Description
House Health Committee- March 31, 2021
A
All
righty,
thank
you.
I
was
getting
a
bit
distracted
there
for
a
second.
Do
we
have
any
members
with
any
personal
orders.
C
Thank
you,
mr
chairman
members.
Just
to
clarify
matters
a
bit.
I
spoke
without
knowledge.
The
last
time
when
I
claimed
that
I
was
no
longer
a
member
of
the
tma,
it
turns
out.
As
I
closed
my
practice,
I
didn't
pay
their
dues,
so
I
assumed
I
was
not
a
member,
but
it
turns
out
they
make
you
member,
if
you're
retired,
forever
without
deals.
So
I
am
a
member
and
I'm
happy
to
be
there.
A
Mr
chairman,
all
right,
thank
you
all
right,
any
further.
Okay
sing,
none
we've
got
a
pretty
good
calendar
here.
We
are
on
item
number
one
house
bill:
666,
chairman
wendell,
okay,
okay,
okay,
we
have
that
bill
is
currently
in
the
posture
and
that
we
have
adopted.
A
Amendment
4568
and
we
were
on
amendment
5517.
It
had
a
motion
in
a
second
and
that
was
chairman
kumar's
amendment.
So
that's
the
posture
of
the
bill.
There
is
another
amendment
that
has
been
filed,
so
I
guess
the
question
to
chairman
kumar.
Would
you
want
to
re,
withdraw
your
that
amendment
five
five,
one
seven
or.
C
D
C
A
So
without
objection,
amendment
number
5517
has
been
withdrawn.
Okay,
that
brings
us
to
amendment
6143
chairman
kumar.
Are
you
recognized.
C
Thank
you,
mr
chairman
and
members.
This
removes
the
language
that
was
concerned
that
the
physician
is
counseling,
a
patient
about
use
of
cannabis
products,
and
the
physician
should
not
do
that
because
it
is
a
schedule,
one
substance
and
having
removed
that
the
rest
of
the
amendment
still
states
that
let.
A
C
Amendment
still
states
that
the
person
does
have
quadriplegia
and
they
suffered
that
injury
during
service
to
our
country
and
that
they
have
tried
the
lawfully
available
synthetic
compounds
for
this
for
the
spasms
that
has
been
approved
by
the
fda.
With
that
explanation,
I'll
be
happy
to
answer
any
questions.
Okay,.
E
First,
I
want
to
thank
dr
kumar
for
his
patience
and
his
hard
work.
I
view
this
as
a
friendly
amendment
and
I
appreciate
his
input
and
also,
mr
chairman.
I
appreciate
your
input
because
you've
been
very
patient
with
me
on
this
particular
piece
of
legislation,
and
I
want
to
say
publicly.
I
appreciate
both
dr
kumar
and
dr
terry
and
also
darren
jernigan
for
their
assistance.
A
Thank
you
chairman's
journey
and
you're
organized.
C
No
physician
cannot
state
that
somebody's
eligible
for
cannabis.
The
letter
simply
states
that
one.
This
person
has
this
condition
the
diagnosis
and,
secondly,
says
the
legally
available
fda,
approved
remedy
has
been
tried.
It
does
not
specify
whether
it
worked
or
not
how
long
it
was
tried
it.
Just
it
has
been
tried.
The
law
makes.
A
E
Again,
I
view
this
as
a
friendly
amendment
and
I
appreciate
dr
kumar's
hard
work
and
patience
and
I
would
appreciate
the
members
consideration.
This
will
be
a
great
benefit
to
service
connected
veterans
who
acquired
and
acquired.
They
became
quarter
police
as
a
result
of
service
in
the
armed
forces,
united
states,
and
I
think
this
is
a
step
forward
for
those
people,
and
we
appreciate
it
all.
C
Mr
thank
you,
mr
chairman
members.
I
need
I
need
to
give
you
an
explanation
and
an
apology.
Again.
Our
feeling
was
that
this
is
a
veteran
who
has
suffered
a
tragic
injury
in
service
of
our
country.
Our
heart
goes
out
to
them
and
we
want
them
to
allow
to
be
able
to
use
everything
they
can
for
your
comfort.
C
Over
the
weekend,
I
received
a
call
from
a
person
who's
whose
feeling
was
that,
if
I
had
same
injury
in
an
accident
with
a
drunken
driver,
I'm
not
entitled
to
this.
My
tragedy
is
equally
at
that
level
and
I
thought
of
other
possibilities
too,
because
it
is
a
tragic
injury
and
who
are
we
to
judge
in
that
sense.
