140644: An Ordinance amending Section 9-203 of The Philadelphia Code, entitled "Street Vendors," by providing for the inspection and regulation of mobile food vehicles that use propane or other combustible fuel, adding definitions, providing for enforcement and penalties and making technical changes, all under certain terms and conditions.
140751: An Ordinance amending Section 9-204 of The Philadelphia Code, entitled "Sidewalk Vendors in Center City," by reducing the number of vendor locations permitted on the east side of 5th Street, from Arch Street to Market Street; all under certain terms and conditions.
140832: An Ordinance amending Title 12 of The Philadelphia Code, entitled "Traffic Code," Chapter 12-100, "General Provisions," by adding new definitions, and Chapter 12-900, "Parking Regulations And Penalties," by adding "live performing arts venue" to the entities exempt from paying fees for curb loading zone permits and adding a new Section, entitled "Performing Arts Priority Loading And Unloading Zones," providing for loading and unloading zones to allow easier access for performing artists to load-in and load-out at live performing arts venues around the City of Philadelphia; all under certain terms and conditions.

introducing
this
bill
to
address
two
loopholes
in
the
process
by
which
the
Philadelphia
Parking
Authority
collects
parking
ticket
revenue.
The
authority
continues
to
monitor
our
collections
process
and
when
we
find
areas
in
which
people
avoid
paying
parking
tickets,
we
attempt
to
address
those
issues.
As
you
know,
the
PPA
is
on
street
division
provides
significant
revenue
revenue
for
the
city's
general
fund,
as
well
as
the
Philadelphia
School
District.

Unfortunately,
there
are
two
groups
of
people
who
are
able
to
slip
through
the
collection
process.
The
first
are
those
who
do
not
properly
register
their
vehicles
with
the
Department
of
Transportation.
There
are
thousands
of
vehicles
with
open
parking
tickets
for
which
there
we
are
unable
to
get
the
owner's
name
and
address
as
a
result.
Under
the
current
system,
we
cannot.
They
cannot
be
added
to
the
boot
and
Totalus,
because
the
proper
notification
cannot
be
sent
by
mail.
This
bill
prevents
vehicles
in
that
category.

That
excuse
me
this
bill
permits
vehicles
in
that
category
to
be
placed
on
the
list.
If
we
are
unable
to
obtain
owner
information
but
have
received
at
least
one
parking
ticket
with
the
notice
of
crime,
with
the
notice
of
the
criteria
for
good
eligibility,
there
are
individuals
who
have
not
fulfilled
their
legal
obligation
to
register
the
vehicle
and
that
negligence
should
not
be
compounded
by
using
it
to
a
lula,
legitimate
collection
efforts.

The
second
issue
involves
those
situations
where
vehicle
owners
report
their
plate,
loss
or
lost
or
stolen
after
they
have
accumulated
a
number
of
parking
tickets
and
get
a
new
plate
and
start
fresh
and
accumulating
tickets.
This
proposed
ordinance
permits
the
authority
to
combine
all
open
tickets
for
license
plates
previously
or
currently
registered
to
them
and
determining
good
eligibility.

For
example,
if
I
have
a
license
plate
with
four
outstanding
tickets
and
got
a
new
license
plate
on
which
I
have
one
open
ticket,
the
current
law
would
not
make
the
vehicle
food
eligible
because
it
does
not
meet
the
three
ticket
at
threshold.
How
under,
however,
under
this
proposal,
the
tickets
from
the
old
plate
will
be
compliant
with
the
tickets
from
the
new
plates
or
permit
the
authority
to
place
it
on
the
boot
eligibility
list.
Both
of
these
measures
only
ensure
the
appropriate
steps
are
taken
to
collect.

