The Committee on Law and Government of the Council of the City of Philadelphia will hold a Public Hearing on Monday, February 3, 2020, at 10:00 AM, in Room 400, City Hall, to hear testimony on the following items:

today
to
testify
in
support
of
bill
number
two:
zero
zero.
One.
Five
and
resolution
number
two:
zero:
zero:
five
six,
which
proposed
to
amend
the
Philadelphia
home
roll
charter
to
revise
and
clarify
rules
pertaining
to
prohibited
political
activities
of
certain
city
officials
and
employees.
The
charters
current
restrictions
on
political
volunteering
by
most
employees,
as
well
as
by
unpaid
members
of
many
city
boards
and
commissions,
are
among
the
strictest
in
the
nation.

This
means
over
30,000
individuals
are
currently
prohibited
from
expressing
political
speech
by
volunteering
for
a
political
party
or
for
any
political
campaign,
even
when
they
are
off
duty,
not
on
city
property
and
not
using
their
city,
titles
or
city
resources
covered
city,
employees
and
boarding.
Commission
members
are
banned
from
volunteering
for
campaigns
anywhere
in
the
country
and
for
any
elective
office.
The
proposed
amendment
would
allow
individuals
to
volunteer
in
non
managerial
roles
in
support
of
candidates
for
any
post
except
the
city
office
or
a
philadelphia-based
state
office.

So
long
as
it
is
not
done,
laun
duty
using
city
resources
for
while
using
one
city
title,
the
more
restrictive
rules
on
political
volunteering
currently
in
place
would
still
apply
to
those
working
for
the
city.
Commissioners,
the
District
Attorney's
Office,
the
police
department,
the
Board
of
Ethics,
and
by
today
the
sheriff's
office.
The
administration
appreciates
the
importance
of
regulating
city
employees,
political
activities
in
order
to
avoid
real
or
perceived
appearances
of
corruption.

Many
of
the
current
prohibited
political
activity
rules
are
untouched
by
the
proposed
charter
amendment,
for
instance,
most
city
employees
cannot
serve
as
committee
people
or
ward
leaders,
no
appointed
city
employees
can
engage
in
political
fundraising,
but
almost
seventy
years
after
the
Home
Rule
Charter
was
adopted,
and
after
decades
of
changing
and
expanded
interpretations
of
political
speech.
Now
is
the
right
time
to
revisit
the
continuation
of
these
prohibitions.
This
is
particularly
important
because
these
restrictions
require
employees
to
surrender
their
basic
First
Amendment
right
as
private
citizens.

The
proposed
charter
change
is
a
sensible
balance
between
preserving
and
respecting,
preserving
respecting
employees,
constitutional
rights,
while
at
the
same
time
keeping
political
volunteering
out
of
the
workplace,
if
approved
by
the
voters,
most
city,
employees
and
boarding.
Commission
members
will
be
permitted
to
volunteer
in
off
City
time
for
candidates
for
federal
offices
such
as
US
president
in
US
Congress
Pennsylvania
statewide
offices
such
as
the
governor
lieutenant
governor
Attorney,
General,
Treasurer,
Auditor
General,
and
the
superior
Commonwealth
and
supreme
courts
and
non
Philadelphia
seats
in
the
General
Assembly.

They
could
also
volunteer
for
candidates
running
in
races
outside
of
Pennsylvania.
While
the
remaining
prohibition
with
the
remaining
prohibitions
in
place,
the
city's
political
activity
restrictions
will
still
remain
amongst
the
strongest
in
the
country.
The
administration
is
confident
that
the
balance
struct
here
pose
a
little
risk
of
undue
political
influence
and
the
increased
penalties
for
non-compliance
will
provide
an
additional
deterrent.

My
name
is
Michael
Cooke
I
am
the
general
counsel
for
the
city's
Board
of
Ethics.
Thank
you
for
this
opportunity
to
speak
on
this
legislation,
which
would
revise
the
flu
activity
restrictions
found
at
X
in
10
107
of
the
Home
Rule
Charter.
Since
its
inception,
the
board
has
administered
the
city's
political
activity.
Restrictions
I've
been
with
the
board
since
2008
at
the
outset.
E
I
note
that,
since
this
legislation
was
introduced
on
January
23rd,
the
board
has
not
had
an
opportunity
yet
to
deliberate
on
it
and
determine
what
position
if
any,
it
would
like
to
take.
I
expect
that
the
board
will
do
so
at
its
February
20th
meeting.
But
as
a
result,
I
can't
offer
testimony
today
on
behalf
of
the
board.
Rather,
my
testimony
will
be
staffs
historical
and
technical
perspective
on
this
legislation
and
as
far
as
that
goes
note
that
this
is
a
revised
version
of
legislation
that
came
before
this
committee.

Others
who
testified
at
that
hearing,
and
at
least
one
member
of
the
committee,
expressed
concerns
about
the
type
of
activity
that
the
proposed
change
would
permit
city
employees
to
engage
in,
and
also
the
fact
that
the
rules
would
be
changed
for
all
employees,
regardless
of
the
nature
of
their
duties
as
I
testified
in
December.
The
board's
primary
concern
was
that
time
be
taken
to
evaluate
these
issues
and
avoid
hasty
changes
that
could
result
in
unintended
consequences
or
a
rule.

That
would
be
difficult
for
city
employees
to
comply
with,
given
that
it's
only
been
about
a
month
since
the
last
hearing
a
little
more
than
a
month,
and
given
that
this
legislation
and
quickly
I
expect
that
the
board
will
voice
similar
concerns
when
it
takes
up
the
matter
at
its
February
meeting.
But
that
said,
I
anticipate
that
the
board
will
appreciate
the
fact
that
the
revised
legislation
does
address.
Most
of
the
substantive
concerns
raised
at
the
December
hearing
and
I
expect.

