bit
less
than
pleasant

It
was
kind

interesting
to
me
when
I
did
the
figuring,
because
I'd
heard
figures
and
of
course
they
were
only
projected
figures.
We
really
couldn't
know,
but
it
was
something
on
the
order
of
20
to
25
percent.

actually
I
in
elekton
to
opt
out
which
I
will
do
I
am
saving
four
thousandths
of
a
Senate
by
not
doing
business
with
the
doing
business
as
arm
of
Amran,
which
is
doing
the
municipal
aggravation.

look
at
your
bill
before
you
figure
all
these
monies
you're
saving
out
there

you're

really

was
in
regards

apartment

really
disturbed,
but
a
little
bit
kind
of
questioning
as
regards
how
the
public
was
dealt,
the
actual
residents,
who
are
there
and
also
I,
noticed
in
the
readings
that
were
that
came
with
the
minutes
and
agenda
and
everything
that
we
have
an
option.
The
City
Council
can
change
the
time
of
that
meeting
and,
given
that
five
people
actually
showed
up
at
three
o'clock
in
the
afternoon
on
a
work
day,
it
says
to
me
they
had
something
I
think
pretty
strongly
vested
in
that
now.

I've
since
talked
with
some
other
folks
that
have
a
more
positive
view
of
the
project,
so
I'm
kind
of
ambivalent.
From
the
standpoint
that
I
don't
live
there,
but
I
am
concerned,
given
what
I
saw
in
paper
with
a
with
a
kind
of
singular
on
egress
route,
the
numbers
that
they
were
talking
about,
putting
in
there
and
substituting
a
55
x,
75
playground
for
four
apartments,
for
what
could
be
hundreds
of
children
seems
to
be
a
bit
conservative
to
be
kind.
But
that
being
said
on
again,
I
am
heartened
by
what
I've
been
seeing.

really
enjoy
the
time
that
I
had
at
the
mayoral
open
house
the
kind
of
discussions
the
engagement
that
I
saw
coming
from
some
of
my
fellow
citizens
was
inspiring.
It
really
was
for
too
long
I
feel
like
I've,
been
one
of
the
loan
door.
One
of
the
few
voices
crying
out
in
the
wilderness-
and
it
does
seem
like
folks,
are
starting
to
realize
that
there
can
be
something
brought
about
in
a
positive
way
with
that
kind
of
engagement.

part

McGraw
subdivision
tonight.
I
am
asking
that
the
city
council
table
or
deny
the
special
use
permit
for
the
apartments
on
X
done
for
the
following
reasons:
one
safety,
crime,
increased
traffic
fire
and
emergency
response
times,
for
example,
mcgraw
park
subdivision
currently
only
has
one
entrance
to
our
homes
with
increased
traffic
coming
from
these
apartments,
and
the
parking
on
Exum
will
further
complicate
the
amp
ems
response
time
that
currently
a
six-second
shy
of
the
national
average
of
six
minutes
as
homeowners
and
taxpayers.

We
would
like
to
know
that
we
can
be
reached
in
a
timely
manner
should
it
arise
in
response
to
traffic
control.
I
believe
this
was
the
Zoning
Board
letter
that
went
to
the
council
members.
It
was
in
the
packet
and
it
stated
that,
on
paragraph
3
of
the
background
that
the
west
side
parking
has
been
eliminated,
which
signs
have
been
placed,
but
law
unfortunately,
does
not
enforce
them.
There's
we've
called
numerous
times
to
report
illegally
parked
cars.
Many
times
cops,
will
drive
by
them
and
just
continue
on
and
not
even
ticket
them.

Mayor's
meeting
it's,
they
can't
install
them
on
exton
because
of
the
increased
traffic.
That's
already
there
now
that
it
would
possibly
cause
further
problems.
They
also
concern
of
traffic.
There
is
the
garrick
haefeli
intersection
if
we
have
increased
apartments
there,
certain
times
the
day,
basically
going
to
work
and
coming
home,
that
intersection
is
very
congested
between
the
two
businesses
and
people,
leaving
the
current
apartment,
people
coming
off
of
empire
into
the
apartment
or
into
our
subdivision.

That
gets
very
congested
right
there
and,
if
you're
coming
off
of
geared,
which
is
X
them
continued,
that
becomes
almost
next
to
impossible.
At
certain
times
of
the
day,
safety
with
increased
population
in
smaller
areas
comes
increase
for
crime
gangs
and
drugs.
Although
these
currently
don't
appear
to
be
a
problem,
but
we
cannot
be
sure
that
in
the
future
of
these
apartments
that
are
currently
there
or
the
additional

guess,
as
of
today,
cants
won't
eventually
become
section
8
housing.

there
any
guarantee
that,
as
homeowners,
our
values
will
not
go
down
because
of
these
apartments,
possibly
in
the
future,
can't
be
fulfilled
and
then
become
section
8
or
low-income
housing?
We
also
have
concern
for
schools.
A
new
school
was
built
approximately
four
years
ago,
Benjamin
to
provide
with
overcrowding.
After
three
years
of
being
open.
It
already
has
150
students
over
capacity
which
is
causing
need
for
redistricting.

