Planning, commission comprehensive plan review and update and discussion mr boston pam.

Good evening, mr chairman and uh planning commissioners.

F

On december 14th 2020, I was here to make a presentation to you on our.

F

Preliminary scope of working strategy for the review of the comprehensive plan update.

F

I gave you out this documents and then we went back to our.

F

Board and then our drawing board and then revealed the work that was submitted to you and then made.

F

Some changes that for effective management and effective control, we tweeted and made a number.

F

Of changes in the uh uh the presentation I gave to you, so what I'm presenting here is just a revised.

F

Preliminary scope of the comprehensive plan update for the review of the comprehensive plan.

F

Yeah, this is the one powerpoint yeah powerpoint, one yeah.

F

Yes, so uh the revised uh uh scope actually uh has been simplified in a way and uh what.

F

We're doing is uh the statement of what proposes that you, the planning commission,.

F

Designates itself as the comprehensive plan review and update committee with a.

F

Total oversight role throughout the estimated 24 month, duration of the plan next slide. Let's slide.

F

Yeah in that direction, uh we are employing you to direct the department of land use and growth.

F

Management as project managers to review and approve the revised scope of work and schedule.

F

To request the commissioners of saint mary's county for a directive to proceed with revisions.

F

Of the 2010 comprehensive plan to review a presentation of the trends in a development.

F

Capacity report yes, and then also to manage online service, which will be part of the public outreach.

F

And visions and the planning element workshops and then review the drafts of the comprehensive plan.

F

And schedule public hearings organize work sessions and then, when all is done, you transmit.

F

A completed, updated, comprehensive plan to the commissioners of saint mary's county. That's right.

F

Yeah, so what you see here uh much more on the chart, which is the west schedule, uh uh illustrates.

F

The flow the workflow and work plan of how we foresee this to be totally accomplished. uh We are.

F

In the initial stages, now uh to present this to you and uh for you to pass a motion in terms of.

F

Requesting the commissioners for directives to prepare the com review, the comprehensive plan.

F

Then, after that, there will be what we call the trends and development capacity report that.

F

Will be a stage whereby we will answer several questions in terms of uh build out rates and also.

F

Socio-Economic trends and others in the country in the county.

F

The trends and capacity report will be done in-house and also with the assistance of the.

F

Maryland, department of planning and our gis and our I.t division and their request that once we.

F

Finish that work, which might take about a month will make a presentation to you. Then, within the.

F

Workflow is the visions. uh As you are aware, the maryland department of planning has these 12.

F

Visions in which we'll do the workshops on and uh we intend to work on online service.

F

Put service online to involve the community. Do a lot of effective community outreach.

F

So that they will help us target uh these visions, uh the plan is within a period of about two.

F

To three weeks uh for every after afternoon, there will be one vision you know in terms of for the.

F

Public to be able to be part of and participate uh in the plan program. Most of these missions.

F

Will be geared towards what actually, the maryland department of planning has actually earmarked.

F

For race, after that, you know there will also be the elements group, which is the most important.

F

Aspect of the project, the planning elements group- are nine and they've been actually been.

F

Worked out in a way whereby, within a period of nine months, we'll have one element for every.

F

Month, the plan is uh we'll be forming committees asking various directors and other expertise.

F

To form into planning element committees- and this will be either water resources.

F

Which will be the initial ones? Sensitive areas element priority preservation, areas, element.

F

Land use plans and growth management elements, transportation, public facilities.

F

Housing, human services and economic element- if you look at the chart, I have them as one two.

F

Nine uh uh areas whereby, for every month each planning element committee will be here.

F

The program will be work towards your reviews so that uh we will look at the.

F

Planning agenda for the month and see how best we could schedule an element within that.

F

Presentation and the presentation will be made to you and for the public also to listen and then.

F

Participate in it, when all is said and done, most of these planning element groups will be writing.

F

Out reports and outcomes of what has transpired and we will move on to the write-up stage. We.

F

Envisage that there will be almost about about two to three months right up stage that is crafting of.

F

The language of the revised comprehensive plan, then after that will be the public hearings.

