To 2021 as we prepare to open the meeting here are some guidelines. If you wish to address the board.

Regarding any of the license applications, please call 301 475-4200 extension 1234 to provide your.

Name and address for the record, you will be then then be given an opportunity to speak to the board.

Through the phone conference, all speakers will be allotted three minutes to address the board at the.

End of three minutes, our communications director, alisa casa, will let you know your time has expired.

We ask that you respect the three-minute time limit in order to give all those who wish to.

Participate an opportunity to be heard, video submissions, written exceptions or testimonials.

Including petitions were accepted up to 72 hours prior to to today's meeting this public hearing.

Of the liquor store in a town wine at spirits, um I have been assisting the parties. This.

Is a simple transfer of stock uh just as a little preliminary uh miss kawara's father.

Is mr malik singh the gentleman who you just mentioned um he has been the owner of the store.

um And he wishes to transfer his interest simply to his daughter, and that is miss dil creed power.

Who you see on the screen as well? Ms kennels has been a member of this corporation and the.

Licensing since its inception- and she will continue to be on that license, thank you, sir.

Personal property, tax and the retail sales, so those would be conditions we're just waiting.

On those clearance letters to come through personal property tax and, mr chairman, if you.

The process of getting those taxes taken care of is that your understanding as well, mr.

So it's contingent on what um clearance letters to our office from assessments for the personal.

Property tax and retail, so personal property and retail sales tax clearances. Okay- and I did speak.

To um the outgoing licensee- and they were they it, it was paid, but they still hadn't.

You know everything's backed up a little okay, so they will need probably 30 days. Well, you.

Had tasked me with some more to find out any more information in regards to the.

uh Three items: the governor's executive order, delegating authority to alcohol license boards to.

D

Suspend fees I have not received any response from the comptroller's office.

D

They were not sure between the melee jurisdictions and the um even the comptroller. There was an.

D

Officer from the comptroller's office on there- and they were not sure they felt that we might have to.

D

If it was lifted and recollect those fees, but nobody has given me a, I was counseled to send.

D

An email to jeff kelly, the director and I have not received a response back yet so that's still.

D

Up in the air, as far as your requests for that information.

D

um The second bill 814 the emergency bill, waiving alcohol and license fees for bars and restaurants.

D

For the 21 22 license year, which is the upcoming license year,.

D

That bill is actually put in as an emergency bill and there will be thereby will be effective as.

D

Soon, as this is approved, the latest approval would be april 15th when session ends. So if.

D

We didn't have any other items, I probably would have I'm sure the bill is going to pass it's it's.

D

Got overwhelming support and I would probably counsel because licenses go on sale april. First.

D

I would pr we would probably counsel our licensees to wait till april 15th to go pick up so that they.

D

Wouldn't have to pay and then be refunded. Okay, so that's I think where I stand there and- and I think.

D

That's the best avenue to go to um senate bill 205 sale of delivery for off-premise consumption.

D

To go drinks, um the maryland alcohol licensing association has drafted a letter asking for.

D

Approval be a favorable response to the bill, but with conditions sunset clause of two years, so data.

D

Can be compiled that you know if this is having a bad effect on you know duis or the health and.

D

Safety of the community, as well as limitations, volume, limitations per sale and um what was the.

D

Final ah fees- I'm sorry fees fees. Yes, they we weren't allowed to charge for that in a lot of.

D

Counties who already allow uh delivery they charge a fee, so this would waive that for them as well.

D

And plus we're tasked with enforcement and and issuing, and you know, bringing them to a.

D

Hearing for to get that permission, so the fact that we cannot collect a fee overwhelmingly, the.

D

Jurisdictions felt that that was not fair and not you know, so that was their suggestions on on.

D

That letter and I did uh send you a draft of that letter- the retail beverage association had also.

D

Supported a sunset clause when they spoke to you to to this last time. Okay, so that's my information.

D

On those three for you and tammy, this is regular legislation, so it would not become effective until.

uh The end of the session, the to-go drink bill uh 205, would take effect july, 1 july 1.. The only.

D

One that would take effect immediately would be the um emergency bill 814, and then we have, if.

G

They approve that sunset. That would be then the uh we won't know until uh that, but if they did.

G

On that two year, then it would be. uh I guess it would be. Last time I assume 2023 yeah, they would.