I
think
that
the
limitation
of
permissible
activity
to
menthe
non
managerial
volunteer
work
is
important
to
ensure
that
city
employees
do
not
become
overly
entangled
in
partisan
politics
or
in
campaigns,
and
then.
Lastly,
given
that,
when
the
board
discussed
the
prior
legislation
in
I,
guess
it
was
November,
it's
November
board
meeting
it
expressed
interest
in
seeing
an
update
to
the
penalty
section
of
the
Charter
I
expect.
They
will
be
pleased
to
see
that
this
version
of
the
legislation
does
that
as
well.

All
that,
of
course,
will
put
further
demands
on
our
already
limited
resources,
but
it
would
in
any
event
be
something
that
we
would
prioritize,
certainly
to
make
sure
that
city
employees
know
what
they
are
able
to
do
and
not
able
to
do
under
the
Revised
Rules.
So
that
concludes
my
testimony
and
I
would
be
happy
to
answer
any
questions
that
members
of
the
committee
may
have.

the
policy
director
for
the
committee
of

I'm,
also
a
pleased
to
be
back
here,
testifying
about
the
newest
version
of
this
particular
proposal
to
avoid
touching
on
ground
that
we've
we've
already
covered
I'll
avoid
reading
my
my
testimony
verbatim
as
Michael
Koch
has
stressed
before
I
mean
these.
These
rules
go
to
the
heart
of
our
charter
and
the
concerns
that
that
the
drafters
had
70
years
ago.

So
you
know
the
fundamental
question
that
we
raised
in
December
and
that
we
we
still
have
you
know
today
is
how
we
made
enough
enough
progress
really
to
loosen
some
of
these
rules,
and
you
know,
after
having
a
little
bit
of
time,
to
reflect
more
on
the
proposed
changes
and
also
speak
to
folks
in
other
cities,
especially
cities
with
a
similar
politics
and
political
histories
to
ours,
New
York
City
in
Chicago.
In
particular,
you
know
it's
it's
our
assessment
that
Philly
has
made
enough
progress
to
have
these
changes.
Move
forward
to
the
voters
in
particular.

I
wanted
to
highlight
this
morning.
The
the
improvements
upon
the
proposal
that
was
put
out
there
at
the
end
of
2019,
as
as
Mr
Cook
noted,
the
the
non
managerial
volunteer
limitation
in
particular,
is,
is
a
is
extremely
valuable
and
improvement.
There's
a
big
big
difference
between
any
city
employee,
whether
it's
it's
a
it's
a
clerk
or
typist,
or
someone
who's
fairly
high-profile,
doing
partisan
volunteering.
That's
relatively
anonymous
phone
banking,
canvassing
et
cetera,
as
opposed
to
managing
a
campaign,
and
that
limitation
takes
care
of
that.
That's
sort
of
concern,
as
mr.
F
Koch
also
noted,
that
the
carve-outs
for
those
particularly
sensitive
offices
here
in
town
that
it
would
also
be
troubling
or
problematic
for
those
folks
to
be
engaged
in
partisan,
voluntary,
partisan
activity
on
their
own
time
that
that's
also
a
good
good
improvement.
And,
lastly,
the
penalty
provisions.
I,
don't
think
we
have
ever
put
someone
in
jail,
at
least
not
for
an
awful
long
time
for
for
violating
one
of
our
local
activity
rules
but
sure,
let's
that's
quite
a
severe.

You
know
punishment
and
an
updated
fine
structure,
especially
something
that's
the
similar
to
the
campaign
finance
fines
that
we
currently
have,
which
would
be
far
more
appropriate
and
would
be
on
the
table,
this
sort
of
a
mement
order
to
ultimately
pass.
So
that's
all
I
have
this
morning
happy
to
take
any

chair,
well,
thank
all
of
you
here
for
testifying
on
this
legislation.
This
conversation
actually
started
during
the
summer.
Early
fall
actually
was,
as
some
city
employees
approached
me
regarding
their
concern
of
not
being
able
to
participate
in
certain
activities
that
will
be
occurring
in
2020,
especially
the
presidential
election
being
very
important,
felt
and
felt
that
our
current
laws
as
it
relates
to
flag
activities,
overly
restricted.

One
of
the
things
that
I
think
is
beneficial
about
the
proposed
legislation
is
that
it
does
provide
a
good
amount
of
detail
and
guidance,
so
that
I
think
it's
pretty
clear.
What
is
intended
to
be
changed
and
would
what
would
be
covered
and
not
covered
under
the
new
rules.
So
I
think
that
the
challenge
with
the
regulations
will
not
so
much
be
interpretive
as
more
practical
in
terms
of
just
taking
the
to
three
months
to
go
through
the
process
and
doing
the
revisions
and
making
sure
that
city
employees
are
aware
of
it.

Just
just
a
stop
on
that
I
think
one
of
the
question
that
may
need
some
additional
clarification
from
a
redditor
perspective
is
what
is
considered
management,
yeah
I
know:
we've
tried
to
no
work
with
the
Ethics
Board
and
the
staff
over
the
years
and
trying
to
get
more
guidance
on
different
things.
From
my
perspective,
manager
would
be
campaign
manager,
a
political
director,
as
opposed
to
someone
just
giving
out
literature.
So
I
know
you
can't
give
a
full
perspective,
but
those
are
some
of
the
things.