problem
in
downtown
Bloomington

stop

people
who,

whatever
reason,
believe
it
that's

spot
for

amount
of
stay
to
sit
around
and
drink
and
cause
trouble,
and
basically
bespeak,
stupid
or
whatever

know,
but
that
their

actions
and
their
behavior
scared
of
crap
out
of
white
people.

real
concerns
for
kind
of
a
real
nuisance,
and
this
is
during
the
day
now
the
police
are
called
and
about

only
thing
they
can
do
is
just
have
them
pour
out
their
drink

run
them
off

they
always
come
back
and
they
got
more
drink
in
their
back
doing
what
they're
doing
in
like

said.

think
we've
talked
about
this

couple

it

not
work,
they
might
not
fly

this
is
becoming
a
real

we've

this
is
during

day

people
using
those
buses.
For
you
know
we
got
kids
moon
with
kids.
Some
of
the
bus
drivers
are
afraid.

of
the
older
folks
are
afraid,
I'm,
not
perfectly
afraid,
but
every
time
every
time
someone
calls
the
police
on
them
those
people.

treated

abuse,

intimidation
and
back
that's

going
to

can't

What
needs
to
be
done
is
you
need
to
designate
that

either
a

no-fly

kind

a

penalties

like
that

need

modify

kind

situation
can

police

generate

I
just
want

reiterate,
as
the
staff
back
of
report
indicated,
we
have
about
25,000,
that's
25,000
traffic
signs
throughout
city
of
Bloomington.
What
we
have
currently
and
and
what's
pretty
you
know
traditional
and
is
we
have
a
manual
system
a
hand?
You
know
handwrite
system
to
really
inventory.

Keep
track
of
these
frankly
I
think
it's
also
important
to
point
out
that
staff
resources
really
haven't
been
sufficient,
probably
to
spend
the
kind
of
management
time
you
know
overseeing
these
25,000
signs
as
we
needed
to
and
then
the
other
key
point
is
that
the
federal
government
is
mandating.
This
is
a
federal
mandate.
The
traffic
sign
certain
traffic
signs
include
this
retro
reflectivity
on
the
signs,
which
is
a
new
requirement,
a
little
bit
more
costly.

it's
designed
to
help
the
motoring
public
see
these
signs,
especially
regulatory
signs
across
the
nation,
in
order
to
achieve
greater
efficiency
effectiveness
and
have
better
management
control
over
when
these
signs
need
to
be
replace.
People

gone

automation,
trying
to
take
this
database
and
put
it
in
electronic
format.
Not
only
so,
you
have
a
mated
inventory
electronic
database
to
go
to,
but
also
what
we
see
this
doing
is
giving
us
each
year
through
monitoring
reporting.

permit

family
dwellings,
for

property
located

1021,
1025,
1031,
1037

1041
exton
drive,
and
there
has
been
a
last-minute
concession
by
the
developer
and
city
manager.

You
let
me
first
just
by
way
of
just
brief
overview
as
you've
seen
in
the
material.
The
applicant
is
proposing
52
story
apartments
they're
on
Exum
over
on
the
city's
east
side.
This
is
in
a
currently
zoned,
be
one
commercial.
They
went
before
the
Zoning
Board
of
Appeals,
on
May
fifteenth
and
on
a
five
to
one
vote.
The
special
use
permit
was
recommended
to
the
council
for
your
approval.
Staff
in
its
review,
did
find
that
the
applicant
had
met
the
criteria
for
a
special
use.

Permit
recommended
approval,
however,
as
indicated
earlier,
there
is
concerns
that
have
been
expressed
by
residents
and
others
in
the
in
the
area
and
that's
documented
in
both
the
petition
and
in
the
minutes
of
the
cba
and
so
forth.
As
a
result
of
staff's
review
of
this,
as
we
were
getting
ready
to
prepare
the
staff
backup
report
in
the
ordinance,
we
did
include
two
additional
conditions
and,
as
you've
seen,
the
one
condition
is
that
the
applicant
has
to
provide
off
street
parking
or
staging
area
for
construction
vehicles.

putting
together
the
staff
backup
report,
the
developer
has
submitted
some
additional
information,
including
what
they
are
calling
a
modification
to
their
plan,
one
which
would
delete
I
believe
it's
for
apartment
units
and
they
would
install
some
playground
material.
At
this
time,
I'd
like
to
have
our
corporate
counsel,
Todd
Greenberg
come

attached

questions

answers
some
additional
information
just
on
special
use
permits,
and
we
do

situation

council
has
both
the
written
record

the
Zoning
Board
of
Appeals

further
information

developer
on
modifications
they're
proposing
to
the
plan
and
to
help
the
council
with
advice
and
counsel
how
to
consider
that
and
the
options
you
have
tonight
on
this
application.

that
sums
it
up
pretty
well,
you
have,
the
ability
to
you
know,
decide
that
special
use
permit
and
be
approved
either
as
in
the
form
that
it
was
brought

additional
restrictions.
The
City
Council
wishes
to
place
on
it.
If
the
City
Council
believes
that
the
information
received
at
the
Zoning
Board
meeting
is
not
sufficient
for
you
to
make
a
decision.

