Description
Armagh City, Banbridge and Craigavon Borough Council Planning and Regulatory Services Committee on Wednesday 7th of December 2022 3.00pm in the Council Chamber at Craigavon Civic and Conference Centre
A
A
Okay,
we'll
move
to
Declaration
of
Interest
item
two
and
we'll
just
take
them
on
the
usual
mono,
as
we
proceeds
through
your
meeting
agenda
item
threes
report
from
the
head
of
plan,
the
immune's
going
to
bring
these
items
to
3.1
and
3.2
first
ones
for
decision
second
for
information.
So
do
you
mean
if
you
can
go
a
3.1?
Thank.
B
You
yep
thank
you,
chair
and
good
afternoon
members
members
last
month's
department
for
infrastructure
issued
a
consultation
paper
to
seek
views
on
a
proposal
to
amend
current
planning
legislation
to
provide
for
the
introduction
of
validation,
checklists
to
prevent
poor
quality
or
incomplete
applications
from
entering
the
planning
system,
members
will
recall
that
officers
have
already
piloted
with
some
success
the
use
of
validation,
checklists
on
major
applications
within
this
Council
area.
B
Currently,
many
applications
are
submitted
without
the
information
necessary
to
assess
them,
and
this
results
in
requests
for
further
information
which
delays,
processing
times
and
impacts
performance
DFI
considered.
The
introduction
of
validation
checklists
would
also
require
a
validation
dispute
mechanism.
Otherwise,
the
only
option
available
to
applicants
would
be
judicial
review
so
subject
to
members
agreement
officers
have
drafted
a
response
which
is
attached
out
of
panics
2
of
the
report,
agreeing
to
the
introduction
of
a
validation
checklist
and
that
a
standalone
dispute
mechanism
should
be
available
to
applicants.
Thank
you,
chair
and
happy
to
take
any
questions.
A
Okay,
members
have
any
questions
for.
Do
you
want
to
lose
points?
It's
like
it's
a
fairly
useful
item
in
terms
of
no,
and
if
you
know,
with
a
plan
system,
people
can
submit
things
that
aren't
complete
and
I
can
leave
officers
on
a
bit
of
a
wild
goose
test
around
a
tie
up
loose
ends
in
terms
of
information
on
that.
So
I
think
it
would
be
a
useful
Endeavor
on
our
part
just
to
try
and
streamline
that
and
and
make
it
more
efficient,
ultimately
and
Holloman
Anderson.
C
Thank
you,
Jaren.
Thank
you,
Damien.
No,
it's
just
to
come
back
yes
and
the
pine
tree
is
here
I'm
still
away
but
concerned
about
the
waliness.
Are
they
the
the
agents
and
how
far
they're,
along
with
this
here,
in
order
not
the
applications
coming
forward?
Are
they
available
in
their
a
mechanism
to
life
or
appeals,
and
things
like
that?
C
But
where
are
we
with
the
agents
here
because
they're
they're
crucial
to
this,
whether
they're
bringing
forward
all
the
information
at
that
time
and
even
up
till
now
we're
seeing
a
lot
of
stuff
coming
in
lately
and
things
may
change
at
different
times?
So
where
does
the
cell
sit
with
the
agents?
Are
there
not
crucial
again,
they
are
Tim
and
I'm
just
asking
for
this
particular
reason.
Thank
you.
C
B
Job
thanks,
chair
and
yeah.
Well,
look
I
mentioned
earlier
that
we
have
piloted
a
very
similar
Arrangement
already
within
this
Consul
area,
and
it
was.
It
was
very
much
welcomed
by
the
agents
that
we
dealt
with
because
basically
they
see
it
as
a
way
of
giving
them
a
steer
to
provide
whatever
information
is
necessary
to
get
it
through
the
system
quickly.
B
So
certainly
our
experience
has
been
a
positive
one.
I
know
it
has
been
trialed
previously
in
Belfast,
City
Council
as
well,
and
it's
been
gone.
It's
been
received.
Well,
there
are
as
I
understand
that
now
this
consultation
exercise
is
a
public
one,
and
there
are
four
reasons:
we'd
be
given
the
opportunity
to
feed
back
with
any
concerns
or
queries
that
they
might
have
about
it.
B
But
I
think
it's
to
be
welcome
because
you
know,
rather
than
an
applicant
or
an
agent,
putting
an
application
in
they're
being
selling
for
for
four
or
five
six
weeks
and
then
getting
a
response
back
by
the
way
you
need
X,
Y
and
Z
they're,
getting
told
at
the
very
headset.
This
is
what
you
need
to
go
and
provide.
So
it's
pretty
low.
It's
front
loading,
yeah,
I
feel
like
and
as
I
say,
the
experience
we've
had
to
do
it.
B
D
A
B
You
yeah,
thank
you,
sure,
members
yeah
just
to
report
that
the
number
of
planning
decisions
that
issued
during
the
month
of
November
it
was
actually
a
slightly
shorter
reporting
month
because
of
the
planning
portal.
The
new
planning
portal
coming
in
and
the
number
of
decisions
that
was
issued
was
just
short
of
150.
It
was
140
yep
and
the
number
of
applications
that
came
in
was
99,
so
the
live
case
number
at
the
moment
is
8070,
which
is
dying
almost
50
from
last
month.
