Description
City of Boston Licensing Board - LPI Hearing - 3/22/22
A
B
A
Are
appearing
or
testifying
before
the
board
good
morning?
This
is
a
hearing
before
the
licensing
board
for
the
city
of
boston.
Today
is
tuesday
march
22nd
2022.
Today's
hearing
is
being
held
pursuant
to
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet.
Virtually
today's
hearing
will
be
recorded
and
posted
to
the
city
of
boston's
website.
Before
every
procedural
matters,
I
will
introduce
chairwoman
kathleen
joyce.
A
Thank
you
please
ensure
that
your
audio
and
visuals
are
working
properly.
I
will
call
each
item
in
the
order
that
it
appears
on
today's
agenda.
I
will
then
ask
who
is
present
on
behalf
of
the
licensee,
who
is
president
on
behalf
of
the
boston
police
department
and
whether
there
are
any
other
individuals
with
first-hand
knowledge
of
the
alleged
incident
who
wish
to
testify.
A
I
will
then
swear
in
all
parties,
after
which
the
police
report
will
be
read
into
the
record.
The
licensee
or
the
representative
will
have
the
opportunity
to
make
a
brief
statement
followed
by
questions
by
the
chairwoman
and
the
commissioners.
Again,
all
testimony
will
be
limited
only
to
individuals
with
first-hand
knowledge
of
the
alleged
incident.
A
We
will
start
with

Perhaps
I
was
just
misinformed
and
I
am
here
for
the

The
harp
in
boston
upon
arrival
officers
were
met
by
employees
of
the
harp,
who
stated
that
one
of
the
patrons
had
been
assaulted
inside
the
bar,
the
officers
were
escorted
to
the
basement
level.
H
Officers
were
directed
to
eric
jones.
The
victim
officers
observed
jones
to
be
carrying
grey
sweatshirt
with
dried
blood
on
it.
Officers
asked
jones
what
had
happened
to
which
he
initially
or
luck
was
a
rocklin
to
answer
any
questions
eventually
jones
stated
that
he
had
been
punched
in
the
face
by
a
white
male
ems
ambulance.
15
arrived
on
scene
jones,
declined
declined
to
be
taken
to
the
hospital
for
further
evaluation.
H
Officers
then
spoke
with
jamie
roberts.
General
manager
of
the
harp
roberts
showed
officers
security.
Footage
of
the
incident
officers
observed,
observed
on
security
footage
jones
stumbled
into
a
group
of
unknown
people,
the
two
unknown
males
the
suspects
then
proceeded
to
strike
jones
and
jones
and
jones
fall
to
the
ground.
The
fight
happened
on
the
first
floor
of
the
bar
suspect
number
one:
a
white
male
with
a
mohawk
style,
hair
wearing
a
camo
jacket
and
blue
jeans
suspect
number.
H
Officers
escorted
jones
out
of
the
harp
and
observed
his
speech
to
be
slurred
unsteady
on
his
feet
and
have
bloodshot
eyes.
Officers
advised
jones
to
call
for
an
uber
and
go
back
home
to
needham
jones
stated
that
he
was
going
to
try
to
get
into
another
bar
slash
establishment
officers
then
strongly
advised
shone
to
go
home
as
he
was
intoxicated
and
unable
to
properly
fend
for
himself.
Jones
became
verbally,
combative
toward
officers,
insulting
them
and
calling
them
quote.
Unquote.
H
D
Thank
you
very
much
attorney
green.
Yes,
sir.
May
I
first
ask
sergeant
mcizek
you.
Your
report
indicates
management,
cooperated
right,
sir.
Yes,
yes,
sir,
and
did
you
inter
interface
with
mr
roberts?
You
know
I'm.
H
Sorry,
I'm
not
I
I
wouldn't.
I
wouldn't
be
able
to
remember
off
the
top
of
my
head
who
it
was.
Maybe
if
I
saw
her,
maybe
if
I
saw
him
I'd
recognize,
but
I
don't
remember
but
whoever
I
spoke
with,
they
cooperated
completely.
D
H
I
don't
I
don't
know,
I
don't
know
exactly
called
maybe
officer
murphy
could
bring
some
clarity
to
that.
H
If
you,
if
you
give
me
this,
if
you
give
me
a
moment,
I
can
try
and
see
if
I
can
find
it
on
the
the
cat.
If
I
can
look
it
up,
but
if
that's
the.
D
D
I
The
staff
called
the
police-
I
can't
remember
exactly
who
called
the
of
the
staff
members,
but
we
called
the
police.
D
D
I
I
We
saw
them,
we
observed
them,
they
were
actually
wearing
the
same
clothing
as
the
night
of
the
incident.
I
approached
them
and
I
asked
them.
I
said
you
guys
started
a
fight
a
couple
weeks
ago,
I'm
not
going
to
let
you
in
and
they
kind
of
denied
that
anything
happened.
So
I
ran
downstairs
and
I
got
a
copy.
I
took
a
video
of
the
video
and
brought
it
back
upstairs,
but
by
the
time
I
came
back
upstairs
they
had
already
left.
I
D
All
right
thanks,
drive,
no
further
questions.
The
chair
and
the
members
may
have
some.
A
No
questions.
Thank
you
great.
Thank
you.
All
the
board
will
take
this
matter
under
advisement.
Thank
you
thanks
jamie.
Thank
you.
Thank
you.

This

is
authored
by

robert
walton.

