under
the

a
premises
license
for
a
new
restaurant,
seeking
authorization
to
sell
alcohol
and
late
night
refreshment.

been
asked
to
clarify
a
number
of
issues
and
define
the
role
of
the
licensing
authority
in
tonight's
procedures,
not
to
nice
tonight's
proceedings
clarifying
to
the
best
of
my
ability,
the
extent
of
the
licensing
authority's
power
and
what
it
can
consider.

law
requires
anyone
wishing
to
sell
alcohol
and
or
provide
regulated,
entertainment
or
late
night
refreshment
must
have
the
appropriate
authorizations
issued
under
the
licensing
act.
2003
in
this
case
a
premises
license
the
government
under
the
licensing
act.
2003
has
made
worthingborough
council
the
local
licensing
authority
and
is
charged
with
the
administration
and
enforcement
of
the
act
within
the
borough.

This
committee
and
its
officers
discharge
this
function.
This
committee
is
apolitical
and
has
extremely
clear
guidelines
set
out
in
the
legislation
as
to
what
is
relevant
to
its
decision
and
what
is
irrelevant
and
I'll
attempt
to
clarify
this.
As
I
go
through
the
report,
but
before
we
go
any
further,
I
need
to
emphasize
that
this
committee
is
not
determining
whether
a
restaurant
can
open
and
operate
at
this
site.
The
council's
planning
authorities
granted
permission
for
that
subject
to
conditions.

And
this
committee
can
only
consider
the
licensable
activity
this
rob
this
restaurant,
if
it
were
not
seeking
authorization,
would
not
require
this
committee's
approval.
For
instance,
this
restaurant
could
open
and
operate
with
bring
your
own
alcohol
and
ceasing
to
sell
hot
food
and
drink
at
11
o'clock
without
a
premises
license
of
any
sort
in
place,
and
this
wouldn't
be
referred
to
then
to
this
this
committee.

moving
on
to
this
application,
calibri
uk
limited
application
has
been
subject
to
formal
representation
by
a
responsible
authority
and
22
members
of
the
public,
and
it
therefore
falls
to
this
subcommittee
to
determine
in
section
3
of
the
report.
I've
explained
the
background
to
this
application
and,
I'm
sure
members
know
the
area,
but
in
paragraphs
3.2
and
3.4
of
this
report
I've
outlined
as
best
I
can-
the
area
where
the
restaurant
is
situated.

The
application
makes
no
mention
of
entertainment,
but
I
should
highlight
that
the
deregulation
act,
2015
and
various
pieces
of
legislation
prior
to
that
means
that
a
license
is
not
required
to
stage
a
performance
of
live
music
or
the
playing
of
recorded
music
if
it
takes
place
between
eight
o'clock
in
the
morning
and
eleven
o'clock
at
night,
and
it
takes
place
at
an
alcohol,
unlicensed
premises
and
the
audience
is
no
more
than
500
people.
But
I'd
have
emphasized
that
this
concession
granted
by
this
legislation
can
be
removed.

5
of
the
report
briefly
refers
reaffirms
our
role
here
today
and
what
members
need
to
have
regard
to
when
making
their
decision.
It
highlights
the
licensing
objectives
and
the
sections
of
the
council's
licensing
policy
that
may
be
considered
particularly
relevant,
though,
as
always,
I
must
point
out
that
the
policy
as
a
whole
must
be
considered.

made
representation
listing
a
number
of
conditions
that
they
consider
required
to
enable
this
premises
to
meet
the
licensing
objectives.
If
members

of
a
mind

grant

application
and
their
representation
is

stated,

made
representation,
and
these

all

licensing
committee's

been

to
how
much
weight,
if
any
they

of
the
points

we
can
all
agree
that
these
representations
highlight
serious
issues,
these

planning
matters,

I
must
emphasize
this
committee
should
not
be
considering

In
addition,
I've
been
informed
that
there
might
be
a
covenant
in
place
from
the
late
1800s
that,
if
enforceable,
might
stop
the
sale
of
alcohol
from
this
site.

well
aware,
the
licensing
act,
2003
encourages
mediation,
and
I
can
report
that
the
mediation
between
the
applicant
and
the
police
has
been
successful
with
the
applicant
volunteering.
A
number
of
conditions
that
sussex
police
requested-
and
I
have
listed
these
paragraph
8.2
of
the
report-
and
they
can
also
be
found
at
appendix
e.

