Description
House Elections & Campaign Finance Subcommittee - March 17, 2021 - House Hearing Room 2
A
B
Are
there
any
personal
orders
announcements
seeing
none,
let's
see
first
up,
if
there's
no
objections,
representative
darnigan
has
got
to
present
another
committee,
so
we're
going
to
call
him
out
of
order
from
three
to
one
and
see
known
hb0411
item
three
on
the
calendar
will
be
called
up.
Representative
jernigan
you'll
present
your
bill
motion
and
a
second.
C
Under
the
tennessee
freedom
of
speech
act,
political
science
can
be
put
60
days
before
a
general
election.
This
bill
would
amend
the
language
to
allow
political
signage
to
go
up
60
days
before
early
voting
starts.
I
did
consult
with
the
secretary
of
state's
office
about
the
definition
change
and,
and
they
had
no
problem
with
it.
Basically,
it's
gonna
add
about
two
weeks
to
to
when
they
can
put
signs
up
and
with
that
I'll.
Take
any
questions.
Please.
B
Representative,
this
is,
I
think,
that's
good
bill
and
I
fully
supported
it.
So
I'm
ending
my
original
bill
and
the
one
we
just
demanded
on
the
house
other
night,
but
it
doesn't
touch
the
rest
of
the
bill
correct
and
it's
just
extending
this
before
the
two-week
period
of
early
voting.
So
I
think
it's
a
good
that
we
people
should
have
a
right
to
put
their
signs
up.
Thank
you
any
any
members,
any
questions
representative
jose
claude.
C
Well,
I
think
we
all
need
the
additional
recognition,
but
you
know
it's
really
what
I
can
tell
you
what
happened?
The
constituent
called
me
and
they
they
put
their
sign
up
60
days
before
early
voting
or
who
started
and
their
hoa
continued
to
take
their
signs
down
saying
it
was
the
general
election
I
checked
with
legal
and
general
election
had
not
been.
C
The
definition
that
I've
been
touched
for
a
long
time
since,
before
early
voting
came
in
and
and
I
had
a
discussion
with
mark
over
here
and
really
the
general
election
when
the
the
polls
open
on
that
first
day
of
early
voting.
That's
when
the
general
election
starts.
C
A
D
You
I
do
think
this
is
a
good
field
misread,
but
I
don't
want
to
this:
does
not
interfere
with
the
city
laws
or
where
some
city
says
you
got
to
wait
30
days,
I
think,
before
you
put
up
a
sign
that
wouldn't
change
any
of
that,
would
it
it
would
just
it
would
just
be
out
in
the
areas
where
you
could
go
60
days,
yeah
like.
C
B
Any
other
questions
we
have
a
question:
if
seeing
no
objection
we'll
go
to
a
vote,
all
those
in
favors
of
house
bill,
4
11
say
I
oppose
nay
eyes.
Have
it
moves
on
to
full
local
chairman.
A
B
E
Thank
you,
mr
chairman,
members
of
the
committee.
This
bill
is
an
attempt
to
address
potentially
private
actors
getting
involved
in
elections
with
local
and
state
election
officials
and
potentially
opening
up
claims
to
putting
the
thumbs
on
the
scale
for
one
side
of
the
other
side.
When
it
comes
to
elections,
what
it
does
it
says:
state
election
coordinators,
commissioners,
county
election
officials
shall
only
accept
money
approved
by
federal
state
county
officials
unless,
if
it's
a
private
for
you
know
other
miniscule,
advertising
providing
a
voting
location
or
something
like
that-
that's
not
included.
E
B
And
I
believe
this
is
also
it's
not
on
here
it's.
I
believe
this
is
co-sign
co,
co-sponsored
by
majority
leader,
lamberth
williams,
myself
and
crawford
yes,
yes,
jesus
printed
before
then.
This
is,
I
believe,
this
amendment,
I'm
not
mistaken,
is
up
to
your
original
bill
is
encouraged
and
supported
by
the
secretary
states
to
address
an
issue
that
they're
favorable
with
and
supporting.
That's.
A
Thank
you
just,
mr
chairman.
I
just
wanted
to
clarify
one
thing
and
get
it
on
the
record.
You
you
were
speaking
of
financial
contributions
and
that
type
of
stuff,
but
this
also
would
it
not
include
in-kind
contributions,
not
meeting
threshold.
E
Mr
chairman,
it
is
it's,
it
says.
The
state
election
commission,
secretary
of
state
or
coordinator
of
elections
shall
not
accept
or
expend
any
grant
gift
or
funding
from
private
persons,
corporations,
organizations
or
political
parties
unless
such
acceptance
or
expenditure
is
approved
by
the
speaker
of
the
senate
and
the
speaker
of
the
house
of
representative,
and
that
also
applies
for
county
election
officials
and
administrators.
E
This
section
does
not
apply
to
election
information.
Advertising
donations
of
a
location
for
voting
purposes,
volunteer
labor
by
citizens
of
the
state
pen,
sanitizers
nominal
items,
so
trying
to
just
keep
everything
straight
above
board.
If
anybody's
going
to
be
contributing
a
bunch
of
money
to
help
conduct
election,
the
speaker
and
the
lieutenant
governor
ought
to
have
a
say.
So
in
that
and.
