asking

legal

directed
to
appeal
this
matter,
because
the
staff
recommendation

refusal

defense,

was
deep
of
the
belief.

breaking
at
the
time

our

fence
exemption

forty
five

stall
Crescent

credence

humanitarian,
practical
security,
safety

privacy
considerations
pertaining
to
this
request.
My
interest
in
this
matter
is
both
personal
and
a
matter
of
civic
duty.
The
residents
of
45
dunst
all
have
been
upstanding
and
law-abiding
members
of
the
community
since
the
summer
of
2013.

They
purchased
the
property
not
only
for
pride
of
ownership,
but
for
well-deserved
peace
enjoyment
and
rest
as
they
are
entitled
to.
None
of
this
has
ever
been
realized
due
to
the
residents
of
43
dunst,
all
as
they
behaved
without
explanation
and
credibility
towards
the
residents
of
45
dunst,
all
rude,
vile
disgusting,
malicious
criminal
and
intent
to
harm
our
ongoing
and
appropriate
adjectives
to
describe
their
conduct.
The
construction
of
the
fence
by
the
residents
of
45,
dun
stall
has
occurred
for
many
reasons.

Multiple
acts
of
vandalism
by
the
minor
male
at
43,
dun
stall,
have
occurred
where
expensive
repairs
were
required.
The
adult
male
of
43
dun
stall,
established
the
ongoing
behavior
of
idling,
his
Dodge
Ram
pickup
truck,
sometimes
for
almost
an
hour
at
a
time.
The
company
seal
tech
Inc
is
a
commercial
business
and
illegally
operates
at
43
done
stall.
The
fence
was
also
constructed
to
prevent
commercial,
material
and
equipment
from
crossing
the
property
line
and
being
stored
at
45
done
stall.

fumes
of
the
personal
and
company
vehicles
and
the
materials
the
company
uses
have
required
the
residents
of
45
dun
stall
to
seek
medical
attention
and
to
be
confined
to
their
home.
At
times
the
fence
was
erected
to
attempt

block

fumes
from
continuing
to
seep
into
the
home
and
they
continued
to
not
be
able
to
properly
use
the
lower
level.
The
adult
male
of
43,
dun
stall
without
consent,
repeatedly,
films,
including
myself,
the
residents
and
visitors
to
45
dun
stall.

order
to
make
his
case
today,
the
male
and
female
adults
purposely
blow
leaves
shovel
snow
and
pile
of
dirt
up
against
the
fencing
in
order
to
impede
the
access
and
foot
traffic
into
the
rear
of
the
property
at
45
Dunn
stall
before
the
fence
was
constructed,
the
home
was
left
vulnerable
to
dumping
and
water
damage
arising
from
this
behavior.
Both
adults
play
excessively
loud
and
amplified
music
with
profane
racist,
violent
and
derogatory
lyrics.
The
residents
of
45
Dunn
style
are
visible
minorities
and
some
are
of
mixed
race.
This
logic
is
highly
offensive
to
them.

Due
to
the
intent
of
the
lyrics,
the
fence
was
erected
to
act
as
a
sound
barrier
to
the
noise
levels,
where
the
adult
female
of
43
dunce
tall
doesn't
just
condone
the
conduct
of
the
adult
male
she
also
engages,
and
they
use
their
minor
male
child
to
further
this
behavior.
There
are
many
more
documented
and
proven
examples
that
are
available
for
your
review.
The
city
has
a
role
to
play
in
this
matter
as
well.
Residents
in
this
neighborhood
have
been
filing
complaints
against
the
residents
of
43
Don
Stahl,
since
at
least
2007.

city
has
not
attempted
to
attempted
to
resolve
almost
the
entirety
of
these
issues,
one
of
which
is
the
current
illegal
fence
that
was
aforementioned.
As
a
result
of
this,
the
residents
of
45
done
stall
and
the
other
neighborhood
residents
were
left
to
fend
for
themselves.
So,
to
speak
of
note
to
the
city's
interest,
there's
no
financial
implication
all
costs,
or
matters
pertaining
to
45
Dunst
all
have
been
solely
borne
by
the
residents.

