
to
me,
but
I
can
tell
you
that
it
was
rebid
on
a
number
of
occasions.
F
The
confusion
about
this
likely
arose,
at
least
in
my
opinion,
from
the
shorthand
descriptions
that
are
used
on
invoice
summaries.
If
you
only
look
at
those
invoice
summaries,
you
would
probably
believe
that
the
old
contractor
was
making
a
separate
charge
for
blood
urine
and
vitreous,
even
though
that
would
be
a
misinterpretation
after
receiving
this
information.
That
seemed
to
be
inconsistent
to
me.

I
reviewed
with
the
help
of
the
medical,
examiner
and
I'll
say
we
did
this
over
the
weekend
a
weekend
a
few
weekends
ago,
and
the
medical
examiner
was
very
good
to
spend
a
lot
of
his
time
that
weekend
in
pulling
these
cases
for
for
my
review,
but
we
wanted
to
get
a
good
representative
sample
and
what
we
try
to
do
is
in
addition
to
just
looking
at
the
invoice
data,
we
pulled
the
requisitions
for
testing,
as
well
as
the
test
results,
and
when
you
put
all
that
together,
you
see
that
the
old
contractor
was
indeed
making
a
single
charge
for
blood
urine
and
vitreous.

Again,
that
conclusion
would
not
be
obvious
from
reviewing
only
the
invoice
summaries
alone
and
indeed
reviewing
the
invoices
would
lead
to
the
opposite
conclusion
and
then,
finally,
I
want
to
update
the
committee
about
the
status
of
the
protest
and
we
have
some
new
information
on
that.
As
I
indicated
in
our
letter
to
you,
mr
chairman,
our
legal
department
had
determined
that,
in
fact,
both
proposals
and
the
last
rfp
should
have
been
disqualified.

We
filed
papers
with
the
finance
cabinet
indicating
that
that
was
our
position
and
just
late
yesterday,
finance
issued
a
decision
that
I've
not
had
time
to
thoroughly
review
at
this
point,
but
I
understand
the
bottom
line
is
that
our
request
to
re-bid
the
contract
has
been
granted
and
the
emergency
contract.
Continuation
has
been
extended
to
make
sure
that
there's
no
interruption
in
these
services
that
are
so
vital
for
kentucky.

explanation

again,
since
you
knew
the
position,
I
think
you've
covered
the
historical
perspective
pretty
good,
but
from
our
committee's
perspective
you
know
what
caught
our
attention.
First
was
the
fact
that
we
had
a
million
dollar
contract
that
was
suddenly
increased
to
1.3
million
dollars
and
with
that
sizable
increase
that
always
catches
our
attention,
and
I
think
what
has
occurred
with
regard
to
this
contract
substantiates
the
need
for
this
committee.
A
But
once
we
start
looking
into
a
little
bit
further
the
issue
of
not
looking
at
the
invoices
property,
it
appeared
that
there's
not
going
to
be
just
a
300
000
difference,
but
it
could
be
literally
a
million
two
million
dollar
difference
in
in
the
bids,
and
it
sure
appeared
to
me
personally
that
this
decision
was
being
made
in
the
vacuum
of
administrative
personnel
without
the
involvement
of
the
people
who
should
have
been
involved.
So
I
commend
you
for
reaching
out
and
involving
as
many
people
as
possible.

I've
got
two
principles
that
I
try
to
live
by
as
a
legislator.
One
is
to
operate
this
like
a
business
and,
secondly,
spend
the
money
like
it's
my
own
and
again
when
you
see
a
30
increase
in
anything.
I
think
it
always
raises
questions
from
from
me
personally,
but
I
think
also
our
committee
members,
so
I
think
you've
done
an
excellent
job
with
your
explanation
and
just
for
formality
purposes,
then
the
current
contract
is
being
withdrawn.

although
I
want
to
make
sure
that
I
correctly
communicate
the
the
facts,
we
will
continue
to
operate
under
the
current
contract
only
until
we're
able
to
get
a
new
contract
in
place
after
a
new
rfp
is
put
on

street
and
finance
has
authorized
that
in
their
recent
decision.
But
we
have
to
do
that
because
otherwise
we'll
have
a
gap
in
these
services
and
of
course
that's
that's
can
happen.
That
would
be
untenable.

understand
what
you're
saying
is
that
national
will
continue
to
handle
this
business
until
the
rfp
process
is
complete.
Is
that

There's
a
little
bit
further
explanation
with
regard
to
I'm
moving
on
a
little
bit,
I
pulled
the
axis
contract
for
for
discussion
today.

