Description
Appeals Committee meeting from October 17, 2022. For full meeting agenda visit https://bit.ly/3VyOX1P
A
You
very
much
Mr
chair,
so
I
can
confirm
that
we
are
now
live
on
YouTube,
so
we
can
go
ahead
and
get
started.
Mr
chair
just
a
note.
I
have
received
regrets
from
counselor
McLaren
who
is
unable
to
join
us.
We
do
have
the
rest
of
the
committee
with
us
as
well.
A
We
have
Kyle
Campo
manager
of
of
enforcement
as
well
as
my
colleague,
Ian
Sullivan,
who
is
the
meeting
host
for
today
and
the
agent
for
the
appellant
Charlie
Moore
is
with
us
as
well,
so
we
can
go
ahead
and
get
started
when
you're
ready.
B
Okay,
well
I'll
start
by
calling
this
meeting
to
order
and
welcoming
staff
members
and
committee
members.
B
So
the
second
item
is
the
approval
of
the
agenda
for
October
17th
I.
Don't
believe
we
have
any
addendum,
and
so
does
somebody
want
to
move
the
agenda.
Ms
Wallace,
the
secondary
Mr
storms
and
so
any
addition
subtractions
or
anything
of
that
sort,
not
seeing
any
all
those
in
favor,
please
vote.
Thank
you.
The
third
item
is
confirmation
of
the
minutes,
and
these
are
the
minutes
for
July
18th
2022.
B
Are
there
I
I
guess
the
first
thing
to
do
is:
have
somebody
move
it
Mr,
Knox
and
Mr
storms?
Secondly,
are
there
any
problems
with
the
minutes
or
conditions
subtractions?
Nobody
is
everybody
seems
to
think
not,
therefore,
all
those
in
favor
of
the
minutes.
Please
vote.
Thank
you
foreign
interests
and
seeing
none
I'll
pass
on
to
five.
There
are
no
delegations
and
there
are
no
briefings
so.
B
The
seventh
item
is
the
business
part.
A
is
new
appeals,
eight
ten
black
burn,
Muse,
so
I
think
we'll
look
to
staff
to
run
through
this
with
us.
So
we
have
a
presentation.
B
Okay,
are
you
doing
this
Mr
combo.
C
Three
yeah
I'm
gonna,
be
acting
on
behalf
of
the
officer
for
today
he's
absent
from
work,
so
I'm
able
to
give
a
brief
to
the
committee
an
overview
and
look
towards
next
steps.
Sure.
C
So,
with
that
note
in
front
of
you
today
we're
discussing
E10,
Blackberry
Muse
apartment
116.
from
a
city
standpoint,
we
received
a
concern
regarding
water
infiltration
into
an
interior
unit
of
the
apartment
building.
We
received
this
concern.
It
was
on
in
the
April
13th
and
the
order
to
comply.
Sorry,
a
notice
of
violation
was
given
and
that
time
was
on
May
27th.
So
when
the
officer
initially
got
this
call,
we
and
you
can
flip
to
the
next
slide
Ian.
C
When
the
officer
initially
got
this
call
on
the
13th.
He
did.
His
inspection
found
that
there
were
violations
within
under
the
Property
Standards
act
he
examined
and
and
was
able
to
document
that
there
was
deteriorations
that
were
happening,
sort
of
on
the
on
the
the
outskirts
in
the
soffit
and
fascia
of
the
exterior
of
the
building
and
the
interior.
C
There
is
noticeable
water
damage
around
the
unit
and
inside
the
unit
with
that
being
the
the
ceilings
and
the
walls,
the
officer
issued
the
the
notice
of
violation
again
with
that
due
date
being
May
15th
and
we
were
working
towards
compliance
with
the
property
owner,
but
after
the
May
15th
date
from
the
correspondence
that
I
have.
Is
that
the
the
the
property
owner,
whether
through
fault
of
the
the
process?
We
we
did
not
receive
any
further
communication
back
from
that
property
management
team?
C
For
this
discrepancy
on
me
or
sorry,
I'm,
just
confirming
the
dates
here
in
August,
there
was
a
notice
of
a
violation
or
an
order
of
Remedy
given
on
that
property
and
so
far,
I'm.
Just
so
sorry,
I
apologize,
I'm
just
confirming
the
date
for
the
order.
C
My
apologies
I,
had
it
right
in
front
of
me
I'm
just
looking
August
23rd
was
the
order
of
Remedy
compliance
date,
so
we
received
an
appeal.
That's
why
we're
here
today
regarding
that
order
of
Remedy.