I
think
we
would
need
to
provide
some
guidance,
some
clarity,
because
I
think
part
of
the
challenge
and
why
this
type
of
legislation
is
needed
and
will
also
need
to
a
public
education
campaign
about
this
is
that
you
have
a
number
of
city
employees
who
believe
they
can't
sign
a
petition.
You
have
a
number
of
city
employees
to
believe
they
can't
make
a
contribution
which
is
their
right
if
they
want
to
in
their
own
perspective,
but
that's
one
of
the
issues
because
of
some
of
our
very
restrictive
our
very
strong
restriction
on
plug
activity.

have
various
employees
that
feel
they
can't
participate,
which
should
be
their
civic
right
to
do,
and
so
this
helps
to
provide
some
additional
opportunities.
Also,
we
have
not
had
their
participation
levels
that
we
need
from
a
city
as
a
whole
in
elections,
and
so
anything
we
can
do
that
can
provide
those
opportunities,
I
think
are
beneficial,
understood.

The
proposed
amendment
under
the
proposed
amendment
city
employees
would
not
be
permitted
to
volunteer
for
the
local
city
campaigns,
like
you
said,
nor
for
races
or
the
state
legislature.
Where
is
something
that
Philadelphia
voters
vote
for
that
person,
so
a
state
rep
or
senator
who's
based
in
Philadelphia
city
employees
would
not
be
able
to
prove
Ahlan
tear
on
those
campaigns
so.

I
You
very
much
chairwoman
as
far
as
I
understand
and
so
I'm
going
to
ask
you.
This
I
mean
basically
the
Charter
was
kind
of
like
created
this
protection
of
city
workers,
so
they
would
not
be
maced
and
bullied
and
provided
good
government
likes
standards.
Then
we
have
civil
service
to
protect
the
workers.
I
Why
not
just
enact
the
Hatch
Act?
Why
not
just
go
ahead
and
allow
like
what
is
the
distinction
between
the
Hatch
Act
that
allows
federal
workers
to
do
certain
things,
including
on
their
own
time,
without
city
resources,
to
get
engaged
in
city
elections,
which
probably
is
of
the
paramount
concern
to
them?
So
why
outside
of
Philadelphia,
not
inside
of
Philadelphia,
so.

The
first
thing,
I
would
say
is
that
I
think
that,
in
fact,
if
the
legislation
were
to
go
forward,
it
would
create
a
set
of
rules
that
is
very
similar
to
the
federal
system.
What
we
call
the
Hatch
Act
in
that
there
would
be
two
groups
most
city
employees
would
be
allowed
to
engage
in
a
wide
array
of
political
activity,
including
volunteering
on
campaigns
and
then,
just
as
there
is
at
the
federal
level,
there
is
a
smaller
group
of
more
restricted
employees
based
on
the
nature
of
their
work.

So
I
actually
think
we
would
end
up
something
quite
similar
to
the
Hatch
Act
with
I,
guess
a
notable
difference
being
that
there
under
the
city
rules.
If
they
were
to
go
forward,
there
would
be
some
races
that
the
more
strict
rules
with
a
plot
you,
just
as
you
were
saying
the
city,
races
or
state
rep,
races
and
I-
think
just
you
know,
sort
of
from
the
the
implementation
or
the
the
legal
perspective.

Me
personally,
I
mean
first
amendment
wise
I,
don't
I
don't
actually
have
that
concern
I
just
think
like
if
you're
a
city
employee
and
you
want
to
run
for
office
in
Philadelphia
on
your
own
time,
your
own
expense,
your
own
resources
go
ahead.
So
so
why
split
there?
Why
split
the
baby
there?
Why
not
just
go
all
out?
You
know
if
your
city
employee,
be
responsible,
use
your
own
resources
go
campaign
for
City
Council,
be
my
guest,
but
why
cut
the
line
there
so.

I
think
the
difference
would
be.
You
know
as
an
example
so
into
the
new
rules,
a
city
employee
say
they
had
a
friend
or
a
family
member
who
was
running
for
office
in
Harrisburg,
so
they
could
go
volunteer
for
that
camp
or
more
than
volunteer.
They
could,
you
know,
take
up
well
volunteer
help
with
the
campaign
for
their
relative
in
Harrisburg.

It's
not
going
to
raise
a
question
for
them
is
there's
something
going
on
here,
where
there's
an
entanglement
between
city,
employment
and
the
delivery
of
city
services
and
political
campaigns
and
partisan
political
politics,
which
was
the
very
real
case
in
the
years
before
the
Charter,
and
why
these
restrictions
are
so
much
a
part
of
what
the
Charter
framers
were
looking
to
do
and
so
I
think
again.
It's
that
distinction
between.

I
generally
tend
to
take
a
thoughtful
and
careful
approach
and
I
appreciate
the
bill
sponsor
using
the
last
month
to
make
adjustments
I
think,
based
on
some
of
the
conversations
that
we
saw
here,
but
I
did
want
to
ask
some
clarity
so,
and
this
may
be
from
the
bill
sponsor
himself,
but
if
the
bill-
if
if
this
goes
on
to
the
Charter
and
the
voters,
were
to
approve
it,
how
soon
would
the
bill
then?
What
how
soon
would
this
go
into
effect
for
city
employees?
Would
it
happen?