to
a

survey

the
applicable

division

request

was
constructed

lives
unfairly

kind

message

being

in-depth
investigation,

based

communicated

the
Mahara
Maharaj

believe
clearly
that
there

more

this

matter

the
fence
and
I
would
encourage
all
of
our
residents
to
recognize
the
nature
of
our
city.

diversity
that
exists
in
our
city,
the
opportunity
for
us
to
be
engaged
and
to
get
along
with
one
another
and
so
on.

city

country
and

want
to

encourage
people
to
get
along
quite
frankly,

we

some

in

yard
knocked

sections
of

fence
between
our

properties:

have
grandchildren.

pets
with

that
were
removed,
there's
pieces
of
shag
like
charred
wood
and
pieces
of
metal
that
were
there,
so
do
the
safety
with
working
and
in
agreement
with
my
neighbor.
We
took
down

rest
of
that
fence
with
the
intent
of
building
a
new
to
code,
proper
fence,
the
vendor.
We
tried
to
work
with
at
the
time
disappeared
on
us.
We've
tried
to
contact
multiple
vendors
to
come
in
and
restruck
this
fence.

now
at
a
point
now,
where
I
do
have
a
vendor
secured
they're
willing,
whenever
the
weather's
permitted
to
actually
rebuild
that
current
fence.
That
was
taken
down
further
from
recommendations
from
the

city.
Folks

property

gonna
take
another
step
forward
outside
of
the
fence
that
was
removed.
My
property's
surrounded
with
a
legal
chain-link
fence,

the

impact

to
the

call
center
and
an
IP
hub.

employs
over
3,000
people
and
currently
they

what
you're
seeing
in
that
picture

an
very
large
area

surface
parking

2.5
hectares,
so
the
hope
for
the
bank
obviously
is
once
the
LRT
is
in
motion
that,
as
planning
would
prefer
that
those
surface
parking
lots
will
disappear
over
time.
So
item
2.8
before
you
is
a
recommended
expansion
of
the
Golden
Mile
secondary
plan
boundary,
but
not
specifically
in
this
area.

So,
first
for
a
provincial
policy
perspective,
the
entire
Bank
property
is
within
500
metres
of
proposed
birch
mount
station,
which
makes
it
a
transit
area
under
the
growth
plan
and
the
growth
plan
directs
you
to
study
that
entire
area.

it
makes
sense
to
study
the
entire
area
in
the
plan.
Secondly,
similarly
to
other
blocks,
this
is
a
large
block,
it's
under
one
ownership
and
that's
a
key
opportunity
in
these
types
of
studies.

allows

to
look
at
a
number
of
the
items
that
were
discussed
earlier,
so
you
can
look
at
what's
the
appropriate
approach
to
park.
What's
the
appropriate
approach
to
permeability
for
the
site?
Currently,
the
site
ends
at
Civic
Road,
and
so
an
expansion
would
allow
a
better
understanding
of
how
cars
may
one
day
permeate
this
site
and,
of
course,
you
can
also
look
at
cycling,
transit,
walking
opportunities.

Another
key
objective
of
the
Golden
Mile
secondary
plan
is
to
phase
out
under
develop
surface
parking
areas,
and
you
can
see,
interestingly,
more
than
2.5
hector's,
so
not
acres
hectares
of
this
site
is
parking
and
the
majority
of
that
is
currently
not
included
in
the
plan
boundary.
So
we
believe
that
that
is
another
planning
reason
to
include
the
entire
site
and
further
the
expansion
is
keeping
in
keeping
with
planning's
rationale
for
the
current
expansion
and
for
the
study
in
general.

