I'm
pleased
to
appear
before
you
today,
on
behalf
of
the
department
in
support
of
city
council
bill
number,
one:
nine
zero
one:
three
zero.

We
believe
that
love
luck
will
take
love
park
to
the
next
level
as
a
popular
destination
for
residents
and
tourists.
Love
luck
was
selected
as
a
concessionaire
through
an
RFI
and
RFP
process
that
began
in
2017
and
culminated
with
the
award
of
the
concession
in
June
of
2018
parks
and
recreation
received.
Several
RFI
proposals
and
several
qualified
restaurant
operators
attended
the
RFP
tree
proposal,
meaning
February
of
2018.

However,
Safran
attorney
submitted
the
sole
proposal
in
May
of
2018
Lovelock
and
Parks,
and
Recreation
signed
a
concession
agreement
in
March
of
2019
with
an
initial
term
of
one
year
and
up
to
three
annual
renewals,
the
initial
term,
converts
to
a
ten-year
term
upon
enactment
of
this
ordinance.
The
concession
agreement
also
provides
for
up
to
two
five-year
renewals
of
the
city's
sole
discretion.

Lovelock
has
agreed
to
pay
a
guaranteed
annual
fee,
ranging
from
sixty
thousand
dollars
in
the
first
12
months
after
opening
to
one
hundred
and
two
thousand
dollars
in
year,
20
plus
an
additional
1%
of
gross
revenue
based
on
Lovelock's
ten-year
projections,
the
combined
amounts
result.
The
combined
amounts
result
in
concession
fee
of
eighty-two
thousand
dollars
in
the
first
year
to
one
hundred
and
twenty
one
thousand
dollars
in
year.
Ten
that
concession
fee
will
be
used
to
maintain
and
provide
free
programming
in
love
park.

Love
luck
executed
an
Economic
Opportunity
plan
that
requires
the
best
in
good
faith
effort
to
achieve
MBE
and
WBE
participation
ranges
from
five
to
ten
percent
for
project
design
and
ten
to
fifteen
percent
for
construction
maintenance
and
operation
of
the
restaurant.
The
EOP
also
includes
workforce
diversity
goals.
Lovelock
itself
is
a
certified
WBE
registered
with
the
city's
office
of
economic
effort.

process
to
convey
this
parcel
of
land.
Upon
completion
of
this
competitive
process,
the
committee
has
recommended
conveyance
to
the
Goldenberg
group
Harvey
and
Robert
Speer,
and
the
badger
group
LLC.

facility

development

will

to
the

been
relocated
so
that

together

Street,
the
actual
health
center,

services

has
been
relocated

1930

Constitution
Health
Center,
where
its
co-located
with
other
medical
uses
and
facilities
and
there's
ample
parking
and
transportation
access
there
as
well.

lab
is
the
last
remaining
piece
which
will
also
eventually
go
over
to
that
location
as
well,

freeing
up
much

animal
control

in
the
city
of

animal
control
care
team
has
been

restricted
for
the
amount
of
space,
so
they
can
take
care
of
the
animals
in
the
City
Philadelphia
they've
they've
had
I
think
on
work,
unsafe
work
conditions.

both
physically
and
mentally,
for
not
just
the
violent.
You
know
the
employees,
but
the
volunteers
and
and
people
who
were
trying
to
care
for
our
dogs
and
make
sure
that
we
have
a

animals
that
we
have

safe
place.

though,

this
is
the
first
step
of
freeing
up
space
and
is
a
former
board
member
of

it's
been
one
of
my
frustrating
arguments
that
I've

been
trying
to
make
with
with
the
city
for
many
many
years
now

to
be
relocated,
and
this
pays
the
path
of
doing
so.

board
member

council
gentleman
Tom.
Who
is
going
to
carry
the
panther
on
trying
to
make
sure
that
we
have
good
work
conditions
and
the
conditions
for
for
animal
control
team
to
do
their
job.

free
up
space
to
have
you

happy
dogs
going
out
for
adoption,
sad
dogs
being
treated
in
an
efficient
way.
You
know,
we've
made
a
lot
a
lot
of
new
moves
with
with
the
board
before
I
left
by
expanding
the
board,
so
they
can
reform
the
animal
code
brought
back
the
defunct
animal
Advisory
Committee.
We
have
Reno
renewed
interest,
I
think
on
a
lot
of
the
activists
and
volunteers
that
are,
you
know.
Finally,
they
should
be
excited
about
vector,
relocating
and
having
the
space
of
their
own
and
having
the
conditions
of
their
own.

know
now
it's
time
to
move
forward.

rebuild
and
fix
the
current
conditions
of
all
that
in
in
this
upcoming
year.

be
proud

have
here
as
a
city
as
a
first-class
City,

animals
are
being
cared
for
it

almost
integrity
and
responsibility,

personal
project

have
pushed

it

facility

absolutely
amazing
per
vector

move
it's
actually

promotes

area

corridor

vacant,

I
understand
this
as
a
you

not
an
easy
issue
and
it's
something
as
a
councilman.
Large
I
don't
deal
with
directly,
but
I
know
that
it's
been
an
important
issue.
I
guess
I'm
just
trying
to
figure
out.

