2021 meeting as we prepare to open the meeting here are some of the guidelines. Public meetings.

Are now open to the public provided social distancing guidelines can be maintained.

And the commissioner's meeting room capacity limits do not exceed 32.

Everyone in attendance must adhere to the social distancing guidelines.

Including wearing a mask at all times, except when speaking or due to disability, this public hearing.

So you ready to present your your application. Yes, okay, go right ahead. um I had I had supported.

I presented an application to extend for my catering license for weddings and such to be held.

E

On uh certain locations such as you know, other venues, besides my own cafe, location.

E

We do small catering events right now. We limit ourselves to a maximum of 150 people.

E

So we keep it in a controlled environment and make sure that the the proper guidelines are in place.

E

To make sure that the guests are taken care of and not over indulging, and I think that's all okay.

Helen, how do you, uh how do you control uh the alcohol that I'm, assuming that you bring.

D

Beer wine and then a variety of liquors right. The guest decides on.

E

The beverage of their choice and then based on, if it's like just beer and wine or.

E

If they decide to go with liquor kind of makes a decision on how many people we would want in place.

E

We have certified bartenders through tam, as well as through the rast program from the alcohol board.

E

But we so we put our own bartender in place and then I have um staff that 90 of my staff is.

E

Actually, over 21 and allowed to serve themselves. um As far as in the catering serving the food.

E

These are all venues that are food related, so it's not just to have a bar. um It's usually coincide.

E

With like a reception, then eating and then maybe another cocktail hour a little bit after you know.

E

Like a normal reception, so um in that place um two of my gentlemen, that actually work for me.

E

In helping with the heavy load, the lifting and moving stuff and clearing, they are also sort.

E

Of like security, and they know to kind of look out as well, um but we are also reminded the bartenders.

E

Remind them that you know if someone looks overly, you know indulgent like they should not.

E

We usually address it with the person who isn't the host of the party when uh somebody.

Makes application for your catering services? um Do you have any idea as to how many people are going.

D

To want to drink beer, how many are going to want to drink wine? How many want you basically have a.

E

General idea um and that we usually limit it more like a time frame as well. um I've not.

E

um Well, in my previous years, when I was catering 20 years ago, usually it didn't go over four hours.

E

So it was a maximum and you kind of I hope that helps to you know, control the situation as well.

And then on-site you have a the means, then, to control all the alcohol. Yes, it's all brought in by.

E

Our staff and kept within a certain area- that's protected. um You know under table like underneath.

E

Or in a storage area close by and all of that can vary depending on the venue correct right.

Okay, so you've already have you already have a catering permit. I've done this an extension.

E

Of print we're catering currently, um but I've had requests to provide alcohol service and.

E

Coming up upcoming actually in september- and I said well we'll see what happens this week, so we.

E

Have a wedding actually right here in leonardtown on the person's property, makes you a one-top.

One-Stop shop, they can get everything yeah, yeah and chairman, if I will, if I may, for especially for.

You guys have not done, I don't think a catering permit, since any of you have been on the board.

F

But our catering permit is only for out for the alcohol they have to have a food catering permit.

F

Helen has been running a catering operation for years, so she just didn't want alcohol until she.

F

Got her brick and mortar down and now she's ready to roll, and we do always have phone calls at least.

F

One a month, people in the community looking for somebody with who who is allowed to do alcohol.

F

Catering, they can't just do the alcohol, it has to be with the food and that's always been a problem.

Do you find most of your building uh most your business coming out of the north end of the county.

E

um For the most part, pretty much from hollywood north to charlotte.

E

Hall at this time, however, I just recently started getting calls all the way to ridge.

E

But years ago, 22 years ago I had a restaurant in ridge. So it's getting out that I am the same.

E

Person up at the other end so, as I say at the other end of the world, um so it could.

E

Happen but for the most part we try to stay in our vicinity between hollywood and charlotte hall. Okay,.

First, what permits are still required for the catering, nothing she has her catering permit.

um Her her health permit states that she can do catering on it and we have a copy of that.

On record, there's also an extension of premise on this. That's a separate thing to those vote.

For outdoor seating, so that's a separate request. Okay, then I'd like to make a.

Premise, an extra serving counter for outdoor seating, um remind you, you're already sworn in.

Yes, I had a question, so um their fencing uh is that it says.

On the diagram net, fencing is that sort of like the construction type net, fencing or.

Yes, sort of like uh normally, you would see orange, we found green um and we actually have plans to.

Transition to more, like the livestock large uh square, fencing that you would use for a large for.

Livestock, that's about four foot tall. Okay, we want to replace the temporary with the more permanent.

And go around those poles and keep it in okay. What what is your transition plan for for.

When you expect to well, we were just waiting for today's hearing to make that decision before.

uh I mean with the fencing, particularly honestly, I mean that's the only thing I.

Guess that about this, that that I got a little bit of concern with, is just the the fencing and.

Maybe having something a little bit more permanent in place. Yes, it's more secure.

Yes, we put at the temp, we put the temporary um plastic netting.

um Before the pandemic to be able to seek people outside, but then it became pretty popular and.

E

People are asking if we're going to continue, so I went ahead and applied for the permit.

E

And if that happens, then we actually have plans for tomorrow morning to replace it with the metal.

E

So it'll be done as soon as this weekend. Okay, so we already have it there we're ready to go.

E

But we just didn't want to proceed with it without knowing for sure. Just on that note.

um Helen, have you gone to land use and growth management to discuss that? um I think it's just.