I
believe
the
legislation
become
effective
when
the
election
was
certified,
although
it
happened
to
personally
double-check
with
the
law
department
because
I'm
a
hundred
percent
sure,
but
that
is
my
understanding
that
it
would
be.
The
change
would
take
effect
in
the
Charter
by
the
spring
and
then,
of
course,
the
board
would
have
to
do
the
implementing
regulations
which
it
would
do
over
the
summer
does.

then
I
assume
that
should
counsel
should
the
bill
make
it
out
of
committee.
If
it
went
through
council,
you
would
be
working
fairly
quickly
on
it,
or
are
you
planning
to
wait
until
the
election
would
be
until
the
electorate
would
vote
on
it?

would
you
anticipate
that
you'd
be
looking
at
regulations
should
they
have
to
change

As
I
said
to
my
testimony,
we're
very
glad
that
councilman
greens
office
was
open
to
having
those
kinds
of
conversations
with
us
and
and
in
particular
hearing
suggestions
that
we
had
to
make
again
from
the
sort
of
technical
perspective
of
you
know.
We
heard
these
concerns
at
the
hearing.
Anticipate
the
board
would
share
those
concerns,
and
you
know
in
terms
of
how
you
might
address
them.
There
could
be
specific
provisions
in
the
legislation
in
order
to
mitigate
those
types
of
risks
and
concerns,
and.

No
I
mean
the
board.
You
know
hasn't,
had
a
chance
to
discuss
or
deliberate
on
this
legislation.
So
I
expect
that
we
do
that
in
February,
that
they
would
talk
through
the
legislation
and
would
welcome
any
members
of
the
committee
or
staff
members
of
theirs
if
they
wanted
to
come
to
the
meeting
if
they
had
any
thoughts
to
share
or
just
participate
in
the
conversation,
but
that
the
board
after
having
that
conversation
would
I
expect
take
a
position
one
way
or
another
with
what
it
thought
about.
The
legislation.

I
mean
I
always
have
a
concern
when
something
significant
changes.
Just
as
a
practical
matter.
You
know
you,
you
never
know
exactly
how
it's
gonna
play
out
or
how
folks
will
react
to
the
new
rules,
I'm,
confident
that
we
will
get
the
regulations
done.
I
am
confident
that
they
will
do
a
good
job
of
explaining
the
rules.
We'll
get
the
opportunity
for
members
of
the
public
to
participate
in
the
regulatory
process
to
the
here
and
in
sharing
their
thoughts.
So
I
think
what
will
come
out
of
that
will
be
good.

Think
the
bigger
challenge
is
going
to
be
the
educational
component
that
councilmember
green
touched
on
of
really
reaching
out
to
and
educating
city
employees
to
make
sure
they
understand
what
they
can
and
can't
do.
I
mean.
Fortunately,
we
have
been
for
the
past
few
months,
really
increasing
the
number
of
staff
that
are
participating
in
training,
really
ramping
up
our
training
program,
and
so
this
will
fit
into
that
and
we'll
sort
of
fit
into
a
framework
where
we
can
reach
out
to
people
but
I
think
that's
going
to
be
the
biggest
challenge.

The
statewide
offices
certainly
don't
have
the
same
level
of
connection
that
a
philadelphia-based
state,
rep
or
state
senator
would,
of
course,
you
know,
we're
all
impacted
by
state
government
as
well,
whether
it's
the
you
know,
Attorney
General's,
Office
or
the
governor
or
whatever.
That
does
have
a
lot
of
impact
on
citizens,
lives
and.

But
there's
no
threshold
minimum
as
what
I'm
saying:
okay,
all
right
and
then
my
last
question
is
for
a
committee
of
seventy
I
know
that
you
have
been
generally
very
conservative
when
it
comes
to
changes
in
ethics
laws.
So,
given
the
changes
in
the
ethics
law,
what
do
you
think
makes
Philadelphia's
laws
still
one
of
the
strongest
in
the
area
around
this?

That
was
a
lot
of
money
seventy
years
ago,
but
not
not
so
much
anymore
and
putting
someone
in
jail,
which
I,
don't
think
we're
gonna.
Do
we
haven't
done
that
either
ticket
parcels
allowed
it
to
to
modernize
the
up
line
structure.
There
is
a
notable
improvement,
so
those
changes
make
us
feel
much
more
comfortable.

mean
on
alig
knowledge
like
this.

headlines
that
come

are
off
around
real

some
not
and
then
there's
still
a
lot
of
folks
who
do
break
the
rules
and
some
times
they're,
not
city
officials,
they're
out
of
state,
the
federal
folks
who
don't
have
the
same
rules
or

a
lot
of
things
have
changed
between
now
and
the
mid
20th
century
and
then
over
the
last
15-20
years
as
well.

independent
board
of
ethics,
pay-to-play
rules,
campaign,
finance
I
mean
all
that
stuff
has
had
a
real
effect
and
I
think
we
have
to
acknowledge
that
the
other
thing
I

able
to
do
over
the
past
couple
months
is
speak
to
folks
in
other
and
in
other
jurisdictions,
and
you
know
what
I
learned
generally
was
that
the
issues
with
local
activity
violations
can
kind
of
to
two
camps.
One
is
around
folks
who
accidentally
trip
over
the
rules
and
I.

Think
that's
that's
especially
given
these
changes,
but
we're
go
into
effect
this
year.
That
I
think
that's
that's
concern
and
I
know
Mr,
Cook
and
and
and
his
his
office
do
everything
they
can
to
get
the
regulations
done
and
get
the
training
materials
out.
There
run
the
trainings,
but
there
that's
still
a
concern
for
our
folks
will
acts
on
the
trip
over
the
rules
and
then
also
this
is
I
mean
less
calm
and
they're.

have
such
a
hard
time
recruiting
people
to
be
committee.
People
election
boards
and
I
say
this
because
I
know
folks.
Who've
worked
with
us,
for
instance,
who
work
at
a
council
office
cancer
on
election
board,
giving
your
recent
rulings
and
stuff
how
do
them?
Folks
from
those
officers
from
those
offices
that
we're
now
restricting
further
to
Sheriff's,
Office,
DA's
office
and
Commissioner's
Office,
feel
about
this.