Essentially,
the
bill
is
taking
a
stab
at
properties,
some
of
which
are
governed
by
city
law,
around
city-owned
properties,
state
law
with
the
land
bank,
enabling
legislation
and
state
law
with
the
urban
redevelopment
law
and
trying
to
meld
all
those
together
and
make
sure
all
the
I's
are
dotted
and
T's
are
crossed
based
on
the
different
requirements
across
those
there's.
A
lot
of
detail
there,
weren't
just
ironing
out
that
out.
I
also
think
there's
some
issues
with
codifying
pieces
of
the
disposition
process
when
what
happens
on
a
piece
of
ground
is
so
disparate.

So,
for
example,
we
have
anything
happening
on
properties
from
a
side
yard
to
multi-year.
You
know
tens
of
millions
of
dollars
development
and
to
try
to
say
those
are
all
going
to
follow
the
exact
same
process
with
this
timeline.
It's
complicated
and,
and
so
I
think
those
are
the
things
that
we're
working
on
I
think
with
the
big
picture
items
we
do
have
agreement.
We
are
in
agreement
with
the
intent,
but
working
through
these
details.

It
takes
some
time
and
I,
don't
think
that
either
side
has
been
unwilling
to
meet
or
unwilling
to
to
roll
up
their
sleeves.
It's
just
every
time
we
meet.
We
make
some
progress,
but
there's
also
some
other
things
that
are
identified,
that
that
we
still
need
to
dot
some
I's
and
cross.
Some
teacher
since.

Think
we're
working
towards
it,
I
can't
I'm
not
able
to
commit
to
that
right
now,
but
I
know
that
we
do
have
some
additional
meetings
set
up
this
week
and
we
are
gonna.

we

all
committed
to
meeting

regular
basis
and
until
we
get
this
done,
I
think
we
all
want
to
get
this
done.

again,
this
is
a
big
deal
and
we're.

So
we
had
a
lot
of
work
that
went
in
and
then
what
came,
what
was
but
put
it
into
the
legislation
did
not
fully
reflect
the
work
that
have
been
done
prior.
It
picked
up
pieces
here
and
there,
but
again
I
think
when
you're
trying
to
take
from
sort
of
different
sources
and
melt
them
together.
It's
just
some
of
the
details
fell
out,
and
so
those
are
the
things
that
we've
been
working
through.
So.

we
really
hit
it.
I
guess
the
colons
removed
of
issues
when
we
have
areas
we're
trying
to
see
for
the
betterment
of
the
community
or
to
save
a
garden,
and
we
have
a
private
property
in
the
middle
of
a
garden
and
therefore
we
could
then
swap
a
property
out
to
the
end
of
the
garden
and
then
keep
the
garden
whole.
Things
like
that.

sort
of
prevent
ourselves
from
doing
that
and
we
and
we're
not
able
to
do
it
or
it's
so
complicated
that
nobody's
willing
to
do
it
and
we
end
up
losing
the
better
good
for
the
community.
Out
of
that,
so
I
mean
I.
Think
it's
something
that
we
need
to
do
to
be
able
to
have
that
option
available
and
there
could
be
regulations
in
place
and
things
to
protect.

there's
got
to
be
a
way
that
we
can
trust
the
people
in
the
community
in
in
our
departments
and
in
our
legislature,
to
understand
if
we're
trying
to
find
what's
best
for
the
community.
You
have
that
ability
to
do
that
and
without
it
makes
it
very
and
it's
very
frustrating
for
some
of
our
community
members.

in
this
process,
we've
really
have
moved
really
a
long
road
ahead
around
this
reform
process,
from
the
creation
of
an
FIR
doulas
position
by
council
president
Clark
to

consolidation

land

the
consolidation
of
the
housing
alphabet,
suit,
I
think
the
administration's
the
alphabet
soup.
The
administration
has
moved
towards
this
I
think
conceptually.
I
We
have
all
of
the
major
agreements
like
any
piece
of
legislation
how
the
administration
operationalizes
they
have
a
lot
of
discretion
around
some
of
the
issues
that
we
talked
about,
but
I
think
we're
very,
very
clear
that
the
you
know
that
we
need
the
strategic
plan.