E

I don't know harry wants a minor site plan: okay, I'll submit it, so she this would be conditional.

F

On her checking with logan, and then they also would have input on on any kind of fencing. You.

E

Would want to put okay yeah, it's just a like. A staple gun would hold what's that and they.

F

Might have regulations on that. So that's who you need to talk to sure I'll double.

Check start that so this would be conditional um on land use and growth management, approval.

Health department, approval and fire marshal approval, so all those once you go to land.

Use that'll kick right, those other ones. Okay, so say that again it's logan bughum health and fire.

Yep and the health department does have the same request as well: okay, uh helen, where, where exactly.

Are you located in in charlotte hall, we are smack dab in the middle of the old farmer's market.

Building a so if you're familiar with the produce, stand that faces route, 5, there's a.

E

Long awning that connects to the old barn that used to have live auction in there right there.

E

One side of that has a brick side to it and that's actually the little cafe. Okay, we see a 46 inside.

And this would allow us to seat approximately you know 24 to 32. You know with the seating outside.

I guess so so. Does the um landowners know these plants? Yes, yes, yes, he's. Actually the.

E

One that offered me the space immediately when the shutdown happened to carry out only.

E

To provide tables outside and thought that that would help and and then it ended up, I put nice.

E

Tablecloths and flowers and everybody likes it around the farm and they're aware of the.

Alcohol as well yeah right, no I'll call them. Okay, okay, helen! Your uh your drawing here then.

Shows a door opening onto the patio walkway, yes, is that how you're going to service this area? There.

E

So, underneath this awning that we, we laid some pea gravel there, but in between there's about a six.

E

Foot walkway, the kind of people will pass through from one side of the market to.

E

The other, but it's really our patio, so we have um a little like hostess table that we.

E

Put outside and we were thinking if this became a more permanent situation, we would like to have.

E

A hostess that actually greets people at the door if they want to sit inside they'll direct them.

E

Properly and if they want to sit outside they'll assign them a server, so they're keeping an eye on.

E

What's going on, where would that hostess station be in the restaurant or right outside the door.

D

Right outside the back door, there right outside it's actually our what we consider our front door.

E

Oh okay, yeah, okay, so this is going to be a temp like a portable for lack of a better word, a.

F

A serving counter, that's only going to be um utilized when you're, when we're opening, because.

There will be no permanent storage of alcohol outside right yeah. We would be moving. We actually.

E

Would move the table out daily and put it away because I don't leave anything out there.

Any other questions, so I just further clarify on that. So the the table you're talking about.

That was your hostess table right I mean the alcohol is going to remain in inside until and.

Then served correctly with the server who's going to carry it to them. It would be everything would.

Be remain at our normal serving counter inside and we would just run it out per drink order. Okay, okay,.

And then you, you would have servers out in the the patio area. I mean, how would how would anybody.

D

Check ids, or we have so, for instance, um the way we would work is we would have three servers with.

E

Because our places are small, one stays on the bar, the bartender stays at the bar counter and.

E

Then one that serves the floors inside tables and then one will be assigned to outside tables.

E

So whoever housed outside would have to come in and get those drinks from the bartender and then.

E

Carry them back outside that person is responsible and right now all of my staff is over 21.

E

So there's no worry of that, you know being a minor serving, but um we we have the id notifications all.

E

Around and we state it constantly like on our facebook site and our website that we we do a.

E

Card regularly, so that would be continued and outside just as well as it is inside.

I

Any other questions helen: what is your landlord's? The walkway does that have to remain through.

E

No, um he hasn't mentioned anything like. We have flowers out there now and um he you know it's not.

E

Like a definite through way, but people do work their way through there so.

E

We've even um at one point had a longer table that was kind of turned to kind of block the flow of.

E

Traffic, but it's not a big heavy. Where would your mobile serving station be on the patio, so we would.

E

Actually are not planning to have a mobile station, you know what I'm talking about a table, but the.

Hostess station goes right against the brick wall beside the door on that walkway yeah. So then that.

Walkway should be included in your permit yeah yeah. Well, the tables will be out so you're still.

Walking across yes, yes, yes to answer your question: yes, so they will be going out to serve through.

There but uh the seating area is actually inside, like this covered area. As you see on the diagram.

So you want this diagram corrected yeah. Well, if, if yeah, she would need to you haven't listen, you have.

The walkway on here, but your your fence, your premise line and your description is just the.

Seating area yeah, so that's how it is now so that the people can walk through right, but it doesn't.

Sound like she intends to change that, though it didn't sound like she intends to change that. Well,.

The question is carrying alcohol from the building across a non-licensed area to a licensed area.

So then, would we have defense all the way to the building? Then.

Or I'm not sure not clear across that walkway with this well yeah.

Because you're crossing that walkway right to get to your area.

Yeah to right, so I think, as I understand it, your current licensed premise is the cafe.

Itself correct correct, so you know and then you're asking for an extension of that license premise to.

Include the fenced-in area correct where they're seating right in order to access that fenced-in.

Area you have to cross this. What you've noted as the patio walkway that currently is not a license.

L

It's not part of your license premise, nor is that part of your proposed extension uh so so at some.

L

Point in time, in order for alcohol to get to your proposed, extended area to be included, correct.

You'll, have you would end up having alcoholic beverages in a non-licensed area gotcha, which is.

Definitely one walkway, so you would have to either include the patio walkway as part of your license.

Premise, in order to achieve that or have some type of um permission to have alcohol go through there.