also
walter,
while
working
the
front

at
district
station
d4
took
a
walk-in
assault
and
battery
report,
which
had
occurred
at
52
gainsborough
street
the
victim.
J
J
J
J
All
parties
involve
our
students
at
northeastern
university.
Northeastern
is
aware
of
the
situation.
They
complete
a
report
and
their
report
number
is
211601
is
that
it
is
additionally
being
handled
internally
by
north
eastern,
the
the
victim
said
that
he
rushed
to
the
hostage
immediately
following
the
incident.
He
said
that
he
he
has
medical
papers
from
the
incident
also
has
pictures
of
the
the
parties
involved.
J
The
bar
believed
to
have
video
cameras.
It
was
advised
that
the
report
would
be
written.
Regarding
the
incident
I
had,
I
had
the
opportunity
to
visit
and
also
to
complete
a
cold
35
at
that
location.
J
I
spoke
to
charles
hitchcock,
who
is
the
I
believe,
the
the
manager
or
the
gm
there
he
fully
cooperated.
He
was
able
to
provide
me
the
video
of
the
incident,
the
the
the
uniqueness
of
this
particular
video.
It
was
captured
exactly
where
everything
dancing
happened.
With.
That
being
said,
I
had
an
opportunity
to
to
do
it
to
interview
the
victim
as
well
as
girlfriend
who
was
president
at
that
time.
J
The
video
after
their
interview
I
gave
I
showed
the
the
video
to
the
victim,
and
I
wanted
him
to
see
what
happened
because
I
I
have
already
reviewed
the
video
and
it
clearly
indicated
that
the
victim
kind
of
basically
started
the
whole
situation
and
from
observing
the
video
he
concluded
that
he
did
not
want
to
pursue
the
matter
further.
A
D
Detective,
you
did
say
mr
hitchcock
cooperated
with.
You
gave
you
the
video.
Yes,
would
you
would
you
describe
this
the
alleged
victim,
as
I
mean
it,
sounds
like
he
was
a
little
off.
Would
that
be
safe
to
say.
J
Well,
everyone
was
off
based
on
the
video.
J
It
does
appear
that
the
individual
that
he
was
that
he
indicated
that
bumped
his
girlfriend
was
was
appeared
drunk
so,
but
when
the
second
time
he
bumped
her,
I
mean
it
was
crowded,
so
you're
gonna
bump
people,
but
he's
the
one
who
kind
of
initiated
poking
at
him.
Saying
telling
him.
J
I
don't
know
what
they
were
saying
because
there's
no
audio
to
the
video,
but
it
clearly
shows
the
victim
poking
to
attack
two
times
two
to
three
times
the
alleged
suspect
and
then
his
his
friends
came
to
his
defense
and
he
just
kept
going
at
it
and
that's
how
this
whole
fight
started
right.
So
all
right.
J
Yeah
it
it,
there
was
no
9-1-1,
it
did
based
on
the
video,
it
didn't
look
like
there
was
any
security
and
that's
that
little
space,
so
there
was
not
no
9-1-1.
J
The
gentleman
walked
out
and
I
believe,
based
on
some
of
the
information
I
got
was
security
did
ask
him
if
you
needed
help
or
something
which
he
declined
and
in
my
understanding
he
went
to
the
hospital
right
away.
I
made
contact
with
him
and
I
was
able
to
get
his
injuries
a
bit
photos
of
his
injuries,
a
photo
of
some
of
his.
J
Some
other
photos
which
reflects
the
condition
of
the
place
prior
to
talking
to
them
directly.
D
And
just
by
way
of
time
frame
here,
his
his
walk-in,
this
incident
occurred
on
december
10th
and
his
walk-in
was
five
days
later
on
december
15th.
J
Yeah
my
understanding,
the
reason
why
is
because
he
was
hurt,
he
actually
hurt
his
ankle
well,
based
on
what
I
saw
it
was
he
they
kind
of
toppled
over.
J
A
table
yeah
and
and
that's
kind
of,
and
then
it
appears
from
just
the
angle
which
the
fight
was
happening.
It
appears
that
he
just
got
the
worst
of
it.
Basically,.
D
D
And
with
regard
to
this
incident,
did
you
are
you
the
individual
who
provided
the
video
to
the
bpd?
I
am,
and
did
you
answer
all
of
their
questions
and
cooperate
with
them?
I
did.
Did
you
discover
from
your
staff
anything
about
the
incident
following
up
on
it.
K
C
I
do
I
don't
know
if
there's
questions
for
the
detective
or
for
mr
hitchcock,
but
how
long
would
you
say
this
fight
took
place?
How
long
a
couple
minutes
was
it.
D
J
K
D
Again,
attorney
green,
dennis
quilty,
representing
the
licensee
with
me,
is
mr
hitchcock
previously
sworn.
Thank
you
thank.
A
A
N
Perfect
so
there's
two
parts
to
this.
This
report,
the
the
initial
incident
report,
was
authored
by
sean
vardal
at
about
10
20
p.m.
On
december
11,
2021
officers,
bardal
and
sparrow
responded
to
52
gainsborough
street.
N
It
came
in
originally
as
our
house
restaurant,
but
I
think
the
name
has
changed
to
the
two
saints
tavern
for
a
report
of
a
female
that
drank
too
much
and
was
unconscious
upon
rival
officers
met
with
the
house
manager,
chuck
hitchcock,
who
directed
officers
to
a
female
at
the
bar
that
appeared
to
be
heavily
intoxicated
and
unable
to
stay
female
later
identified.
N
A
victim
was
being
held
onto
a
chair
by
a
group
as
she
was
unable
to
support.
Herself
officers
spoke
with
the
bartender
caitlin's
celery
salerno,
who
stated
that
she
had
served
the
victim
her
drinks,
all
night
salerno
stated.
She
believed
the
victim
might
have
had
a
date,
rape,
drug
put
in
her
in
her
drink
salerno.
Further
the
state
of
the
victim
had
about
six
mixed
strings
and
also
smoked
marijuana
mit
ambulance,
8
responded
to
the
scene
and
transported
the
victim
to
brigham
women's
for
further
treatment.
N
I
had
stopped
by
personally
to
the
bar
on
december
13th,
but
I
believe
that
was
a
monday
and
the
bar
was
closed.
I
was
then
able
to
stop
by
on
saturday
december
18th
at
about
eight
o'clock
with
police
officer
mcmorrow,
the
delta
431.
N
B
A
D
And
the
did
you
was
there
any
further
information
garnered
with
regard
to
the
quote:
unquote
date:
rape,
drug
allegation,
it
seems
as
though
there
have
been
a
few
of
these
recently
around
the
city
that
have
been
happening
all
over
the
place,
quite
frankly,
which
is
the
first
time
in
a
couple
of
years
that
I'm
aware
of.
Is
there
any
anything
going
on
in
that
regard?
You
discover
about
this
incident.
D
N
It
was
a
hypothetical
that
that
she
threw
out
to
the
initial
responding
offices,
but
no
no
real
evidence
that
would
even
give
rise
to
the
reasonable
suspicion.
However,
I'm
aware
that
we
had
published
a
couple
of
warnings
right
around
that
time
frame
prior
to
this
incident,
that
there
was
some
concern
about
date.
Rape,
drugs,
however,
like
I
said,
I
couldn't
confirm
or
dispel
that
that
was
the
cause
in
this
particular
case.
D
D
K
The
police
and
the
emts
arrived.
What
we
did
was
try
to
provide
them
with
all
of
the
information
that
the
friends
gave
us,
they
had
stated
that
they
were
previously
smoking
marijuana
before
they
came
to
this
again.
It
was
just
a
two-hour
private
event
and
that,
throughout
the
entirety
of
the
night
she
probably
had
six
drinks.
D
So
when
you
say
the
entirety
of
the
night,
meaning
both
prior
to
her
arrival
at
your
establishment
and
and
while
at
your
establishment,
that's
correct
and
the
the
information
that
this
was
provided
by
this
young
young,
woman's
friends
or
colleagues,
whoever
they
were
at
the
party
was
that's
correct,
okay
and
did
your,
did
you
have
any
further
information
with
regard
to
a
like,
a
roofie
or
date,
rape,
drug
or
any
such
thing?.
K
D
All
right
and
then
you
you
stood
by
and
you
were
then
did
you
go
over
any
of
these
matters
with
your
staff.
After
the
incident.
O
K
You
know
letter
that
they
put
out
regarding
the
possibility
of
these
date
rape,
drugs
and
to
make
sure
that
everybody
is
up
to
date
and
aware
of
what
they
needed
to
be
paying
attention
to.
A
A
Thank
you.
All
the
board
will
take
this
matter
under
advisement.
Thank
you.
Thank
you.

Upon

officers

the

in

of
tommy

Cottage

approached
the

and
made
contact
with
thomas

The

mr

stated
that
his
girlfriend
and
her

were
attacked
by
bouncers
at
the

Mr
frisbee
stated
that
the
bouncers,
both

kicked

then
made

with

Ms
flynn
stated
that
she
was
out
celebrating
her
birthday
when
she
was
attacked
by
bouncers
at
the

Q
Miss
flynn
said
that
she
was
slammed
to
the

by
one
of
the
bouncers
and
was
kicked
and
punched

Ms

saying
that

mr

stated
to
officer

that
he
had
a

Q
Ms
epstein
then
stated
that
she
was
also
kicked
in
the

while
on
the

officer
driscoll
requested,
if
any
of
the
victims

they
all
stated.