between

and

purchase

of
what
we're
dealing
with
in
this
legislation

trying

create

by
city
law,
what's
required
by
state
land
bank
law
and
also
what's
required
by
state
redevelopment
in
law.

mean
that
we
may
not
get
exactly
there,
but
we're
trying
to
get
as
close
of
alignment
as
possible

certain
protections
are
in
place,
regardless
of
what
is
the
land
holding
entity.

start

thanking
Councilwoman
council
persons,
council
members,
Sanchez
I'll,
get
it
right
eventually,
and
the
council
president
for
sitting
down
with
us
and
and
their
staff,
to
walk
through
legislation
and
hearing
our
recommendations
and
addressing
our
questions.

So
we
do
appreciate
that
this
bill
will
make
several
important
changes
to
the
way
that
Philadelphia
manages
vacant
surplus
property.
First,
it
would
eliminate
the
vacant
property
review
committee
v,
PRC
PA
CDC
has
advocated
for
eliminating
the
V
PRC
during
the
debates
over
the
creation
of
the
land
bank.
Back
in
2013,
we
hold
a
seat
on
the
V
PRC
and,
as
such,
we've
seen
firsthand
the
important
work
that
it
has
done
in
overseeing
the
process
of
disposing
public
property.

But
the
goal
of
the
land
bank
was
and
still
is,
to
streamline
the
process
and
create
transparency
and
accountability
so
by
eliminating
the
V,
PRC
and
folding
its
functions
into
the
land
bank.
Philadelphia
moves
one
step
closer
to
having
one
land
holding
agency
with
an
open,
transparent
process
with
one
set
of
policies
and
procedures
and
one
path
tis
it
to
disposition.

City
Council
can
take
another
step
by
working
with
the
administration
to
transfer
all
remaining
vacant
surplus
property
into
the
land
bank,
including
the
inventory
that's
still
held
by
the
office
of
public
property
and
the
Redevelopment
Authority
pa
CDC
is
also
pleased
to
see
some
of
the
provisions
in
the
bill
that
established
a
scoring
criteria
for
properties
subject
to
competitive
bid.
These
criteria
highly
value
economic
opportunity
and
inclusion,
as
well
as
social
impact,
while
de-emphasizing
purchase
price.
We
do
support
policies
that
advance
long
term
equitable
development
goals
over
short-term
financial
gain.

Now
scoring
criteria
for
competitive
bids
already
exists.
However,
this
bill
makes
that
criteria
publicly
known
in
ordinance
for
the
first
time
and
but
it
will
be
important
for
the
definitions
of
the
scoring
criteria
to
be
more
more
fully
developed
as
part
of
the
land
bank
disposition
policies.
So
there's
uniform
agreement,
for
example,
on
what
Economic,
Opportunity
and
inclusion
means,
or
what
public
purpose
means.

We
also
do
request
that
the
bill
be
amended
slightly
just
to
ensure
that
the
scoring
criteria
results
are
disclosed
to
the
applicants
when
they
get
either
an
approval
or
a
denial
letter,
creating
some
more
transparency
about
how
that
criteria
is
being
applied
for
disposition
decisions
without
advertised
bids.

CDC
also
requested
that
the
bill
requested
the
bill
be
amended
to
define
affordable
housing
as
intended
for
properties
where
at
least
51%
of
the
rental
units
are
designated
to
households
below
80%
area
median
income
and
for
sale
units
below
120
percent
AMI.

While
we
strongly
support
prioritization
of
land
for
affordable
homes
that
serve
far
lower
income
populations,
this
would
give
the
land
bank
flexibility
to
support
development
of
mixed
income
rental
properties,
as
well
as
mixed
income,
housing
developments
under
the
that
program
and
workforce
housing.
As
well,
the
legislation
also
allows
the
land
bank
or
the
land
holding
agencies
to
discount
the
sale
price
for
a
nominal
or
less
than
fair
market
value
for
a
number
of
reasons.