E

Okay, okay, that makes sense that makes sense yes, so yes, we would need to alter that. So I.

If the board were to decide and we'll have her correct, her sketch and her well, I think.

I think also that all of this will be dictated by uh uh lugham's requirement as far as.

Permanent fencing, well, I think more also on your landlord.

D

Absolutely that thorough traffic, so it is a conditional approval.

So if she hits any roadblocks, obviously she would have to come back. I have a question as.

Well, is the patio walkway part of your leased premises or is that, yes, that is yes, okay,.

D

So you would not need uh landlord approval to uh we've already. um He offered this space to me.

And he knows what we're doing out there as far as the the food scene, the seating for food purposes,.

E

um You know like during the pandemic and all and I when I spoke to him last month, he knows about.

E

My hearing today so if you're watching, but he was fully aware of everything and had no problem.

E

Most of the tenants in the market area mike himself as my landlord.

E

Mike burrows sorry seemed to appreciate really what we have done. There was dressing it up and.

E

Making it look nice and bringing a nice clientele in for lunch because it brings a nice group of.

E

People in so we haven't had any complaints with that he's been fully on board with everything. Mr.

D

Chairman would this need to be conditioned by some kind of approval from the landlord.

A

I wouldn't think so I think it's like she has it. She would just need to.

Update her, but something in writing.

That's what you'd have to have have the lease we have already have a lease, but.

But I think my concern at this point is if, if the board requires her defense in that area,.

F

That might be an issue with the landlord because of the through traffic, even though.

F

It's part of her at least premise. He you know just and and depending since it's private property.

F

It's not like out in lexington park. You can't have seating on a on a walkway impeding traffic.

F

It would be more like in leonard town, where we have outdoor seating on our sidewalks, because.

F

The corporate town of leonardtown allows that so I think maybe and maybe an addendum to her lease.

F

Something that states that, but that's gonna, like I said with the board I mean, if he doesn't want it.

F

Closed off to his um to the rest of the market traffic, um it's gonna be up to you guys, there's.

E

A lot of traffic that goes through there, no really on saturdays, we say it occasional.

E

People walk through going to the other side, but that's the only day, really the rest of the time.

E

The market itself is only open, wednesdays and saturdays and wednesdays. It's not even at fifty.

E

Percent of the business, you know the venues that are there, so um most of it is just the.

E

Produce stands on wednesdays, saturdays, there's, a lot more um units that are open and active.

E

And people you know they walk up and down the aisles and they'll occasionally cut through there.

E

We have our nice little sidewalk, chalkboard, easel and flowers and stuff. They have about a five foot.

E

Clearing to go through, but the seating itself, that worst I mean we don't get people that come to us.

E

We're not a bar that serves food, we're we're a cafe that likes to offer bloody mary's and.

E

Mimosas and things that's most of the time when we get the business is mostly breakfast and.

E

um There's people that just they like the outside and they want to be able to be out there. So we.

E

Just want to offer them to be able to sit at the table, we're not um in any way looking for to have.

E

People walking around and we don't encourage it and in fact I would discourage it, and you know.

E

And probably I'll probably be the one monitoring this myself for for a while to get it started and.

E

Teach other people what I expect, but it's not to gather people to be standing around drinking beer.

E

Or walking off into the market, so I'm very strict about that. um It's more like to just.

E

Have those who, of course, not on a 95 degree day, but a nice 75 degree day to enjoy sitting outside.

E

And watching the people go by, so that I understand that patio walkway with just the only time alcohol.

Would touch that is when it's being transported by the server to right from indoor to the outdoor.

Patio seating area and I'm wondering when there's a more permanent fencing structure. If that will.

C

Even further eliminate the amount of people that want to go through there, because now it's going to.

C

Look like okay, that's the actual restaurant, it's not oh. What are they doing right it would. I would.

E

Be afraid that it would hinder and actually void the whole purpose of even doing this so.

E

um My thoughts just going through this start popping in my head is to maybe put some type of.

E

Taping on the sidewalk and additional signage that says no alcohol beyond this point.

E

Or um you know something to that matter that lets them know that this is our boundaries.

E

You're walking through here you're welcome to walk through here, but this is you're not to.

E

Take the walk out of the year basically, um but that's it. It would just be from the server to.

E

Go through the door six feet across the concrete into the gravel pit that we call our little area.

Could she even put a sign up? That said no through fair, you know what I'm sorry that no one can just.

C

This it's for patrons only patrons of helen's cafe. Only we've noticed that there's not as much.

E

Foot traffic because we've put the flowers and the signage that you know the easel and.

E

And there's actually a table that is part of the patio that doesn't belong to us. It.

E

Belongs to the woodworker next door, but I think people think that that is one of our tables.

E

So they kind of just they'll look at it, and sometimes I just actually see them walk away.

E

Just go the other way and go around, but we know we don't tell them that they have to. Let me ask you a.

F

Question when, when you're your new covered area, no it doesn't, it doesn't impede the produce. So when.

F

You're, coming from the street end through the produce barn, they can still go straight through.

E

Yeah they can still go through yeah, it's to the one side of it. So the area that um mr burroughs.

E

Gave to us was, or now leases to us, I should say, uh was formerly a flower stand for one of the amish.

E

Who would come every year from like may till july and sell their flowers, and it just.

E

Really wasn't eyesore any other time of the year and uh he said you know you've. He because.

E

I've asked him for it for two years. I've asked him for this spot. I was willing to pay for it.

E

It's just an eye sword. It's right out my front door. Finally, he's when the when we were shut.