These
would
become
enforceable
conditions
of
any
premises
license.
Members
may
be
of
a
mind
to
grant
to
go
together
with
those
that
have
volunteered
in
the
applicant's
operating
schedule
and
the
mandatory
conditions,
of
course,
and
as
a
result
of
this
sussex
police
have
withdrawn
their
their
representations.

the

the
committee's
attention
is
directed
to
the
aspects

the
act
and
this
application
that
members

consider

premises
license
at
14,
west
avenue,
but
we're
amongst
a
group
of
21.
I

address
you
on
the
breadth
and
strength
of
the
opposition
and
highlight
concerns
around
the
nuisance,
noise,
disturbance
and
criminality
that
this
application
may
cause
her,
and
indeed
all
of
us
as
neighbours
on
14
west
avenue.
Louise
is

to
speak
for
and
on
behalf
of
the
quakers.

I
have
actually
in
in
the
lead
up
to
this
presentation
red
where
worthing
borough,
council
statement
of
licensing
policy
2018
and
in
that
found
that
you
know
you,
you
do
consider
the
disturbances
impacting
on
people
living,
working
or
sleeping
in
the
vicinity
of
the
premises
and
understand
that
noise
can
not
only
arise
from
within
the
premises,
but
also
from
people
or
motor
vehicles
outside
the
premises.

Based
on
this
and
following
on
from
our
written
objection
to
the
application,
I
would
really
like
to
ask
the
licensing
officers
to
give
particular
consideration
to
the
locality
that
we
live
in
and
that,
in
particular,
in
the
context
of
creating
public
nuisance,
where
there
currently
is
none
and,
on
that
basis,
not
to
grant
a
license.

Now,
let
me
expand
a
little
bit
if
we
look
at
the
area
between
keen
road
to
the
east
and
wallace
avenue
to
the
west
of
wallace
avenue,
west
or
elm
grove
towing
road
to
the
north
and
the
seafront,
we
have
an
entirely
residential
area.
There
are
only
private
residences
there,
some
retirement
homes,
a
couple
of
nursing
homes,
there's
a
dementia
home
places
of
worship
and
a
couple
of
nurseries,
but
there
are
no
bars
or
restaurants
within
this
quadrant
of
housing.
A
I
believe
that
goes
back
to
town
planning,
which
obviously
is
not
a
matter
of
this
committee
and,
as
simon
mentioned,
the
restrictive
covenant
equally
isn't.
But
us
all
having
that
covenant
in
in
our
titles
has
made
a
huge
difference
to
the
attractiveness
of
moving
into
this
area,
because
we
knew
we
are
moving
into
a
quiet
area,
bars
and
restaurants
are
in
this
area
confined
to
certain
stretches
like
the
goring
road
parade
or
a
long
towing
road,
but
they
are
not
in
this
quadrant
that
I've
laid
out.
A
So
when
we
bought
this
property,
we
bought
it
because
we
wanted
to
be
in
a
quiet
area
and
there
hasn't
been
any
nuisance.
Anyone
who
lives
on
west
avenue
knows
that
street
lights
are
switched
off
late
in
the
sorry
in
the
evening
and
that
actually
ambient
background
noise
is
primarily
from
nature
from
girls
from
foxes
that
only
occasionally
leaves
a
cast
off
after
seven
o'clock.

I
believe
so,
if
we
imagine,
you
know
that
number
of
people
coming
and
going
drinking
eating
being
merry
in
the
hours
that
are
applied
for
that
would
sort
of
equal,
my
neighbors
having
a
party
in
their
house
and
garden
every
day
with
people
coming
and
going
now
with
also,
as
simon
already
pointed
out,
the
licenses
around
music
and
entertainment
being
relaxed
and
not
necessarily
an
extra
license
required.
Those
people
could
make
a
fair
amount
of
record
legally
and
yeah.
That
would
seriously
have
an
impact
on
on
the
environment
and
create
public
nuisance.

