Description
Planning Commission - January 11, 2023
A
Okay,
there
we
go
okay,
this
meeting
of
the
Ascension
Parish
Planning
Commission,
is
called
to
order.
It's
January
11
6
o'clock,
P.M,
where
the
Ascension
Parish
courthouse,
607,
East
worthy
Road,
Gonzales,
Louisiana
70737
in
the
council
chambers.
So
the
first
order
of
business
is
to
call
to
order
which
I've
done
call
rule
of
members.
A
In
attendance
Pledge
of
Allegiance
Nick,
would
you
please.
A
A
What
I
will
do
is
I'm
going
to
opened
the
Florida
nominations
of
anyone
has
desire
to
make
a
nomination.
Please
wait
to
be
recognized.
You'll
make
your
nomination
when
it
appears
there
are
no
more
nominations.
A
Okay,
now
and
I
will
accept
we,
don't
we
don't
by
the
way
seconds,
are
not
necessary
for
nominations,
so
I
prefer.
If
we
don't,
we
have
those
unless
you
want
to
express
support
for
the
nominee,
but
thank
you
Randy
I
appreciate
it.
Do
we
have
any
other
nominations?
A
Okay,
nominations
are
closed.
I
will
take
a
vote
on
it.
I
guess
follow
those
in
favor,
Max
NASA
being
chairman,
please
aye
all
right,
all
right!
Okay!
Thank
you.
The
next
office
is
vice
chairman,
so
we
will
open
the
floor
for
our
nominations.
Provision
Pro
chairman:
do
we
have
nominees
for.
A
Can
we
have
nomination
Mr
Miller
for
vice
chairman?
You
agree.
J
A
Okay,
any
other
nominations:
Wade
Shake,
Snyder,
Mr
Clue
at
nomination,
Wayne
Sheikh
Snyder.
Do
you
accept
I
do
do.
C
A
Okay,
the
nominations
are
closed.
So
Miller
was
nominated
first,
those
in
favor
of
Mr
Miller
Vice
chairman
signified
by
aye
aye.
A
Did
you
say:
hi,
okay,
those
in
favor
of
Mr,
Sheck,
Schneider,
Vice,
chairman
aye,
aye?
Okay,
so,
let's
see
chairman
I
think
we
need
to
do
a
roll
call
vote.
Okay,.
A
I'm
glad
you
said
that,
because
I
was
getting
confused,
I
think
it
was
four
to
three
but
I
couldn't
count
yeah
names.
Okay,
we'll
do
a
roll
call,
but
who's.
First,
we're
gonna
go
for
Nick
Miller.
First.
A
Okay,
so
the
voting
is
Foreign,
Auto,
Miller
and
Villa
in
favor
klua
checks
not
in
Nasser
no
opposed
okay.
So
now
we
will
take
a
vote
on
Mr
schech
Schneider.
Could
we
clear
the
machine.
A
Back
here
does
everyone
voted
Ronaldo,
Miller,
Villa,
voting,
nay,
clue
watch
not
in
Nasser
no
voting,
yes,
so
with
Mr
schexidine's
Vice
chairman.
Thank
you
very
much
Chairman's
comments.
My
only
comment
is
to
commissioner
no
I
missed
I
missed
the
last
meeting,
which
was
your
first
meeting.
I
just
want
to
welcome
you
to
the
commission.
A
We
have
public
comment
on
any
item.
Do
we
have
anyone
that
prepared
a
card
for
comment
on
any
item.
I
Thank
you,
Mr
chairman,
you
see
in
front
of
you
January
2023,
normal
subdivision
report.
Any
changes
in
Mark
with
an
asterisk.
The
the
most
notable
change
is
that
there
is
a
preliminary
plat
up
for
next
month's
meeting
in
February
from
all
side
Villas.
It
is
a
36
lot
subdivision
proposed
just
on
the
west
side
of
the
highway
74
overpass.
It
was
originally
approved
about
four
or
five
years
ago
as
another
subdivision,
but
it
stalled
and
the
plot
was
rescinded.
I
So
the
applicant
has
reapplied
for
that
subdivision,
but
that
will
be
on
there
next
month.
