been
subject
to

formal
representation
by
two
responsible
authorities
and
one
member
of
the
public,
and
it
therefore

this
subcommittee
to
determine
in
section
three
of
this
report,

outlined
as
best
I
can,
the
area
where
the
premises
is
situated.

description
of
Montague
Street
and
the
surrounding
area

attached

the
area
and

of
the

you
can
see
from

the
stores,
surrounded
by
commercial
units

occupies,

a
ground
floor,
retail
unit
next
door
to
a
hot
food
takeaway
and
the
other

a
charity
shop
Montague
Street
is
is
a
busy

whilst
the
street
can
be
extremely
busy
at
times,
particularly
during
the

the
day
it
during
the
evening,
it's
fairly
quiet,
it's
a
fairly
quiet
area
being
situated
slightly
away
from
the
main
bars
and
venues
that
attract
the
majority
of
worthings
nighttime
trade.

long
held
a
premises
license
and
the
current
premises
license
is
attached
to
appendix
C.
However,
in
summary,
the
current
license
authorizes
the
sale
of
alcohol
for
consumption
off
the
premises
between
the
hours
of
0700
and
2300
hours,
Monday
Sunday
to
Wednesday
and
oh
700
hours
to
oh
100
hours
of
the
following
morning,
Thursday
to
Saturday
foreign
you'll,

to
the

As
I've
said,

the

few

application

license

authorize

extension

the
hours

alcohol
sales

the

looking
for

the
policy
are
considered
particularly

as

must
point

the
policy
as
a
whole
must
be

license

premises

meet
the

and
the
Ada
and
Worthing
council's
Environmental,
Protection
Team
made
a
number
of
comments
regarding
their
concerns
that
granting
the
extended
hours
will
never
negatively
impact
on
the
prevention
of
public
nuisance,
subjective
and
and
they
are
opposed
to
the
variation
to
24-Hour
opening
being
granted.

concerns
regarding
possible
crime
and
disorder,
anti-social,
behavior
and
public
nuisance
implications
that
can
be
associated

In
a
town
center,
the

licensing
act
encourages
mediation,
though
I
should
stress
that
it
doesn't
make
it
mandatory,
but
contrary
to
the
report
in
front
of
you,
I
can
confirm
that
mediation
between
the
applicant
and
Sussex
police
has
been
successful
and
Mr.
Yoga
fan
has
agreed
to
all
the
conditions.

Sussex
police
have
requested
being
placed
on
the
license
if
members
were
of
a
mined
Grant-
and
this
includes
conditions
regarding
digital
digital
CCTV
provision
and
alcohol
deliveries
and
and
consequently,
Sussex
police
have
withdrawn
their
representation
and
objections
to
the
variation,
a
copy
of
all
the
conditions
agreed
between
the
applicants
and
the
police.
What
was
forwarded
to
members
the
this
week
as
an
addendum
I,
don't

further
information
regarding
any
mediation
between
the
applicant
and
the
Environmental
Protection
Team
or
with
Worthing
Pub
watch
in
section
9
of
the
report.

attention
is
directed
to
the
aspects
of
the
ACT
and
this
application
that
members
should
consider
when
coming
to
a
decision,
including
the
four
statutory
licensing
objectives:
Worthing
Borough
council's
statement
of
Licensing
policy,
the
guidance
issued
by
the
Home
Secretary,
the
relevant
representations
from
all
the
parties
and
any
mediated
agreements
reached
and
listed
in
9.3
are
the
options
that
are
open
to
the
committee
when
making
their
decision
and
section
9
also
emphasizes
members
obligation
to
give
reasons
for
their
decision.

legal
implications

this
application
and
hearing
and

of
the
rights
of
appeal

the

stores
based
on
garage

one
in
Finland
Valley
that
have
24-hour
licenses.

from
that,
no
we
don't
have
any
any
stores
that
sell
24
hours

day.

mixed

There

residential
close
by
the
background
noise
at
this
location
in

middle

night,

you
can
imagine,
is
very
low,
meaning
any
noise
from
customers
arriving
or
departing
will
be
noticeable
and
could
cause
disturbance
and
therefore
public
nuisance,
as
we
as
their
statement
says,
we're
not
aware
of
any
other
convenience
store
that
operates.

we

members
now

locally

ethnicity

the

bars

are
representing
the
Town
Center
I
will
say
to
you
that
I
object
for
this
due
to
numerous
facts
is
certain
areas
during

if
granted,
a
24-hour
license
certain
roads,
such
as
Augusta
Place,
New,
Street,
Prospect,
Place,
Graham,
Road,
Buckingham,
Road
lights,
do
go
off
at
a
certain
time,
I
to
protect
any
crime
and
disorder
or
vulnerable
people.

have
serious
concerns
for
that.

to
get
home
