Are discussions first, one will be a for fiscal year. 2023 the capital improvement budget request.

And our second one will be saint mary's, county metropolitan commission, 2023, cip and cib.

Following that, we have two public hearings. This evening we have a continuation of number 13-12004.

For the woods at myrtle point section 3 for a major subdivision that was continued from.

February 28th and then after that, we'll have zone 21-0140 for guardrail llc and that's a zoning map.

Good morning, good good afternoon evening, long day, I know it has been a long day um along with.

Me today with jody, I have the cip group. Here I have kim howe and I'm dr walker from the board of.

Ed, I have art shepard from recreation and parks, chris casalimus from economic development and.

C

Our new dpw director, mr jim gotch, I've got some progress since the last time I saw you, we had our.

C

Ribbon cutting for the adc in june that was pretty exciting. That's a long, a project, long time coming.

C

We also have two upcoming ribbon cuttings that are coming up. We have the ribbon cutting at the.

C

Barns of new market- that's going to be happening on april 5th and then we're going to have the.

C

Animal shelter- that's actually scheduled right now for august 30th and then I'm sure you guys.

C

Are watching the meetings with the commissioners? We um they've made a decision we're going to.

C

Do the ymca at great mills so we'll be updating that project as we go through the budgets process.

C

In the package that was provided to you, you'll notice, there's an agenda and the items that are.

C

In red are new projects just so you can see the first one is lexington park, charlotte.

C

Hall library renovations, then we have the vehicle maintenance facility addition and renovation for.

C

Public schools, we have two: these are two planning for the benjamin banneker elementary school roof.

C

Pre-Designed study and then we have the town creek elementary school. The proof pre-designed study.

C

On page, one you'll notice, our cip. This is our budget book format and they're listed by year.

C

And they're listed by project type, so you can see on that page. We start off with highways.

C

And for fy 2023 the total amount for the projects is 21.6 million. Then we have land conservation.

C

7.5 million marine zero for this fy 2023 public facilities is 5.6 million. Public landings, 355 000.

C

Recreation and parks, 10.4 million next page, is public schools at the top at 18.7 million.

C

Bring in the total cip for fy 2023 at 64.3 million, the plan out to fy 2028 totals 220 million.

C

Going to page 3 is our brand new and updated debt capacity schedule. We kicked metcom off and I know.

C

They're happy to have their own schedule now, so we had legislation that was approved in the 2021.

C

Session that gave us a total limit of 3.15 percent. 40 percent goes to netcom, and the 60 goes to the.

C

County so, along with our um personal property um limit at five percent, our new real property limit.

C

Is now one point, eight nine percent so you'll see on the first yellow. We are completely um below.

C

That one point eight nine percent, all the way out to fy 2028.. Our second yellow row is for our.

C

Debt service as a percent of our revenues, and that should be below 10 and we are under that limit.

C

Also so we are both are within our affordable limits, all right now we're getting into our cip.

C

Sheets and um any questions I'll bring up the director in charge of those project types.

I just had a couple of walmart questions that have probably been answered before, but it gets.

Lost over the over the years, and it's not to put anybody on the spot. It's just a couple questions.

Of um actually, I had three uh mr erickson was up here earlier and we were speaking about the.

Saint climate shore- and I was wondering if he'd give us an update on.

What's happening over at saint clement shores, with the system upgrades and approvals, that's on the.

The metcom ci, I'm sorry, I'm sorry joe sorry we're here for county. We go first.

Always? Okay, I'm sorry one under on parks and rec. Yes, art for mr shepard.

Right here come on.

Just a quick question, I remember a couple um a year ago may have been two. I think you.

E

Mentioned some money had come forward for a boat ramp at snow hill, what's happening with that,.

Snow hill looks like um month of april we're going to be coming here to the planning commission about.

F

Our master plan, we want to schedule that then april as well. The end of april, with.

F

The commissioners regarding and potentially adopted, the master plan, so this boat ramp.

F

And the kayak launch ramp are the two priorities within the master plan and the uh land water.

F

uh Grant a million dollars a matching grand 500 thousand dollars will go toward the boat ramp.

F

And that's well on schedule and moving forward as a priority as to what's to projected.

F

Well, you get through the master plan and the planning is going to take another year.

F

Then that will be constructed so you're, probably talking about a year and a half after the summer.

F

So maybe the winner of the next year be ready for the spring of 20 that'd be the spring of 24.

F

The boating season at the latest- okay- that's all I had it's just serious. I never heard about it.

Any other comments, yeah any other questions for mr shepherd, while he's here, yeah arthur how are.

You good uh with regard to uh I'm looking at this central county park, shannon and there's.

G

Another one on here so the sports complex. I guess the sports complex in the central county park.

Those are going to be built over on. I guess four. Well, the one in the sports complex in the project.

That is a designated a placeholder spot that it hasn't been identified fully: okay, yeah yeah. I.

Just you know when I, when I look at some of these projects and I'm not opposed to parks.

G

And rec, you know you guys have um and actually it's reflected the support in the in the budget.

G

When I look at these some of these projects, I wonder about.

G

Especially there in traffic in certain places on that road that really need to be addressed. That's.

G

A state road, but there are some places there that that need some that need some traffic help. Sure.

G

If nothing more than a way to get around, people that are trying to make left-hand turns.

G

That it would be a concern along. You know right there, where that, where that to that area is yeah.

And and that's why it's a placeholder at this time and the fact that what's happened with the sports.

F

Complex it's it's kind of changed somewhat with the turf fields with uh the department and the.

F

New three ones with public schools. So what that's really going to look like and if it's going to.

F

Afford it's going to have that scope of traffic on there and because it might now wind up to be.

F

In maybe some indoor type of a pickleball tennis, that's been something that's been spoken about too.

F

And that's why you see it: it's moved out to what about 27 now, yeah, yeah and- and I guess uh it's.

Part of this, the idea of uh the opportunity of attracting um sports tournaments opportunities.

G

Here, yeah, you know yeah and we think we've and we think we're there now, uh with the nine turf.

F

Fields in the county for the multi-sport fields: right: okay, okay, that's all thanks!.

Tell us about the new ymca! Well I'll get mr weiskopf to tell you about that. That's.

In our budget, but uh I met with um the county administrator acting county administrator met.

F

With the um jeanette and ymca robbie gill, today and they're handling that more outside of an r p.

F

Project sure we're still hammering out some of the details, but the commissioners did approve the cip.

Sheet, which has about one point, is it 1.10, 1.106 million for the architect and like 500,.