So
councilman
with
regard
to
the
restriction
on
employees
serving
on
election
boards,
that's
actually
restricted
not
by
the
political
activity
restrictions
but
by
the
dual
office,
holding
provision
of
the
Charter
and
by
the
state
election
code.
So
this
legislation
wouldn't
affect
that
and
actually
our
office
doesn't
administer
those
provisions.

they
would
stay
the
same
as
they
currently
are?
The
the
effect
of
the
legislation
would
be
for
folks
in
our
office
and
those
other
ones
that
you
mentioned,
that
the
rules
would
just
stay
the
same.
They
would
become
more
relaxed

other
city
employees,
in
the
sense
of
allowing
them
to
volunteer
for
certain
campaigns.

law,

the
sponsor

clarify

For
me
around
the
amendment
and
Section
B,
it
says
the
exemption
for
participation
and
non
manager
or
volunteer
activity
in
support
of
a
candidate
shall

city
commissioners
or
district
attorneys,

why
we
listing
them

the
District
Attorney's
Office

Safety,

those

offices

point

view

maintaining

partisan

how
you
operationalize
it
and
I
just
want
to
make
sure
that
it
in
our

increased
participation.

the
spirit
of

is
being

create

pathway
for
folks
to
have
their
First
Amendment
right
to
be
engaged,
so
my
concern
is
just
again
because
I
know
between

Commissioner's,
Office
and
other
places.
Filling
these
volunteer
roles
gets
more
complicated
right.

hundreds
of
spots
that
are
open,
that
the
messaging
and
how
we
message
this
and
how
we
operationalize
it
is
important,
because
then
it
becomes
the
people
who
know

how
to
get
around
the
rules,
who
are
better
informed

good
lawyers
figure
it
out,
and
then
everybody
else
is
like
I
got
to
be
hands-off
because
we're
scared
right.

just
we
have
to
be
cognizant
of
that
and
again,
the
irony
of
me
saying
that.

compromise

different
issues
from
trying
to
make
it
closer
to
the
Hatch
Act
dealing
with
the
ability
for
people
to
exercise
their

Amendment
rights
to
participate
in

civic
process
of
Elections,
but
also
a
timing
issue.

Part
of
the
timing
issue
and
concern
is
that
you
know
our
primary
is
April
28th.
If
the.

we
want
to
have
anything

that
ballot,
it
would
have
to
come
out
of
committee
basically
this
week,
and
so
there

those

want

participate
in
local
activity
in
2020,
because
the
importance
of
this
year

take
the
opinion
that
this
aspect
of
our
city
laws
would
have
been
changed
years
before.

resources
decided

and

on

commentary

a
law
professor

hearing

person
probably
would
have

my
perspective

my
legal

people

would
have
been

hard
to
defend
the
overly
restrict
nature
of
our
restrictions
on
plug
activity.

have
impact
on
people

have
participate
in
the
Civic

timing
was
challenging

people
want

participate
in
activity
in
2020

balance

city
employees
to
participate
in
statewide
elections
that
are
at
the
state
level,

federal
level,

also

of
the
concerns

committee
assembly

about
being
engaged
in
local
races,
even
a
local
congressional
race.

are
in

having

to
labor
rights
and
uplifting
workers
here
in
the
city
of
Philadelphia.

still

a
Congress
that
is
actually
rolling
back
labor
rights
and
standards
and
an
administration
that
is
doing
so,
and
so,
when
those
things
happen,
it's
got
to
be
up
to
us
and
here
in
one
of
the
biggest
cities
in
the
nation.
With
such
a
strong
history
of
labor
rights,
labor,
organizing
and
powerful
and
progressive
labor
unions,
we
have
the
chance
to
really
lead
the
way.
I
am
so
proud
to
be
part
of
a
city
council
that
has
truly
led
the
way
on
groundbreaking
labor
reforms.

rights,
the
rights
that
we've
created
here
through
City
Council,
are
only
as
good
as
our
ability
to
educate

public
and
our
fellow
neighbors
that
they
have
these
rights
to
educate
our
employers,
that
we
will
enforce
these

ensure
that
we
have
a
path
to
to
making
sure
that
these
things
are
upheld
here
in
the
city
of
Philadelphia.

ordinance
will
allow
us
to
create
a
permanent
office
of
labor
that
will
continue
to
uphold
and
support
labor
relationships.

relations
rather

representative
city
employees,
ensure
that
our
city
contracts
and
our
city
laws
are
upheld
for
them
to
to
ensure
that
we
have
robust
enforcement
of
our
laws
and
one
of
the
most
important
ones.

me

that
we
are
truly
invested
in
educating
the
Philadelphia
philadelphians
and
the
companies
and
businesses
that
do
work
here
and
hire
our
employees
that
we
have
a
powerful
labor
enforcement
agency

enforce

rights

survive

creation

Department

Labor

a
Board

Labor
Standards

revive

of
such
department
in
such
board
and
to
otherwise
provide
for
incorporation
of
the
Department
and
board
into
the
city
government
and
providing
for
the
submission
of
the
amendment
to
the
electors
of
Philadelphia.
This
Charter
change
represents
a
pivotal
moment
in
the
history
of
Philadelphia.
Our
residents
have
fought
long
and
hard
for
their
rights
as
employees.

