problem

seeing.
This
repeat
note
of
this
contract
replaces
such

such
such,
and
would
just
like
some
clarification,
what's
going
on
here
as
to
why
we're
seeing
this
replacement
contracts
and
this
whole
dynamic
around
purchasing.
If

kind

give
me
some
some
historical
perspective
on
that.

passed

session
regular
session
and
it
changed
the
procurement
and
for
the
fish
and
wildlife,
and
but
we
still
have
to
follow
krs-45a
and
any
contracts
that
were
in
process,
even
if
they'd
already
been
bid
and
just
waiting
final
approval
were
rejected
back
to
draft
and-
and
there
were
certain
contracts,
though
associated
with
Deca.

engineering
and

Administration
within
Finance
cabinet

allows
us
to
utilize,
Statewide
agreements,
and
but
the
finance
cabinet
has
taken
several
measures
even
as
late
as
a
week
and
a
half

in
order
to
keep
us
from
using
those,
we
did
not
feel
like
that.

agreements
because,

Statewide
functions,
they

agency,

cabinet

engineering,
because
it
takes
according
to

hundreds
of
millions
of
dollars
that

not
going
to

able

move
forward
on
once
these
contracts
are
completed
in.

an
emergency,

really
have
no
way

a
contract

because
we
can't
perform
the
Committees
that
we
need
for
engineering
contracts.

a
contract

our
health
care
regulatory
work
and
we
had
previously
put
this
out
to
bed
and
we
had
a
firm
that
had
connections
outside
of
the
state
that
to
do
this
work.
But
we
found
that
when
we
can
partner
with
the
firm
in
Kentucky
that
does
most
of
our
work,
most
of
which
is
at
the
contract
rate,
although
at
this
particular
instance
we're
seeking
a
higher
rate
because
of
the
highly
specialized
nature,
we
had
an
opportunity
to
have
significant
savings.
You'll
see
that
the
rate
here
is
265
to
565
an
hour.

always
do
this
just
presents
a
sole
source
contract
and
I
I
appreciate
that
folks
had
this
position,
but
I
think
just
a
matter
of
policy
that
these
things
should
be
routinely
should
RFP
should
be
prepared
just
as
a
Fail-Safe.
You
know
I
appreciate
your
position
that
the
partner
here
has
given
you
supposedly
a
discounted
rate,
but
quite
kindly
not
trying
to
be
crass
about
it,
but
how
you
know
it's
a
discounted
rate.
You
know,
there's
really
not
a
whole
lot
of
transparency.

Well,
one
thing
I
can
speak
to
is
the
the
bids
that
we
have
for
all
the
firms
when
we
did
the
RFP
for
this
work.
There
were
four
firms
the
winning
bid
was
between
685
and
975
for
Health
Care
regulatory
work.
Another
firm
had
a
range
from
1060
to
1
395.
I
Another
firm
had
575
as
their
number,
but
did
not
have
experience
with
academic
Medical
Center
and
then
the
third
fourth
firm
had
rates
between
1070
an
hour
and
1270..
So
we
actually
have
sort
of
looked
at
Across,
the
Nation,
really
the
folks
that
do
this
work
and
tried
very
hard
to
get
the
lowest
rate
that
we
can
with
a
group
that
understands
the
nature
of
the
work
that
we
do
here
in
Kentucky.
How.

Well,
the
firm
that
we're
using
was
did
not
participate
in
this
firm
because
what
that
we
needed
this
bid,
because
in
some
cases
this
firm
has
a
conflict.
But
on
this
issue
there
is
no
conflict
and
they
have
a
much
lower
rate.
So
we
wanted
to
have
an
opportunity
to
spend
less
money
for
a
firm,
that's
more
familiar
with
the
work
that
we
do
here
and
that's
the
reason
for
the
you.

because
this
firm
there
were
some
conflicts
that
we
thought
would
be
in
place,
which
is
one
of
the
reasons
why
we
needed
to
have
a
firm
outside
of
this
one
to
potentially
do
the
work,
but
wherever
we
can
we're
seeking
to
save
money.
So
when
we
had
an
issue,
that's
come
up
and
we
have
that
does
not
fall
within
the
conflict
of
interest
that
this
firm
had
it.
One
gives
us
the
opportunity
to
work
with
the
trusted
partner
and
two
gives
us
an
opportunity
to
save
money
on
the
rate.
So.
I
Generally,
yes,
and
unless
we
can
like
I,
said
if
we're
trying,
if
we're
able
to
save
money,
we
certainly
would
like
to
be
able
to
do
that.
But
generally
yes,
if
the
work
Falls
within
the
conflict
that
led
for
the
need
to
do
the
RFP
we're
going
to
use
the
firm
that's
at
the
higher
rate,
but
we're
going
to
try
to
minimize
that
as
much
as
possible,
obviously
because
their
rates
are
at
least
30
to
40
percent
higher
than
the
firm
that
we're
seeking
approval
for
today.

the
only
place

we
could
not
use
them
as
if
it
fell
within
the
conflict
of
interest,
which
would
be
a
limited
sort
of
area
of
work?