H

And something this year and 500 and something next year and then like about 15 million. I think in the.

H

2025 um budget uh we just met the ymca, came down. I think march 1st and gave a presentation we're now.

H

It's you know, the prices have gone up, so what was 15 or 16 million is now. I think, 20 to 21 million.

H

um We're talking with them about fundraising, we're talking with them about um you know. We.

H

Had a meeting with uh cardin's office to discuss, uh you know earmarks as well, so we're just looking.

H

At everything- and um hopefully you know it's going to take a take flight soon, I think when it gets.

H

um What'd they say about 14 months to build it. I think, once we, you know about nine months to design.

H

Design, I think you know a couple more months to get sure you know all the permits are in place and.

H

Then about 14 15 months to uh to build it so we'll see it was in your section, mr shepard, that's why.

Duly noted, the timeline that they presented, um it showed construction essentially happening.

In fy 24, but we we don't have any construction money in there. Well, it's something we're looking.

H

At and something we're gonna, you know talk to the commissioners about, probably you know, say march.

H

Or april to see, if there's you know something, we can do to move up the timeline so, and uh I.

I

Remember uh some there was conversation about an additional ymca as well. Well, the hope is to.

H

Have three right: one for the north, one for the south and one for the middle. But you got to get.

H

Started on the first one first and see how that goes, I thought somebody actually tried to get.

I

One, the one in the north side of the county added to the cip. I thought that was a note that was in.

I

One of the I I think one of the commissioners had suggested it as a placeholder, but.

Exciting: okay, exciting: we are excited.

It's got to be the fdr question. No, what oh come on somebody can. This is an outstanding I'm just.

Curious about mr gotch might not even have the end he's just taking over, so he may not even.

Have the um but he's got supporting staff here? I know he will know the answer. I know he does.

With the charlotte hall tractor supply roundabout, that we've been has been an ongoing talk, debate.

Going to be installed the last couple years and we haven't seen it yet.

Excellent question: I don't know the answer to that one and I didn't mean to put anybody on the.

Spot seriously, it's just something that I've been asked about a couple times and I've asked about.

E

It a couple times and now I don't have the exact numbers in front of me, but I know it took a while.

Because you were dealing with, I don't know, seven or eight different properties was a very big help.

H

Because he was instrumental in it- and I know you know, and some of the properties had.

H

You know liens on them by mortgages and had to get the banks involved, but my understanding.

H

And donnie could correct me if I'm wrong is that we have gotten all the property.

H

So that we can now move forward with it, I'm not sure when it's set to begin construction.

H

But I know just obtaining the property for it all was took some doing. I I think we're now.

H

At the next stage of it, but it's still in the plans too. Yes, oh yes! Oh it's still here! Okay,.

Is there a I mean if all the properties acquired? Do you have an educated guess of.

E

Could it be this this year or it's been hanging out there for quite a while.

Usually it takes about nine to 12 months to get something through the process.

J

To get to construction, that's before that's your engineering design.

J

So this calendar year- probably not probably not.

So let me ask you this, because I ask it: every year.

G

With regard to the retrofit sidewalk program in here city gym this planning, commission and other.

G

Planning commissions for decades, every project that comes before this planning commission.

G

Use the word I typically use, but we require sidewalks. We require sidewalks to be.

G

Constructed and you of anybody would know that to be true from the private side, so.

G

Not a single project gets constructed in the county without those sidewalks being completed.

G

Here's the problem.

G

The property owner constructs the sidewalks to the property line and that's where they stop.

G

The next property owner has the ability or responsibility to build those down the line well,.

G

Many of them are never going to get built, not ever so. We have sidewalks to nowhere.

G

Everywhere, they're just everywhere um and I hate to call out anybody, but over on.

G

Buck hewitt road sidewalks, where they end fall into ravines, just ditches.

G

If you were walking, if you weren't aware where you were walking at nighttime, you'd wind up.

G

In in a culvert so- and I and I seen this again and we've been talking about this particular area,.

G

For probably a decade or more on buck, hewitt road and the reason I bring it up is because.

G

I pass there every single day and almost every day I see people walking in the ditch.

G

The good news is buck, hewitt. Well, no, no, have all the property and.

G

Well buck hewitt wrote is on this in this paragraph right, but this is not his first. It's not.

G

His first time it showed up in that paragraph, and so I'm I'm getting to what I'm getting to is that.

G

If we talk about walkable getting you know getting a ability to walk from point a to point b, those.

G

Kinds of things the county has to consider more than three hundred thousand dollars in retrofits.

G

They just do yeah, I mean it's just and I don't know how to I'm not here to tell you that you're.

G

Going to manufacture money, but when I look at when I look at projects new projects that are.

G

15 18 19, 20 million dollar projects, airports, 40 million dollar projects.

G

And then we have people that have to walk in ditches, be becau, because uh these are property.

G

Owners because they can't get from point a to point b and again, I want to bring a point.

G

Because I pass there every day um and uh and of course, the developments up the way.

G

All their sidewalks are completed because they wouldn't get approved, but they weren't. So the.

G

County needs to welcome the county government, so the county just needs to do a better job.

G

In funding you to to take care of some of these sidewalks to nowhere because they're, a problem.

G

Thank you. I did it as eloquently as I possibly could. Well, if you look at the cip sheet on page.

Eight, um there is prior approval of about 2.1 million and we are adding 300 000. So I know that.

C

They're working on them, I see the money being spent. It's just, and I see that and I just got.

G

To get caught up yeah and I and I do I see I see that in lexington park I was in lakeshore.

G

Park the other day I was just telling them. I grew up on uh visiting my my relatives on east rinnell.

G

And what I see down there at three oaks, all those brand new sidewalks yeah, all those brand.

G

New sidewalks um and that's great the deal is they were there before they they were retrofitted. They.

G

Were torn up and new ones put down, all I'm trying to do is get the connection from one place to.

G

Another so that people aren't walking in roadways and ditches, and things like that, and I know that.

G

The county wants that, and I know that mr gosch wants that we just have to find a way to get them.

G

Out of this paragraph, and so people can walk on them. Okay, thank you. Thanks any other questions.

From mr gotch gary, I think we have to ask the fdr question right so get an update because it.

I

Looks like the the uh the rest of the project is supposed to be completed in the next fiscal.

I

Year right, yes, we are completely funded in the 2023. 12.7 million. That can give us a big road.

That's, oh, it takes it all the way to peg road. So can you give us an update on.

I

Where we're at, as far as the the project goes with, uh with land acquisition and construction.