Where,
as
I
said
at
the
beginning,
we
really
currently
don't
have
any
you
know
take
into
consideration
what
might
happen.
You
know
people
need
to
be
passed
into
orchid
house,
because
it's
a
gated
house,
so
there
will
be
an
intercom
that
will
be
used.
The
door
at
the
moment
has
a
repeat
message
that
comes
out
say:
door,
opening
door
opening,
so
that
would
be
heard
there
would
be
cars
coming
and
going
never
mind
sort
of
cooking
smells
all
the
smells
from
people
who
are
in
the
garden
and
potentially
smoking.

So
again,
I
would
really
urge
you
to
consider
that
you
know
I'm
aware
that
a
license
for
a
restaurant
has
already
been
granted
and
I
wonder
how
that
happened
in
the
first
place.
But
that's
not
for
this
meeting.

element

aware:
we've
been
to
the
mediation
meeting
and
alex

for
inviting
us
to
it.

raised
issues

disturbance
from
noise,
traffic
deliveries

cooking
smells
nuisance
from
drinking
and
smoking
outdoors,
antisocial
behavior
as
a
result
of
people
drinking
and
potential
increase
in
crime
and
violence
in
the
local
area
as
a
result
of
alcohol
consumption.

I'd
like
to
open
by
saying
that
I
believe
that
the
applicants
have
seriously
misjudged
the
level
of
objection
to
this
proposal
from
the
local
residents.
All
neighboring
properties
and
many
in
the
street
have
raised
an
objection.
There
have
been
meetings
between
local
residents
who
have
never
met
before
this
application.

I
would
like
to
describe
west
avenue
to
those
who
are
not
immediately
familiar
with
the
location.
It's
quiet.
There
is
little
to
no
ambient
noise.
It's
true
to
say
that
mill
road
is
a
mainly
thoroughfare
into
town
and
can
be
busy
during
the
day,
but
post
rush
hour,
seven
o'clock
onwards,
there's
absolutely
nothing.
It's
very
quiet,
there's
very
little
traffic.

If
you
went
to
west
avenue
at
nine
o'clock,
you
will
not
hear
a
sound.
The
complete
is
the
street
is
completely
residential
and
many
are
in
bed
by
that
time,
due
to
the
demographic
being
young
families
and
the
more
elderly
you'll
barely
see
a
car,
let
alone
people
the
thought
of
a
bar
having
people
drinking
and
smoking
outside
at
that
hour
or
any
hour
is
opponent.

It's
totally
out
of
character
with
the
neighborhood.
Excuse
me,
it
would
irrevocably
change
the
nature
of
the
street
because
it's
so
quiet
in
west
avenue
noise
carries
more
than
another
any
other
location.
Where
there's
a
level
of
ambient
noise,
everyone
can
hear
the
slightest
thing.
There's
no
disguise
from
ambient
noise
at
all.
The
disruption
to
the
neighborhood
from
this
venue
should
take
that
fact
into
account.
Please,
as
I
said,
if
I
sit
in
the
garden
in
the
early
evening,
there's
no
background
noise.

If
there
were
six
guests
next
door,
all
down
the
street,
the
noise
would
be
intrusive
but
acceptable
because
it
would
be
it
would
not
be
a
normal
or
regular
event,
but
to
have
that
level
of
disruption.
Every
night
would
completely
change
the
place
that
we
call
home.
Our
sanctuary
would
be
violated
every
night.

I
love
living
in
my
home,
and
this
threat
has
caused
much
anxiety
and
distress
not
just
to
myself
but
to
most
within
the
neighborhood,
we'll
also
hear
from
my
neighbour
about
the
need
for
the
quaker
community
to
have
silence
and
tranquility
the
elderly.
The
young
shift
workers,
retired
residents,
bought
their
homes
in
the
full
knowledge
that
a
covenant
existed
on
our
properties.
That
clearly
stated
that
the
property
was
not
to
be
used
to
sell
alcohol
or
open
as
a
public
bar.
That
property
should
remain
residential.

It's
not
unreasonable
to
expect
that
the
law
should
be
on
our
side
and
that
our
residential
area
should
remain
intact.
The
applicants
are
in
full
knowledge
of
this
covenant,
but
still
they
power
on
the
original
planning
commission
was
granted
for
a
high
end.
Five

excuse
me
a
five
star
establishment.
The
applicants
are
now
seeking
to
undermine
that
proposal
by
opening
a
public
bar
and
take
away
until
midnight
later
on
the
eve
of
public
holiday.
They
talk
about
a
capacity
of
70
plus
drinkers
until
nine
o'clock.