For
that
reason,
I
have
very
mixed
emotion
about
the
bill.
C
A
Thank
you
for
those
words,
any
further
questions
from
the
committee.
Okay
sing.
None.
We
are
going
to
vote
on
house
bill
666
as
amended.
All
those
in
favor
say:
aye
aye
opposed
have
captioning,
not.
C
C
It
solves
a
problem
in
the
sense
that
10
care
expects
those
people
who
are
providing
this
service
to
be
registered
with
with
them.
On
the
other
hand,
most
pharmacists
are
not
directly
registered
with
10
care,
so
therefore
they
will
work
through
the
chief
medical
officer
of
the
department
of
health
to
do
so,
and
this
agreement
also
includes
parameters
about
training,
the
pharmacist
to
be
able
to
provide
this
service
and
vaccination.
C
Thank
you,
mr
all.
Right.
A
Thank
you.
We
have
an
amendment
on
that
bill.
I
believe
that
came
up
through
health
subcommittee
amendment
four
four
one:
zero.
You
have
motion
a
second
and
I
think
you
just
described
that
amendment.
So
without
objection.
Let's
vote
on
amendment
4410,
all
those
in
favor
say:
aye
aye
opposed
eyes.
Have
it?
Okay,
we
are
back
on
the
bill
as
amended
any
questions
for
the
sponsor
okay,
seeing
none.
We
are
voting
on
house
bill
778,
all
those
in
favor
say:
aye
aye
opposed
eyes.
Have
it
bill
goes
on
to
calendar
and
rules.
A
F
Thank
you,
mr
chairman,
for
those
of
you
who've
been
in
the
general
assembly
a
while
you've
heard
me
talk
about
this
issue
for
a
number
of
years
now
this
is
a
bill
to
bring
the
pay
scale
for
our
dids
folks,
our
direct
service
providers,
to
bring
it
up
to
something
approaching
reasonable.
F
So
this
bill
would
attempt,
over
a
period
by
july,
of
24
to
gradually
move
this
pay
scale
up
to
15.
Once
we
reach
that
amount,
then
we
would
want
to
tie
the
increases
to
state
salary
increases
so
that
these
folks
could
wouldn't
get
left
behind
again,
that's
basically
what
happened
and
what
got
us
in
this
hole.
So
we
want
to
just
tie
them
to
standard
increases,
but
we
don't
want
to
do
that
until
their
salaries
are
at
a
more
reasonable
level.
So,
with
that,
I
stand
ready
for
any
questions.
Okay,.
A
A
All
righty
that
brings
us
to
item
number
four
house
bill,
180.
rumps
of
hall.
You
are
recognized,
you
have
motion
in
a
second
and
there
is
an
amendment.
Yes,
sir
honestly,.
A
Okay,
you've
motioned
a
second
on
the
amendment,
go
ahead
and
tell
us
about
your
legislation.
D
Thank
you,
mr
chairman
house,
bill
180
is
addresses
suicide
counseling,
any
health
care
provider
that
has
a
patient
in
within
their
care
that
demonstrates
inflecting
bodily
harm
or,
or
has
mentioned
suicide
before
being
discharged,
they're
required
to
give
them
the
mental
health
resources
to
get
counseling
after
discharge.
It
doesn't
require
them
to
do
so.
It
just
provides
the
resources
for
them
to
get
help
after
being
discharged
I'll,
be
glad
to
answer
any
questions.
D
For
the
sponsor
no
further
comments,
mr
chairman,
I
renew.
A
My
motion
see
none.
We
are
voting
on
house
bill
180
as
amended.
All
those
in
favor
say
aye
opposed
eyes.
Have
it.
The
bill
goes
on
to
calendar
and
rules.
Thank
you,
mr
chairman.
A
All
right,
thank
you.
That
brings
us
to
item
number
five
house
bill
750
by
chairman
boyd,
chairman
boyd.
Do
you
recognize?
Do
you
have
a
motion
and
second.
E
Thank
you,
mr
chairman
house,
bill
750
would
create
a
chronic
weight
management
task
force
to
study
the
health
implications
of
chronic
weight
management
and
type
2
diabetes.
A
Okay,
sing?
None.
We
will
be
voting
on
house
bill
750,
all
those
in
favor
say
aye
aye
opposed
eyes.
Have
it
the
bill
goes
on
to
government
operations.
Thank
you
chairman.
Thank
you.
G
G
House
bill
231
serves
to
be
serves
to
form
a
carve
out
for
home
care
services
under
a
federal
energy
employee
program
which
treats
former
energy
employees
for
chronic
illnesses,
primarily
from
the
oak
ridge
laboratory
areas.
