A
Welcome
everyone
to
the
32nd
meeting
in
2019
of
the
delegated
powers
and
Law
Reform
Committee
first
item
of
business
is
to
propose
that
we
take
items
five
and
six
in
private
to
agree
to
that.
Okay.
Gender
item
two
is
to
consider
an
instrument
subject
to
the
affirmative
procedure.
No
points
have
been
raised
on
the
draft
environment,
EU
exit,
Scotland
amendment,
etc.
Number
two
regulations
2019,
so
is
the
committee
content
of
this
instrument.
A
Thank
you.
Gender
item
three
were
considering
instrument
subjects,
negative
procedure:
the
police,
pensions
amendment,
increased
pension
entitlement,
Scotland
regulations,
2019
SSI,
2019,
three,
eight
zero.
This
instrument
amends
the
police
pensions
regulations
1987
to
make
provision
to
ensure
continuity
of
an
affected
members.
Police
pension
at
its
current
rate,
we're
incorrect
guaranteed
minimum
pension
data
has
applied
to
the
annual
indexation
of
that
of
pension.
The
regulations
use
the
terms
HMRC
and
SP
PA
without
defining
what
these
acronyms
mean.
A
They're,
also
undefined
in
the
1987
regulations
that
are
being
amended
and
the
parent
statues
and
that's
not
in
line
with
Scottish
government
drafting
guidance
which
states
that
acronyms
nearly
always
need
the
support
of
a
definition.
So
does
the
committee
wish
to
draw
the
regulations
to
the
attention
of
the
Parliament
on
reporting
ground
H
as
the
meaning
of
the
terms
HMRC
and
SPP
a
could
be
clearer?
A
Okay.
Does
the
committee
wish
to
call
on
the
Scottish
Government
to
amend
the
1987
regulations
to
clarify
this
matter
at
the
next
available
opportunity?
Okay,
thank
you.
Next,
we've
got
the
firefighters
pension
scheme,
amendment
increased
pension
entitlement
order,
Scotland
order,
2019
SSI,
2019
381.
This
instrument
amends
the
firemen's
pension
scheme
order
1992
to
make
provision
to
continuity
of
an
of
an
affected
firefighters
pension.
At
its
current
rate,
we're
incorrect
guaranteed
minimum
pension
data
has
applied
to
the
annual
indexation
of
that
pension.
A
Also,
the
1992
order,
that's
being
amended,
all
the
parents
attitudes
so
does
the
committee
therefore
wish
to
draw
this
order
to
the
attention
of
Parliament
on
reporting
ground
H
as
the
meaning
of
the
terms
HMRC
and
SP
PA
could
be
clearer.
Thank
you
and,
as
a
committee
wish,
to
call
on
the
Scottish
Government
to
amend
the
1992
order
to
clarify
this
matter
for
the
next
available
opportunity.
A
Right,
then,
we've
got
the
firefighters
pension
and
compensation
schemes,
amendment
order,
2019,
SSI,
2019
382.
This
instrument
amends
the
firemen's
pension
scheme,
order,
1992
and
the
firefighters
compensation
scheme,
Scotland
order,
2006
to
improve
the
fairness
of
these
schemes
and
enable
the
Scottish
Fire
and
Rescue
Service
to
pay
a
higher
level
of
lump
sum.
There's
an
error
relating
to
the
consistency
of
the
retrospective
provision
made
in
article
1
3
for
consistency
in
article
1
3.
A
Article
2
should
have
retrospective
effect
from
the
1st
of
April
2007,
insofar
as
necessary
to
give
effect
to
article
3,
which
has
effect
from
that
date.
Article
2
should
also
have
retrospective
effect
from
16th
of
December
2014,
insofar
as
necessary
to
give
effect
to
article
7,
which
has
effect
from
that
date.
Furthermore,
article
9
sure
had
should
have
retrospective
effect
from
the
5th
of
December
2005,
insofar
as
necessary
to
give
effect
to
articles
10
to
12
which
have
effect
from
that
day.
A
A
A
Next
item
of
business
is
to
consider
instruments
are
not
subject
to
any
parliamentary
procedure,
so
we're
looking
at
the
planning,
Scotland
Act
2019
commencement
number
two
saving
and
transitional
provision
regulations,
2019,
SSI,
2018
377.
This
instrument
commences
three
sections
of
the
planning,
Scotland
Act
2019,
and
makes
savings
and
transitional
provision.
A
Regulation
nine
saves
the
provisions
of
section
one
four:
five
of
the
Town
and
Country
Planning
Scotland
Act
1997,
as
they
have
effect
before
20th
of
December
this
year
in
respect
of
a
planning,
contravention,
notice
served
before
that
date.
However,
these
provisions
should
instead
have
been
saved
in
respect
of
a
breach
of
condition
noticed
so
a
different
type
of
notice
served
before
that
date,
so
this
effectively
means
that
the
provision
does
not
have
the
intended
effect.
A
The
Scottish
Government
acknowledges
this
error
and
has
indicated
that
it
intends
to
bring
forward
an
amending
instrument
in
time
from
the
regulations
coming
into
force
on
the
20th
of
December.
So
does
the
committee
wish
to
draw
the
regulations
to
the
attention
of
the
Parliament
on
reporting
ground
I,
as
the
drafting
of
regulation
9
appears
to
be
defective.
