Description
City of Boston Licensing Board - Voting Hearing 08/17/23
A
B
Good
morning,
this
is
the
voting
hearing
before
the
licensing
board
for
the
city
of
Boston.
Today
is
Thursday
August,
17
2023..
This
morning's
hearing
is
being
recorded
and
will
be
posted
to
the
city
of
Boston's
website.
While
the
public
is
encouraged
to
attend,
there
will
be
no
additional
testimony
accepted
this
morning.
C
Thank
you,
Danny
I
did
not
see
a
violation
in
either
incident.
I
didn't
think
there
was
enough
there
and
the
staff
was
very
cooperative.
D
D
A
C
C
This
incident
happened
before
our
security
and
operations
that,
before
their
security
and
operations,
plan
was
approved
by
the
board.
I
would
like
to
note
it
in
the
file,
but
I
don't
see
a
violation
here
because
they
have,
since
this
is
an
old
one,
that
they
have
since
put
corrective
measures
in
place
and
since
those
measures
have
been
placed,
they
have
had
no
violations.
D
B
C
B
C
The
bleacher
bar
I
believe
their
testimony
was
persuasive
at
the
hearing
that
they
did
try
to
stay
in
compliance.
They
had
a
line
outside.
It
was
a
very
busy
day
in
that
neighborhood.
C
C
D
C
D
I
did
too,
but
what
was
your
contention.
C
The
waitress
had
ordered
the
waitress
had
placed
the
order
for
the
shots
for
a
table
of
I,
think
six
people,
and
then
she,
based
upon
the
testimony
she
clocked
off
her
shift
and
the
shots
were
left
on
the
bar
and
had
not
been
delivered
to
the
table.
Yet
so
the
from
what
I
heard
in
the
testimony
the
patrons
went
to
go
pick
up
the
shots
that
were
ordered
by
the
waitress
who
had
finished
up
her
shift.
That.
B
To
one
we
have
two
votes
for
a
violation
terminal:
Jersey
violation
is.
A
D
A
No,
no
I'm
voting
for
a
violation
but
I'm
not
suggesting
for
me.
I,
wouldn't
suggest
even
a
warning.
I
thought
the
the
testimony
that
the
bartender
did
have
eyes
on
the
table
was
enough.
Mitigating
that
I'm
not
seeing,
as
you
know,
seriously
enough
to
rise
to
a
warning,
but
in
the
same
manner
I
I
think
something
happened
here
and
so
I
don't
want
to
completely.
A
The
sheer
number
the
12
drinks
was
why
I
couldn't
kind
of
see
nothing
going
on
here.
So
I
I
definitely
agree
with
that.
A
B
So,
just
just
to
recap,
it
sounds
like
the
the
how
this
will
be
disposed
of
is
correspondence
from
the
board
in
terms
of
whether
they're
a
violation
has
been
found
or
not
just
want
to
get
that
back
on
the
record.
Commissioner
Karen.
Your
vote
is
still
to
find
a
violation.
It.
D
B
Thank
you
item
number
10
was
an
informational
hearing
does
not
require
a
vote
from
the
board,
but
if
there
is
anything
the
board
would
like
to
discuss,
the
licensee
is
154
Maverick
LLC
doing
business
as
Maverick
House
Tavern,
located
at
154
Maverick
Street
in
East
Boston
informational
hearing
regarding
non-use
of
the
license
ownership,
beneficial
interest
in
the
licensee
entity,
manager
of
record
of
the
licensee
entity
and
oversight
and
control
of
the
day-to-day
operations
of
the
licensee
entity.
Chris,
who
went
to
mass
generalize,
chapter
138
sections,
12,
15a,
23,
26,
24
and
77.
C
Thanks
Danny
I
just
have
a
few
comments.
