The Committee on Commerce & Economic Development of the Council of the City of Philadelphia held a Public Hearing on Monday, November 19, 2018 to hear testimony on the following items:
180704 An Ordinance amending Chapter 17-1600 of The Philadelphia Code, entitled "Economic Opportunity Plans", by requiring the Labor Standards Unit to monitor contractors and enforce City Contract requirements for Workforce Diversity, all under certain terms and conditions.
180975 An Ordinance authorizing the City Commerce Department, on behalf of the City of Philadelphia, to enter into agreement with the Philadelphia Authority for Industrial Development and the Philadelphia Convention and Visitors Bureau, both for the purpose of hosting the Army-Navy intercollegiate football game in certain years, under certain terms and conditions.

further
refining
the
role
of
the
labor
standards
unit
and
monitoring
contractors
and
enforcing
city
contract
requirements
for
workforce
diversity.

bill
will
require
the
labor
standards
unit
to
determine
whether
a
contractor
is
on
track
to
meet
workforce
goals
at
a
specific
point
in
the
contract,
once
25%
of
the
hours
and
25%
of
spend
are
completed
and
taken,
and
it
also
allow
us
to
take
appropriate
action
pursuant
to
17
1606
penalties
and
remedies
if
best
in
good
faith.
Efforts
are
not
evident
at
that
time.
The
administration
supports
the
intent
behind
the
legislation.
Workforce
diversity
monitoring,
has
been
a
responsibility
of
the
labor
standards
unit.

17
1600
was
amended
in
2016
in
the
years
since
we
have
developed
reporting
requirements
for
contractors
around
workforce
diversity
and
implemented.

good
faith
efforts
form
that
covered

contractors
must
submit
as

prerequisite
to
be
issued

Notice
to
Proceed.
The
change
is
contemplated
under
bill
number
one.

aligns
with

internal
goals

enforcement
protocols
to
ensure

contracted
workforce
is
representative

citizens
of
this

done

going

project,

percent

it

know
if
that
was

continuation
which
you
would

just
get

the

they

they

will

forces

opposition

breaking
those
chains
of
property
may
position
ourselves
to
just
get
to
the
twenty
five
percent

they

dollars
spent,

then
we
move

another

end

that,
we
really

coming
back

maybe

wanted

consider
the
language,
because
in
this
language
you
say,
contract
and
one
thing
about
the
OEO
regulations
that
this
council
has
done
over
the
years.
You've
made
a
couple
exceptions
and
one
of
those
is
covered
project
all
phases
of
a
covered
project,
and
that's
that's
wording.
We
need
to
just
talk
about
for
a
second
a
covered
project.
All
phases
is
not
just
the
contract
dollars.

are
something
like
the
councilmen.
Blondell
is
always
about
the
soft
stuff,
the
architects,
the
consultants
all
that
stuff.
So
we
should
at
least
consider
cover
project
because
it
might
be
some
some
re
tweaking
of
the
labor
enforcement
standards
regulation
because
they
just
use
that
word,
contract
and
and
covered
contract.
But
it's
really
I
just
want
you
to
consider
the
covered
covered,
all
phases
of
a
cover
project,
and
that
would
be
anything
that
counsel
in
in
other
assets,
because
we
run
into
at
a
lot
with
zoning
and
I
remember
in
Miss
Parker.

aren't
we
asked
for
that

clearly
says
it
in

legislation,

two
things
we
need
to
just
look

forward,

is

step

says
you
know
best
practice
always
lead
to
a
beaten
path.

push
everybody
ahead

refine

hurdles

one
more
tool,
one
more
tool
in
the
toolbox
that
our
department
of
labor
standards
and
our
entire
city
of
Philadelphia
needs
to
ensure
that
there
is
accountability
when
we
talk
about
diversity
and
inclusion
relative
to
doing
business
with
the
city
of
Philadelphia.
So
I
want
to
thank
both
of
you
for
your
testimony

Mr

very
specifically
for
accurately
noting
that
the
25
percent
marks,
who
usually
sometimes
people
want
to
check,
and
they
want
to
give
you
numbers
when
there's
75
percent
through
the
project,
and
they
only
have
25
percent
on
the
backend
that
they're
waiting
for.
But
what
this
language
does
is
ensure
that
every
step
and
now
that
you
have
clarified
for
the
record
for
us
that
these
are
torn
increments
of
25
percent.
We
know
that
it
will
happen
consistently
throughout
the
throughout
the
project,
so
I
want.