The
money
which
is
due
check
is
your
schedule
for
Heba
tickets,
which
are
scheduled
for
hearings
are
not
included.
It
does
not
remove
the
notice
the
notice
requirement
for
those
vehicles
properly
registered.
It
only
addresses
those
situations
in
which
the
owner
has
taken
steps
to
avoid
pain.
One
is
legally
owed
and

would
ask
for
favorable
consideration
of
this
bill

vehicle
inspection
stickers,

for
expired
tags.
Many
years
ago
we
went
on
to
start
writing
tickets
for
expired
tags,
not
having
the
little
sticker
in
the
corner
and
I
made
that
decision
to
do
that,
and
it
became
a
very
large
problem
because
a
lot
of
people
don't
put
their
sticker
on
the
car.

you
won't
because
we
don't,
we
won't
know
if
between
ticket
number,
one
and
ticket
number
to
the
registration
was
processed
in
its
valid.
So
it's
only
after
the
third
ticket
comes
back
and
it's
boot
eligible
and
none
of
them
have
come
back
with
ownership
information.
It's
then
added
to
the
bhutto
file
and
then
it's
eligible
to
be
booted.

also
be
looking
at
the
tag
that
escaped
from
a
dealership
or
a
tag
agency,

it
could
have
a
current
sticker
on
it
because
most
of
it
comes
in
a
package
as
weary.

that
came
out

a
dealership,
they
put
that
sticker
on
the
on
the
tag
and
it
just
never
went
back.

someone

reported

tags,
stolen,
officially
and
tickets
are
issued
during
the
time
with
these
people
these
tickets.
What's

normal
regulation

want
is
we're
assuming
everyone's
guilty
as
opposed
to
everyone.

tag
is
reported,
stolen
and,
and
a
person
comes
in
for
a
hearing
or
sends
a
complaint
in
to
us
that
they
got
tickets
after
the
date
that
the
tag
was
reported
stolen.
We
cancel
those
on
the
police
report
and

are
for
tickets
issued
before
the
date
of
the
stolen
tag.
Many
stolen
tags
because
you
can
just
walk
in
and
report
them
stolen.
Our
result
of
individuals
accumulating
parking
tickets,
so
they
go
in.
They
report
it
stolen.
They
go
to
the
friendly
neighborhood
tag
agency.
They
do
everything
proper
to
get
a
new
tag.

they
are
free
to
roam
and
start
accumulating
more
tickets.
Again,
that's
what
happens,
we're
just
trying
to
close
the
loophole
and

efficient
in
towing
cars,
but
when
we
report
this
abandoned
vehicle
sitting
in
front
of
our
parking
lot
or
in
front

private
entrance

it's
like,
they
can
never
tell
it,
and
one
of
the
things
that
this
does.
It
now
allows
for
these
nuisance
vehicles
and
properly
registered
vehicles
to
to
finally
be
towed
and
I.

that's
one
of

biggest
complaints
that
I
certainly
come
across
is
how
can
how
come
we
can't
tow
away
these
abandoned
or
improperly
parked
vehicles
and

on
top

that,
what
I've
discovered
through

office

many
vehicles
there
are
in
Philadelphia
and
there
are
thousands
of
these
vehicles,
and
so
those
are
thousands
of
problems
and
thousands
of
perhaps
drivers
who
accumulate
tickets
and
switch
license
plates,
which
means
they
continue
to
violate
the
the
laws
of
Philadelphia
and
inconvenience
people.

parking
zones
are
established
and
regulated
by
the
Philadelphia
Parking
Authority
in
consultation
with
the
streets
department.
These
zones
are
intended
for
passenger
pickup
dropoff
and
to
be
used
as
a
location
for
valet
services.
I
The
department
of
streets
feels
that
exempting
christopher
columbus
boulevard,
where
many
upscales
clubs
and
high-end
establishments
are
located,
may
generate
high
demand
for
valet
services,
which
may
lead
to
traffic
circulation
and
public
safety
issues.
The
department
is
also
concerned
that
this
may
send
a
mixed
message
to
other
establishments
with
valet
services
in
the
city.
By
most
commonly
known
definitions.
Center
city
is
bounded
by
the
Delaware
River
to
school
river
and
from
South
Street
to
vine
street.
I
By
tweaking
this
definition
in
the
code,
it
opens
up
challenges
from
many
other
establishments
nearby,
who
have
different
interpretations
of
where
center
city
actually
lies.
The
streets
department
will
remain
neutral
on
fee
structure,
but
as
opposed
to
this
ordinance,
as
it
removes
both
christopher
columbus
boulevard
from
the
center
city
boundaries.

