✔️ Approved an ordinance accepting the appraised roll and approving the property tax rate for the tax year 2023 (FY 2024) at 0.681485/$100 valuation for the tax year 2023 (FY 2024), which is 1.35 cents less than the current tax rate.
✔️ Approved an ordinance ratifying the budgeted property tax increase reflected in the FY 2024 Budget.
✔️ Approved an ordinance amending Section 22.05.211 of the Code of Ordinances to increase garbage rates by $1.00 per month effective October 1, 2023. Raising the rate from $22.25 to $23.25 will ensure that the minimum fund balance requirement of fifteen percent (15%) is maintained per financial policies.
✔️ Approved an ordinance amending Section 22.02.001, Water Service Rates and Section 22.02.002, Wastewater Service Rates of the Code of Ordinances to increase water rates by four percent (4%) and sewer rates by ten percent (10%) effective October 1, 2023. The increase in minimum required fund balance is necessary in order to meet the concerns of rating agencies when the City goes to the market to issue water and sewer revenue bonds. As operating costs within the fund
continue to rise due to inflation and employee increases, it is necessary to increase the revenues of the fund as well. A customer using an average of 5,000 gallons per month would see an increase in their bill by $4.80 per month from $70.06 per month to $74.86 per month.
✔️ Approved an ordinance amending Section 22.05.214 of the Code of Ordinances to increase landfill disposal fees by $1 per cubic yard effective October 1, 2023, which would bring the compacted refuse fee to $7.10/cy and the noncompacted refuse fee to $6.31/cy which will ensure that the minimum fund balance requirement of fifteen percent (15%) is maintained per financial policies.
✔️ Approved a resolution authorizing the City Manager to execute Change Order No. 5, accept maintenance, and authorize final payment to To-Mex Construction, LLC, of Houston, for the Street Rehab Sewer Line Pipe Bursting Project.
✔️ Approved a resolution authorizing the City Manager to award a contract to King Solution Services, LLC, of Houston, for the Street Rehab Phase V Sewer Line Replacement Project.
✔️ Adopted the disaster declaration issued by the Mayor on September 8, 2023
✔️ Held a work Session to review and discuss adopting amendments to gaming site regulations and licensing with the goal to increase City oversight and improve public safety.

Lamar
University's

1901.

for
South
Park,
Junior
College's
Creation
in
1923.

us
in

planning

all

September
events

the
United
States
suicide
is
the
10th
leading
cause
of
death.
This
means,
on
average,
135
individuals
each
day
lose
the
battle
for
their
suicidal
thoughts
and
behavior.

Ninety
percent
of
those
who
have
died
by
Suicide
may
have
experienced
symptoms
of
a
mental
health
condition
according
to
later
interviews
with
family
friends
and
their
medical
professionals.
Suicide
is
preventable
and
it
is
important
that
we
identify
and
support
those
at
risk.
Our
mission
at
Mental,
Health
America
of
Southeast
Texas,
is
to
promote
the
mental
Wellness
of
our
region
and
enhance
the
lives
of
all
individuals
impacted
by
mental
illness
through
Community
collaboration,
education
and
advocacy,
see
by
talking
openly
about
mental
illness,
educating
ourselves
as
well
as
others
and
normalizing
necessary
treatment.

depression

anxiety

when
people
tell
you
they're
having
difficulties,
don't
be
afraid
to
ask
them.

know
how
bad
is
it
don't
be
afraid
to
ask
someone
that
you
know
suffers

depression

that

000

in
our
community

struggling
with
addiction
right
now,
if
you're
less
of
a
big
picture
person
and
more
of
a
people
around
me
person.

during

I
need

my

I'm
a
Beaumont
resident,
a
volunteer
for
Beaumont
Animal
Care
and
a
volunteer
for
local
animal
rescues
as
well.
In
May
of
this
year,
I
made
public
certain
concerns
I
had
regarding
shelter,
euthanasia
practices,
Beaumont
Animal,
Care,
euthanized,
six,
healthy
adoptable,
happy
animals
with
21
empty
kennels
on
May
5th
and
eight
empty
kennels
on
May
12th
I
was
advised.
There
was
an
investigation
to
why
this
happened.