J

You know I I'm hoping donnie has information on that, but I think we're down to the last.

J

Couple of people that we need to acquire the property from between buck, hewitt and peg road.

J

I've been here three weeks, so you guys are hitting me on the trail on the fly.

Yeah, it's a lot for him to take in. We could we could flood him if we wanted to.

K

So property acquisition is is underway on phase 3b, um so.

K

I think I think we might be about halfway through that, um maybe 18 properties, so.

K

So I think we're about halfway. The design is, is buttoning up. There is a.

K

Little bit left to deal with on state highway, that's down there by peg, so.

K

And then the other part um you know at chances ronna's, his utilities have been relocated.

K

We do have utilities to relocate in 3b and that should be.

K

Getting you know, funded and and moving forward, because we have to pay uh smacko to do that.

K

um You mentioned, I think you talked about mount wolfe earlier to you just to go back on that.

K

Now that we got the property, we have a power pole to move. So it's one that we're dealing with smeko.

K

There- and we have not got that. We know where it's going to go and get it out of the way. But the work.

K

Hasn't happened yet so that is another component. There, that's kind of holding that project.

Appreciate that yeah yeah just one one comment from all that and I listened to.

The commissioner's meetings and the budget work sessions and I don't think most people realize.

E

Me included really, even though we do this a lot, I don't think we realize, and I do more and more.

um About how hard it is for property acquisition.

E

I've heard mr whipple talk about it from the airport side. I've heard mr mills talk about it.

E

I've heard mr dietrich talk about it. For mr erickson talk about it, you know, there's many.

E

Things that go into that and if you don't watch all that stuff, you don't catch all them.

E

Things that you know well, we got 20 of them, but we still need 20. You know it's a lot and I can.

E

I can understand that and again, when I ask you guys them questions, it's not.

E

To put anybody on the spot, it's just to see where we're at within projects- and I.

E

Do understand that um that probably comes into play mostly every and then utility.

E

Moves and poll you know different stuff, so but the average, I don't think the average people realize.

E

That, even if we hear it all the time, I don't know if all of us realize the magnitude of getting.

E

30 or 40 people to agree to the same thing, so I appreciate it. We talked about it before.

I

About you all getting state support on land acquisition side is that still happening. uh Yeah.

For the for the fdr project, only um that's the only project, we're utilizing the state to help us.

And they come out of the gate, saying it would be a 12-18 month process.

I

So we're saying it's going to be a 12-8 18-month process from now from from when they get the.

Whenever we sign the mou with them right, then then.

J

They start their process, but from the private side it takes them longer than that. Usually.

This evening yeah, he misses you guys, I'm sure we believe we can. We came instead of him today.

First order business welcome mr hall and mrs summers.

Our planning commission goes on a capital budget. Welcome on board, try to make it short.

Good evening, chairman thompson and balance, the planning commission members.

uh We have a microphone.

I have with me tonight christy hollander, who you all know very well she's. Our chief engineer.

L

To answer any specific questions on status of projects, especially those that have been funded.

L

In prior years, there's a transmittal letter in your packages. I believe it's dated february 10th.

L

Transmitting the capital budget to you for your review.

L

A couple of items: uh follow-up, mr van kirk, you asked a question earlier regarding saint clement,.

L

Shores and the schedule for that we recently awarded the design our board has to approve all.

L

Design awards in excess of certain dollar values, so the design should be completed by december 2022.

L

So it'll basically take an entire calendar year to do the design. We look forward to.

L

Bidding that in february 2023 that bid process will take several months, at least through april.

L

Construction, we anticipate will start may 2023.

L

And be concluded somewhere around august 2024.

L

Thank you and you asked another question, but not directly to the metropolitan commission, but a.

L

General question about property acquisition, which I won't put my old dpw hat on, but I'll put the.

L

Metcomp hat on, we have similar issues with just design plans in general, saint clement shores, water.

L

Is a good example: we take the design plans of the community representatives. They walk that around.

L

You'd be surprised that a location of a hydrant is extremely important to people. If you could.

L

Get it across the street in front of the vacant parcel that would be desirable if you could put.

L

It on the property line. That would be much better, but please get it away from my driveway, because I.

L

Don't want to back into it or back out of it. So even the smallest little thing when it comes to.

L

Acquisitions, because, when you're talking about acquisitions, you have the design plans with you.

L

On the dpw side, that's extremely more complicated, much more invasive. The sidewalks are much more.

L

Further into the yard way, the grading can be completely different. It's the location of the.

L

Relocated utilities- ours is not as difficult as theirs but nonetheless to your question.

L

About complexity, it's amazing what some issues will cause in terms of change to design plans.

L

So that was just a sidebar comment. Thank you for letting me uh thank you introduce that to you, yeah.

L

From a progress standpoint, we've already scheduled our public hearing for the 19th. We have to do that.

L

In advance, so there's no pressure on on this group at all. That's plenty of time.

L

Advanced time, but in accordance with the county code, why we're here tonight obviously is to get.

L

Obtain your concurrence because your concurrence is an integral part of the county commissioner's.

L

Concurrence with our capital budget, the county is not allowed to approve our capital budget.

L

Unless the planning commission gives a favorable recommendation and our board is not allowed to.

L

Approve the capital budget until after it's had a public hearing it hears from the county.

L

Commissioners, based on your recommendation, so it's not just we're not just here on behalf of metcom.

L

It actually goes through a couple of other steps before we get to that point of approval.

L

Tonight, capital budget wise- it's not too much different than what you saw last year at about.

L

The same time, I think we come before you in march, just about every year we have about 33 million.

L

Dollars in water projects and about 31 million dollars in sewer projects over the next six years.

L

What we try to do, every year with you and some of your heads will nod.

L

We highlight and yellow the changes from last year instead of going through every single project.

L

We like to tell you what the changes were from last year. I could go through each one, but some.

L

Of them are pretty mundane and not that exciting. We have a couple of salient changes that I'll go.

L

Over really quickly, just three or four on the water side and three or four on the sewer side.

L

On the water side in fy, 23 we've reflected arpa. That's american rescue plan funding. We.

L

Received some allocations in 2022 from the county commissioners, as well as some 2023 commitments, so.

L

If we're to receive grant funding, we need to reflect that in our budget as grant funding.

L

So we've received several hundreds of thousands of dollars and on st clement shores. I wanted to point.

L

Out to mr van kurt, we just got a state funding eligibility determination. St clement shores was.

L

Going to be a 10 million dollar project, 7 million dollars, because we chose to upgrade that facility.

