Fink

I
am
the
chief
code
official
for
the
department
of
license
and
inspections.
I
am
here
to
provide
testimony
on
behalf
of
the
department
in
support
of
bill,
one
eight
zero,
three
four
8,
which
will
amend
title
for
the
photo
Fiat
code
entitled
the
building
construction
and
occupancy
code.

Currently,
the
Philadelphia
Building
Code
requires
that
newly
established
businesses
that
generate
refuse,
that
is
to
be
disposed
of
through
the
use
of
a
dumpster,
provide
a
location
within
the
building
or
on
the
premises
for
the
storage
of
that
dumpster.
This
requirement
has
existed
in
the
building
code
since
1989.

This
bill
will
amend
the
foot
off
your
property
maintenance
code
to
require
that
all
such
business
businesses
maintain
those
dumpsters
in
the
pub
in
the
building
or
within
an
enclosure
unless
they
have
obtained
prior
approval
from
the
streets
department
to
store
their
dumpsters
in
the
public
way.
This
bill
will
provide
an
enforcement
tool
for
the
department
to
have
owners
clean
up
unsightly
dumpsters
and
hide
them
from
the
public
view.

Usually,
the
Suites
sweeps
inspectors
that
are
going
out
inspecting
those
dumpsters
that
are
looking
at
the
ones
in
the
public
way
to
make
sure
that
they
are
licensed,
because
the
idea
is
that
the
streets
department
is
kind
of,
particularly
in
Center
City
frozen
their
approvals
for
dumpsters
in
the
public
way.
So
what
they're
really
concentrating
on
is
any
addition
of
new
dumpsters
in
the
public
way
that
we're
never
licensed
so.

just
a
general
question:
I
have
us
want
to
make
sure
anything.
Let's
talk
about
this
earlier,
but
when
you
drive
around
the
city
and
you
see
on
back
alley
of
streets,
especially
in
the
urban
center
city,
core
area,
see
all
these
dumpsters.
These
people
that
have
applied
for
licenses
to
put
those
dumpsters
on
the
sidewalks
in.

know

think
I.
Think
it's
you
know
the
problem
is
we
have
old
real
estate
here,
so
it's
very
hard
to
accommodate
the
rebirth
of
some
of
this
real
estate
with
all
the
trash
that's
generated,
but
I
understand
that
issue.
So
have
you
ever
looked
into
other
ways?
There
are
other
countries
that
actually
are
putting
the
trash
below
the
sidewalk,
so
it
goes
down.
So
we
didn't
see
it
not.

just
as
a
follow
up
I
remember
when
the
medallion
bill
was
put
together
to
give
him
credit.
Former
councilman
bill.
Green
came
up
with
that
idea
and
it
was
kind
of
a
compromise,
because
I
think
we
talked
about
a
lot
of
these
streets
in
Center,
City
and
the
cuff'
births
and
the
Moravians,
and
all
that
just
have
become
dumpster
alley.
You
know
and
we
were
trying
to
figure
out
a
middle
ground
on
these
kind
of
things.
Interesting
enough.

My
understanding
is
that
New
York
has
a
law
where
you
can
only
keep
dumpsters
out
for
a
couple
hours
per
day.
They've
somehow
figured
it
out,
but
we
haven't
quite
figured
it
out
yet,
but
I
think
it's
the
reason
that
was
stated
that
a
lot
of
these
older
buildings
are
just
not
any
place
to
accommodate
them,
but
it's
something
I
think
we
should
keep
working
on
because
these
streets,
some
of
these
side
streets,
are
ridiculous,
but
I,
certainly
you
know,
support
this
bill.

just
for
the

we've
been
working
with
the
Planning
Commission
I

10
else,
tops
and
I've
not
been
able
to
get
them
to
tell
me
how
we
help
people
store
trash
so
that
I
can
get
small
units.
So
we've
been
working
on
this
issue,
so
any
ideas
that
folks
have
I
will
walk
on
them.
I
think
we
want
to
incentivize
residential
living
along
the
L
and
the
challenge
is
trash
and
trash
storage.