What
would
that
look
like
potentially
70
people,
drinking
and
smoking
outdoors
until
nine
o'clock?
We
all
know
that
alcohol
increases
the
volume
of
voices
and
encourages
more
smoking
after
9
p.m.
Even
if
drinking
is
not
committed
outside
smoking
will
be.
If
groups
are
already
invaded,
people
will
still
be
noisy
even
if
they
leaked
a
glass
of
wine
indoors.

I
refer
to
4.29
of
your
own
licensing.
Guidelines
patrons,
may
no
longer
smoke
inside
licensed
premises
and
consequently
may
go
outside
to
smoke.
Applicants
an
existing
license
holders
are
encouraged
to
assess
whether
the
noise
from
such
patrons
could
potentially
disturb
nearby
residents
and
whether
there
is
a
potential
for
smoke
to
drift
drift
in
the
nearby
residential
properties.

There's
also
a
revision
which
I
found
in
april
218
of
the
licensing
act,
which
is
section
2.21.
If
people
do
wish
to
smoke
to
do
so
at
designated
places
on
the
premises.
Instead
of
outside
also
respecting
the
rights
of
people
to
living
nearby
to
have
a
peaceful
night,
so
can
we
request
that
they
have
a
smoking
that
they
smoke
inside
in
a
designated
area?
Should
this
license
be
granted,
which
ideally
hope
it
is
not?
Otherwise,
smokers
will
be
outside
until
the
establishment
closes.

The
reality
of
this
smoke
and
associated
noise
is
apparent
to
the
local
residents,
especially
those
adjoining,
but
the
smell
of
smoke,
and
certainly
the
noise
will
carry
beyond
those
immediate
areas.
We
are
aware
that
the
license
is
binding
for
life.
If
this
were
an
approved
application,
what
limitations
can
be
imposed
containing
their
impact,
the
impact
on
local
residents?

We
know
the
karma
bar
terran
road
was
permitted
and
a
license
in
good
faith,
probably
because
the
area
is
already
commercial
and
is
now
according
to
the
local
requests
making
the
life
of
the
local
residents
absolutely
intolerable.
One
is
quoted
as
having
to
go
for
long
drives
in
the
evening
to
escape
the
noise
and
disruption.

The
hours
requested
in
this
application
are
totally
unreasonable
and
not
in
keeping
with
the
locality
or
worthing
bower
council's
policy
of
11
o'clock,
as
the
last
license
in
hours
permissible.
The
residents
for
this
application
may
have
been
made
to
realize
the
profit
by
selling
on
the
business
has
been
developing
for
years,
and
no
actual
business
activities
happened.
Yet
this
would
be
a
reason,
easy
way
to
recoup
the
investment
they
have
made
thus
far.
We
know
that
if
the
owners
cash
in
should
the
license
be
granted
and
a
bigger
concern
take
over
will
have
no
recourse.

So
as
natalie
said,
I'm
a
quaker
attender,
and
so
I'm
representing
the
the
friends
meeting
house
so
and-
and
I'm
just
going
to
give
you
a
bit
of
a
flavor
of
why
quiet
and
silence
is,
is
so
important
to
us.
So
the
building
was
chosen
in
1958
because
it's
in
a
quiet,
residential
and
conservation
area,
so
our
quaker
worship
is
based
on
silence
and
it's
a
key
part
of
that
spiritual
worship.

it's
in
that
quietness
that
we're
communing
with
with
god
or
the
divine
our
quaker
community
activities
are
generally
carried
out
in
quietness
and
they
don't
disturb
the
neighborhood.
The
garden
is
used
for
quiet
activities
both
by
the
quaker
community
and
also
by
other
groups
such
as
the
buddhists
that
use
it
for
quiet,
walking
meditations.