F

The once they craft the document it will have a draft document, then that will be.

F

Given to you, in which you will then organize and schedule the pc public hearings after that.

F

Then there you will schedule the pc work sessions and then once you go through.

F

And then close the public hearing, then whatever changes and others that will be made there will.

F

Be a transmitter of this to the commissioners and they will also organize their public hearings.

F

Conduct their work sessions and then, uh with the final approval, will be the uh revised.

F

Comprehensive plan, so this is the workflow that I'm presenting to you and my request is for you to.

F

Review discuss, I think, you've already taken a look at it and then request. The commission associates.

F

uh Mary county for a directive to proceed with the revisions of the 2010 comprehensive plan.

F

If there's any other explanation that you want us, I mean able to explain in.

F

Detail, it's really easy when you say it like that it does just this flows off the tongue.

G

Yes, please is there going to be one planning, group or nine planning elements, nine planning.

F

Element groups: okay: uh there will be a committee made up of my suggestions that directors and.

F

Various expertise will form. The planning element committee within in the committee will be one.

F

Water resources, then there will be sensitive areas. They can form their own group of various expertise.

F

Who look at uh the subject areas that are concerned within the 2010 comprehensive plan?.

F

Which areas are to be revised? We foresee I mean we already know that the the water resources and.

F

Certified areas is so much important. You know to so this discussion. My directors brought in.

F

For this to be the first, so that will be their own uh committee, but all of these nine I will be.

F

A standing, nine-member planning element committee and each member will be directing its expertise in.

F

Terms of the various groups that I've outlined here, so it's one committee with nine members.

F

Yes for to overlook the planning elements, because that is the main component of the board: okay,.

F

So each committee will have its chair so and then, once we have this committee within that.

F

They'll confirm their expertise group, whether it's transportation, whether it's housing, whether it's.

F

Priority preservation areas yeah two three yeah, if I may so it's one committee, but nine groups.

E

And so there could be some people that might serve on more than one group because of their broad.

E

Range of expertise, yes, during our meetings, we'll only be discussing one one subject at a time. Yes,.

F

So on the chart, if you look on the chart, uh the number five I've made in such a way that.

F

For every month, there's one uh element group and on the second month, another element group.

F

The third month at another element group out of a period of nine months, we would have completed.

F

All these and they'll be coming out with draft write-ups and changes that we have to make.

F

To give to srs into the crafting of the language or the final of the comprehensive plan, I know.

A

We haven't scheduled any of the uh work sessions for that part, because it's it's a little ways out.

A

But I'm thinking that we should do it at the beginning of the month. The work session in.

A

Case it takes more than one work session to for each one of these elements that we have nine.

A

So some of them are going to be gonna have a lot of information with them. Here's some that.

G

Are going to take longer, I mean yeah. Yeah we've been some of these subjects. Yeah, I don't say we.

G

We have struggled with over decades, and so to put this in in place is this? Is you know, hopefully it.

G

Works out, this is very aggressive. Yeah he's very aggressive. That was my going to be my question.

You're expecting uh each group to like group one should be finished at the end of june. Yes, please.

A

Say for water resources we should be able to get it done, yeah, so you're given 30 days yeah. That is.

F

That's just a time yeah and says it with a smile too yeah, I'm smiling, but that's why I say maybe.

A

We should like try to plan our work sessions the first week of the month, then, by the end of that.

A

Day we can figure out one. We got to figure out when all these board members are going to be.

A

Able to meet for their for these work sessions being a monday or tuesday wednesday, thursday.

A

Whatever, because we're going to have to have them during the day, I would suppose, but the chart shows.

Our work sessions at the end of all them nine yeah, it's like we're, not that is separate involved that.

F

Is separate? Well then good, let them have it yeah. It does that's what it looks like we're. Booted.

B

Out of one three, however, we're gonna get them all mined at one time I didn't know if we had to be.

H

Better, as you could one at a time well, actually, if that's how the paragraph is written so one month.

Each element worked on by the planning element group, then, at the end of that group's work, we.