a
issue:

avenue,
columbus
boulevard

separated

center
city

what
we
found
out

that
the

cost
of
the
valet
parking
is
sort
of
prohibited,
valet
parking
from
being
used
in
a
lot
of
establishments.

what
we
found
out
is
we
want
to
try
to
as
we
grow
columbus
boulevard
along
with
the
water
there
we're
going
to
encourage
more
and
more
businesses
there.
We
want
them
to
use
valet
parking.
We
want
to
try
to
avoid
what
is
happening
now.
Is
there
are
people
parking
in
the
neighborhoods
going
into
the
neighborhoods
and
then
frequent
in
these
establishments,
which
is
causing
the
problem
for
the
community
surrounding
the
area?

doing

entice
more
businesses
to
open
up
ballet,
and

know,
maybe,
in

years,

we
see
this
is
working
well,

could
come
back
and
revisit
it
and
go
back
to

different
option

pay
scale.

bill
number
1,
500
92,
which
was
introduced
by
councilmember
Johnson
on
februari
12
2015
bill
number,
150
92
will
authorize
the
construction
of
the
steel
staircase
with
the
corrugated
roof
decking
on
the
southern
foot
way
of
ritenour
street
near
would
scoff
Woodstock
Street.
The
staircase
encroaches
four
feet
and
6
inches,
unto
the
foot
way
and
leaves
seven
feet
at
six
inches
walk
away
for
pedestrians.

proposed
encroachment
will
leave
sufficient
walking
zone
for
pedestrians.
The
City
Planning
Commission
recommended
a
bill
number
1,
500
92
for
approval
as
an
item
in
court
with
previous
policy,
and
this
concludes
my
testimony

testimony
on
bill
number
1,
500
95.
This
regulation
was
posted
on
December
second
2014.
As
a
trial.
We
have
not
received
any
complaints
or
concerns
from
the
residence
as
such.
The
Department
of
streets
has
no
objections
to
this
bill.
Thank

be

amendment
at

first
little
I,
where
the
semi-enclosed
cabinet,
where
the
propane
tank
can
be
housed
at
the
industry's
request
of
mobile
food
association
industries,
requests
that
the
top
of
the
semi-enclosed
cabinet
not
be
required
to
be
vented,
as
it
just
appears
that
when
they're
manufactured
their
vented
from
the
bottom,
it
is
not
a
safety
concern
about
it
not
being
vented
at
the
top,
because
the
gas
st.
is
it's
heavier
than
air
and
it's
vented
from
the
bottom.

For
that
reason,
and
we-
and
so
we
made
that
change.
The
second
change
that
we
make
on
that
page
is
that
B
is
at
e
mobile
food
vehicle
shall
carry
no
more.
Then
it
had
said
40
pounds
of
propane
natural
gas.
It
now
says
120
pounds
and
it
used
to
say
that
it
could
only
be
in
40
pounds,
140,
pound
tape,
because
you're
going
to
be
carrying
or
220
pound
tanks.

problem
with
that,
and
if
they
were
to
recommend
to
us
that
you
know
will
do
by
regulation
what
the
volume
of
gas
that
should
be
allowed
to
be
carried.
We're
really
not
opposed
to
that,
except
to
say
that
we
believe
you
know
the
industry
right
now.
I'm
understand
is
carrying
160
fails.
Typically,
so
you
know
this
is
so
we
long
as
it's
you
know
makes
sense
from
a
business
standpoint
and
from
a
safety
standpoint.

I'm
agreeing

I
don't
want

us
to

As
a
committee
hearing
I'm,
not
an
expert,
the
fire
department
is
I
trust
their
expertise.
You
I
want
them
to
have,
because
this
is
a
moving
target,
because
this
has
become
so
popular.
The
summer
is
coming
all
of
these
things.
I
want
them
to
have
the
freedom
we're
not
going
to
be
in
Council
in
the
summer.
Having
sessions
I
want
them
to
have
the
freedom
freedom
to
determine
what
is
safety
in
their
minds
because
they
have
to
regulate
it
and
then.

