fund.
Grant
application
with
the
michigan
ended
indigent
defense
commission
for
fiscal
year
2023..

Good
morning,
commissioners,
thank
you
for
having
me
normally,
with
our
yearly
midc
grant.
We
come
to
the
board
one
time,
which
is
in
september
the
reason
that
we
normally
do
it
only
once
is
because
we
have
to
some
legal
requirements
that
we
have
to
submit.
We
have
some
negotiation
back
and
forth
with
the
midc,
and
then
we
bring
it
to
the
board
for
a
combined
application
and
approval
process
for
the
next
fiscal
year.

What
we
are
planning
to
do
for
next
fiscal
year
is
create
an
in-house
public
defender's
office,
we're
going
to
start
it
small
we're
going
to
start
it.
Our
submission
to
the
midc
is
a
request
for
nine
employees
to
start
that
office
and
then
over
the
years,
build
that
office
up,
so
that
it
can
take
more
of
a
percentage
of
our
caseload.

It
is
something
that
is
done
in
most
of
the
counties
in
our
state,
quite
frankly,
other
than
the
bigger
counties
have
have
been
slower
to
do
this
and
which
is
which
is
to
be
expected
because
they
have
the
biggest
caseloads.
So
it's
a
bigger
lift
for
the
bigger
counties,
but
we
do
feel
like
it's
time
to
get
that
started
and
to
to
bring
that
to
our
county.

So
that's
that's
the
reason
that
we're
here
now,
specifically
as
it
relates
to
the
grant
submission
or
the
negotiations
that
we're
going
to
have
with
the
state.
There
is
a
draft
version
of
our
cost
analysis
in
your
packet.
That
draft
absolutely
will
change.
In
fact,
it
has
changed
already,
since
I
uploaded
it
to
your
packet,
we're
going
to
be
requesting
about
15
million
dollars
in
grant
funds
from
the
state.

This
program
is
designed
so
that
oakland,
county
and
every
other
county
in
the
state
has
a
statutorily
calculated
local
share,
which
we
have
to
contribute
every
year.
Our
local
share
is
1.8
million
dollars.
So
that's
what
we
put
in
as
a
county,
1.8
million
dollars.
It's
based
on
a
calculation
of
the
three
year
average
of
what
we
spent
on
indigent
defense
services
in
the
three
fiscal
years
prior
to
the
midc
act,
and
so
what
that
means
for
us
in
very
simple
terms,
is
we
take
all
of
this
information.

We
tell
the
state.
This
is
what
we
want
to
do,
and
this
is
how
we're
going
to
provide
indigent
defense
services
we're
going
to
kick
in
1.8
million,
because
we
have
to
and
anything
above
that
the
state
has
to
fund,
assuming
that
they
approve
our
plan,
and
so
that's
what
we're
seeking
is
this
submission
to
the
state?
We
are
asking
them.
As
I
said
right
now,
it's
going
to
be
approximately
15
million
dollars.
It
may
even
grow
a
little
bit
by
the
time
we
actually
submit
it.

we
currently
pay
on
an
event-based
system.
We
don't
pay
hourly.
So,
for
example,
if
we
look
at
a
capital
felony
case
right
now,
assuming
that
it
didn't
go
to
trial,
so
just
you
know
it
was
a
plea
of
some
kind.

What
we're
trying
to
do
for
capital
cases
is
to
increase
that
to
the
midc
standard,
eight
rate,
and
what
that
means
is
the
midc
passes
all
of
these
standards
that
everyone's
supposed
to
follow?
We
don't
have
to
follow
them
until
they're
approved
by
lara
licensing
and
regulatory
affairs.
Standard
8
is
a
standard
that
midc
has
proposed,
but
lara
has
not
passed
yet
standard
8
rate
for
capital
cases
is
120
an
hour,
and
so
what
we
are
going
to
do
assuming
approval?

you
stated
that
this
is
also
going
to
be
creating
a
public
defender's
office
within
oakland
county.
Yes,
okay,
that's
something
that
I've
been
desirous
of
many
years
on
this
commission
and
with
that
occurring
you
know
we
have
cash,
bail,
assistance,
programs
and
payment
programs
that
are
national
that
want
to
do
things
at
the
county
level
that
just
not
having
a
public
defender's
office
was
prevented.

I
just
wanted
to
bring
that
to
the
attention
of
this
committee,
because
you
know
it's
very
important
that
we
do
have
a
public
defender's
office
operating
within
this
county
and
looking
at
the
trials
that
are
taking
place
so
I'll,
be
supporting
this.
For
that
alone,
absolutely.

and
you
know,
the
the
one
of
the
important
points
is
the
contract
attorneys
that
we
use
and
frankly,
we're
going
to
continue
to
use
for
the
most
part
provide
excellent
service,
but
there
is
something
to
be
said
for
having
that
in-house
office
that
can
provide
better
service.
That
can
be
a
direct
point
of
contact.
You
know
there
are
all
those
things
that
you
get
with
an
in-house
office
that
you
don't
get
when
you're
using
only
independent
contractors.

Well,
I'm
cautiously
optimistic,
I
think,
what's
interesting
to
me
in
this
process
is
what
we
are
giving
them
is
a
huge
increase
over
our
current
year's
budget.
Our
current
grant
year
fy22
is
a
six
million
dollar
grant
we're
asking
for
15.,
but
the
things
we
are
asking
for
are
all
the
things
that
the
state
and
the
midc
says.

should
be
doing
we're
not
asking
for
anything
that
you
know
they
don't
support
in
terms
of
how
systems
should
be
operating,
so
I
would
be
quite
frankly,
I
would
be
extremely
disappointed
if
they
tried
to.
You
know,
significantly
decrease
this
this
this
request,
because
it's
what
they
want
us
to
do.

We'll
submit
this
in
june,
the
midc
meeting
on
which
or
at
which
it
will
be
voted
is
august.
So
we
should
know
by
mid
to
late
august,
we
will
have
probably
when
we
submit
it
prior
to
the
meeting,
we'll
have
some
negotiation
with
them.
That's
why
we
do
have
a
little
flexibility
within
the
resolution,
and
then
we
would
bring
this
back
to
the
board,
which
we
do
every
year,
usually
in
september,
cool.

prosecutor
obviously
is
a
separately
elected
official.
These
employees
at
this
point
would
be
a
division
under
the
county
executive,
okay,.

it's
due
in
on
the
31st
of
may.
This
is,
I
believe,
our
ninth
year
in
requesting
approval
for
grant
funding
for
our
program.
We
have
approximately
40
people
in
the
program
right
now.

money
will
go
towards
one
staff,
probation
officer,
a
peer
recovery
coach,
which
we
were
able
to
add
last
year
with
grant
funding
which
has
been
invaluable
to
the
program
we
have.
Counseling
and
testing
are
the
big
ones
that
we
that
we'll
be
requesting
monies
for.
