The Committee on Law and Government of the Council of the City of Philadelphia will held a public hearing on Monday, May 16, 2016 to hear testimony on the following item:

An Ordinance amending Chapter 9-1100 of The Philadelphia Code, entitled "Fair Practices Ordinance: Protections Against Unlawful Discrimination," by adding a section prohibiting employers from obtaining or using credit-related information regarding employees and job applicants in certain circumstances, under certain terms and conditions.

a

advocates
for
this
particular
area,

government
I'm
rule
and

executive
director

the
Philadelphia
Commission
on
Human
Relations.
As
you
know,
the
Commission
is
the
city
agency
that
inventors
administers
and
enforces
the
fair
practices
ordinance.
The
city
law,
protecting
people
from
unlawful
discrimination
in
employment,
public
accommodations
and
housing,
and
real
property
bill
number
16.

will
men
the
fair
practices
ordinance
to
ban
the
discriminatory
use
of
credit
reports
in
hiring
and
employment
decisions.

I'd
like
to
recognize
council
president
Clark
for
introducing
this
bill
and
for
the
opportunity
to
testify
in
favor
of
it.
Studies
show
that
almost
half
of
employers
use
credit
reports
to
make
hiring
decisions
for
some
or
all
of
their
jobs,
even
when
the
positions
have
nothing
to
do
with
the
finances
of
the
company
across
the
country.
People
are
telling
their
stories
of
being
qualified
for
jobs
but
being
denied
simply
due
to
poor
credit,
whether
it
was
a
bankruptcy.

There
is
no
correlation
between
credit
and
a
person's
ability
to
perform
at
work
or
to
a
succeed
in
the
workplace.
In
fact,
in
2010
a
representative
at
transunion,
one
of
the
big
three
credit
bureaus
admitted
under
oath
quote,
we
don't
have
any
research
to
show
any
statistical
correlation
between
what's
in
somebody's
credit
report
and
their
job
performance
or
their
likelihood
to
commit
fraud,
and
even
when
a
person
has
good
credit
mistakes
on
credit
reports
are
pervasive.

Moreover,
using
credit
reports
for
employment
purposes
may
also
be
discriminatory.
Research
shows
that
african-american
and
latino
households
tend
to
have
more
problematic
credit
histories
than
white
households.
Thus,
using
credit
reports
for
employment
purposes
like
we
will
have
a
disparate
impact
on
those
communities.

Given
the
lack
of
correlation
between
credit,
history
and
job
performance,
the
inaccuracies
of
credit
reports
and
the
potential
discriminatory
impact
states
and
municipalities
across
the
country
are
passing
laws
to
protect
people
from
the
abuse
of
using
credit
reports
and
employment
decisions.
As
of
December
2015,
11
states
and
New
York
City
passed.
Such
laws
and
legislation
is
pending
in
Congress
to
ban
the
practice
nationwide
in
Philadelphia
bill
number
1600
72
would
make
it
unlawful,
make
it
an
unlawful
discrimination
under
the
city's
fair
practices
ordinance
for
most
employers,
subject
to
certain
exceptions.

the
bill
parallels
the
requirements.
The
Fair
Credit
Reporting
Act
by
requiring
employers
exempted
from
the
bill
who
obtain
and
use
credit
reports
to
provide
a
written
notice
to
the
applicant
or
employee,
with
a
copy
of
the
report
explaining
the
potential
adverse
action
and
gives
the
affected
person
an
opportunity
to
respond,
throw
it
up
your
job
seekers
and
employees
already
struggle
to
get
or
maintain
decent,
stable
employment
in
this
tough
job
market.

me

testify
on
this
very
I,
considered
a
very
urgent
issue
for
over
40
years.
To
give
you
a
little
background
on
a
Philadelphia
unemployment
project
for
over
40
years
of
Philadelphia
unemployment
project
has
offered
a
supportive
environment
for
unemployed
Philadelphians,
trying
to
find
jobs.
Our
computer
lab
offers
12
internet
access,
computer
stations
of
fax
machine
printers
and
telephone
staff
and
volunteers
assist
job
seekers
from
basic
computer
and
Internet
skills,
as
well
as
job
search
techniques.