I
had
a
lot
of
comments
on
on
Wednesday
but
I'm,
sorry
on
Tuesday,
but
as
I
said
on
Tuesday,
we
want
to
see
this
license,
put
to
good
use
and
proper
use,
and
the
purpose
of
the
hearing
was
to
try
to
determine
what
was
happening
at
this
location
and
whether
or
not
this
license
is
serving
the
purpose
of
a
neighborhood
restricted
license.
C
This
license
has
no
monetary
value
on
the
open
market,
which
I
think
was
lost
in
some
of
the
testimony
we
heard
the
change
in
ownership
interest
was
approved
by
this
board
and
the
abcc
based
on
a
superior
court
order.
In
an
opinion
of
the
board,
this
neighborhood
restricted
licenses
outside
the
scope
of
any
marital
asset.
C
It
does
appear
that
the
ongoing
litigation
is
still
the
ongoing
litigation
is
still
trying
to
determine
the
division
of
other
marital
assets
and
I
would
be
hesitant
to
take
a
drastic
measure
until
all
of
those
issues
have
been
properly
resolved.
That
being
said,
I
want
to
see
this
license
put
to
good
use
under
the
control
of
the
licensee.
It
appears
based
on
the
testimony
that
the
license
is
soon
to
be
put
to
good
use
with
a
restaurant
opening,
according
to
the
testimony
this
week
or
or
as
early
as
September
I
know.
C
According
to
the
testimony,
this
week
is
early
September
and
the
licensee
was
just
has
just
submitted
an
application
for
a
new
DBA
for
the
new
restaurant
concept.
I
would
like
to
schedule
another
hearing
on
the
DBA
change
for
our
next
transactional
hearing
and
use
that
as
an
opportunity
for
the
licensee
to
appear
again
with
his
consultant
and
partner,
and
explain
fully
to
the
board
the
New,
Concept
and
structure
I'm
very
concerned
about
what
sounds
like
a
pattern
of
this
licensee
bringing
on
Partners
or
operators
who
do
not
fully
understand.
C
I
think
it's
a
valid
point.
Commissioner
Karen
and
I
would
support
scheduling
and
cancellation
hearing
for
October.
D
Yeah
I
agree
with
all
that's
been
said,
I
think
there's
some
issues
to
me
that
go
toward
the
character
and
fitness
of
the
of
the
operator
I.
Just
it
just
seems
concerning
that
there
are
a
drastic
miscommunications
between
him
and
anyone.
He
has
as
a
partner
or
operator
or
manager.
It's
I
think
it's
all
very
confusing
and
I
think
it
goes
to
its
character.
Figures.
B
On
this
item
sounds
like,
or
it
will
schedule
a
transactional
hearing
on
the
DBA
change,
but
expect
the
licensee
and
the
consultant
to
appear
and
explain
the
partnership
to
the
board
and
also
as
a
Fail-Safe
schedule,
or
look
towards
scheduling
a
cancellation
here
in
October.
Should
that
not
work
out?
C
B
A
C
D
A
C
A
A
C
About
to
approve
and
I
do
think
that
the
minute
manager
should
put
a
plan
in
place
should
she
be
doing
a
reading,
and
someone
comes
in
off
the
street
to
purchase
some
of
the
other
Goods
that
are
there,
whether
it's
additional
staff
or
by
appointment
but
I,
don't
think
it's
our
role
to
get
involved
in
the
day-to-day
operations,
but
I
do
approve
this
license.

A
A
C
Thanks
Danny,
there
was
a
request
from
the
neighborhood
to
defer
this
until
after
the
community
process,
I
know
this
board.
We
are
very
sensitive
to
the
concerns
of
the
neighborhood,
but
we
also
have
an
abbreviated
hearing
schedule
in
August,
which
means
our
next
transactional
hearing
to
vote
on
this
wouldn't
be
until
September.
That
being
said,
this
is
an
alteration
of
premise.
They
are
already
operating
in
the
adjacent
space.
I,
don't
think
deferring
this
would
harm
this
business.