would
have

making
this
request
much
earlier

the
study,
but
it
is,
as
the
bank
receives
information,
sometimes
it
doesn't
get
to

right
people
in
the
right
timing,

as
soon
as

out
on
Friday
is
that
there

before

the
Golden
Mile
report,

proposal
to
expand

boundary
across
Victoria
Park
for
the
Golden
Mile
secondary
plan
study
area

North
York,

impacts
directly
now
our
clients,
development
application
outlined
in
gray,
is
the
expansion
areas.
We
have
no
concern
about
the
southern
expansion
areas
and
we
have
no
submissions
to
make
to
you
about
the
presentation
you
just
heard
from
Scotiabank
about
their
proposed
expansion.

second
point
that

wanted
to
emphasize
that
we
cover
in
our
written
submission
is
that
it's
premature
because
the
lands
are
located
outside
of
the
Scarborough
community
council
planning
area,
and
we
would
have
thought
that
there
would

extensive
consultation
with
the
person
with
the
parties
engaged.
For
example,
our
client
there's
been
no
stakeholder
consultation,
our
North
York
planner,
of
course
didn't
know
to
call
us
to
say,
oh
by
the
way
in
Scarborough
they're
thinking
of
taking
their
planning
area
and
covering
the
area
of
your
application.

far
as
we
know,
there's
no
precedent
for
this.
There's
no
other
secondary
plan
being
considered
or
have
what
was
considered
by
a
community
council
which
expands
into
the
area
of
another
community,
council
and

Think
in
parallel
or
empathy

clients,
position

say
how
would
a
member
of
this
community
council
feel
if
it,
it
was
determined
that
another
community
council
was
now
expanding
a
secondary
plan
into
their
ward
without
the
appropriate
degree
of
consultation
and
discussion.

far
as
we
know,
there's
been
none
of
that.

none
that
we've
been
engaged
in
and
I
would
say
very
simply.
This
is
not
the
way
we
do
things
in
Toronto.
There's
more
consultation
involved
before
things
like
this

proposed.

alert

fact

there's
a
waterfall
of
costs
impact
he
this
is.

client
has
a
development
application
underway.
If,
in
due
course,
the
land
is
acquired
for
a
realigned,
Road
there'll
be
a
whole
range

claims

delay,
damages
that
would

implications

not

be

requirement
as
well
to

look
at
the
realignment
of
O'connor
in

had
a

Park
and

that
well
attended
lots

asked

time
this
particular
parcel

was
not
party
to
that

south

tremendous
amount

development,
that's
being
planned
for
Scarborough
and
yet
we're
suggesting.

there

decisions

councilors
would
actually
be
sort
of
left
out
of
the
loop
at
least
that's
kind
of
how
I
see
it

to
get
this

there's
great
opportunity

us

deal

York
planning

not
the
delay

see
transportation
alignment
take
place

it

good

planning

this
have
been
done

prudent

good
judgment,

part
of
the
process
would
in
fact,
be
rather
dereliction
of
our
duties

members

this
Community
Council
and
representing
of
the
residents
of
Scarborough

I
just
wanted
to
provide
a
little
bit
of
context
of
what
the
problem
is
here
and

why
it
exists.
Fox
Ridge
Drive
is
a
residential
street,
there's
no
retail,
there's
no
industrial,
it
comprises
of
approximately
75
homes.
It
runs
east-west
between
birch,
mountain
and
Kennedy,
Road,
north
of
st.
Clair
and
south
of
Eglinton
to
the
north
of
Fox,
Ridge,
there's
three
or
four
streets
that
either
dead-end
or
they
come
back
out
onto
Fox
Ridge
and
the
whole
area
comprises
of
only
340
houses.

of
the
fact
that
this
street
is
the
only
Street
between
st.
Clair
and
Eglinton,
that
runs
directly
through
from
birch
Mount
to
Kennedy,
what
we
find
on
the
street
is
that
people
trying
to
avoid
the
traffic
on
either
Eglinton
or
Kennedy
are
using
this
as
a
as
a
through
Street.
The
speed
limits
for
T.
Being
that
it's
residential,
a
traffic
study
was
done
at
the
request
of
the
homeowners
on
Fox
Ridge.