My
the
amendment
number
is
three
seven.
A
Nine,
nine!
Okay,
so
we
have
an
amendment.
You
have
motion
second,
on
three:
seven:
nine,
nine,
okay,
so.
G
3799
is
the
bill
and
for
the
energy
workers
of
the
30s
40s
and
50s,
they
were
subjected
to
radiation
that
they
sometimes
were
unprepared
to
deal
with.
And
what
this
does
is
this
a
federal
program
that
provides
home
care
services
for
these
folks
that
worked
at
oak
ridge
back
in
the
day,
and
this
carves
it
out
to
where
those
providing
this
service
aren't
required
to
get
a
certificate
of
need
for
them.
A
A
G
You,
mr
speaker,
and
on
this
bill
we
have
a
house
amendment
that
I'd
like
to
add
on
which
rewrites
the
bill
it's
drafting
code
5804.
all.
A
G
Eight
zero,
four
okay
after
the
wide
council
of
the
subcommittee,
we
got
together
with
those
that
had
some
concerns
about
it
and
we
got
it
addressed
addressed
all
those
folks
concerns-
and
here
we
are.
This
program-
will
allow
nurse
graduates
should
they
desire
to
in
the
time
before
they
take
their
licensing
exam
up
to
120
days.
They
can
work
in
the
hospitals.
G
It's
a
it's
almost
an
apprentice
program.
It
allows
them
to
get
their
feeds
on
the
floor
to
where
they
understand.
What's
actually,
a
ward
and
wing
look
like
they're
under
direct
supervision
of
practicing
nurses,
and
so
we
think
this
allows
for
retention,
and
it
has
also
proven
well
during
the
pandemic
to
be
able
to
have
some
more
feet
and
arms
and
hands
on
those
floors,
assisting
folks
with
what
they
need.
So
we're
looking
to
make
this
program
full
time
and
that's
what
this
bill
does.
A
B
A
A
H
You,
mr
chair,
if,
if
we
can
entertain
a
motion
in
a
second
so
that
we
can
get
your
amendment
on
on
the
bill,.
A
Okay,
all
right-
and
we
do
have
an
amendment
on
this-
it
is
6305
and
I
will
need
to
pass
the
gavel
all
right.
Thank
you.
That
is
a
friendly
amendment.
Absolutely
we
have
worked
on
this
amendment.
On
this
resolution
I
told
the
sponsor
I
assist
with
finding
language
for
the
resolution.
It
recognizes
that
the
ama
adopted
a
new
policy
recognizing
racism
as
a
public
health
threat
and
that
the
ama
is
committed
to
collaborating
with
stakeholders
to
eliminate
racism.
D
Any
questions
of
chairman
chairman
hall,
thank
you,
mr
chairman.
I
I
move
that
we
we
send
this
to
summer
study,
that
is,
a
promotion.
That's
been
moved
and
seconded.
D
Well
yeah,
could
you
hold
that
thought
for
a
second
yeah?
Okay
yeah?
Could
you
withdraw
that
move
the
withdrawal?
Mr
trump,
all
right?
Thank
you
without
objection.
That
motion
is
withdrawn
back
on
the
amendment.
Any
questions.
D
H
Thank
you
thank
you,
mr
chair,
and,
and
thank
you
committee
committee
members
and
and
and
to
to
the
members
a
couple
things
come
up.
Let
me
let
me
state
a
couple
of
things.
One
is
I'm
not
running
this
resolution
to
create
or
present
a
gotcha
moment?
That's
not
that's
not
what
the
purpose
was
and
when
members
had,
you
know
a
little
bit
of
heartburn
or
maybe
a
lot
of
heartburn,
obviously
about
the
way
the
draft
was
written.
The
draft
came
from
legal.
H
H
You
know
we,
we
understand
the
harms
of
racism
and
we,
I
think
we
do,
and
we
do
there
are
things
in
motion
right
now
that
things
that
have
been
implemented
to
help
to
close
these
gaps
in
health
care,
and
you
know
whether
these
gaps
were
were
created
intentionally
or
not.
Is
honestly,
you
know
beside
the
point.
Our
our
goal
is
to
recognize
that
they
do
exist.
H
H
A
lot
of
that
is
is
because
we're
trying
to
because
we
have
areas
where
you
know
the
attention
is
needed
and,
and
some
of
it
is
in
in
those
minority
communities,
this
resolution-
this
is
not
a
gotcha
moment.
This
is
us
recognizing
that
that
there
are
some
areas
that
that
we
need
to
work
on.