So
it's
a
good
news
story.
Members.
B
You
know
the
application,
the
live
application
numbers
we're
driving
them
down
they're,
going
in
the
right
direction.
We
still
have
some
progress
to
Nick.
We
want
to
get
them
down
even
further,
and
but
we
have
certainly
had
significant
progress
since
the
start
of
the
business
year.
B
There
have
been
two
callings
over
the
month
of
November,
which
brings
the
total
number
of
colons.
Here.
It
did
to
be
a
team
and
just
a
little
bit
of
information
around
the
processing
of
major
applications.
We've
processed
eight
of
those
here
that
did
we
just
brought
in
105
Million
worth
of
investment,
and
we
currently
have
about
25
majors
in
in
the
system
at
the
moment,
but
year
to
deal
as
well.
B
Members
are
over
a
thousand
decisions
so
far
this
year
and
around
875
applications
in
so
happy
chair
to
take
any
questions
or
queries
running
down
over.
A
Okay,
this
was
one
of
the
obvious
quizzes
in
terms
of
the
portal
of
DNA.
How
do
we?
How
are
we
getting
on?
What's
that
whole
transition,
and
are
we
seeing
any
problems
or
is
it
all,
a
new
technology
can
be
remembered,
but
we're
hoping
that's
going
to
make
a
difference
and
speed
things
up
eventually.
Is
that
your
take
on
it.
B
Yeah
thanks
chair
yeah,
absolutely
the
the
you
know
in
the
medium
and
longer
term,
and
we
will
certainly
see
improvements.
I
mean
online
submissions
well
without
any
shot
of
a
data
that
will
help
to
Pro
improve
processing
times.
Look
within
AIT
system,
I
think
anyone
would
tell
you
it's
never
going
to
be
perfect
on
day
one,
and
that
certainly
was
the
case.
I
mean
there
has
been
some
issues.
B
I've
been
some
issues
around
data
transferring
across
maybe
not
going
under
the
correct
folders
system,
not
showing
up
whether
consultations
have
issued,
for
example
as
well,
and
it's
maybe
sort
of
slower
than
we
would
have
expected
at
the
moment.
But
look
we
we
did
expect
some
dealing
problems
with
it
and
we
are
having
those
but
we're
working
our
way
through
them.
B
But
when
this
system
beds
in
yeah
we'll
see
all
sorts
of
benefits
with
it,
because,
as
I
mentioned
earlier,
the
ability
to
make
online
submissions
helps
us
to
process
much
more
quickly
and
not
combined
I.
Think
with
this
validation
checklist
that
we
covered
in
the
previous
item.
I
think
they'll
pay
dividends,
we'll
start
to
see
significant
improvements
within
the
plowing
system.
A
B
A
Thank
you.
Okay.
Excuse
me,
hands-ups,
we'll
move
on
now
to
item
four
4.104.2
and
I'm
going
to
have
4.3
and
4.4,
so
we're
sort
of
split
two
first,
two
or
four
decisions.
Second
for
information,
so
it's
all
Google
4.1!
Thank
you.
E
Thank
you,
chair
and
good
afternoon
members
item.
4.1
is
a
request
for
a
name
about
housing.
Development
of
Ford,
balance
of
the
current
road
and
borderline
and
details
are
containment
appendix
one.
The
airplane's
referred
name
for
development
is
Kernan
Muse
and
the
rationale
preferred
name
is
a
development
lies
within
the
timeline
of
Kernan.
So
the
officer
of
assessment,
the
imposes
complaint
and
recommendation,
therefore,
is
for
members
approval
of
current
news,
I'm
happy
to
take
any
questions.
Members
may
have.
A
E
Thank
you
chair.
This
is
a
request
for
the
naming
of
a
Housing
Development
consistency,
84
dwellings
of
the
End
Road
in
Darlington,
and
they
maps
are
in
appendix
2..
The
Uplink
has
Preferred
name
for
development
is
in
Road
manner
and
obviously
the
main
reason
is
the
continuation
of
the
current
inroad
members
will
also
note
from
the
mountain
appendix
2
that
the
SEC
surrounds
the
new
token
Hall
saint,
that
Council
approved
back
in
June
of
this
year.
Recommendation,
therefore,
is
from
Members
approval
of
enrolled
manner,
I'm
happy
to
take
any
questions.
E
Thank
you
again
sure.
Yes,
it's
reported
to
keep
my
members
of
the
date
of
the
workload
of
the
department
over
the
first
eight
months
of
this
financial
year.
E
So
during
the
last
eight
months
we
have
received
2416
billion
regulation
applications
that
comes
with
emotional
construction
investment
value
in
the
area
of
just
under
310
million,
which
is
actually
about
60
million
more
than
we
get
normally
in
a
complete
Financial
year
we
have
carried
over
10
300
site
inspections
and
undertaken
1
612
plan
assessment
decisions,
and
they
should
all
start
to
appropriate
notices
on
these.
E
The
department
also
continues
to
deliver
the
council's
property
certificate
function
for
the
convention
of
properties
across
the
borough.