But
again
the
main
concerns
were
examining
the
faucet
and
the
the
the
stuff
that
around
the
windows,
along
with
the
water
damage,
that's
in
the
interior
of
the
building,
so
we
have
until
April
13th
of
2023
in
order
to
pursue
charges
against
the
property
owners
because
of
the
violation.
C
But
again,
if
the
committee
was
to
consider
an
extension
from
an
enforcement
standpoint,
we
have
up
until
that
date
to
proceed
with
charges
again.
I
I
I
find
some
of
this
Can.
It
can
be
minor
in
repair,
whether
that's
be
like
sealing
some
of
the
the
faucet
around
the
exterior
of
the
premise,
but
again
we're
looking
towards
some
remedial
action
to
do
with
the
the
water
damage.
That's
surrounding
the
building
right
now
or
in
so
sorry,
inside
of
the
Interior
unit,
specifically.
B
D
C
E
Okay,
so
the
original,
no
and
then
in
May
or
actually,
and
if
the
first
due
date
was
May
15th,
the
notice
of
violation
was
May
27th.
So
the
property
owner's
been
well
aware
of
this,
and
if
you
could
just
summarize
so
I'm
understanding,
we
have
exterior
work
for
Soffit,
Fascia,
Masonry
eavesdrops,
and
then
we
have
interior
work
to
repair
the
water
damage
inside.
So
we've
got
two
aspects
and
you've
had
and
you've
had
no
contact
with
the
property
owner
since
mid-may.
C
The
from
what
I'm
reading
through
your
chair
is
what
I
have
acknowledgment
on
May
27th.
C
Understanding
that
there
are
discrepancies
within
the
unit
and
they
were
working
towards
a
remedial
plan
of
action,
but
we
have
not
received
any
further
communication
since
the
the
2017.
E
B
Mr
storms
I
have
to
tell
you
you
can
see
only
like
half
your
face,
so
it's
I'm
not
sure.
If
I'm
missing
you
or
not,
no.
B
C
B
C
Our
understanding
through
your
chair,
there's
still
substantial
images
that
are
that
are
in
the
interior
of
the
unit
with
the
ceiling
and
the
walls
that
are
damaged
from
from
water
right
and
and
no,
we,
we
have
not
been
shown
anything
to
rectify
those
violations.
Okay,.
B
C
C
C
So,
from
from
our
standpoint,
we
haven't
had
concerns
about
adjacent
units
beside
or
above
this
unit.
It
looks
like
there
is
a
runoff
from
the
roof
where
water
is
coming
down.
The
side
of
the
wall
in
through
discrepancies,
whether
there's
minor
holes
that
are
in
the
foundation
or
whether
it's
just
the
Soffit
Fascia
that
we
just
described
there
is
water.
That's
penetrating
this
unit
specifically,
so
we
haven't
heard
from
any
other
units,
but
there
seems
to
be
water,
infiltrating
this
specific
unit
and.
B
C
D
C
C
All
we
can
say
is
that,
when
we're
doing
the
inspection
there
looks
to
be
damage
that
is
coming
from
the
outside.
So
there
is
a
portion
of
water
damage.
That's
on
the
ceiling
of
this
unit,
but
through
our
observations,
it's
not
something
that
we
could
can
determine
where
it's
coming
from,
and
we
also
have
to
have
obviously
that
consent
to
go
into
other
units,
I'm,
not
sure
if
Mr
storm
could
provide
any
contacts,
whether
there
are
concerns
of
other
units
but
from
a
Property
Standards
perspective.
B
B
Well,
typically,
you
have
to
open
the
ceilings
and
things
like
that
to
find
out
where
the
leak
is
coming
from
correct
and
then
an
apartment
building,
it's
probably
even
more
difficult.
The
okay.
B
I
answered
a
question
that
showed
it
showed
that
we
lost
contact
with
the
tenant
for
about
three
months.
And
can
you
explain
what
happened
there.
C
Thank
you
through
your
chair,
we've
had
several
attempts
to
contact
the
the
tenant
through
email
and
we
stopped
receiving
those
concerns
is
what
we're
looking
through
the
timeline
for
from
from
this
tenant,
specifically
so
I'm,
not
necessarily
and
I
apologize,
because
the
officer
is
not
here
today,
but
when
I'm
looking
through
this,
it
doesn't
appear
that
this
tenants
moved
at
all
and
again
Mr
storms.
Maybe
you
could
clarify
if
that
was
the
case,
with
the
tenants
no
longer
there,
but
from
from
looking
at
the
timelines.
C
All
I
can
say
is
that
there's
been
several
attempts
to
contact
the
tenant,
and
then
we
received
a
further
concern
in
in
August
about
what
will
the
follow-up
was
with
her
initial
concern.
