position

because
I've
spoken

this

This
is
something
that
I
feel
very
strongly
about.
Our
city.
Right
now
has
big
issues
I'm
holding
in
my
hand,
to
Santan
Sun
News.
The
top
three
articles
was
the
concern.
The
number
one
is:
the
inflation
looms,
the
city
financial
threats.

We
have
serious
money
problems
that
we're
going
to
have
to
deal
with
coming
up
right
now.
The
second
one
discusses
the
ndo
and
the
great
amount
of
concern
and
the
tempers
that
are
flaring
as
we
discussed
this
important
issue
that
matters
to
the
people
who
live
here.
The
third
one
talks
about
Chandler,
adding
days
to
the
fireworks
Council
calendar
and
as
I
read
this
paper
I'm
so
disgusted.

We
have
big
issues
in
our
city.
Just
on
Monday,
we
heard
the
chief
of
police
discuss
our
policing
and
he
told
us
that
in
the
next
approximately
two
to
three
years,
almost
a
quarter
of
our
police
force
is
slated
to
retire
and
we're
not
able
to
hire
fast
enough
to
fill
the
gaps
of
the
people
who
are
leaving
right
now.
Our
police
numbers
are
plummeting
as
we
speak.

This
is
the
first
time
tonight
that
people
have
come
to
speak
for
the
chicken
ordinance
in
every
meeting
overwhelmingly,
we
have
had
people
speaking
against
this
ordinance.
We
have
two
city
council
members
that
are
going
to
take
office
in
January
who
ran
on
the
premise
that
they
would
vote
no
to
this
ordinance
and
they
were
elected,
but
rather
than
letting
their
voices
be
heard,
rather
than
letting
the
voices
of
our
city
be
heard.

Rather
than
focusing
on
what
matters,
whether
or
not
we
can
pay
our
bills,
whether
we
have
police
to
protect
us,
you
guys
are
focusing
on
whether
or
not
we
can
have
more
days
to
shoot
off
fireworks
and
whether
or
not
you
can
get
the
chicken
ordinance
through
the
door
before
the
end
of
the
year
before
two
of
our
council
members
age
out
and
are
no
longer
on
the
council,
that's
something
you
should
think
about
seriously
in
your
own
poll
that
you
put
online
for
chickens.

a
three
to
one
vote
for
chickens.
However,
the
poll
was
skewed
because
a
lot
of
the
people
who
voted
lived
in
HOAs
that
can't
even
have
chickens,
so
you
don't
even
have
accurate
data.

ordinance
as
it's
written
so
far,
and
it
has
so
many
holes.
It's
like
Swiss
cheese,
I
beg
you
to
wait
and
let.

backyard
chicken
ordinance

will
impact

affect

daily
lives
of
some

Chandler
residents,
who
are
at
the
mercy
of
the
sole
decision
of
six
council
members
and
the
mayor.
Instead
of
being
rightfully
decided
by
the
will
of
the
people
in
a
referend
vote

Chandler's
City
organization
chart
lists
the
residents
at
the
top,
showing
that
the
mayor
city,
council
and
City
staff
are
all
obligated
to
the
direction
and
will
of
the
residents.
But
this
council
is
avoiding
the
will
of
the
residents
on
this
chicken
amendment
by
not
allowing
this
to
be
voted
on
in
a
public
referendum.

remind

and
taxpayers
of
the
potential
for
lawsuits
from
homeowners
and
renters
against
the
city,
landlords
and
real
estate
agents,
claiming
a
violation
of
the
inherent
legal
property
right
doctrine

quiet

The
serious
health
impact
of
the
CDD
CDC,
just
reporting
on

November
3rd,
on
the
record
outbreak
of
the

the
highly
pathogenic
Avian

Influenza,
affecting

wild
birds,
backyard

Commercial
poultry
in
the
USA
that
can
infect
pets
and
humans
and
can
also
be
deadly

almost

and

the
consent

the
Govern
really

requires

free

fair
referendum.

the
people
can
speak
on
their
own
behalf
about
the
issues

affect

impact

as
the
proposed
amendment
to
allow
backyard
chickens
in
all
single-family
homes
owned
or
rented
in
Chandler.

delay

this
amendment

the
disease

grew
up

Idaho.
Not
everyone
knows
how
to
take
care
of
chickens.

know
it's
great
to
have
fresh
eggs,
but
there's
a
fries
a
couple
blocks
down,
but
first
and
foremost,
let's,
let's
just
let
the
people
decide
in
the
city
and
that's
really
all
I
have.

opposed

but

am
looking
at
this

being
very

studies
need

be
made

seen
the
impacts
of
this
in
the
city
of
Mesa,
where
we've
actually
had
farming
that
was
right
next
to
homes
and
now
that
we're
looking
at
a
little
bit
different
real
estate
market
and
I'm,
always
here
to
protect
my
clients
and
the
people
in
the
city
of
Chandler
I've,
been
here
since
1981.