They
fought
equally
hard
for
a
city
government
that
could
view
as
a
partner
in
protecting
their
interests.
They
have
found
that
partnering
in
this
administration,
and
you
will
and
with
all
these
men
and
all
our
councilmembers
mayor
Kenney,
has
been-
has
been
committed
to
workers
rights
since
the
beginning
of
his
time
as
a
public
servant
during
his
time
in
council.
More
recently,
as
mayor
he's,
backed
up
the
commitment
by
becoming
the
first
mayor,
to
establish
an
integrated
office
of
labor
to
serve
as
a
central
location
for
both
internal
and
external
workers
rights
issues.

However,
as
we
are
aware,
mayor's
offices
rise
and
fall
depending
on
the
priorities
of
the
sitting
mayor.
This
administration
is
aligned
with
council
and
thinking
that
there
should
not
be
a
threat
to
the
office
of
labor
simply
going
away
when
this
term
is
done.
Every
day
my
staff
hear
from
private
sector
workers
who
suffer
from
workplace
abuses
such
as
wage
theft,
refusal
of
sick
leave
and
threats
of
retaliation.

We
hear
internally
from
dedicated
city
employees,
who
may
be
the
victim
of
harassment
and
turning
to
us
for
support,
and
we
hear
from
our
labor
unions
about
grievances
and
the
technical
details
of
the
contract
rules,
and
we
know
that
these
issues
will
not
go
away
to
them
after
this
administration
completes
its
last
term.
Establishment
Department
of
Labor
through
charter
change
is
the
right
way
to
ensure
that
these
issues
remain
at
the
forefront
of
any
future.

Administration
is
the
net
natural
evolution
for
the
mayor's
office
of
labor,
and
it's
the
culmination
of
years
of
work
put
in
both
by
my
staff
to
build
out
enforcement
capacity
and
by
city
council
through
the
successive
work
of
protection
ordinance

you
have
passed
on
behalf
of
the
mayor,
I'd
like

say

working

members
in
similar
cities
throughout

Northeast

Guess,
more
importantly,
for
this
we
are
Union.

That
is
where
most
people
are
going
to
work
for
the
next
3040
years
in
this
city
and
in
this
country
and
unfortunately,
throughout
the
service
sector.
Employers
have
long
had
practices
of
doing
things
like
not
giving
paid
sick
days,
not
paying
living
wage,
not
giving
people
paid
time
off,
not
giving
people
childcare
leave.
The
biggest
employers
in
this
country
are
known
for
those
sorts
of
practices
Walmart,
and
you
can
kind
of
go
through
the
whole
list
and
we've
seen
that
and
saw
that
with
thousands
of
security
officers
in
hotels
all
across
the
city.

But
I
know
we
saw
that
with
3000
airport
workers
who
were
making
many
of
them
$5
an
hour
with
none
of
the
things
five
years
ago
that
have
been
passed
best
counsel.
Most
recently,
this
council
passed
the
first
just
cost
legislation
to
address
parking
workers
where
we
found
folks
who
routine
routinely
exploited
at
work.

We're
not
given
the
the
slightest
bit
of
dignity
at
work
and
are
continued
to
be
paid
poverty,
level,
wages
and
because
the
state
government
and
the
federal
government
have
failed
to
act
not
just
over
the
past
five
years,
but
over
the
past
30
years
to
really
address
those
issues.
It's
fallen
on
cities
to
step,
in
everywhere
in
the
country
to
stand
up
and
fight
for
the
workers
in
those
cities
and.

That
makes
sense,
because,
frankly,
that's
where
the
economy,
this
country
is
it's
in
cities
like
Philadelphia,
that's
where
most
people
live,
that's
where
most
people
work,
that's
where
most
people
are
gonna
live
and
that's
where
most
people
are
gonna
work,
it's
in
major
metropolitan
areas
like
Philadelphia,
and
so
when
employers
won't
do
it
and
the
federal
government
do
it
and
the
state
government
won't
do
it.
You
need
folks,
like
this
council
and
like
this
administration,
to
step
up
and
fight
for
the
citizens
and
that's
what
we've
seen
happen.

But
after
these
laws
get
passed,
that's
really
when
the
hard
part
starts
it's
when
you
actually
have
to
enforce
the
law,
it's
fine
to
pass
a
law
and
I
know.
I
mean
I've
worked
with
a
lot
of
you
almost
all
yet
and
I've
passed.
You
guys
have
done
really
amazing
things
for
workers
in
the
city.
Over
the
past
five
years,
I
mean
staff,
and
this
has
been
the
first
time
we've
had
an
administration.
I
was
in
my
experience.

Can
our
members
can
speak
to
that
just
in
prevailing
wage,
for
example,
where
that
law
has
passed
in
some
ways?
You'd
think
this
would
be
the
easiest
one.
Someone
gets
a
handout
from
the
city
and
in
return
for
getting
huge
amounts
of
public
dollars.
All
that
to
do
is
follow
a
wage
rate
that
they
get
from.
You
know
the
city
office
instead,
two
years
of
some
of
the
biggest
wealthiest
institutions
in
the
town,
Penn
Temple,
Drexel
CCP,
the
Community
College
of
Philadelphia,
saying
we
don't
care
what
law
you
passed.

Yes,
we
took
the
money,
we
don't
think
it
should
apply
to
us
and
then
what
happens
is.
Is
it
takes
the
mayor
which
they've
done
and
cat
living
the
wage
going
after
the
money
fighting
was
in
the
biggest
institutions
in
town
and
and
making
progress?
But
that's
really
what
happens
when
you
pass
laws
that
are
new,
where
you're
really
trying
to
make
things
better
for
workers?
You
have
to
put
the
infrastructure
in
place
to
let
that
happen.

know,
I
represent
a
union
and
in
Union
there's
a
whole
infrastructure
in
place
to
go
fight
for
workers,
but
I
I
have
to
wonder
for
those
folks
who
are
at
prevailing
wage
sites,
for
example,
or
Just
Cause
locations
or
sickly,
where
there's
not
a
work
organization
already
in
place
constantly
pushing
for
these
laws
to
be
implemented.
Do
they
even
know
that
such
a
law,
parts
of
them
is
anybody
telling
them
about
it?
Is
anybody
trying
to
make
sure
that
they
get
the
things
that
you
guys
have
stepped
in
to
do?