E

Would bring you the result of that group, hopefully at one of your regular monthly meetings? Okay,.

E

Within the schedule month I mean supposedly well or presumably the next element could be working.

E

On the next element, um the next element group could be working on the next element.

E

While we're giving you the presentation so it it doesn't have to happen the exact same month, but.

E

You have to be here, but the plan is not for us to get all nine elements.

H

At the end of the year, you're going to get one element update a month, okay and hopefully during.

E

Regular meetings, but if your case load, as the paragraph says, if the caseload does not allow, is.

E

When we would schedule um extra meetings to get to keep you updated on the status, that's even better.

B

So do we have to have that at this meeting I mean it in the beginning. Yes, I thought we just had it.

B

When we worked all those months, we can't work in your office anymore. The house yeah in your.

B

Office it worked out pretty well yeah. The the committees will be doing their homework.

F

The committees for each if we take water, let's take an example: the water resources committee.

F

They'll be doing their homework enough. I know that before a presentation is made up to, you must.

F

Have covered quite enough of what is required and the changes in the 2010 comprehensive plan.

F

And they would have crafted that language to accelerate, extend that to go into the write-up.

A

Yeah are there meetings open to the public when they, when they do that yeah to be just like this.

F

Open to the public yeah, but but the monthly element update to you is just a presentation.

E

It's it's not a work session for you, it's a here's! What that group um worked on and arrived at, here's.

E

Their final product and then that'll, be you'll, be informed on that subject and that information will.

E

Be set aside, while we work on the next element and at the end is when you'll have your work sessions.

E

And when you say put the thing together, correct and together correct when you say it's open.

A

To the public now suppose are board members allowed to uh be present at the work session.

E

You would be allowed, I mean the important thing is, we have to. You, can't be a quorum.

A

So you can't act as a company as a planning commission, especially if somebody wanted to.

A

Have input so you could have three yeah well, if something bad happens, we'll work that out.

A

I just know sometimes there's going to be a couple board members that are probably going to go.

A

Want to go to one or two or three or four of these. Yes, since it's open, I think.

F

Very interested and committed you might just want to contribute so you'll. Have it in this.

A

Room but uh yes, please, basically it's going to be on webex. Yes, please and part of what we need to.

E

Get input from you is also in this paragraph, so I'm referring to page four.

E

And it's right above the planning element um table.

E

So these groups could be made up of experts that could be appointed by the.

E

Commissioners of saint mary's county or the planning commission or recruited by staff.

E

To add to that, since you've shown that some planning commission members would be interested.

E

Planning, commission members um could volunteer to be a member of a given group. Well if they.

A

Wanted to they, we could get in a joint email. You know if it comes to I'll, say.

A

More than three of them wanting to be there, but we'll we'll worry about that when it comes.

A

Okay, we'll make it we'll make it work. So at the december meeting quasi, um you know when.

E

He presented, and there was some discussion about how to find people to work on this, and um what mr.

E

Sinclair um has provided one person so so far I have a list of one and, and you know we could go.

E

Out and recruit people, as this paragraph says, or you all can put forth um people that you would.

E

Propose including volunteering yourselves and then we can look to the county commissioners to appoint.

E

People, okay and the tennis uh they direct us and various other people with expertise will form.

F

Each these committees, they will know best- I mean who will be very much- uh have time and contribute.

F

You know to the subject areas of this area, so if we take a for example, transportation.

F

Element, for instance, uh we expect and that john dietrich, the director of transportation,.

F

To be the chair, he will form his own know, people who will really contribute. Look at the.

F

2010 competitive plan, what changes students who made and then the presentation will be.

F

Made up to you so uh that's how it's gonna operate on the various.

F

Element groups for the the chess and we'll be able to find out who and who will be able to contribute.

F

You know to look at what is in the 2010. What changes should be made, then the presentation to.

F

You your work sessions will only really start when the document the draft document has been given to.

F

You and then you've done the public hearing and then the the work session will follow up. Then.

F

You have the whole document in one totality. Yes, but these are subject areas required uh within.

F

The state mandates, let me ask another question real quick just so I'm trying to understand.