Black
Bayou
Estates
is
the
other.
They
have
started.
Construction
they've
started
some
minor
clearing
and
everything
and
they're
working
with
our
subdivision
inspectors
and
our
stormwater
folks
to
make
sure
that
they're
having
everything
in
place
that
they
need
to
proceed
with
construction.
A
I
H
This
one
yet
yes,
Mr,
chairman
members
of
the
commission,
I'd
like
to
announce
that
at
next
meeting,
our
consultant,
Kendy,
Keys
collaborative,
will
be
giving
an
in-person
presentation
on
the
work
so
far
on
the
ordinance
modifications
the
last
time
they
made
a
presentation.
It
was
by
Zoom
they're,
going
to
be
here
at
the
next
meeting,
which
is
to
be
I,
think
it's
February,
9
8
and
on
February
7th
we're
going
to
be
having
the
citizens
advisory
committee
meeting
regarding
those
ordinance
changes
all
right,
so
the
parish
president
has
convened
a
committee.
H
Those
people
will
meet
the
day
before
the
next
day
will
be
giving
a
presentation
to
the
Planning
Commission,
all
right
and
I'd
like
to
follow
up
a
little
bit
on
what
Mr
poche
was
saying
about
some
of
the
projects
that
were
in
the
queue
right
now.
We
had
a
bad
rain
sort
of
about
a
week
or
two
ago,
and
we
had
some
flooding
on
neighboring
properties
from
an
existing
construction
site.
We
have
taken
care
of
that.
H
We
put
a
stop
work
order
on
that
particular
subdivision
until
they
can
get
their
drainage
problems
in
line,
and
we
we
continually
monitor
those
sites
on
a
daily
basis
and
as
soon
as
that's
been
corrected
and
they've
got
everything
in
order,
we're
going
to
lift
the
the
stop
work
order
on
them.
Okay,
so
thank
you.
That's
all
I
have
to.
A
A
E
A
I'm,
sorry,
we
had
a
motion.
Do
we
have
no
discussion?
Let's
vote;
okay,
all
those
in
favor
aye.
Anyone
opposed
no
opposition.
Miniature
adopted
next
item
is
the
consent
agenda
before
we
I'm
gonna
read
the
items
on
the
consent
agenda
and
then
I'm
going
to
ask
if
any
of
you
have
any
item
on
the
consent
agenda,
you'd
like
to
have
removed
from
the
consent.
Agenda.
A
So
does
anyone
have
any
item
they'd
wish
to
have
removed
from
the
consent
agenda.
H
A
Have
a
motion
to
approve
the
consent
agenda
as
read?
Second,
anyone
second
by
Mr
kluat,
all
those
in
favor,
aye
aye
that
is
adopted
next
items
will
be
public
hearing
to
approve
a
deny
various
family
petitions.
A
A
Hi
good
evening,
I
would
like
to
ask
you
to
if
you'd
introduce
yourself
please
my.
A
Okay,
could
you
tell
us
a
little
introduce
this
this
project
to
us?
Please
a.
B
Little
bit,
Mr
Jones
purchased
this
property
approximately
three
plus
years
ago
and
awaited
his
time
to
as
per
Ascension
Parish.
To
perform
the
family
petition.
We
executed
everything
that
needed
to
be
done
as
per
Parish
regulations
and
submitted
all
the
documentation
and
we're
here
before
you
to
seek
approval
of
that.
L
B
I
Sir
I
mean
the
the
subdivision
of
property
meets
the
code
for
the
family
petition
process.
If
you
approve
it,
then
we
would.
The
corrections
have
been
made
on
the
map
and
we
would
have
the
map
signed
and
recorded.
Should
you
approve
it
as
soon
as
the
donations
are
completed
so.
A
Does
it
find
nothing
unusual?
Yes,
okay,
so
we
will
open
a
public
hearing
on
this
on
this
item.
If
anyone
wishes
to
speak
on
this
particular
item,
please
come
to
the
podium.
A
Okay,
I'm
gonna
call
the
public
hearing
closed
commission
any
comments,
discussion.
A
Is
that
my
motion
to
approve
I
Mr
bernata,
who
tends
to
whisper?