To
date,
I
have
heard
nothing
regarding
the
status
of
this
investigation.
No
one
has
contacted
me
to
follow
up.
I,
have
sent
multiple
emails
to
everyone
involved
and
haven't
received
a
response
from
anyone.
This
is
a
very
important
issue
and
deserves
to
be
given
attention.
Also,
ever
since
I
disclosed,
this
I've
been
banned
from
volunteering
inside
the
shelter.
This
is
unfair
and
unjust
and
it's
only
hurting
the
animals.

is
a
federal
law
called
section
1983
that
states
shelters,
cannot
ban
rescues
or
volunteers
from
speaking
out
and
Reporting
wrongdoings,
abuse
or
violations
of
the
law,
and
it
states
that
I
have
the
right
to
sue.
If
I
have
been
retaliated
against
by
being
banned,
I
do
not
want
to
do
this.
My
only
wish
is
to
help
the
animals
at
Bowman,
Animal
Care.

answers
to

status

the
investigation.

also
want

address
certain
issues.

feel

help
save
more
lives

Bowman,
Animal
Care,
the
Beaumont
Animal
Care
Foster
program

a
Lifeline
for
these
animals,
based
on
conversations
with
potential
Fosters
we've
been
advised
they
will
not
Foster,
because
BAC
does
not
provide
medical
care
if
it's
needed
monthly
flea
and
heartworm
preventatives
food
or
supplies.
This
seriously
limits.
The
number
of
people
who
would
otherwise
become
Fosters
as
rescues,
do
provide
this
for
their
Foster
families.

Our
city
also
needs
additional
resources
for
free
or
low-cost
spay
and
neuter
clinics,
either
by
putting
more
funds
into
the
voucher
program
BAC
already
has,
or
through
Partnerships,
with
local
vets.
We
must
work
on
the
pet
overpopulation
problem.
This
is
not
a
shelter
problem.
It's
a
problem
for
our
entire
community.

my

cat
ordinance
since
I've
been
speaking
about
these
three
other
people
have
told
me
they
have
this
problem
too.
So
I
understand
this
is
not
an
isolated
incident,
though
it
seems

just
on
my
street,
when
I
first
reached
out
to
these
about
these
kids
that
belong
to
the
people
across
the
street
I
contacted
the
pound.
Eventually,
they
directed
me
to
the
city's
ordinance
and
gave
me
the
brochure
which
I
love
for
popping
with
when
I
came,
hear
Pride
when
I
called
the
the
police.

When
she
threatened
me
behind
these
kids,
they
directed
me
back
to
the
pound.
So
this
is
a
circle,
but
one
thing
is
certain:
it's
the
cat
ordinance
that
the
city
has
at
the
root
cause
of
this
problem.
If
these
was
puppies,
as
I
just
heard,
the
power
would
have
been
come
to
get
them.
In
that
case,
the
dogs
were
killed
in
this
case.

been
having
this
problem
with
this
neighbor
being
negligent
over
these
cats
running
loose
in
the
street
and
on
my
property
for
over
a
year
on
the
fourth,
her
son
is
in
my
it's
on
my
yard.

my

he's
calling
for
all
three
of
these
cats
they
didn't
come,
then
he
comes
back
on
the
seventh
again
walking
under
my
trees,
calling
for
this
cat
telling
them
he'll
give
them

chicken.

it
seems
funny,
but
it's
not
miss

cats

state
legislature

tax
rate
that
this
council

is
actually
lower

are
two
components
to
determining
how
much
property
tax
you're
going
to
pay.
One
component

we
as
a
city
control,
is
your
tax
rate.

component
that

city,

not
control

appraised
value

your
property,
that's
controlled
by
the
Jefferson
County
Appraisal
District.
If
you
received
an
appraisal
notice
this
past
year
from
the
appraisal,
district

property

go
up
in
value,
then
this
tax
rate
will
not
increase
your
taxes,
it'll
actually
lower
them.
So
if
your
property
did
go
up
in
value
which
many
did,
then
you
will
end
up
paying
more
taxes,
even
though
the
tax
rate
is
lower
anytime,
you
get
an
appraisal
notice
from
the
appraisal
district.

have

right

protest.
That
appraisal.
You
can
go
down
to

appraisal
district
and
say
you
want
a
hearing

citizens
of
your
peers

case

why
you
think
your
property
is
overvalued

this

say
our

appraisal
rate

willing
to

district
is
tasked

setting

value

for
many
years

low

got
in
trouble

to

our

for

and
sewer

so

recommendations

has

depleted

and

the
Capital

citizens

faith
when
they
see
a
list
of
infractions
like
that,

other
hand
that
same
TCEQ
rates,
our
water
system
as

conference

week

we
had
questions
and
they
were
answered.
We
have
a
communication
Department
that
puts
out
regularly
what's
going
on
in
the
water
department,
we
have
adopted
a
philosophy
of
making
sure
that
all
citizens
questions
are
answered
and
responded
to.

we
try
to
be
an
open
book
with
what
we're
doing
with
the
converting
over
from
free
chlorines
are
from
chloramines
to
free
chlorine.

will
run
into
a
notification
issue
that
you

detriment

way
we
combat,
that
is
by
a
free
chlorine
conversion.

that's
what
we

with
the
issues

chlorine

we

we
were
well
aware
of
that
piece

the

date
we're
36
alleged
violations.