it's,

at

end

day
the
workforce
doesn't
look
like
the
city
fell
off,
and
then
we
have
failed
in
our
duties
period.

speak

how
well
you're
coming
along

challenges
faced

department
due
to
lack
of
personnel,
to
help
carry
out
these
multiple
laws
that
we
pass
out

this
committee

helped
us
with
bringing
some
additional
people
on,
so
things
are
going
a
lot
better.
What
this
does
for
me
is
it
codifies
some
of
the
things
that
that
we're
already
doing
the
procedures
we're
trying
to
put
in
place
mm-hmm,
whereas
before
contractors
could
kind
of
push
back
and
say
well
we're
not
in
compliance
now,
but
we
will
be
by
the
end
of
the
project.

takes
that
away.

can
only
go
by
what's
written
in
the
bill,

my

public's
point
of

need

look
at

bill.

country
great

remembering
that
the
people
that
are
in
power
will
be
our
power
one
day
and
there'll
be
other
people
there.

one

things
is
to
ask
the
mayor
through
his
office
to
make
sure
that
they
have

funds
in
place
to
get
additional
resources
when
they
need
them,
for
instance,
sometimes
on
my
side
of
the
table,
I
hear
from
Union
guys
and
other
guys
and
another
thing
about
this
bill.
This
is
this
is
a
this
is
a
neutral
bill.
It
doesn't
matter
whether
union
or
non-union
cuz.
We
have
the
same
problems
from
non-union
developers
as
we
have
from
union
developers.

They
still
try
to
make
the
most
in
the
case
of
the
private
developers
and
non-union
they're,
trying
to
make
the
most
of
the
money
and
the
union
developers
they're
trying
to
make
the
most
for
the
men
on
the
job,
but
they're
only
excluded
they're.
Only
looking
out
for
union
people,
one
of
the
things
that
happens
with
labor
labor
standards
is
somebody
could
give
you
a
report.
If
there's
no
red
flag
on
that
report
to
indicate
that
something
doesn't
seem
right,
it
won't
trigger
flag.

project

could

count
the
amount

manpower
on
there
and
if
there's

red
flag

Labor
Standards
doesn't
have
the
resources

out

count
hairs

substantiate
what
he's
putting
in
and
since
we're
putting
in
for.
Like
you
said
council
now,
I'm
chair,
you
say
we're
looking
out
for
the
workforce
of
Philadelphia,
but
we're
involved
in
this
business
with
other
entities
that
their
workforce
is
within
the
whole
region.
So
we're
we're.

out

ourselves
as
we
should
because
they're
your
constituents,
but
there's
other
guys
who's
gonna,
be
fighting
you
saying
you
know
what
we
don't
care
about,
just
being
Philly.
We
have
to
man
this
job
and
we're

it

can
I
think
that
this
is
a
step,
another
tool
for
you
to
fight
like
any
any
any
kinetic
craft.
Whatever
you
use
all
the
tools
in
your
toolbox,

this

officers
that

payrolls,

only
for
prevailing
wage
but
have
a
full-time
person.

doing

work

diversity

full-time
inspectors

go
out
on
the
site
and
interview
workers.
So
we
checked
the
certified
payrolls
against
the
interview
sheets
so.

that
payroll
comes
in,
say
we
were
going

all
build
this
room,
but
we
got
a
payroll
report
that
just
said
two
people
built
this
room
now,
if
there's
not
somebody
there

say
right,
it's
impossible
for
two
guys
to
make
that
with
$4,000
right.
So
we
need
to
look
at
this
further
and
hearing
the
explanation.

impossible

developer,

build

building

have
this
workforce
that
he's
telling
us.

need
to

to
have
a
way
to
check
that
the
responsible
person
for
any
company,
whoever

responsible
person

designate

signs
on
a
back
of
that
form.

there's
your
form
have

penalties
on
it
from
the
United
States
Code.