Q
Q
Let
it
be
known
that
officer
driscoll
was
shown
the

upon

from
mr

the

this
video
showed
a

apparently
in
the
doorway
of
the

Driscoll
was
able
to
speak
with
that

mr

What
should
say
that
one
of
the
females
was
grabbing
his

which
caused
his

to
fall

Mr

A
You
detective
attorney
blitzer.
Would
you
like
to
address
the
alleged
incident.
P
Detective,
you
were
not
there.
That
night
were
you.
P
I
have
no
further
questions
for
the
detectives.
I'd
like
mike
neff
is
the
manager
that
was
working
on
duty
that
night.
If
I
can
ask
some
questions
from
mr
neff,
please
do.
Thank
you,
mr
nephew.
You
were
working
the
night
of
the
incident
correct.
P
And
how
many
employees
were
working
that
night.
R
P
In
the
doorstep
that
you
had
working
with
the
individuals
that
have
been
working
at
the
bar
for
a
period
of
time,.
R
So
we
had
a
nice
crowd
in
here
that
evening,
maybe
about
140
people.
These
girls
came
in
come
up
to
the
bar.
We
have
like
a
service
area
where
you
can
walk
up
and
order
a
drink.
They
kind
of
bumped
up
against
another
group
next
to
the
service
area
and
just
had
some
words,
but
it
was
nothing
that
we
thought
was
going
to
be
a
problem.
R
They
stepped
back
and
then
kind
of
kept
coming
back
up
to
the
area,
just
kind
of
being
a
little
bit
belligerent
and
rude
to
these
girls.
It's
that
point
just
not
wanting
to
have
any
issue
between
the
two
groups.
We
decided
to
ask
these
girls
to
leave
and
where
was
a
group
of
girls,
I
asked
leah
to
go
around
the
bar
with
our
door
staff
to
just
escort
them
towards
the
exit.
R
I
stayed
behind
the
bar
kept
an
eye
on
everything
else
and
I
looked
over
as
they
were
exiting
and
saw
some
commotion
at
the
doorway,
which
looked
like
you
know.
Some
some
people
had
fallen
down
a
little
bit
of
chaos
there,
so
I
turned
up
the
lights.
It
was
close
to
last
call.
Anyhow,
stop
service
and
where
I
could
see
there
was
commotion
and
some
kind
it
looked
like
shoving.
I
went
ahead
and
called
911
just
to
assist
with
us
getting
them
out
of
the
bar.
R
Outside
they
were
aggressive,
they
were
kind
of
kicking
at
employees.
Actually,
one
swung
and
hit
our
bartender
leah
in
the
face.
Just
they
weren't
happy
that
they
were
asked
to
leave.
They
were
out
celebrating
a
birthday
party.
Our
staff
just
is
always
trained
to
de-escalate
we're,
not
hitting
people.
We,
I
don't
even
like
putting
hands
on
anybody,
but
they
were
just
uncooperative
fairly,
belligerent
and
just
didn't
want
to
go.
They
weren't
happy
about
it.
P
At
some
point
I
know
the
report
talks
about
nathan
orchard,
the
he's
one
of
the
door
staff
correct.
R
Right
when
the
one
of
the
girls
was
on
the
ground,
they
were
kind
of
like
flailing
about
and
one
was
grabbing
at
his
leg
and
pulled
his
shoe
off.
He
had
to
actually
go
and
get
his
shoe
off
the
ground
from
out
front
because
they
were
just
so
uncooperative
with
wanting
to
leave.
P
And
did
you
see
any
of
your
staff
strike
any
of
the
patrons.
R
We
train
on
higher
and
then
we
review
it
pretty
frequently,
especially
with
all
the
covert
protocols
and
the
date
rape,
advisory
and
things
like
that,
we're
in
constant
communication
with
our
door
staff
about
what's
going
on
and
what's
expected
of
them,
and
it's
not
something
I
could
see
what's
alleged
in
the
report
as
having
happened.
P
And
as
a
result
of
this
incident,
did
you
have
further
meetings
with
your
security
staff
and
fire
staff.
R
We
reviewed
that
that
night
our
owner
was
in
the
next
day
we
went
over
it.
I
was
fairly
confident
in
our
staff
that
we
did
the
correct
thing
in
in
having
these
females
leave.
The
bar.
P
R
Fully
that
night
and
detective
magoon
came
in
maybe
two
days
later,
I
was
working
and
cooperated
with
him
then
as
well.
We
appreciated
the
response.
C
I
do
from
the
time
you
asked
this
group
to
leave
until
the
time
they're
outside
how
how
much
time
went
by.
R
I
would
say
less
than
five
minutes,
you
know
we'd
come
around
the
counter
and
just
said
yeah.
You
know
it's
time
to
go.
R
Once
I
saw
the
in,
you
know,
kind
of
scuffle
towards
the
front
door,
I
turned
the
lights
on
and
we
stopped
completely
stopped
service.
It
was
right
at
last
call
anyhow.
R
Typically,
around
the
beginning
of
every
month,
like
I
would
say
at
christmas
time
there
we
just
did
this
happen
in
december.
We
we
do
it
frequently
enough
people
are,
are
very
well
aware.
We
try
to
send
multiple
staff
members
over
just
you
know
to
to
calmly
approach
them.
That's
particularly
where
these
were
females.
I
wanted
to
have
leah,
go
around
and
just
have
a
softer
touch
to
it,
but
we
we
do
it
frequently
that
that's
we
have
a
no
tolerance
policy
for
anything
aggressive
from
our
door
staff.
C
A
T
Good
morning,
commissioners,
my
name
is

I'm

The

of
the
incident.
A
O
A
O
You
all
right
and
just
to
clarify
prior
to
reading
the
report,
there's
just
for
clarity
purposes,
there's
more
than
one
victim
victim
number
one
is
referred
to
as
charlie.
That's
actually
a
female
and
she
wasn't
on
scene.
So
we
only
have
the
name
charlie
as
a
reference,
but
that
is
a
female
victim.
O
O

O

he

A

the

Ems
on

with

that
there
was
no

As
a
result
of
the

and
stated
he
did
not

O
Officers
spoke
with
the
suspect,
mr
adams,
and
questioned
what,
as
he
questioned,
why
officers
were
speaking
with
him.
Officers
asked
the
suspect
what
happened
prior
to
their
arrival
as
he
was
unable
to
communicate
the
events
of
what
happened
after
leaving

