360
for
your
consideration.

to
note
that,
be
speaking,
the
measures
in
the
amendment-
and
I
hope
all
of
you
have
had
a
chance.
I
know
I
delivered
a
copy
of
the
amendment
to
you,
and
anybody
watching
virtually
it
has
been
upload,
has
been
uploaded
to
nellis,
and
the
amendment
appears
on
my
letterhead
dated
march
26
2021,
and
that
amendment
would
require
retailers
to
utilize
an
advanced
age,
verification
technology
at
the
point
of
sale
for
each
tobacco
and
vapor
product
purchased,
to
ensure
that
the
purchaser
is
at
least
of
the
age
of
21
years.

This
amendment
is
meant
to
completely
replace
the
contents
of
the
current
language.
A
little
bit
of
background
information.
Before
I
begin,
the
purpose
of
the
bill
is
really
twofold:
one.
It
is
to
keep
tobacco
and
vapor
products
out
of
the
hands
of
the
underage
youth
and
two
is
to
increase
nevada's
compliance
rate,
so
we
can
maximize
and
not
jeopardize
our
federal
block,
grant
funding
that
is
available
to
enact
nevada
according
to
the
cdc.
E
E
Every
single
day,
e-cigarettes
commonly
known
as
vape
products,
have
been
the
most
used
product
among
youth
since
2014.
E
Fortunately,
the
use
of
these
products
has
actually
dropped
since
2019,
and
I
have
to
thank
senator
ratty
and
her
efforts
in
this
she's
really
taken
the
lead
and
in
her
bill
last
legislative
session.
Sb
263
has
really
seen,
in
my
personal
opinion,
the
reduction
in
the
state
of
nevada,
which
has
been
important.
Currently
the
federal
standard
is
that
a
we
cannot
have
a
violation
rate
of
no
more
than
20
percent.
E
In
2018
there
were
months
where
we
saw
as
high
as
almost
30
percent
violations,
which
is
a
pretty
big
impact
for
the
state
of
nevada,
because
the
way
that
the
federal
grant
money
works
is
they
can
penalize
us
for
every
percent
over.
We
would
get
penalized.
A
percent
of
the
federal
money
and
a
10
overage
in
the
violation
rate
could
result
in
a
penalty
as
high
as
16
million
dollars
and
that
into
the
washoe
county
health
district.
So
I
do
want
to
thank
them
for
that
information
as
well.

So
part
of
the
also
part
of
the
decreased
use
has
been
the
awareness
of
the
products
and
the
the
the
effects
on
health,
but
even
with
this
truck
in
use
about
one
in
every
20
medical
middle
school
students
reported
in
2020
that
they
used
an
e-cigarette
in
the
past
30
days
and
about
one
in
five
high
school
students
reported
in
2020
that
they
used
e-cigarettes
in
the
past
30
days.

This
is,
in
my
opinion,
still
a
significant
problem
and
that's
why
I
have
brought
forward
this
bill.
As
you
all
know,
the
federal
government
has
raised
the
minimum
age
to
21
from
18.
E
that
is
being
addressed
in
a
separate
bill,
but
it
is
now
illegal
for
retailers
to
sell
any
tobacco
products
to
anyone
under
the
age
of
21
and
a
lot
of
the
retailers
have
already
implemented
similar
technology
that
is
in
this
build.
That
would
then
be
required
to
all
of
them,
which
I
will
touch
on.
So
what
is
an
advanced
age
verification
technology?
E
This
is
simply
just
an
identification
card
scanning
tool
that
pulls
the
limit
information
from
a
photo
id
to
automatically
verify
and
validate
both
the
age
of
the
purchaser
and
the
validity
of
the
id
to
implement
this
retailers
only
need
a
2d
barcam
scooter
scanner
that
can
be
used
to
scan
the
back
of
the
id,
and
there
are
a
couple
of
other
technologies
out
there
that
do
this
as
well.
But
the
most
common
is
the
2d
bar
scanner
that
the
majority
of
these
retail
locations
already
utilized.