B
I
got
two
more
representatives
wanting
to
ask
the
question:
I'm
going
to
take
a
moment
of
personal
privilege,
and
one
thing
I
think
it
was
said
to
me
this
morning
that,
where
this
really
comes
in
handy
is
when
we're
we're
out
of
session
for
the
for
the
state
matters
the,
which
is
why
we
need
these
two
to
sign
off,
because
otherwise
no
one's
here
and
that's
been
a
problem
in
the
past.
So
to
resolve
that
issue
with
the
lieutenant
governor
secretary
of
state.
Exactly
all
right.
We
have
representative
love
next.
F
E
Was
prompted
from
news
reports
that
there
had
been
a
number
of
non-profits
formed
during
the
2020
election
and
that
they
were
engaged
in
helping
various
election
officials
in
various
states
conduct
their
elections
and
claims
arose
that
improper
influence
and
so
forth,
and
this
is
designed
to
address.
So
we
don't
have
claims
like
that,
and
if,
as
long
as
the
speaker
and
lieutenant
governor
are
on
board
with
okay
with
it,
I
think
we'll
all
be
comfortable
with
it.
So
that
was
intent
of
it.
F
Thank
you,
mr
chairman,
and
so
with
that
being
the
case,
what
is
the
procedure
for
approval
for
the
lieutenant
governor
and
speaker
to
approve
an
organization?
I
I
may
have
a
group
of
people
who
want
to
help
with
the
election
process
and
want
to
support.
So
what
is
the
process
for
that?
Yes,.
E
You,
mr
chairman,
and
thank
you
representative
love
for
that
I'll,
certainly
defer
to
legal
or
state
state
elections
coordinator.
Mr
goins,
it's
my
understanding.
If
a
local
entity
wants
to
accept
funds,
they
should
notify
the
state
elections
coordinator,
that
they
wish
to
accept
them,
and
then
they
would
pass
that
to
the
speaker
and
lieutenant
governor
for
approval.
B
Any,
if
not
more
what.
F
Was
in
your
life,
if
I
could
and
I'm
just
trying
to
get
the
threshold
for
what
approval
looks
like
what
would
be
considered
of
a
valid
organization
versus
an
invalid
one
for
approval,
and
you
may
have
me
to
ask:
maybe
someone
from
legal
or
someone
else
could
answer.
G
G
G
That's
that's,
certainly
one
option,
but
it's
implied
of
course
that
that
the
speakers
would
approve,
accept
and
approve
the
expenditures,
so
that
in
itself
isn't
to
me
as
an
applied
authority
to
act.
Pursuant
to
this
bill.
B
Yes,
representative,
griffey.
E
And
legal.
B
E
B
E
Legal's
comments
pop
something
in
in
my
mind,
because
our
secretary
of
state
is
constitutionally
in
charge
of
elections
in
tennessee.
I
would
say
that
that
approval
process
would
defer
to
our
secretary
of
state
to
set
up
whatever
approval
process
he
wants
to
do.
That's
that's
why
I
would
look
at
it
may
not
be
correct,
but
that's
the
way
I
would
look
at
it.
B
That's
your
intent,
any
other
questions
before
we
go
back
in
the
so-called
representative
shaw.
B
D
Thank
you,
and
just
to
give
you
a
breath
of
fresh
air,
I'm
gonna
vote
for
your
legislation,
so,
but
I
I
just
wanted
to
ask:
would
this
this
would
not
affect
any
way.
For
instance,
I
I
run
a
radio
station
and
there
may
be
some
candidates
that
I
want
to
support
that.
I
want
to
give
some
advertisement
to
support
them.
This
would
not
affect
that
process
in
any
way.
Would
it
say
if
I
wanted
to
support
you
and
give
you
a
hundred
commercials
to
reelect
you
with
that
this
field
affect
that
and
in
a
way.
E
D
F
F
Even
though
it's
not
a
donation
to
the
election
commission,
we
try
to
coordinate
our
efforts
with
them
to
ensure
that
when
we
have
early
voting
sites
that
it's
okay
for
us
to
bring
those
persons
by
there-
and
I
just
have
concerns-
just
want
to
make
sure
that,
when
we're
talking
about
in-kind
donations,
we're
talking
about
actually
taking
folks
to
vote
that
you're
not
going
to
be
restricting
or
have
to
get
approval
from
the
speaker
or
lieutenant
governor
for
those
type
of
events.
E
E
This
would
not
impact
that,
as
my
understanding,
of
course,
I
would
defer
to
legal,
but
that
it's
my
intent
not
to
do
anything
but
make
sure
our
elected
officials,
whether
they
be
at
the
state
or
county
level,
are
not
accepting
private
in-kind
contribution
from
anything
is
to
conduct
the
elections,
because
I
think
all
our
citizens
want
to
know
that
that
is
only
up
and
up.
It's
all
approved
government
funding.
If
it's
a
private
donation
to
assist
them,
there's
disclosure
and
the
speaker
and
the
lieutenant
governor
are
okay
with
it
all.
B
B
Seeing
no
objections,
we
are
now
voting
on
the
bill.
All
those
in
favor
say,
say:
aye,
aye
opposed,
nay
eyes
have
it.
It
goes
on
to
full
load.
Thank
you.
Thank.
B
Now
we
have
an
addendum
kind,
we
have
22
more
bills,
I'm
just
kidding
item
number
two
1251,
but
faison
has
been
taken
off
notice
and
is
there
any
other
announcements,
personal
matters
or
that
needs
come
seeing
none.
We
are
hereby
adjourned.
Thank
you.
