this

first
time
we've

we're
gonna
go

hearing

bill
258
good

welcome
to
both
of

I
had

distinct
pleasure
of
serving
on
the
las
vegas
clark
county
library,
district
board
of
trustees
for
over
10
years
until
my
term
just
expired
in
february
of
this
year.
During
that
time,
I
took
part
in
the
hiring
process
of
two
executive
directors,
as
well
as
our
most
recent
director
of
human
resources.

The
district
serves
1.7
million
people
over
8
000
square
miles
larger
than
the
state
of
connecticut.
Many
of
the
branches
have
art
galleries,
as
well
as
performing
arts
centers.
As
the
las
vegas
clark
county
library,
district
has
grown
exponentially
over
the
years.
Unique
needs
and
challenges
have
come,
and
the
nevada
vice
statute
and
corresponding
nac
codes
need
to
reflect
those
changes.
The
executive
director
manages
so
much
more
than
library
operations.

Their
duties
include
supervision
of
hr.
I
t
finance
legal
issues,
marketing
development
planning
facilities,
community
engagement
and
that's
just
to
name
a
few
assembly
bill.

does
two
main
things
for
the
consolidated
library
district
that
serves
over
1
million
people,
which
is
clark
county,
las
vegas
library.

is

both
both

like
to
say
a
few
words
to
complement,
shannon
bilberry
axelrod's
introduction.
So
first
things.
First,
we
have

We
also
have

participants.

branch
visits
we
currently
have
eighteen

and

one
programs
operating.
We
have
over
one
million

hundred
fifty
seven

and

computer
sessions,
and
we
had
over
19
million

As
you
can
see,
the
library
has
grown
over
the
years
and
then
the
challenges
are
unique
to
the
library
district.
We're
a
top-tier
one
library
district,
and
the
reason
that
we
ask
for
both
of
these
items
is
that,
as
far
as
a
trustee
selecting
a
director,
we
want
to
expand
the
pool
of
applicants
right
now
by
keeping
it
to
an
mlis.
It's
limiting.

So,
in
our
view,
it's
better
to
expand
the
applicants
and
then
ask
them
to
go:
learn
the
tools
of
the
trade,
because
in
library,
there's
construction
planning,
building
and
a
lot
of
ancillary
items
that
are
critical,
that
a
lot
of
mlis
individuals
may
not
have
had
the
experience
of,
and
so
that's
the
first
part.
We
would
ask
for
approval
of
that
item.
It
does
not
impact
any
library
under
with
a
population
of
a
million
or
less.

It's
now
gone
to
71
million,
but
I
firmly
believe
that
we're
gonna
go
back
to
that
amount
of
money.
That's
a
lot
of
money
and
so
there's
a
lot
of
moving
parts.

We
currently
pay
bdo
a
big
accounting
firm
to
do
our
overall
audit
that
provides
the
information
to
us
and
then
to
the
legislative
council
bureau
and
then
the
legislature
into
the
cities
and
the
counties
and
theirs
is
a
financial
lot.
What
we're
looking
is
for
an
internal
auditor
that
can
do
performance
audits,
performance
audits,
real
quick.

board

daughter

actually
both

parents
were
librarians
at
one
point

another
in
their
life,

it's
always
fabulous
to
have
an
opportunity
to
celebrate
our
libraries.

an

so
I
just
wanted
to
see.

this
already
something
that
is
a
possibility
and
it
is
just
simply
solidifying
it
in
law,
or
has
there
been
some
changes
over
the
last
times

where
this
became
a
necessity.

know
that

certain
departments
are
going
to
be
audited,
so
they
can
prepare
for
those
audits,
as
opposed
to
being
selecting
a
an
auditor
that
stops
for
bed,
and
then
they
don't
know
who's
going
to

audited,

facilitates
it
faster
makes
it
easier
and
removes
a
lot
of
stress
from
the
employees
and
the
other
departments
that
will
be
in
there
for
the
audit.

questions
here
in
the
bill.

