I
am

present
assembly
bill
130..

I
will
walk
through
the
bill
itself
and
I'll
walk
you
line
by
line
through
the
bill
language,
to
explain
how
I
believe
we're
addressing
that
concern
and
then,
lastly,
I'm
going
to
discuss
the
amendment,
because,
where
the
conversation
started
with
this
bill,
which
was
a
much
broader,
much
more
encompassing
bill,
and
now
it
is
a
much
smaller
fix.

with
that.
Madam
chair
I'd
like
to
first
talk
about
medical
pay
and
I'm
going
to
be
referring
to
it,
as
the
industry
often
does
as
medipai
and
just
to
put
meta
pay
into
context.
I
I
think
an
easy
way
of
explaining
it
is
liability,
doesn't
trigger
or
doesn't
come
into
this
conversation.
In
other
words,
the
alpha
driver
is
not
a
topic
to
be
discussed.

The
way
metapay
would
work.
If
you
have
it
is
medipaint
comes
in,
and
it's
the
first
party
payment
for
reasonable
and
necessary
medical
expenses,
and
what
that
means
is
it
doesn't
matter
that
you
were
the
one
who
collided
into
the
vehicle
in
front
of
you
or
even
if
you
ran
into
a
poll
or
something
like
that,
metaphase
would
trigger.

If
you
have
it
and
presently
under
nrs,
and
I'm
just
going
to
go
into
the
statute
very
quickly
nrs687b.145,
there
is
a
requirement
that
a
a
insurance
company
offer,
in
the
amount
of
at
least
up
to
a
thousand
dollars
for
payment
of
reasonable,
necessary
medical
expenses.

However,
the
issue
that
I've
identified
and
that
we're
trying
to
fix
today
is
that,
particularly
in
statute
there's
a
reference
to
a
passenger
car,
so
if,
in
that
same
exact
hypothetical,
instead
of
driving
a
minivan
in
that
icy
road,
I
was
driving
a
motorcycle
and
I
ran
into
a
vehicle
and
again
incurred
some
damages
that
involved,
maybe
an
ambulance
showing
up
and
me
being
having
to
be
transported
to
a
hospital.

It's
not
necessary
that
they
that
the
insurance
company
have
to
provide
me
the
insurer,
the
option
of
purchasing
medpay
of
at
least
a
thousand
dollars
per
how
the
nrs
is
written
presently.
So
what
I
seek
to
do
with
this
bill
now
is
simply
expanding
the
nrs
so
that,
rather
than
just
reading
passenger
car,
we
also
put
motorcycle
and
that
it'd
be
offered
medical
pay
just
to
put
into
context
of
what
it
covers
again.

It
doesn't
matter
if
you
were
at
fault
and
typically
you
could
use
it
to
cover
something
like
ambulance,
expenses,
professional
nursing
services,
surgery,
x-rays,
doctor
visits,
etc.
So
that's
kind
of
what
you
would
want
that
for
a
lot
of
people
opt
out
as
the
nrs
is
written
now
it
has
to
be
offered,
but
you
can
sign
a
document,
that's
approved
by
the
commissioner
and
then
you
could
waive
medpay.

So
I
want
to
walk
you
through
the
bill
because
there's
changes
that
I'm
doing
to
the
bill.
A
lot
of
the
conversation
prior
to
today
has
been
around
the
conversation
of
usual
and
customary
charges
that
I
had.
So
if
I
can
walk
you
through
the
bill
and
I'm
going
off
of
what's
on
nellis
here,
you
go
to
page
two.
Excuse
me
page
three
line:
eleven,
that's
referring
to
section
one
subsection
three
in
line
eleven
you'll
see
that
we're
adding
the
language
of
motorcycle.

Again,
as
I
previously
mentioned,
it
was
just
passenger
car
and
we
want
to
make
sure
that
it
encapsulates
motorcycles
well
that
they
have
to
opt
for
that
offer
that
option
of
purchasing
coverage
in
the
amount
of
at
least
a
thousand
now
other
folk
may
choose
to
purchase
more,
but
we
want
to
make
sure
that
we
extend
them.
Now
we
go
to
lines

through
25.
On
that
same
page,
three,
I'm
going
to
be
removing
that
in
that
entire
language.

intend

tackle
this
conversation
in
the
interim,
so
I
will
work
on
it
with
a
coalition
of
folk
of
stakeholders
and
come

years

try
to
resolve
this
concern
that
I
have.
But
again
I
don't

muddy

record,
so
I
don't
want
to
get
into
the
issues
we
were
trying
to
fix
there.
I
would
do
that
in
a
separate
bill
in
two
years.