In
the
first
eight
months,
we've
received
an
administered,
2
542
new
applications
and
we've
issued
2
634
certificates
to
solicitors
and
agents
leading
to
property
sales,
making
sure
this
report
is
from
Members
information.
But
how
do
you
take
any
questions
that
members
may
have.
A
E
Thank
you
again.
Members
will
note
from
the
report
that
in
September
past
that
Council
received
an
application
for
a
dual
language
speech:
signage
in
respect
of
a
specified
Street
in
number.
Just
to
recap
for
members,
the
council's
adopted
policy
comprises
the
following
two
stages
stage:
one
is
where
an
application
module
language
should
sign
is
submitted
to
council.
E
E
The
the
names
of
the
same
the
names
are
on
the
same
petitions,
so
better
should
be
verified
on
how
to
be
verified
by
Council
officers
using
the
electrical
register
following
verification,
a
stage
one
report
will
be
presented
to
this
committee
and
the
stage
one
report
shown
four
members
about
the
application
and
whether
or
not
the
application
is
valid
under
the
policy,
and
that
report
shall
be
for
Newton
only
and
no
decision
would
be
required.
E
H
E
The
names
of
petition
occurred
was
elected
register
on
on
the
required
threshold.
Under
the
policy
has
been
met,
members
will
be
advised
at
the
application,
public
application
have
been
received
and
the
application
can
proceed
to
stage
two
at
stage
two.
Following
the
presentation
of
stage
one
do
this
committee
and
be
informed
that
the
develop
application
has
been
received.
The
council
will
then
come
as
Bank
post
all
occupancy
parameters
on
the
street
until
seek
the
views
of
on
the
application.
E
My
development
account
was
in
about
comparison
present,
a
stage
two
report
to
this
committee
stage.
Two
reports
shall
outline
the
results
of
the
calendars
and
exercise
and
if
the
required
threshold
has
been
met,
I.E
at
least
two-thirds
of
the
occupiers
of
the
premises
on
the
relevant
Street
are
in
agreement
with
the
reaction
of
fuel
lines
Spanish,
the
report
shall
include
a
recommendation
to
members
and
that
stage
members
will
be
required
to
make
a
decision
based
on
the
information
on
the
stage
to
report
as
to
whether
or
not
the
application
should
be
approved
or
refused.
E
E
Remember
this
report
is
for
noting
but
I'm
happy
to
take
any
questions
that
members
may
have.
Thank
you.
A
To
tell
you
when
the
confidential,
so
if
I
could
seek
a
proposal
under
agenda
item
five
to
move
into
confidential
items
other
than
Anderson
Mr
mcgillons.
Thank
you.
So
I
have
to
read
the
following
statement:
members
and
online
viewers.
In
accordance
with
scheduled
sex
of
the
Local
Government
Act
exam
information.
We
will
now
be
moving
into
a
confidential
session
of
the
kind.
So
this
means
that
we
were
turning
off
the
public
feed
of
the
meeting.
This
will
be
referred
when
the
meeting
is
restarted.
Can
I
ask
the
ICT
officer?
A
A
B
Yeah,
thank
you
sure.
Members
DFI
has
written
to
all
councils
to
advise
that
Dera
department
for
agriculture
has
declared
and
the
Avian
Influenza
prevention
Zone
across
Northern
Ireland
in
respect
of
all
poultry
and
captive
birds
from
20th
of
November
of
this
year,
from
that
the
birds
will
be
required
to
be
kept
indoors,
except
in
specific
situations.
The
purpose
of
the
letter
from
DFI
is
to
remind
planning
authorities
that
permitted
development
rights.
I.E
no
need
for
planning
permission
exists
which
permit
the
erection
of
buildings
necessary
for
housing,
poetry
to
protect
them.
B
At
this
time
you
will
see
there
are
conditions
around
this
in
terms
of,
for
example,
notifying
the
council
before
commencing
development
and
regarding
removal
once
the
need
for
it
has.
It
ended,
happy
to
take
any
questions
or
queries
around
any
of
that
sure.
Thank
you,
foreign.
A
The
lay
feed
started.
Thank
you.
Okay,
we'll
move
to
Indiana
item
six,
so
under
the
through
the
part
to
read
the
following
statement.
Members
of
the
public
are
advised
that
the
planning
and
Regulatory
Services
committee
is
being
held
in
the
council
chamber
in
craigavon
Civic
Center
every
two
to
covered
restrictions.
The
number
of
persons
who
can
physically
be
facilitated
in
the
chamber
is
severely
limited.
A
As
a
result,
members
of
the
public
are
only
able
to
view
the
meeting
on
YouTube
and
anyone
wishing
to
address
the
committee
has
been
invaded
in
the
first
instance
as
an
attendee
via
Zoom
audio
recording
is
being
used
to
assess
and
preparing
the
formal
minutes.
Therefore,
anyone
participated
in
the
meeting
consensus
to
it
being
recorded
and
being
live
streamed.
Also
during
the
course
of
this,
many
questions
may
be
asked
by
County
solution.
A
Your
members
of
the
planning
and
Regulatory
Services
Committee
of
planning
officers,
Republicans
for
planning
permission,
objectors
or
those
speaking
on
their
behalf
and
doing
so
counselors
and
divert
theosity
and
the
information,
if
they
feel,
is
necessary
to
enable
them
to
determine
the
application.