A
Thank
you
lieutenant
attorney
albrecht.
Would
you
like
to
address
the
alleged
incident.
T
T
O
They
appeared,
I
mean
they
admitted
that
they
had
been
drinking
for
the
night.
They
were
also
inside
anchovies.
They
said
that
they
were
on
a
date.
They
were
just
concerned
about
the
behavior
that
they
saw
inside
and
transferred
outside.
T
And
if
I
understand
correctly,
there
was
no
activity,
no
physical
activity
or
fighting
or
arguing
that
went
on
inside
the
bar.
To
the
best
of
your
knowledge
is
that
right.
T
T
No
further
questions.
Members
of
the
commission
I
had
submitted
a
statement
by
one
of
the
witnesses
who
was
named
by
the
police,
is
sienna
nagel
thompson.
She
couldn't
be
present
at
this
hearing.
She
just
got
a
job
with
a
travel
agency
and
she's
actually
traveled
to
columbia,
south
america
and
couldn't
participate
by
a
computer
either,
so
I
knew
she
wouldn't
be
able
to
so.
I
admitted
that
I'd
just
like
to
touch
on
a
few
points
that
were
in
that
in
that
report.
T
If
I
could
the
I
I
have
also
submitted
along
with
that
statement,
the
current
business
certificate
for
anchovies,
which
you'll
see,
has
now
been
taken
care
of,
and
also
tips,
training
certificates
for
mr
tully,
the
manager
in
bartender
who
was
on
service
at
night
and
mr
talieri.
T
I
submitted
the
statement
of
ms
nagel
thompson
siena
to
make
things
simple,
because
I.
T
Some
context
here
and
gives
a
better
understanding
of
the
events
the
woman
charlie
who's
identified
as
his
victim.
One
came
into
anchovies
with
this
fellow
daryl
adams,
the
man
who's
now
identified
as
a
suspect.
They
came
in
late
sometime
after
11
30,
and
they
came
to
the
bar
as
a
couple
out
for
the
evening.
T
The
manager,
joe
tully,
who
will
testify,
recalls
them
coming
in
as
as
a
couple,
they
ordered
a
drink
without
any
signs
of
speech,
problems
or
physical
problems
and,
as
sienna
later
found
out.
As
she
said
in
her
statement.
T
In
her
conversation
with
charlie,
that
charlie
and
and
this
guy
adams
had
gotten
together
earlier
in
the
afternoon,
charlie
had
apparently
just
lost
her
job
that
day,
so
she
was
feeling
down
and
the
two
of
them
had
some
drinks
at
several
other
establishments
before
they
came
to
anchovies.
T
Sienna
also
observed
that
charlie
looked
kind
of
remote
when
she
saw
her
inside
the
bar,
but
not
really
drunk
the
activity
inside.
The
bar,
as
now
has
been
testified
to
was
entirely
nothing
more
than
conversation,
and
it
was
mostly
conversation
between
one
of
the
two
witnesses
maggie
and
both
charlie
and
adams.
T
T
Charlie
had
spent
the
afternoon
with
adams,
but
now
had
come
to
the
conclusion.
It
was
time
to
go
home
and
she
wanted
to
be
alone
sienna,
as
you
said
in
the
report
also
learned
later,
that
charlie
had
had
some
problems,
difficulties
with
people,
including
her
father
in
the
past,
and
did
not
want
anybody
to
know
where
she
lived,
which
was
one
reason
she
wasn't
asking
somebody
to
get
her
an
uber
or
or
even
to
take
her
home.
T
She
just
wanted
to
walk
home
alone,
eventually,
charlie
left,
the
bar
and
the
other
witnesses
advised
adams
to
just
leave
her
alone
and
let
her
go
home.
But,
as
the
events
show,
adams
decided
shortly
after
that
to
leave
and
he
followed
charlie
outside
and
that's
caused
the
witnesses
to
go
outside
just
to
make
sure
that
charlie
was
okay.
It
was
only
when
adams
went
outside
and
was
obviously
trying
to
get
together
with
charlie
that
the
conversation
that
had
been
going
on
inside
started
changing
to
action.
T
The
witnesses
tried
to
keep
adams
away
from
charlie,
and
he
obviously
became
increasingly
angry
and
then
eventually
got
this
from
the
vantage
point
of
the
bar,
and
mr
tully
will
testify
here,
he
had
no
way
of
knowing
what
might
be
going
on
outside.
Nothing
had
gone
on
inside.
This
wasn't
a
situation
where
there
was
loud
drunken
arguments
inside
that
turned
into
a
brawl
outside
as
sienna
kind
of
characterized
it.
This
was
the
result
of
a
man
acting
in
a
predatory
way,
rather
than
anyone
really
getting
over-served.
T
I'd
just
like
to
ask
mr
tully
a
couple
of
questions.
If
I
could
tully
you,
you
were
on
the
bar
that
night
is
that
correct,
correct
and
you
observed
the
victim
charlie
and
his
fellow
adams
committee
together.
Yes,
so
they
came
in
together
as
sort
of
as
as
a
couple
would
come
into
the
bar.
U
It
was
fine,
they
only
had
the
one
drink
and
I
it
was
a
saturday
friday
night,
and
so
they
were
fine
when
they
ordered
it,
and
I
had
seen
charlie
before
so
I
was
kind
of
it
was
seemed
normal
to
just
give
her
the
drink,
and
that
was
kind
of
my
interaction.
T
Okay,
did
you
observe
any
arguing,
yelling
any
any,
pushing
or
pulling
going
on
in
the
bar
that
involved
these
people?
No,
no
arguing
at
all.
It
was
just
the
girls
coming
to
talk
to
charlie,
but
even
still,
I
was
like
a
little
busy,
so
I
wasn't
completely
enthralled
in
what
was
going
on
with
them,
okay
and
by
the
after
this
incident
took
place
outside.
Were
you
aware,
by
the
end
of
the
night
that
that
incident
had
even
happened
outside?
I
had
absolutely
no
idea
that
that
happened.
T
Okay,
I
have
no
further
questions.
If
our
board
has
questions.
A
Thank
you.
All
the
board
will
take
this
matter
under
advisement.
Thank
you
very
much.
Thank
you.