down

bill

go

there
is
a
definition
of
health
care
services
in
lines,
one
and
two,
and
then
there
is
line
seven
and
eight
that
talks
about
provider
of
healthcare
in
blue.
That
is
also
no
longer
necessary,
since
I'm
not
tackling
that
question
anymore
and
that
will
be
removed
from
this
bill
and
then,
lastly,
in
that
same
page,
four
you'll
see
lines
12
through
18,
where
there
is
a
definition
of
usual
and
customary
charges
again
that
will
be
removed
and
is
no
longer
part
of
this
bill.

this
bill
is
now
seeking
to
do
is
ensuring
that
medpay
is
offered
to
an
insurer
who
rides
a
motorcycle
when
they
go
in
and
try
to
purchase
a
policy
for
their
motorcycle
and
that
it
needs
to
be
offered
of
at
least
of
a
thousand
dollars.

vehicles

this
is
assembly
of
negative
floors
for
the

The

answer
is:
yes,
it
does
most
most
passenger
vehicles,
so
that
would
include
trucks,
sedans,
etc.
They're
all
covered
under
that
definition,
just
inadvertently
motorcycles
had
not
been
covered.
I
will
say
that
I've
had
an
opportunity
to
speak
with
the
commission
with
commissioner
richardson,
and
I
do
know
that
a
lot
of
insurance
companies
now,
particularly
our
larger
insurance
companies
in
the
state
of
nevada,
do
offer
medipay
for
motorcycles
there.
It's
a
de
facto
practice.

However,
the
concern
is
that
not
all
insurance
companies
have
to
do
it
and
the
reason
this
is
relevant
and
why
you
you
want
it
to
be
offered,
say
you're
involved
in
a
in
a
an
accident,
and
you
want
to
use
medpay,
but
it
was
never
offered
to
you.

So
if
I
could
go
to
a
different
hypothetical-
and
let's
say
you
have
an
an
attorney
involved
in
a
claim
and
you're
trying
to
collect
x,
y
and
z,
if
you
don't
offer
med
pay
and
there's
usually
a
waiver,
that's
signed
so
say
I
go
to
farmers
insurance
and
I
tell
them
I'd
like
to
as
an
I
want
to
be
insured
under
xyz
policy.
I
drive
a
motorcycle.
I
want
to
ensure
that,
and
I
also
want
to
have
med
pay
for
it.

I
asked
for
it
then
great,
but
you
know
if
they
offer
it
great
I'll,
have
that
option
of
purchasing
it,
but
there's
some
insurance
companies
that
may
not
be
offering
it
now
and
number
one.
We
want
to
make
sure
that
we're
protecting
those
motorcycles
that
want
to
have
it
and
number
two.

If
there
is
a
lawsuit
involved
and
it's
later
found
out
that
the
insurance
company
never
offered
the
insured
the
option
of
purchasing
medpay,
then
there's
automatically
a
thousand
dollars
that
has
to
be
available
towards
that
claim,
and
so
that's
why
it's
it's
relevant
and
important.
Usually,
insurance
company
will
keep
that
form
where
you
waived
it
at
the
beginning.

Again,
it's
an
option
that
has
to
be
offered
to
you,
but
you
don't
have
to
purchase
it
but
it,
but
if
you're
a
motorcyclist,
that
option
may
have
never
even
been
offered
to
you
and
down
the
road.
You
want
to
have
that
added
protection
where
your
the
insurance
company
will
be
on
the
hook
for
at
least
a
thousand
dollars
for
having
failed
to
do
that.

just

ride
motorcycles
and
used
to
instruct
motorcycle
safety
courses
so,
and
I
thought
it
was
already
practice,
so
I
thank

bringing
this
forward
and
coding
it

statutes

a
a
very
good
piece

legislation

my
question
basically
is:
was
there
a
reason
like
motorcycles
were
never
included
to
begin
with
just

oversight
or
we
don't
know,
but
I
think
it's
a
good
idea
that
we
include
them.

back

20
years

trying

figure
out
where

conversation

accidentally

escaped
motorcycles,

unable

successfully
find
the
minutes
on
why
it
was
done
in
that
manner.

know
that
other
states
don't
offer
it
for
motorcycles.

be
a
conversation

had
directly
with
the
insurance
companies,
but
I
don't
know
the
exact
reason.
Understandably,
we
we
know
that
this
type
of
protection
is
very
important,
and
so
we
just
wanted
to
make
sure
that
we
were
extending
it
to
our
motorcycle
drivers.

reason
that
this
is
important
is
medpay
is
often
the
first
line
of
defense
for
hospitals
and
catastrophe
cases
to
get
paid
for
co-pays
and
deductibles
that
may
arise
and
may
not
be
covered
by
health
insurance,
and
obviously
we
know
that
when
people
on
motorcycles
are
involved
in
accidents,
it
can
often
be
catastrophic
and
it's
important
for
those
motorcyclists
to
not
come
out
of
the
hospital
with
collection
actions
against
them.
If
they
elect
to
use
medpay
to
cover
themselves,
we
think
it's
good
policy
all
around.