H

I'm kind of comparing it to the work sessions that we did over at luggum a few years ago, updated some.

H

Of the comprehensive right plan um with this it says the planning elements group will make.

H

A presentation at our regular planning commission meeting, like this, mr knight, said so at that point.

H

When they're giving us just say end of the first month, they're giving us the water resources.

H

Update or it's it's finished, this is what we've got for you to look at for the water.

H

Resources element is that at a time that we will discuss that and will will it be changeable or.

H

Like we, you know when we had to work sessions, we went through each particular part.

H

And if one of them said you need um three acres to build a house and uh five members.

H

Of the nine voted that we only needed two and a half it changed, it certainly will be changeable.

E

Because it's just a presentation of the work that the elements group had completed thus far.

E

And so those nine elements will all have to be put together in the draft comprehensive plan.

E

And so when we give the presentation that would be at the commission's discretion.

E

If you want to have discussion and provide comment at that time, what I would think will be helpful is.

H

This just my opinion on the board is when we finish each you're going to give us.

H

Whatever the committee has came up with for water resources, I would think that at that time,.

H

We would probably I don't know if we would want to do it here or look at it on our own and make some.

H

Notes so, at the end, when we got to the entire document, is that the way to that you would think.

H

To do it, if we had 20 total changes over the whole nine elements or whatever, or would we address each.

H

One right now: let's get the water resources done happy with the with the board members and.

H

What would be the preferred way for they? They they most of these elements, grouped in.

F

Comprehensive plan process are very cyclical. uh They are not finite, you know. So if the committee.

F

Looks at water resources and reveals that there are some major issues that have come up here.

F

Meeting you formally presentation that they are giving to you is not the final assertion.

F

We foresee that the committee members will have an communication with ourselves with yourselves. There.

F

Will be ongoing discussions as such and uh before even they come over here, you know to that. This is.

F

The former, because there might be another person outside who will be listening, who say: hey you have.

F

Come up with this, this is what I my idea that I have you know on this water resources. So most.

F

Of these uh discussions will be ongoing, but but we expect the committee to come up with a final draft.

F

Document after the public elements uh meeting now with you, you know to go into the draft.

F

Plan which will still also have to go through another review and work sessions as such.

Because there yeah, because there could be elements that once you can't expect this.

B

Board to review that digest it make recommendations in an hour right yeah. It's just.

B

Not doable no, and I I I I'm sorry to interrupt, but I don't think that's our intent at all.

These these um elements, work groups will do their work. The results of that work will be.

E

Presented to you understanding um your interests, mr van kirk, we should get that.

E

Presentation to you well in advance so that you can see it and and be prepared to discuss it.

E

Then, if the commission, of course, at the chairman's discretion decides they want to have.

E

A discussion at the meeting on the subject and provide feedback input every step of the way we.

E

Need to gather information, we need to, you, know, um collect and hear and assimilate and then there's.

E

So we will have done that up to a point and we're going to present what that elements group did.

E

Then you're going to give us feedback that night at the presentation, if you so desire and then.

E

We'll take that back and the next step after the elements group is the actual drafting of the plan.

E

But it's just a draft, then there'll, be the public hearing and you'll get the public's input.

Because somewhere down the road like and I'm just using these as an example, we hear the.

A

Water resources element part of it and we discuss it and we're moving on. Then we get somewhere down.

A

The road like housing element and start working on that we realized we left something out of the of.

A

The water resources or something pops up, so we would still be able to move back and forth. Yes,.

E

Absolutely it's a working document and then, when you get to the then when you have a draft that has.

E

Everything from the work groups, everything from your feedback from the presentations, everything.

E

From the public from the public hearings, then, is when you're going to need to invest much.

E

More than an hour in your work sessions to arrive at that final document, which I didn't think would.

Be in here yeah because the work session is on. If you look at the chart, it's to the task, seven.

You know the tax seven after the public hearing, which the same way will go through reviews and.

F

Comments and feedbacks, and so many others yeah and ms robreck, are you asking for confirmation.

