A
Can
welcome
everyone
to
the
24th
meeting
in
2019
of
the
delegated
powers
on
Law
Reform
Committee.
The
first
item
of
business
is
to
welcome
Jeremy
baltha
to
the
committee
and
invite
him
to
declare
any
relevant
interests.
No
interests.
You
talk,
you
know,
okay,
thank
you,
Germany
and
welcome.
The
next
item
of
business
is
to
propose
that
committee
takes
items
8,
9,
10,
11
and
12
into
private.
Are
we
agreed
okay
agenda
item?
A
3
were
considering
an
order
under
the
Convention
rights
compliance
Scotland
act
2001
the
order
is
the
representation
of
the
People
Act
1983
remedial
Scotland
order,
2019,
which
gave
prisoners
serving
12
months
or
less
the
right
to
vote
in
the
shetland
by-election.
No
points
have
been
raised
on
this
instrument.
So
is
the
committee
content
with
the
instrument?
A
Okay
and
the
committee
will
consider
its
draft
report
on
the
order
later
in
the
meeting
so
gender
item.
4
is
consideration
of
an
S
si
laid
under
the
European
Union
withdrawal.
That
2018
were
therefore
considering
the
scrutiny
procedure
under
which
it's
being
laid
and
the
categorization
applied
by
the
Scottish
Government.
So
we
have
the
environmental
liability,
etc.
Eu
exit
Scotland
amendment
regulations,
2019
SSI,
2019,
276,
that's
been
laid
under
the
negative
procedure
and
it's
been
categorized
as
of
low
significance.
Part
four
of
the
regulations
is
made
under
the
European
Union
withdrawal
Act.
A
This
part
makes
minor
and
technical
changes
to
address
deficiencies
in
the
environmental
liability,
Scotland
regulations,
2009
our
advisors
indicate
the
scrutiny
procedure
and
categorization
it
could
be
appropriate.
So
are
we
content
with
all
that?
Okay,
gender
item
5
were
considering
an
instrument
subject
to
the
affirmative
procedure
and
no
points
have
been
raised
on
the
draft
environmental
protection
act.
1990
amendment
Scotland
regulations
of
2019
is
the
committee
content
with
this
okay
gender
item
six
were
considering
instruments.
A
However,
the
Scottish
Government's
confirm
the
effect
of
this
instrument
is
that
the
statutory
panel
will
not
be
consulted
in
respect
to
the
first
fuel
poverty
strategy.
Instead,
they've
indicated
they
intend
to
consult
the
existing
fuel
poverty
advisory
panel
and
partnership
forum
in
the
meantime,
and
this
is
because
the
statutory
panel
won't
have
been
set
up
in
time.
Does
the
committee
wish
to
draw
this
instrument
to
the
attention
of
the
Parliament
under
the
general
reporting
ground
as
the
Scottish
fuel
poverty
advisory
panel
is
not
being
consulted
in
respect
of
the
first
fuel
poverty
strategy?