It
just
seemed
very
unusual
to
me
that
we
terminated
a
contract,
there's
not
a
run-out
period
and
then
we're
left
with
200
samples
that
apparently
axis
didn't
think
they
were
responsible
for
and
national
couldn't
do
because
it
was
under.
I
guess
the
old
contract,
but
what's
our
assurances
when
we
complete
this
irp
process?
If
national
is
not
the
the
company
who
gets
his
bid,
that
we
don't
run
into
the
same
situation
again.

And
that
I
think
that's
certainly
that's
a
that's
a
reasonable
question.

I
can
only
tell
you
I
mean
we
have
the
contract.
We
have
the
new
contract
when
it
is
issued.

will
tell
you
we'll

set
up
a
process
for
transition
so
that,
as
a
matter
of
contract,
we
cannot
be
in
that
situation
again.

working

nms
now
really
to
ensure
that
we
have
a
smooth
transition
and
nms
is
one
of
our
vendors
and
and
we've
worked
with
nms
they've
been
responsive
to
many
of
our
concerns,
and-

I

expect
them

work
with
us
in
good
faith,
to
ensure
that
that
we
have
no
repetition
of
what
we've
been
just
been
through.
With
these.
With
these
specimens.

Well,
what
we
have,
mr

is
is
the
contract
that
was
entered
into
and
implemented
on

1st,
so
we
won't
have
a
new
contract.
We
now
have
a
decision
from
the
finance
cabinet
that
essentially
says
this
contract.
This

should

rebid
and
also
we
can.

are
to
continue
under
the
existing
nms
contract
until
we
can
get
the
new
rfb
on
the
street
and
decide
it
so
we
again-
and
the
purpose
of
that
is
so
that
we
don't
have
a
gap
in
in
these
services,
but
we
will
be
working
with
nms
to
ensure
that
we
have
a
smooth
transition
with
no
fumbles
in
the
event
that
nms
does
not
does
not
retain
this
contract.

you
know
the
this
committee,
even
though
chapter
45a
says
we
approve,
disapproved
contracts
or
really
don't
we
kind
of
give
it
the
good
housekeeping
civil
approval,
saying
everything
is
good
legitimate
and
it's
always
lifted
the
finance
cabinet
to
overrule
us
which
they
do
on
numerous
occasions.
But
I
think,
given
the
fact
that
this
is
still
a
contract,
that's
in
force,
I
I
think
it's
appropriate
for
our
committee
to
still
take
action
on
this.
You
know
I
don't
think
it
impacts
what
happens
with
the
national
or
access
at
this
point.

request
would
be
that,
in
light
of
these
developments
that
the
contract
be
deferred,
I
would
not
ask
that
that
you
approve
it,
but
if
it
could
be
deferred
until
such
time
as
we
get
the
new
contract
in
place.
But
of
course
I
respect
completely
the
committees
to
discretion,
discretion
to
act
as
it
thinks
best.

afraid
this
is
falling
on
deaf

obviously
it
hasn't,

probably

times
in

row
about
the
axis
not
having

something
missing

their

rfp
that
disqualified
them,

we
didn't

detail

what

magic.

we're
hearing
that
national
was
also
disqualified.
Was
it
is
it
because
they
were
missing?
Something
rfp
that
given
the
opportunity
to
amend,
would
be
abated,
or
is
this
something
that
you
know
they
just
actually
don't
have

ability
to
do
the
service
we're
asking.