While
we
strongly
support
this
concept,
some
of
those
categories
are
not
defined,
such
as
Economic
Opportunity,
design
and
sustainability.
So
we
really
hope
to
see
in
the
land
bank
disposition
policies
that
more
that
detail
is
fleshed
out.
So
it's
clear
and
we're
also
very
pleased
to
see
in
the
amendment
that's
been
submitted
today,
requiring
reporting
of
discounts
that
are
applied
in
the
land
banks
annual
performance
report.
We
also
recommend
that
that
include
not
just
the
that
the
discount
was
offered,
but
the
justification
for
the
discount.

Finally,
the
bill
also
could
require
that
the
amount
that
the
land
bank
pay,
the
city
of
Philadelphia
to
acquire
vacant
tax,
delinquent
parcels
at
sheriff's
sale.
It
limits
the
price
to
the
lesser
of
the
assessed
value
where
the
real
estate
tax
is
due
right.
Now,
there's
an
MOU
land
bank
and
multiple
city
agencies
in
the
school
district
that
requires
a
land
bank
to
pay
all
municipal,
liens
and
back
taxes
to
acquire
property.

and

property

legislation
seeks

accomplish

Philadelphia

bank.

are
concerned,
however,
with
the
provisions
in
this
legislation
aiming
to
establish
a
scoring
system
to
help
determine
how
best
to
move
property
out
of
the
Philadelphia
land
bank
into
the
hands
of
the
public.
There
are
good
sounding
terms
like
public
purpose,
social
impact
and
Economic
Opportunity
and
inclusion.

However,
there
are
no
firm
definitions
for
the
terms
in
this
legislation.
We
understand
that
the
land
bank
is
under
the
executive
branch
of
government
and
that
sometimes
there
may
be
limits
legal
and
political
to
what
the
legislative
branch
can
do
in
meddling
and
the
land
banks,
policies
and
procedures
sooo,
so
as
to
make
them
more
supportive
of
affordable
housing
and
other
community
uses.

legislation
fosters
transparency

process

disposing

means

the
public
must
see

developers

indigenous

knows
the
neighborhood

internal

projects

with
job

new
residents

are

poor

our

livings

delinquent

rustic
churches.

properties
are

conditions
have
become
blight
and

nuisance
and

haven
for
criminal
activity

local
neighbors
non-payment

taxes.
Obligations

owners

needs
to
be
a
quick
vetting
process
that
the
owner
may
be
able
to
do
a
payment
plan.

to

properties

non-profit
community
based
advocacy
and
development
organization
as
a
resident
I,
have
seen
firsthand
the
impact
of
the
for-profit
development
in
the
neighborhood,
particularly
after
its
designation
as
an
opportunity
zone.
Every
day,
I
hear
the
concerns
of
residents
losing
their
backyards.

They've
maintained
for
20
30
40
years
to
share
of
sales
without
any
prior
notice
or
having
their
homes
damaged
by
developers.
Contractors
who
do
not
respect
or
care
about
the
impact
of
their
projects
on
family
properties.
This
proposed
legislation
for
procedures
to
be
followed.
An
acquisition
of
city
property
is
one
of
the
keys
to
planning
for
future
development
of
our
neighborhoods
and
controlling
the
abuse
and
short
and
long
term
negative
impact
on
our
neighborhoods.

The
other
key
government
procedures
which
impact
our
neighborhoods,
which
also
need
to
get
dealt
with
our
zoning
and
legislated
financial
burdens
or
benefits
imposed
on
real
estate
as
I
read
the
legislation.
I
was
glad
that
the
vacant
property
review
committee
was
eliminated
as
a
process
for
acquisition
in
this
position
of
cities
properties,
as
at
times
it
seemed
lengthy
and
redundant.
The
proposed
process,
though,
is
concerning,
as
it
is
vague
in
terms
of
the
priorities
identified
by
the
city
for
the
disposition
of
its
properties.

What
does
30%
of
the
weighted
criteria
for
Economic,
Opportunity
and
inclusion
mean
one
might
think
it
gives
opportunity
for
low-income
persons
to
receive
training,
get
a
job
be
eligible
for
housing,
but
the
word
opportunity
has
become
questionable.
The
opportunity
zone
was
hailed
as
such,
and
so
far
the
only
beneficiaries
have
been
wealthy
investors
developers,
avoiding
payment
of
capital
gain
taxes
by
investing
in
poor,
neighborhoods
and
developing
quote
affordable
workforce
housing,
which
translated
into
current
reality
in
our
neighborhood,
means
a
one-bedroom
apartment
at
a
rent
of
1,200
to
1,400
per
month.