It
appears
to
narrowly
list
qualifications
for
the
executive
director
obtaining
an
a
mls
mlis
and,
as
I
was
reading,
I
was
wondering
if
we
are
narrowly
looking
at
qualifications
of
an
executive
director
and
not
considering
those
that
have
had
older
degrees
like
an
mls
and
msls.

I

know
that
is
basically
my
question.
I
just
want
to
make
sure
that
you're
not
narrowly
considering
the
qualifications
of
others
that
may
be
able
to
perform
this
duty.

that
the
language

permissive
actually
expands
that
we
do
recognize
that
having.

professional
background
in
libraries
is
obviously
helpful,
but

size

scope
of
this
job,
it

really
more
like
a
ceo
type
position,
and
so
we,
while
we
we
find
that
the
mls,
the
other
degrees
viable
and
helpful.

just
really
want
to
give
the
option
to
open
up
the
field
even
more,
and
to
that
end

actually
ask
if
our
executive
director,
mr
watson,

speak
on
his
experience
in
the
hiring
he's
worked
in
several
different
library
districts,

recently
in
florida,
but
he
was
in
queens
before
so.

20
years
of
experience
in
both
libraries

undergraduate
degree
in

also
was
a

former
military
officer

working
for

sold
materials
to
libraries
as
well
as
I
have
retail
experience.

then
I
have
also
worked

actually

say
that
the
roles
and
responsibilities
of
leading
large
library
systems
that
you
that
you
would
want
to
look
at
expanding
the
educational
requirements

or
the
skills
that
that
an
individual
may
have,

I'm
also
currently
pursuing
my
mba
as
well.

auditor

perform

each
library,
and
I
understand

I

want

know.
What's
the
qualifications
for
that
internal
audio.

qualifications
are.
They
have
to
have
a
cpa
knowledge
of
general
accounting,
government,
accounting
practices
and
clearly
we'd
like
them
to
understand

process
for
which
the
state
of
nevada
and
the
legislative
council
bureau
requires
audits
under
the
nrs.

doesn't
mean
they
have
to
have
all
of
that,
but
if
they
don't
have
it,
they'll
have
to
learn
it
so
cpa,
the
knowledge
of
the
government,
accounting
practices
and,
hopefully,
knowledge
of
how
they
submit
audits
to

legislature,
because,
ultimately,
we're
creatures
of
the
state,
and
so
we
need
to
be
accountable
to
them.
If
they
don't
have
that,
they'll
have
to
come
up
to
speed
very
quickly.

library
system

clark
county.
It's
amazing.
I
was
very
surprised
at
how
big
it
is,
but
I
also
like
the
fact
that
you're,
a
fiscal
conservative
and
that
you
care
about
making
sure
that
the
money
is
spent
where
it
where
it's
supposed
to
be.
But
I
was
just
curious,
I
don't
see
a
fiscal
note.
So
would
this
position
be
paid
for
out
of
your
budget.

quick,
I
am
a
fiscal
conservative.
In
my
past
life
I
was
a
federal
probation
and
parole
officer,
and
we
saw
too
many
cases
of
government
employees
taking
government
money.

record
is
clear:
it's
I
don't
need
to
even
go
into
that,
and
so
that
doesn't
mean
that's
happening
here.
It's
important
that
we
know
that
our
services
are
being
performed
as
as
committed
to
and
that
the
money
is
spent
accordingly,
two
plus
two
always
equals
four,
and
so
the
final
answer
is
yes.

think
libraries
are
an
integral
part
of
our
community
and
I
think
that
it
helps
to
get
our
students
where
they
need
to
be
when
we're
looking
at
the
education
system,
but
that
they're
also
playing
a
positive
role
for
other
nevadans
as
well.
So
I
just
want
to
understand
a
little
bit
more
about
why
this
pop
cap
is
put
into
place.
This
seems
really
reasonable
for
all
libraries,
and
so
I'm
just
wondering
why
it's
only
applicable
to
this
type
of
library.