Yes,
please,
good
morning,
madam
chair,
ladies
and
gentlemen
of
the
board,
I'm
not
100
sure,
but
I
know
we
have
this
down
as
royal
nightclub,
but
I
really
believe
this
was
downstairs
at
candy
bar
and
I
spoke
with
mr
barboza,
and
he
gave
me
a
report
here
that
I'd
like
to
read
to
the
board.
If
that's
possible,.
V
I
don't
know
how
many
times
people
lose
their
phones,
they
forget
where
they
put
them,
they
come
back
the
next
day,
we've
found
it
or
they
found
it
before
they
left.
V
We
told
him
that
he
would
have
to
wait
till
the
end
of
the
night
and
we
could
see
if
we
could
find
it
and
he
could
come
back
tomorrow.
He
got
very
angry
and
started
disrespecting
the
security
and
customers.
We
gave
him
several
warnings
to
stop
and
just
enjoy
his
night.
He
was
still
yelling
saying
no.
I
want
my
phone
now
once
he
tried
to
check
on
a
customer's
pocket.
We
told
him
he
had
to
leave
now.
I
spoke
with
mr
barboza
and
mr
barboza
said
that
he
walked
him
out.
V
I
went
back
downstairs
and
saw
him
and
then
finally
came
outside
later
and
saw
him
sitting
on
the
floor
and
a
police
officer
outside
was
asking
the
customer
what
he
was
yelling
at
the
officer
asked
me
if
he
could
get
his
phone.
I
said
that
he
had
to
wait
till
the
end
of
the
night
once
it
was
clear
and
the
lights
were
on.
She
said:
okay,
she
told
the
customer
the
same
thing,
but
he
kept
yelling
again.
A
Thank
you,
mr
del
video,
chairman
joyce.
Do
you
have
any
questions.
V
As
far
as
the
video
in
candy
bar
itself,
we
do
not
have
video
the
there
is
no
video
at
candy
bar,
but
I
will
check
with
linda
and
get
it
to
you
if
there's
some
security
upstairs
and
outside
of
the
building
that
could
see
that
we
walked
him
out
and
he
was
perfectly
fine.
C
Okay,
that
would
be
helpful.
I
would
assume
she
has
it
since
she
told
the
police
she
was
going
to
preserve
on
video.
So
I
will.
V
V
V
C
Dance,
we're
gonna
we're
gonna
move
on
we're
gonna
move
on
to
the
next
one.
So
thank
you.
A
X
Me
detective
kenneth
curly
from
area
a1.
Sorry,
I
think
I
missed
the
the
introduction
there.
If
I
could
just
add
this,
this
investigation
is
ongoing.
I
haven't
yet
sat
down
and
spoken
with
the
victim.
I
did
speak
with
him
briefly
on
on
the
telephone,
but
we
do
have
boston.
Police
does
have
flare
video
from
across
the
street
that
shows
the
front
door
and
and
that
this
incident
did
actually
take
place
out
front
on
the
sidewalk,
approximately
17
minutes
after
he
was
removed
from
the
club.
X
So
I'm
not
sure
if
they
also
have
video
of
the
front
door,
but
I've
also.
I've
also
spoken
with
stephen
barboza
he's
agreed
to
come
in,
hopefully
thursday
night
and
speak
with
me
about
this
issue
as
well.
X
So
when
the
victim
is
removed,
he
spends
the
next
and
actually
he's
aware
of
this-
I'm
not
apparently
he
didn't
log
in
but
he's
he
spends
the
next
17
minutes
harassing
the
staff.
He
has
a
cell
phone
in
his
hand,
he's
filming
the
staff
he's
flipping
him
off.
He's
looks
like
he's
debating
whether
he
can
be
on
the
sidewalk
or
not,
and
it
appears
that
eventually,
the
staff
loses
patience
with
him.
X
X
I
believe
it
see
it
was
cold
that
night,
so
they're
all
masked,
but
it
appears
to
be
three
three
members
of
the
door
staff
and
one
of
them
does
punch
the
victim
in
the
face.
C
And
you'll
forward
that
video
to
the
board.
S
I'm
I
I
guess
I
have
a
lot
of
questions.
Do
we
have
any
response
to
the
allegations
with
the
video
shows.
V
V
I
have
not
seen
this
video,
I
would
love
to
see
it,
and
then
I
could
tell
who
these
people
are,
because
I
have
one
doorman
up
at
the
top
of
the
stairs.
I
have
one
dorm
that
does
pat
downs
and
in
this
particular
entrance,
royale
comes
in
there
candy
vacuums
in
there.
So
you
know,
like
mr
barboza
said,
we
walked
him
upstairs.
He
was
perfectly
fine.
He
went
outside
mr
barboza
went
back
downstairs
after
that.
I
don't
know
what
happened
outside,
but
this
video
could
help
me
also
to
find
out
what
really
went
on.
C
V
V
Outside
the
building,
I
do
not
not
outside
the
building.
No,
because
we
have
a
nightclub
going
on
downstairs
and
we
need
to
take
care
of
what's
going
on
downstairs.
You
know
if
you
look
at
my
record,
my
record
stands
for
itself
on
on
anybody
getting
hurt
or
punched
in
candy
bar.
The
answer
is
almost
zil.
Nothing
and
I
you
know,
there's
nothing
more
satisfying
than
going
to
work
having
a
great
night
and
getting
everybody
out
safely
throughout
the
whole
night.
S
Are
there
still
like
on
a
saturday
night
like
this?
Are
there
still
police
in
that
area
regularly
posted.
V
We
have
a
if
I'm
correct,
that
we
have
a
traveling
group
that
goes
around
and
that
we
all
pay
for,
and
you
know
what,
when
we
brought
this
individual
up,
he
walked
right
up
with
our
doorstep,
with
stephen
and
and
stephen
is
not
the
kind
of
man
that
would
do.
This
he's
been
with
me
four
or
five
years,
and
I
depend
on
him
a
lot
and
he
knows
exactly
what
I
want
from
outdoor
staff.
L
V
You
know
on
the
floors
and
and
so,
if
there's,
if
there's
a
situation
and
and
again
if,
if
this
indication
needed
to
be
called
9-1-1,
I
would
have
done
that
in
a
moment,
but
he
walked
right
upstairs
and
he
had
his
cell
phone
in
his
pocket.
I
don't
know
what
this
man
was
doing
and
I
don't
know
if
the
person
that
allegedly
had
maybe
hit
him
who
it
was
but
I'll
tell
you
right
now
was
not
one
of
my
personal
staff
and
that
video
will
help
me
to
get
to
the
bottom
of
this
case.
C
One
question:
what
does
your
staff
wear
for
uniforms
just
so
that
we
can
identify
who's
in
the
video.
V
There
well,
if
there
was
outside
everybody's
gonna,
have
jackets
on,
and
you
know
it's
so
cold
outside
that
they
freeze
out
there
as
it
is
so
if
outside
would
be
a
little
more
difficult.
C
A

that
just
brought
this
to
the
attention
of
the
person
in

Mr
zach
zialbro,
the
ceo,
was
stated.
He
would
immediately
bring
the
establishment
into
compliance
over
a
result
of
what
detectives
observed.
Child
detective,
william
gallagher,
issued
licensed
promise
inspection
notice,
zero,
four,
four,
six:
six
zero
for
overcrowding
of
the
establishment.
This
this
is
your
sign
for
an
accepted
notice
as
well.
D
Thank
you
if
I
may
like
to
just
ask
detective
fernandez
a
couple
of
questions
detective
when
you
arrived
on
premise,
was
there
a
line
outside
the
premise
for
admission.
D
And
did
you
recall
whether
the
various
egresses
in
the
establishment
were
clear.
D
D
May
I
just
inquire
mr
shaw
and
the
staff
you're
right
and
mr
just
you,
you've
been
sworn
just
identify
yourself
for
the
record.
Please.
D
Y
Yeah
we
we
always
have
two
guys
on,
especially.
I
think
this
was
the
night
before
thanksgiving
any
any
major
nights,
thursday.
Through
sunday.
They
keep
an
accurate
account.
Then
we
start
a
line.
If
the
demand
is
there
the
check,
ids
and
check
egresses
throughout
the
night
we
always
have
two
or
three
guys
stationed
inside
two
with
the
door.
You
know
priority
for
us
is
creating
a
safe
environment
for
the
patrons
that
are
inside.
D
And
on
the
night
in
question,
can
you
verify
that
indeed,
a
a
line
had
been
started
outside?
Yes,
I
mean
to
your
knowledge:
did
your
staff,
you
know,
take
an
appropriate
account.
Y
To
my
knowledge,
yes,
but
if
detective
hernandez
got
a
different
count,
then
that
that's
the
county
has
and.
D
C
Thank
you
either
mr
shaw
or
attorney
quilting.
How
many
staff
did
you
have
working
that
night?
All
total.
Y
C
A
Thank
you.
Thank
you.