That the work sessions would take place here. Well, I'm not in a planning and zoning meeting.

Here I mean you know like or once a month or twice a month.

E

Right, your regular monthly meeting, I don't think- would accommodate.

A

I'd like to think that a lot of people would come in and make comments during the work sessions.

A

It's always better, the more information you get the better um but you're going to have.

A

A certain amount of people in this room too I'll, say you know, staff and such that's going.

A

To y'all will be present at these meetings and then um as many as many as you can accommodate.

A

Yeah we'll come in and then we'll be on webex, but now with all these virtual meetings,.

F

uh We intend to once uh we send our information to the pio and much publicity is given onto this.

F

No, when we're doing these work sessions and others, we expect a lot of people to you know, call.

F

In or write in or then we we intend to give much publicity and on this process on the lego website.

F

And also and the various areas where the pio, the public information office will.

F

Provide the information and uh throughout all this, so there will be this continuous.

F

Recycle car review, of whatever outcomes that we see in this uh program.

I

May I ask a question: please kevin summers. Can you hear me yes, so what I'm? What I'm.

I

Thinking I I'm trying to follow um is that, for example, the first element would be discussed.

I

And at that meeting the group that is presenting that element would obviously provide all the.

I

Members of the planning commission, the information prior to the meeting, so that we could review.

I

They would come in, they would do their presentation and then what what I would.

I

Sort of make sense to me and correct me: if I'm wrong is that then the next meeting.

I

Would? Give us an opportunity to come back with any additional questions.

I

Possibly listen to public comment and then the second element group would present their.

I

Information so that there's a little bit of an overlap with each one. Does that make sense.

F

Yeah, I think, we're speaking the same language, yeah, okay,.

G

Quasi, do you um do you see some uh that these work groups are going to be formalized just to.

G

The degree that there'll be a certain number of members of these work groups you're and there's.

G

Going to be some subjects, you're not going to have a problem with people reaching out yeah. There are.

G

Some of these people, some of these subjects that are people very passionate about yeah.

G

So, with regard to the group itself, um do you have some sense about the number of people that would.

G

Would form the group? Is it going to be sort of a finite number? Not the information, you're.

G

Going to have information flowing in all over the place, I hope I think if we elect a chair.

F

Of let's say, transportation and john dietrich knows that uh within this area, there's an.

F

Element that uh and that will look on highways or those are all certain m dot requirements.

F

That will determine the number of expertise that he's actually looking for within the world.

F

Yeah within the work group they're going to have to come to consensus.

G

Within that work, group yeah and if it's open to well it's open. But if, if it continues to be.

G

Open to 100 people, drawing consensus, sometimes from seven, is difficult enough. As aside from.

F

Yeah it it to be a controlled uh a group by that's just getting it to be a controlled by the chair of.

F

The element group, water resources is a major issue. You know that uh you'll find a lot of people who.

F

Wanna just say that the chair, if we find that the chair for that water resources element, there are.

F

So many variations on whether that is an element of groundwater, there's so many others and they'll.

F

Find those expertise to be that group, you know and they would actually look at the language.

F

In the existing comprehensive plan make the change look at what has been happening and then.

F

Help craft a draft language for us, you know to follow up in the new the revised, comprehensive.

F

Plan so the elements groups will be controlled group actually by the chair.

G

So it's it's important, I mean this is for some of us. We we've done this before so it's.

G

It's important for people to make a contribution for people to reach out to to, because once every.

G

10 years outside of you know, adjustments along the way. This is an opportunity, yes uh to to address a.

G

Lot of these things, yes, that not that they will be remedied because many of the things that we talked.

G

About in ten we'll be talking about again in twitter, yes, yes, so so I'm just! I would encourage.

G

People that that, um over the last five years that have issues with with something. Yes, that.

G

They voice them. This is the time to do that. Yes, yeah, if they would do that, it's it's helpful. Yeah.

G

um You know, don't don't wait till after it's over and then start to complain. I know yeah. We.

F

Intend to have an online provision, and now that's been done in various counties and online. A on the.