Some
of
them
don't
have
access
to
alleyways,
and
you
know
the
last
thing
we
want
to
do
is
eat
up
a
tremendous
amount
of
footprint
in
inside
the
building
for
trash,
but
at
the
same
time,
we've
recognized
that
for
smaller
units,
people
are
not
gonna
store
trash
for
a
long
time.
So
it's
a
challenge.
So
I
echo
your
sentiments
as
someone
who's
been
waiting
for
a
year
from
the
Planning
Commission
to
get
an
idea
to
make
it
work.

the
committee
leasing
the
space
inspections
again,
my
name
is
Michael
Fink
and
I
am
chief
code
official
for
the
department
I'm
here
to
provide
testimony
on
behalf
of
the
department
supported
bill,
1-800
464,
which
will
amend
title
4
of
the
Philadelphia
Code
entitled
the
building
construction
on
occupancy
code.
Currently,
the
Philadelphia
Building
Code
and
fire
codes
classify
a
building
that
contains
sleeping
units
where
residents
share
bathroom
or
kitchen
facilities,
such
as
a
rooming
house,
a
boarding
home
fraternity
or
sorority
house
as
congregate
living
facility.

When
these
congregate
living
facilities
have
16
occupants
or
less,
they
are
regulated
the
same
as
a
single-family
dwelling.
While
the
codes
have
required
newly
constructed
single-family
homes
and
congregate,
living
facilities
to
have
hardwired
smoke,
alarms
since
1998
and
have
fire
sprinklers
installed
throughout
the
building,
since
2011
existing
homes
and
congregate,
living
facilities
only
require
battery
operated
smoke
alarms.
However,
people
who
live
in
most
rooming
homes
to
bring
small
appliances
such
as
microwave
ovens
and
many
refrigerators
into
their
sleeping
units
in
many
existing
facilities.

These
appliances
overload
the
electrical
circuits
meant
to
handle
only
bedroom
lights
or
fans,
and
this
can
result
in
a
fire.
This
bill
will
amend
the
philadelphia
fire
and
property
maintenance
codes
to
provide
for
increased
fire
safety,
protection
of
existing
congregate,
living
facilities
by
requiring
one
hardwired
smoke
alarm
on
each
floor
to
supplement
or
replace
the
required
battery
operated
smoke
alarm.
It
also
requires
these
hardwired
smoke
alarms
to
be
interconnected
so
that
when
one
activates
they
all
activate
today's
technology
provides
smoke.

Alarms
that
can
enter
inter
connect
wirelessly,
thus
decreasing
the
overall
cost
of
installing
these
devices
and
existing
facilities.
This
bill
also
provides
for
a
retrofit
period
to
allow
operators
of
congregate
living
facilities
to
have
the
required
hardwired
smoke,
alarms
installed
by
a
licensed
electrical
contractor
before
the
end
of
next
year.

most
cases
were
talking
about
hrow
hams
in
the
homes
and
the
typical
layout
of
that
would
render
one
of
those
in
in
the
hallway
we're
on
the
first
floor
and
in
the
basement,
even
even
with
that
minimal
coverage,
we
still
have
a
greater
coverage
of
the
facility
than
we
would
with
battery-operated
I.
Think
the
failure
and
battery
operated
are
twofold.

We're
approaching
the
the
10-year
lifespan
of
the
ones
of
the
smoke,
alarms
that
required
almost
10
years
ago
for
these
battery-operated,
so
those
should
be
coming
to
the
end
and
their
life
expectancy
anyway,
and
we
find
that
battery
operated
smoke
alarms
are
more
easily
removed
by
the
tenants
or
or
not.
They
are
not.
You
can't
actually
see
when
they're
they're
activated,
so
you
have
to
actually
test
them
with
a
hardwired
one
they're
lit,
and
you
can
see
from
below
that
that
the
smoke
alarm
is
still
active
at.

Yeah,
the
smoke
alarms
themselves
have
a
10-year
life
with
those
those
lithium-ion
batteries
and
they're
due
to
be
replaced
in
the
next
couple
of
years,
so
the
the
expense
for
each
one
of
those
is
in
the
neighborhood
of
about
$50,
so
owners
of
those
properties
would
have
to
install
those,
as
we
all
do
in
our
in
our
homes.

using
more
and
more
what
I
would
call
data
mining
to
try
to
determine
where
these
locations
are
because
actually
going
to
the
properties
has
not
been
helpful.
We
find
that
the
tenants
do
not
allow
us
in
to
even
make
an
inspection
to
determine
whether
or
not
it
is
a
congregate
living
facility.
Whether
or
not
it
is
even
rented
so
we're
using
more
data
to
try
to
determine
where
these
locations
are
and.