It's
second
about
Mr,
Sheikh
Schneider,
any
further
discussion
by
the
commission?
Okay,
all
those
in
favor
aye.
Anyone
opposed
nope.
Congratulations!
Thank.
A
C
C
We
have
a
family
partition.
The
applicant
Reagan
denim
is
donating
track,
5c6b
to
her
grandmother
and
Justin.
The
new
is
the
simple
division,
part
of
it
and
he
owns
a
lot
5c4-b
and
he
is
now
going
to
be
5c-6-8.
A
Okay
and.
I
Staff
comments,
yes,
or
no,
that
there
were
two
properties
that
were
exchanged
in
the
one
to
the
West
in
in
Reagan's,
existing
property
to
the
Northeast
and
then
she's
creating
one
lot
through
the
family
partition
process
and
it
does
meet
the
code
and,
like
I,
said
we'll
as
soon
as
the
donations
are
done.
If
you
approve
it
we'll
have
it
signed
and
recorded
nothing.
A
Unusual,
okay:
this
is
opening
a
public
hearing
on
this
particular
item.
Anyone
wishing
to
speak
on
this
item,
please
come
to
the
podium.
E
A
Most
by
Mr
Fernando,
second,
by
Mr
Clue
out
any
commission
discussion
questions;
okay,
all
those
in
favor
aye.
Anyone
opposed
okay
passes.
Congratulations!
Thank
you.
Y'all
have
a
good
evening.
F
I
No
I
it
meets
the
code
and
we'll
we'll
get
it
recorded.
Should
you
approve
it?
There's
nothing
out
of
the
ordinary
I
mean
it's
a
little
bit.
It's
a
little
bit
different
because
he's
he's.
He
has
two
lots
that
are
doing
being
done
by
Family
petition,
like
Miss
Ellen,
said
in
front
of
no
call,
but
only
a
lot
being
created
by
the
family
petition
is
lot
2a1b.
E
G
A
So
chairman,
yes,.
A
Is
there
anyone
here
that
would
like
to
speak
in
favor
or
an
opposition
to
this
particular
application?
A
E
I'm,
just
I'm
just
going
to
abstain
for
for
any
discussion
or
vote
due
to
a
potential
business
conflict.
Okay,
so.
D
Nick
I
do
I,
have
one
question:
yes,
sir,
it
seems
like
the
access
for
2a1b
is
through
2b1a.
The
other
line.
There's
no
issue
with
that.
I
know.
A
few
months
ago
we
had
a
a
driveway
situation
where
somebody
wanted
some
clear
today
they
didn't
want
the
people
driving
through
their
yard
or
whatever.
Well.
A
A
F
Ellen
Jackson
again
with
McLean
Taylor
Incorporated,
representing
Mr
Joseph
Risa.
This
is
to
subdivide
to
give
a
lot
to
his
daughter,
son
and
mother,
asking
for
your
approval.
Okay,.
A
F
A
Public
hearing
I
got
it
that
time
I've
been
open
to
public
hearing
on
this
issue.
Please
state
your
name
and
you'll
have
three
minutes:
okay,.
K
I
The
property
changes
hands,
there's
a
restriction
as
far
as
Sue,
or
should
an
individual
property
owner
create
more
than
eight
Lots
on
it.
Okay,
we
now
have
something
from
an
original
Parent
tract.
Where
each
should
you
do,
let's
say,
for
example,
that
he
created
these
four
lots
and
within
five
years
from
now,
he
had
enough
property
to
do
an
additional
family
partition.
If
it
came
from
this
original
Parent
tract,
you
would
add
those
together
and
when
it
exceeded
eight,
then
he
would
be
required
to
to
put
in
a
community
sewer
system.
I
I
H
M
My
name
is
James
Kennison,
keep
in
mind
that
the
track
under
consideration
tonight
is
700
feet
approximately
off
of
Highway
73.,
my
family
and
some
of
my
relatives
on
the
property
across
River
Lane
pre-roll
Lane
is
a
private
Gravel
Road
tonight
my
concern
I'm,
not
against
family
petitions.