Sorry,
as
it
is
ridiculous,
perhaps
most
damning
to
this
application
is
that
the
applicant
themselves
have
shown
no
consideration
of
the
specialist
location
of
14
west
avenue
and
the
proposed
conditions
that
they
could
offer
have
come
about
through
mediation
with
the
police,
but
have
not
been
offered
and
show
flagrant
disregard
for
their
for
the
surroundings,
seeking
to
use
the
gardens
until
9pm
at
night
every
night
of
the
week
and
serve
refreshments
till
midnight
or
11
pm
on
a
sunday
every
night
of
the
year,
it's
unconscionable
on
every
level
you're
going
to
hear
from
the
applicant's
agent
mention
of
letters
of
support,
and
we,
the
objectives,
make
two
very
simple
points
in
relation
to
those
one.
I
Notwithstanding
this
members
of
the
committee
as
you're,
no
doubt
aware
under
clause
6.1
of
the
licensing
policy
document,
customer
demand
is
irrelevant
and
an
entirely
relevant
consideration
for
planning
for
licensing
purposes.
Accordingly,
we
ask
you
to
give
those
letters
that
you're
going
to
be
referred
to
the
weight
that
they
clearly
deserve.
I
In
relation
to
the
application,
much
has
been
made
of
the
exclusive
pre-bookable
nature
of
this
venture.
It's
apparently
the
applicant's
entirely
unsustainable
contention
that
a
high-end
venue
cannot
cause
nuisance,
disturbance,
criminality
or
noise.
Respectfully.
I
ask
you
to
give
this
approach
to
treat
this
approach
with
the
skepticism
it
deserves.
I
I
They
will
be
party
to
enquiries
being
made
by
the
intercom
all
day,
all
times
of
the
day
and
night,
it's
further
relevant
to
the
contention
that
the
applicant
should
the
applicant
have
no
bookings
that
they
will
not
open.
It's
unclear
how
the
application,
how
the
applicant
would
manage
staffing
levels,
food
and
alcohol
delivery.
Should
this
be
true,
it's
unclear
how
commercially
viable
this
is,
but
that
is
very
much
a
matter
for
the
applicant.

A
proposal
to
open
sporadically
provides
significant
nuisance
to
neighbours
and
residents,
who
would
have
absolutely
no
idea
whether
to
expect
disturbance
or
not
on
the
basis
of
the
agent's
representations?
Seemingly
14
west
avenue
could
appear
closed
all
day,
receive
a
telephone
booking
or
inquiry
by
the
intercom
and
spring
into
life
to
admit
customers.
I
Five
minutes
later
at
10
pm
at
night,
14
west
avenue
would
also
be
subject
to
people
using
the
intercom
to
make
bookings
as
suzanne
referred
to
the
intercom
makes
a
sound
when
someone
opens

alcohol
once
they've
been
somewhere

how
the
owners
could
actually
address
this
cause
of
nuisance
when
they
plan
to
open,
sporadically
or
at
a
moment's
notice.
This
is
one
example
of
the
way
that
the
nuisance
caused
nuisance,
noise
and
disturbance
caused
to
immediate
residents
cannot
be
minimized
and
why
we
say
the
application
is
wholly
unsuitable
and
should
be
rejected.

It
should
be
noted
also
that
the
present
gates
are
going
to
it
says
in
the
application
to
be
electric.
The
entry
gates
are
manual
that
provide
access
to
the
four
car
parking
spaces
and
the
venue
itself
you
have
to
buzz
for
entry,
and
someone
physically
has
to
exit
the
building
and
come
and
open
those
gates
manually.

Presumably
someone
is
also
going
to
have
to
let
people
out
of
those
four
spaces
and
the
gates
are
manual.
So
someone
is
going
to
have
to
come
out
of
west
avenue
as
anyone
chooses
to
leave
14
west
avenue,
anyone
chooses
to
leave,
it's
surely
something
to
impact
immediate
neighbors
and
towards
disturbance,
plus
a
delay
of
people
idling
with
their
engines
while
waiting
to
come
in
or
out
of
the
spaces.

We
recognize
as
the
objectives
that
there
are
a
number
of
failings
in
the
licensing
act
2003,
and
we
recognize
that
the
consideration
of
a
new
license,
as
opposed
to
a
renewal,
is
difficult,
because
there
is
no
proof
that
disturbance
will
in
fact
be
caused,
but
the
delicate
location
of
14
west
avenue,
which
is
not
your
usual
location,
to
be
considered
for
a
premises
licence
warrants
additional
consideration
in
accordance
with
the
statement
of
licensing
policy
for
mostly
residential
areas.