sure
what
we

them

certainly
if
they

able
to
participate,
they
would
have
been
the
winning
bid.

discussed
wanting

summer
issue

rfps
for
these
highly
specialized
work
so
that
we
have
them
available

us
and
know
if
they
have
a
conflict.

won't
look
at
them,
but
we're
going

I
know
we
did
have
the
case
where
we
were
asked
to
retract
it
and
then
reinstitute
it
when
we
have
the
need
so
we're
kind
of
on
the
fence,
which
way
is
the
best
way
to
go.
But

are
going
to

summer
test
the
waters
to
find
out
and
get
the
local
firms
for
these
highly
specialized,
because
we
feel
like
the
firms
that
are
charging
the
state
rate.
They
do
have
the
familiarity
with
the
university.

that's
why
they're
typically
coming
in
at
lower
than
some
of
the
out-of-state
members,
because
they've
got
the
familiarity,
so
we're
going
to
try
to
do
that
this
summer
and
then
we'll
have
the
RFP
process
and
then
issue
the
PSC.
Only
once
we
have
the
work
coming
to
us
learning
from
what
we
did
earlier
this
year,
when
we
were
attracted
it
because
we
didn't
have
the
work
at
that
time.

I'm
all
for
saving
money
using
in-state
firms
for
this.
But
it
appears
to
me
to
be
backwards
that
this
firm
couldn't
participate
in
RFP
because
of
potential
conflict
of
interest.
But
they're
doing
the
work
until
a
conflict
of
interest
arises.
Could
they
have
not
participated
in
the
RFP
process
and
then
identify
those
conflicts
of
interest
and
that
work
be
awarded
to
another
firm.

they
didn't
respond
because
of
the
conflict
of
interest
on
the
solicitation
from
the
out-of-state
vendors,
so.

word

that
one

anybody's

I'm
coming
from
that
I
think
we
first

just

bothered

contracts

think
this
Falls
in
this
particular
category,

there's

to
be
some
method
in
place

validate
these
rates,
that
they
are
fair.
They
are
competitive
and

know
how
you
do
that
outside
RFP
process.

we
are
going

re
sort
of
bring
this
all
back
together
and

another
RFP
and
I
think
it

show

this
firm
will
emerge
as
as

best
candidate
given
their

contact.

Louisville
and
Kentucky
contacts
with
us
and
the
lower
rate
that
they're
giving
us
on
this
specialized
work,
and
so
I
don't
know.
If
there's
a
way,
we
can
come
back
and
certify
that
we've
done
that,
but
we
certainly
will
do
that.

to

universities

concerned
about
the
things
we're
being
told
to
our
students
if
they

a
contract
that

risen.
It
was
like
it's
eight
hundred
thousand
dollars.
We've
increased
about
2.7
million,
and
the
explanation
given
here
is
that
additional
funds,
as
Department
of
Juvenile
Justice,
underestimated
its
current
need
when
creating
the
initial
contract
so
and
then
it's
followed
by
the
underestimation
was
a
result
of
this
contractor
being
better
than
the
previous
and
other
contractors
of
finding
nurses
and
actively
feeling
necessary
positions.

the
previous,
to
give
some
estimation,
the
previous
agency
probably
filled
about
50
of
our
nursing
slots,
and
that
was
where
they
capped
out.
When
we,
when
we
submitted
a
new
RFP,
we
didn't
want
to
be
stuck
like
that,
so
we

actually
put
out
two
different
agencies
and
we
were
awarded
two
different
agencies,
and
so
we
doubled
the
the
funds.
So
it
was
800
000,
but
it
was
800
000
for
each
agency.

we
now
have
two
agencies,
two
rfps
that
allow
us
to
use
nursing
services,
and
this
particular
company
has
been
finding
nurses
and
the
other
agency
has
not.
So
we
are
very
lopsided
in
this
agency
and
they
are,
unfortunately,
the
ones
who
who
cost
a
little
bit
more,
which
is
why
it's
a
little
bit
lopsided
on
the
funds.
So
we
had
to
redo
that
for
this
agency.

salary

nurse
coming

and
when

benefits

number

was
able
to
pull

cost

nurse

thousand
would
be
somewhere
around

that's

benefits
and
health
insurance,
and
all
that,
with
an
agency
nurse
with
the
more
expensive
agency,

full-time
nurse

somewhere

they

submitted

and

believe

said

Personnel

to

dollars

potential

something
that
we're
going

tackle

not
spending
dollars
wisely

no
other
alternative.

you
know
when
we're
hiring
the
agency
nurses
like
this
in
all
likelihood
we're
one
of
a
better
term,
stealing
them
from
other
health
care
providers
within

Commonwealth,
and
that's
not
a
good
environment
for
us
to
exist
in
either
domain
competition
with
them
with
the
public,
but
with
that
Mr,
chair,
I,
hope,
I
made
my
point:
I'll
make
a

to
prove
this
contract.

been
good
about
getting

on

RFP

but
technically
they're
on
a
three-month
rotation,

if
they
wanted
to
leave
that
position,
they
could
with
the
agency
as
they
run
it.