So
there
was
a
timeline
for
two
months
where
we
could
not
receive
communication.
The
way
that
she
was
communicating
with
us
I
had
not
been
able
to
check
the
officer.
If
there
is
a
physical,
you
know,
presence
or
if
there
was
a
follow-up
in
person
to
the
to
the
tenant.
B
C
F
Yeah,
just
for
Clarity
on
the
record,
I
think
you're
making
reference
to
Mr
Moore
as
opposed
to
Mr
storms,
because
I
don't
know
yeah.
D
B
B
That's
right,
John,
Okay!
So
all
right!
So
that's
the
presentation
with
some
questions.
So
now
we
move
to
the
agent
for
the
owner,
which
is
Mr,
Charlie
Moore.
You
could
respond
Mr
Moore,
please.
G
Sure
thing
I
can
answer
a
couple
of
those
questions
that
came
in
there.
The
the
tenant
does
still
reside
at
the
building
the
timeline
over
the
summer.
For
this
there
were
some
ups
and
downs
with
with
trying
to
make
this
right.
There
was
an
initial
attempt
identified
when
Mr
compo
mentioned
the
water
down
the
side
of
the
wall
of
the
building.
A
first
attempt
was
made
with
a
Genie
Lift
to
clear
the
the
gutters
properly.
We
thought
we
had
that
done.
G
It
wasn't
quite
successful
after
doing
that,
we
re-cocked
all
the
balconies
up
and
above
that
unit,
where
they
attached
the
walls
again
thought
they
had
it
and
then
in
August
we
had
the
follow-up,
I
guess
from
the
tenant.
I
don't
have
a
very
good
I.
Have
a
property
manager
works
for
me
who
was
in
charge
of
this
job?
He
was
on
top
of
it,
I'm,
not
sure
where
the
lost
communication
with
the
city
was
during
this
time.
G
G
Water's
flowing
properly,
it's
been
raining
a
few
times
in
the
last
30
days,
or
so
we
don't
see
that
issue
coming
down
the
wall
and,
in
speaking
with
the
tenant,
she
hasn't
seen
any
problems
with
water
as
of
this
date,
and
it
just
subsequently
happened
to
have
one
of
our
staff
in
working
on
her
repairs
and
her
unit
today,
just
coincidentally
but
our
side
of
things
at
this
point
is
we
do
think
that
the
issue
has
been
rectified
with
where
the
water
is
penetrating
or
has
penetrated
in
the
past
I.
G
My
request
would
just
be
maybe
an
extension
on
this
time,
just
to
make
sure
that
we
have
solved
it
once
and
for
all,
but
given
the
equipment
we
require
to
get
up
to
the
fifth
floor
on
the
above,
the
fifth
floor,
I
should
say,
and
staff
available
to
you
just
use
that
equipment.
It
does
take
a
little
bit
of
time
to
get
to
get
that
work
done.
B
G
B
G
No
I
think
the
exterior
work
is
complete.
We've
fixed
the
gutters
we've
done
any
identifiable,
caulking
work
that
needs
to
happen.
G
It's
the
interior
work
that
has
to
be
finished
so
putting
her
windowsill
and
her
ceiling
back
together,
which
is
the
first
code.
The
first
attempt
is
going
right
now.
B
All
right,
I,
don't
see
any
that's
really
good
thinking
about
it.
Okay,
so
there's
Mr
Knox,
you
didn't
put
your
hand
up,
did
you
or
did
you,
okay,
you're
you're,
your
Faces
Sometimes
move
around
for
no
particularly
good
reason?
Okay,
so
it's
all
technological
okay,
so
the
interior
is
outstanding
and
I
guess.
Another
simple
question
that
someone
who
I
might
ask
is:
why
did
this
take
so
long.
G
G
That
the
tenant
saw
the
work
was
happening.
Both
of
us
thought
that
we
had
it
done
by
our
first
work
done
outside
we,
even
I
I,
don't
want
to
misspeak
I,
think
we
were
in
there
and
helped
clean
up
her
situation
inside
it
as
well,
and
then
it
happened
again,
which
I
I
think
the
ball
was
dropped
after
we
thought
we
had
done
it.
Perhaps
it
wasn't
communicated
to
the
the
building
enforcement
properly.
G
That's
probably
why
the
timeline
seems
to
be
so
long.
At
this
point,
it's
not
coupled
with
our
having
the
correct
staff
available
to
float
our
machines
over
there
to
get
up
to
the
roof
line.
