year

The
house
passed
it
before
the
senate,
and
so
the
senate
made
technical
corrections
and
then
that's
where
the
amendment's
coming
from.

amendment

This
is
the
bill
I
brought
before
the
body
and
here
a
few
weeks
ago
it
deals
with
a
local
issue
between
school
facilities
between
germantown
municipal
school
district
and
the
memphis
shelby
county
school
system
has
come
back
over
some
senate
with
a
with
a
little
bit
tighter
restrictions,
and
with
that,
mr
speaker,
I'm
moved
to
concur
with
the
senate
amendment
number
five
chairman.

Yeah,
first
of
all,
number
one:
they
moved
one
of
the
effective
dates
up
to
january
1
of
between
now
and
january,
1
2023,
the
next
basically
eight
months.
Both
parties
are
wide
open
to
come
together
and
have
mutual
agreement
on
how
to
resolve
this.
One
reason
they
moved
it
back
to
january,
one
instead
of
july
of
the
one
is
they
don't
want
it
to
come
back
up
here,
and
neither
do
I
they
want
the
parties
to
solve
this.
I
tried
that
last
year
didn't
quite
get
there.
So
that's
one
of
the
changes.

The
first
is
a
mutual
agreement
between
the
parties
on
their
own
terms
under
subdivision
c1,
which
is
what
I
just
referred
to
earlier.
This
is
not
only
addressed
to
the
germantown,
but
there's
another
issue
with
lucie
elementary,
and
it
takes
into
consideration
that
the
second
is
a
mandatory
agreement
for
county
leas
operating
schools
and
municipal
leas.
When
the
parties
cannot
reach
a
mutual
agreement,
it
makes
it
clear
that
the
terms
outlined
in
in
subdivision
c2ah,
a
through
h,
only
apply
to
those
humanitarian
agreements.

And,
lastly,
to
get
to
your
point,
subsection
d
establishes
that
the
title
of
all
real
property
and
fixtures
in
a
municipality
for
a
school
operated
by
county
will
immediately
vest
by
operations
of
law
to
the
municipality
by
january
july,
1
prior
to
the
start
of
the
school
year.
Immediately
following
the
creation
of
the
municipality
which
errors
later
unless
the
county,
lea
and
the
municipality
enter.

county
schools
decide
not
to

schools

their

mistaken,
the
basis
of
this
legislation
is
not
to
oper
for
one
lea
not
to
operate
in
the
boundaries
of
another
la.

purpose
of
the
property
is
to
educate
children,
and
so
what
we're
trying
to
get
at
is
to
allow
the
municipality
a
in
which
these
properties
are
located
to
to
operate
the
school
systems,
and
so,
like
I
mentioned
earlier,
when
I
was
on
the
floor,
both
parties
agree
that
the
students,
hopefully
will
continue
to
go
there.
If
that
is
their
desire
of
shelby,
county
and
germantown,
that
they
will
continue
to
go
there
if
they
opt
not
to
do
that.
That
is
something
they
can
come
to
an
agreement
between
now
and
january.

shelby
county
schools
decides,
I
want
to
keep
my
property,
but
I
will
not
operate
a
school
inside
of
your
municipality
you're
telling
me
they
still
have
to
sell
their
property
to
that
municipality,
that's
their
real
property.
Now
I
thought
this
was
about
not
operating
schools
inside
of
another
municipality.
So
this
is
really
not
about
that.
This
is
really
about
that
property.

about
school
buildings
which
belong
to
the
citizens
of
shelby
county.
All
the
citizens
of
shelby
county
have
paid
for
those
buildings
for
the
past
50
years.
What
we're
trying
to
do
is
put
the
operation
of
those

those
schools
under
the
operation
of
the
camp
of
the
lea,
in
which
they
are
geographically
bound.

so,
if
that's
the
real
issue
or
the
real
thing
that
you're
trying
to
get
to,
I
think
it
would
be
important
for
the
citizens
of
the
state
to
know
that's
what
our
real
situation
is,
because
if
I
own
property,
if
I,
if
I
own
property
or
let's
say
if
the
city
of
memphis
owns
property
in
fayette,
county
and
y'all
passed
a
law
that
says,
city
of
memphis
cannot
operate
inside
another
county's
jurisdiction.