It
is
staggering
to
the
objectives
that
we
find
ourselves
faced
with
these
opening
hours
that
have
been
applied
for
with
no
regard
to
the
location
and
neighbours.
But
notwithstanding
all
of
that,
there
are
some
indisputable
facts
that
we
can
agree
are
directly
relevant
to
this
application.
Consumption
of
alcohol
can
cause
noise
disruption,
antisocial,
behavior
disturbance
and
criminality.
I
Consumption
of
alcohol
lowers
inhibition
and
lowest
perception
of
volume.
The
running
of
its
of
the
premises
itself
causes
noise,
kitchen,
noise,
ventilation,
deliveries,
refuse
collections,
particularly
this
application
shows
refuge
being
able
to
be
emptied
into
outside
receptacles
up
until
10
pm
at
night.
I
At
present,
there
are
no
licensed
premises
which
can
cause
noise
disruption
and
anti-social
behavior
in
either
west
avenue
or
mill
road.
The
application
seeks
to
introduce
a
cause
of
nuisance
disruption,
noise,
criminality
to
mill,
road
and
west
avenue.
Groups
of
people
are
noisier
than
single
people
and
a
beer
garden
setting
noises
cumulative
resultant
noise
levels
rise,
considerably,
noise
travels
significantly
and
more
so
where
there
is
no
ambient
noise.
We've
heard.
We've
heard
that
already
the
property
is
situated
immediately
next
to
a
place
of
worship
for
which
silence
is
a
central
tenant
and
fundamental
foundation.
I
These
are
not
limited
to
sunday
worship
sessions
and,
as
we've
heard,
there
is
a
silent,
walking
group
in
the
quakers
garden,
which
continues
until
9pm
one,
I
believe
one
evening
a
week,
but
there
are
activities
which
continue
till
9pm
at
night,
which
is
the
same
time
as
the
applicant
hopes
to
have
people
using
their
garden
for
licensed
activities.
I
I
Many
of
the
neighbours
are
elderly
and
those
in
the
dementia
care
home,
and
indeed,
we've
heard
from
neighbours
in
westmead,
directly
opposite
14
west
avenue
that
they're
often
in
bed
by
9
pm
some
of
those
neighbors
have
living
carers
and
are
in
bed
by
9
pm,
noise
of
access
and
egressing
14
west
avenue,
as
well
as
smoking
even
after
hours
and
use
of
the
garden
will
disturb
those
elderly.
Neighbors
much
has
been
made
about
the
pre-bookable
nature
and
I've
already
set
out.
I
Why
that's
an
issue?
But
members
of
the
committee?
I
respectfully
ask
you
to
see
through
the
pre-bookable
nature.
Essentially
this
is
a
walk-up
pub.
This
is
an
application
to
open
a
pub
on
a
residential
street
next
to
a
place
of
silent
worship
and
a
dementia
home
immediately
adjacent
with
many
elderly
residents
who
go
to
bed
at
9pm
members
of
the
committee.
If
something
looks-
and
it
in
this
case
sounds
and
smells
like
a
pub,
it
is
very
probably
a
pub.
I
I
Siobhan
has
already
set
out
that
the
objectives
fear
that
this
red,
this
venture
could
be
sold
on
and
become
a
sizable
concern,
creating
significantly
more
impact
on
the
on
the
residents
of
west
avenue
and
mill.
Road
combined
objectives
ask
to
reject
the
application
in
its
entirety
in
its
entirety,
as
the
only
sensible
decision
in
this
case
sec
clause.
6.4
of
the
policy
document,
provides
you
with
the
ability
to
impose
stricter
conditions
where
properties
are
mostly
residential
as
I've
set
out.
I
These
properties
are
entirely
residential
and
with
a
significant
elderly
community
and
additional
specialities
of
the
quakers
on
the
boundary
and
the
dementia
home
in
housing
very
vulnerable
residents.
But
one
property
removed
the
objectives
believe
that
there
is
no
way
that
this
application
can
bear
legitimate
scrutiny
for
approval
either
in
the
current
form
or
at
all.