the

administration
followed
through
and
provided

additional
staff

instance

circumstance

there
was
discovery
that
a
prime

sub

honoring,
the
workforce,
diversity
piece
and
indeed
were
penalized?

we
penalize
anybody
in
the
city
of
Philadelphia

contractors

send
that
out
first

them
an
opportunity,
because
it's
best
faith
efforts

them

opportunity

to

substantiate

reason.

penalized

administration

needs

teeth

stop

stop
somebody's
payment,
you're
gonna
get
something

notice.

stop

payment
at
25
percent,
so
you're
gonna
catch
them
upfront
and
then
you're
gonna
catch
them
again.
So
we
really
need
to
be
thinking
what
happens
that
the
second
occurrence,
the
first
occurrence

just
even

stop
somebodies
payment.
You
get
the
right
lawyer
in
there.
Somebody
with
the
caliber
of
mr.
Christmas
over
there
you're
gonna
return
that
money
after
the
first
knock
that
first
hole
back
because
you
haven't
taken
the
steps
necessary
to
warn
him
about
that
non-compliance.

think
about

little
bit

Academy
is
accepted.

city's
proposal

host
the
annual
game
at
Lincoln,
Financial
Field
for
the
following
years:
2018,
2019,
2020

2022.
The
game
in
2021
will
be
played
in
New,
York
and
honor
of
9/11.
The
PA
Chelsea
DB
is
proud
to
have
successfully
won
the
bid
to
continue
to
host
this
important
and
historical
game
in
conjunction
with
the
city
of
Philadelphia
and
the
Commonwealth
of
Pennsylvania.

According
to
a
study
that
we
conducted
in
2016,
the
army-navy
game
festivities
attract
over
54,000
visitors
to
the
Philadelphia
region.
They
generate
close
to
31,000
room
nights
and
have
a
total
estimated
economic
impact
of
35
million.
Each
time
the
game
is
played
here
in
Philadelphia,
army-navy
is
traditionally
one
of
the
biggest
weekend's
of
the
year
for
our
city's
hospitality
weekend.
Community
and
our
community,
as
you
know,
is
now
the
second
largest
employment
sector
for
Philadelphia
and
we
support
over
73,000
jobs.
I
It's
also
a
tremendous
opportunity
for
our
city
to
roll
out
the
red
carpet
to
our
nation's
military
community
to
travel
to
Philadelphia,
while
millions
of
fans
watched
across
the
nation.
The
game
has
a
special
history
in
our
great
city
that
started
in
1899
and
has
concluded
games
at
Franklin,
Field,
JFK,
Stadium,
veteran's
stadium
and
now
in
the
Lincoln
Financial
Field
this
year
will
mark
the
88th
time
that
Philadelphia
has
hosted
the
game
and
its
illustrious
119
history.

bring

events

city

opportunities,

cup

strong

opportunities
available

the
city
of
Philadelphia
to
bring
other
sporting
venues
different

Navy

economic
impact

especially
when
we
have
such
a
large
and
growing
international

immigrant

so
Larry
and
his
entire
team
work
throughout
the
year
to
secure
events
that
can
be
played
indoors
or
outdoors.
As
you
know,
we
have
our
bid
for
in
2026
that
we're
hoping
that
we'll
be
successful
in,
but
definitely
we
are
considered
one
of
the
premier
sports
towns.
Here
in
Philadelphia
we
roll
out
the
red
carpet
actually
to
help
secure
the
army-navy
bid
for
the
next
four
out
of
five
years.

actually
had

folks
from
arm

the
academies
come
down
for
the
NFL
Draft,
and
so
they
were
able
to
see
how
successful
we
were
in
maneuvering,
the
number
of
folks
on
the
Parkway
and
throughout

city.