that's
what
we
asked
last
year's
for
both
parties
to
come
together,
and
so
we
wouldn't
have
to
bring
this
bill
up
here,
but
it
didn't
happen,
and
so
now
we've
got
it
before
us
once
again
got
next
six
months
to
figure
it
out.
If
not,
then
we
put
in
this
bill
puts
in
a
restrictions
on
how
it
is
to
occur,
because
we
do
have
a
law
in
the
books
where
one
lea
cannot
operate
within
the
geographic
boundaries
of
another
lead.

yes,
if,
if
chippewa
county
schools
determines
that
they
want
to
sell
the
property
they
can,
they
can
have
they
have
that
option.
But
right
now
between
it's
got
to
be
an
agreement
between
the
two
parties,

tell
you

negotiating
13
times
in
both
parties
last
year,
they
are
they're
both
in
a
mutual
agreement.

shelby
county
decided

repurpose
this
building
for
another
purpose

another
commercial
entity

was
interested
in
purchasing

schools
controls
north
side,
high
school
they've,
repurposed
that
property
for
something
else.
That
is
not
school
related,
because
that
is
a
property
in
their
portfolio.

Essentially
it's
about
the
same
as
it
was
before
when
you
first
presented
it.
It's
just
that
now
we
have
the
time
limitations
that
clock

ticking

both
negotiations
and
then,
if
negotiations
fail,
then
only
so
much
time
before
they
have
to
be
out
of
the
buildings.

believe
it
does,

you
know
it's,
you

we
talk
about
turf
wars
and

we
can't
go
across
certain
lines
and
everything
from
bills.
But
what
we're
really
not
talking
about
is
the
fact
that
almost

300
kids
in
these
three
schools
that
we're
talking
about-
and
these
are
kids
that
live
just
really
close
to
germantown
or
a
good
number
live
actually
in
germantown
themselves-
are
basically
told
that
they
have
only
so
much
time
and
they've
got
to
clear
out
they've.

These
are
schools
that
have
been
in
existence
not
50
years,
but
over
a
century
and
they've
they've
their
schools
of
choice
that
kids
like
to
go
to
their
parents
want
them
to
go
to
it.
I've
had
parents
call
me
and,
and
a
good
portion
of
this
or
of
the
student
body
or
constituents
of
mine
and
parents
are
highly
upset
that
this
is
going
on,
and-
and
I
just
feel
that
this
and
and
this
is
not
between
shelby
county
schools
in
the
germantown
municipal
schools.

is
I've
not
been
contacted
by
them
about
this
issue,
except
to
say,
they're,
not
involved.
It's
between
the
shelby
county
schools
and
the
mayor
of
germantown
and
frankly,
when
it
comes
between
the
two.
I
think
we
should
definitely
take
the
side
of
kids
and
education
and
not
interrupt
their
education
by
sending
them
to
schools
not
of
their
choice
but
to
schools
which
they
do
not
want
to
go
to.

and
I
would
hope
that
the
the
rest
of
the
members
here
would
agree
with
me
that
students
are
more
important
than
municipal
mayors
who
simply
want
to
take
over
the
properties.
With
no
specific
thing
in
mind
at
all,
and-
and
I
would
hope
that
the
body
would
remember
that,
when
they're
voting
on
this
film.

remind
the

We've
already
had
this
discussion
a
couple
weeks
ago
when
we
voted
on
the
bill.
We
passed
the
bill,
I'm
just
now
concurring
with
the
senate
structure
and
this
one
last
thing
I
knew

motion,
my
fellow
representative
shelby
county
representative
from
shelby
county.
I
got
clarity
legal
between
now
and
july,
1
or
2023
sheppy
county
schools
is
free
to
sell
the
property
with
no
there's.
No
input
from
the
germantown
city
got
clarity,
and
with
that,
mr
speaker,
I
renew
my
motion.