If
our
members
of
the
public
should
know
the
counselors
will
not
reach
the
conclusion
as
to
whether
an
application
should
be
approved
refused
or
deferred
until
it
will
be
at
on
the
application
has
concluded.
A
Okay
members
removed
T
in
the
next
item
number
one
and
which
application
earlier.
We
have
2021
007
AF
Russian's
got
to
bring
this
plan
on
report,
but
as
chair
I'm,
going
to,
if
I
keep
my
chair
at
this
point,
because
it
wasn't
present
for
the
first
here
or
the
second
hearing
of
the
application
due
to
being
on
holidays
and
rather
be
in
a
position
when
commenting
on
an
obligation
to
be
more
informed.
C
C
D
D
Marriage
will
be
aware
that
there
have
been
a
number
of
reports
in
this
application,
given
the
complexity
of
the
issues
on
the
unusual
and
exceptional
circumstances
on
this
occasion
redeem
it
appropriate
for
the
applicant
to
make
a
further
submission
on
this
application.
So
Mr
Brown
Martin
is
going
to
make
a
representing

So
you
have
three

exactly

Whenever

Mr

G
G
It
considers
that
it
was
okay
to
force
an
applicant
to
make
significant
changes
to
what
was
a
perfectly
valid
planning
application
on
pain
of
having
it
returned
to
him.
If
he
refused,
that
may
be
the
same
legal
advice
that
considers
it
okay
to
do
that
on
little
more
than
an
Unwritten
when
that
is
contrary
to

G
Now
maybe
the
same
legal
advice
considers
that
all
care
for
the
planners
to
insist
on
including
a
change
of
host
tape
in
the
application
when
there
is
no
change
of
host
tape
involved.
G
That
may
also
be
the
same
regular
advice
that
members
have
now
been
given
with
a
report
and
to
which
the
applicant
has
been
denied
access
advice
which
hides
seeks

privileged.
These
are
not
the
actions
of
a
fair
and
open
process
or
of
a
competent
Authority.
They
are
unjustifiable.
Irrational
and
unlawful
enforcement
is
discussed
on
page
five
of
the
third
addendum,
but
there
is
no
explanation
as
to
what
rational
enforcement
action.
D
Sorry,
Mr
Martin
your
times
office
I've
had
your
three
minutes
to
any
member
wish
to
ask
questions
of
Mr
Martin
in
relation
to
so.
G
G
I.
Think
that's
what
is
said
in
the
report
to
the
committee.
The
issue
is:
has
a
carrying
out
of
that
work
rendered
continuing
it
illegal.
G
Clearly
says
that
if
you
cannot
take
rational
enforcement
action,
then
the
work
completed
and
the
works
to
be
continued
are
lawful.
Implementation
of
the
original
planning
permission.
So
the
question
really
is
what
rational
enforcement
action
if
the
planner's
field
could
be
taken,
but
I
I,
don't
say
that
anywhere
explained.
D
H
Thank
you,
Char
The
Works
that
have
been
carried
out
to
date
were
carried
out
in
breach
of
condition.
Seven
so
condition
seven,
which
is
a
pre-commercement
condition
that
went
to
the
heart
of
the
position,
was
not
complied
with
when
those
Works
were
carried
out.
However,
the
works
that
have
been
carried
out
today
had
happened.
There
are
more
than
five
years.
They
are
now
lawful
through
the
passage
of
time,
so
we
cannot
take
any
action
against
those
works
that
are
there.
However,
the
permission
has
not
expired.
H
D
So,
thank
you
very
much.
Russian
Mr
Mark,
just
another
question
for
yourself
in
relation
to
the
Kia
stock,
could
you
specify
which
here's
law
that
you're,
referring
to,
like
particular
cases,.
G
Well,
the
case
law
that
I
can
refer
to
German,
which
is
relevant
to
what
the
Samos
just
said.
It's
on
page
three
of
the
third
addendum
there's
a
quotation
there,
which
I
made
at
the
original
council
meeting
in
August
and
what
it
says
is
we're.
Enforcement
action
is
no
longer
possible
either
because
the
time
limit
for
taking
enforcement
has
expired
or
because
it
would
be
irrational
and
therefore
unlawful,
to
take
enforcement
action.
The
planning
permission
is
to
be
viewed
as
having
been
lawfully
implemented.
G
Despite
the
fact
not,
the
operations
may
have
been
convinced,
commenced
and
breached
of
a
condition.
That
is
a
negative
condition.
So
the
the
the
point
is:
how
would
it
be
rational
to
take
enforcement
action
on
what
action
would
that
be
and
that
question
still
hasn't
been
answered
and
a
few
lines
down?
G
The
council's
report
also
endorses
night
view
where
it
refers
to
justice,
Ashley
and
the
Hamilton
case,
and
that
confirms
exactly
what
I've
what
I
just
said.
So
the
question
which
needs
to
be
asked
of
the
planners
is
what
rational
enforcement
action
could
be
taken.
D

we

very
happy
to

any
questions.
Okay,
thank.