F

Subject, area and people can put in their comments put in their uh reformers and you could have.

F

A lot of feedbacks and then we ourselves and the committee will see through the comments.

F

And this is not for this time, but I I've been able to participate in charettes yeah that do the very.

G

Same thing, exactly a bunch of flash cards come up and you start I like it like. I like it right.

G

And at the end of the day, you have uh some students, perhaps from university.

G

They put all that information together, yes and, as mr summer says, the next time you meet yeah you're.

G

Shared that information that you talked about from the previous session I mean uh prince, I mean.

G

Yeah calvert did it with prince prince frederick. uh Unfortunately, it was one of the most successful.

G

Charettes I've ever seen yeah. Unfortunately, none of it was implemented, at least almost none of it.

G

Yeah, which is which is truly a shame, because after all that time and we, when we all came together.

G

The church you know here comes: are there any questions and everybody wants to shudder? Yes and.

G

There were two: there were just two comments: how well it had gone yeah, but at the end of the day,.

G

um All that really good information, yeah and unfortunately yeah we mentioned the chares.

F

In the uh and divisions in the vicious exercise and various judges have done it- I mean by I mean.

F

Virtually virtually both uh the items on the newspaper uh dochester county, the items on the.

F

Newspaper in which uh people contribute that what they their views on sustainability, what they are.

F

Their views on community design, what are their views on transportation or house and others and.

F

Then the shares will operate in that way, and that would be the same. That's excessive! That's this.

G

Particular character, which is this much smaller area, yeah yeah, which is that there are overlays.

G

Yeah is that here is the basic idea: yes, and they present it. Okay and everybody will say: oh, I don't.

G

Like that, and then they would, I use, I use the term vellux, it's old school, okay, clear and they would.

G

Lay the next layer on top and say well, do you like that better, okay and then that's how it evolved.

G

You know over time, and this is the and then they would vote. This is what we'd like to see.

G

And then they would talk about phasing and the rest of that yeah. It's a protracted thing.

G

In this particular instance, it was not inexpensive. Okay, I mean because.

G

They had a company that they came in, I'm not suggesting that I'm just simply saying that.

G

um The more input that you have exactly is is better for the people that are that are getting.

G

For the critical area boundary map update first, where is the critical area all waters.

Of the chesapeake bay, the atlantic coastal bays their tributaries to the head of tide, all land.

J

Under these waters, and then what we're most concerned with here, of course, is the land the.

J

Land within one thousand feet of the landward edge of tidal waters entitled wetlands the background.

J

To what I'm presenting tonight begins some years ago, the original 1000 foot critical area.

J

Boundary was manually drawn using the 1972, tidal wetlands map and they haven't been updated since.

J

Then the boundary back then was drawn manually and of course there were inherent inaccuracies.

J

And since that time, not only do we have initial inaccuracies, there have been extensive changes.

J

To the landscape, the shoreline wetlands and the maps must match the landscape.

J

The electronic maps are now the standard, so that brings us to the general assembly in 2008.

J

Which bear in mind that's 2008, this mapping project started at the state level house bill 1253.

J

Has mapping provisions the legislation required the state to work cooperatively with local.

J

Governments to update the critical area maps to replace those original hand-drawn maps with.

J

An electronic map hb1253 directed the department of natural resources to prepare a statewide base.

J

Map with the state determined shoreline, the new boundary line has been drawn using color.

J

Infrared imaging new light detection, ranging data, new aerial photography and gis software.

J

Critical area: commission staff, the eastern shore, regional gis, cooperative and salisbury university.

J

Staff worked with local local governments to make the new boundary line field visits were.

J

Conducted in some instances to ground truth, the aerial, photography and color infrared imagery.

J

The critical area commission held a public information meeting here in this room in.

J

August of 2018 property owners with at least a one percent change in the critical area.

J

Boundary on their property, as determined by the mapping group that was putting this map together.

J

Were notified by letter of the change and the meeting with critical area staff, the letter.

J

Had photographs of the proposed change on their property, here's some images of how that mapping.

J

Process we didn't say how, but at least the the data that it looked at.