our
discussions
going
forward
the
number
one
priority
has
been
the
students
that
currently
go
there,
no,
sir,
that
there
is
no
truth
at
all.
When
I
began
negotiations
with
both
parties
last
year
I
said
the
number
one
priority
is
protect.

current
students
and
both
parties
agreed
to
that.
So
no,
sir,
I
don't
want
to
go
down
that
road
with
you.

we're
already
down
that
road,
sir,
whether
you
intended
to
make
that
turn
or
not
the
fact
that
we
have
the
shelby
county
schools
and
you
know
the
history
of
the
shelby
county
schools,
memphis
city
schools,
the

different
municipal
school
systems
that
popped
up.
You
know
that
history,
you
probably
probably
also
know
the
history
of
the
federal
lawsuits
that
we
engaged
in
not
merely
the
one
that
settled
the
germantown
schools
and
the
the
shelby
county
schools
dispute.

So
the
I'm
not
imagining
what
the
the
culture
was
and
how
that
lingering
sense
of
desegregation
and
superiority
seems
to
be
part
of
not
your
intentions
but
the
intentions
of
some
of
the
leadership
of
the
germantown
school
system.
Now
there
are
some
specifics
that
I
still
don't
understand.

It
is
about
the
community
of
germantown,
we
all
believe
in
community
schools.
Even
the
memphis
chevy
county
schools
are
going
back
to
a
community
based
program.
The
community
of
germantown
would
oper
like
to
operate.
The
schools
that
are
in
their
city
simply
put
they
want
to
operate
their
schools,
they
want
to
manage
them.
They
want
to
be
able
to
cut
the
grass
when
it
needs
to
be
cut,
they
need.
They
want
to
be
able
to
take
care
of
deferred
maintenance
when
they
need
to
they
want
to
maintain
the
buildings.

Two
different
issues
on
that
we've
looked
into
that
many
times,
two,
two,
two
different
issues
and,
like
you
say
one
time,
these
were
community
schools
in
germantown,
before
memphis
city
schools
gave
up
their
charter
in
2010,
so
these
were
community
schools
in
germantown
and
then
they
no
longer
became
once
we
did
the
municipal
school
district
but
you're
bringing
up
two
different
issues.
I
wouldn't
be
before
you
necessarily
if,
if
I,
if
that
were
true.

I'm
bringing
up
an
issue
which
encompasses
all
of
the
rest
of
the
issues
the
federal
courts
take
sway
over
anything.
We
do
anything
that
the
germantown
schools
and
the
shelby
county
schools
may
do,
and
they
have
spoken
by
approving
the
agreement
that
these
schools
have,
and
I
think
you'll
agree
with
me
that
we're
doing
a
modification
of
that
court
order.

I

to
just
get
clarity
on
a
couple.
Other
things
chairman,
I
think
he
said
you
spoke
to
legal
and
they
agreed
that
the
property
rights
of
the
shelby
county
schools
couldn't
be
violated,
so
they
are
free
to
sell
that
property
to
dispose
of
that
property
in
any
way
they
see
fit
other
than
operating
it
as
a
school.

shelby
county
schools
are
free
to
lease
those
schools,
if
they
see
fit
repurpose

schools
as

fit
for
anything
other
than
serving
as

shelby
county
school
that
they
operate.

millington,
or
that
has
really
come

topic

this
we're
working
this
out
for
germantown,
but
there
is
an
issue
millington's
lucy
elementary.
They
seem
to
have
things
worked
out
on
their
end
and
I
haven't
heard
anything
from
them
that
would
indicate
otherwise,
so
they
they
can
come
to
whatever
agreement
they
want
to
in
millington
with
that
lucy
school.

Early
this
morning
I
received
a
phone
call
about
a
little
before
midnight.
Last
night,
the
ocoee
olympic
whitewater
center
was
engulfed
in
flames.
It's
a
total
loss
this
morning,
and
this
is
a
tremendous
historic
loss.
It
was
the
site
of
the,
of
course,
the
olympic
whitewater
venue
in
96
and
also
a
huge
economic
hit.
So
I
just
asked
that
you
keep
the
people
in
polk
county
in
your
thoughts
and
prayers.
