communications

occurred
while
we
were
away
these
last
few
weeks

december,

first

which

a
letter
from
john
spaforth
who
has
written
to
the
council
before
with
concerns
of
runoff
on
the
property
at
seven
brown
avenue,
and
he
writes
to
us
this
time
to
let
us
know
that
he
has
sold
this
property
and
let
the
new
owner
be
aware
of
the
situation
there.
So
I
did
want
to
record
that
we
have
received
that
communication.

The
next
items
are
from
the
division
of
liquor,
control
out
of
the
department
of
commerce,
and
there
are
three
notices.
One
is
a
name
change
from
ca,
gold
limited.
It
was
doing
business
as
dale's
bp
on
50
north
court
and
the
name
changes
to
parmar
oil
company,
and
so
that
that
is
just
a
name
change
going
through.

the
city
also
filed
a
complaint
and
motion
for
injunctive
relief
and
the
common
police
court
combined
the
two:
the
motion
for
injunctive
relief,
complaint
and
motion
along
with
the
appeal
and
right
now,
the
stage
we're
in
is
deciding
what
additional
evidence
will
be
allowed
by
the
court
and
we
have
a
telephone.
Actually,
we
have
an
in-person
conference
and
about
two
weeks
so
briefs
have
not
been
written
yet
and
again.
At
this
point,
the
drive-in
drive
through
there
at

50
east
state
does
not
have
a
zoning
permit
for
such
a
business.

we
would
have
until
january
18th
to
submit
that
so.

the
business
doesn't
have
a
zoning
permit
for
a
drive-in
drive-through,
and
the
request
here
is
for
the
athens
community
drive-through
at
750
state
to
get
a
liquor
permit,
and
I
guess
the
reasoning
is
that
they
don't
have
a
permit
to
operate
as
a
drive-in
drive-through
and
we
would
object
to
them
getting
a
liquor
permit
if
they
don't
have
a
permit
to
a
zoning
permit
to
operate
such
a
business.

The
last
item
for
communication
is
from
two
places
is
from
the
ohio
municipal
league,
that
reported
a
few
weeks
ago
on
december
17th.
The
legislation
that
has
been
proposed
house
bill
512,
and
this
is
the
public
safety
pension,
modernization
act
and
they
are
requesting
that
the
rates
for
cities
and
villages
paying
into
retirement
comp
contributions
for
ohio,
police
and
firefighters
be
increased
to
26.5
percent
for
both
police
and
fire.

Then,
several
days
later,
we
had
a
request
from
our
auditor
kathy
hecht,
who
said
she
respectfully
respectfully
requests
that
city
council
members
consider
a
resolution
to
be
sent
to
our
ohio
representatives
regarding
this
employer
contribution
and
knowing
that
some
council
members
are
brand
new.
I
will
forward
this
email
and
the
ohio
municipal
league
and
then
suggest
that
if
council
members
are
interested,
what
we
can
do
is
discuss
it
at
committee
next
week
with
a
little
bit
more
information
and
time
for
reading
and
then
consider
whether
or
not
we'd
want
to
issue
a
resolution
opposing
it.

I

auditor
is
putting
this
information

mlk
junior
celebration
week
committee,
which
also
oversees
juneteenth
celebrations
organized
by
the
university
that,

university

events
which
citizens
and
interested
persons
can
find
just
by
googling,
ohio,
university,
mlk
or
mlk
celebration.

also
bring

that

on
behalf
of
that
group,

well
as
the
racial
equity
coalition
of
athens
county,
I'd
like
to
do
more
to
make
these
events
known
to
the
community

encourage
involvement.

we
have
four
new
members
of
council.
While
we
really
have
two
but
two
that
are
recent
members.
Every
year.
On
the
first
meeting
in
january,
I
give
an
annual
report
of
business,
we're
we
are
a
statutory
city
and
we
are
bound
by
the
ohio,
revised
code
and
the
ohio
revised
code
requires
me
on
the
first
meeting
in
january
to
give
a
report
of
what
my
office
has
been
doing
for
the
last
year.

So
my
office
is
the
office
of
the
law,
director
and
city
prosecutor
and
by
law.
I
am
obligated
to
also
prosecute
misdemeanor
cases.
We
have
a
lot,
I'm
going
to
tell
you
we
have.
Oh.
Last
year
we
had
19,
oh
700,
1763
cases
would
be
impossible
for
me
to
do
my
duties
as
law
director
and
also
to
prosecute
all
those
cases.
So
the
app
and
city
code
and
the
ohio
revised
code.
Both
allow
me
to
appoint
prosecutors
and
in
our
office
we
have
three
full-time
prosecutors.

