Agenda Items of Interest:
✔️ Heard a proclamation recognizing Our World: Worldwide Day of Play on Saturday, September 30th with the Beaumont Children's Museum.
✔️ Heard a presentation from Richard Backhaus with Evergreen regarding the employee salary study and their recommendations for a phased three-year implementation approach.
✔️Council approved amending an ordinance to Article 6.10 Gaming Sites and Gaming Machines.
✔️Council to approved amending Section 2.04.002 of the Code of the Ordinances related to declaring Presidents' Day as an official holiday for City employees.
✔️Council tabled a resolution to award HOME ARP (American Rescue Plan) funding for the development of non-congregate shelter, tenant based rental assistance and the administration associated with the planning and management of the projects.
✔️Council tabled a resolution approving the write-off of uncollectible water accounts totaling $51,055.48 for which each individual account exceeds $1,000.
✔️Council approved a resolution authorizing a contract with Zion Industrial Group, LLC, and TMT Utilities, Inc., for the Citywide Emergency Water Main Repairs III.
✔️Council conducted a Public Hearing to receive comments on the 2022 Consolidated Annual Performance and Evaluation Report (CAPER).
✔️Council held a work session to review and discuss the city's sanctioned encampment strategy, which presented information and potential costs for proceeding with creating a primitive campsite with a service provider or pallet housing with a service provider.

✔️ Heard a proclamation honoring Lamar University’s Centennial Celebration.
✔️ Heard a proclamation recognizing the month of September as National Suicide Prevention Month.
✔️ Heard a proclamation celebrating the 117th Anniversary of the Pride of Beaumont #291.
✔️ Heard a proclamation recognizing the month of September as National Recovery Month
✔️ Held a Public Hearing on the 2023 (FY 2024) Proposed Tax Rate.
✔️ Approved an ordinance adopting the FY 2024 Budget by a record vote.
✔️ Approved a resolution adopting the 2024 Capital Program.
✔️ Approved an ordinance accepting the appraised roll and approving the property tax rate for the tax year 2023 (FY 2024) at 0.681485/$100 valuation for the tax year 2023 (FY 2024), which is 1.35 cents less than the current tax rate.
✔️ Approved an ordinance ratifying the budgeted property tax increase reflected in the FY 2024 Budget.
✔️ Approved an ordinance amending Section 22.05.211 of the Code of Ordinances to increase garbage rates by $1.00 per month effective October 1, 2023. Raising the rate from $22.25 to $23.25 will ensure that the minimum fund balance requirement of fifteen percent (15%) is maintained per financial policies.
✔️ Approved an ordinance amending Section 22.02.001, Water Service Rates and Section 22.02.002, Wastewater Service Rates of the Code of Ordinances to increase water rates by four percent (4%) and sewer rates by ten percent (10%) effective October 1, 2023. The increase in minimum required fund balance is necessary in order to meet the concerns of rating agencies when the City goes to the market to issue water and sewer revenue bonds. As operating costs within the fund
continue to rise due to inflation and employee increases, it is necessary to increase the revenues of the fund as well. A customer using an average of 5,000 gallons per month would see an increase in their bill by $4.80 per month from $70.06 per month to $74.86 per month.
✔️ Approved an ordinance amending Section 22.05.214 of the Code of Ordinances to increase landfill disposal fees by $1 per cubic yard effective October 1, 2023, which would bring the compacted refuse fee to $7.10/cy and the noncompacted refuse fee to $6.31/cy which will ensure that the minimum fund balance requirement of fifteen percent (15%) is maintained per financial policies.
✔️ Approved a resolution authorizing the City Manager to execute Change Order No. 5, accept maintenance, and authorize final payment to To-Mex Construction, LLC, of Houston, for the Street Rehab Sewer Line Pipe Bursting Project.
✔️ Approved a resolution authorizing the City Manager to award a contract to King Solution Services, LLC, of Houston, for the Street Rehab Phase V Sewer Line Replacement Project.
✔️ Adopted the disaster declaration issued by the Mayor on September 8, 2023
✔️ Held a work Session to review and discuss adopting amendments to gaming site regulations and licensing with the goal to increase City oversight and improve public safety.

✔️Council approved a resolution authorizing a contract with SETEX Construction Corp., from Beaumont for the City Wide Emergency Water Main Repairs Contract.
✔️Council approved a resolution approving the emergency repair of a pump for Lawson’s Pump Station.

✔️ Council approved ordinance providing for the reimbursement of capital expenditures incurred prior to the closing of financing.
✔️ Council approved a resolution authorizing the City Manager to execute a new interlocal agreement (ILA) with Beaumont Independent School District (BISD) for the School Crossing Guard Program.
✔️ Council approved a resolution adopting the Strategic Plan 2023-2028-2038 for the City of Beaumont which outlines the City's vision, mission and goals for the next 15 years and will be shared with the public soon.
✔️ Conducted a Public Hearing to hear applicant requests for funding from the 2023 Hotel Occupancy Tax Grant Program. Organizations spoke about their tourism proposals, which will be reviewed by an advisory committee and voted on at a later date.