premises,

believe,
reflects
very
much
the
diversity
of
types
of
premises
now
encouraged
by
so
many
statements
of
licensing
policy
across
england
and
wales,
whereby
alcohol
will
be
offered
for
sale,
but
not
in
any
way,

maybe
defined
as
a
traditional
vertical
drinking
public
house.
I've
heard
so
many
references
to
this
premises
being
akin
to
a
pub.
It
is
nothing
like
a
public
house
that
I've
ever
come
across
and
I've
been
responsible
for
over
500
over
the
course
of
my
career.

So
the
key
points
of
difference,
if
I
may
outline
them,
are
as
follows:
one
as
you've
already
heard
admission
will
be
dependent
on
a
booking.
Now,
while
it
has
been
muted
that
bookings
could
be
placed
at
the
gates
before
the
gate
is
open.
The
intention
and
the
actuality
will
be
people
book
hours
or
even
days
in
advance,
to
choose
a
table
to
relax
and
enjoy
the
services
provided
by
the
premises.
Therefore,
people
will
be
invited
to
have
their
booking
accepted,
based
on
the
availability
of
bookings
of
tables
at
that
time.

Secondly,
customers
must
be
seated
when
consuming
alcohol.
There
will
be
no
vertical
drinking
at
this
premises,
which
is
commonplace
in
apartment,
doesn't
mean
people
drink,
while
they're
capable
of
standing
up.
It
actually
means
the
act
of
standing
while
they're
having
a
drink
so
completely
and
utterly
different
to
any
form
of
public
house
that
I've
ever
been
in
charge
of.

there's
been
talk
about
takeaways,
please
don't
be
misled
by
the
word
takeaway,
which
in
my
mind,
means
collecting
or
having
delivered
food
and
or
alcohol
to
a
place
where
one
someone
lives,
we've
already
volunteered
right
from
the
word.
Go
for
off
sales
will
be
restricted
to
existing
customers
already
on
the
premises
for
on
sales
and
in
sealed
containers.
Only
the
intention
of
this
is
someone's
having
a
meal
with
a
bottle
of
wine,
and
they,
like
the
wine
so
much
that
they
would
like
to
buy
a
bottle.
That
facility
will
be
available.

Next,
there
will
be
a
noise
management
plan
in
place
to
negate
any
risk
of
noise
nuisance.
Noise
nuisance
is
not
quite
the
same
animal
as
noise.
We
can't
all
live
in
absolute
silence.
It's
a
miracle
that
none
of
my
children
have
come
into
this
room,
while
I've
held
the
meeting
so
far
and
will
work
to
the
benefit
of
the
licensee,
but
also
to
the
benefit
of
the
residence.

So
having
a
noise
management
plan
with
a
decibel
restriction
for
background
music
within
one
meter
of
the
speakers,
controls
the
noise
output
both
indoors
and
when
permitted
outdoors,
there
will
be
a
specific
smoking
policy
in
place
restricting
the
number
of
smokers
to
a
maximum
of
four
people
at
any
one
time,
and
this
will
be
located
at
the
end
of
the
parking
area
where
there
is
a
zen
garden
before
the
seated
area
for
the
public.
So
it
will
be
quiet
and
private
for
the
smokers.

Only
four
of
them
can
congregate
at
any
one
time,
and
that
is
only
available
until
nine
o'clock
at
night.
I
personally
think
smoking
has
become
far
less
fashionable.
People
become
more
and
more
aware
that
it
is
unhealthy
and
therefore
it
is
no
longer
a
case
where
60
70
percent
of
people
visiting
our
licensed
premises
are
going
to
smoke.

At
some
point,
I
actually
checked
on
statistics
from
a
nearby
nightclub
to
where
I
live,
and
they
only
had
12
smokers
out
of
a
capacity
of
500
on
friday
night
last
week
the
numbers
were
permitted
on
the
premises.
There
is
no
specific
restriction
on
numbers
on
the
premises,
but
on
the
visits
that
I
have
made,
you
could
just
about
get
up
to
30
people
accommodated
outside
about
22
currently
but
potentially
28
in
the
two
dining
rooms,
and
there
is
a
maximum
of
six
seats
available
at
tables
in
the
bar
area.