That's
why
I'm
perfectly
fine
perfectly
fine
with
the
rewrite
of
the
resolution.
H
I
I'm
I'm
happy
with
it
if
it
if
it
gets
us
all
on
the
same
page,
to
to
start
closing
those
gaps,
I'm
with
it,
and
I
hope
that
the
rest
of
the
members
will
be
okay
with
it.
Also
and
and
and
let's
be
honest,
you
know,
and
you
know
chairman,
you
know,
I
respect,
you
know,
you
know
barber
and
beauty
stuff
right,
you
know,
but
you
know
this
is
not
something
that
will
be
studied
in
the
summer.
H
You
know
I
I
just
I
just
you
know
hope
that
we
can.
We
can
move
this
on
out
and
and
and
all
they're
saying
is
that
we
recognize
what
they
say
and
we're
gonna.
You
know
work
to
fix.
You
know,
you
know
whatever
parts
we
have
responsibility
for
that,
we
can
fix.
You
know
to
close
those
those
gaps
in
healthcare.
That's
it
that's
all
this
does,
and
so
I
hope
that
we
can
move
it
out.
Thank
you.
C
I
have
an
apology
for
you
and
a
disagreement
with
you.
My
apology
is
that
I
did
not
speak
up
the
last
time.
Honestly.
These
are
difficult
issues
and
I
was
not
able
to
gather
my
thoughts
together,
and
these
are
difficult
issues
in
difficult
times
in
the
sense
that
even
good
words
can
be
misunderstood
and
it
can
create
a
media
and
social
media
storm.
So
I
was
afraid
to
speak
up.
C
C
C
I
acknowledge
that
if
there
is
prejudice
and
racism
in
in
american
society,
it
has
been
in
the
past,
but
today
we
live
in
the
best
times
ever.
From
that
point
of
view,
we've
had
african-american
president
the
highest
office
in
the
land,
and
we
have
made
tremendous
strides
in
civil
rights,
certainly,
and
I
think
it
is
something
to
celebrate.
C
Your
resolution
says
that
there
is
systemic
bias
in
and
racism
in
health
care.
I
have
worked
in
this
country
in
healthcare
for
50
years,
and
that
is
not
my
experience
to
to
a
most.
Yes,
there
are
bad
apples
everywhere,
but
to
most
of
healthcare
workers,
a
person
who
is
sick
is
really
our
call
to
rise.
C
Yes,
there
is
inequity
and
there
is
disparity
in
health
care,
but
you
mentioned
heart
disease
and
high
blood
pressure,
but
kindly
realize
that
maybe
genetic,
maybe
diet,
related,
maybe
socioeconomic
factors.
I
think
of
play
a
very,
very
major
role.
Certainly
african-american
patients
don't
do
as
well
in
treatment
because
of
the
lack
of
support
because
again
socio-economic
limitations.
C
C
C
My
health
care,
my
fellow
health
care
workers,
have
risen
to
unbelievable
challenges
during
the
pandemic
and
how
they
have
served.
They
have
put
themselves
at
risk
and
put
their
families
at
risk.
If
anything,
they
need
our
gratitude
and
our
congratulations
and
thank
you
for
having
done
what
they
have
done
it
is.
I
find
it
is
unjust
to
imply
that
there
is
systemic
bias
and
systemic
racism
within
my
profession.
I
feel.
C
A
Thank
you,
representative
parker
in
your
house,.
H
And-
and
thank
you
for
that
and
and
dr
kumar
thank
you
for
for
your
statements
and
and
and
two
things.
Let
me
be
clear.
I
am
in
no
means
attempting
to
disparage
or
show
a
lack
of
appreciation
to
our
healthcare
workers.
I
have
another
bill.
That's
that's
that
I'm
working
on
that
would
relieve
nurses
of
their
fees
this
year.
If
we
can
get
it
passed,
and
so
I
just
want
you
to
know
that
be
clear
on
that.
H
Secondly,
no
I
I
was
not
in
bondage
as
as
our
forefathers
were,
but
there
has
been
a
difference
in
the
the
health
care
or
or
the
treatment
that
that
was,
that
has
been
given
to
to
people
of
color
and
and
and
and
not
just
people
just
poor
people.
Also,
let
me,
but
let
me
let
me
qualify
that
let
me
qualify
that
and
and
I'm
not
trying
to
be
argumentative
with
with
the
doctor.
H
H
I
was
I
was
involved
in
the
robert
woods
johnson.