D
If
I
may
detective,
did
the
management
cooperate
with
you?
Yes,
sir.
The
information
that
I've
gotten
in
reviewing
this
was
that
there
was
a
staff
person
with
this
group
but
was
not
easily
identifiable
at
that
time
in
question.
Did
you
inquire
whether
there
were
any
staff
people
in
the
in
the
area.
M
D
Thank
you,
sir.
Mr
chong.
Are
you
with
us?
Yes,
yes,
can
you
can
you
explain
to
the
board
what
happened
here.
Z
To
my
knowledge,
at
that
particular
day,
it
was
a
day
after
christmas
or
I
wasn't
there.
I
was
spending
time
with
the
family,
but
I
did
sit
down
with
the
staff
that
was
there
that
particular
night
they
mentioned
to
me
the
detective
herlandez
and
galileo
walked
in
and
they
mentioned
that
they
brought
the
bottles
out
which
we
don't
condone
at
all
hundred
percent.
They
then
mentioned
to
me
the
gentleman
named
lam
that
was
actually
server
there.
Z
That
night
was
present
at
that
particular
location
when
he
hernandez
walked
up
and
to
my
knowledge,
you
know
it
just
you
don't
condone
this
bottle
service
at
all.
It
was
day
after
christmas
there
was
a
party
of
30
people
that
was
those
had
a
private
party
up
top.
I
sat
down
all
my
stuff.
I
trained
them
a
lot
and
you
know
they're
better
than
what
what
I
should
have.
They
are
knowledgeable
on
this
matter
and
top
that
off
I.
This
is
the
first
violation.
Z
Five
years
I've
been
in
fenway
and
yeah,
and
the
staff
and
the
person
that.
Z
He
stepped,
he
was
definitely
recommended
and
he's
no.
He
lost
his
position
as
a
server,
but
we
definitely
trained
them
well
enough
to
make
sure
there's
no
bottles
at
the
tables
at
all.
D
From
your
from
your
discussions
with
the
server,
did
this
person
think
that
he
was
doing
he
was
acting
appropriately.
Z
Do
I
think
he
was
acting
appropriately?
No,
I
I,
I
think
that
he
took
you.
D
Z
He
he
thought
it
was
okay.
Yes,
he
thought
was
fine.
If
that
was
okay
as
long
as
he's
attending
to
the
bottom,
especially
with
30
people.
That
was
that
that
was
there
at
that
particular
table.
There
was
quite
a
bit
of
people
on
this
day
after
christmas,
he
thought
was
okay.
D
All
right
well,
madam
chair,
we
will
be
retraining
staff
and,
more
importantly,
we'll
be
applying
appropriately.
If,
if
the
establishment
seeks
to
have
bottle
service,
we
will
be
applying
to
the
board
appropriately.
I
think
this
individual
thought
that
since
he
was
there
now
we
were
informed.
He
was
there.
Perhaps
he
didn't
identify
himself.
D
D
For
his
five
years
with
no
violations,
he
runs.
Good
businesses
has
been
a
good
licensee
and
we'll
certainly
address
and
take
care
of
this
issue
going
forward.
C
D
D
Mr
chung,
you
know,
I
know
it
was
a
group
of
people
that
came
in
and
I
think
the
the
issue,
as
I
understand
it
from
mr
john,
was
that
they
they
were
all
ordering
the
hennesseys.
So
this
fellow
thought,
okay!
Well,
I
can
serve
it
over
there
as
opposed
to
going
back
and
forth
to
the
bar.
He
was
wrong,
but
mr
trump
is
that
what
your
knowledge
is
here.
Z
It
was
a
big
group,
it
was
a
30
people
group
and
they
to
my
knowledge
they
did.
They
wanted
a
shot
each
and
I
think
the
gentleman
that
was
that
was
on
server
at
the
time
he
thought
it
was
appropriate
for
him
to
bring
the
bottle
rather
than
you
know,
serving
30
shots
to
to
each
person
he
does.
It
was
appropriate
during
the
battle
and.
M
Z
Just
I
just
I
still
speak
to
liam.
Actually
the
other
day
he
did
mention
to
me
that
duterte
hernandez
came
by
and
asked
him
are
you
the
survey?
He
did
he
I'm
pretty
sure
he
mentioned
that
that
he
was
a
server
and
I
don't
know,
maybe
when
he
asked
him
again
what
the
policies
on
bottles
and
everything
else,
and
maybe
he
got
scared.
He
said
I'm
not
a
server,
I'm
not
sure,
but
he
was.
He
was
different
up
there.
D
And
madam
chair
just
want
to
make
it
clear
that
what
it
was
inappropriate,
we,
our
belief,
is
that
he
thought
he
was
acting
appropriately.
He
wasn't,
but
we
will
take
stat
if
mr
chong
requests
to
you
to
have
bottle
service
we'll
make
an
appropriate
application
and
he
will
train
his
staff
accordingly.
A
A
Great,
thank
you.
All
the
board
will
take
this
under
advisement.
Thank
you.
Thank
you.
So
much.
Thank
you.

Okay
on
the

again
I'll
be
reading
from
a
police

which
I
wrote
on
monday
january,
31st
2022,
sorry
detective,
william

and
detective

hernandez
assigned
to
the
bpd
licensed

unit
conducted
a
license

of
the
red

located
at
nine
bowdoin

in
boston.
While
reviewing
the
licenses
and
permits
of
the
establishments
the
detectives
observed,
there
was
no
entertainment
license
posted
as
detectives
walked
through
the
barrier.
They
observed
a
table
of
six
patrons
drinking
alcoholic
drinks.
Detectives
noticed
these
patrons
appeared.
M
Young
detectives
asked
them
to
produce
identification
to
confirm
their
ages.
Five
five
of
the
patrons
stated
they
were
over
21
years
of
age
detectives
confirmed
that
the
five
patrons
were
indeed
over
25
years
of
age.
The
sixth
patron,
mr
michael
oddssur,
stated
that
he
was
over
21
years
of
age.
Mr
archer
then
produced
a
fraudulent
pennsylvania
driver's
license
that
can
contain
the
correct
name
to
display
the
date
of
birth
that
made
it
appear
as
though
he
was
over
21
years
of
age.
Detectives
used
a
license:
verification
program
which
confirmed
that
the
driver's
license
wasn't
defrauded.
M
M
Detectives
brought
this
to
the
attention
of
the
person
in
charge.
Mr
jacob
nicholson.
As
a
result
of
what
detectives
observed,
sharon
detective
gallagher
issued
a

