kind

do
a
quick
overview
here
just
for
the
benefit
of
everyone
here
tonight.

So
again,
the
proposal
is
to
construct
a
new
three-story
mixed-use,
building
with
a
four-car
parking
garage
on
the
ground
floor
and
a
280
square
foot
storefront
commercial
space
at
the
ground
floor.
The
third
and
the
second
and
third
stories
would
contain
four
dwelling
units,
one
and
two
bedroom
units
the
ground
floor.
Storefront
would
be
conveyed
as
a
live
work
unit
this
this
is
not
prohibited
as
part
of
the
ncr2
regulation.
So
just
more
of
a
point
of
information
and
that's
what
the
applicant
proposes
to
meet
the
storefront
requirement
there.

The
applicant
has
also
requested
a
reduction
to
the
required
400
square
feet
of
passive
open
space
per
unit
for
condominium
developments
and
proposes
an
average
of
180
square
foot
of
open
space
per
unit
instead
through
a
combination
of
private
and
shared
outdoor
spaces
included
in
the
design.
Permit
request
is
a
approval
for
a
35-foot
height
limit.

The
typical
height
limit
is
28
feet,
but
the
commission
may
approve
in
the
design
permit
up
to
35
feet,
which
again
was
approved
as
part
of
the
original
2020
approvals
for
the
design
permit
other
than
the
standard
design
review
findings.
There
are
no
special
findings
that
apply
to
allowing
that
35
foot
height,
so
I'll
kind
of
leave
it
at
that.

a
design
permit
is
the
original
design.
Permit
is
effective
for
two
years
and
you
have
to
pull
a
building
permit
within
that
period
you
can.
If,
if
that
doesn't
happen,
you
can
submit
the
applicant
can
request
a
three-year
extension
maximum

the
original
approvals
and
that
three-year
extension
is
effective.
It's
tied
from
the
original
effective
date
of
the
permit,
so
this
particular
permit.
The
approvals
would
have
expired
in
on
December,
19th,
I,
believe
of
2022.
If
this
extension
request
is
approved,
they
would
expire
three
years
from
that
date,
so
December
19,
2025.

interesting
how
the
building
code,
what
the
building
code
considers

bedroom
or
not,
ultimately,

rooms

noticed
they
have
widened
kind

hallway
entries

doors.

given

design,
the

study
area
was
not
considered
an
additional
bedroom.

rent
it

could
you

occupy
it

bedroom
without
a
door,

suppose
technically,
that's
possible,
but
again
it

egress

to
bedrooms
and
the
building

mean
similarly
to
someone
could
rent
out
their
living
room
right
now

not
really
built
or
intended
to
be
used
as
such.

we
wanted
to
address
the
questions
around
I
guess.

question
is
around
why
we
haven't
pulled
a
building
permit
as
yet
so
just
a
few
things
happened.
So
one
is.
We
did
the
soil
testing
and
the
condition
for
that
soil.
That
site
is
very
unusual
than
what
we've
seen
in
other
spaces
in
Birmingham.
It
has
almost
five
feet
of
infill
landfill,
and
so
after
talking
to
you
know,
we
work
with
prestigious
soil
Engineers.

we,
we
did
some
research
looking
at
the
library's
findings
for
soil
reports,
because
we
can
kind
of
like
use
some
of
the
soil
reports
of
adjacent
sites
to
kind
of
gauge
like
what
kind
of
work
we
would
have
had
to
do.
Preliminarily
and
when
we
got
the
soil
report
findings,
it
was
a
shock
to
see
the
the
findings
of
the
soil
report.
What
that
happens
for
that
site
is
that,
then
we
are
required
to
do
extensive
amount
of
structural
work.

harder
for
that
is
also
I
think
it
would
still
be
financially
viable
if
the
lumber
prices,
hadn't
skyrocketed
I
mean
at
that
point.
The
project
just
became
completely
financially
unviable,
and
since
the
lumber
prices
came
down,
I
got
pregnant
with
twins
and
I
was
hospitalized
for
a
majority
of
2021
and
then
I
don't
know
what
happened
to
2022.
Since
the
twins
came
along
I've,
it's
just
been
not
feasible
for
me
to,
like,
you,
know,
execute
a
project
of
that.

requires
that
much
involvement.
So
those
are
the
three
real
reasons
why
we've
really
just
not
pulled
the
permits,
because
it
requires
us
to
go
back
to
the
drawing
board,
revisit
structural
work
and
see
you
know
what
are

best
and
the
most
cost
effective
ways
for
us
to
take
it
off
the
ground.

completion

factors
now

the
Lumber
costs
are
down.

loans
have
become
extremely,
you

they

years

versus

loan

we

construction
lending
the
cost
of
doing
that,

it
requires
me
to
literally
go
back
to
the
drawing
board
and
run
the
performance
all
over
again.

biggest
problem
for
us
has
been
just
the
cost
of
the
structural
work.
The
amount
of
peers
that
the
building
would
require
because
of
the
five
feet
of
infill,
is
just
something
we
we've
done
very
complex
projects
in
San
Francisco,
with
all
Corner
lots
and
like
crazy
slopes
that
we've
not
had
to
do
the
kind
of
structure
work
that
got
thrown
at
us
because
of
the
soil
report
and
what
the
structural
engineers
said.

in

building
together

structural
work

go
after
the

existing
Shack
is,

demolished,

think
we
once
we
determine
what
the
plan
of
action

for

permit

any
basis
for

The
city
council,
who's
requesting
this
amendment
didn't
consult
with
any
drug
development
scientist
when
they
decided
amongst
themselves
that
animal
testing

species
outside
of
rodents,
amphibians,
insects
and
fish
was

longer
necessary
and
should
be
prohibited.

FDA
typically
requires
drugs
for
human
use
to
be
tested

rodent
species

species

to