as

mentioned
in
my
early
testimony,
we
are
the
11th
largest
library
district
in
the
nation,
and
so
with
that
we
have
very
unique
issues
that
happen
and,
like
I
said
you,
we
kind
of
have
to
run
our
library
board
sort
of
more
like
a
business
like
it's
a
ceo
type
role.
Other
library
districts
are
not
that
large.
It's
as
I
mentioned
executive
director
watson
worked
in
queens.

I
you
can
say
how
many
libraries
are
in
that
this
is
just
a
very,
very
large
library
system
and
you
don't
typically
see
that
we
are
literally
on
the
likes
of
with
los
angeles
chicago,
just
very,
very
large.
So
that's
that's
why
we
thought
it
was
important
and-
and
you
know,
chair
ortiz
mentioned
that
at
some
point
washoe
might
get
there.
I
think
that's
going
to
be
a
long
time
coming,
but
the
language
is
also
permissive
right.

And-
and
I
appreciate
that-
and
I
think
it's
because
the
language
is
permissive-
that
I'm
wondering
if
it
doesn't
make
more
sense
that
we
do
that
now,
so
that
as
these
districts
as
a
as
these
library,
districts
want
to
have
these
opportunities
that
they
would
be
able
to
do
so,
and
we
wouldn't
have
to
revisit
this
legislation.
Did
they
ask
not
to
be
included
in
this
in
this
specific
legislation,
or
was
that
not
a
conversation
that
we
had
with
them?

just
wondering
it,
since
it
is
permissive.

board

trustees
are
made
up
of
board
members

appointed

both
county
commission

city
councilmen.
So
we
are
currently
both
las
vegas
clark,
county
and
clark
county
library
district.

clark
county
library
district
is
its
own
tax
and
authority,
and
so
we
became
a
consolidated
district
and
I
want
to
say
it's:
it
might
have
been
89

92.

not
sure
at
this
point,
but
I
92
sounds
like
it
clings
to
my
mind,
and
so
they
created
a
consolidated
district
allowed
us
to
do
a
for
populations
over
a
certain
amount.
I
want
to
say
it
was
600
000
at
the
time,
if
you
read
the
nrs
and
then
they
allowed
us
to
be
our
own
taxing
district.

So

can
see
it
runs
like
a
small
city
if
you
will
and
that's
why
the
need
to
have
a
ceo
type
individual
with
knowledge

libraries
and
also
need
to
have

with
us

that
we
can
move
forward

houses
being
built
in
clark
county
we're
going
to
get
larger.

libraries
owned

the
county
are
operated

the
county,

district
of
zone
on

valorem.

be
a
change
or
something
that's
already
in
place,
so
it
looks
like
it
is.

wonder

our
library
districts

of
not
under
the
purview
of
the
county
and
everything.

legislative
training

maybe
next

we
just
have

thinking
about
how
our
libraries
are.

they?

they

county

Are
they

the
city?
How
exactly
are
they
funded
because
it
sounds
like
clark?
County
is
funded
in
a
very
specific
fashion,
due
to
the
size
that
they
are,
but
it
might
be
different
in
washington.

administrator
of
the
nevada
state
library,
age,
archives
and
public
records,
I
am
deeply
familiar
with
the
way
that
chapter
379
of
the
nrs
and
the
administrative
code
speak
to
this
question.

In
the
letter
from
the
nevada
library
association,
I
addressed
that
that
it
would
seem
that
the
proposed
amendment
were
opening
up.
The
qualifications
of
the
of
the
director
is
unnecessary
because
it's
already
contemplated
and
it's
something
that
the
legislature
has
already
moved
in
the
past
and
written
into
the
code
and
that
that
specifically
enables
it
so
that
any
board
each
board
of
of
libraries
around
the
state,
whether
they're
in
a
separate
district
or
in
a
municipality
or
a
county,
is
already
authorized
to
hire
someone
with
or
without
the
credentials
of
masters
of
library.

