the
binoculars
known
as
the
concarry
bill.
I
will
tell
you
that,
while
it
does
significantly
improve
constitutional
rights,
specifically
the
second
amendment
right
in
this
state,
it
will
absolutely
also
improve
community
safety.
There
are
a
number
of
enhancements
and,
from
a
budgetary
standpoint,
the
enhancements
to
the
criminal
code
include
items
like
making
sure
that
if
someone
steals
a
firearm
from
a
vehicle
from
a
from
a
home
from
a
business
that
is
a
felony,
many
firearms
are
valued
at
under
a
thousand
dollars.

That's
a
misdemeanor
now
and
a
lot
of
times
it's
a
smack
on
the
wrist,
but
when
someone's
stealing
a
gun,
they're,
usually
not
stealing,
that
for
their
own
usage,
they're,
not
stealing,
that
gun
for
their
own
self-protection,
they're
stealing
it
because
guns
sell
like
hotcakes
out
on
the
street
and
those
folks
that
are
buying
those
guns
illegal
in
the
street
are
the
ones
that
can't
buy
a
gun
legally.
So
it's
also
going
to
come
with
a
180-day
mandatory
minimum.

So
again,
the
the
message
needs
to
go
loud
and
clear
if
this
bill
passes
and
becomes
law,
if
somebody
steals
a
gun,
I
hope
you
like
jail
because
there's
going
to
be
a
whole
lot
of
it
if
you
get
convicted,
so
I
mean
that's
what
this
bill
does
again:
it
improves
and
and
protects
constitutional
rights,
and
it
also
increases
crimes
like
stealing
a
gun
fell
in
possession
of
gun
other
types
of
crimes
that
are
absolutely
you
know
we're
trying
to
keep
the
guns
out
of
the
bad
guys,
hands
and
preserving
the
rights
of
the
good
guys.

idea

permits
free

bill
without

amendment
would
still

separate
piece
of
legislation,
saying
that
our
permits
are
free,

would
fully
support
it.
Unfortunately,

bill

create

fiscal
note
that

funded
in
the
budget

bill

behind
the
budget.

a

I'm
passionate
about,
because
unfortunately,
it's
personal
for
me
and
my
family
in
2016,
my
brother,
a
dedicated
state
employee,
was
senselessly
shot
to
death
in
a
road
rage
incident
a
few
miles
from
here.
Like
all
americans,
we
honor
the
constitution,
as
required
by
the
second
amendment,
support
well-regulated
gun
ownership.
We
support
our
existing
permitting
systems
that
require
background
checks
and
gun
safety
training
for
people
who
wish
to
carry
firearms
in
public
places.

I'd
like
to
open
by
reading
the
fiscal
review
committee's
summary
of
the
governor's
budget
as
it
pertains
to
permitless
carry
quote.
The
governor's
proposed
budget
recognizes
a
reoccurring,
increase
in
state
expenditures
of
17.7
million
dollars,
a
reoccurring
decrease
in
revenue
to
the
handgun,
permit,
division
of
2.4
million
dollars
and
a
reoccurring
decrease
in
revenue
to
the
tbi
of
469
thousand
dollars.
Unquote,
let's
be
clear.
These
are
state
taxpayer
dollars,
17.7
million
dollars
that
could
go
to
our
school
teachers,
small
businesses
and
frontline
workers.

Instead,
our
elected
officials
want
to
use
these
state
taxpayer
dollars
to
satisfy
the
gun
lobby
when
we
should
be
helping
tennesseans.
This
bill
does
the
opposite,
as
it
will
quote:
increase
in-state
car
incarceration
expenditures
by
an
estimated
12.3
million
dollars.
Unquote.
That
means
69
percent
of
the
proposed
17.7
million
dollars
going
towards
locking
tennesseans
up
supporters
of
berlin.
Miss
kerry
will
lead
you
to
believe
that
this
legislation
will
not
impact
our
permitting
system
or
the
revenue
generated
from
it,
because
the
governor
is
allocating
state
taxpayer
dollars
to
plug
any
gaps.

As
the
fiscal
review
committee
found
quote
of
the
states
that
have
switched
to
constitutional
carry
in
the
past
six
months,
there's
been
an
average
decline
of
19.5
percent
and
criminal
background
checks,
requests
for
those
specific
states.
Therefore,
it
can
be
reasonably
estimated
there'll
be
a
reduction
in
approximately
20
percent
in
new
and
renewed
enhanced
handgun
carry
permit
and
concealed
handgun
carry
permit
applications
each
year.
It's
time
for
this.
To
stop.
Permitless
carry
will
increase
the
number
of
people
carrying
loaded
guns
in
public
because
this
law
incentivizes
it
gun.