L

To a higher treatment level, 7 million dollars out of that 10 million is going to be state grant.

L

Another one funded, a half to 1.6 million, is going to be the county arpa funding and the.

L

Balance is going to come from the metcom reserve, another million and a half. It was a joint project.

L

It solves a public health issue. You got 140 150, failing septic systems down there. The plant part.

L

And parcel fixes that and also provides additional capacity for the future. But how often do you hear.

L

That a 10 million dollar project only requires one and a half million dollars from the project.

L

Coordinator, if you will, and the balance of it is grant funding, it's not loan, we're, not borrowing.

L

It's outright grant funding. So what a great, what a great project? Really all around health department.

L

County commissioners, mde metropolitan commission and the customers who have to pay back the debt.

L

When you have seven million dollars out of ten or eight eight and a half million dollars out of ten.

Being grant funded, that's that's a big win for everybody, so I want to report that the hollywood.

Water system, we move that out a year because the dean self storage facility has gone through this.

This process, they were approved they're required to build a portion of the water line.

L

We don't have to build the entire portion anymore, so we reduce the scope in addition to that.

L

I guess it's town creek. I think mr hall you're interested in town creek.

L

We switched, we switched sections three and section five and you'll note that you may or.

L

May not see that, but there's a funding difference between the two sections. We switch those because.

L

We're having more issues maintenance, wise with section five than section three, so we.

L

Wanted to move five up ahead of sections four and three, so that was simply a switch based on need.

L

Greenbrier you'll see that as an additional project in our fy23 budget, that project was.

L

Not ready to go to construction and we had some money that we borrowed and that money was better.

L

Utilized for a project that we also already had in the queue- and that was a clarifier project.

L

Which I think we brought this to about three or four years ago? We basically did a budget amendment.

L

To move money out of this project to fund another one that had a higher need, we're restoring the.

L

Money in fy23 to that project all based on timing, very minor change. On the sewer side, we added a.

L

A I guess what I want to say is we added a new project to study how we treat our water at marley.

L

Taylor, how we treat our waste water at one of our facilities, marley taylor. We believe that.

L

Through this optimization study, we'll be able to use a lot less less electricity and a lot less.

L

Chemicals and if you're not watching the market, our chemical prices are going through the roof.

L

We spend about five hundred thousand dollars a year, we're going to need about eight or nine.

L

Hundred thousand next year, just with the current price increases so any kind of a study we can do.

L

To optimize and the electric costs you know those are going up about 25 or so anything we can do.

L

To reduce chemical costs and electrical costs, we're going to study it and take a look at it.

L

We also introduced a grinder pump replacement project. We already had a project in place.

L

Because of the the success of that project, you start pilot.

L

Projects either in one year or you do it every other year and see how it goes.

L

We're able to expand all that money each year and we still have a demand to keep up with our.

L

Grinder pumps, so we just converted that into an annual project as opposed to a bi-annual project.

L

One big project- that's exciting to us that may not be too exciting to the.

L

Planning, commission forest run wastewater pump station. We moved that out one year.

L

That's all I'm going to tell you well, there's a reason that we moved it out a year, we're looking.

L

At one of our other pump stations and seeing if we can convert that over to a small wastewater.

L

Treatment plant, if we can do that in particular the piney point wastewater pump station. If we.

L

Can convert that over to a treatment facility which, by the way, is how it started before it.

L

Was converted to a wastewater pumping station, we can do four things. Add capacity to marley taylor.

L

Add a lot of edus to marley taylor, which there's a need for additional capacity, marley taylor. We.

L

Have a 3.4 million dollar expansion project for forest run that we think we can cut in half if we.

L

Can convert this to a treatment facility, as opposed to completely upgrade the pumping station.

L

We've got 6.2 million dollars of piney point pump station rehabilitation that we may not have to do.

L

If we convert this facility- and we have a 5.6 million scheduled force- main replacement- that.

L

We may not have to do. Why do I say we may not have to do if we can divert some of the wastewater flow.

L

From the system that alleviates the need to pump all that flow, that's number one. It alleviates the.

L

Need to treat all that flow. That's number two and alleviates the pressure that we're putting on the.

L

Downstream force main from that flow, so this is well worth looking at doing. We have preliminary.

L

Discussions with mde mde said it sounds great. We borrowed 6.2 million dollars a couple of years ago.

L

To actually convert not convert to do the upgrade to this facility. Dhcd said you can use that to.

L

Convert it to a wastewater treatment plant as well, so on the funding side, we're good on the.

L

Borrowing side we're good on the feasibility side. Mde has given us preliminary indications, we're.

L

We're in good shape and there's a potential to save us. If I add those up correctly.

L

14 15 million dollars all or a portion of that in future borrowing. So we talked about jeanette.

L

Cudmore your cfo talked about debt capacity. Anytime, you don't have to borrow, is a good thing.

L

It allows you to push other projects up, that you had pushed off because of affordability.

L

But it allows you also allows you not to borrow, which is always a really good thing and.

L

A closing comment today, on the debt side, we had talked about the decoupling of the metropolitan.

L

Commission debt from the county's debt, we have a self-imposed 120 million dollar debt cap.

L

We are currently at 106 million as the highest debt, whether it is current debt that.

L

We're paying off which we're paying off faster than we're incurring new in our next six years.

L

Over the next six years, we're at about 106. the new legislation that decoupled.

L

Our debt from the county's debt allows us to borrow up to 168 million.

L

So you might be asking: what are you going to do between 106 million and 168? We fully plan.

L

To keep things affordable, our capital contribution charge has been the same for five years.

L

Our system improvement projects have been the same for five years. That impacts developers a lot.

L

We're keeping those the same we're trying to encourage development, not increasing those.

L

The other thing that that does marley taylor cost us about 40 million dollars to build.

L

How many years ago, christy three we finally finished it three or four years ago use the.

L

Tornado as an example, if that plant were ever to be wiped out, for whatever reason, god forbid, it's.

L

Going to be at least 50 million dollars to put that back, we intend to use this debt capacity.

L

For an emergency for something unforeseen, not something that that we're going to plan to upgrade.

L

To upscale, or to move up faster, it's no different than having a reserve. If you have a reserve in.

L

Your budget and there's an emergency you tap into your reserve, you replenish your reserve.

L

You don't use your reserve for recurring costs, so the intent is to not move capital projects up.

L

Close so we're going to keep them affordable for developers and and our residents we're going to.

L

Keep that that debt cap available for an emergency there could be two emergencies, not just one.

L

And try to work our plan. The sewer plan is about 220 000 difference than what we proposed.