H
I
thought
it
was
courageous
for
them
to
volunteer
to
be
part
of
this
study,
to
put
them
put
themselves
on
the
line
and
they
did
it
and
and
what
they
found
was
that
even
them
methodist
north
hospital
was
guilty
of
some
of
the
disparities
in
treatment
to
minorities
and
the
reason,
but
the
reason,
but
I
applaud
them
and
the
reason
I
applaud
them
is
because,
when
they
found
out,
they
started
fixing
those
things
that
they
found
out.
Robert
wood
johnson's.
H
That
foundation
is
a
is
a
real
incredible
foundation
in
our
country
and
and
when
they
did
that
study,
you
know
there
was
six
hospitals
across
our
state
from
shelby
county
to
hamilton
and
knox
that
participated,
and
they
found
some
things
that
they
just
didn't
realize
were
happening
and
that's
what
this
resolution
speaks
to.
H
I'm
not
saying
dr
kumar,
dr
kumar,
I
love
talking
to
you
know
that
we
had
a
good
conversation
outside
yesterday.
I'm
not
saying
that
you've
experienced
that
I'm
not
saying
that
anybody
on
this
on
this
diet
experienced
it
personally,
but
it
exists.
The
method
is
the
methodist
system
in
in
in
shelby.
County
is
one
of
the
biggest
hospital
systems
in
our
state
and
I'm
proud
of
methodist
north
hospital.
H
I
am
proud
of
them
and
I
am
proud
to
have
them
in
my
district,
but
sometimes
there
are
just
things
that
we
don't
realize
that
that
are
happening
right
up
under
our
noses,
and
until
you
know
we
we
we
see
it,
we
can't
we
don't
we
don't.
I
just
want
to
be
clear,
dr
kumar,
this
is
nothing
against
your
the
the
profession.
You
serve
a
very
noble
profession.
H
Our
colleague
robin
smith
and
other
health
care
professionals
in
here
you
do,
we
need
you,
we
need
you,
but
if
there's
a
way
for
us
to
make
it
better,
then
I
just
think
that
we
should
make
it
better
and
you
know
I'll
leave
it
up
to
the
committee.
I
I
you
know
I.
I
will
also
want
to
be
clear
with
this.
H
I
understand
that
the
original
resolution
was
kind
of
harsh
right.
They
were
kind
of
harsh.
There
was
some
stuff
about.
You
know:
law
enforcement,
but
that's
not
stuff.
I
I
decided
to
put
in
there.
I
just
sent
the
resolution
to
legal
and
legal
draft
and
that's
what
I
ran
with
you
know,
but
but
that's
why
I'm
okay
with
with
this
rewrite,
because
it
still
gets
to
the
spirit
of
what
I,
what
up?
What
I
wanted
us
to
acknowledge
or
us
to
you
know
grasp
is
that
you
know
racism
does
exist.
H
It
does
you
know,
and
we
shouldn't
be
ashamed
of
it.
I
mean
it
does
it
exists
and
you
know,
and
and
if
we
have
the
ability
to
fix
our
part
through
our
policies
and
guess
what
some
of
that
has
already
been
happening.
You
know
the
fact
that
the
governor
created
this
this
department
of
disparities
and
minority
health
headed
by
dr
kimberly
lamar.
The
governor
is
already
doing
stuff
to
work
on
this
stuff
that
we
wouldn't.
I
don't
believe
that
we
would
be
wasting
resources
if
there
wasn't
an
issue.
H
He
he's
appointed
dr
kimberly
lamar,
who
I
think
the
world
of,
and
I
thank
governor
lee
for
doing
that,
and
you
know,
because
there
is,
there
are
challenges
you
know
and
gaps
that
we
have
to
work
on
to.
You
know,
make
sure
all
of
our
tendencies
are
taken
care
of
at
their
highest
level,
and-
and
thank
you
thank
you,
mr
chair.
D
A
A
Recess
to
determine
how
we
need
to
vote
on
this,
how
the
process
would
be
if
we're
voting
up
or
down.
A
A
A
A
A
A
A
Those
voting
in
the
affirmative
we'll
be
moving
this
to
summer
study.
Those
in
the
negative
is
that
correct.
B
B
B
A
A
I
need
three
hands
for
a
roll
call
vote.
Okay,
there
is
a
roll
call
vote
for
this
clerk.
Take
the
roll
take
the
vote
yes
to
summer
study,
no,
not
summer
city.
B
B
Whitson
williams.
B
A
All
right,
the
eyes
have
it,
the
bill
goes
or
the
resolution
goes
to
summer
study.
A
Seeing
no
further
business
before
us,
we
are
adjourned.