Violence
costs
tennessee,
9
billion
dollars,
each
year,
of
which
433.2
million
dollars
is
paid
by
taxpayers
at
an
average
cost
of
one
thousand
three
hundred
forty
six
dollars
per
person
each
year,
tennessee
has
the
eighth
highest
per
person.
Cost
of
gun
violence
in
the
united
states,
not
to
mention
the
negative
impact
of
gun
violence
will
have
on
our
business
community.

We
know
that
communities
that
experience
gun
violence
are
less
likely
to
be
hubs
for
economic
growth
and
commerce
and
face
lower
property
values
for
your
business
startups
and
loss
of
jobs,
and
that's
why
all
of
our
law
enforcement
leaders
have
opposed
this
bill.
The
tennessee
bureau
of
investigations,
the
sheriff
association
and
the
police
chiefs,
the
men
and
women
charged
with
keeping
tennessee
safe
the
same
men
and
women
you
claim
to
support
the
bottom
line
is
permit
less
carry
is
bad
for
tennessee.

put
public
safety
first
and
vote
against

When
I

a
problem,
I
look
at
five.
Major
factors
is
what
I'm
going
to
do
about
it.
First
of
all,
what
do
my
employees
think
about
it
when
tennesseans
are
surveyed
with
this
bill?
I
Second
factor
I
look
at
is:
what
are
the
people
who
are
tasked
with
enforcing
this
thing?
The
chiefs
of
police
across
the
state
are
opposed
to
this
legislation,
as
per
as
we
don't
any
longer
have
well-regulated
militias
per
the
second
amendment.
We
have
police
who
are
highly
trained,
dedicated
and
really
responsible
to
maintain
our
safety
and
security
for
all
tennesseans.
I
So
I
believe
we
should
listen
and
support
them
as
they
risk
their
lives
daily
to
support
us.
Thirdly,
what
are
the
safety
risks
of
this
legislation?
To
me,
I
grew
up.
My
father
was
adamant
about
gun
safety.
He
said
son,
you
put
your
guns
away,
safe,
you
don't
point
them
at
people,
you
make
sure
they're,
not
loaded.
You
clean
them
properly.
You
take
good
care
of
them.
I
As
everybody
in
this
group
knows
recruiting
businesses
to
the
state
of
tennessee
is
costly
and
it
takes
a
lot
of
time
and
effort.
We
have
an
opportunity
to
differentiate
ourselves
and
to
stand
out
from
the
group,
because
all
the
other,
the
nra,
on
top
of
the
18
states
that
are
already
going
to
pass.
I
This
will
be
one
of
the
18.,
but
instead,
if
we
can
say
for
any
companies
looking
to
relocate,
they're
worried
about
their
employees
and
how
safe
they're
going
to
be
and
to
me,
we
could
stand
out
as
a
beacon
of
a
safe
conservative
refuge
by
not
having
this
done
and
then
what
is
the
dollar
cost?
You
just
heard
jason
talk
about
it.
It's
almost
20
million
dollars,
an
additional
cost
to
the
state
of
tennessee,
18
million
incarceration
of
risk
of
2.4
million
and
permitting
another
500
000
to
tbi.
That's
a
lot
of
money.
I
So
when
I
look
at
this
overall,
I
say
what
are
the
issues?
What
is
the
problem?
We're
trying
to
solve
and
are
we
solving
a
problem?
Are
we
making
a
bigger
problem
that
could
have
impact
tennesseans
for
years
to
come
to
me,
we
ought
to
be
working
on
bills
and
things
that
are
impact
all
tennesseans
and
they're,
all
for
it
like
education,
health
care
and
economic
development.

I
know
it's
a
passionate
issue
for
for
all
tennesseans,
so
I
really
appreciate
that
just
just
some
clarification,
the
the
cost
that
we've
heard
the
financial
obligation,
that's
from
incarceration
expenses,
that's
where
the
the
facet
of
leader
lambert's
bill.
That's
where
we're
putting
the
bad
guys
in
jail
is
where
that
substantial
amount
of
money
is
coming
from.

another

of
clarification,
two
different
speakers
now
have
mentioned
how
certain
groups
represent
all
law
enforcement
across
this
state,
and
I
call
bull
on
that.
One
we've
talked
to
individual
police
chiefs,
individual
sheriffs,
and
they
have
stated
emphatically
that
this
these
groups
do
not
in
fact
represent
them.
So
I
would
submit
to
the
to
the
committee
that
those
statements
are
in
fact
false
and
that
should
not
even
be
considered
by
this
committee.
The
other
expenses
that
are
in
this
bill,
the
fiscal
notes,
are
generated
from
over
taxing
and
overcharging.