There's
a
reason
why
you
passed
these
laws
to
address
a
fundamental
need
that
the
city
has,
but
if
there's
no
enforcement
mechanism
and
there
aren't
people
to
go
and
force
it,
then
it's
as
if
council
did
nothing
at
all
and
the
life
of
a
regular
worker.
So
we
really
support
this.
You
know
I,
think
and
I.
Think
now
is
the
time
to
do.
It,
I
think
that
we've
had
really
five
years
of
counsel
attempting
to
address
these
issues,
passing
good
laws
that
really
do
address
issues
for
some
cases.

getting

been
on

train.
All

weights

working
with
receive

hey
cab,
you
don't

come

today,
we're
slow.
We
have
too
many
people.

Imagine
a
mother
that
has
children.

am
one

them.
Imagine
having
to
pay

bills

you
get

phone

don't
come

don't
need
you

hotel.

clean
rooms

people

afford

rooms,

I

afford

room

I
live

me

my

the
world

the

non-union
workers.

fighting
poverty.

fighting

dignity

go

jobs
every

not
secured.

Work
Week,
passed
or
when

asked

help
to
pass
this
bill,

was
so
excited
and
willing,
like
I,

many

asking

your

getting

parents

efforts
and
your
hard
work,

able
to
get
it
past
four
US
citizens
in
Philadelphia
that
works

service

office
of
Labor,
we
kind

went

government

pulled
out
different
units
that

their

pulled
them
into
three
different
units
underneath
of
myself
to
to
lay
it
out.
The
three
units
are
employee
and
labor
relations.

internal
group

contract,
CBA
work

grievances,
unfair
labor
practice,

also
does
the
training
and
enforcement
for
sexual
harassment,
EEO
complaints,
so
that
all
stay
at
all
be
internal

deals

long
internal
workforce.

other
two
that
are
external,
mostly
are
prevailing.
Wage
labor
standards
unit
that
does
that
sets
prevailing
wage
for
public
works
projects
and,

Gabe
had
mentioned,
also
sets
prevailing
wage
for
institutions
that
give
financial
interest
from
the
city.
So
we
set.

rates
is
all
for
building
service
workers,
so
that
unit
does
that
and
then
the
third
units,

newest
unit,
which
a
lot
of
members
in
here
have
worked
with
very
closely,
is
the
office
for
benefits
and
wage
compliance.
That's

group
that
handles
all
of
our
external
worker
protection
laws,
paid
sick
leave,
wage
theft,
Fair
Work
Week,
coming
domestic
workers,
Bill
of
Rights
and
also
21st
century
wage
of
that
unit
also
works

all
those
bills.

questioning,

we

budget
season

get
a
sense

questions

reference

organization

this
department
and

laid

resource
will
be
allocated
for
this
new
department,
because
in
order
for
really

ability
to
help

inlay,
they

really
the
benefit

work
they

this
type
of
legislation
on
the

more
centralized

be

budget

us

continue

in
employees
in
those

call

ask
questions
about,
even
if
they

not
sure

they
that
they're
at
their

already
get
it
or

goal

a
voice

whether
we
need

more
enforcement

in

ten

elected

it

real
help

real

look
at

labor
issue,

anti-poverty
issue,

bringing
people

subsistence

able

providers

their

that

say

recently
with

security
guards.
We
took
a
stand
in
the
middle
of
broad
street
and
said
what,
if
you,
if
you
come
through
here
with
more
support
folk,
getting
those
kinds
of
things,
so
we're
not
new
to
this,
and
we
then
are
supportive
of
what
labor
can
do.

But

going
to
tell
you
right
now:
it's
not
enough,
because
here's
what
I
want
I
want
you
to.
Also
when
you're
checking
on
air
to
look
at
wages
and
all
those
other
things
is
there?
Inclusion
of
minority
and
female
staff,

that's
a
box
that
can
get
checked
right
now,
yeah
when
we're
looking
at
OSHA,
because
you
had
us,
sit
right
at
this
table
and
and
fight
for
over
7500
recommendations
to
make
sure
that
people
on
those
work
sites
are
safe.

assured

box

boxes
are
being
checked
equally
to
the
amount
of
people's
bed,
because
what
is
a
paycheck
if
you're
not
safe
and
your
family
has
to
prepare
because
a
crane
fell

list
of
what
you
are
going
to
be
checking
for,
and
one
of
them
needs
to
be
female
and
a
minority
participation,
because

didn't
hear
any

that

any

before

connect

people

passed

violators

laws

not
great
employers
at
all

when
we
peel
back,

peeling
back
an
onion
when

peel

layer,

up
seeing
all
these
other
issues

refer
them
to
other
city
departments
to
handle
that
that
are
not
on
there
our
purview.

that
goal
is
once
you
see
these
employees
coming
in
and
they're
talking
to
us
and
they're
starting
to
tell
us
what
happens
in
the
job
or
what's
going
on
with
their
employer.

think
it's
a
two-way
street
and
we
have
to
also
be
open
in
the
business
sector
as
well
to
work
with
especially
small
businesses
to
make
sure
they're
complying
and
because
they
want
to
most,
businesses
want
to
comply
and
they'll
come

say
we
want
to
comply.
We
didn't
know
we
were
violating
the
law
and
we
want
to
make
sure
that
we
help.
Those
folks
can
also
help
the
employee
as
well.