G
A
D
Thanks
very
much
chair,
okay,
let's
just
a
question
about
what
are
the
conditions
conditional
level,
all
hdvs,
forklift
products
and
other
vehicles
associated
with
other
servicing
development,
hereby
permitted
shall
be
fitted
with
Broadband,
audible
alarms,
I'm
a
bit
of
a
technophobe.
But
can
you
tell
me
what
the
purpose
of
these
is
is
to
meet
the
sound
of
them?
Is
it
a
muffler
on
them
or
what
the
purpose
is
I'm,
just
I'm
just
curious
and
interested
as
the
how
the
work
thanks
sure.
K
Yeah,
so
from
research
I
would
have
carried
out
on
that
type
of
system.
Instead
of
the
normal
people,
often
Laurie,
it
would
be
like
a
white
noise
that
is
a
mirror,
and
research
would
show
that
that's
actually
safer
for
the
people
on
on
the
site,
but
also
then
for
a
neighborhood
properties
or
other
other
people.
The
impact
on
it
actually
is
a
lot
less
than
than
the
beeping,
so
that
that
would
be
a
betterment
than
having
the
the
beeping
a
system
on
any
of
those
vehicles.
C
Thank
you
chair
and
thanks
Kate
for
that
presentation.
No
we're
just
following
on.
Maybe
on
the
theme
of
noise
levels.
C
Note
in
the
report
an
environmental
health
had
carried
out
noise
assessments
at
various
times
on
it
was
40
to
42
I,
think
it
was
on
50
decibels
from
7am
to
7pm,
I,
think
I'm
getting
the
times
right
here,
no
I'm
just
wondering,
and
it
states
that
those
levels
would
indicate
that
they're
they're
pretty
low
and
I'm,
not
one
for
No
One
the
decibels
here,
but
maybe
we
could
just.
Let
me
seek
for
clarification.
C
The
the
noise
level
there
on
is
there
a
that's,
an
acoustic
fence
or
what
is
going
on
there?
Okay,
on
Landscaping
as
well.
C
Maybe
just
give
me
some
clarification
on
those
three
points
and
that
the
noise
levels
will
not
be
a
detriment
to
to
the
barn,
View
House
care
home,
one
other
ones
around
that
particular
area
just
for
some
clarifications.
Actually.
K
Yeah,
so
just
in
terms
of
the
noise
levels,
then
hey
yeah,
so
the
background
noise
levels
were
calculated
between
seven
a.m,
7
pm
to
be
50
decibels
and
then
between
7
pm
and
11
P.M
to
be
42
decibels.
So
the
dominant
noise
Source
at
the
moment
that
that
site
would
be
the
traffic
generated
from
the
8
from
the
A1.
So
whenever
the
rate
was
then
applied
of
what
the
impact
of
this
development
would
be
on,
the
Residential,
Properties
I
think
the.
K
If
impact
was
in
right
in
the
mid
mid
sort
of
30s
on
most
of
the
residential
receptors
so
as
below
the
the
background
noise
level.
So
from
that,
then,
from
the
very
standard
they
determined
the
impact
to
be
to
be
low
on
development
or
sorry
on
the
residential
receptors,
a
yeah
as
As
Nice,
and
then
there
is
an
acoustic
fence
that
is
proposed.
It's
not
included
on
the
plan,
so
we
have
that
as
a
condition
where
those
details
would
be
submitted
today.
K
After
you
know,
if
the
application
was
approved
and
then
be
brought
back
to
committee,
if
the
committee
approved
application
to
agree
those
details
at
that
stage,.
C
Thanks
Kyle,
no
just
on
on
the
back
of
that,
when
the
acoustic
fences
is
put
in
position,
will
there
be
levels
taken
then
by
the
environmental
Department
to
see
what
the
actual
levels
are
and
I
know
that
maybe
the
background
from
the
from
their
the
road,
where
Megan
I
don't
care
about
the
the
lesson
what
the
traffic
assessment
would
be,
so
just
from
my
own
information,
would
there
be
another
test
done
with
not
acoustic
fence
in
position
on
it's
an
as
in
place
before
the
development
begins?
Is
that
right?
Thank
you.
K
Yeah,
so
in
terms
of
the
acoustic
fan
set,
it
has
to
be
constructed.
We
had
prior
to
the
use
commencement
on
the
site
in
terms
of
any
levels
in
Tech
and
by
the
Environmental
Health
Department.
After
that
it
there
wouldn't
I,
don't
believe
it
would.
It
would
be
the
case
that
they
would
be
taken,
but
indeed,
if
there
was
an
issue
with
noise
or
a
noise
complaint
at
that
stage,
I'm
sure
then
Environmental
Health
Department
would
would
investigate
that.
J
D
Thank
you,
church
I've,
just
two
questions,
and
it's
just
one
for
Kelly
I
know
he
maybe
highlighted
it
in
the
report.
Taylor
terms
is
a
fallback
position.
You
know
from
Reading
report
thankful
that
the
argument
he
reduces
the
betterment
on
your
opinion.
Would
this
be
a
betterment
in
terms
of
the
application
in
terms
of
closeness.
He
did
give
us
a
Nightline
in
terms
of
the
separation
distances,
so
just
be
interested
and
and
just
yeah
he's
not
out
a
little
bit
more
and
also
just
one
for
the
the
applicant
chair.