Our
citizens
for
permits
the
entire
fee
system,
with
that
permit
system
was
created
to
offset
cost
of
that,
and
it
has
generated
millions
of
dollars
into
the
general
fund
over
and
above
those
costs-
and
I
challenge
the
department
to
get
that
fixed
we're
charging
people
too
much
money
for
permits,
so
their
fiscal
note
is
bogus
as
well
in
my
opinion
and
most
states
that
have
enacted
this
have
in
fact
seen
an
increase
in
permit
sales
over
time.
That
is
a
fact
that
is
proven.

understand
how
difficult
it
is
to
come
and

report,
and
some
of
the
comments
that
were
that
were
made
address
some
some
items

kind

tried
to
redirect.

facts

from
representative
law
enforcement
said
they
were
against
this
bill
and
the
facts
are
that
the
cost
of
this
bill
are
reflected
in
the
fiscal
note
that
we're
all
looking
at
so
whatever
that
is,
and
and
the
reasons
for
that
I
appreciate.

it's
great
testimony,
but
it

little
to
do

this
actual
bill.

want

be
real,
clear,
we're
keeping

permit
process

place.
People

get
a
permit

fact
they
should
get
training
well,
above
and
beyond
the
one
class
that
that
folks,
that
have
testified
today
in
other
committees
act
like
somehow
another
one
class
on
a
half
a
day
on
a
saturday
miraculously
makes
you
safe
with
your
firearm
for
the
rest
of
your
life.
It
doesn't.

want

be
clear,
go
train
with
that
firearm
regularly.
We
don't
require
that
and
we
shouldn't
require
that,
but
we
should
absolutely
all
encourage
that.
I
have
said
in
other
committees.
I
have
friends
that
carry
a
firearm
and
I
have
asked
them
before.
Are
you
sure
it's
not
rusted
shut
because
they
haven't
been
to
the
range
in
years?
If
that's
you
and
you're
hearing
this,
don't
carry
that
firearm
go
practice
with
it,
learn
how
to
safely
store
it
learn
how
to
safely
use
it.

Nothing
in
this
bill
changes
that,
but
I
will
say
this:
it
does
take
away
a
potential
jail
time.
Offense,
it's
a
misdemeanor
offense.
If
you
are
currently
eligible
to
get
a
permit-
and
you
simply
have
not
done
so-
you
can
have
that
gun.
You
can
legally
possess
it
in
your
home,
your
business,
your
car,
your
boat,
your
bicycle,
your
motorcycle,
your
friend's
business,
home
boat,
car
motorcycle,
everything
else,
but
it's
a
crime
to
walk
between
those
locations,
we're
keeping
the
permit
process
in
place,
but
we're
not
locking
up
people
that
are
eligible
for
a
permit.

are
law
abiding
citizens,
but
in
tennessee
it's
a
crime
for
them
to
carry
their
gun
in
between
the
locations
that
they're
already
lawfully
allowed
to.
Have
it
that's
wrong:
let's
go
after
the
bad
guys,
let's

good
guys
alone
and,
let's
all
work
together
to
make
our
communities
safer.
That's
why
this
has
a
significant
fiscal
note,
because
there's
a
lot
of
bad
people
out
there
doing

lot
of
bad
things
every
day
this

going
to
put
them
in
jail
for
a
lot
longer.

remind
us
of
our
oath
of
office

these
law
enforcement
officers,
take
the
same
oath
to
uphold
the
constitution

states

constitution.

enumerates
several

rights,

but
it
enumerates
several,
the
second
of
which
is
the
citizens
right
to
keep
and
bear
arms,
and
it
shall
not
be
infringed
this
body
and
bodies
before
us
have
definitely
infringed
on
that
right.

infringements

right
to
carry
that's
our
obligation
and
its
obligation
of
law
enforcement
as
well

come

their
members
are

opposed

frankly,

they
justify
it

believe
in
the

amendment,

committee
is
debating
different
bills

worth
funding,
this
one
is
well
worth
the
money.

there

family

lost
a
husband
and
a
father
and
a
son
that
was
dedicated
to
our
community.
His
name
is
spencer.

Bristol
this
bill
is
named
after
him.
He
was
literally
just
doing
his
job.
He
was
chasing
down
a
fleeing
felon
that
was
endangering
our
community
and
was
struck
by
another
vehicle
when
that
felon
was
literally
out
dodging
between
cars,
this
officer
was
literally
just
trying
to
apprehend
this
guy.
This
raises
the
penalty
on
folks
that
are
evading
to
rest
and
that
directly
causes
an
officer's
death.
That's
why
there's
a
very
small
fiscal
note,
because
it's
not
going
to
happen
very
often,
but
when
it
does
it's
devastating
to
a
family,
it's
devastating
to
a
community.