So,
if
you
add
all
those
together,
it
could
add
up
to
70.
I
guess
we
are
of
the
minds
not
to
recommend
a
restriction
on
that
number,
because
when
you
hear
more
about
the
premises
in
the
coming
minutes,
I
think
you'll
feel
that
that
would
be
over
restrictive
on
what
is
intended
to
be
a
tranquil,
peaceful
and
pleasant
place
to
share
a
drink
friends
without
making
unnecessary
noise.

moving
on
from
those
points,
what
will
orchid
house
be?
I've
stated
as
clearly
as
I
possibly
can.
This
is
not
an
application
for
a
public
house.
It
is
an
application
for
the
sale
of
alcohol
by
retail,
on
the
premises
and
with
very
considerable
limitations
to
take
away
in
an
environment
which
is
completely
different
to
how
we
describe
most
public
houses.

right
from
the
off
that
there
will
be
no
use
of
the
garden
after
nine
o'clock

Therefore,
the
number
of
people
who

remain
on
the
premises
after
that

40.
But
I
see
this
as
predominantly
predominantly
a
daytime
premises
where
people
will
join
in
the
evening
or
stay
into
the
early
evening
when
they
want
a
meal,
sophisticated
food
with
sophisticated
wine
and
occasionally
maybe
a
bottle
beer.

that
is
their
wants,.

we
offered
was
given
brief
reference
during
the
representation.

conditions

mildly,

suggestions

the
claim
that
we
did
not
offer
a
late
an
operating
schedule
with
this
application
is
untrue.

had
over
20
voluntary
conditions
which
accompanied
the
application
and
the
changes
are
minor,
to
say
the
least.
It
took
five
minutes
maximum
of
communication
between
myself
and
alex
bell
to
wholeheartedly
agree
with
him.

We
invited
all
the
people
objected
to
the
premises
on
the
evening
of
friday.
The
1st
of
july,
I
think,
remember
the
time
was

to
8
o'clock,
but
most
stayed
till
8
30,
which
we
would
like
to
think
was
certainly
not
a
fact
that
they
won't
enjoy
themselves
in
one
degree
or
other
I
spent
about
an
hour
from
outside
and
then
asphalt
took
over
inside
of
those
six.
We
got
positive
comments
from
one
couple
and
one
single
but
weren't,
necessarily
at
the
conclusion
that
they
were
withdrawal,
but
it's
good
to
hear
that
one
has.

invited
them
for
soft
drinks,
some
food
and
literally
open
house
of
the
ground
floor
areas,
so
they
could
see
for
themselves,
and
I've
sent
some
photographs
for
the
committee
to
view
today.
So
they
can
see
exactly
what
the
premises
is
laid
out
to
be
so
just
to
conclude.
At
this
stage
we
considered
long
and
hard
whether
as
a
result
of
hearing
much
the
same
as
what
you've
heard
tonight
from
the
should
lead
to
an
offer
of
further
mediation.

As
a
result,
we've
decided
on
three
potential.

Offers
of
the
mediation
to
accompany
our
application
to
encourage
those
representations
to
withdraw
one
is
relating
to
deliveries,
and
we
propose
to
add
that
no
arrival,
reception

dispatch

deliveries
shall
take
place
other
than
between
eight
in
the
morning
and
six
in
the
evening,
and
only
monday
to
saturday
no
deliveries
on
sundays.

on
the

garden
will
be

dragging
that
back
by
one
hour
and

people
who
like
to
take
their
time
over
their
food
and
their
wine,
could
still
be
there

terminal
house
that
we've
proposed,
but
in
the
majority
of
cases

suspect
one
and
a
half
to
two
hours
would
be
more
than
enough,
and
so
we're
expecting
most
days
of
the
week.
We
will
trade,
but
we
will
be
quiet
and
closed
by
11
o'clock
at
night,
but
that's
as
far
as
we
want
to
go
at
this
stage.

but

do
hope
the
subcommittee
understand
that
this
is
a
very
different
type
of
license
application,
which
the
local
residents
perfectly
entitled
to
fear

the

the

forward

in

family

terms

high

may
be

suggest

good
value