The
system
that
the
legislature
has
already
put
in
place
is
one
in
which
the
state
library,
the
administrator
of
the
state
library
agency,
in
conjunction
with
nevada,
revised
statutes,
chapter
379
and
the
administrative
code
is
able
to
is
able
to
issue
a
waiver
to
the
the
library
itself
on
a
year-by-year
basis
to
encourage
the
board
and
the
library
to
get
that
director
up
to
speed
in
terms
of
their
credentialing.

As
far
as
the
library
is
concerned,
if
they
never
do
achieve
that
credentialing,
the
only
way
that
that
would
impact
is,
should
the
administ
state
library
agency
decide
that
the
waiver
is
no
longer
appropriate
and
need
to
revoke
that,
meaning
that
the
district
would
no
longer
have
access
to
the
federal
monies
again.
The
reason
why
the
minimum
public
library
standards
are
put
in
place
is
to
ensure
that
the
state
has
access
to
those
millions
of
dollars
each
year.

district
in
the
state.

every
other
library
is

run

the
city
or
the
county,
but
don't

percent
quote
me
on
that.
I'm
just
I'm
about
90
percent
sure
the
waiver
is
not
the
same
as
a
board
power
to
hire
to
speak
to
the
the
neutral
testimony.

is
really
just
you

We
just
really
need
to
set
this
out
in
nrs
and
nac,
and
I
think
this
is
the
vehicle
to
do
it.
Just
so,
there's
not
it's
on
the
record,
it's
clear
and
we

talk
about
eric
scott
on
7
10
2010.
Eric
scott
was
shot,
leaving
a
cross
codes
in
las
vegas
by
lvmpd
officer,
william
mosher,
who
fired
two
rounds
in
joshua,
stark
and
thomas
mendiola,
who
also
fired
hitting
eric
seven
times
literally,
a
costco
loss
prevention
supervisor
claimed
eric
had
a
gun
in
his
waistband
and
costco.

weapons

said

remove

gun
from
his
waistband.

handgun
was
later
found
still
in
its
holster
mosher
testified.
He
didn't
recall
ordering
eric,
who
is
now
outside
the
store
and
would
have
been
within
his
constitutional
rights.
According
to
your
state's
second
amendment,
laws
to
drop
the
gun,
but
a
9-1-1
recording
recorded
that
that
command
was
given
to
eric
by
marsha.
In
truth,
eric
was
legally
walking
out
of
costco.
That
day
he
wasn't
posing
a
threat
to
anybody.

didn't
make
any
aggressive
movements.
In
fact,
moshe
instructed
eric
to
drop
the
gun.
Eric
was
surrounded
by
three
officers.
He
turned
around.
He
was
compliant,
he
was
told
to
drop
the
gun
and
he
did
exactly
that
and
was
executed
for
it.

was
the
second
community
member
killed
by
marsha
eric
scott,
like
my
brother,
thomas
was
38
years
old
and
I'd
like
to
tell
you
a
little
bit
more
about
eric
as
a
human
being
all
these
loved
ones.

He
subsequently
served
as
an
m1a1
tank
platoon
leader
with
the
first
cavalry.
He
left
active
duty
during
the
post
military
drawdown
and
embarked
on
a
successful
career
in
medical
and
real
estate
sales
and
was
transferred
to
las
vegas
in
1999,
while
working
full
time
he
attained
a
master's
degree
in
business
administration
from
duke
business
school
then
branched
into
real
estate.
Eric
was
the
sales
director
and
involved
in
a
major
project
in
las
vegas.
He
is
loved
and
missed
by
his
parents,
bill
and
linda
scott
and
his
brother,
kevin
scott,
and
so
many
others.