✔️ Council voted to adopt the proposed 2023 tax rate of 0.681485/$100 of valuation via record vote and scheduled a public hearing for September 12. This is the lowest rate in 10 years.
✔️ Council approved an ordinance calling for a Special Election on November 8, 2023, for the purpose of submitting to the qualified voters of the City of Beaumont certain proposed amendments to the existing Charter of the City of Beaumont, Texas. The proposed amendments include:
(A) increasing City Council terms from two years to four-year staggered terms
(B) requiring individuals to sit out after having served two (2) consecutive full terms in one office or four consecutive terms in two offices
(D) requiring the City Council to hold such regular meetings as necessary to efficiently conduct the affairs of the City

(F) consistency and clarity with state law
(G) delete repetitive and unnecessary provisions

These include the 1. qualified hotel program, 2. water and wastewater infrastructure, 3. economic development, 4. public health, 5. public safety, 6. resiliency, 7. transportation and mobility, 8. revenue, 9. to restore and preserve local control, 10. tourism, parks, natural resources and the arts, 11. and planning and development.
✔️ Approved the recommendations for the Parks Capital Improvement Plan for Fiscal Year 2023, which includes: 1. replacing Imagination Station in Central Park, 2. replacing the playground in Charlton-Pollard Park, 3. installing playground equipment at Combest Park, 4. a drainage study at Henry Homberg Golf Course, 5. adding a shelter at Sprott Park, 6. resurfacing the tennis courts into basketball courts at Magnolia Park, 7. purchasing a turf tank striping system, 8. installing a playground at Babe Zaharias Park, 9. replacing nine scoreboards at the Athletic Complex and 10. a general maintenance budget. ✔️ Supported Abiding Grace as proposed Housing Tax Credit (HTC) project.

✨WHAT YOU MISSED AT COUNCIL✨
✔️ ExxonMobil Beaumont presented the City with a $100K check to go towards Parks & Recreation's restoration of the Charlton-Pollard Park playground and discussed a future recycling initiative.
✔️Amended the FY 2023 Budget to increase the general liability fund by $500K
✔️ Authorized participation in Entergy's rate proceedings for 2023. The committee successfully negotiated a rate increase of only 4.6%, reducing their original proposal by 58.90%.
✔️ Held a work session to review and discuss supporting the request of the Southeast Texas Groundwater Conservation District (SETGCD) to raise the maximum water production fee from 1 cent per 1,000 gallons to 7 cents per 1,000 gallons and authorized the City Manager to send a letter supporting the maximum rate increase. That does not mean there will be an increase and no increase is anticipated in the near future, it's merely a failsafe for worst case scenario.
✔️ Held a work session to review and discuss the adoption of the 2021 Uniform Plumbing Code. The vote was to table the item for two weeks to allow staff more time to research if and how it may impact potential future FEMA reimbursements.

✔️ Heard a presentations from the Chamber of Commerce on Economic Development about allocating funds to a strategic plan and potential pilot programs to be voted on at a later date
✔️ Heard a presentation from International Association of Plumbing and Mechanical Officials about potentially adopting new building codes to be voted on at a later date.
✔️ Approved an ordinance calling the General Election for May 6, 2023, to elect a Mayor, two (2) Councilmembers-At-Large, and four (4) Ward Councilmembers (one each for Ward I, II, III and IV); with a Runoff Election if necessary on June 10, 2023. Exact polling hours and locations are tba with input needed from other stakeholder groups on the ballot.
✔️ Authorized the City Manager to award a contract to Callan Marine, Ltd., of Galveston, for the Riverfront Park Restoration FEMA No. 6499 Project. An exact timeline is tba but it will take approximately 1.5 years once they begin.
✔️ Authorized the City Manager to enter into an agreement with Evergreen Solutions, LLC to conduct a compensation and classification study for all city employees.
✔️ Authorized the City Manager to apply, and if approved, enter into an Advanced Funding Agreement with the Texas Department of Transportation for the Highway Safety Improvements Program for grants for signage and sidewalks near Beaumont schools.
✔️ Held a public hearing determining a few structures public health nuisances and passed a resolution ratifying that determination. Citizens were given a timeline to work with staff on improving the properties to become compliant.
✔️ Held a public hearing on dangerous structures and consider an ordinance declaring 50 structures unsafe. Anyone who came to speak on their item was granted an extension and entered into the work program. Anyone who couldn't make it due to weather will have another opportunity next week.

✔️ Council authorized one-year contracts with several local non-profit arts and historical organizations primarily funded through the Hotel Occupancy Tax (HOT) Grants to promote tourism.
✔️ Council held a work session for Bird Scooters to hear the six-month update as they are halfway through a year-long pilot program. They addressed questions about safety, youth ridership, and oversaturated/cluttered areas and what they are doing to mitigate concerns. To date their have been 42,000 trips taken by 11,000 unique riders.
✔️ Council heard a presentation from Lanier, the engineering firm contracted to determine the feasibility of relocating the Battleship Texas to Beaumont. A work session was held to discuss potential costs, issues, and options and Council voted to authorize the City Manager and staff to continue investigating what would be necessary to submit a formal bid. No commitments of funding were made, just that the majority of Council had an expressed interest in continuing to gather more information.
