It
is
the
intention
of
this
board
to
promote,
protect
and
improve
the
health,
safety
and
Welfare
of
the
citizens
of
Tarpon
Springs
by
providing
an
equitable,
effective
and
inexpensive
method
of
enforcing
various
codes
within
the
city
of
Tarpon
Springs.
Any
aggrieved
party
May
appeal
a
final
administrative
order
of
this
board
to
the
Circuit
Court.
Such
appeal
shall
be
filed
within
30
days
of
the
execution
of
the
order
to
be
appealed.
A
Florida
statute
286.0105
requires
any
party
appealing
a
decision
of
this
board
to
have
a
record
of
the
proceedings
to
support
such
an
appeal.
The
procedure
of
the
board
is
as
follows.
First,
the
city
presents
its
Witnesses
and
Exhibits,
after
which
the
alleged
violator
is
able
to
ask
specific
questions
regarding
the
testimony
that
part's
just
they
present.
If
you're
here
you'll,
ask
questions
following
that,
the
alleged
violator
is
allowed
to
make
a
presentation
and
present
his
or
her
Witnesses
and
Exhibits.
Then
the
city
can
question
the
alleged
violator's
Witness.

testimony
on

and
on
the
part
of
the
alleged
violator,
each
party

stormwater
inspector
Paul,
Hopkins
inspected
the
property
located
at
495
River
Village
Drive,
due
to
self-initiated
activity
upon
arrival
of
the
property,
Mr
Hopkins
witnessed
contractors
washing
out
paint
supplies
into
the
storm
water
inlet,
and
there
was
red
paint
that
was
thrown
directly
into
the
inlet
as
well.
Mr
Hopkins
advised
both
the
contractors
and
respondent.
This
had
to
cease
immediately
and
could
not
continue.
The
contractors
have
been
washing
the
paint
out
in
the
storm
water
inlet
for
at
least
the
past
three
days
due
to
contamination.

to
City
storm
water
staff
cleaning

areas

property
is
in
compliance.

this
time,
a
hearing
notice
was

the

with

with
the
restaurant

another

on

9th

pavers

property

communities

result
of
the
torrential
rainfall
in

water
accumulation
occurred
and
ultimately
led
to
water
within
my
neighbor's
garage
at
133
North
ring
Avenue.
Due
to
this
event,
my
neighbor
has
filed
a
complaint
with
the
city
of
Tarpon.
Springs
I
have
already
begun
readymade
remediation
process
to
address
all
my
neighbors
concerns.
In
addition,
I
have
submitted
a
detailed
plan
of
action
to
my
HOA.

to
resolve
the
current
mitigating
circumstances.

neighbor
states,
he
is
a
contractor
from
California.
He
has
given
me
nothing
but
grief
as
I
attempted

rectify
the
current
state
of
affairs.

contractor

have
limited
knowledge

December
20th
2022

McNeese
sent
an
email
to
the
respondent

review,
along
with
a
letter,
HOA
documents,
site
drawings
and
stone
water
management
information.

the
letter
to
the
respondent.

explained

property
was
part
of
the
carriage
homes
on
ring,
which
was
approved
by
the
city
of
Tarpon
Springs
as
a
compliant
project
with
respect
to
the
drainage
design,

also
approved
by
the
southwest
Florida
Water
Management
District.
It
further
stated
that
per
the
city's
Land
Development
code,
the
addition
of
impervious
Services,
which
was
what
occurred
with
the
respondents
project,
was
not
compliant
with
this
code
and
cannot
be
permitted
by
the
city.

explained

if
he
had
received
approval
for
the
work
from
the
HOA,
the
HOA
document
specifically
state
that
this
would
not
be
approved.
Lastly,
that
all
work
on
the
site
must
cease
immediately

removed
and
the
property
restored
to
its
original
graded
and
sodded
condition
by
the
two-week
timeline