it

sure
pathway
to
risking

livelihood

real

mean
this

we
see
experienced
workers

time

people
are
doing
everything
they
can

just
to
feed

families,

when
there
are
federal
laws
that
are
in
place

knows

too
scared
to
say
something

office

people
gives
them

way
to

the
economic
ramifications,
arts,

city

these
laws

positive

Employers
only
want

playing

they're

bad
employers
actually

up

city
money

you're

fix

take
care

doing

example

prevailing
wage,

public

decent
wage

someone
doesn't

doing

the
city
basically
loses
credibility,
money,

name
it
and

it's
continuing
to
hand
out
money
to
that
very
entity
right

the
city
could
be
getting
a
much
bigger
public

for
the
money
it's
already
giving.

folks

normally
participate

experience

want

role

council

don't
know
who
the
next
mayor
is
going,
but

know

the
last
mayor
wasn't
always
with
us
when
we

navigating

mayor

come

willingness,
obviously
led
by

deputy
mayor
laser

others
to
figure
out
how
to
navigate
this,
but
I
would
say
to
you
that
over
the
next
decade
we're
gonna
have
even
more
challenges
around
this
right.

hear
the
narratives
around
whether
it's
the
underground
economy
and
other
stuff
and
I.
My
fear
is
those
are
buzzwords
for
excluding
people
who
have
been
historically
marginalized
from
certain
sectors
right
as
well
as
feeling
unprotected.

learned,
learn
from
SEIU
and
unite
and
others
undocumented
workers
feeling,
like
they're,
protected
with
domestic
workers.
We
saw
that,
and
so
in
that
spirit,
I
want
to
make
sure
that
there's

balance

the
power
and
the
decision-making
as
we
shape
these
laws
and
operationalize
them,
because
the
next
administration
may
not
be
as
friendly
right
and
then
we're
back
to
a
council
led
kind
of
reform,
movement,
and
so
I
will
formally
put
that
in
because
I
think
councilman
Jones's
point
and
Councilman
bass.

enough

happens

we
pass

fills

hard
work

listening
to

like

wait:

months
for

work
week
to
go

effect,

know

there

employers
who
won't
enforce

enforced

think
the
tremendous
work

you've
done

show

much
it
takes

get
prevailing
wage

city

employ

unions

sites

receive
city
subsidies

get
Just
Cause

our
parking
workers.

had
to
hold
rallies,

mayor
directly
involved
and

show
it,
but
if
the
city
government
puts
its
full
weight
with
an
enforcement
agency

investigators

collaboration,

that's
a
big

want

look
like

city
government
coming
down
on
a
handful
of
businesses.

processing

reporting
instances
of
employee
misconduct
and
provide
information

workers

someone

works
in
the
food
service
industry,
I
work
with
people
did
not
speak.
Many
of
my
co-workers
are
people
who
are
not
fluent
English
who
have
a
disability,
and
none
of
us
can
afford
to
lose
our
jobs.
We
deserve
to
have
an
independent
labor
office.

study
conducted

shallow
center

social
justice
in
2015,
the
philadelphia
metro
area
has
120,000
minimum
wage
violations,
a
hundred
thousand
overtime
violations
and
83,000
off-the-clock
violations
violations.

workplace
labor
laws
like
waste,
not
only
cost,
families
become
food,
insecure
meaning
they
have
to
choose
between
necessities
like
food,
housing
and
clothes,
but
they
also
hurt
our
local
economy.
According
to
the
same
report
conducted
by
a
Temple
University
sheller
Center
for
social
justice,
wage
theft
accounts
for
more
than
10
million
lost
and
business
tax
revenue.

has

cited
both
nationally

locally
for
having
enacted
some
of
the
most
progressive
worker
protections
in

country.

applaud
our
City
Council
members
for
the
passage
of
paid
sick
leave,
Fair
Work
Week
prevailing
wage
and
the
domestic
bill,
a
workers
bill
of
rights
legislation.
We,
the
members
of
crew,
firmly
believe
that,
in
order
for
the
great
working
people
of
Philadelphia
to
reap
the
full
benefits
of
this
legislation,
we
need
a
fully
staffed
permanent
Department
of
Labor
to
oversee

two
essential
components
that
make
the
legislation
work,
education
and
enforcement.

Pennsylvania

recently
conducted
surveys
which
have
concluded
that
the
vast
majority
of
Philadelphia
workers
are
aware
of
their
rights.
Philadelphia
workers
began
or
earning
paid
sick
days
on
May
13
of
2015,
yet
many
workers
have
no
knowledge
of
these
rights.
I
had
restaurant
workers
come
and
speak
with
me
as
recently
as
three
weeks
ago
and
did
not
understand
that
they
had
the
right
to
paid
sick
leave
a
permanent
and
fully
staffed
and
funded
Philadelphia
Department
of
Labor
is
absolutely
essential
for
these
strong
labor
laws
to
have
any
meaning.

bargaining

our
students
learning
conditions.

student
body

students

color,
including
immigrants,
first-generation
college
students,
older
adults
returning
to
school
for

career

veterans.

the
students

future
workers

benefit

the
hod
hard
fought
contract
provisions
that

class
size
caps,
staffing
ratios

well
as
counselors
advisers,
librarians
and
Learning
Lab
faculty,

Department

importance
of

Our
contributions
to
our
city's
public
institutions

the
overall
economy
of
this
city

recognize
that
unions

provide

pathway

poverty,

Department

organized
labor

key