J

I hope this is showing up well enough yeah, so what they looked at.

J

Was to digitize the shoreline, the edge of open water location of water time of image, capture.

J

They took into consideration, shadows, tree canopy, the width of the channels and then.

J

In the next one, you see what it looked like with false color infrared, where they digitized.

J

The elements of concern and of interest to show the wetlands, as well as the water itself in the.

J

Mapping process when there were discrepancies, anomalies, inconsistencies that were identified.

J

Next slide harry, they were reviewed and additional resources such as permits historical aerials.

J

Helped resolve issues and in some cases, dnr went into the field to ground truth. The.

J

Images that they were and the maps that they were, that they were making the county gis division.

J

Created an online map for county residents to show a comparison of where the critical area.

J

Boundary is currently located on the property and where it will be located with the adoption of the.

J

New boundary line- and these were posted after that meeting and they've, been on the website ever since.

J

The maps are on the on the website so that that residents, who own property in the critical era.

J

Can compare what's on their property now as far as mapped and what the new change is going to be.

J

The critical area commission also responded to residents with questions about the revised boundary and field. Verification was done when needed.

J

So what where we are now is st mary's county and all local governments must adopt the new.

J

Maps without changes, in other words the general assembly, passed legislation in 2008, instructing.

J

That these new maps be made and after they were made and finalized in our case, that was done.

J

After that meeting in 2018, then the legislation requires that local governments adopt the maps.

J

But you can't change the maps so in other words, the.

J

What you have in front of you is the final version that was put together by the state.

J

And then our gis division received those files and put them on the existing official zoning.

J

Maps of saint mary's county such that when the commissioners of saint mary's county, adopt these.

J

In a month, or so they will become the official, the official zoning maps will have that new boundary.

J

But not not this board, nor the commission can change them at this.

J

Point it's a state-created product that must be adopted by the local government.

A

Landowners say over the past year that have come to you to work out wherever whatever they want to.

A

Do on their piece of property or have you all been utilizing those maps, no landowners, that I.

J

Know have have come to the department initially, when critical area commission sent out the maps.

J

Mary received some people coming to the counter asking what it means, but afterwards um it's been.

J

Quiet since 2018., well there, the meeting was well attended. Meeting was well attended, but they.

A

Answered questions: well, they had stations all over and yeah right and then, after that point they went.

J

Out into the field, the department doesn't have a list of who might have made inquiries and what.

J

The results were, but it was a one-on-one situation where the the critical area, staff and dnr people.

J

Were here and if property owners who had received those letters came and asked them questions.

J

They either got an explanation that satisfied them with the change that had actually been shown on.

J

Their property, or else in some few cases, I don't know how few the dnr arranged to go to property.

J

To feel truth with the people we're talking about, they were very thorough at that meeting. That night.

J

There was a very thorough meeting well well. I thought it went well yeah. I thought it did too.

Bill when all when this is all said and done of the people that will be affected by this.

um Will will they be notified of whatever changes were made or how it has affected them, or anything.

G

Like that, are they no? This is a county-wide change to the zoning maps that had that input.

Before with in 2018 with the people who drew the maps, so at this time the maps have been put on.

The website and advertised right for information, but again it's one of those. I don't like to say.

J

It's a catch-22 exactly because it doesn't exactly fit, but the situation is the state.

Made the maps and says you must adopt them and they're county-wide in impact, though so that but.

This is just for the thousand foot it changed if the the they mapped the shoreline and the.

J

Tidal wetlands and then drew the thousand foot boundary off of those so that that boundary now.

G

The the 200 foot buffer now will come off of that. That will come off of those new lines just like.

G

It does now just like it does now right: okay, but there's no, nothing in there about expanding those.

G

Expanding that buffer off the the 200 foot buffer, the the same ordinance, the same pertains right.

Right: okay, that's just resetting the line based on accurate data for shoreline and time. I guess.

What I'm getting! Because! Because it winds up the people that are approximate to water, for example,.

There's a thousand foot buffer, the two 200 foot uh buffer and then there's flood plains and all.