Two
other
questions:
I
mean
we've
noticed
in
the
work
space,
there's
more
cooperton
spaces,
whether
it's
we
work,
sir
Benjamin's
desk
or
I
pipeline
with
their
sharing
office
space
in
other
parts
of
the
country,
they're
doing
something
called
pad
share
where
they're
taking
houses
or
townhouses
and
splitting
them
up
like
a
three-bedroom
row,
home
and
they're,
renting
them
to
three
different
people.
Have
you
seen
that
is
that
been
prevalent
here
and
with
this
bill
then
applied
to
those
properties
that.

Specific
description,
I
have
not
seen
a
lot
of
that,
but
from
the
an
average
the
specters
view,
those
would
probably
look
no
more
different
than
than
the
facilities
that
we're
talking
about
here.
Just
from
a
visual
determination,
it's
hard
to
determine
what
the
contractual
relationship
of
the
different
entities
are
there
and.

You
before
I
recognize
councilman
Jones.
We've
been
really
concerned
about
again,
because
we
want
to
encourage
some
of
the
smaller
living
and
been
talking
to
PGW
and
pico
because
they
install
meters
without
verifying
whether
places
are
zoned
and
licensed,
and
so
we
would
probably
be
asking
this
committee
in
the
fall
to
engage
with
us
in
a
conversation
about
that.
Now
that
we
have
eclipsed
and
there's
a
there's,
an
easier
way
for
them
to
do
the
verification
right
now.
A
They
claim
that,
because
of
the
PUC
and
their
requirement
to
provide
service
at
request
that
they
don't
check.
But
clearly
that's
one
of
the
data
sets
that
we
need
to
bring
in
line
I,
see
too
many
of
multiple
meters
in
our
districts
and
without
the
renter
license
and
all
those
other
things.
So
this
is
something
that
that
has
come
up
and-
and
we
want
to
help
the
department
with
that
councilman
Jones.

although
you
can
consider
a
single-family
dwelling
having
up
to
16
people
the
same
as
you
could
a
congregate
living
facility,
once
you
actually
get
inside
these
locations
and
see
that
the
individual
bedrooms
are
locked
and
they
have
cooking
equipment
within
their
their
dwelling
units,
then
you
determine
that
they
are
congregate.
Living
facilities
and
not
operating
as
a
single
family
are.

The
property
owner
receives
a
compliance,
a
grace
appearance
for
at
least
two
weeks
for
them
to
record
to
Phi
the
violation
before
any
punitive
action
is
taken
and
the
summer
months
the
abatement
of
properties
takes
a
smaller.
Thus,
the
compliance
a
grace
period
is
longer
due
to
the
demand
for
clip
services.
In
addition,
property
owners
may
contact
the
clip
office
to
request
an
extension
of
their
compliance
or
grace
period
to
allow
them
more
time
to
rectify
the
violation.

clips,
if
clips
staff
abate
the
violation
on
the
property
or
vacant
lots,
the
property,
the
private
property
owner
will
receive
a
bill
for
the
cost
of
the
cleanup
plus
an
administration
administrative
fee.
Now,
if
clip,
must
clean
a
private
property
leaking
like
more
than
one
time
in
a
calendar
year,
a
penalty
will
be
imposed
on
the
property
owner
if
the
property
owner
does
not
pay
the
bill
for
our
services
or
the
penalty,

placed
on
the
property
and

inspected
for
exterior
property
maintenance
violations

will
allow
the
city
to
find
habitual
nuisance
property
owners
that
refuse
to
comply
with
property
maintenance
violations
on
a
yearly
basis.

positive

the
clip
program.
Folks
are
doing
a
good
job
out
there

you

sense,
probably

you
get
more
complaints,
so
really
people
the
time
that
you
first
notify
them
just
for
this
two-week
grace
period
can
be
longer
than
that
right.

possibly

we
suffer
from
the
affliction
that
our
eyes

drawn

dump.