L

Last year, what we brought to you before and I think on the water side, it's about two million.

L

Dollars difference, so we are working our plan, not bringing cibs to you each year that are.

L

Five, ten million dollar swings and we think we have a really good plan. We finished a.

L

Facility plan just recently so you'll see some different projects. Perhaps next year.

L

Next year will be the year for some for some flux, but we have some built-in debt capacity and we'll.

L

Be we will be able to keep our rates the same for our developer, projects on the capital contribution.

L

System improvement side that we did this year, that is our plan. So um that's the brief introduction. I.

Could give you a long one, but I'm sure you may not. You did fine. You want to hear that.

And I apologize for the lack of my my attire. This is the first time I think in.

As a denied access line currently.

Because of the federal money that was used to put it there- and you know that as well as I do.

Once once you fix this line, once you spend subscriber money.

Or whoever's money to fix this line, will you guys own the line or will it be? Will it be still.

Controlled by the federal government and still have denied access to that line, I believe the.

Provision in that grant was that we have to keep it in working order in perpetuity. Basically, so.

I'm answering your question indirectly, but that's a very indirect way of asking that question too.

Right yeah, I mean I, I guess we believe that the restricted access will still be in place.

That is so that you know, as you guys struggle with subscribers, you need subscribers.

um And, and so I guess, what I'm saying is that, if you're going to whether it's, I don't care, what's.

Grant money where, where the money comes from you're, going to put the line in place, replace.

The line make it like brand new not to have control over that subscriber base. That would.

Be available, perhaps especially, you know, given the fact that we are up here constantly talking about.

Housing- clustering- don't put it don't put lines out into the hinterland, all that silliness. That.

We talk about, we talk about a lot, um and yet we don't. We won't have control over that line. So.

One other question just sort of expand on that: a little bit we're getting ready to do this.

Comprehensive plan going through the comprehensive plan. What is it that you believe? What is it that.

That the comprehensive plan that you see to do now- that's not being addressed with regard to medcom.

That's an easy one. Your comprehensive water and sewer plan right gets its direction from the.

L

Comprehensive plan exactly in the comprehensive water and sewer plan, there are two areas in the.

L

Back one is called problem, water areas and one is called problem sewer areas. There are areas that.

L

Have been identified in the comprehensive water and sewer plan, climate resiliency is.

L

Another big thing coming down the pipe by 2050, I believe sea level rises are expected to be.

L

I'm going to round it up to a foot by 2050 or 2100. Excuse me: it's 4.35 feet. Let's just call.

L

It four feet, you can say five. We could see four, probably one of the exercises that we should do.

L

Is look at all of the septic systems and wells that are private, not metcom, that are in that.

L

Potential, I don't want to call it a surge area because it's not a storm surge area.

L

It's not a hundred year, floodplain level, it's climate resiliency, how many private wells and.

L

Septic systems are in that zone which may create another saint clement shores issue.

L

Depending on the area and the health department will get involved,.

L

And somebody will ask: why did not the metropolitan commission do planning and we'll turn around and.

L

Tell you because those properties are number one in the county's plan in the no plan service area.

L

Where you do not want public water and sewer right, but yet here we are with a potential so.

L

What I would suggest is take some of the language. That's in the comprehensive water and sewer plan.

L

Put it in the comprehensive plan that says we have recognized these areas as potential problem areas.

L

Many of the septic areas that are too far away from sanitary sewer facilities, force mains.

L

Gravity mains are so remote that the solution is even in the comprehensive water and sewer plan.

L

It says package treatment, plants right and that's that was what I was getting where's the land where.

L

Is the land to put the package treatment plant I'll use, fdr boulevard as an example.

L

And you'll see my logic in a minute. Sometimes we we throw the baby out with the dishwasher.

L

With the dishwater I mean not with a dishwasher- let's not put them in the dishwasher, but you have.

L

Your design and your land acquisition and then you have the construction, which is that big number.

L

So, let's not do any of it! If you can design it and get your land.

L

You can build it whenever you want, because we know getting land is, is tough, no different than.

L

Solving potential septic failure areas if a package treatment plant is the solution.

L

Where is that property in relation to these areas and shouldn't we be purchasing that now or at.

L

Least, identifying it now well, brown road is sort of a success with regard to a package plant. You.

G

Know from way back in the back of a while, you know been very, very successful where I live. I benefit.

G

Every single day, from the fact that I have access to medcom sewer, if it weren't for that.

G

My property and likely most properties approximate to where I live.

G

Would be on pumpkin hall, it's it's simply no way to have any other kind of.

G

Mechanism to to address the sewer need issue, and so my guess is, as we move along. You know.

G

And you know you know people want to hear this, but if you were to take those little.

G

Pink pills and throw them in the toilets and flush the toilets. There's a lot of places in st.

G

Mary's, that would turn completely pink and those are the places. Those are the places.

G

However, we get there that need to be addressed. I mean they, especially from a sewer perspective.

G

They could may be able to dig a well, but the sewer you really don't have any place.

G

To put it, I mean everybody wants to do their deed. Nobody wants to put it.

G

Someplace else and somewhere else, just not near me, so to answer your question yeah if some of.

L

The comprehensive language were brought into the comp plan and then we talked about climate.

L

Resiliency, then, the comprehensive water and sewer plan could address how we're going to tackle that.

L

As opposed to the comprehensive plan saying we know, there's some areas.

L

You know, usually your your comp plans more global and your plans after that are more detailed.

L

Right so I think that would be very helpful and we were talking earlier. I think that that when.

G

When we start talking about um densities, you know when we talk about ten to one twenty to one. Thirty.

G

To one four to one people in their in their heads think it was time, mr fosek, as they conjure chicago.

G

And what that looks like it doesn't have to look like that. It just doesn't, and I think in.

G

Our county, given where we are approximate to the water and the issue that you just brought up we're.

G

Going to have to look at that in a much different way with regard to densities in those areas that.

G

We've determined where we want to have a great residences or whatever we want built in those.

G

Areas for the very reason that you gave and for the fact that if, if the county is going to grow,.

G

It has to grow in these development areas. uh It's not going to be able to grow in the hinterlands.

G

Because the land's not going to perk it just isn't and and so I'm hopeful moving forward.

G

That some of that can be addressed because in in in that you know, conversation we're talking about.

G

Water, we're talking about sewer, we're talking about housing, we're talking about economics.

G

And and many of these modules that we're going to be talking about and.

G

All of them rely on infrastructure, especially the infrastructure that that medcom provides.