G

Three of those things cannot can affect what you can or can't do, and so I didn't know whether or.

G

Not anything else was going to be affected other than this one thousand foot, but you're telling me.

G

This just a 1000 foot is, is going to be done and it'll be adopted, correct, but now now remember that.

The change between 1972 and whenever the state actually mapped saint mary's county would have.

J

Shifted or could have shifted sure yeah, that's what I was getting to yeah.

There were some shifts, probably some fairly large shifts, um especially if those people that.

G

um Were not unable to address erosion right on the on the fronts of their properties,.

G

I mean they're pr, probably properties along the way that lost 25 30 40 feet um over that over.

G

Time um and so all that gets it just it's moved back. Yes, it's just like it's always a thousand.

G

Feet it just gets reclaimed correct and where does it and where it so, where does it fall now.

G

You know for a lot of people they're inside all of their entire properties inside for other people.

G

It's not it's marginal, and so for people that so for people that it winds up affecting them. Where.

Area where it winds up being it slides them into the critical areas, do they do they have to go to.

The board of appeals just like they do now and I'm sorry chairman, I didn't let myself be sworn in, but.

I don't I mean I'm just asking an administrative question, I would say: well you only go to the.

Board of appeals, if you're um seeking a variant, not everyone who develops in the critical area.

Needs a variance, in fact, most people don't right. Okay, all right yeah, I'm just I'm just.

And I don't, I don't think a lot of people have a problem with accepting a new map, um the the items.

In the zoning ordinance that would pertain to a property, I think, is the main issue. So, for example,.

My property in hollywood is is completely out of the critical area boundary now and then.

In this new map, mine is totally in in within that boundary. So what happens? Is the the items.

In the zoning ordinance would then kick in onto my property, so two parts of that is um one is the 15.

Coverage uh becomes a condition on my property that isn't there today and um it right now. I'm.

It's allowable to have an accessory apartment, and I would most likely not be able to have that.

And I don't and I don't think, there's a variance that even applies for that accessory apartment.

um So I mean those are the two things that I think are the most important.

To people in this you know for this mapping change. I don't think it's the map per se that people got.

Trouble with- and I think that's uh what you had another um written statement that went in.

I think that's what that was kind of aimed at so um one other item that I think um that I think.

Really wasn't said is: is that this um in chapter 41.3.3.a and b of the czo, I think is like what.

This meeting's all about tonight, and so I think, they're following the right steps. That's one of.

The things that was brought up about, at least in the written statement, but I question also is.

Is item c right after that? Is that no longer going to be needed in the czo so that talks about.

What really pertains when you talk about the czo is the fact that the czo can be more stringent.

Than comar with the critical area law, but it can't be less stringent, so the goal in amending the czo.

Amendment to the to the critical area, ordinance is finished, it's going to be like comar, and so the.

The provisions that are in komar that restrict the use of your land are going to be in the czo.

In and that was title water well that wasn't mapped in the 72 map and then in this new. This.

New edition, when they re redid, all the line work it extended into that finger which pushed the.

1000 foot boundary okay across my property, similar to mr hunt's slide in the powerpoint. These creeks.

When they declare that that creek has his title, that's what brings it in so the the person whose.

Waterfront and may have lost 50 feet of shoreline. They were always in the critical area, so it made.

No change to them right. They were already right there, but it's that neighbor who was 950 well.

1050 feet away who? Because they lost 50, that thousand foot just shifted on to them.

They just reclaim it they have to. They got to find that thousand foot someplace yeah, and so they yeah.

The state law declares a thousand foot right so when the shoreline moves, the thousand foot.

Moves in yeah in the flood plain you don't have to worry about. If you have a mortgage, you don't have.

To worry about, because you're you're, the person who holds your mortgage, they will reach out to.

You if it's determined you're in the flood plain and then you get to have a floodplain survey, done.

To determine in or out and unfortunately I was sort of facetious when I made the comment about.

Waving sticks, you know the last meeting, but that's pretty much what it is there, because until you get.

A floodplain survey done, you know your your. Your mortgage holder is going to require you to get.