16
of
them.
There's
six
potentials.
We
resolve
two
there's
11
records
requests.
Two
of
those
have
been
resolved.
Nine
additional
issues.
Seven
were
resolved
three
that
they
didn't
know
to
type
on
two
were
resolved,
so
we're
about
a
little
less
than
halfway
through
responding
to
all
this
to
level
set
and
give
you
an
idea.

he

meters
that
aren't
adjusted
correctly

the
entire
system

that
that
project's
underway
now
I
believe.

we

heard

concerns

public

two
different
factors.

drought,

catching

water
delivery
system,
and
we
need
to
remember
here
that
the
responsible
thing
is
that
we're
not
a
business,
we're
not
operating
to
make
money.
So
when
we're
operating
at
a
deficit,
this
isn't
sustainable.
So
we
have
to
take
this
appropriate
action.

I
don't
want
people
to
think
that
we
ignored
your
concerns.
It's
just
that
we.
This
is
not
sustainable,
not
increasing
the
rate,
so
we're
going
to
have
to
increase

rate,

if
we
waited

increase
the
rate
more
and
we
must
provide
a
safe
infrastructure

you

we
currently

it
doesn't

us

option

don't
feel
like
it
gives
me
the
option
to
be
responsible
and
kick
the
can
down
the
road

not
vote
for
a
rate
increase.

changes
that
we're
outlining
here
today
is,
as
you
may

aware,
game
rooms
often
result
in
gambling
activities
and
increased
calls
for
service
from
police
and
fire
departments,

building
codes,
Planning

Zoning
in
other
departments.
In
fact,
since
the
enactment
of
the
original
Zone
gaming
ordinance
back
in
2014,
thousands
of
calls
have
been
made
to
these
sites
at
a
pretty
high
cost
to
the
city,
and
so
as
such,
the
intent
of
the
proposed.

first
is
a
game
room
which
has
six
or
more
gaming
machines
and
that's
distinguished
from
an
accessory
Gaming
use,
which
has
five
or
fewer
gaming
machines,
so
that
may
be
more
something
like
a
convenience
store
or
smaller
other
retail
use
with
another
primary
use.
That
might
have
a
few
missing
few
machines
and
the
reason
for
this
distinction
is
because,
in
addition
to
some
of
the
rules
we're
outlining
here
in
this
proposed
ordinance,
we
still
regulate
game
rooms
through
specific
use,
permit
process,
and
we
in
zoning.

Machine
registration
requirements,
the
applicant
would
be
required
to
submit
an
inventory
list
of
gaming
machines
with
the
type
of
game,
identification
numbers
and
Texas
comptroller
identification.
Number
each
machine
within
the
game
room
shall
match
the
submitted
inventory
list
which
would
display
the
city's
registration
decal
and
match
the
Texas
comptroller
decal.
Any
changes
to
the
inventory
list
should
be
submitted
to
the
game,
room,
permitted,
administrator
and
subject
to
applicable
fees
and
inspection.

be
fairly
similar
to
the
current
process
and
that
the
applications
would
be
made
to
planning
and
Community
Development
Department.
Initiating
the
review
process
would
include
zoning
building
code
and
other
reviews.
However,
we're
adding
up

three
inspections

fire
department

order
to
ensure
compliance
with
all
the
requirements
operating
hours,
we
would
propose
that
operating
hours
be
from

pm
to

for
game
rooms

well

as
mentioned
prior,
we
have
had
many
many
calls
for
service
service
from
PD
and
fire

building

these
types
of
uses.
So
as
we're
proposing
here,
we
would
request
that
Windows
must
be
unobstructed
at
all
times,
so
that
you
could
see
into
the
the
game
room.
In
addition,
we're
asking
that
all
Sites
with
gaming
machines
have
closed
caption
or
CCTV
camera
systems
and
or
security
monitoring
systems
at
the
owner's
expense
in
order
to
record
activities
going
on
again.
The
reason
behind
that
is
call
for
service.