My
question
tonight
concerns
the
12-foot
utility
servitude
that
shows
on
the
map.
M
That's
fine,
but
as.
M
M
M
M
M
A
I
I
In
Richmond,
yes,
I
mean
the
past
requires
and
anytime
there's
a
subdivision
of
property.
The
12-foot
utility
servitude
be
placed
parallel
to
the
road
Frontage.
Now,
as
the
servitudes
go,
when
the
map
is
is
submitted
by
the
applicant,
it
is
subject
to
those
rules
and
regulations.
It
doesn't
say
anything
about
what
happened
prior
to
that
time.
All
the
parish
is
concerned
about
as
far
as
the
rules
and
regulations
go
is
that
the
property
being
divided,
have
drainage,
utility,
servitudes,
so
on
and
so
forth.
I
The
the
property
owner
is
going
to
be
responsible
for
whatever
he
has
to
do
to
get
his
utilities
back
there.
If
he
has
to
go
to
all
of
these
people
and
purchase
rights
to
a
12-foot
utility
servitude,
if
he
can't
purchase
rights
that
that
is
something
that
is
that's
on
him
from
the
parish's
standpoint,
so
the
these
people,
unless
they
go
to
court
or
something
like
that,
these
people
can't
be
forced
to
to
do
anything
if
there's
no
dedicated
servitude
across
their
property.
At
this
time.
Okay,.
A
J
G
I
And
I
mean
from
the
parishes
standpoint:
they
don't
care
the
the
servitude
doesn't
have
to
run
adjacent
to
the
to
the
roadway,
the
pro
it
can
run
wherever
it
can
be
situated,
and
we
do
have
situations
like
that
years
and
years
ago,
when
things
were
subdivided
before
these
rules
were
in
place,
things
get
put
placed
covers
septic
tanks.
Culverts
thinks
concrete,
slabs
things
of
that
nature.
In
from
the
parishes
standpoint,
like
I
said
as
long
as
those
servitudes
are
placed
on
the
map,
that's
under
application.
I
G
C
M
G
That
would
be
something
code
wise
as
far
as
a
septic
tank
to
get
utilities
back
there
and,
like
you
said
I
mean
you
would
have
to
I
mean
what
was
done
prior
is
we're
just
following.
What's
done
now,
but
the
sewer
specifically,
you
might
be
able
to
do
something
about
that,
because
it's
supposed
to
be
10
foot
off
the
property
line
in
order
to
get
utilities
back
there.
Well.
A
A
F
H
You're
selling,
can
you
put
that
under
the
under
the
overhead
projector
and
we
can
turn
that
on.
F
L
F
Is
the
12-foot
utility
service
it
was
already
so
I
need
to
turn
it
the
other
way.
F
E
Miss
Jackson
and
I'm
just
going
to
ask
you
ask
a
few
questions,
regardless
of
whether
track
B2.
If
there's
a
servitude
and
the
location
of
the
home,
that
is.
That
is
not
a
question
here.
What
we're
discussing
is
the
is
the
partition
of
track
B3
and
subdividing
those
if
in
the
future,
where
that
servitude
line
is
is
drawn
and
is,
is
listed,
any
new
building
in
that
area
has
to
follow
new
servitude
rules.
So
therefore,
regardless
of
track
B2,
what's
what's
existing,
that
is
irrelevant
right.
E
What
we're
focused
on
is
track
B3
and
the
four
four
Lots
there
and
any
new
building
has
to
adhere
to
those
server
two
lines:
if
something's
not
if
they
can't
put
something
in
that
servitude
line,
and
they
can't
do
something-
that's
not
anybody
else's
problem,
but
the
new
home,
the
new
landowners,
correct,
correct
and
they're
not
going
to
be
forced
to
to
to
deal
with
the
neighbor.
The
neighbor
then
has
choices
if
they
have
to
purchase
or
sell
servitudes
exactly
I
got
you
that's
what
I
wanted
to.
A
Any
other
you
gotta
call
you
nick
Mr
Miller.
D
Mr
pochette
is
a
new
road
access
rules
applied
they're.
I
Going
to
say,
yeah
I
mean,
but
the
apron
that
they
have
was
doing
when
73
was
wide
and
that
meets
the
requirements.