To
to
that
point,
they're
very
comfortable
with
the
40-pound
take
something
with
which
they
have
a
lot
of
experience.
Right
and
now
this
this
amendment
is
guided
by
that
experiment
and
then
at
the
top
of
page
3
is
an
amendment.
So
reports
were
required
to
be
sent
quarterly
by
food
truck
operators.
That
was
very
impractical
for
the
fire
department
to
receive
all
these
reports.

So
these
reports
will
not
be,
you
know,
don't
need
to
be
sent
to
the
fire
department
they
are
they.
The
bill
requires
that
these
reports,
which
are
due
every
90
days,
have
to
just
be
on
the
truck.
So
if,
if
the
fire
department
comes
up,
you
can
say
I
want
to
see
the
report
and
we're
going
to
go
with
that
regime.
Also,
the
fire
department
is
not
required
to
perform
the
inspection.

Another
thing
that
the
fire
department,
you
know
is
you
know
just
a
it's,
not
a
cord
cut,
you
know
they
don't
want
to
have
to
do
that
and
what
the
bill
actually
requires,
that
it
be
done
by
a
propane,
professional,
same
type
of
person
who
would
be
Ashley
refilling
refilling
the
tank
when
they
need
to
be.
We
filmed
so.

And
then
the
final
amendment
is
that
the
bill
have
required
that
propane
facility
providers
maintain
the
reports
of
all
of
these
entities
and
that's
not
required
anymore,
so
that
propane
providers
don't
have
to
maintain
reports
of
food
truck
refills
and
food
truck
safety
reports.
And
then
you
know
we're
not
less
safe
because
of
that
food.

real
quick
in
there
before
we
go
on
the
other
questions,
and
if
we
were
to
say
that
these
were
the
preferred
methods,
but
the
regulations
could
be
changed
and
altered
by
the
fire
department
at
any
time.
Is
that
something
that
would
stand
as
far
as
giving
them
the
power
to
regulate
and
we're
I
think
things
depending
because,
if
not
we're
gonna
have
to
change
us
every
time
we
find
something
new
new
tanks
come
out,
bigger
tanks
come
out
or
whatever
it
is.
You're
gonna
have
to
come
back
to
council
every
time
I
mean.

It
looks
like
we've
reached
a
reasonable
accommodation,
both
books
in
the
industry
and
post
in
the
safety
division
of
the
city
of
Philadelphia,
but
I
think
that
ultimately,
at
some
point
we
understand
this
whole
jurisdictional
issue
with
respect
to
some
of
the
inspections
and,
ultimately
it's
our
hope
that
we
entered
some
sort
of
an
agreement
with
the
state
to
give
us
on
a
local
level
the
authorization
to
have
full
inspection
authority.
But
at
this
point,
I
think
that
this
is
a
reasonable
approach
to
setting
certain
safety
standards.

So
we
can
make
sure
that,
what's
out
here
now
is
safe
and
reasonable
by,
while
allowing
the
industry
to
continue
to
grow.
I
agree
with
a
Councilwoman
Sanchez.
This
is
probably
one
of
the
fastest
growing
food
industries
and
anticipate
that
it
will
continue
to
grow.
Poor
just
want
to
make
sure
that
everybody
is
comfortable,
particularly
in
this
very
hot,
dense
areas.
So
it's
our
hope
that
we
can
get
these
amendments
adopted
today
and
continue
conversation
with
the
state
to
get
some
further
inspection
authority.

safety

city

fire
department,
the
Deputy
Commissioner
Corrigan,

services

Commissioner
Jesse
Wilson,
Deputy
Commissioner
of
operations
were
prepared
to
give
testimony
on
the
previous
iteration
of
this
bill.
We
understand
that
there
were
amendments
that
were
just
introduced
which
changed
the
tenor
of
the
bill.
So
I
believe
that
our
that
the
testimony
that
was
previously
prepared
for
the
previous
bill
is
no
longer
relevant.
So
I
don't
want
them
to
give
that
testimony.