E

Down he to to carry out and outside only he says all right, you've been asking me this spot for a.

E

Long time he says, I'm just going to go ahead and give it to you and do what the best you can and.

E

Of course, I went out there and put picnic tables and nice little tablecloths and dressed it up and.

E

Then everyone comes around and says: well so nice and now he says well, you can have it now we're.

E

Not gonna take it away from you, because it really does look nice and it brings a nice appeal to the.

E

Farmers market that we're looking for so now the farm, the amish, who has the flowers are over on.

E

The other side of the hot dog stand, so they have a whole new place and I feel bad because I feel like.

E

I kicked them out. I really love their flowers, but I just buy their flowers and bring them over so.

E

That's uh how that worked out, and then I found out that I needed to get the permit permanent use of.

E

It, and so here we are and well we didn't have that. I'm thinking health department, permanent.

E

Use and now we want to serve alcohol so helen, how late are you? How late are you open in the evening.

E

So our normal hours currently are wednesday through sunday from 7 a.m to 3 p.m. We have.

E

Been known to be open on fridays, which started with an oyster thing a couple of winters ago, so.

E

We continued that so friday evenings we are, we close our kitchen at nine and we close.

E

Our whole place up at 10., very rare, that we're open any later. If we do occasional, like a birthday.

E

Party or something sometimes people will stay a little longer, but that's our normal hours.

D

My question to you is that uh patrons that are outside then could continue to order.

D

Until 10 o'clock, they can order food up until 9 00 pm on fridays on 9 p.m is when you cut off food.

E

Correct and when you also cut off the with that switch, actually alcohol, we do our last call at.

E

Nine o'clock and we close the kitchen at nine o'clock so that way they have that extra hour.

E

We allow them to stay for like and usually so like. We even have um an acoustic gentleman that.

E

Comes in from six to nine, so everything shut off, basically at nine o'clock, but we don't.

H

Start you know giving them hints to get out the door until about ten o'clock. Okay. Well, this was.

D

Just uh another consideration that I just thought of, because we have a lot of these outside permits.

D

Okay, that we we we need to be cognizant of the fact that some of these places don't close until.

D

2 a.m. You know and are we talking about being able to serve alcohol outside until 1 30? You know.

D

In the morning, that's just a consideration for the board, and that was what led me to your questioning.

H

When, when do you, when do you close? Yes, we have. We are it's very rare that we ever the last. I.

E

Remember we did a birthday party for someone on a saturday that was indoors not including the patio.

E

But we did have. It was a 21st birthday party that a mother held for her uh daughter and it was from.

E

Like eight till midnight, and but it was a controlled 25 people, it wasn't, you know, that's.

E

The kind of stuff that we do we're not into the typical bar scene, we I'm more proud of my food and.

E

Than anything- and we don't have a large selection um kevin can tell you that I have a very small.

E

My whole selection's about this wide compared to some bars that go on for the whole wall. You know.

Mine's very small, and I'm mostly just known for the bloody marys and crushes fresh crushes and the.

E

Mimosas not that I'm here to advertise, but that's the type of drinkers that we get. We.

E

Carry a little bit everything, but you know beer and such but to suit all. But but we're.

E

Not um well, we want to have that permission. We're not there to to be more known for a bar.

I

Very good, so I guess there's a couple options here in there, one of them being.

A

Table this until next meeting and come back and bring us.

A

A more solid, formal plan, what you want to do, um maybe with a letter from the landlord addressing.

A

These questions that they don't have a concern, that's what I would recommend.

The board can do that, I mean either you have any other. uh What are other options? Well, I mean you.

F

Can conditionally approve it now pending those items and they would come through? She brings you.

A

Brings it to your office the the letter, so you can. You can add that as one of the conditions, a letter.

F

From the landlord verifying that he's, okay with her using that walkway and and then also the.

D

The new drawings for the uh for the fenced-in area. Well, I don't think the fenced-in area is going to.

F

Change, it's just the material for the fence, I'm I'm looking at this fenced in area right here.

D

And if they go permanent with it right now, they only have one one way in and one way out and I'm.

D

I'm pretty confident that the health department, or that would be the fire or log them, is going.

D

To require another entrance or a fire marshal fire marshal would require an an exit exit only.

F

She would bring an amended drawing if the fire marshals had right had dictated that. But what.

D

I'm saying is: is condition this upon that upon that receipt of that drawing yeah she's still you.

F

Know we can do that and that's with all of your conditional approvals when, when the waiting on.

F

Other agency safety agency and permits right always conditioned, and it's always just if.

F

Something has to change, they have to bring us the final diagram. I think we just had that recently.

F

I think there's just there, at least in my mind, there's an enough conditions on this.

That I know for me personally, I think I'd like to I'd like to see that all put together. First.

G

Before we try to do a conditional approval, I just think there's too many other things to you know.

G

In motion that need to happen, um you know if it it's, you know one or two things. It's.

G

One thing, but it's there's, you know half a dozen here that I think need to be kind of.

G

You know coalesced and solidified, um that's my perspective as well.

G

So I I agree with richard, I know for me, I I definitely love giving people what it is. You.

Need so you don't come back you're like well, they didn't really say what I needed right. I know.

I won't be here but a a letter from the landlord addressing the use of the patio walkway to transit.

Okay and the alcoholic beverages to and from to that outdoor seating, the diagram updated showing.

Their plans to have an actual fencing that that goes tremendously. It's so much harder to jump.