tremendous
inspection
notice,

a
person
under

year
years
old
in

no

posted
mr

signed
for
an
accepted

A
Thank
you,
detective
attorney
update.
Would
you
like
to
address
the
alleged
incident.
A
AA
If
it
pleases
the
board,
I'd
just
like
to
mention
a
few
facts,
number
one,
the
entertainment
license.
Application
was
apparently
completed
at
that
time,
but
they
had
not
filed
it.
They
filed
it
within
two
days
of
that
and
it
has
been
issued
and
posted
since
early
february.
AA
So
he
had
been
working
four
months
at
a
furious
pace
on
hiring
and
opening,
and
this
was
his
third
or
fourth
day
of
operation.
It
is
their
policy
to
card
all
patrons
and
in
fact,
staff
did
card
this
entire
group,
all
six
people,
and
because
they
are
aware
of
the
prevalence
of
quality,
fake
ids
that
seem
to
be
everywhere
these
days
they
have.
They
had
at
that
time
ordered
a
card
scanner.
AA
However,
it
had
not
arrived
yet
and
even
though
they
carded
all
six
of
these
people,
the
one
guy
with
a
fake
fooled,
the
server
who
looked
at
it,
it
had
the
guy's
picture,
it
had
his
name,
it
had
state
of
birth,
it
had
his
address.
He
said
he
was
from
pennsylvania,
but
the
more
sophisticated
software
of
the
bpd
obviously
determined
that
it
was
a
fake.
AA
This
was
a
good
server.
This
is
someone
who
had
worked
for
the
red
hat
for
two
years
before
mr
nicholson
took
over.
This
is
someone
they
kept
on
he's
a
full-time
server,
he's
an
experienced
person,
he's
tips
trained
as
our
all
staff,
but
in
this
case
he
was
not
able
to
recognize
the
fraudulent
id
because
of
that
they've
instituted
a
new
policy.
AA
Mr
nicholson
has
also
discussed
all
of
these
issues
with
staff
and
has
contacted
each
staff
member
by
email
with
the
instructions,
so
there's
a
record
of
it,
and
the
scanner
and
appropriate
software
has
now
arrived,
which
was
delayed
due
to
some
supply
chain
issues,
but
now
they
have
it.
They
have
the
software
and
not
only
do
they
card
everyone,
they
use
the
actual
scanner
on
them
and
it's
our
hope,
that'll
prevent
an
incident
like
this
from
happening
in
the
future.
AA
If
you
please
the
board,
mr
nicholson,
who
is
a
20-year
veteran
of
the
industry,
he
was
the
manager
of
record
that
came
on.
He
was
the
manager
of
record
at
finland
cools
and
he
would
just
like
to
say
a
few
words.
B
Thank
you,
as,
as
mr
upton
said,
and
you
know,
I'm
the
owner
operator
now
I've
been
on
the
life
since
that
game
on
in
the
past,
fema
cools
with
no
history
of
any
violations
or
any
issues.
Definitely
a
frustrating
and
you
know
very
upset.
Obviously
it's
just
three
four
days
after
we
just
opened
so
we
had
gone
over
staff,
training
and
and
everything
unfortunately,
on
that
one
day,
our
door
guy
didn't
call
out
to
work.
B
So
our
server,
who
is
like
mr
upton
said,
is
tip
certified.
Is
you
know
everyone,
as
is
everyone
trained,
and
unfortunately
this
did
get
by
him?
I
do
apologize
apologize
to
the
board.
This
is
definitely
like.
I
said
not
something
that
that
that
happens
in
any
place
that
I've
that
I've
been
involved
with
in
the
past.
B
You
know
working
working,
100
hours
a
week,
getting
the
place
open.
This
is
it's
been,
it
was.
It
was,
but
now
being
open,
I'm
still
on
site
every
day
and
since
the
incident
obviously
checked,
every
id
that's
come
through
and
we'll
continue
to
and
again
now
that
we
have
the
scanner
in
place.
I
feel
like
this
will
both
deter
people
once
they
get
word.
You
know
if
they
do
have
a
faith
that
don't
come
through
and
and
also
be
able
to
catch
anyone
that
that
does
come
through.
B
So
again,
I
apologize
to
the
board,
and
this
is
something
that
I've
definitely
worked
on
to
make
sure
that
this
doesn't
happen
again.
Moving
forward.