absolutely
a
occupational
hazard.
We
cannot
all
right
and
so
I
called
it
in
I
call
it
an
airdrop,
I
started
texting
and
going
crazy
and
send
us
in
week
or
so
later,
I
come
back
in
the
trash.
Seemingly
is
still
there
I'm
losing
my
mind.

sending
in
my
second
strike,
halt
to
do
it.
Third,
two
weeks
later,
maybe
I'll
come
back
and
is
still
there
come
to
find
out.
You
guys
had
cleaned
it
up,
not
once
not
twice
but
three
times
it
was
different
trash,
but
it
all
looked
alike.
To
me
and
I
say
that
to
say
how
do
we
balance
there?
Whoever
owns
that
lot
is
just
as
much
a
victim
as
you
are
for
having
to
clean
it
multiple
times.
Are
we
also
working
with
the
Sanitation
police
to
look
at?

there's

lot

logistics.

actual
cameras
themselves,
the
motion
of
the
camera:
how
often
can
we
will
the
camera
go
without

battery
usage?
So
there's
been
a
lot
of
conversations.

things
that
still
need
to
be
worked
out,
but
in
residential
Ares
is
a
lot
harder
to
put
cameras,
as
opposed
to
some
far-off
corner
where
there's
less
traffic.

whole
issue

battery
life
mobility,
vandalism,
we've
we've
been
working
with
clip
because
we
as
soon
as
we
figure
it
out
they'll
get
the
resources
to
ramp.

Here
to
ask
you,
as
you
consider
this
legislation
to
consider
concerns
that
I've
experienced
the
first
is
being
charged
after
the
property
was
cleaned.
I,
guess
that
was
a
record-keeping
error,
but
it
couldn't
have
happened
within
a
week.
It
wasn't
a
case
of
dumping.
It
was
a
case
of
but
too
much
registration,
so
I
know
that
was
an
error.
I've
been
charged
for
bills
that
were
unpaid
until
I
found
receipts
for
half
of
them
and
the
others
were
several
years
old.
I
So
my
concerns
are
improvement
and
record-keeping,
a
need
for
improved
record-keeping
and
more
timely
notice
to
people
when
you
have
a
violation,
because
you
can't
account
for
a
bill
that
several
years
old
either.
Maybe
you
threw
the
receipt
away,
maybe
you
paid
it?
Maybe
you
didn't
pay
it,
but
in
the
several
years
it's
been
accruing
penalties
and
interest.
I
But
there's
no
way
to
do
it
so
I
hope
you'll
consider
some
way
to
get
out
from
under
it,
maybe
not
for
if
the.
If
you
have
liens
that
are
worth
more
than
the
property,
then
that's
obviously
a
problem,
but
sometimes
it's
worse
worth
less
than
the
value
of
the
property.
And
then
maybe
she
gets
something
back,
but
right
now,
I
don't
know
of
any
any
alternative
even
a
way.
At
one
time,
I
wanted
to
donate
property
to
a
community
group.
I,
don't
know
how
to
do
that
or
use
it
for
a
garden.
I

don't
live
nearby
and
it's
not
fenced
well
partially
fit
it's
partially
friends.
So
you
get
a
lot
of
dumping.
Yeah,
that's
a
little
bit
of
a
challenge
for
us
and,
as
you
can
imagine,
we
have
40,000
of
them
throughout
the
city.
So
from
time
to
time
we
will
make
an
error.
So
you
know
our
apologies
to
you
if,
in
that
the
record-keeping
is
done
by
the
Bureau
of
adjudication.

appealed
the
stuff
in
college.

they're
there
just

We
really

There
are
some
community
garden
groups
that
will
take
over
the
parcels
of
land,
and
sometimes
they
enter
into

memorandum

understanding
and
sometimes
they'll.

a
title,
transfer
and
I
know
in
very
unique
situations.

law
department
has
been
willing
to
work
through
those
gifted
situations
to
clear
those
titles.
It's
a
little
bit
complicated,
but
I
suggest
that
you
reach
out

President
Clark's
office
and
I'm
sure
he
can
connect
you
with

neighborhood
Community
Development
Corporation.

there's

been
we've
done
sin
in
my
district.
We've
done
some
cases
where
people
have
donated
property,
it's
a
little
complicated
because
there's
a
liability,
you're,
shifting
liability
and

if
there's
an
outstanding
debt,

sure
there's
a
way
to
make
it
work,
no
I.