So,
mr
chairman,
I
know
that
it'll
go
behind
the
budget
today,
but
I
would
implore
you,
on
behalf
of
the
bristol
family,
on
behalf
of
his
wife
and
and
daughter
that
are
left
behind.
I
mean
his
baby
girl.
You
may
have
seen
pictures
two
years
ago
when
this
happened
she's,
so
small
she's
never
really
going
to
know
her
daddy
she'll
know
the
legend
of
her
father,
but
she's
never
going
to
have
a
daddy
there,
and
so
I'm
not
trying
to
pull
on
your
heartstrings.
But
that's
what
this
bill
is
about.

mean
the
person
that
that
in
essence
murdered
her
dad
is
gonna
do
about
six
months.
For
that,
that's
just
not
enough,
and
so
this
would
increase
that
penalty
can't
go
back

fix
that,

next
time
it
happens,

in
tennessee.

can

acts

for

if

have

group

to
throw
a
rock
or

charge

become
contagious

group

can
escalate
to

riot.

damages

changes

improve
safety,
reduce
damage
to
underground
utilities
and
achieve
compliance
with
federal
rules
and
regulations.

guard

strong
act

2017..
It
also
includes
vocational

technical
programs

graduate
program
is
a
master's
program.
Not
a
doctoral
sets
forth
limitations
and
conditions
on
the
eligibility
for
tuition.
Reimbursement
expands
the
definition
of
tuition
to
include
all
mandatory
fees.

this
bill
is
clarifying
is
that
that's
not
a
taxable
situation
where
sales
tax
will
be
collected
on
that
service
to
folks
that
have
the
professional
license.

an
idea
where
this
bill
is
going,
but
I
just
wanted
to
give
you
an
idea
where
this
bill
is
coming
from.
As
we
all
know,
our
cities
are
the
economic
engines
of
the
state
in
1947.
The
state
in
recognition
of
this
began
sharing
4.6
percent
of
each
year's
total
sales
taxes,
their
collections
with
our
cities.
O
This
was
also
an
acknowledgment
that
city
residents
incur
a
local
tax
burden
that
is
directly
attributable
to
financing
developing
and
maintaining
an
economic
environment
that
continues
to
generate
a
significant
portion
of
the
sales
tax
revenue
accruing
to
the
state.
Today,
now
today,
92
percent
of
st
the
state's
total
sales
tax
collections
are
generated
within
city
limits.
The
sharing
of
these
revenues
helps
reduce
our
local
tax
burdens
in
2002.

Today,
municipalities
only
receive
a
share
of
the
state
sales
tax
generated
by
5.5
percent
of
the
state
sales
tax,
rather
than
the
full
7
percent.
For
this
reason,
cities
now
only
receive
a
3.6
percent,
as
opposed
to
that
original
4.6
percent
effective
share
of
total
sales
tax
revenues
as
a
direct
result
of
this
cities
have
been
denied
well
over
700
million
dollars
in
shared
revenue
since
2002..

The
fiscal
note
on
this,
as
you
can
see,
is

million

of
the
state
revenue,
but
you'll
notice
that
goes
directly
into
local
government
revenues,
we're
collecting
these
funds
in
our
localities
and

cities,

state
is
healthy.

have
made

smart
financial
decisions,

out
of
the
gutter
and
right
now
we're
sitting
on
a
lot
of
money
that
our
municipalities
could
be
benefiting
from.
That's
what
this
legislation
seeks
to
do.

update
our
local
government
finance
statutes
carrying
this
on
behalf

the
comptroller.
It
does
things
like
remove
outdated
terms.
It
modernizes
some
of
the
language,
simplifies
borrowing
procedures,
increases
transparency
and
provides
different
updates
to
the
code,
for
example,
in
our
current
code
is
the
term
abattoir
there
may
be
someone
in
here
who
wonders
what
that
is:
it's
evidently,
a
slaughterhouse.

has
been
possible
for
a
city
or
county
government
to
publicly
finance
an
abattoir,
that's
no
longer
being
done,
and
so
these
revisions
take.

a
second
example,
the

code
makes
the

local
governments
to

a
capital
outlay
note
on

long-term
capital
project
in

fixed
rate
revenue
bonds.

intent
here
is
to
benefit
our

encourage

some
cases
the
changes
reduce

times

local
governments
need

restores
a
tax
use
exemption
for
vanderbilt
university
medical
center.
It
qualified
for
this
exemption
prior
to
its
split
with
the
university
and
tennessee
code,
contains
a
use
tax
exemption
for
non-profit
schools
when
vanderbilt
university
and
the
medical
school
became
two
separate
entities.

Vanderbilt
university
medical
school
was
no
longer
considered
the
degree
granting
institution,
even
though
they
grant
medical
degrees
for
that
school.
So
this
simply
takes
care
of
that.
It
really
was
an
oversight
in
the
process
of
that
split
and
it's
nearly
focused
to
clarify
that
the
medical
school
can
still
claim
the
tax
exemption,
and
this
applies
when
they're
doing
you
know
new
projects,
building
projects
remodeling
whatever
to
the
the
properties
or
the
materials
that
they're
purchasing
and
being
used
in
those
projects.