It's
also
my
understanding
that
the
bill
will
be
held
to
allow
us
to
work
out
some
of
these
issues
and
I
just
wanted
to
put
on
the
record
the
fact
that
the
city
philadelphia,
the
fire
department,
any
other
city
agencies
will
continue
to
work
closely
with
council.

council
presidents
office
mr.
Christmas
the
industry
to
formulate
a
bill
that
that
assists
the
industry
but
also
guarantees
safety
for
the
citizens,
because
this
is
a
very
important
life
safety
issue.

regulations
in
place

change

ability
to

new

I
know
they're
up
to
date
on
nfpa
the
NFPA
one
in
96.
We
both
have
a
committee
together
right
now
that
are
investigating
the
best
way
to
regulate
these
food
trucks
and
I
would
just
bring
your
attention
to
like
know.

from
the
Department
sits
down
there,
so
maybe
they
can
look
that
up,
but
they're
they're,
looking
at
amend,
section,
1
and
96,
both
of
them
to
regulate
these
on
a
nationwide
level.

pmf,
a
and
I'd
like
to
thank
the
fire
commissioners
office

Philadelphia
mobile
Food
Association
would
like
to
commend
council
president
clark
and
his
office
for
his
vested
interest

well-being
of
Philadelphians
with
regard
to
propane
safety.

application

mobile
food
vending
vehicles,
drawing
off
of
member
input
from
the
100-plus
mobile
food
operators
that
we
represent
the
pmf
a
thanks
you
and
welcomes
the
opportunity

further
discuss
improvements
to
bill
number
140
644,
as
this
legislation
continues
to
be
discussed
and
moves
forward.
The
Philadelphia
mobile
food
association
holds
food
and
fire
safety
sacrosanct
on
our
list
of
priorities
in
serving
the
consumers
of
our
great
city.

Propane
safety
in
particular,
was,
is,
and
continues
to
be,
an
area
of
vigilance
for
all
members
of
our
association,
as
we
take
substantial
measures
to
educate
our
truckers
on
safe
and
effective
propane
handling.
In
light
of
conversations
with
council
president
Clark's
office
and
the
fire
department,
we
are
optimistic
about
exploring
these
impending
revisions
to
the
bill
and
look
forward
to
continued
discussion
in
closing
the
pmf
a
wants
to
reiterate
our
vested
interest
in
promoting
propane
safety
throughout
our
industry.

Although
multiple
areas
of
change
are
being
discussed
as
potential
safety
precautions,
we
firmly
believe
the
two
most
crucial
factors
in
maximizing
propane
safety,
our
first
assuring
the
integrity
and
credibility
of
the
food
truck
builder.
By
this
we
mean
the
truck
builder
should
operate
out
of
a
licensed
facility,
understand
the
engineering
of
piping
use,
NSF
products
and
have
a
proven
track
record
with
building
trucks
and,
secondly,
mandating
truck
operators
to
establish
a
propane
safety
protocol.

We
take
this
measure
with
our
members
already
and
do
understand
that
education
and
consistency
is
the
key
by
addressing
both
of
these
areas.
Along
with
revisions
that
we've
already
discussed
to
dis
ordinance,
we
believe
the
pmf,
a
in
the
city
of
Philadelphia,
can
create
a
consistently
safe
environment
for
mobile
food,
vendors
and
consumers.
We
thank
committee
and
council
president
Clark
at
his
office
and
look
forward
to
taking
these
revisions
back
to
our
membership.

of
the
moment,
safety
precautions
that
we
list
for
our
members
is
for
them
to
use
the
soapy
water
spray
test
to
properly
maintain
hoses
and
regulators
purchase
their
propane
from
a
reputable
source,
establish
a
protocol
list
for
all
employees
who
work
on
that
truck
with
regard
to
propane,
to
keep
their
valves
closed
when
item
use
to
familiarize
themselves
with
their
cooking
equipment
to
absolutely
not
smoke
in
the
vicinity
of
propane
to
shut
off
their
valves
when
they
do
run
out
of
propane,
there's
a
leaking
valve.
I'm.

Sorry
as
leading
the
valve
open,
can
cause
moisture
and
air
to
get
in
and
produce
rust
inside
the
tank,
which
would
therefore
make
the
odor
smell
less
pungent
and
less
detectable.
We
asked
them
to
visually
inspect
tanks
regularly
for
rust
or
corrosion.
We
mandate
that
they
replace
tanks
if
rusted,
corroded
or
physically
impaired
we're
always
abiding
by
the
shelf
life
that
is
engraved
on
the
tank
yeah.