I

say
that
you

I'm
not
an
expert
on
these
things,
and-
and
I
wasn't
here

I
this
may
not

the
best
explanation

hear,

think
that
the

rfp
asked
any
proposers
to
send

essentially
some

the
kit
that
would
be
used
for
for
to
transmit
the
samples
and
to
gather
samples
to
do
the
testing

think
in
one
case
the
kit
was
not
provided
at
all.

pretend
that
the
same
thing
happens
again:
these
two
people
both
send
in
a
photo
or
a
half
kid
or
whatever.

that
something
in
that
situation?
Would
it
be
more
efficient
for
us
to
just
come
back
and
say
you
all
need
to
amend
your
thing,
because
we
don't
have
any
bids
that
qualify?
Is
that
what
would
normally
happen?
Because
I've
been
trying
to
figure
out
why
we
don't
just
contact
if
we
don't
have
any
bidders
that
are
qualified,
but
probably
they
are,
but
we
can't
verify
that
just
ask
for
an
amended
rfp.

it's
easy
money
monday
morning,
quarterback
these
things,

I
think
one
of
the
issues
and
you've
already
addressed.
It
was
the
lack
of
communication
involvement
of
people
who
should
have
been
involved

end.

both
these
firms
or
multiple
firms
respond
to
the
rfp
who's
going
to
be
involved
in
the
scoring
of
these
contracts,.

know
where
and
actually
chairman,
I
I
can't
give
you
a
conclusive
answer
on
that,
because
again
we
have
to
be
very
careful
about
adhering
to
the
procurement
rules,
many
of
which
I
don't
have
a
great
understanding
of,
but
so
obviously
the
procurement
staff
will
be
involved
and
I
think
what
we
would
like
to
do
and
we'll
probably
consult
with
finance,
we'll
make
sure
that
we
get
this
right,
but
certainly
we
want
to
to
to
the
extent
possible
to
have
someone
who
actually
has
expertise
in
doing
this
work
to
at
least
play
a
consulting
role
on
that
now.

understand
that
that
the
way
procurement
works
you
have
to
have
a
buyer
and
ultimately
the
buyer
makes
those
decisions,
but
what
I
hope
can
happen
is
is
that
people
that
have
expertise
in
how
the
work
really
gets
done
can
at
least
play
some
consulting
role
in
that
perhaps
blinded
to
the
identity
of
of
whoever
might
be
it,
but
we're
we're
working
through
that
now
I
I
can
tell
you
that
there
there
will
be
collaboration
between
procurement
and
the
medical
examiner's
office
as
we
develop
this
rfp
that's
already
started.

As
I
say,
we
spent
most
of
the
morning
sitting
at
the
table
at
the
medical
examiner's
office
in
in
louisville,
with
our
procurement
staff,
to
ensure
that
that
happens
we
had
a
tour
of
their
facility.
It
is
a
very
busy
place,
as
you
know,
and-
and
I
think
we
all
developed
a
better
understanding
of
of
what
those
folks
do
in
that
facility.
So
I
hope
that's
responsive
to
your
question.

it
is,
but
I'm
always
concerned
about
the
scoring
process,
because
those
decisions
seem
to
be
made
within
a
black
box.
It's
not
really
covered
by
chapter
45a
and
it
seems
that
scoring
guidelines
change
depending
on

the
contract
cycle.
And
that's
my
concern.
You
know
if
you
got
like
a
a
five
criteria
process
for
scoring
a
contract
and
they're
weighted
that
there's
a
shifting
weight
on
those
things.

say
to
that
that
again,

big
purpose

our
initial
meeting-

doubt
if
that'll

the
last
meeting-
was
to

have
the
medical
examiner's
office.
Tell
us
what
this
rfp
needs

look

deliver
the
services
most
efficiently
for
their
use
and
the
use
of
kentucky
coroners.

elements

the
rfp

not

drawn
up
in
a
vacuum.

result
of
collaboration

just
two
goals

adhere

sure
that
we
don't
do
anything

anyone

think
would
be
untoward
in
terms
of
the
procurement
rules
but
within

that

to
work
with
the
medical
examiner's
office

work
very
closely

collaboration
with
kentucky
coroners,
because
those
those
cases
cannot
be
successfully
prosecuted.

work

coroners
and
and
I'm
happy
to
report
that
the
coroner's
really
performed
admirably
during
my
time
in
the
justice
department.