D
D
K
It
also
had
parking
areas
adjacent
to
that
as
well,
so
there
wouldn't
just
be
potentially
Disturbed
from
those
buildings,
but
then
obviously
people
come
in
tune
from
from
the
building,
which
would
be
significantly
greater
numbers
than
what
are
proposed
here.
If
you
take,
for
example,
the
main
car
park
is
to
be
formalized
within
this
application
and
it's
the
main
car
park
is
set
back
well
away
in
Access
from
them,
albeit
there
will
be
some
STP
parking
closer,
but
definitely
not
as
close
as
was
proposed.
An
accident
approval.
A
J
I
need
to
be
all
muted
to
you.
Can
you
hear
me
yeah.
J
Well,
we
have
Trevor
Higgins
here,
representative
of
the
applicant
and
Travis
Mr.
Higgins
is
aware
of
the
conditions
and
it's
my
understanding
that
they're
acceptable
to
Mr
Higgins,
so
perhaps
Mr
Higgins
might
be,
might
want
the
the
champion
and
just
confirm
that.
But
that's
my
understanding.
A
D
Thank
you,
chair,
I,
think
you
know.
Cags
gave
us
a
very
comprehensive
report
on
that
on
all
sorts
of
questions
in
relation
to
the
the
noise
at
Alderman
Alderson
hot
answered,
I'd
asked
how
to
thank
you
overall.
You
know
this
news
came
it's
this
case.
My
date
is
the
betterment
to
what
could
be
put
there.
So
you
know
I
reminded
to
approve
the
application,
just
method,
sure.
C
Thank
you,
chair
and
I'm
happy
with
the
responses,
and
the
issues
that
were
released
here
on
the
us
has
already
been
said
with
the

so
I
have
a

to

We

L
In
this
respect,
Dura
have
advised
that
the
farm
business
has
been
in
existence
for
six
years
and
that
the
farm
business
is
currently
active
category
a
has
been
satisfied
in
terms
of
category
B,
new
dwellings
or
development
opportunities
out
with
settlement
limits
have
been
sold
off
from
the
farm
holding
within
10
years
of
the
date
of
the
application.
In
this
respect,
officers
undertook
an
assessment
of
the
planet.
History
of
the
farm
schema
I've,
not
identified
any
dwellings
or
development
opportunities
sold
off.
So
in
that
respect,
Criterion
B
has
been
started.
L
Faith
in
relation
secretary
and
C
officers.
Consider
the
dwelling
associate
of
farm
buildings
situated
to
the
north
of
36.
Point
Road
are
part
of
an
active
and
established
Farm
business.
This
grouping
of
buildings
forms
a
substantial
backdrop
to
the
proposed
site
and
when
viewed
in
a
Northern
direction
from
the
access
Liam
we're
almost
there's
a
Content
that
the
citing
of
the
proposed
dwelling
can
be
visually
linked
to
the
existing
group
of
foreign
buildings,
subject
to
a
sailing
condition.
So,
therefore,
The
Proposal
complies
with
policy.
L
Ct
weighed
him
on
the
principle
of
development
is
acceptable
in
terms
of
design
integration
and
layout.
You'll
know
that
this
is
an
outline
Plumbing
application
and
that
officers
consider
that
a
dwell
in
with
a
rich
head
of
not
good
in
6.5
meters
would
suitably
integrate
into
this
real
landscape
as
the
mature
hairdrel
along
the
side,
boundaries
provide
a
suitable
degree
of
enclosure.
L
Full
sailing
condition
for
the
dwelling
is
also
adjacent
to
exist
in
agricultural
buildings
and
provide
a
backdrop
from
critical
views
that
are
restricted
to
a
side
checked
section
of
the
Liam
way.
Officers
consider
that
the
proposed
side
in
division,
redhead
restriction
that
the
say
could
provide
a
suitable
degree
of
enclosure
for
our
dwelling
when
concerning
the
Topography
of
the
state
and
the
surrounding
lands.
So,
therefore,
is
considered
the
proposed
development
in
place
for
the
spps
policy,
cty
10,
13,
14
of
pps21
terms
of
traffic
and
parking
considerations.
L
Again,
this
is
an
outline
application,
so
you
can
approval
principle
only.
However,
there
was
an
indicative
layout,
provided
that
indicates
a
new
access
onto
a
privately
and
where
to
serve
the
proposed
dwelling.
The
private
laneway
then
connects
onto
the
point
ruled
policy,
emp2
or
pps3
status
of
planning.
Permission
will
only
be
granted
for
a
development
proposal
involving
direct
access
or
intensification
of
useful
and
existing
access
onto
public
road,
where
certain
accessible,
not
Prejudice,
ruled
safety.
In
that
respect,
DFA
rules
were
consulted
in
relation
to
the
proposal.
L
I'm
advised
the
Admiral
objections,
so
the
officers
are
therefore
satisfied
that
the
development
will
not
Prejudice
through
its
safety
and
is
fully
compliant
with
amp2
and
amp7
or
pps3
in
terms
of
impact
and
residential
immunity.
The
only
residents
will
probably
increase
book.
Somebody
to
this
site
is
number
36.