be
able
to
not
have
an
effect
in
this
far
as
these
are
concerned,
I
know
that,
just
recently
it
was
mentioned
about
the
bundles
of
ownership.
Part
of
the
bundles
of
ownership,
of
course,
is
the
quiet,
peaceful
enjoyment
of
your
property.
If
you
have
chickens
waking,
you
up
and
five
o'clock
in
the
morning,
that's
not
necessarily
peaceful
enjoyment,
so
I
asked,
if
maybe
this
might
be
premature-
that
you
might
go
ahead
and
actually
get
some
outside
study
in
reference
to
this,
so
that
you
can
reflect
on
this.

not
going

be
even
allowed

considered
on

majority
of
the
properties,
because

lot
of
these
are
already
HOA
properties,

amount

affected
people
is
not
actually
the
full
number
of
citizens
of
Chandler,
so
the
them
and
and
then
even
fewer
of
those
are
actually
going
to
end
up
owning
them.

main
argument:
besides
the
smell
and
loose
animals,
a
lot
of
people
were
saying:
noise,
complaints,
chicken
make
noise,
so
do
adults
and
children
and
dogs
stereos
lawn
equipment.
I
know
we
all
like
to
do
our
Lawns,
so
I
would
say
that
the
chickens
are
on
the
lower
end
of
the
spec
spectrum.
They
do
clock,
you
know
if
they
lay
an
egg,
but
they
don't
create
constant
noise
and
basically,
as
far
as
human
conversation

innocuous

40
feet

So
as
far

upkeep,
if

guys
are
assuming
that
all
chickens
are
going
to
chicken
owners

irresponsible.

There's
over
40
percent
of
people
in
Arizona
that
own
dogs
there's
probably
going
to
be
an
overlap
and
some
that
own
chickens
and
you're,
assuming
that
people
are
just
not
Humane
to
animals
which,
in
time
and
time
again,
I
think
that
that
is
something
that
we
found
untrue
and
as
far
as
cruelty
to
animal
complaints.
Obviously
those
catch
our
attention,
but
they're
not
going
to
be
the
majority
of
animal
owners.
Basically,
this
is
impact
is
much
overstated.

the
small
amount
of
households
are
going
to
be
impacted
if
HOA
was
impacted,
it's
also
per
their
discretion
if
they
were
going
to
make
any
exceptions.

basically
thank

to

under
state
law,

council
can
only
refer
a
limited
number
of
items
to
the
voters.
Independent
of
you
know
that

just
refer
things.
For
example,
our
home
rule
gets
referred
to

voters.
Any
Charter
amendments
can
be
has
to
go
through
the
voters,
so
Bond
issuance
gets
approved
by
the
voters,
but
if
you're
not
specifically
authorized
under
state
law,
you
do
not
have
the
ability,
as
a
city
council,
to
just
refer
a
question
to
the
voters
I.E
whether
chickens
should
be
permitted
or
not.

There's
Arizona's
Supreme
Court
case
law,
limiting
that
power
of
the
council
once
an
ordinance
is
approved
by
the
council.
If
it's
a
considered
a
legislative
act,
then
a
referendum
petition
can
be
pooled
by
the
voters
within
the
30-day
period
before
that
ordinance
goes
into
effect
and
they
have
to
gather
enough
signatures
to
have
it
put
on
the
ballot
and
I.

what
that
number

top
of

head
and
then

they
have
enough
valid
signatures,
it
comes
back
to
the
council
and
then
that
can
be
referred
to
the
voters

that's

power
of

were

It
was
unclear

four
o'clock

pulled
what

occurred
in
a
week
and

send

email

everybody
about
a
week

half

the
Planning
and
Zoning
commission
video

well
as
the
memo.

that's

great

we
started
this
process

we
had
to
take
a
look
at
how
other
cities
permitted
for
chickens.
And
currently
you
know
the
the
town
of
Gilbert
permits
for
chickens
regarding
lot
size,
Queen,
Creek,
lot,
size,
Mesa,
Tempe,
Scottsdale,
Phoenix
and
Maricopa.
County
all
permit
for
chickens
buy
right.

only
cities
that
currently
do
not
is
city
of
Avondale.