we
continue

host
high-profile
events,
especially
army-navy
game
and
NFL
draft
that
put
the
city
on
an
international
and

definitely

so
I'll
tell
you,
we've
been
working
very
closely
with
the
academies.
The
contract
for
the
game
is,
is
extremely
intricate,
and
so
there
have
been
some
spirited
negotiations,
I
would
say
on
everyone's
part
and
certainly
looking
for
the
best
interest
of
Philadelphia,
as
well
as
the
academies,
and
so
we
find
ourselves
at
this
hour.
We
did
reach
out
to
the
academies
two
to
three
years
ago,
hoping
that
we
wouldn't
have
to
go
through
the
bid
process,
because
we've
done
such
a
great
job
over
the
years.
I
But
this
game
has
really
become
a
bowl
game
for
us,
and
so
there
were
a
number
of
cities
that
were
bidding
against
us,
and
so
we
had
to
kind
of
sharpen
our
pins,
and
so
we
find
ourselves
in
this
close
proximity
timeframe,
but
there
have
been
I,
think
fair
negotiations
and
I
think
we're
all
a
very
good
space.

other
questions:
we've
done
a
total
fiscal
impact
analysis
of
the
3035
million
that
generates
compared
to
the
six
million.
We
have
to
pay
them
compared
to
all
the
other
income
and
expenses
that
occur
where
we
can
actually
point
to
a
bottom
line
and
I'm
in
favor
of
the
game.
I'm
just
saying,
is
there
any
kind
of
an
analysis
that
we've
done?
That
would
show
up
bottom
line
number.

we

detailed
budget
of
the
game
that
we
go
into
the
game
with
and
certainly
controls
expenses
as
much
as
we
possibly?
Can
we
also
an
art
or
gonna?

they
shouldn't
do
fundraising

help

it

weekend?
So
when
Army
Navy
first
came,
it
was
just
the
day
of
the
game,
and
many
folks
would
just
come
for
the
day
and
now
we've
been
able
to
include
a
gala
that
happens
on
Friday
night.

actual
financial
commitment
excuse
me
that
the
city
realizes
around
the
game
is
much
less
than
the
six
million
dollar
guarantee.
The
actual
ticket
revenues
from
the
game
are
somewhere
between
four
and
five
million
dollars,

are
the
initial
revenues
that
count
against
the
guarantee
mm-hmm.

in
addition
to
the
financial
reward
that
the
city
enjoys
wherever
the
city
makes
an
investment
of
any
amount,
I'm,
always
looking
for
opportunities
where
philosophy
of
public
school
children
can
benefit.

part

a
statue
of
the
stature
of
the
army-navy
game
and
what
it
represents
in
the
future,
it
can
hold
for
young
people
any
linkages
with
the
fall
for
school
district
in
any
way,
shape,
form
or
fashion.

them
a
food
voucher,
we
give
them
a
ticket
and
you
know,
keep
them
transportation
over
to
the
game.

as
we
look
down
the
road
to
the
future
and
looking
at
the
glass
as
half-full
and
knowing
that
fall-off,
it
already
does
a
great
job
when
it
comes
to
hospitality
and
tourism.

our
track
record
with
army-navy
in
future
negotiations,
is
there
any
consideration
to
increasing
that
number,
because
there
are
a
hundred
and
a
hundred
plus
thousand
students
in
public
schools?
Not
even
thinking
about
charters
and
I,
don't
know
what
percentage
of
those
are
high
school
students,
but
the
more
we
can
touch
their
imagination
during
that
period.

are
in
JROTC
have
been
exposed
to
that
experience,
their
gazillion
students
who
don't
have
a
clue
what
those
letters
mean
and
so
I'm
asking
that
as
you
look
to
the
future
that
you
find
a
way
to
touch
young
people
in
grades
nine
through
12,
we
don't
have
a
clue
up.

could
be
inspired
if
they
were
invited
to
the
game?

so
all
of
the
high
schools
now
I'm
thinking?
Ideally,
every
high
school
should
have
young
people
represented
at
that
game.

we

body

say,
as
we've
discussed,
the
expectation
is
that
FIFA
and/or,
US
soccer
will

making
the
final
determination
on
host
cities
sometime
by
the
end
of
2020.

all

city

region,
need
to
be
very
focused
to
own
that
bid
over
the
next
18
months
to
make
sure
that
Philadelphia
goes
from
the
current
shortlist,
which
has
approximately
23
cities
in.

enhance
that
this
is
a
big
deal.

only

second
time
in
the
history
of
FIFA
World,
Cup
that
the
games
would
be
in

States

it

have
one
in
our
city
which
has
a
lot
of
soccer
heritage
as
well,
because
last
time
it

here
there
were
no
games
played
before
that's
right.