Point
Road,
which
is
owned
by
the
applicant,
is
considered
that
the
proposal
would
not
have
an
adverse
impact
on
the
immunity
of
the
residents
of
property.
L
Considering
the
separation
distance
created
about
a
site
and
condition
on
the
introduced,
introduction
of
appropriate
landscape
and
plant
and
scheme
Environmental
Health
Department
were
consulted
in
relation
to
an
assessment
of
the
residence
and
Immunity
Associated,
opposed
to
Allen
being
located
in
close
proximity
to
exist
in
farm
buildings.
Environmental
health
note
that
enthusiasm
business
is
within
the
control
of
the
applicant
and
of
no
objection
in
principle
subject
to
suggested
informatives.
L
L
That's
the
view
of
the
existing
dwelling.
Let's
just
look
here
beside
the
farm
buildings,
okay,
so
this
is
the
view
of
the
access
point,
you'll
notice,
a
very,
very
long,
limware
and
I
say
it's
actually
hidden
from
public
view
from
the
Vantage
points
along
the
the
main
road.
So
it's
basically
over
the
hill
and
behind
the
red
stop
there,
so
you
can't
actually
see
the
side
from
the
main
road.
A
Thank
you,
Liam
yeah,
a
written
report
has
been
received
from
John
Coles,
which
I
think
is
included
in
or
addendum
switch
has
been
circulated
and
bombers
will
take
any
queries
or
questions.
You
have
on
this
one
to
Liam.
A
I
suppose,
just
for
our
purposes
of
the
meeting,
the
a
lot
of
third-party
representations
have
been
made
on
this
one,
but
I
know
they're,
focusing
on
matters
that
are
ultimately
I'd
say
to
the
control
of
of
plan
and
there's
not
a
lot.
We
can
do
about
those
those
issues
and
but
the
half
I
suppose
being
fully
addressed.
Was
communication
sent
back
to
the
objectors
on
those
various
points
that
they're
made
aware
of
our
position
in
terms
of
the
likes
of
those
civil
issues
that
are
that
are
beyond
the
scope
of
our
committee.
Land,
foreign.
L
Yes,
sir,
essentially
the
the
first
when
the
application
first
came
into
us,
the
the
notice
wasn't
served
correctly.
The
named
individual
wasn't
right,
so
we
went
back
and
we
got
that
served
correctly
with
the
the
revised
address
pointers
sort
of
a
contestation
over
the
the
address
of
the
named
individual.
Who
was
the
landowner
so
yeah
that
was
all
tidied
up,
and
there
has
been
various
pieces
of
Correspondence
between
officers
and
the
the
objectives
and
we're
now
content
that
we
have
resolved
those.
A
G
A
I
Thank
you
chair
and
thanks
for
the
planners
for
the
presentation
there
again
I've
read
through
this
carefully
and
be
inclined
to
thank
that
that
is
approval
as
a
cracked,
the
session
in
this
case
again,
this
is
an
outline
application
for
so
therefore,
accessor
agents
will
come
at
a
later
stage,
but
I
think
in
terms
of
a
dwelling,
a
domestic
dwell
on
a
on
a
farm
site.
I
It's
it's
in
beside
the
cluster
of
the
other
dwellings
are
and
there's
talk,
title
as
Liam
said,
with
regards
to
the
log
in
the
anyway,
so
I
think
the
recommendation
and
security
was
a
correct
one.
A
There
are
also
any
alert,
know
points,
numbers
or
positions
on
this:
one:
okay,
I'll
move
to
decision
and
Stage
and
I'm
happy
enough
to
propose
this
one
yeah
I
feel
as
as.
Okay,
sorry,
I,
really
sad.
Flowers
have
well
certainly
give
it
a
fur
here
and
in
that
regard,
yeah.
Okay,
so
Lottery
your
hands
up,
yeah.
A
M
It's
been
presented
to
committee
because
the
applicant
is
related
to
your
planning
member
of
the
planning
team,
firstly
of
a
suggested
amendment
to
condition
five
which
I
just
like
to
outline
and
and
I'd
like
the
condition
to
read
in
accordance
with
drawing
number
o2a
received
on
the
6th
of
September
2022.
The
existing
natural
screening
of
the
site
to
the
Western
northern
and
southern
boundaries
shall
be
retained
at
a
minimum
height
of
1.8
meters
during
the
first
available
planting
season.
M
After
the
occupation
of
the
dwelling,
a
native
species
Hedgerow
and
trees
shall
be
planted
at
the
Eastern
rear
boundary
and
to
the
rear
of
the
visibility
space
and
retained
at
a
minimum
height
of
1.8
meters,
unless,
unless
sorry,
unless
necessary,
to
prevent
danger
to
the
public,
in
which
a
case
in
which
case
I
feel
ex
explanation
shall
be
given
to
the
counsel
in
writing.
Within
14
days,
all
Landscaping
shall
be
retained
to
perpetuity
and
the
reasons
to
remain
the
same.
M
The
main
principle
of
development
here
focuses
on
cty,
eight
foreign
and
Phil
dwelling,
and
the
full
consideration
is
set
out
in
the
planning
report.
