item
2
is
to
consider
an
SSI
laid
under
the
European
Union
withdrawal
at
2018
and
we're
considering,
as
always,
the
categorization
applied
by
the
Scottish
Government,
the
draft
environment,
EU
exit
amendment,
etc.
Scotland
number
2
regulations
2019,
has
been
laid
under
the
affirmative
procedure
and
it's
been
categorized
as
of
medium
significance.

instrument
amends
a
power
to
legislate
and
the
2018
Act
requires
the
affirmative
procedure
for
such
instruments.
Accordingly,
there's
no
choice
of
scrutiny
procedure
for
the
committee
to
consider.
The
committee
is
still
asked
to
consider
the
appropriate
category
for
the
instrument.
The
purpose
of
the
draft
instrument
is
to
address
certain
deficiencies
in
Scottish
legislation
which
arise
from
the
UK's
withdrawal
from
the
EU
in
the
area
of
waste
from
the
environment.
Our
legal
advisors
indicate
that
this
instrument
would
be
more
appropriately
categorized
as
of
high
significance,
as
it
amends
a
power
to
legislate.

relation
to
a
number
of

committee's
concerns.