It's
just
not
a
of
the
simplest
task
for
last
size
of
the
building.
D
E
G
So
usually
what
happens
is
they
will
take
out
anything
that
looks
damaged
at
this
point
today?
The
first
reinstallation
of
drywall
will
go
up
with
the
first
coat
of
mud,
so
usually
three
coats
of
mud
go
on
painting,
typically
I
would
say
in
this
case,
like
five
to
seven
business
days
is
probably
an
accurate.
It's
not
a
huge
space
that
we're
dealing
with
so
yeah
I
would
say
about
five
to
seven
business
days
from
now
to
final
coat
of
pain,.
B
Okay,
so
we
have
to
determine
whether
we're
gonna
uphold
or
extend
or.
B
F
Sorry,
chair
I,
was
if
it
sounds
to
me
like
ultimately
there's
plenty
of
time.
If
a
charge
were
to
be
required,
I
think
I,
think
Kyle
said
we
had
until
April.
F
If
the
outside's
been
done
and
I
mean
I
assume
it
has
to
be
rechecked
and
then,
if
inclement
weather
happens
just
to
make
sure
so
and
then
the
inside
can
be
done.
So
it
sounds
to
me
like
I
I,
wouldn't
I
wouldn't
hesitate
to
I,
don't
know
what
the
amount
of
time
to
push
it
back
is
30
days
or
something
to
give
time
to
see.
B
B
B
How
does
that
affect?
How
do
staff
see
that
that
reasonable
yeah.
C
I
think
that's
through
you,
chair,
I,
think
that's
reasonable.
Obviously
our
concerns
are
if
inclement
weather
happens
and-
and
this
turns
into
a
bigger
concern
than
than
what's
on
the
the
table
in
front
of
the
committee
right
now
is.
Do
we
just
are
more
concerned
about
the
weather
coming,
so
we
want
to
see
some
kind
of
action
happen
before
we.
We
hit
those
winter
months.
C
B
Okay,
does
someone
want
to
make
that
motion
Mr
storm
seconded
by
Mr
Knox,
any
comments
or
additions
from
the
committee?
I?
Don't
see
any
forthcoming?
Okay,
all
those
in
favor
of
the
extension
of
this
order
of
till
the
next
appeals
meeting.
Thank
you
very
much
that
passes.
Okay,
so
I
think
that's
the
only
item.
We
have
sorry
go
ahead.
Kyle
did
you
have
something
to
say
no,
okay,
so
all
right,
so
we
already
have
the
one
item
so
item
eight
on
the
agenda
is
motions.
B
B
B
Okay,
and
so
before,
I
say
German.
Thank
you
very
much.
Mr
Moore,
you
can
be
in
touch
with
the
city
staff
and
things
should
go
well.
Yes,
Miss
Ms
clerk.
A
A
B
My
thoughts
well,
okay,
so
this
just
leaves
me
one
last
thing
to
do,
which
is
to
thank
the
committee,
members
and
staff,
but
for
a
good
working
relationship
and
I've
enjoyed
working
with
you.
As
you
know,
I'm
not
running
again,
so
it
won't
be
me
here
and,
and
that
might
come
as
a
small
relief
to
you.
I
don't
know,
but
but
anyway
it's
been
good.
I
think
we've
worked
together
well
and
and
I
I
think
some
of
you
are.
This
is
your
final
year
too.
E
F
Yeah
I'm
still
eligible
a
year
or
something
for
a
couple
more
yeah.
Oh.
B
Good
did
Mr
Knox
yeah,
but
so
the
okay.
So
anyway,
that's
good,
because
you
know
it's
good
for
committees
to
have
the
con
continuation
right
and
and
and
some
kind
of
corporate
memory,
I
I
presume,
but
I
don't
know
it
depends
on
whether
Mr
McLaren
is
councilor.
Mclaren
is
elected
with
he
gets
back
on
or
he
wants
to
do
this
so
anyway,
that's
a
fortune
when
it
comes
to
whatever
comes
before
you,
hopefully
not
too
many
Plaza,
Hotels,
and
so
anyway.
I
just
wanted
to
thank
you.
B
It
was
always
a
a
pleasure
actually
in
certain
in
many
ways,
so.
C
B
C
B
Call
for
a
German
and
all
those
oh
I
need
emotion,
Mr,
storms,
Ms
Willis.
Do
you
want
to
do
your
final
for
the
almost.
B
You
have
to
chair
in
the
next
meeting
too
bad,
but
I'm
13
is
the
German
all
those
in
favor.
Okay,
goodbye
best
of
luck
to
everyone,
thanks,
Rob,
okay,
take
care.