G

And this you know land use of growth management sort of gives you marching orders as to where.

G

Where it goes and how it goes well and as you go through this process, I urge you to look.

At the comprehensive water and sewer plan, the sewer service areas and the water service areas.

L

You'll see that more than 95 percent of the county is in no plan service. Exactly the thought would be.

L

Well, the direction is metropolitan commission. We don't want public water and sewer in these.

L

Areas so don't plan for it and don't look for it. St clement shores was a great success. Let's have.

L

More successes, and if a lot of failing septic and wells which are private, are going to be.

L

On the in these coastal areas and we've already identified problem sewer in problem water areas,.

L

Why don't we start addressing that now and I'm not suggesting we make a no plan service 2050 for a.

L

Foot sea level and a no plan service dash 20 100 for the year 2100. But if those are areas that we.

L

Know are going to be impacted, they should perhaps be something different than no planned service or.

L

We're going to have another saint clement shores and that's the problem. The problem will be if we.

G

If we don't look at that in a comprehensive way, what's going to happen, is you're going to have an.

G

Outcry from people they're they're their systems are now failing and, more importantly, when the.

G

Health department comes and they do test they're not going to be able to get an alternative system.

G

Then what do they do and there are places in the northern part of the county that that's.

G

Going to happen well, let's just say this: the county, commissioner said is the board of health.

L

So in the health department presents to the county commissioners, they are the board of health.

L

Someone didn't plan, it's either, I'm not. I can't point, can I it's either the planters which are.

L

On both sides of the table here or the people responsible for water or sewer or the health.

L

Department, how did we let this happen again? I've talked to heather moritz, she's she's, all on board.

L

With looking at it comprehensively like this, we're certainly on board and anything we can do with the.

L

Comprehensive plan of the comprehensive water and sewer plant- I know christie.

L

And ed hogan our operations, people have been identified to talk as part of the comprehensive.

L

Plan yeah, I think water and sewer so we'll be bringing these ideas to the forefront as part of.

L

That process- I just don't see how you'd accomplish it without without the idea of using package.

G

Plants I mean I don't: where are they going to go? I agree who's going to pay for them sure and right.

G

But if you're going to grow you're going to grow where you you're going to grow, where.

G

You're going to grow where there's there is availability to sewer or infrastructure.

G

You don't have a choice, go to the two tables in the comprehensive water and sewer plan.

Look at the scope problem, sewer areas, problem water areas, there's very few.

L

Wells that are issues maybe there's three or four there's a lot of sewer issues.

L

In terms of availability and in that one of the columns, you'll read failing septic.

L

Failing septic, failing septic, failing septic that comprehensive water and sewer plans dated 2017.

L

All right we're going into 2023's budget, let's start doing a little bit more planning and.

L

Again, it's just you ask for perspective and that's that's our perspective from the.

L

Metropolitan commission side, it's going to be a great exercise, just like st clement shores, was.

I think part of our our responsibility up here is to ask questions that sort of need to be.

G

Asked they're not meant to put anybody on the spot. They're just meant to be because they're important.

To ask absolutely so okay, thank you plans. Plans are great plant plans. Somebody asks you what your.

Plan is the next question is well when we got the first part now, we've got to start tackling.

L

It, let's not throw out the construction with the land acquisition and the design. Let's, let's find.

L

Out where these package treatment plants are going to go, let's find out how we're going to pay for.

L

Them, let's find out what the fiscal impact is and maybe prioritize them pick one off one at a time.

Who's going to who's going to buy the land for the package areas, would it be metcon? Would it.

Be the county I mean somebody has two as it stands today. These are in no planned service.

Areas, the metropolitan commission is told, we don't want public water and sewer there.

L

From a planning perspective and public health perspective, one might say it's a joint venture.

L

We can figure that out later, let's decide we want to do that first or that it's a good idea. First.

L

Because I can tell you, in some of these areas the communities who have failing systems there.

L

Is not one parcel in that community available? We have to go outside that community. Is it one mile.

L

Away: half a mile away or two miles away that we can find a piece of land suitable enough for a.

L

Packaged treatment plant, I think we get somebody to look comprehensively at that, but it's also.

In the package area, depending on how many you look up to it,.

L

That are 10, some that are 25. I just looked at this yesterday, so yeah, some that are 100, some that are.

L

100, yes, the size of the parcel will vary right. Absolutely you mentioned brown road. Is that the.

Subdivision on brown, road, mm-hmm, yeah forest farms, fun yeah, that's a that's a really good example.

Of it and to be honest with you, this is, I mean these: what we're talking about all up and down.

G

The east coast, new england and those areas are all most all are private. I mean they're partnerships.

G

And with without the partnership part with regard to land acquisition,.

G

That can be a problem. uh It could be that someone steps up has a perfect place. They own the land and.

G

Then reach out and there becomes they. They create some sort of a partnership to do just that. But.

G

Again, there has to be a return on investment with regard to that package plant and the people that.

G

Are approximate to the plant? So you know, but it's it's a it's a good. It's a good question to ask and.

G

Actually, it's actually more than a question to ask: it's actually something you're going to have to.

Well, is it, is it no plan service, it's not public water lines, extensions, a package treatment plant.

L

Is like a spot improvement right, so we're still sort of, in conformance with no planned service.

L

But as far as the metropolitan commission's leading the charge we've been told, we don't want.

L

Public water and sewer there, but we end up being part of the solution in the end. So let's, let's get.

L

Together now and be part of that, you folks would still wind up managing those package plants just.

Like they do on brown road, you would have the the the package plant would be constructed. The.

G

Connections made and then either you or state of maryland would prefer. You um would would manage.

G

Those plants- which rightly so, that's the way- this that's the way it should be you're here.

G

So, wouldn't it be hard to build something I mean I know it's the future, wouldn't it be hard to.

Acquire and actually build something if 20 houses needed it and there's a 500 that hadn't failed.

E

You're going to have the same thing that you face now: if people don't have to connect they're, not.

E

Going to connect so you spend that's correct millions and millions of dollars. You have to.

Require the connection and require it within a certain number of years, but look I just redid my.

L

Septic field last year, what do you mean? I have to connect in the next three there's a lot of detail.

L

But if you don't have the land for the package treatment plant, maybe what happens there? Is you.

L

Just defer it two or three years till you get more people failing right, you get a greater consensus.

L

Right but you have the property and you know it's it's there. So you pick one of those pieces off.

They don't want to connect until they fail sure I mean they want. You know, and it doesn't matter.

G

Whether it's new 10 years old or what it is in our case when that, when that line, came.