The
site
is
considered
by
officers
to
be
a
small
Gap
within
a
built-up
frontage
number,
four,
six
and
eight
other
buildings
which
surround
this
Gap.
There's
no
there's
no
impact
on
natural
or
built
Heritage.
There's
no
concerns
regarding
access
and
parking
and
then
not,
and
it
will
not
result
in
a
detrimental
impact
on
residential
immunity
officers.
Consider
the
design
and
materials
are
sympathetic
to
the
rural
area.
M
M
Thank
you.
This
is
the
location
of
the
site
which
you
can
see
is
just
I.
Take
the
settlement
of
and
more
next
slide.
Please,
and
you
can
see
a
view
of
the
site,
you
can
actually
see
number
four,
six
and
eight
and
how
this
site
just
fits
really
in
a
very
similar
way
to
what
is
already
along
that
road
in
terms
of
complying
with
the
requirements
for
infill
policy.
Next
slide,
please.
M
This
is
a
site
location
plan.
Next
slide,
please!
This
is
plan.
This
is
full
application,
so
the
layout
and
the
elevations
and
plans
were
all
submitted
next
slide.
Please.
This
is
their
front.
Andrea
elevation
of
the
dwelling
proposed
next
slide.
Please
proposed
side
elevations
next
slide.
Please,
and
this
is
the
floor
plan.
It's
a
single
story.
Next
slide,
please.
M
This
is
a
garage
plan
for
the
site
next
slide
place.
So
this
is
the
site.
You
can
see
the
site
of
number
six.
This
light
does
rise
from
the
road
so-
and
this
is
just
a
VR
ventured
from
the
roadside
next
slide.
Please.
M
This
is
the
view,
then,
from
Norris
looking
South
towards
the
site
along
that
Frontage.
There's
a
number
of
entrances
to
each
of
those
properties
next
slide.
Please-
and
this
is
a
slide
then
from
further
south
like
a
north,
you
can't
actually
see
number
four
it's
behind
the
Hedge,
but
you
can
see
clearly
number
six
and
number
eight
and
the
Gap
then
next
slide.
Please.
M
This
is
a
view
of
the
site,
then
from
the
Marsh
Road,
which
is
I,
wrote
just
across
from
just
further
west
next
slide.
Please.
M
This
is
the
view,
then,
from
the
roadside.
It
just
shows
us
an
existing
hedge
draw
along
there,
and
a
lot
of
that
hedger
has
been
retained
as
part
of
this
of
the
details
of
this
application.
Next
slide,
please
that's
number
eight
Gary
gavard
Road,
so
you
can
see
that
the
dwellings
actually
number
four
six
Andy
are
all
one
and
a
half
story
in
format.
But
this
proposal
is
a
single
story.
Next
slide,
please.
M
A
I
suppose,
just
in
terms
of
your
the
conditions
in
terms
of
the
Hedge
height
is
it
does
seem,
you
know
the
boundaries
do
appear.
You
know
fairly
well
growing
up
points
on
the
other
on
the
neighboring
properties.
A
A
Aren't
that
overly
happy
with
is
there
any
scoop,
for
you
know,
I,
just
not
sure
the
need
to
raise
when
it's
actually
fully
out
in
bloom
are
the
required
hey
to
see
a
laurel
hedge
in
one
of
them
as
well,
and
they
can
grow
quite
sporadically
and
they
take
a
lot
a
lot
of
Maintenance,
but
just
kidding
at
your
your
view
on
that.
Just
in
terms
of
the
practicalities
of
them.
M
Thank
you,
chair
condition.
Five
is
in
regard
to
the
parts
of
the
site
which
don't
have
a
Hedgerow,
so
really
the
the
rear
of
the
site,
which
is
the
western
boundary
or
sorry
the
yeah.
No,
the
a
sorry,
the
Easter
in
the
rear
and
Eastern
binary
doesn't
have
it's
undefined.
So
it's
to
put
a
new
Hedgerow
in
along
there
at
around
1.58
meters.
Sorry,
so
to
retain
it,
then
at
that
and
then
really
just
the
front
of
the
site,
if
there's
any
hedger
to
be
removed
as
part
of
the
visibility
space.
M
Just
to
replace
that
the
other
condition
further
down
is
just
to
retain
the
any
existing
vegetation,
we're
not
actually
asking
for
plant
and
along
those
boundaries.
Ether
is
already
existing
vegetation
along
it.
A
Okay,
that's
actually
a
Clarity
on
that.
Thank
you.
Okay,
remember,
there's
any
other
questions
or
queries
on
this
one,
not
then
we'll
move
to
the
decision
phase
or
the
sorry
that
immediers
and
then
decision
I'm,
pretty
content
with
the
numbers
in
terms
of
what,
if
you've
heard
and
seen
in
the
presentation,
all
over
the
omnisan.
C
Yes,
chair,
thank
you
and
thanks
to
Nicola,
this
is
probably
one
of
the
more
easier
ones
for
an
infill
site.
We
do.
We
do
meet
the
more
difficult
ones
on
all
the
points.
Are
there
not,
it
does
meet
all
the
criteria
for
for
an
infill
site
along
that
road
and
I'm
happy
the
way
I
can
send
it
down
and
recommendation
so
happy
enough.
Thank
you.