is
a
significant
change
from
the
existing
code
that
was
adopted
back
in
2014,
and
this
is
prohibited
locations
again,
as
I
mentioned
earlier,
game
rooms
still
require
zoning
review
and
specific
use
permit
you've
seen
many

those
applications
come
through
our
process,
but
under
the
current
ordinance
we
do
require
a
300
foot,
setback
from
church,
hospitals,
churches
or
houses
of
worship,
hospitals
and
schools.

the
proposed
changes.

we're
requesting
is
a
600
foot,
setback
from
schools,
Child
Care,
Facilities
churches,
hospitals,
as
well
as
residential
zoning
districts,
as
well
as
a
thousand
foot
setback
from
an
existing
game
room,
and
this

little
hard
to
read
in
this
map.
But
the
pink
area
would
would
be
the
areas
of
the
city
that
would
be
excluded
currently
based
on
the
location
of
zoning
residential
zoning,
as
well
as
existing
game
rooms.

during

permit

occupation,
taxes
will
be
levied
on
all
machines
on
site,
whether
they
are
in
operation
or

owners

operators
shall

city

completion

background
checks,

badges

site-specific
personal
to
the
holder
and
not
transferable,

finally,

manage

mitigate
what
we
already
have

place.

know
the
number

gaming
rooms
that
we
presently

Beaumont?

that's
been

kind

a
common
point
of
discussion
amongst
us
is
because
I
would
say
our
our
fee
structure
has
been
so
low
and
our
some
of
our
regulations
may
have
been
a
little
bit
less
restrictive
than
other
communities,

surrounding
that
we
may
have
gotten
more
more
than
our
fair
share
of
uses.
So
again
we're
trying
to
rectify
that.

determined

illegal
businesses,
but
they
do
create
specific
nuisances
to
the
area,
so

comptroller,
the
law,
does
allow
for
cities

fees

they're
not
intended
to
profit.
But
it's
intended
to
be
self-funding.
The
fact
that
whatever
it
takes
to
have
these
enforcement
with
inspections
required
by
police
and
fire
that
these
fees
would
support
those
efforts-
and
currently
our
current
fee
structure
does
not
allow
for
that
and
I
think
we're
operating
at
a
severe
deficit.

game
rooms,

unpermitted

rooms

a
permitting

dollars

machine,
and
we
realized

quickly
that
that
the
expense
associated
with
opera

not

necessarily
operating
but
with
managing
the
permitting
process.

changes

align

other
cities

doing

kind

able

some

the
nuisances

commonly
associated
with

us

ordinance

attracted

rooms,

the

they
allow
their
permit
to
lapse
or
their
permit
is
revoked,
they
would

they
sold

business

it
is
the
existing
owner
in
the
existing
location
and
they've
met
all
requirements
and
maintained
the
certificate
of
vacancies
in
their
gaming
permit,
they
would
be
grandfather

these

businesses

as
councilman
felshaw
mentioned,
create
the
the
appearance
that
we're
trying
to
exclusively
exclude
these
businesses
they're.
If
they
operate
legitly.

they
are
meeting
on
requirements,
they

be
have
reasonable
restrictions
in
place
and
I.

going
outside
of.

did
in
some
of
the
discussions,
talk
about
I'm,
doing
long,
larger
gaps,
but
that
would
create
a
situation
where
it
would
impact
the
ability
of
where
they
could
locate.

have
several
schools
located
within

city,
several
churches

cities,
several
of
the
businesses
in
which
we
are
trying
to
restrict
them
from
being
in
so
that
would
limit
their
area,
and
what
will
you
possibly
do
is
create
a
cluster
of
game
rooms
in
one
particular
area,
which
would
be
unfair
to
the
residents
in
that
area
as
well.

when
we
first
started
there's
a
lot
of
the
businesses
that
had
game
rooms
or
operating
as
a
accessory,
so
they
were
in
gas
stations
and
they

locations

about
the
same.
Obviously,
you
have
more
propensity
for
the
nuisances
in
the
larger
game
or
just
operating
game
rooms
that
have
you
know
several
machines
in
excess
of
25
to
100.

creates
a
different
type
of
Lottery
and
a
different
type
of
attracts
a
different
type
of
crowd,
as
opposed
to
a
restaurant
or
bar.
So
I
think
that
is
it's
not
if
you're
asking
are
they
both
do

calls
for
service.
The
answer
would
be,
yes.
Are
the
calls
for
service
slightly
different
and
an
accessory
location
versus
a
full-blown
Game
Room?

answer
is
also
yes.

businesses

Street

whole
street

being
done

one
end
to
the

administration

this
Council
on
passing
a
very
ambitious
CIP,
a
capital
plan.
It's
a
detailed
plan
that
is
designed
to
move
this
city
forward.
We
get
a
lot
of
criticism
about
matters
that
are
really
outside
of
our
control.
We
can
only
control
what
we
we
can
control
things
like
droughts,
months
of
triple
digit
temperatures
that
impact
our
water
system
negatively
are
really
outside
our
control.