appointed

private
law
practice
for
three
or
four
years,
and

was
in
the

issues

while

that
this

contract

a
company

california

not

redundant,
but
to
remind

california
took
them
precedent
action
in
2018
to
prohibit
their
employees
from
traveling
to
the
state
of
kentucky,
because
they
wanted
to
protest
some
legislation
that
we
passed
during
that
session
legislation
which
had
no
impact
upon
their
state
whatsoever.

was
intended
to
hurt
the
economy
of
kentucky,
which
in
turn
hurts
the
working
people
of
kentucky
and,
as
a
matter
of
personal
principle,
I
don't
think
we
should
be
doing
any
business
with
companies
from
california
until
that
action
is
rescinded.
So
that's
my
objection
to
this
contract
representative
bowling.

those
lowest

looking
at
is
very
similar
to
what

done

ohio
state

at

university

iowa

duquesne,

company

company
coming
in

taking
over

operations

steam
plant,

their
expertise
in
the
energy
environment
basically
to
to
to
run
that
plant
help
us
be
more
efficient
in
what
we're
doing

campus,

save
costs,
to
work
towards

sustainable
model,
basically
trying
to
reduce
the
carbon
footprint
on
campus
as
best
as
possible.

concessionaire

deal

that

groups

energy
consumption
is

dollars

great

and
so
the
books
are
specially
selected.

2021
book
selection
list.

can
also
provide
you

rubrics
of
what
we
focus
on
each
year
is
certain
characteristics
specific
to
the
age,
appropriateness
and
obviously
the
first
goal
is
to
inspire
love
of
books
and
reading,
but
the
secondary
goal
is
to
get
them
ready
for
kindergarten
right
to
improve
the
home
literacy
environment.
Build
a
home
library,
increase
the
one-on-one
time
for
parents
to
be
on
caregivers
to
be
involved
in
their
child's
learning,
and
we've
been
doing
this
for
26
years.

this
program
and
we're
time
limited,
and
I
appreciate
I
think
that
everybody
on
this
committee
understands
the
importance
and
value
of
reading,
particularly
at
the
early
age.

think
what
centric
southwest
is
trying
to
ascertain
is:
are
there
guard
rails
for
this
program
to
ensure
that
the
the
books
are
age
appropriate
that
the
content's
ain't
appropriate
and
that
we're
not
teaching
some
manifesto?
That's
contrary
to
what
their
parents
may
have,
and
I
don't
think
we're
giving
a
very
precise
answer
to
her
question.

contract

objections

retroactive

why
this
contract
wasn't
brought

get

line

not
knowing
how
long
that
line
was

the
federal
guidance
would
come
out,
but
knowing
that
we
had
this
set
of
funds
that
was
going
to
be
granted
to
us
and
not
knowing
exactly

parameters
were
of
it.
Only
knowing
that
we
would
need
this
system
in
order
to
deal
with
it.
We
went
ahead
and
got
in
line
with
public
protection.
Public
protection
was
able
to
begin
those
services
and
said
again
creating
that
system
in
july.

We
are
asking
them
to
be
retroactive,
because
some
of
those
services
were
begun
in
july
and
we
need
to
be
able
to
pay
them
for
those
services.
The
services
will
be
paid
for
out
of
the
federal
grant
dollars
that
were
provided
to
us,
but
because
the
guidance
didn't
come
out
start
coming
out
from
the
federal
government.
Until
august,
we
weren't
really
able
to
begin
negotiation
of
an
agreement
with
the
protection
cabinet
until
that
guidance
came
out,
and
so
those
negotiations
began
began
in
late
august.

we
were
issued
the
initial
guidance
we
have
developed
a
program
based
off
of
that
initial
guidance.
We've
submitted
it's
the
federal
government
for
approval.
We've
not
received
any
feedback
on
that
yet
from
the
federal
government.
But
that
is
why
the
contract,
the
contract
was
effectively
negotiated
after
the
services
were
begun
and-
and
that's
in
large
part
because
of
you
know
not
receiving
guidance
from
the
federal
government
who's
granting
the
dollars
until
after
those
services
were
begun.

need
those
services
to
begin
so
that
we
can
be
up
and
running
and
able
to
get
these
resources
out
to
these
homeowners
who
need
it
as
soon
as
possible
because,
as
you

we're.

advance