G

The system was working, not so much, but it was, you know, nobody had no one came down and and we're.

G

Making us you know the property pump and hall, but the fact of the matter is when that line came.

G

Through everybody that that had, uh except for a few that you know, pushed back and over time, guess.

G

What their systems fail, because, ultimately, they will fail, they will be allowed to connect. Is my.

G

Understanding, um you know if they have a failed system down there. So this year we decoupled the.

L

County's debt from the metropolitan commission's debt the year before we added some, and I think we.

L

Reported to the planning commission some special provisions in the law that weren't there before.

L

One allows special taxing districts to occur, call them special assessment districts, call them.

L

Whatever you want, but if a community this gets back to your question, uh commissioner evans, if.

L

A community as a whole because of the number of failing systems is a problem for that community.

L

They can now come in and petition us ask us to build it, we'll tell them how much it costs.

L

To get repaid, there's another tool in that toolbox, maybe it's a 50 50. health department.

L

County commissioners, us to to ease that burden, because a treatment plant for 20 people is a lot.

L

Different than a treatment plant for 100, even though the 100 is bigger, I think, on the scale.

L

Dividing it, the bigger the denominator, the better off you are, so it's going to be an.

G

Affordability thing, but pumping hall is not cheap now and when people hear special, taxing districts.

G

What they they don't hear anything other than tax. That's what they hear, uh but special taxing.

G

Districts are a really good tool to do what you just described. We call it special assessment.

Exactly or a benefit charge, that's that really is what it is, and it's really the benefit of the.

G

It it comes as as a a charge that benefit the people that that they're being charged, I mean.

G

They do it with you know, putting a rip rap in they've, they've done it for for decades, and.

G

Over a period of time, you know it's on your tax bill and if you sell the property that follows a.

G

Along with a deed, so it's it's it's a great tool to use. The trick is balancing public need with.

L

I understand that with forcing the public need before it's time it it's it's a tough balance, but.

L

Again, if we do the planning, we get the properties we're in a really good position at that point, in.

L

Time and and just to piggyback on that, a lot of those package plants are very expandable.

They have different kind of modules that you could kind of plug in and expand those plants.

So they are very flexible and that that means as well- and I will say I have some some contact with.

Folks in maine and new england states a lot of those folks like you guys, like medcom. They monitor.

G

When I visited there, they monitor everything with a laptop.

G

Everything they, if you put a particular chemical in that system,.

G

It it peaks, they can tell every and they don't have to be on site. They can be remote.

G

They can be, you know, it's really extraordinary. We have scada systems that send us not only.

L

Electronic messages to monitor that, but whenever any of them gets out of a certain performance.

L

Metric automatically sends a message to us and we go out and respond and the digesters and the media.

G

They use for you for all of that. It's just really extraordinary, and this is not old technology. I.

Mean this is how it's changing come for a visit. Anybody free tours any time of day any day, marley.

Maryland route 235 three notch road, south of mechanicsville, the property.

Is located near the intersection of oakville road and three notch road.

The area includes a major transportation corridor with some existing commercial development.

Nearby businesses include wentworth's nursery boatman's, mini market east coast investments.

Solders and ritual oil and heating, air and oakville elementary school is nearby.

Q

For the justification for the zoning request, it is currently occupied as buckler's auto parts.

Q

Formerly ransom motors, it is improved with multiple commercial and storage buildings.

And other improvements to support the current business, the applicant has stated that the.

Land use, designation, designation change will better implement the conceptual land use plan.

And reflects implementation of the comprehensive plan. The proposed justification for the amendment.

Is due to changes in the neighborhood and a mistake potentially observed in the 2010.

Comprehensive plan the applicant believes the designated land use is a mistake that occurred.

With the la last land use map changes, since the business uses on these properties have existed.

For a considerable amount of time, with primary structures built in 1985 and 1989, there are.

Several properties within proximity with the rural commerce, land use designation, including.

The property immediately adjacent to the southeast, the land, use, designation change and zoning change.

Would allow the existing uses to continue and be further developed to include similar and related.

Uses the justification letter from the applicant was attached for your review and reference.

So part of the saint mary's county, comprehensive zoning ordinance 21.2.2 for amendments to zoning.

Maps or texts of the ordinance, the planning, commission and the board of county commissioners.

Shall each hold at least one public hearing on an application for an amendment to the official.

Zoning maps such hearing may be held jointly at the discretion of the planning commission.

And the board of county commissioners and then per 28.3.2 review procedures by the.

Time tonight I'm here representing the applicant guardrail llc and I'll note that in the audience.

Is tammy buckler one of the principals of that llc and if you have questions for her she's available.

As we go forward tonight, we do have a powerpoint presentation that I'll run through.

And address the the substance of our request tonight we can kind of um be happy to answer any.

Questions as we go, um the summary of our request tonight and and uh member evans um touched on.

R

This a little bit, there's actually two requests, um and ms jenkins mentioned in her and her report. One.

R

Of the requests is to rezone the property to be rural, commercial, limited district right now, it's a.

R

Rural preservation, district and then the second request is to change the land use designation.

R

From rural preservation to to be rural, commercial, I know the planning commission is.

R

Aware of this, I was in front of you, I believe, about a month ago, with a property nearby here.

R

The idea here is that the client wants to rezone the property. This one is.

R

A little different purpose than that other requests. I've been before you, this property.

R

Has an existing non-conforming use on it that is allowed buckler's. Auto parts are there and ransom.

R

Was there for a considerable amount of time before that you'll see from some of the overhead.

R

Photos my clients purchased it in the not too distant past within the last couple of years.

R

And they're operating their business there. One of the issues that they've run into is that.

R

Other potential related business uses that would make sense for them to do like have an office in.

R

The in the facility and maybe rent out an office to somebody to use right there on 235 they're, not.

R

Allowed to do because it's owned rpd they're only allowed to continue to use the non-conforming use.

R

That's there already, so they are allowed to continue to do this. This will give them more.

R

Flexibility to do that and as I'll highlight- and I believe miss jenkins did a wonderful job of doing.

R

Her report as well that's the whole purpose of the rural conservation, a rural commercial, limited.

R

District and the rural commercial land uses when you have existing commercial uses to allow them.

R

The flexibility to continue if they were in those places when the plan was adopted.

R

And likewise be able to expand and adapt to their business environment. So that's the purpose of our.

R

Request today, as you'll see on here, there are two adjacent properties that are part of the.

R

Application, as mentioned in the staff report and we've listed, the two tax account numbers there. So.