A cost into legislation, so it's a 650 permit. The legislation did allow this board to.

Issue that permit, without yet putting in our rules and reg so like I said, we're playing catch up now,.

And this is a bit of an anomaly where that's why this is taking a bit of time to figure out, because.

Traditionally, as tammy said, this was created by the state. These are state licensed.

Manufacturers and usually when it comes to permits or authorizations those usually.

Come from the state right not from the local boards, but in this situation this.

When they promulgated this legislation, they gave the authority to the local licensing boards.

To issue the permits to these class, one distilleries, you know to be able.

To sell and have on-site consumption, so so I guess what I'm asking is our enforcement.

Ability is through the permitting, not the licensing, correct. That's absolutely correct.

But since since it's creating an authority to issue permits by this board right, we have.

To change our rules and regs to address that right and where we haven't had that in the past.

So it creates some new, it's a difference right and it creates not just in this one provision, but.

Also, throughout the rules and regs to address the issuance of permits, not just this one in.

Particular, but in general, okay, because a license and a permit are two different things right.

Hours 4.02, uh the law does give them a different set of hours than our regular.

But I did leave you a packet that she sent me last night with some information. Okay. um So if you I.

Know you haven't had time to really review it, but it was some stats and and- and it also includes the.

Letter that they sent to the legislators when the bill went up on their opinions now their.

Opinions on that letter were based on the initial language of the bill. There were amendments made to.

The bill on recommendations by the mela board and the mail- you know the jurisdictions com.

Combined having the delivery on delivery, the delivery person being 21 and alcohol awareness.

Certified and and certain other factors that we felt needed to be in giving the boards.

Authority to set drink limitation on on these orders, it's it's a coveted relief bill. It's.

Got a two-year sunset close, the sunset close was also added because we asked for it because.

It's it's difficult, but I will let you um have time on that. I know the chairman and I are due to.

Meet before the county commissioners towards the end of the month to get their input and we will be.

Presenting this information to them as well ahead of time, so I don't know if I I know you didn't.

Have a lot of time to look at mary, ellen's stuff and I apologize- and she did want to be here. But.

Again, um if there's any questions on that, I I just have a question I like breeze through it quickly.

But I noticed one of the topics that we had asked um and we had a pretty in-depth discussion about.

It when sergeant meyers was here, we always seem to get statistics from other counties.

Like we're looking at montgomery county's um statistics that 55 of their restaurants did.

Not check the id where the order was picked up. I'd like to think that I know my county.

And that the small businesses that are doing this there's more than 55 percent of them that are.

Checking the ids montgomery county had a grant and they use the. I don't know if you guys have heard.

Us use the red card green card lingo, which is the responsible retailer forum that the community.

Alcohol coalition has used via grant to do secret shopper checks on our businesses, montgomery county.

Use that company to do that, anne arundel also, I believe, did a check the results weren't pretty.

And but I just I don't know me, it's the prior law enforcement in me. I I can't compare the counties.

Because the counties are extremely different, the crime rates in both montgomery and anne arundel.

And the size and comparison to our well just for a little bit longer my my small county, those aren't.

Our numbers, I don't think that's happening here. My question was: I wanted to know how this impacts the.

People that we represent and those businesses that we represent here well, we do have also the retail.

Beverage association here to speak to the bill as well to represent the licensees the retailers.

So they are also here to speak. To that. That would be good. I just I want to know hey how.

Is this affecting them? You know, I see the owner of the rex. How does this affect him? You know. Do.

They are, is this helping your business is being able to do those things? Is it um financially sound.

Are you what precautions are you taking to to make sure that there is carting going on, and mainly I.

Think one of the pointers we wanted to know um due to covid has the ability to be able to do to go.

C

And delivery, or and or delivery, helped you keep your doors open.

C

Because I know, even though I'm not here much longer, that's why we're here is to to find ways to.

Ensure that the laws are protecting our community, but also protecting our small businesses, and we.

C

Don't want to do something that inadvertently affects their well-being and their employees.

Well-Being, so I just wanted to say that before we get the opportunity to to hear from them well the.

Some of the data we were given, those at national level and and some of it was.

A

Pretty pretty depressing 41 increase with with uh women drinking heavy drinking, there was.

A

40 of people who are have home offices and are actually on the clock or drinking at work.

A

I don't know how we with us not having any the the right resources that other people have, that.

A

We can get that kind of information, that's local, but the national trend. It's it's not good.

A

And the spreadsheets that were provided looking at the businesses and and and how much they've.

A

Businesses declined in the last year, the alcohol sales have not buoyed it up, and you know, and the.

A

Only way you can can improve that number is selling more alcohol. You know, that's that's.

A

The other thing are, we: are we serving more food? That's what you want to see. You know proportional.

A

To alcohol, but fortunately those numbers have been pretty much same stay the same. The proportions.

A

Within a couple percent right, in most cases, yeah, we had a few anomalies, but I tried to.

F

Explain them to you on the spreadsheet, um there were extenuating circumstances on most of them.

F

um Either because of their type of business and realize we only get.

F

Gross sale, information from class b licenses or restaurant licenses- that's all we're required.

F

By law to get so, I did give you a comparison of pre-covered numbers versus during cove of 2020.

F

I will still say I'm very happy and surprised that our licensees were able to maintain.

F

Food to alcohol ratio required by law for a restaurant, so we didn't have any, but we.

F

Were also prepared, we were preparing ourselves that that would not be the case because of the.

F

Liberality of the governor's order- um and we were prepared to this year's just a blind eye because.