Things
like
crime
that
happen
usually
between
people
that
know
each
other,
it's
outside
our
control,
but
we
can
recognize
our
Police
Department
for
quickly
apprehending
those
things
when
they
do
occur.
We
are
working
very
hard.
All
of
us
up
here
on
Council,
to
make
Beaumont
a
great
place
to
work,
live
and
play
it's
never
popular
to
increase
tax
rates
or
water
rates.
Sometimes
these
things
have
to
be
done.

I
am
a
physical
conservative
I
want
our
city
to
be
efficient
and
use
our
resources
in
the
best
manner
that
we
can
and
I
do
pledge
to
continue
to
keep
a
close
eye
on
that.
But
some
of
these
expenses
that
we've
incurred
today
and
will
be
incurring,
have
to
be
done
in
order
to
be
physically
responsible.
It
would
be
fiscally
irresponsible
to
not
raise
our
rates
and
jeopardize
our
bond
rating.
So
that's
why
I
voted
the
way
I
did.

think
that's
one
of
the
major
pushbacks
when
it
comes
to
the
rate
increase
but
I
support
it
because
I
know
we
have
to
spend
money
in
order
to
approve
things,
but
I
also
would
like
to
see
more
support
and
accountability
on
our
end
for
what
we
know,
we
can't
control
and
do
better
and
I
think
that
will
put
a
lot
of
citizens
at
ease
outside
of
that.

know
I'm
in
a
pretty
good
place.

think
when
we
ask
for
information,
I
would
like
to
see
a
timeline
on
things.

why
am
I
so
quiet
about?
What's
going
on
with
our
water
and
water
rates
and
I
I
tend
to
look
at
things
from

past
the
present
and
look
at
at
the
future,
and
so
I'm
trying
to
be
a
bit
slower
to
immediately
jump
out
and
respond
to
things
without
looking
at
the
full
perspective.

been
here
a
long
time
and
I've
been
on
councils,
I've
tried
to
make
sure
we
didn't
increase
tax
rates
and
we
always
took
a
very
slow
position
to
increase
rates
and
we
always
tried
to
lower
them
when
we
could
and
keep
them
maintained.
When
we
could
and
over
that
period,
I've
learned
that
sometimes.

While
we
have
money
in
the
budget,
because
some
things
are
out
of
our
control,
we
don't
control
hurricanes
coming
into
our
area.
We
don't
control
the
climate,
we
don't
control
the
lack,
this
drought
that
we're
in
and
fortunately,
we've
had,
we've
been
in
a
position
to
have
fund
balances
that
can
take
us
through
the
tougher
times
and
for
that
I
say.

had

perfect

that's

times

us

shouldn't

didn't

didn't
always
understand

do
now
so
I
just

for
their
heroism,
just

guys

business
downtown,

Boutique
and
I'm
really
excited

see
that
as
we
invest,
the
city
invests
in
our
downtown
Improvement
that
business
owners
are
trusting
our
vision
and
our
plan
and
are
moving
back
into
downtown.

mass
reunion
for
Westbrook,

we've
been
working
diligently

water
issue,
we're
very
sincere

we're

thing
came
about
because
the
city
wanted

what
was
best
for
a
citizen.
It
came
about
because
they
wanted
to
make
sure
the
water
was
disinfected
properly.

That
that's
was
the
chloramine
issue.
It
wasn't
to
create,
do
other
things.
It
was
to
make
sure
the
water
was
safe
and
that's
what
we're
doing
making
sure
the
water
is
safe
and
it's
being
safe.
Of
course,
the
drought
and
heat
contributed
to
that
greatly.
As
again
everyone
said
that's
out
of
our
control.
We
can't
control
those
things,
but
we
can
just
manage
them
as
best
as
we
can
and
I
think.

We've
done
a
good
job
of
managing
that
this
disaster,
actually
that
we're
not
finished
with
yet
so
we
are
getting
resources
in
we've,
stabilized
our
system,
we're
running
about
what
38
millions
or
so
a
gallon
a
day.
Now
Bart,

we
were
up
to
44
what
the
system,
that's
probably
designed
to
run
45,
we
were
running
over
44
million
gallons
a
day,
so
we
are
we're
in
a
good
place.
We
want
citizens
to
know
we.
We
know
their
concerns,
we're
responsive
to
what
they
do.
