the

portion

counsel
for
the
nevada
system
of
higher
education,
and
I'm
here
today
on
behalf
of
the
board
of
regents
after
reviewing
ab1
this
afternoon,
I'm
pleased
to
say
that
it
is
consistent
with
the
proposal
that
was
voted
on
by
the
board
of
regents
on
september,
9th
and
submitted
to
the
legislature
for
consideration
in
review
and
so
on.
The
record
I'd
like
to
reflect
that
we
do
support
ab1
as
drafted
and
also
at
the
outset.
I
would.

was
just
intending
to
provide
some
highlights
in
the
the
materials
that
you
have
before
you
and
to
get
to.
What
I
believe
is
is
the
heart
of
the
proposal
by
the
board
of
regents,
and
I
do
have
to
apologize.
I
did
have
a
powerpoint
prepared
for
the
committee,
but
due
to
technical
difficulties,
it's
not
up
today.

Ideally,
as
the
committee
may
know,
we
look
for
a
deviation
threshold
of
less
than
5
percent
of
the
ideal
district
population,
either
five
percent
above
or
five
percent
below.
What
I
am
pleased
about.
What
is
presented
in
ab1
is
that
we're
able
to
achieve
a
deviation
of
less
than
one
percent
and
actually
less
than
one
quarter
of
one
percent
in
what
the
proposal
is
before
the
committee.

Largely
in
looking
at
the
different
committee
districts,
a
few
highlights
that
change
the
current
proposal
for
consideration
from
prior
districting.
I
would
note,
is
district
11,
which
is
currently
held
by
regent
gettys.
It
picked
up
humboldt
county
which
is
different
than
district
8,
which
is
currently
held
by
regent
mcadoo.

Of
the
regents
are
located
in
clark
county,
so
in
other
words,
about
nine
and
a
half
and
27.03
percent
of
the
regents
are
in
the
rest
of
the
state
about
three
and
a
half.
So
certainly
by
far
the
majority
of
regents
reside
in
clark,
county.

A
couple
in
in
looking
at
some
of
the
tables
that
were
presented
to
the
committee
today,
I
think
a
couple
points
to
note
is
that
what
I
believe
is
for
the
first
time
we
are
presenting
in
what's
in
ab1
is
a
majority
hispanic
population
district,
two
of
them
in
districts,
four
and
districts,
five,
as
well
as
a
hispanic
majority
voting
population
in
districts
4
in
district
5.,
while
in
the
2010
redistricting
there
were
majority
hispanic
populations,
they
weren't
both
voting
age,
and
so
that
is,
I
believe,
an
important
change.

Another
is
when
looking
at
districts,
one
through
five
in
clark
county.
They
are
currently
drawn
as
a
non-white
majority
districts,
whether
there's
a
combined,
diverse
population
of
majority
nevadans,
and
that
is
a
change
from
the
2010
districting
proposal
where
there
was
only
two
districts.
It
was
district
one
in
district
five
that
were.

the
plan
that
was
submitted
to
the
legislature,
we
made
every
intent
and
I
believe
it
it
does
comply
with
the
principles
of
the
nevada
constitution,
the
u.s
constitution,
the
voting
rights
act,
and
with
that
I
might
be
happy

caveat
before
I
make
this
presentation

a
member

your
legislative
staff,
I
neither
urge
nor
oppose
any
particular
legislation
and
am
in
fact
prohibited
by

doing

purpose
for
being
before
you
tonight
is
just
to
explain
the
contents
of
the
other
portion
of
the
bill
from
a
legal
perspective
not
to
provide
any
sort
of
a
policy
justification
and
supporter
and
opposition
of
those
contents.

remaining
portions
of
ab1,
specifically
sections
six
through
eight
and
a
portion
of
section
14
of
the
bill
revise
the
filing
period
for
judicial
candidates.
This
was
included
in
the
governor's
proclamation
as
item
number
four
to
temporarily
have
filing
for
judicial
candidates
match
filing
for
non-judicial
candidates
for
the
2022
elections.

Existing
law
provides
that
judicial
candidates
begin
to
file
on
the
first
between
the
first
monday
and
january
of
election
year
and
the
second
friday
after
the
first
monday
in
january
of
an
election
year
and
for
non-judicial
candidates
filing
begins.
The
first
monday
in
march
of
that
year
and
ends
the
second
friday
after
the
first
monday
in
march
sections
six
through
eight
of
this
bill
temporarily
for
the
2022
general
primary
general
elections,
revised
the
filing
period
for
judicial
candidates
to
match
the
filing
period
for
non-judicial
candidates.

for
the
2022
elections,
all
candidates
would
have
a
filing
period
that
begins
on
the
first
monday
in
march
and
ends
on
the
second
friday
after
the
first
monday
in
march.

to
remember
where
the
second
and
the
first
fell
in
that
sentence.
Section
14
of
this
bill,
specifically
subsection
4,
is
the
effective
date
provision
that
limits
this
change
to
apply
only
for
the
2022
round
of
elections.
So
this
would
be
a
one-time
change
in
this
filing
period.