It's
not
like.
They
have
to
close
down
until
we
vote
on
this
again.
C
I
I
would
like
them
to
go
back
finish
the
community
process
and
then
come
back
to
us
at
our
next
transactional
vote.
So
my
vote
here
would
be
to
defer.
A
I
would
vote
to
approve
it
today.
It
wasn't
clear
to
me
why
the
community
process
hadn't
gone
through
and
whether
the
the
applicant
had
any
you
know
probability
and
having
it
not
not
go
through.
So
without
an
explanation
of
why
it
hadn't
happened.
I,
don't
I
didn't
really
want
to
hold
them
up
on
this
one
so
I
was
holding
I
was
Voting
to
approve
today
sorry
go
ahead.
C
B
So
on
this
one,
we're
actually
not
not
entirely
sure
there
was
another
one
where
it
well
we're
going
to
later,
where
the
applicant
was
operating
under
instructions
from
ons.
This
one
potentially
fell
through
the
testimony
from
ons
was
that
there
was
turnover
in
ons
in
this
neighborhood
and
they're
not
entirely
sure
what
happened
with
this
community
process
either.
A
D
A
The
applicant
dropping
the
ball
for
me,
I
I,
don't
think
it's
fair
in
our
part
to
hold
this
up
because
anything
can
happen
while
we're
deferring
that
could
cause.
You
know
this
thing
to
get
kicked
further
down
the
road
so
yeah
and
the
fact
that
it's
moving
into
another
space
that
was
already
a
restaurant,
was
compelling
to
me
too.
So
I
just
didn't
think
there
was
enough
to
hold
them
up
here.
So
I,
don't
I.
Just
felt
like
there
was
a
very,
very
small
chance
that
there's
going
to
be.
D
C
Yeah,
even
though
the
other
application
is
a
couple
of
down
on
the
agenda
I,
we
have
been
speaking
to
their
attorney
and
the
neighborhood
for
the
last
24
hours
trying
to
determine
what
happened
here
and
at
the
other
on
the
other
application.
It
seems
as
if
they're
following
and
this
one
that
they
it
doesn't.
We
don't
know
what
happened
and
the
other
one.
They
were
following
the
advice
of
ons.
C
However,
you
know
it
could
be.
In
my
opinion,
they
should
have
gone
to
the
neighborhood
anyways
on
the
other
one.
But
if
you
know
I
I
understand
where
commissioner
Curran's
coming
from
so
commissioner
Saxon
I,
don't
know
what
your
vote
is
here,
but
I
respect.
Where
he's
coming
from
on
that,
one
too,
so
I'd
be
willing
to
move
this
forward.
D
C
This
one's
are
open
and
operating
already,
it's
a
local,
it's
a
restaurant,
that's
aren't
operating
the
other.
One
is
a
a
national
restaurant
that
if
they
were
deferred,
it
would
put
them
back
a
month
or
even
more
for
us
to
wait
right
in
order
for
them
to
get
the
next
get
everything
else
in
order
to
then
come
into
the
space
yeah.
So
that
would
have
a
more
financial
impact.
Should
we
defer
it's
the
same
attorney,
it's
the
same
neighborhood
group
and
so
looking
at
them.
C
Two
different
neighborhoods
but
I'm,
sorry,
they
Owen
I'm.
Sorry,
it's
the
same
attorney
in
ons
breakdown
of
communication
and
I.
Just
don't
want
to
not
be
sensitive
to
the
neighborhood,
but
I
also
want
to
weigh
the
impact
on
small
business
and
thrown
into
the
mix
is
the
fact
we
don't
have
another
hearing
for
a
month
so
on
this
one
they
are
already
open
and
operating
I.
Don't
think
it's
going
to
have
a
big
impact
on
business
should
they
wait
for
this
alteration
of
premise
to
go
through,
but
I
I
respect.

my
opinion,
but
technically
they
don't
have
to.
They
were