F

Who can you know, but we were very pleased, um but, yes, the the anomalies are listed there. um Some of.

F

The owner, some of the numbers you see there where it looks like they, they gained a profit. Well, they.

F

Actually, really just opened the end of 2019. The brave souls who opened at the beginning of covid.

F

So they didn't have full numbers. We don't require if you've been open less than.

F

Three months to do a ratio with us: it's not a full year, so it wouldn't be a good comparison.

F

And then there were some businesses that.

F

Didn't open or reopen when the governor allowed them for indoor, seating and outdoor seating, so.

F

Some made the choice not to and eight or nine actually exceeded sales from the year before yeah.

A

And, and did the gain better than others and their alcohol ratios did not increase right.

When you have to ask yourself too, I mean how much of that uh you know was was benefited because of.

G

To get the to-go stuff right right, yeah and we see yeah relief, and you know extensions of you.

Know outdoor extension, things and so right numbers, that's just straight up numbers, there's nothing.

We don't ask how much of that is to go. You know that that was not even a factor in the you just.

Don't know nope, but it's just it to me. It's it's just it's an indication that that those measures.

Collectively, you know have an appearance of correct having a positive effect right now,.

Given that the bill requires a report to be filed before the sunset clause is up um means, we will.

F

Have to for this upcoming year it it back dates us to the beginning of covet, while nobody knew.

F

We were supposed to be keeping this data till the bill passed, um but we will be required. Then.

F

To at least consider those stats, if, if the, if the board opts into this, and that's one of the things.

Confusing because I've seen stuff on social media that implied that there was a law passed and this.

A

Extends for two years and what it does is it gives the individual boards the opportunity to opt in.

A

And that's and we don't have to opt in right away if it took us five months to opt in. We get opt-in.

A

There's no there's no timeline as to when we opted not saying we should drag her feet because of it.

A

I'm just saying that you could actually decide not to opt in in the year later. Have other data.

A

And change your mind and not all jurisdictions have this, but in saint mary's county our bars.

And restaurants are currently for the most part, with few exception.

F

Are allowed on off sale of closed factory, sealed containers of beer, wine or spirits so.

F

They can do that now as far to the only thing they can't do is a mixed cocktail.

F

Or an open container what we would normally consider an open container.

And so one of our responsibilities, if we opt in, is going to be.

A

What kind of containers appropriate, for example, we could restrict the time frame that it's.

A

They do these kind of things, there's a lot of things. I believe that we can sit there and do is.

A

That correct you'd have to ask the attorney. I mean I'm kind of under the impression the only thing.

The board can limit is the quantity of alcohol that goes with each order, so you don't have to.

A

Have a tamper, I thought she said that that's in the law. The statute provides that the sealed.

Container uh must be closed with a cap, cork, seal or lid with no holes or straws or sipping. They.

L

Already qualify what what the container yeah it's pretty! That's pretty vague! That's uh yeah! I mean.

A

It could be just uh it could be a paper. It could be a a coca-cola container with no hole in it.

A

Right, you got almost like, you know, buying a coke, it could be just a paper container, it doesn't.

A

Define what material it's in and all you have to have is a snap top on it and you're good to go.

A

Which you could unsnap it and drink it there's a difference between having a a beer which is.

A

Factory sealed and the police officer pulls you over and and sees a beer in the car and and.

A

And the cap's opened, even it's a screw cap it has, you know you can you can say yes.

A

That bottle's been open in this case, there's nothing that requires them to provide a cup.

A

Or container like a growler or something that has a tamper tape on it, the language for the growlers.

Was a little more broad at what the boards could do to in in in to enact rules.

And chris you'd be better at this. What I see here other than on 4 1107 paragraph a.

Which still to me, says that it gives the licensing board adopted to adopt regulations to authorize.

The sale or delivery and then at the end, towards the end of the statute, it states.

Section d d: it says um the local licensing board may not charge a an additional fee to licensee and.

May limit the quantity, the fact that they added in the type of containers- I I don't think we have.

I don't think the board has the authority to change that. I know there is one jurisdiction, who's.

Actually put that already in their regs that they have to be tamper, proof, and I kind of I wasn't.

Sure if they were coloring outside the lines there, but it certainly did seem so to me I mean that's.

My interpretation, but I would I would agree to a certain degree with what tammy is saying, because.

They actually go out of their way in this statute to say what the licensing board.

Can and can't do right, so if they, if they were going, if the legislature was going to provide the.

Licensing board with broader power- I presume they would have stated that in the bill, but they don't.

So normally the languages the board may adopt regulations to administer to this and they've kind.

Of really given you straight up what you can do or can't do well, they give you the ultimate authority.

Whether to promulgate right right, I presume that's what they're, why they've done it that way.

They say if you, if you're going to do it. This is how it's going to be done and.

These are your your powers. If you don't want to do it, then.

And then obviously they're saying you need to convey and consider economic recovery and.

Public health and welfare when deciding whether to promulgate and propose this or not.

And in your packets you also received a letter addressing the chairman and.

The board from the restaurant association, which was one of the sponsors of the bill.

And their reasoning for the need now this bill um does tighten up the reign of what the current.

Executive order allows, I mean it's: half of our bars will not be able to participate in this.

F

Bill because they do not have kitchen facilities to make prepared meals.

F

So, like I said that it's the res, we all all our restaurants and about half of our bars um have the.

F

Facility to prepare food versus convenience store goods which you cannot which would not qualify. You.