his
name
the
date
of
birth,
making
it
appear
that
he
was
over
21
years
of
age.
Mr
kashuko
stated
he
was
insulted,
while
inside
the
premise
sergeant
detective
gallagher
then
contacted
meteo,
aslan
club,
bishop,
informing
him
of
the
incidents
in
the
age
of
both
persons.
Mr
oslon
stated
that
bijou
was
in
the
process
of
purchasing
a
new
scanner
to
prevent
underage
patrons
from
sneaking
into
the
club
and
purchasing
alcohol.
W
As
a
result
of
these
incidents,
sergeant
gallagher
issued
a
licensed
premise:
inspection
notice,
number,
zero,
six,
one,
two,
eight
five
to
club
bijou
for
the
underage
patrons
on
premise,
mr
william
mcintyre
signed
for
and
accepted
the
notice,
those
essentially
the
facts.
I'd
just
like
to
add
that,
on
the
the
second
incident,
mr
allison
did
provide
me
copies
from
his
cell
phone
of
the
fake
id
that
was
observed
that
day,
so
they
were
aware
of
this
prior
to
me
calling
them.
A
Thank
you
sergeant.
Would
you
like
to
address
the
alleged
incident.
AB
Yes,
thank
you
good
morning
sergeant
detective
gallagher,
the
when
you
and
detective
hernandez
arrived
on
january
30th
to
the
premises.
It
was
as
a
part
of
your
inspection
was
to
provide
notice
of
these
two
prior
alleged
incidents.
Isn't
that
correct.
W
W
I
talked
to
the
the
first
victim
via
phone.
I
was
not
on
scene
for
either
of
those
two,
but
I
did
make
the
apollo
investigation.
AB
AB
Okay
and
sergeant
detective
on
the,
if
you
take
the
first
incident
of
january
22nd,
do
you
recall
whether
or
not
this
was
as
a
result
of
a
walk-in.
C
AB
Right
right,
so
the
first
one
was
the
underage
there's
a
reference
to
another
report,
so
it
does
mention
that
it
was
the
result
of
a
walk-in.
Are
you
heard
that
or
not
detective
gallagher.
AB
Okay,
well,
what
I'm
just
trying
to
establish
is
that
we're
trying
to
verify
you
know
her
whereabouts,
whether
what
information,
if
any,
the
police
had
as
to
how
she
was
able
to
gain
access
to
the
establishment
that
evening.
AB
Okay,
have
you
had
an
opportunity
to
look
at
that
other
report
which
is
referenced
in
this
report?
Detective
gallagher,
I
believe.
W
It
was
a
sick
assist,
I
did
it
was
back
in
january,
so
I
don't
have
all
the
incident.
I
don't
recall
all
the
incidents,
but
it
was
a
sick
assist.
W
Sick
assist
she
she
left
there
not
feeling
well
in
the
company
of
her
friends
and
she
was
escorted
over
to
normal
medical
center.
AB
AB
Type
of
gallagher,
but
I
do
have
that
underlying
report,
which
ends
five
one,
nine,
nine
and
it
does
indicate
it
was
a
walk-in,
the
following
warning
from
the
individual,
and
it
did
indicate
that
you
know
she
met
with
officer
stocko.
Does
any
of
that
sound
familiar,
not
sure?
Okay,.
G
F
If
I'm
married
with
chairwoman
just
reading
from
an
incident
report
here,
it
says
about
4
30
p.m.
On
sunday
january
23rd,
2022
officer
stacka,
while
assigned
to
the
front
desk
of
district
one
when
ariana
del
dean
walked
into
district
one
and
reported
that
she
had
a
cup.
She
had
a
couple
of
drinks
before
going
out,
met
her
friends,
including
other
individuals
in
vienna.
I'm
sorry.
F
She
stated
that
she
met
with
another
individual
at
bijou,
located
at
51
stewart
street
in
boston
about
midnight
on
january
22nd
2022.,
the
victim
stated
that
either
individual
at
escado
bought
her
a
drink,
and
she
observed
the
bartender
pour
in
hand
to
her.
The
victim
stated
that
she
had
a
few
minutes.
F
After
a
few
minutes,
escaro
told
her
to
finish
her
drink
and
we
could
go
and
dance
which
she
did.
She
put
the
cup
down
and
went
to
find
her
friends
to
dance
the
victim
stated.
She
doesn't
recall
what
happened
which
she
found
herself
in
the
bathroom
thrown
up
and
almost
unresponsive
victims
stated
that
her
friends
found
her
in
a
stall
and
she
was
unable
to
walk,
talk,
stand
or
hold
her
head
up,
but
was
able
to
say
hospital.
AB
Thank
you,
lieutenant
detective,
sergeant,
detective
gallagher.
Does
that
help
professional
memory
a
little
bit
or
does
that
you
had
an
independent
conversations
with
this?
This
woman
is.
W
AB
W
My
conversation
with
her
that
she
was
there,
she
readily
admitted
that
and
when
I
asked
how
she
get
in,
she
told
me
she
had
a
fake
id.
So,
okay.
AB
AB
W
Yes,
sir,
they
have,
since
we
repurchased
a
new
scanning
device
which
is
much
more
able
to
detect
fake
ids
than
the
ones
I've
had
in
the
past.
AB
Thank
you,
I'm
just
going
to
ask
the
staff
first
and
then
we
can
get
into
the
other
incident.
I
think
that
makes
sense
to
handle
each
one
one
at
a
time
sure
that's
fine.
So
if
I
can
inquire
of
mr
aslan
and
mr
ganum
you've
both
been
sworn
in.
Yes,
yes,
and
can
you
were
you
either
one
of
you
there
on
the
night
of
january
22nd.
G
AB
You
both
were,
and
can
you
just
describe
the
the
process
on
how
you
handle
the
the
entrance
into
the
establishment.
AB
And
do
you
have
any
independent
memory
of
this
incident
or
this
this
individual
being
there
that
evening.
AB
And
again
had
you
ever
had
an
opportunity
to
actually
this
should
go
back
to
sergeant
detective
gallery
when
she
indicated
she
provided
a
fraudulent
id.
Did
you
ever
obtain
that
or
receive
a
copy
of
that
fraudulent
id.
W
AB
And
then
back
to
the
to
to
mr
aslan
and
mr
ghanim,
so
obviously
you
you
have
not
had
an
opportunity
to
see
a
copy
of
this
fraudulent
idea.
What
what
potentially
was
used
that
evening
is
that
right,
that's
correct,
and
it's
fair
to
say,
though,
if
someone
was
inside,
they
would
have
had
to
go
through
security
and
had
their
id
scanned
and
checked.
Is
that
accurate?
All
right?
AB
I
don't
know
if
the
board
has
any
questions
on
this
incident
or
I
could
get
into
the
second
night
as
well.
Whatever's
the
boy's
preference.
AB
You
so
sergeant
detective
gallagher
on
the
next
incident,
which
is
of
january
28th.
It
indicates
that
the
boston
police
department
was
brought
on
scene
as
a
result
of
a
call
at
bijou.
Is
that
accurate,
that's
correct,
sir,
and
again
to
your
understanding?
The
staff
was
cooperative
that
evening.
Yes,.
W
AB
AB
AB
And
again,
just
for
ratification,
I
don't
need
to
read.
There
is
a
additional
report
and
it
does
corroborate
what
you've
stated,
but
it
does
identify
mr
gannon
again
by
name
that
he
was
the
individual
that
had
scanned
the
id,
and
I
can
certainly
ask
him
that
question
the
point
being,
though,
that
in
the
presence
of
the
police,
mr
gannon
again
took
that
id.
That
was
confiscated
from
this
individual
and
ran
it
through
their
scanning
system.
AB
And
it
at
that
time
indicated
that
it
was
a
valid
id.
Is
that,
at
least
as
to
the
staff's
position?
Is
that
accurate?
AB
That
could
be
yes
and
again
since
this
incident
you
and
also
indicated
that
they
have
now
implemented
new
scanning
system,
they
do
and
do
you
recall
whether
you
received
an
email
or
a
call?
I
think
that
evening
from
mr
aslan
about
this
incident
I
did
sure
and
again
it
was
to
keep
the
lines
of
communication
open
to
inform
you
that
this
had
happened
and
to
keep
the
report
with
the
police.
Is
that
accurate
that
is
and
and
since
that
time
have
you
noticed
that
you
know
you've
noticed
prestigious
upfront?
AB
W
AB
That's
correct,
sir
okay,
and
that's
all
I
have
thank
you
sergeant,
detective
gallagher.
So,
joseph
again,
if
you
could
just
talk
about
the
evening
on
january
28th,
you
met
with
the
police
officers.
You
spoke
to
them
after
this
incident
occurred.
G
AB
And
can
you
just
explain
what
happened
specifically
with
running
that
id
again
and
and
tell
us
what
what
transpired.
G
AB
G
AB
B
AB
Okay-
and
you
have
since
then
have
met
up
with
sergeant
detective
gallagher
and
detective
hernandez,
you've
seen
them
at
the
premises
outside
on
several
nights.
G
AB
And
you
can
corroborate
the
fact
that
you
believe
this
new
scanner
is
definitely
going
to
flag
some
of
these
fraudulent
ideas
that
have
been
very
sophisticated.
C
AC
No,
no,
it's
a
brand
new
system
that
detective
sergeant
gallagher
and.
AC
AC
Right
so
we
had
a
scanning
system
that
we
had
purchased
before
and
even
with
the
updates,
it
was
failing
the
scans
and
when
the
detective
sergeant
gallagher
told
us
to
look
into
this
new
one
that
they
actually
use.
It's
a
completely
different
system.
It's
a
lot
more
expensive
and
then
we
we
wouldn't
be
invested
in
that.
So
it's
a
brand
new
system.
It's
not
an
update
or
anything
like
that.
It's
a
it's!
A
completely
different
system.
AC
Not
really
I
mean
it
just
wasn't
working
we
purchased
right
when
we
opened
again
after
clovid,
and
it
just
wasn't
working
and
every
time
we
had
a
problem
with
it.
So
we
just
went
ahead
and
took
the
boston
police
recommendation
and
purchased
this
more
sophisticated,
more
expensive
system.
S
I'm
just
saying
it:
it
seems
to
me
that
if
you
paid
money
for
this
scanning
system
and
if
it's
failing
on
you
when
you
and
you're
now,
you
know
looking
at
liability
for
this
failure
that
you
would
want
to
give
back
to
them
and
say
how?
How
could
the
system
let
let
buy
an
id
that
you
know,
doesn't
display
a
residential
address.
AC
S
W
Official
might
interject
the
scan
is,
for
the
most
part,
they
don't
verify
the
information
on
the
license.
We
read
the
the
strip,
the
magnetic
strip
on
the
back,
the
bar
code
on
back
and
it
looks
for
deficiencies
in
the
id
and
it
looks
at
the
format.
It
doesn't
verify
any
of
the
information
in
aim
date
of
birth
or
the
address.
In
this
case,
it
just
is
looking
at
the
back
of
the
license
in
the
format,
not
the
information
itself.