Our
office
is
obligated
under
the
high
revised
code
to
prosecute
that
case.
We
do
a
wide
variety
of
cases.
So,
in
addition
to
prosecuting
for
the
athens
city
police,
we
prosecute
for
the
admins
county
sheriff
the
ohio
state,
highway
patrol
ohio
department
of
liquor,
control,
various
state
agencies
and
ohio
university
police.

Now
the
ohio
revised
code
also
says
that
we
do
get
some
additional
compensation
and
that
comes
from
the
board
of
county
commissioners
and
I'll.
Tell
you
about
that
in
just
a
moment
how
much
we
received
from
them,
so
the
misdemeanor
cases
are
prosecuted
in
municipal
courts
and
in
2021
there
were
7
350
criminal
traffic
and
ovi
cases
filed
in
athens
county
municipal
court.

In
2021
there
were
379
defendants
who
entered
diversion
for
driving
under
suspension,
substance,
abuse,
alcohol,
offenses
and
selected
cases
for
theft.
The
remaining
cases
were
prosecuted
by
our
office.
Our
prosecutors
have
direct
involvement
from
the
very
beginning
until
restitution
in
a
case.

I,
in
addition
to
supervising
the
prosecutors
as
law
director,
I
keep
council
apprised
of
litigation
involving
the
city
and
I'm
required
to
present
this
annual
report.

So,
on
page
two,
I
have
this
broken
down
by
defendants,
who
had
an
attorney
who
did
not
have
an
attorney
and
we
had
some
carryover,
but
we
prosecuted
1763
cases.
Page
three
tells
you
all
the
additional
services
our
prosecutors
perform,
and
one
note
is
at
the
bottom
of
page
three.
We
collected
our
office
collected
21,
265
dollars
and
61
cents
in
restitution
for
victims.

Our
chief
city
prosecutor,
she's,
available
day
or
night
to
give
advice
to
law
enforcement
and
she's
also
provided
training
to
the
athens
city
police.
Some
of
my
duties
are
outlined
on
page
four
things
that
I
did.
I
think
that
probably
one
of
the
most
significant
accomplishments
this
year
was
that
I,
along
with
many
other
people,
including
member
grace
our
church
of
council
debbie
walker.

the
other
interesting
things
I
did
this
year
well,
I
always
meet
with
the
prosecutors
weekly
to
discuss
the
cases
I
review
ordinances
resolutions
I
administer
oaths.
I
review
contracts,
agreements
bonds,
I
meet
with
outside
counsel.
We
have
such
for
civil
matters
involving
the
city
I
meet
with
the
boards
and
commissions.
I've
provided
training.

I
do
for
the
city
school
district
is
I'm
in
a
situation
where
a
private
citizen
can
test
the
valuation
of
their
property.
The
city
school
district
obviously
has
an
interest
in
that
and
if
property
value
were
lowered,
so
when
there's
a
complaint,
I've
for
many
years
decades,
maybe
file
counter
complaints
on
behalf
of
the
athens
city,
school
district.

about
what
cases
we
have
pending
and
I
guess
I
could
try
to
knock
on
wood.
But
we
completed
one
case
in
2021.
There
were
three
cases
filed
in
2021
and
pending
at
the
end
of
2021,
two
were
board
of
zoning
appeals
cases,
and
then
one
was
the
complaint
and
motion
for
injunctive
relief.
The
city
filed
appendix
a
just
gives
you
a
general
idea
of
the
kinds
of
cases.

lot
of
people
will
come
into
court
and
not
get
attorney
representation.

was
1085
and,
as
I
said
before,
there
were
some
carryover
cases,
but
you
know
our
office
prosecutes
everything
from
a
speed
or
disorderly
conduct,
all
the
way
up
to
domestic
violence,
which
is
the
most
serious
operating
under
the
influence
in
vehicular
manslaughter.
So
it's
a
wide
variety
of
cases
and.

identifying
domestic
violence
is
one
of
the
higher
numbers
of
issues
that
we
see
here,
I'm
familiar
with
some
diversion
programs
that
our
courts
have
and
I'm
wondering,
if
you're
aware
of
any
programs
that
support
or
respond
to
the
issue
of
domestic
violence
through
our
courts.

Sometimes
we
could
have
a
conversation
about
domestic
violence
and
a
lot
of
times
a
victim
will
come
in
and
after
the
charge
has
been
filed,
request
to
have
a
case
dismissed,
and
it
takes
quite
a
bit
of
time
for
our
prosecutors
to
work
with
the
victim.
There
are
victim
advocates
available
and
there
just
isn't
a
diversion
program.

probably
domestic
violence
is
probably
the
area
that
we
are
always
that
we
lose
sleep
over
if
we
have
a
domestic
violence
case
where
we're
worried
about
the
victim.