Today
I
found
out
that
the
town
of
Fountain
Hills
does
not
the
town
of
Paradise
Valley
does,
and
the
town
city
of
Glendale
allows
for
chickens
on
Lots,
10,
000
square
feet
or
larger.

follow

so
the
question
came
up
earlier
by
Resident
that
a
lot
of
these
folks
are
in
HOAs.
Were
you
able
to
feel
that
in
between
finding
out
they
live
in
in
Arizona
at
all
or
if
they
weren't

surveys
after
I
went
through
and
picked
out

ones

Chandler
residents.

had
them

shows

people

you
see
the
under
the
under
color
of
the
red,
those
are
properties
that
are
within
an
HOA.

there
seems
to
be
a
lot
of
residents,
particularly
South
Chandler,
and
some
West
Chandlers
East
are
pretty
much
somewhere
on
the
border.
I'll
give
them
credit
for
that
okay
or
in
HOAs
right
now,
even

want
chickens

even
no
chickens
at
all.

followed

year

design
review
process
with
the
city,
a
process

they
would
hold
extensive
neighborhood
meetings
and
complete
sound
studies
so
that
they
could
mitigate
any
noise.

have

challenge
in
the
ordinance
as
it's
drafted
tonight
and
once
we
found
out
about
this,
we
quickly
contacted
City
staff,
I
contacted
the
city
of
the
City
attorney
and
your
planning
staff.
The
ordinance
is
as
it's
written
is
ambiguous
and
it
imposes
requirements
that
could
actually
impair
a
property
owner's
rights
to
develop
on
their
property.
Those
rights
are
vested,
but
this
could
impair
them
and
stop
them
from
developing
altogether,
which
is
a
challenge
under
an
existing
development
agreement
with
the
city
and
under
proposition
207.

Arizona's
private
property
protection
act-
the
fix
is
fairly
simple,
but
it
must
be
addressed
to
guarantee
private
property
owners
rights
and
also
to
ensure
that
residents
and
neighboring
properties
are
not
impacted.
The
challenge
here
is:
we
propose
a
fix
to
staff
shortly
after
becoming
aware
and
having
conversations
with
the
city
attorney,
where
your
staff
actually
agreed
with
me
that
there
was
ambiguity
in
the
ordinance.

person

religious
faith

a
parent

transgender

child
lives
with
fear
every
day,
she's
smart,
she's,
hard
worker
and
she's,
currently
a
student
at
NYU.
Yet
she
knows
she
could
be
turned
away
from
a
job
in
Chandler,
simply
because
she's
transgender,
she
could
also
be
turned
away
from
an
apartment
or
a
public
space
just
for
being
transgender.

She
lives
in
this
fear
because
she
knows
transgender
people
locally
who
have
faced
these
kinds
of
discriminations.
She
knows
transgender
people
who
have
had
difficulty
finding
jobs
or
if
they
do
get
a
job,
they
face
discrimination
and
harassment
until
it's
no
longer
a
safe
place
to
work.
She
knows
a
transgender
woman
who
was
told
to
leave
a
restaurant
because
they
don't
serve
people
like
her.
This
was
local
restaurant.
Not
too
long
ago,
my
daughter
just
wants
to
be
an
independent
adult
providing
for
herself
giving
back
to
the
community
she's
smart,
talented,
generous.

She
would
be
a
benefit
to
Chandler,
yet
she
knows.
Chandler
doesn't
have
right
now
the
basic
legal
protections
for
her,
and
she
may
not
return
to
her
hometown.
Because
of
that,
although
she
knows
she
can
always
come
home
if
worse
comes
to
worse
other
lgbtq,
Youth
and
adults
aren't
welcome
in
their
family
home.
Some
of
them
aren't
welcome
in
their
family.

Home
I
recently
met
a
local,
transgender,
high
school
student
who
was
living
on
his
own
own
and
supporting
himself
any
way
he
could,
while
trying
to
stay
in
school
because
he's
transgender
he
faces
hurdles
with
employment
and
housing.
Most
of
us
here
don't
have
to
face.
There
are
disproportionate
number
of
unemployed
and
homeless
people
who
are
lgbtq
and
especially
transgender.

This
ordinance
is
needed
to
remove
the
hurdles
they
face.
These
aren't
special
rights
that
we're
asking
for
just
equal
rights
that
the
rest
of
us
already
have.

religious
person

committed
to
my
religious

to
treat
others
as
I
want
to
be

win-win.

continues
to
provide

freedoms,

freedom

we

protect
our
freedoms,

a
military
veteran
I
serve
my
country
to
protect
our
freedoms,

passed

made
a
commitment
when
I

Army

took
that
oath
I
said
that
I
will
protect

country

foreign

domestic

embedded
inside

weekend

Saturday.

great

was

of
the
first
to
start
of
this
organization
that
truly
helped
the
kids
here
in
our
communities.
I
know
that
Valley
of
the
Sun
clubs
they
do
I
can
get
something
from
them.

things
also
and
then
I
got
there
because
of
the
YMCA
I'm
a
member
of
their
board,
and
they
were
able
to
send
me
there.
So
it
was
amazing
to
represent
YMCA
there
and
have
a
great
time.

the

the

prospector

of
Merit

economic

economic
development
team
for
doing
such
a
fine
job
in
getting

project

Chandler

an
outstanding