There's
an
industrial
area
off
Comstock
which
you're
probably
all
familiar
with
it:
houses
roofers
it
houses,
landscapers,
it
houses
salvage
yards
and
we
get
all
of
the
vehicular
traffic
trucks
and
and
everything
that
utilized
the
industrial
area
coming
through
Fox
Ridge,
because
they
don't
want
to
be
stuck
in
traffic
on
either
st.
Clair
or
Eglinton
and
then
further
to
the
west
and
the
north
is
the
whole
golden
mile,
plaza
area
that
people
use
this
as
a
cut
through,
so
that
they
can
get
to
their
stores.

When
we
first
started
talking
about
the
traffic
report
and
and
the
study
and
what
we
would
find,
the
thought
was
that
perhaps
traffic
calming
could
be
done
by
not
allowing
left
or
right
turns
at
specific
time
times
of
the
day
if
it
was
a
rush
hour
problem.
But
that
didn't
seem
to
be
the
case
because
you've
got
everyday
people
working
business
in
both
the
retail
section
and
the
industrial
section
that
are
using
that
as
a
cut-through.

the
recommendation
that
I
moved,
it
will
be
moving
to
put
into
speed
humps
without
doing
what
we
normally
do
a
polling
process
to
go
through
asking
the
residents
if
they
want
that
so
you're,
confident
not
only
yourself
but
with
residents
in
the
community
that
this
measure
would
would
help
in
supportive
of
it.

course,
yeah.

what
this
in
essence
says
is:
there's
normally
a
process
to
go
through
for
traffic
calming
speed
humps
to
ask
all
the
residents,
and
this
is
saying
we're
going
to
forego
that
and
we're
actually
going
to
put
those
traffic
calming
measures
in
I'm
generally
as
a
councillor
on
Scarborough
Community
Council
have
not
been
favorable
of
speed
humps.
There
are
pros
and
cons
to
speed
humps
as
a
lot
of
my
colleagues
know,
and
there
are
certain
areas
of
the
city
that
tend
to
put
a
lot
of
speed
humps
on
their
streets.

tend
not
to
do
that
out
here
in
Scarborough
for
various
reasons
and
I've
jazz
I
said
when
community
members
come
to
me
about
looking
at
traffic
calming
measures,
I
always
look
at
every
other
opportunity
to
slow
down
traffic
and
make
communities
safer
without
putting
in
speed
humps.
This
is
different.

I've
been
a
counselor
for
eight
years,
and
I
have
been
on
well,
first
of
all,
every
street
in
in
my
old
Ward
now
my
new
Ward
had
the
opportunity
to
be
up
on
Fox
Ridge
during
the
election
around
five
o'clock,
knocking
on
doors
as
part
of
the
election
parked.
My
car
and
a
few
of
the
volunteers
who
were
canvassing
on
the
street
and
I
can
say
at
that
point.

I
was
actually
nervous
for
myself
crossing
the
street,
but
not
only
that,
but
the
volunteers,
with
the
volume
of
traffic
going
through
I,
was
also
nervous
about
having
my
car
parked.
It
was
legally
parked.
It
wasn't
illegal,
it
was
the
it
allowed
three-hour
parking
there
as
I
started,
knocking
on
the
doors
and
I.
Think
I
did
speak
with
mr.
Fullerton,
and
one
of
the
comments
was
you'd.

Better
move
your
car
fairly
quickly,
because
at
that
exact
location
where
my
car
was
there
have
been
collisions,
and
not
only
that
as
I
started
to
talk
to
the
the
residents.
I
just
saw
the
volume
of
traffic
and
not
only
volume
but
the
speed,
and,
as
mr.
Fullerton
said,
it
is
a
cut-through
between
birch,
Mount
and
Kennedy
and
a
lot
of
cars
and,
of
course,
we're
having
beginning
the
Eglinton
LRT
construction,
understanding
that
there's
going
to
be
more
infiltration
into
that
community.

aside
from
that,
the
just
the
sheer
volume
of
traffic
and
cars
and
speed
that
was
going
through
there
I
again.
When
I
had
the
conversation
first
off
I,
don't
know,
I
think
this
is,
as
I
said,
I
don't
normally
support
speed
humps,
but
this
is
the
one
consideration
that
I'm
going.
We
need
almost
to
put
speed
I'm,
seeing
here
for
the
for
the
safety
of
the
residents,
so
hopefully
I
get
support
from
my
colleagues
on
that.