Our
jobs
club
is
a
weekly
meeting
where
those
looking
for
work
can
exchange
ideas,
get
tips,
job
leads
and
gives
them
something
to
do
and
to
help
counter
some
of
the
depression
of
not
being
out
of
work
as
a
job
developer.
I
work
with
at
least
200
clients
a
year,
helping
them
create
a
work
search
plan
and
improve
their
resumes
in
101
job
counseling
sessions.
Our
computer
lab
has
over
7,000
instances
of
use
each
year
nearly
900
people
attend
our
jobs
Club.

As
you
can
see,
we
have
an
excellent
track
record
in
helping
them
find
jobs,
we're
also
one
of
a
handful
of
key
spots
in
Center
City,
a
coalition
of
community-based
groups
committed
to
bringing
internet
access,
training
and
technology
to
all
Philadelphia
communities
where
forty-one
percent
of
residents
are
not
connected
and
by
the
way
our
job
placement
rate
with
some
of
the
hardest
to
employ.
People
is
about
twenty
seven
percent,
which
is
about
ten
percent
more
than
what
most
other
job
placement
agencies
attain.

That
insult
to
injury,
many
of
our
job
seekers
have
reported
that
they
have
been
turned
down
for
employment
because
of
their
bad
credit
score.
Imagine
the
very
thing
they
need
to
get
back
on
their
feet
and
begin
to
repair
their
credit.
They
are
being
turned
down
for
we've,
seen
people
who
have
criminal
backgrounds
applied
to
so-called
second
chance
employers
and
then
get
turned
down
because
of
a
consumer
credit
background
check.
This
egregious
practice
makes
no
sense,
especially
for
jobs
where
workers
are
not
handling
or
working
around
cash
or
securities.

a
couple
of
our
clients
who
got
turned
down
by
local
employer
and
I
won't
mention
their
name
for
jobs,
making
hoagies
imagine
getting
turned
down
for
a
job
making
hoagies
that
doesn't
even
pay
that
much
in
the
first
place,
because
you
have
bad
credit.

the
legislation
to
require

employers
to
end
this
insane
practice
and
let's
work
together
to
get
people
back
to
work.

dealing

finances

just

customer
service
position
or
an
executive
secretary

something

that
sort,

trying
to
get
an
income
to
work,

pay
bills
and
live

hard
when
you
have
maybe
close
to
ten
thousand
dollars
in
medical
bills.
Okay,
so
I
just
needed
to
give
a
heartfelt
speech
about
how
important
it
is
for
someone
like
myself
and
I'm
sure,
like
a
hundred
other
people
out
here
in
the
city
that
once
work
that
can
work
with
a
few
stipulations
but
I'm
always
straightforward
in
front
with
the
employer.
My
last
job,
like
I,
said
they
knew
about
my
condition
and
they
was
working
with
me,
but
the
company
decided
to
downsize
and
phase
out
my
position.

suspect
it.
The
first
interview
I
had
everything
was
great,
then
if
he
was
great
and
they
said
the
broken,
it
won't
take
me
to
the
next
phase
and
it
was
going
to
be
it
with
the
hiring
director.

spoke
with

hiring
director
and
he
said
he
will
contact
me.
They
were
going
to
do
the
background,
checks
and
everything.

they
came
back
and
said
they
found
somebody.

was
a
much
better
fit

health

their

loved

banker

before
FICO
scores
before
saan
the
credit
scoring
and

I
went
through
loan
school.

insurance
policies,

able
to
get
insurance
unless
they
have
a
good
credit
score
and
now
even
go
into
employment.
How
a
person
is
dealing
with
bills,
especially
they
have.

medical
issue,
has
no
determination
on
whether
they
have
a
strong
care
during
a
strong
work,
ethic
and

the
blending
of
those
two
is
based
on

now

that
someone
made
at
some
point
feeling
that
one
is
somehow
indicative
of
how
the
other