I

Okay, a lot to think about yeah, the the um during mayla and throughout.

F

Legislative, um our meetings during legislation I mean some of the concerns- are the biggest concern.

F

Is mixed cocktails nobody's concerned about beer wine because most of us allow closed containers.

F

However, in saint mary's county, our rules and regs prohibit delivery, so we would, if, if you.

F

Opted in, we would probably for a delivery. We would have to do something in the regs to address that.

F

um Did you say something about they're gonna have to keep a log most of the boards who are looking.

F

Into well, some some of the jurisdictions already have delivery and they and they use a log book.

F

um Which it's kind of it's like a keg book, a lot of any of our stores that sell kegs for off sale.

F

They're required to have it's a sticker, but it's required to fill a log book. You.

F

Get the name address, and it also has the form of id and the license number written on there.

F

So it's kind of proof that they've checked the id of the person and the date of birth and made.

F

Sure that you know this person was of age, it's not required in this law. It's not well! This.

Law allows there is uh part of the statute. Does state that the law, the board can.

Where is it, it was something there is something in here about the board dictating.

F

um uh Requirements for ids all right, yeah, well, they're, you're, required to.

The licensee or the permit, or the licensee is required to do the proper. It's yeah.

Proof of proof of age, but there's nothing, demand data log. Well, I think what it says is if the sale.

Is for delivery provides any documentation that the local licensing board requires.

So there are many jurisdictions that are going to either expand the logbook to include a copy of the.

F

Invoice receipt showing that it was food and alcohol, not just alcohol,.

F

And, and those who don't have are many are talking about, including there's no other.

Way for us to enforce this, or or or even get data on it or anything right. um You can't, as.

F

Sergeant meyers told you last time you can't exactly have a compliance check where you have.

F

A ci order from his home it puts the ci's identity at risk. You know.

F

That's why they're a ci, so you can't have somebody delivering to law, enforcement's home.

F

It's it's just not feasible and you can't have um you know our inspector, but how do we follow the.

F

Delivery, what do you know do we do we just stand outside and watch delivery, whoever's.

F

Delivering and follow them around to their it's. It's a difficult thing to enforce. On delivery.

F

We got on the weeds with this last meeting and the melee two got in the.

F

Weeds in regards to what constitutes a meal, two slices of pizza, three hot dogs, a pie.

And I think I don't know the statute unfortunately, is pretty vague when it comes to that it says.

Prepared me or prepared meal other than pre-packaged snacks, so it leaves it pretty.

Open as to what yes, my son's six foot, four, he can eat a whole pie, no prob. It's not a snack.

Yeah we're making a fish sandwich would meet the requirement yeah.

Versus a tavern versus a bar, um I think the ones most affected in the hospitality realm.

By covert were those who did not have food to help them get through. This are straight-up.

Bars that do not even have kitchens, um they were the ones that really took a a hit. So.

I think from the information I heard the other day um you know, package stores are.

Hurt for her too, you know, there's, there's uh shortages of c um cdl licenses and being able.

To get product delivered to the stores and that the numbers in the beginning were good.

Because people were stocking up on alcohol, but sales have dropped off, can't get product.

So um I think it's across all the business models that kevin was out speaking to one of the.

On one of his inspections, speaking to a liquor store owner who actually, I think he said.

This march march, 2021 sales were actually lower than pre-private yeah people were stocking up, yeah.

So and that's what I've heard from the few liquor stores that I've spoken to it's in initially.

It was christmas march 2020. It was like christmas sales um because people were like. Oh, I gotta.

Get my alcohol, I get my I gotta get my town outs, but you know and and then you have the.

Aluminum shortage which stopped product so yeah it was, it was tough. It was tough for everybody. I.

I don't think anybody really. I I don't think the norm was that somebody did better.

I'm sure there are a handful out there that that beat the odds, but I mean you see everybo, there's.

Very few on here who, um who had an increase in their bottom line in the in their gross sales.

um It's been a challenging time. You know, everybody knows that you know between.

Labor shortages, customer shortages, food shortages, delivery problems, um just a whole host of issues.

We were fortunate when the governor put through his executive order, a temporary emergency order.

Allowing us to do business a little bit um different than we normally do. I think.

Everybody that I know of that attempted to do that. um You know at least you know, speaking for my.

Peers, I know that we tried to do it responsibly. I think that we pretty much have done it responsibly.

As far as this legislation is concerned, I think that.

Even though covid restrictions are being lifted and things are getting more back to normal.

We're still having a lot of issues in our businesses, and I think this would.

Be a good crutch, a good tool to help us transition back to being more normal.

In my personal business we were fortunate to do a lot of to-go food. We didn't do a lot of.

Takeout drinks, but if a customer asked us to do takeout drinks, we certainly accommodated.

P

Them other businesses made a part of their business model where they would sell jars of.

P

Mixed drinks or crushes, or things like that, and I'm sure that helped get everybody through.

P

Obviously, everybody didn't make it through there's a lot of restaurants that have closed.

P

A lot of bars that have closed, and I would only ask that the board would opt into this.

P

Legislation just to continue those of us that have survived if we need to use this tool to to use it.

Joe, would you like to speak to please, so I think what makes this unique is it's not a.

Law that you're putting into motion and then we're going to see how it goes. It's a it's a.

Law that we already saw how it went and um a lot of this to answer a lot of your questions earlier.

About regulating everything, a lot of this was for craft cocktails. This is for things we did well so.

If you go to, uh if you want a good steak and cheese you go to, you can go to showtime.