Occurrence
with
residents
in
the
city
of
Toronto
in
2018,
happened
in
Scarborough
forty
six
percent,
so
people
being
hit
crossing
the
road
on
a
bike
and
so
on.
One
of
the
most
problematic
issues
that
we're
dealing
with
in
the
city
is
the
issue
around
people
and
driving
habits
and
speeding,
and
so
on.
I
was
going
to
a
school
in
my
area
late
last
year
to
respond
to
a
complaint
that
I
had
received
from
a
number
of
residents
about
people
speeding
in
and
around
the
school
area,
and
so
on.

I
happened
to
arrive
in
the
area
at
about
3
to
58.
I
know
this
because
I
was
looking
at
that
time.
In
my
car
and
I
was
driving
the
speed
limit,
which
is
40
in
that
area.
There's
someone
driving
really
close
to
me
and
proceeded
to
pass
me
in
order
to
go
about
their
business
on
looking
to
see
where
that
person
was
going.
I
know
this.

That
person
was
actually
going
to
the
school
itself,
I
believe
the
school
gets
out
a
bit
just
after
3:00
or
so,
and
they
sped
by
really
fast
to
park
at
the
school
parking
lot.
I
went
up
to
the
purse
the
vehicle
and
just
took
a
photo,
because
I
wanted
to
use
that
as
part
of
my
discussion
with
the
police
as
to
ensuring
that
we
had.

Obviously,
some
enforcement,
as
one
I
too,
have
been
one
of
those
who
have
been
not
as
strongly
in
favor
of
the
speed
bumps,
humps
and
what-have-you
because
of
the
issues
around
fire
or
ambulance
and
so
on.
And
when
you
ask
those
different
Department,
they'd
say
you
know
we're
not
really
strong
in
favor
because
of
a
variety
of
things
and
so
on,
or
even
the
snow
plowing.

But
the
problem
is:
is
that
too
many
of
our
residents
are
being
impacted
by
occurrences
with
traffic
and
some
are
getting
killed
and
so
left
to
note,
with
no
other
choice
and
I
know
that
there
are
technologies
that
can
be
utilized
to
help
us
as
we
move
forward
to
help
people
to
remind
to
slow
down
and
so
on
and
issuing
some
tickets
as
well
but
left
to
with
unchecked.
This
is
an
issue
that
is
going
to
continue
to
have
an
impact
with
the
community.

the
most
recent
election
that
passed,
many
residents
said
you
know,
I
want
to
look
at
asking
council
to
start
putting
speed
bumps
and
in
places
one
again.
It's
not
the
first
option
and
I
think
you
have
to
basically
look
at
each
situation
individually
and
so
on,
but
buttress
that
and
or
face
with
the
condition
of
the
number
of
our
residents,
who
are
being,
in
some
cases,
fatally
impacted
by
speed
and
traffic
collisions
and
so
on
and
resident
or
just
walking,
and
you
know
trying
to
get
to
where
they
need
to
go.