So
I
do
want
to
touch
on
the
the
language
in
the
amendment
with
the
the
first
part
of
the
amendment
basically
replaces
all
the
language
and
and
replaces
it
with
the
advanced
age,
verification
technology
at
the
point
of
sale
for
every
tobacco
and
vapor
product
to
ensure
that
the
purchaser
is
at
least
21
years
of
age.

The
as
you
can
see
in
the
amendment,
this
gives
some
new
teeth
and
a
series
of
civil
penalties
to
provide
a
first,
second,
third
and
subsequent
offenses,
and
for
both
the
individuals
and
the
licensee
and
I'd
have
heard
back
from
a
number
of
interested
parties
on
those
violations
and
and
why
those
are
there.
And
so
I
just
wanted
to
address
that
right
off
the
bat
in
working
with
the
attorney
general's
office.

In
the
interim
on
this
bill,
it
was
recommended
that
without
some
sort
of
teeth
or
penalties
that
this
bill
would
be
really
hard
for
them
to
enforce,
and
therefore
they
recommended
that
I
I
established
some
civil
penalties
and
the
easiest
thing
for
us
is
to
adopt
what's
currently
in
statute
under
nrs
370
and,
as
I
mentioned
earlier,
the
efforts
by
senator
ratty
under
senate
bill
263
last
legislative
session
implemented
the
teeth
and
the
penalty
structure
that
is
actually
listed
in
the
conceptual
amendment
that
you
have
here.

I
didn't
see
a
reason
to
reinvent
the
wheel,
the
numbers
that
we've
actually
seen
since
the
implementation
of
sb203
have
actually
been
pretty
pretty
good
results.
We
went
from
in
2019
some
months
bumping
up
against
the
30
percent
violation
rate
to
to
really
getting
back
more
towards
our
our
historic
average
of
approximately
13
percent.

However,
that
13
is
is,
is
too
high.
We
are
still
above
the
national
average,
which
is
approximately
10
percent,
and
I
think
that
everybody's
goal
at
the
end
of
the
day,
is
to
ensure
that
our
youths
are
not
gaining
access
to
tobacco
products
and
getting
hooked
on
tobacco.
At
a
young
age,
and
so
that's
where
I
came
in
with
with
this
language
in
madame
chair,
I
really
appreciate
the
time
today.

think
that
the
amendment
in
ab360
is
the
moving
in
the
right
direction
to
ensuring
that
our
youths
and
teenagers
are
not
using
tobacco
and
at
least
not
being
able
to
purchase
it.

that

adopted

the

discussion
as
well
about
shortening
the
amount
of
time
for
the
retailers
and
keeping
that
awareness
and
I'm
sure
there
will
be
further
discussion
about
that.

mention
that
some
of
the
outlets
already
have
these
card
scanning
tools.

They
can
purchase
the
2d
bar
scanners
themselves,
which
run
between
100
and
200
a
piece
and
then
the
the
really
old-fashioned
retail
stores
that
are,
you
know
mainly
using
a
cash-based
system
and
a
cash
register
drawer
and
haven't
moved
digitally,
which
I
will
say
I
was
guilty
of
until
just
a
couple
years
back.

Those
systems
can
run
upwards
around
two
thousand
dollars,
but
again
the
basic
system
scanners
to
200
dollars.

The
the
reason
for
the
length
of
time
is
for
those
individuals
that
I
just
mentioned
that
are
still
on
a
cash
basis
that
don't
have
the
2d
bar
scanners
and
the
the
point-of-sale
equipment
enough
time
to
research,
the
different
options
that
they
have
available
to
themselves,
go
out
to
bed
and
and
then
acquire
and
install
the
the
systems
and
softwares
I
reached
out
to
a
few
of
the
convenience
store
owners
that
I
know
in
the
southern
nevada
area,
and
in
talking
to
them
they
felt
that
they
could.

know
the
process
should
take
about
12
months
to
have
everything
up
and
running
and
all
the
bugs
and
kinks
and
everything
out
of
place
being
that
we're
living
in
a
coveted
world
and
hopefully
getting
out
of
it
very
very
soon.

a
little
bit
of
a
buffer
of
an
additional
six
months
being
that
we
we
end
the
session
may
31st.

schoolers
and
high
schoolers,
where
they
were
getting

product.