Deli or you can go to the grocery store and get everything you need to make a steak and cheese.

We didn't see a lot of people coming in, for you know later in the evening, 10 rum and cokes to go.

For you know we're on the road we're having a party. Let's keep this party going or anything.

This was, I think, for most of us more for us to display something that we did well.

Something that people missed while they were at home from our particular establishments.

And to highlight a couple of things, you said, I think the to-go containers and the time period.

Is the best way to regulate these things? I mean I was looking at some of the suggestions.

um That were sent out to regulate the. I give you a loophole for almost every one of them right now,.

J

If you did want 10, rum and cokes, and I'm not allowed to do rum and cokes to go.

J

I could sell you a bottle of rum right now in 10 cokes and um with a lot of the national numbers.

J

You were talking about, I mean a lot of that falls on people going to a liquor, store and picking up.

J

All these things and when you go to a liquor store, even if you're, just going in for a bottle of beer.

J

Do they say you got to get a stick of beef jerky? Along with it I mean at some point. You have to.

J

Put this on the consumer as well, and but the most important thing for us is the restaurants.

J

Where we highlighted things we did well, and people said: oh man, we missed the the bretton breeze from.

J

The wrecks and they could come up and get a few of those and bring them home for a cookout. But.

J

I don't think there's a lot of establishments that want to do this past 10 o'clock at night.

J

I mean we don't want to turn to the person. Who's been partying, this whole time and say.

J

Oh sure, you want one more ticket to go with you and I don't think a lot of people want.

J

To bring it in their car with them to go at that time, so I've been in this business.

J

For a long time- and I can tell you, there's two different crowds: there's the before 10 o'clock.

J

And there's the after 10 o'clock- and I would I'd limit this to the before 10 o'clock- crowd.

J

And I'd allow businesses to highlight the craft cocktails or secret recipes or things they've come.

J

Up with in the past and allow them to continue to do so as far as the delivery, I didn't have one.

J

Delivery request, I'm not saying other restaurants and bars didn't, but if we did I'd be the one doing.

J

It I wouldn't allow my staff to do it, then you have insurance and gas prices and I'll.

J

Let uber eats or whoever you know deal with that because well they're not well legal. To do that.

J

Yeah, I just don't, I don't see the I, you never know what will take off and you don't want to.

J

Cancel yourself from a potential business idea that could could help you out in the long run, but.

J

I wouldn't have any interest in delivering alcohol late at night or anything like that.

J

And, like I said, the craft cocktails and things of that nature, we have one gentleman whose wife can't.

J

Make it to the bar anymore, and he stops by on a wednesday, and we have a special drink.

J

That she likes that, obviously they don't know how to make or don't have all the ingredients and.

J

That, I think, is what helps us out things like that, but not keeping the party going.

For somebody else who do you think your product travels? Well, I mean you know if I was to buy.

A

One-Year specialty drinks and I drink it right there at the bar vice traveling 25 minutes later.

A

It's delivered to a home, that's a very good point and that's uh maybe even something that you could.

J

Use to the advantage of this law is ice or no ice, I mean if you don't put ice in a drink. I don't.

J

Know if there's any rules or regulations with that, but who would want to drink it right there.

J

And then, and who would want to go home and add ice to it, whereas you know that might be a very good.

J

Way of limiting that so and I think the health department actually classifies ice as food. Yes, so.

J

Joe, what what would you want from us, how how do we help? How do we help the small businesses.

Me personally, I would like to see the continuance of serving our drinks to go. I mean again there's a.

Loophole with anything else, if you, if you want to stop a lot of it, you can't we can sell the.

Ingredients and they can mix it up on the way home if they want. But if you allow this to to go and.

J

And allow us to serve our local flavors or our secret recipes, or anything like that.

I would limit to 10 o'clock. I think my staff would would be appreciative if they could call the rule.

At 9, 30 10 o'clock to people begging at the bar for a drink to go, say: hey, no, we're not allowed.

J

And that would everybody has uh you know the worry these days? Is it going to fall on them, so nobody.

J

Wants to do that, nobody wants to give that rum and coke with more than two ounces of lick. I don't.

Know how you'd enforce that unless you brought it to a lab by the way, I saw that in that packet.

But nobody wants the liability these days, but the the good part of it would.

Be more geared towards during the day to do something in that manner.

Rearranging cabinets and things preparing for we can have rash training again, which hopefully.

Will be soon, um I did 11 inspections and the paperwork and following that goes wrong with that.

uh The friday mail meetings, the cac meeting and this past tuesday, the mail our conference was.

The all-day conference we had so that's what this month, so I did this month so excellent.

So my other issue is that we tabled for this month is amending the resolution. 2020-01 that you issued.

To me, you granted me during the very beginning of cover, give me authority to approve certain.

Requests, obviously, the covid emergency seating plans, outdoor seating plans, but also.

Officer changes, extension of premise um any any any that were um they had come before you, but.

You know they had a 90-day, any extensions, any extensions of those actually, the extensions of.

Those the expiration dates of those carried through with covets, so they actually all.

Expire according to covid, on, according to the governor's last order on june 30th.

So they would need, if you retract this order, they need to come to you.

um Those who are expiring, who weren't given beyond that they need to come to you next month for.

Extension, if they, if they haven't finalized their extension of premises or their transfers,.

Transfer of licenses or new license applications. All of those fell under that.

So I mean at this time I mean I know you're still six feet apart, but you notice there's.

And we can have up to 32 people in here and and that's easy enough to control.