In
my
area
last
year
we
had
the
unfortunate
accident
on
February
the
end
of
February
to
have
a
young
fellow
killed
coming
out
of
a
school
area
behind
the
school
on
a
on
a
walkway,
and
you
certainly
a
gut
wrenching
exercise
for
the
community.
The
school
community,
the
parents,
the
elected
politicians
and
I
guess
you
can
say
was
because
of
that
that
we
moved
quickly
to
be
able
to
put
speed,
humps,
there's
a
lot
of
schools
that
are
on
major
thoroughfares,
like
cut
throughs
that
are
facing
problematic
problems.
A
I
am
presently
in
consultations
with
all
my
schools
and
all
my
parents
and
I'll
have
to
tell
you
there's
an
overwhelming
support
in
order
to
make
sure
that
we
slow
that
vehicles
down
will
show
the
traffic
down
not
only
for
the
youngsters
to
go
back
home
safe,
but
everybody
to
go
home
back
safe,
so
I
will
be
supporting
councilor
Crawford's
motion
and
urge
all
my
colleagues
as
we
move
forward
to
make
sure
that
all
our
streets,
especially
the
ones
schools,
are
safe.
Therefore
I
will
wholeheartedly
support
supporting
it.

busy
intersection
for
pedestrians,
there's

lot
of
conflicts
between
Minette
pedestrians

motor
vehicles,

the

on
the
left
hand
side
of
this
center
section.
This
is
a
very
busy
plaza,
there's
a
number
of
apartment
buildings
just
to
the
south
side
of
here.
On
the
right
side,
that's
not
shown
on
Stephenville
is
there's
a
school
Cornell,
Park
junior
public
school.

It's
when
we
probably
one
of
the
busiest
schools
I
have
in
the
area
after
school
before
there's,
there's
basketball,
there's
very
busy
green
space
playground.
There's
a
ball
hockey.
The
sports
pad
the
school
yards
is
very
well
used
for
cricket
after
school,
as
well
a
lot
of
kids
going
back
and
forth.
It's
actually
one
of
the
first
schools
in
the
area
where
we
implemented
the
school
safety
zone.

the
concern
I
have
for
bonus
is
the
fact
that
it's
a
two-lane
highway
there's
an
abundance
of
pedestrians,
there's
a
quite
a
bit
of
vehicular
traffic
and
I
mean
cars
that
are
coming
to

from
the
condos
and
the
apartments
there
and
Agincourt
mall.
But
over
the
last
four
or
five
months,
we've
seen
upwards
of
forty
eight
huge
highway
tour
buses,
utilizing
both
Bay
Mills
and
bonus.

So
it's
virtually
impossible
to
see
the
no
passing
sign,
for
example,
of
the
crosswalk
coming.
You
cannot
see
half
of
the
crosswalk
and
throughout
basically
the
whole
day
and
the
evening
these
buses
are
well,
they
don't
stop,
they
go
24
hours
and
we
have
an
abundance.
We
have
a
large
senior
citizens,
complex
shepherd
village
across
the
road.

My
concern
is
I,
don't
want
their
problem
becoming
ours
and
I
support
the
motion.
I
just
I've,
just
sort
of
seen
it
in
front
of
me
here,
I'd
like
to
see
them
banned
from
the
street,
because
bonus
is
in
fact
restricted
to
heavy
vehicles.

would
say
60%
of
the
time
they
neither
pickup
nor
drop-off
any
people
they're
just
using
it
as
a
cheap
bus
terminal,
and
it
certainly
would
be
nice
to
see
it
stop
on
bonus.

can't

best

best
way
forward
and

certainly
sympathize

would
be

total
agreement
with
the
other
streets

residential
streets.

those

mall

Avenue,

is
the

Street

people

buses
and
go
to
casino
rama
and
go
down
to
Niagara
Falls
in
order
to
go
to
the
casinos
and

they
would
go
and
stop
at
bamberg
circle,

of
steals
on

stop
at
the
McDonald's
and
they
will
continue
to
go
up
to
splendid
China,
which

on

leaf.
So
they'll
make
the
three
stops.
People
will
park,
they
will
get

we'll
go
down
to
read

casino
Rama
or
to
the

to
Ajax,
or
to
Niagara
Falls
that
has
become
very
hazardous.
These
bus
tours
bus
operators,
I
worked
with
them
and
I
said.
Please
don't
go
on
our
side
streets.

make
sure
where
you
stop.

created

at