consolidated
appropriations
act
of
2021,
which
included
the
preventing
online
sales

e-cigarettes
to
children
act,

that

intended

exactly

just
asked

put
safeguards
in
place

mail-order
e-tobacco
products,
and
and
and
prevent
them
from
getting
into
the
hands
of
miners,

and

believe
that
the
that
federal
act

address
that
it

currently

the
rulemaking
process,

they
took
their
last
public
comments
on
march
20th.

technologies,

recognizing
that
there
are
still
existing
technologies

achieve
the
same
goal
of
reducing
underage
sale

tobacco
products
and
vape
products.
It's

simple.
It's
a
tool,
our
members
support
technology
and,
as
was
stated
by
the
build
sponsor
many
of
convenience
store.

Businesses
currently
use
some
form
of
electronic
age
verification,
as
opposed
to
the
old
paper
calendar,
some
type
of
prompt
for
the
frontline
workers
technology
uses
at
the
is
called
the
pos
or
the
point-of-sale
test
register.
If
you
will
so,
these
tools
really
are
necessary
to
help
consistently
stop
underage
sales.

provides
tools,
it's

tool
for,
in
my
case,
our
members
are
convenience
stores
and
it
simply
provides
a
dependable,
reliable
tool

front-line
worker
to
judge

age

verification,

even
more
suspect

look
at
a
person
and
determine
their

like

completely
free

cost

operates

smartphone,

there
is
no
cost

a
retailer
to
participate
should
they
want
to.
Additionally,
there

no
majorly
used
solution
on
the
market
that
allows
a
clerk
to
manually
enter
an
age.
The
whole
purpose
of
these
software
is
that
you
have
to
swipe
a
government
or
some
other
government
compliant
id.

university,
ids
I'd
have
to
double
check
with
our
membership,
but
I
do
not
believe
any
in
nevada
currently
do
that.
Finally,
when
talking
about
online
sales,
federal
law
already
requires
this
type
of
software
for
online
verification.

heard
just
recently
in
addition
to
t21,
also
brings
or
gives
nevada
the
authority
to
enforce
similar
rules
for
online
verification
to
what
we're
discussing
in
person
here.
So
after
answering
those
questions
with
the
remaining
time,
I

the
nevada.

Vaping
association
is
very
excited
to
support
this
legislation
when
we
surveyed
our
members
about
this
bill,
every
single
one
of
our
retail
members
is
already
using
this
type
of
software,
but
this
bill
takes
it
one
step
further
by
mandating
that
it
be
used,
it
solves
one
of
the
biggest
challenges
that
a
vaping
store
has
which
is
getting
their
clerks
to
adopt
it
and
making
that
judgment
call
on.
If
someone
is
old
enough
or
not,
this
makes
the
rules
simple
everyone's
carded
every
single
time.

Finally,
this
bill
is
actually
good
for
nevada's
vapor
industry
in
order
for
vapor
vape
stores
that
make
their
own
products
to
sell
to
achieve
fda
approval
to
continue
selling
their
products
past
the
end
of
this
year.

only

going
to
have
a
positive
public
health
effect,
reducing
teams
access
to
vaping,
but
it's
going
to
have
a
positive
economic
effect
by
helping
small
manufacturer

direct
to
consumer
sales
operations

I'm
representing
pax
vape
company
pax
makes
products
that
vaporize
cannabis
oils
only
we've
had
an
ongoing
concern
regarding
the
definition
of
vapor
product
found
in
nrs
370.054,
while
cannabis
products
are
excluded
based
on
the
taxation
of
the
product
that
goes
in
the
vape
or
where
it's
sold.
The
definition
contains
a
very
broad
conjunctive,
where
vapor
product
means
anything
non-combustible
means
any
non-combustible
product
containing
nicotine
or
any
other
substance
that
employs
a
heating
element
based
on
the
federal
law
that
assemblyman
haven
referenced.
I
This
broad
definition
creates
a
plethora
of
unintended
consequences
as
it's
written
cbd,
hemp,
essential
oils,
even
even
water,
for
baby
vaporizers
is
classified
as
a
vapor
product
here
and,
as
you
may
know,
in
order
to
pay
the
tax
on
vapor
products,
you
have
to
register
as
a
tobacco
company.
That
is
a
cumbersome
and
challenging
process.
Assemble
assemblyman
haven
has
graciously
agreed
to
help
work
on
this
definition
that
is
workable
for
all
market
participants.