D

Look at it again, I guess the legislature would look as to whether and make that a permanent.

D

Law, so if there's no further questions on those bills, okay, so.

We last time we had discussion about this and we decided we were going to chair it.

A

The discussion about were we going to as a board take action to to waive fees.

A

Or not, uh we don't have a lot more uh information. We know now that leonard town.

A

Is the government local, the local um town commissioner town council is good with.

A

The delegate's bill and supports it. We know the county commissioners are in support of it.

A

So I guess the question is going to be now is: do we as a group wish to do something.

A

And- and we have, uh we do have the option of waiving these fees um outright. For now,.

A

As a entire group or one segment or two segments of this, you know we, the push is right now, as the.

A

Concern our our um from our elected leaders is the um the toll on the restaurants and the bars.

A

Which are felt to be greatest affected and the information that's been gathered so far from them.

A

And then there's also the that other little class of a few, which is the um the salons.

A

And the like art, galleries and things like that, there aren't many who have a license.

A

But there's a group there, um which seems right now not to really been addressed too much.

A

And, um of course, the county has a golf course, which also has a license.

A

So uh we'll have a discussion about this. Has anybody have a better idea where they would.

A

Like to see us go um april, um I definitely it was a discussion that we had last month and I thought.

On that and pondered on that, and I feel that it's our duty to do what we can to help our community.

In any way that we can, you did bring up a great point that I did not factor in. I didn't consider.

B

The salons that offer um alcohol you know as for special events or while you're getting.

B

Services done, but I don't think that that's their bread and butter, um that's not affecting.

B

Them the way that it it affects our local bars and our local restaurants. So I think that's.

B

If we're going, is that something that we want to differentiate between the two or do we just.

B

Want to support all together, no fees um instead of trying to say. Oh, you know if.

B

The salon is going to do it. They'll pay the fee, that's not really their their bread and butter.

B

Or we're just going to make it just clear across the board um no one's paying these fees to give.

B

Them some sort of I don't want to say stimulus, but a little something that says hey. We support you.

B

We know things are hard: let's not try to nickel and dime.

B

And it's one of the few things that we can do and we can control and if we can do that, I think.

B

um I think that's our responsibility to do that. Okay,.

Mr cole, do we need to uh uh submit some some form of uh letter um either accepting acknowledging.

Do this, are you talking or just simply, our discussion here? Are you talking about the.

Governor's order or whether you guys you talking about under the governor's order.

Under the delegate's bill delegates bill a letter of support yeah, you don't have to don't have to.

Would it be appropriate, but I I don't know what you're discussing? Are you just we're discussing.

Right now we're not discussing the delegates right. That's what I yeah we're discussing the.

The actions of the committee that what I mean the board, if we wish to take some action.

We we have a delegates bill, we have, we have the local officials here that are support of.

A

It right now we can take what we're talking about here. This discussion right now is we had tabled.

The possibilities of us acting and waiving the fees on their own- oh no, okay,.

A

You have no comment. No, I'm I'm in support of waiving the fees- okay, okay, okay um and as as.

The others have have agreed, you know to move this forward. I mean we've got a very limited time on.

On some of this well, if we don't act at all, and the governor's order doesn't.

Doesn't um it continues on um it doesn't matter yeah? What we do here will is basically.

At that point would be meaningless.

Watts, mr chairman, I'm obviously very much in support of it, uh particularly if the.

The governors have looked at it from the financial perspective and said it's.

um You know they're they're willing to accept that as a you know, uh from a.

I

Financial perspective, it's not going to impact uh or have a significant impact on the county.

um You know, while it won't have a major impact on the county, it will have a major impact. I think, on.

I

On these, these vendors restaurants bars, so I think, it'd be very meaningful to them um and.

I

As april uh you know alluded to as well: it's going to be a huge help to them and help them.

I

Get back on their feet and keep things going and hopefully get us all out of this. uh This pandemic.

Happy and healthy and having our businesses still intact, barbara. I agree with the rest.

Of the members, I think we should go along with it and I think it's beneficial to them.

And I think it should be across the board, you think it should be everybody. I think.

It should be everybody mm-hmm, no, no um cookie cutter. No, I think it should be across the board.