R

It's clear on the record: if we go to the next slide, um I know the the planning commission is.

R

Well aware of your process, I know that this slide you've seen several times for me in the last six.

R

Months or so, we are at the review stage by the planning commission, as mentioned in the staff.

R

Report this has been reviewed both at the tec level. The planning director is deemed a.

R

Complete to come before you, it's been reviewed by all the tec agencies and, as mentioned again.

R

By mr evans, there is a requirement because one of our two requests is to amend the comprehensive.

R

Plan and that being the land use map that is part of that plan, it was required to go to the.

R

Maryland department of planning at least 60 days before today, and be advertised as such.

R

And all of that has been done. We want to thank staff for that. As you can see, these.

R

Applications take a lot of lead time and a lot of work up front and staff has really worked with us.

R

On this one and the other ones, and we really appreciate all their hard work.

R

And then, the next stage after this we're asking for a recommendation of the board of.

R

County commissioners, this evening to approve it and, of course, the board of county commissioners.

R

Will schedule a public hearing um they'll have a meeting to decide to schedule that and then.

R

They'll have a public hearing and then a decision, uh so the remainder of the process. If all goes.

R

Well, I would go forward in the next six weeks to three months on the outside is what we're hoping.

R

If we go to the next slide, this is just an overhead photo. It's similar to the one in.

R

The staff report, the two properties that are there in the center, are the properties we're.

R

Talking about they're kind of the odd shape properties they directly front three-notch road.

R

And you can see that they're kind of odd shaped in the back to the immediate left or to the left.

Of that you can see the wentworth nursery. That, of course, was before you with a similar request.

That was recommended by this planning commission uh to be rezoned rcl, as this request is, and.

R

Immediately to the to the right there, you can see a portion of it in the bottom middle of.

R

That photograph is original uh oil and, as you'll see on the zoning map, that's already zoned rcl. So.

R

This would be consistent with that. If we go to the next slide, this is the zoning map. So again you can.

R

See our properties there right in the center those two parcels that make up our application. They are.

R

Operated as one business and- and you wouldn't know their two parcels there, just by driving by.

R

But through ownership we we've listed both of them in here, so our application is complete.

R

The property immediately to the south of that, as you can see uh two parcels, I don't think that.

R

Overlay is exactly accurate. I believe it applies to those two parcels there. That's just how gis.

R

Printed it out, so that's already rcl again we have a request that you had approved immediately.

R

To the north of this property for the wentworth property, that would, if successful, before the board.

R

Of county commissioners will likewise be zoned rcl, and then you have the other commercial properties.

R

Immediately to the north of that, including one adjacent to wentworth, that is also rcl.

R

So the idea of this request, similar to the other one, is that this would be consistent with the.

R

Neighboring properties- this is exactly the type of area that we think rcl was designed for and given.

R

That this property has had a commercial use for so long it'd be appropriate to zone it as such um and.

R

And this zoning map, we think, highlights that we go to the next slide. uh This is the current land.

R

Use map again, you can see uh that the properties that we're here talking tonight are immediately.

R

Adjacent to rural commerce, some property again the original property and then to the north.

R

There are the other properties that already zoned rural commerce and again this planning commission.

R

Recommended that wentworth also their land use map likewise be changed to be rural commerce,.

R

If we go to the next slide, this is an excerpt of the maryland department of assessments and.

Taxation information report- I provide this to the planning commission. You can see in the bottom.

Left-Hand corner, the purpose is to show that the primary structures on the property were built in.

R

1985 again, they are commercial use structures that is to demonstrate that this commercial use.

R

Has been on the property for some time and as far as the zoning map change, we need to show either.

R

A mistake in the original zoning of the property um or a change in the neighborhood one thing that.

R

Was in the staff report, that I'll clarify is that we are not changing the we're not suggesting that.

R

This neighborhood has changed since 2010. I don't believe it has much. Some of the uses have changed.

R

On some of those other rcl properties, but like the wentworth property, this was there.

R

Well before that 2010 rezoning and that's where we think I was mistaken- the form of an oversight.

R

That rcl was really the appropriate zoning at that time. If we go to the next slide, these are some.

R

Historic overhead photos taken off the county gis map just to demonstrate again the length of time.

That this use has been on the property. You can see our property immediately in the center. There.

R

There's some, it appears to be some dirt storage area for some vehicles, as you can see, running.

Toward the back of the property, you can see a fence right along 235, either that fence.

Or a similar one is still there today and the other commercial buildings that are out front.

Again, this was from 2003, which was well before the 2010 rezoning. If we go to the next slide, uh this.

Is another historical photo that was a little bit more difficult to see, but this is from 1998.

Again, showing that there's been a commercial use on this property, um since at least that.

Time and there were some other historical photos and went back a little further, but they were.

Too difficult to see on a slide, so 1985 again was the the date on the stat printout for the.

For the buildings on the property, this again is a copy of a slide referencing. The purpose.

Of the royal commercial limited district and as you can see, it's the purpose that.

Is to accommodate existing small-scale commercial uses serving localized markets that are scattered.

Along highways and in some cases clustered at intersections, you can also see that they're.

Compatible with the area and that the idea behind it is that their continuance operation and.

Opportunity for reasonable expansion is consistent with the policies of the comprehensive plan. Rcl.

Districts provide for the continuation and limited expansion of such uses. That's again, why we're.

Asking for this to be rezoned as rcl. We think that that purpose falls directly in line with.

This property and its use over the approximately last 30 to 40 years. If we go to the next slide,.

um Again to to qualify for the rezoning, we have to show one of these two standards.

uh We are arguing a mistake in this one, as in good faith, I don't think we can argue, there's been a.

R

Substantial change in this neighborhood so we're we're stating that there's a mistake in the 2010.

um Comprehensive plan and in the zoning ordinance that was adopted at that time.

If we go to the next slide, this is another. This is a direct excerpt from the comprehensive plan.

Again to to show you the land use, rural, commercial, limited and the purpose there, you can see that.

It is designated for established areas of commercial use along county or state roadways.

That existed in the rpd at the time of the passage of this plan. Again, we think we fall.

Right into that category, and it allows for the continuation of those commercial uses.

Is twofold one: to recommend to the board of county commissioners that they amend the county zoning.

Map to rezone the property from rpd to rcl, and that the planning commission also recommend to the.

Board of county commissioners that the land use map that is uh part of our comprehensive plan.

Redesignate, the property from rural preservation to rural commerce, and um that is our request.

Tonight, I believe, that's our last slide um so that that's our request. We appreciate the time tonight.