that

to

out
to
all

them
and
confirm
none
of
the
nine
are
actually
members
of
the
convenience

the

members

supportive

trying

I
know
that
there
was
some
opposition
to
the
penalties.

benitez-thompson,
representing
us
district
27,
and
I
am
here
today
presenting
assembly
bill
368,
which
I
am
not
going
to
be
shy
about,
is
one
of
my
favorite
bills
of
this
session,
and
let
me
tell
you
why
I've
been
serving
now
for
a
while.
I
guess
you
would
say
I'm
a
more
seasoned
legislator.

I
don't
want
to
say
you
know
agent,
legislator,
but
more
seasoned,
and
from
the
time
that
I
was
first
elected,
I
served
on
the
taxation
and
the
revenue
committee
and
I've
watched
conversations
unfold
year
after
year,
and
one
of
the
things
I
really
come
to
value
is
transparency
and
follow-through
on
taxation
policy.
Hopefully,
you'll
stick
with
this
committee
for
many
sessions
to
come,
and
hopefully
you'll
always
watch
legislation
that
you
vote
for
and
to
see
how
it
plays
out.

So
this
bill
in
front
of
you
right
now
is
specific
to
tax
increment
districts,
more
specifically,
sales
tax
sales,
tax
revenue,
districts,
more
commonly
known
as
star
bonds,
and
so
star
bonds
were
a
mechanism
that
about
12
years
ago,
the
legislature
put
in
place
to
try
and
encourage
tourism
and
retail
incentives
by
allowing
taxable
sales
to
be
withheld
and
applied
to
the
developers,
cost
of
building
the
infrastructure
and
bonding
it
out.
Now
we
don't.
These
are
not
government-backed
bonds.
J
These
are
governments
bonds
held
by
the
businesses,
but
the
the
policy
quickly
turned
to
something
that
the
original
bill
sponsors
then
assemblywoman
smith
just
did
not
envision,
and
so
within
a
couple
of
years
she
went
back
and
removed
them
from
statute,
but
the
initial
bonds
that
were
made
are
out
there
and
still
living
to
this
day,
I
serve
as
a
member
of
the
legislative
commission
and
on
the
legislative
commission.

We
get
a
report
every
year
on
the
status
of
the
bonds
and
since
I
kind
of
lived
through
the
cleanup
hearings
and
testimony
and
language
regarding
star
star
bonds,
I
remain
very
interested
in
watching
this
and
just
as
a
member
of
the
northern
nevada
community,
we'll
kind
of
you
know
watch
to
see
what's
happening,
want
to
understand
what
developments
in
my
own
backyard,
and
so
I
have
listed
four
exhibits.

The
current
study,
I'm
sorry,
the
current
report
that
we
get
as
legislative
members
and
if
you
pull
up
that
exhibit
you'll,
see
that
there
is
a
table
and
everything
right
now
is
reported
in
aggregate,
and
my
goal
with
this
bill
is
to
de-aggregate
some
of
this
data
to
have
a
better
understanding
about
what's
happening
in
our
region,
also,
so
that,
once
you
know
quite
frankly,
I
exit
this
building
and
I
don't
have
access
to
tax
staff,
and
you
know
a
host
of
different
people
who
helped
might
help
me
understand
and
read
these
reports
or
get
more
insight
to
those
reports
that
any
normal
person
who
likes
to
follow
tax
policy
could
pick
up.

report
have
a
better
understanding
about
what
is
happening,
so
I
have
a
conceptual
amendment
that
was,
I
think,
just
recently
posted
to
nellis.
It's
very
short,
so
I'm
you
you'll
be
easy
to
digest.
I'm
looking
for
more,
what's,
like
I
said,
to
de-aggregate
this
report,
I'm
specifically
looking
to
one
have
the
tax
increment
districts
named.

