appealing
a
decision

The
procedure
of
this
board
is
as
follows.
First,
the
city
presents
its
witnesses
and
exhibits,
after
which

alleged
violator
is
able
to
ask
the
city's
witnesses
any
specific
questions
regarding
their
testimony.

is
allowed
to

presentation
and

from

rules
or
procedure.
This
is
rule
five
section
four
and
it
provides
as
follows.
After
a
fine
has
been
imposed
by
the
board
and
within
60
working
days
after
the
affidavit
of
compliance
has
been
accepted
by
the
board,
a
violator
may
petition
for
reduction
of
fine.

petition
must
be
in
writing
signed
by
the
violator
and
must
include
a
copy
of
the
affidavit
of
compliance
executed
by
the
code
inspector.
The
petition
must
show
conclusive
evidence
showing
extreme
or
undue
hardship
in

payment

fine
or
preventing
the
violator
to
come
into
compliance
within
the
time
period
established
by
the
board's
order.
The
code
enforcement
clerk
shall
schedule
the
petition
to
be
considered.
The
code
enforcement
inspector
may
present
in
written
form
a
response
to
the
petition
for
reduction
of
a
fine.

It's
actually
a
lean
settlement
when
it
comes
before
the
board
of
commissioners,
but
this
past
tuesday
night
on
the
property
at
714
north
avenue.
This
was
a
residential
piece
of
property
where
there
was
a
business
being
operated
there,
car
sales,
in-op
vehicles
and
a
violation
of
not
having
an
occupational
license.
We
call
them
a
business
tax
receipt.
Now
there
was
a
fine
amount
of
approximately
sixty.
Two
thousand
dollars
had
been
accrued
on
that
one.

city's
staff
city
manager
and
I
brought
forward
a
settlement
offer
of
a
thousand
dollars
to
the
board
of
commissioners
based
upon
the
financial
hardships
that
were
listed
in
the
letter
that
came
to
the
city
and
the
the
board
of
commissioners,
considered
it
tuesday
night
and
they
granted
that
settlement
offered
a
thousand
dollars
the
property
owner
is.
I
did
contact
the
property
owner
the
following
morning
and
she
said
that
she's
going
to
be
making
payment.

She
said
she
was
going
to
be
dropping
it
off
of
my
office
today.
I
haven't
been
in
the
office
today
because
I've
been
here
at
city
hall,
but
once
that
check
clears
then
we'll
issue
the
release
of
lien
on
that
particular
property.

the
most
recent
case
that
came
before
the
board
of
commissioners
for
consideration.