Since it's easier, I'm trying to dig out who it does that's just getting into yeah so.

The the the breakdown have, you guys got to see the breakdown, the revenue um so.

The total revenue for um the package stores coming to county licensing a year is uh eighteen thousand.

A

Dollars sixteen thousand one hundred and forty seven dollars and fifty cents goes to the county.

A

Coffers and then um the city of leonardtown gets 1852 of that.

A

That would be an additional amount than than what the delegate's bill was.

A

When it comes to salons, their fee is actually pretty high. Considering.

A

Probably the volume of business that they do so you know their licensing fee is 300 a year.

A

There's four there's only four there's four art establishments and one salon.

A

And then the the golf course is 600 a year, so the total revenue coming in is 2100.

A

And the county commissioner shares 675 and leonardo gets 1425 of that.

A

um Restaurants account for forty thousand seven hundred and fifty a year.

A

uh County gets thirty thousand, and a little over ten thousand goes to leonardtown. The.

A

Bar in taverns 31 950 is the total 27 6 275 goes to the county and 4 322 goes to the town.

A

Of leonardtown talk about waiving a total of 90 800 in fees for this year, coming up.

A

Any additional discussion before we have a vote.

Nothing, I think all's been said. Do I have a motion? What is it, mr chairman? I guess.

I'll make a motion, then, that uh we uh uh waive the fees for the uh the 2021 year uh in support of.

Kind of a bridge in support of the current governor's executive order, uh as well as.

The house bill uh 814.. Okay, do we have a second? No second emotion, so mr watts makes the.

Motion and um april is seconding the motion that we waive all fees.

Alcohol licensing fees for the upcoming year do we have any final discussion before a vote.

Do we have an alcohol enforcement coordinator report to be given by someone? um No did.

Did you want me to I sent you a copy of the chain store bill? I didn't know if you guys had.

I'm sure it was a last-minute bill drop, so I didn't know or if chris I don't know, if.

You got a chance to really look at it and which one the chain store bill, how it would affect the.

Local is that the house bill 996, yes, 996. um I can quickly just tell you the the concerns before we.

Saw the language of the other jurisdictions was that one you would have to hear the application.

D

I guess we would have to process the application we would have to enforce it. Yet all the funding.

D

Or the fee would go to the state, it would not stay, we would not collect the fee which.

D

I can tell you every county across the board: was dumbfounded didn't make any sense at all.

D

um I'm sure the retail beverage association, although I you know, would be uh not in favor.

D

Of this bill only because it does hurt mom and pops.

D

It is limiting it to beer and wine.

D

Versus beer, wine and liquor, it's also it's also limiting to those establishments that are in.

Priority funding areas, so it's not every grocery store. So that's also another limiting factor.

Especially when you consider our county, which there aren't that many priority funding areas.

And there are other restrictions as well. Obviously, if you read the bill and 500 a year fee, correct.

That's correct that doesn't benefit our county at all. This goes straight to the state, goes to the.

A

Community legacy financial assistance fund correct all the footwork and they get all the money.

And I feel it's safe to say that none of that money probably go to saint mary's county.

So that being said, I just want to bring that up. Let you know I will inform you what mela's.

I I've kind of given you what we anticipated before seeing the language. um The concerns were.

I have a hard time seeing any jurisdiction support this, including the jurisdictions.

D

Whose member and and senator proposed the bill, so they weren't too keen on it either.

D

The alcohol enforcement coordinator, which is because I'm done.

D

Is um he he submitted his report? I think it needs a few amendments and he just.

D

Texted me that he wouldn't be able to get to that until next week, so he will be.

D

Putting an amended report later on, okay and everybody got the report. Okay,.

Afternoon, the last month, I did nine inspections, that's down a little bit from normal. I one day.

I did schedule some down ridge and I only got two responses. I didn't run down there for just two. I.

K

Was trying to get five or six so that day, kind of got canceled and then also I spent three or four.

Days, making these phone calls to every licensee, um letting them know that their renewal package.

K

Was mailed out and if they hadn't received it to call us, and I got 10 responses back and then.

K

Ended up like three didn't get it, so we they've picked them up since um and then.

K

um Participated in the mail calls each friday and got caught up on a lot of filing that need.

To be done before the um our next year's renewals and stuff started being filed soon,.