Next,
I
would
like
the
report
to
include
the
amount
of
the
75
percent
pledge
of
taxable
sales
that
are
that
are
being
pledged.
So
right
now,
what
you
see
is
total
sales
tax
revenue,
but
we
don't
know
that
75
percent
that's
being
pledged
or
we're
just
asking
the
public
to
do
an
extra
step,
which
is
the
the
math,
the
arithmetic,
to
figure
out
that
75
percent,
that
department
of
taxation
does
that
so
much
better
than
we
do
so
it
makes
sense
to
have
that
75
pledge
listed
specifically
next.

You've
got
one
in
reno
or
in
northern
nevada,
one
in
sparks
and
then
three
in
reno,
and
we
can't
get
down
to
the
level
of
what
what
each
taxpayer
is
reporting.
That
is,
you
know,
proprietary
information,
but
we
can't
aggregate
that
by
counting.
So
I
should
be
able
to
look
at
this
report
and
just
kind
of
know
what
is
happening
in
my
county
and
have
those
grouped
together
same
for
clark,
county
symphony
park
4th
and
stuart
area
51,
all
of
those
being
in
las
vegas.

You
should
be
able
to
see
that
as
a
group
so
that
you
can
better
understand
the
impact
within
your
community
of
those
and
then
once
it's
broken
down
by
by
county
range
of
taxable
sales
and
I've
been
discussing
with
our
tax
staff.
How
that
might
look
if
the
ranges
are
too
small,
we
will
know
what
each
individual
taxpayer
is
paying
in
taxable
sales.

We
don't
want
that
so
somewhere
of
a
range
of
750,
000
increments,
seems
to
make
the
most
sense
and
then
lastly,
I
want
reported
the
number
of
years
left
on
the
bond
payment
to
me.
This
is
so
important
for
transparency,
because
the
clock
has
started
running.

Some
of
these
are
10
years
in
some
of
these
are
nine
years
on
in,
but
we
still
have
the
rest
of
the
life
of
the
bond
out
there
and
so
once
again,
just
really
easy
for
the
public
to
see
when
they
pick
up
the
report
to
know
we're
15
years
in
or
20
years
in
and
have
a
better
idea
of
when
those
revenues
will
go
back
online
for
the
local
government
systems.

superfund
site
after
the
97
flood
was
cleaned
up

then
turned

The
marina
next
adjacent
to
the
shopping
center
was
was
rehabbed
and
turned
into
a
beautiful
area.

so

so
sorry

if
I

so
I
know
that
one
and
then
I'm
very,
very
well
versed
on
on
symphony
park
as
well,
which
also
had
that
same
issue.
So
I
was
just
wondering
if
all

all

those

environmental
impact.

highway
right
there
I-80
and
the
ground
gave
way.

ended
up
with
oil
leaking

what

old
helms

of
the

already
it's
kind

almost

possibility

an
item

came
back
in
when
the
bill
sponsor
came
back
into
these
chapters

say
this

playing
out

a
different
way
than
I
imagined,
and
I
you
know,
need
to
take
ownership
of
this
and
address
some
behaviors
that
I've
seen
what
I
believe
we
did
pass
a
law
in
2011
that
would
not
allow
for
any
existing
business
within
a
40
radius
to
relocate
into
this
district,
because
that
was
a
a
trend
we
did
see
in
something
that
the
locals
did.

Municipalities
and
local
governments
didn't
expect
was
the
loss
of
a
revenue
base
outside
of
the
district
to
relocate
into
the
district.
Where
then,
their
sales
tax
would
be
pledged.
So
I
don't
believe
that
that's
a
current
practice
anymore,
but
we
would
have
to
I
see
if
there
are
existing
businesses
there,
that
re
located
in,
I
actually
think
most
of
the
ones
that
we
were
concerned
about
at
this
have
have.

sure,
just
to
just
to
confirm
we're
going
to
keep
in
the
the
blue
language
in
the
bit
and
just
add
on
your
your
amendment,
correct.

districts

one
retailer

there

districts
where

are
multiple
retailers
in
there.
So
we
can't
report
it
by
district
because
then
you
would,
we
would
obviously
disclose
the
taxable
sales
of
an
individual
business.

we
don't
want

kind
of
want
to
get

where
we
are
now
at
the

000
foot
level
much
much
closer
to
the
ground,

think
that
we've
got
language
that
strikes