They're
going
to
be
required.
There's
base
all
the
way
to
the
ditch.
That's
on
what
will
be
b3d
the
base.
Is
there
they're
going
to
be
required
to
improve
it
from
the
last
house?
I
think
it's
on
A3,
A1
or
a2d
back
to
they're
gonna
have
to
resurface
it
back
to
the
end
of
of
lot
b3d.
D
And
the
beginning
near
the
entrance
at
73
is
going
to
have
to
be
paved.
I
A
B
J
A
To
accept
Mr
cluart
do
we
have
a
second
to
the
second
one
Mr
Bernardo
any
further
discussion
before
we
vote?
A
Okay,
all
those
in
support
all
right.
Any
opposition,
Mr
Villa,
fill
in
opposition.
The
other
commissions
vote
Yes.
A
F
I
That,
yes,
sir,
the
subdivision
meets
the
family
petition
portion
of
the
code.
The
map
has
been
revised
and
if
it's
approved
here
tonight,
we
will
have
it
signed
and
recorded
as
soon
as
the
donation
is
completed.
Okay,.
A
Okay,
the
public
hearings,
close
Commissioners,
any
commentary,
questions
motion.
A
To
approve
of
Mr
schech
Snyder
segment,
Mr
Villa,
any
discussion
commissions;
okay,
let's
cast
our
votes,
those
in
favor
in
the
opposition,
no
opposition
we
have,
but
thank
you
ma'am,
congratulations,
I!
Think
I
think
that's
everything
right!
A
Yeah!
Okay,
we
have
item
13,
which
is
old
business.
We'll
take
this
up.
Do
we
do
we
need
a
motion
to
take
to
take
this
up
into
this
old
business
or
it's
just
okay?
Oh
business
Adam,
a
Smitty,
J
Lee
estate
John
a
lot
sjl1a1
through
sjl1a4
and
lot
sjl
2-4.
It's
a
family
petition.
It
is
Bei
surveying
LLC,
it's
in
Council,
District
Two!
Is
that
someone
here
that's
representing
the
applicant.
I
I
There's
a
requirement
of
the
parish
rules
that
once
it
is
approved
at
the
Planning
Commission,
the
applicant
has
180
days
to
execute
the
acts
of
donation
and
have
the
the
and
then
he
can
have
the
map
signed
and
recorded.
There
was
some
confusion
between
The
Heirs
and
the
survey.
I
Each
one
thought
the
other
one
was
doing
it
and
so
what
they
are
doing
here
tonight
since
it
was
approved,
and
they
have
done
the
acts
of
donation
already
for
each
of
the
pieces
of
property,
and
that's
why
we
wanted
to
try
to
come
before
you.
He
wanted
to
try
to
come
before
you
to
ask
that
you
waived
that
requirement
without
them
having
to
make
a
new
application
and
start
over
again,
which
was
what
they
would
be
required
to
do,
and
so
that's
basically
asking
you
guys
to
to
reapprove
it.
So.
A
Sir
okay,
does
everyone
understand
that
yep?
Do
we
have
question
motions
motion
to
approve?
Oh
I'm,
just
one
question
I.
D
I
I
Yeah
I
mean
it's
15
foot
asphalt,
driveway
that
comes
there
they're
going
to
the
back.
Yes,
it
would
yes,
it
would
I
mean
we
wouldn't
go
all
the
way.
Obviously,
because
there
are,
there
are
several
tracks
and
there's
a
a
public
road
that
goes
out
to
a
certain
point,
but
as
far
as
the
the
driveway
that
has
to
be
extended
to
access
those
lots.
Yes,
it
would.
D
I
A
Stuff:
okay,
okay,
I'm,
going
to
take
a
step
back
now,
any
anyone
sign
up
for
a
public
hearing
on
this
for
them
no
public
hearing
this
Commissioners.
Do
we
have
a
motion?
The
most
clue
outside
moves
to
check,
Schneider
I
think
they
did
that
already,
all
those
in
favor
anyone
to
post
no
okay,
so
that
also
passes
next
item
is
a
motion
to
adjourn
so
moved.