washoe
county.
We
are
here
in
support
of
sections
6
through
8
and
14,
as
mentioned
by
mr
killian,
for
the
changing
of
the
judicial
filings.
The
reason
we're
asking
for
this
is
due
to
covet
19
and
the
delayed
census
and
redistricting
data.
This
would
result
in
our
election
staff
having
to
stop
the
process
of
redistricting
to
open
up
judicial
candidate
filing
and
then
go
back
to
that
after
that
filing
period.

with
this
one
time,
change
it'll
allow
us
to
complete
the
entirety
of
the
redistricting
and
then
do
all
filings
at
one
time.
So
we
agree
that
this
only
needs
to
happen
one
time
in
this
very
specific
circumstance,
but
it
would
be
of
great
assistance
to
our
staff
to
really
be
able
to
finish
redistricting
before
we
start
candidate
filing.

speaking
on
behalf
of
the
rural
clerks,
just
echoing
what
ms
rodriguez
from
washoe
county
said.
We
just
appreciate
the
flexibility,
understanding,
the
delay
and
understanding
the
need
for
it
and
we're
in
support
of
the
measure
as
well.

hoping
for
your
support
in
with
this
piece
of
the
bill,
I
would
ditto
exactly
what

mentioned

washoe
county
being
with
the
delay
and
the
information
being
provided
from
the
census
bureau.

There's
a
tremendous
amount
of
work
that
needs
to
go
into
redefining
all
of
the
districts
and
defining
the
new
precincts
that
need
to
be
put
into
place
for
all
of
the
districts
and
the
increased
timeline
will
ensure
that
we
can
complete
that
work
before
the
combined
judicial
filing
and
non-judicial
filing
in
march.
Having
to
stop
that
work
to
carry
out
judicial
filing
in
january
would
be
a
scenario
that
we
would
very
much
like
to
avoid,
and
so
I'm
hoping
that
we
can
get
your
support.
I
I
Just
by
way
of
background
near
the
end
of
last
session.
At
the
suggestion
of
speaker,
fryerson
chief
justice,
hardesty
and
I
met
with
registrars,
and
we
talked
through
these
changes
and
understand
the
need
for
them
specifically
related
to
concerns
associated
with
timing
and
staffing.
Given
the
lateness
of
the
census
data,
we
reached
an
accommodation
that
resulted
in
a
one-time
change
to
the
filing
period
and
one
the
court
felt
was
fair,
and
these
changes,
as
mr
killian
pointed
out,
are
in
sections
six,
seven,
eight
and
fourteen.
I
It
just
so
happened
that
the
proposed
changes
for
2022
is
good
timing,
because
it's
a
small
year
in
terms
of
total
judicial
seats
up
for
election
in
2022,
there
are
only
18
justice
court
and
municipal
court
seats,
one
district
court,
three
appeals
court
and
two
supreme
court
seats
up
in
22
and
by
contrast
in
2024,
there
will
be
90
district
court
seats
up
alone.
So,
as
you'll
note
in
section
14
of
ab1,
the
filing
period
changes
expires
on
december
31
so
beginning
in
2024.
I
The
filing
period
for
judicial
candidates
will
revert
back
to
the
first
two
weeks
in
january,
in
a
manner
similar
to
the
code
requirement
for
the
past
14
years.
For
the
legislative
record,
I'd
like
to
take
a
moment
to
briefly
highlight
why
judges
and
justices
are
treated
differently
than
non-judicial
candidates
in
terms
of
filing
requirements.
I
I
The
supreme
court
code
of
conduct
established
the
judges
and
justices
cannot
solicit
or
accept
campaign
con
funds
unless
they
face
an
opponent
prior
to
the
adoption
of
this
rule.
As
many
as
65
percent
of
the
judicial
seats
in
nevada
went
unopposed.
Yet
those
candidates
and
judges
continue
to
solicit
and
accept
campaign
funds
throughout
the
entire
campaign
period
when
ab1
is
signed
into
law,
and
it
includes
the
one-time
change
of
filing
dates,
it's
felt
the
judicial
candidates
in
2022
could
be
unfairly
burdened
in
their
ability
to
engage
in
campaign
financing.
I
Therefore,
chief
justice
hardesty
will
convene
a
meeting
of
the
nevada
supreme
court
on
november
18th
to
consider
amending
nevada
code
of
judicial
conduct,
allowing
for
a
one-time
modification
to
the
fundraising
rule
and
to
address
the
issue
of
when
judicial
candidates
can
solicit
and
accept
funds
during
the
2022
delayed
filing
period
as
proposed.
The
code
change
will
allow
candidates
for
judicial
office
to
begin
fundraising
on
january
15
2022
through
the
close
of
filing,
as
was
pointed
out
on
march
17th
2022.
However,
if
a
candidate
for
traditional
mr
ferrari,