That
is
not
affordable
in
a
neighborhood
where
the
ami
is
17
to
20,000
per
year,
do
the
math,
but
that
is
the
ami
of
our
workforce
unless
we
are
more
specific
as
to
the
economic
impact
and
inclusion
and
what
that
means
and
how
it
gets
measured.
Our
poor
neighborhoods,
where
families
have
struggled
to
improve
and
maintain
mostly
without
city
assistance,
will
be
decimated
and
they
will
become
homeless.
It's
already
happening
as
people
sell
their
properties
to
these
developers.

These
lots
should
have
top
priority
for
city
council
to
legislate
a
simple
expeditious
process
that
provides
heated
titles
to
the
caretaker
of
these
properties,
with
no
restriction
on
use
so
not
limited
to
for
open
space
or
Gardens
liens
of
30
years
on
the
D
etc.
It
should
be
open
and
available
to
expand
their
home
to
accommodate
parents
or
their
children,
build
a
garage
or
sell
the
property.
Why
should
poor
people
be
limited
and
the
use
of
properties
they
have
maintained
for
30
40
years?

Why
is
it
that
only
the
well-to-do
get
the
opportunity
to
even
be
more
well-to-do,
they
can
sell
and
they
can
make
their
money,
but
the
poor
people
can't
so
again.
I.
Ask
that
you
address
this
in
this
legislation
of
acquisition
and
disposition.
Let
me
tell
you
a
quick
story,
so
we
have
several
residents:
who've
been
taking
care
of
their
lives
for
decades
and
decades
and
decades,
so
they
go
to
court
under
adverse
possession
they're
being
helped
by
a
nonprofit
who's,
helping
with
gardens
and
Lots.
They
assign
an
attorney.
The
lady
is
an
elder
lady.

She
only
speaks
Spanish,
so
she
goes
ready
to
go
to
court.
She
pays
for
the
court
car
she
gets
there
and
the
attorney
says
oops
can't
represent
you.
I
have
a
conflict
because
US
bank
lien,
and
so
they
postpone
the
case.
Then
she
gets
a
sign
two
months
later.
Another
attorney
who's
doing
it
pro
se
and
so
I
spend
the
night
explaining
translating
for
her
several
weeks
later
months
later
they
have
another
court
date
and
again
oops
can't
do
it
conflict
of
interest.

They'll
pay
taxes
forward,
but
it
has
to
be
included
in
this
disposition
property.
Otherwise,
we're
not
really
taking
care
of
the
people
who
have
suffered
the
most
from
the
blight
and
the
lack
of
maintenance
and
I
understand.
City
didn't
have
the
resources,
but
the
city
didn't
maintain
those
neighborhoods.
Those
people
did
second
concern.

There's
no
clearly
defined
priority
and
percentage
value
for
properties
to
be
developed
for
the
homeless
and
or
low-income
families
using
the
city's
ami
as
the
measurement
for
affordable
housing
assures
the
exclusion
of
families
where
the
neighborhood
ami
is
seventeen
thousand
to
twenty
thousand,
as
opposed
to
the
city
at
forty
thousand.
So,
for
example,
that's
the
ami
and
nor
square.
So
you
have
these
developers
coming
and
saying
they're
going
to
do
some
affordable,
housing
well,
affordable,
and
it's
at
forty
thousand
dollars.
Nobody
there
makes
$40,000.

Third
concern:
there
is
no
plan
proposed
for
the
identification
and
protection
of
the
cultural
footprint
and
heritage
of
the
neighborhood.
Philadelphia
has
a
long
history
of
how
minority
neighborhoods
have
been
decimated
through
the
process
of
gentrification,
particularly
when
advanced
and
exacerbated
by
governmental
incentives
such
as
tax
abatements,
Opportunity,
Zones,
and/or.
Zoning
density
bonus
legislate
as
part
of
the
acquisition
process.
That
30%
of
your
priority
is
going
to
go
impact
on
the
neighborhood
cultural
economic
footprint.
Is
it
going
to
have
a
negative
impact?
If
it
does
you
don't
approve
it?

Ten
parking
spots,
mostly
one-bedroom
apartments,
in
what
is
basically
a
row
home
single-family
neighborhood
of
two
to
three
story:
homes:
family
housing
is
not
being
provided
and
the
rental
and
the
sale
price
of
the
same
is
way
beyond
the
capacity
of
most
families,
as
our
ami
again
in
four
out
of
our
five
census
tracts
a
seventeen
thousand,
but
these
are
all
touted
as
workforce
housing,
which
is
what
you
have
prioritized
here.
Workforce
housing
pays
1200
to
1400
dollars
a
month
for
one-bedroom.
You