Chapter
2
section
26
of
the
City
Code,
provides
that
in
most
cases
of
the
City
Council
will
not
rehear
matters
that
have
already
been
referred
to
a
board
or
Commission
for
a
public
hearing
and
there's
two
reasons
for
that.
First.
Is
that
to
impress
that
and
in
fact
the
the
proper
time
for
people
to
state
their
objections
to
give
evidence.

That
type
of
thing
is
at
the
public
hearing
and
also
because
it's
it's
difficult
in
the
context
of
a
Monday
night
city
council
meeting
for
the
city
council
to
make
findings
of
fact,
particularly
when
they
might
just
be
hearing
from
one
person
rather
than
other
people
who
might
be
able
to
give
additional
information
or
even
rebuttal
information.
So
that's
mainly
it.
There
are
six
standards
which
usually
are
the
Zoning.

Board
is
required
to
make
findings
of
fact,
and
if
the
council's
belief
is
that
there
isn't
sufficient
evidence
for
you
to
be
secure
with
one
of
those
six
findings
of
fact,
it's
staffs
recommendation
to,
if
that's
the
real
reason
to
then
to
send
it
back
to
the
board
for
additional
evidence.
But
we
also
put
in
the
request
that
these
are
citizen
committees
and
don't
simply
send
it
back.
You
know
in
order
to
avoid
making
a
decision,
because
it's
also
an
imposition
on
the
citizens
who
serve
on
those
boards
and
commissions,
but
one.

clarification
and
I
think
maybe
member
black
might
weigh
in
here
and
the
county.
We
were
told
essentially
if
we
couldn't
consider
any
additional
facts
that
weren't
done
but
gathered
by
the
ZBA.
So
there's
the
elected
representatives

were
bound
by
whatever
was
collected
by
the
CD.

that
correct,

checked,
obviously,
we've
got
more
ability
as
a
home-rule
municipality,
then
the
county
does.

county
is
strictly
covered
by
the
county's
code
in
the
revised
statutes,
or
I
should
say
the
compiled
statutes,

showing
how
old
I
am
it's
a
you
know,
and
that
may
be
the
reason.
So
you
you
have
slightly
greater
latitude
than
the
County
Board
does
thank.

just
like

counsel

clarify
if
the
council
were
to
approve
the
special
use
permit

tonight
by
ordinance.

wanted

they
have
the
option
of
approving
the
original
plan
as

amended
submitted

developer

fire
have
indicated

additional
development
would
not

problem

departments,

we
can

recommended.

zba
has
recommend
this.
As
we
often
say
up
here,
we're
not
opposed
to
more
public
comment,
but
if
we
return
this
to
a
border
commission,
as
recommended
here
we're
on
a
very
slippery
slope,
because
there
is
always
more
information,
the
second
time
around.

the
ZBA
did
not
see
this
revised
plan,
where
the
developer
is
just
as
a
Friday
said
that
they
would
be
willing
to
eliminate
for
apartment
units
and
in
its
place,
put
in
some
playground
equipment

space

equipment
in
the
project
area.
Yes,
was
discussed,
but
at
that
time
the
developer
did
not
offer
this.
It
just
came
in
between
the
ZBA
action
and
tonight's
councilman,
so.

there's
not
been
public
comment

on
the
revised
petition
by
the
developer.

that

so
I
guess
one
of
the
principles
here
and
I
agree
with
with
alderman
freuen

he
says.

want

try

create
an
efficient
process,
but
we
also
don't
want
to
encourage
and
enable
a
process
that
allows
changes
after
public
comment
happens
at
the
board
and
Commission
level
and
then
brings
it
to
us
without
having
what
I
would
I
mean.

another
person,

change

mean
it's
kind
of

the
eye
of
the
beholder
and
so
for
me,
I
guess
the
principle
is:
do
we
want
to
make
sure
that
whatever
we're
voting
on
tonight

been

vetted?

will
or
heard
in
its

its
proposed
form
at
the
board
or
Commission
level
before
it
comes
to
the
City
Council
and
what
I'm
hearing
is
it
has
not
been
so
I
just
want
to
be
sure.

that

important

have

much
information

possible

the
size
of

also
for
the
neighbors

area

be
able
to
have
a
chance

speak
up,

frankly,
I
think
we,

issue
of
time
was
raised
as
well
the
time
that
the
CBA
holds
meetings.
It's
true
that
people
you
know
if
they
can't
make
it
they
can't
make
it,
but
is
it
you
know
adequate?

to

we

hit
the

have

The
conversation

concerns

that

unit

could
possibly

understand

better

that

bid
again

public's

doubling

hundred
percent
increase

funding

sidewalk
repair
throughout

compliments

our
engineering
staff
and
their
their
evaluation
of
the
condition
of
sidewalks
throughout

city.
But
again,
this
is
a
big
increase
in
funding
over
last
year.

remember
about
four
years
ago,
we
may
have
only
had
about
a
hundred
thousand
dollars,
so
I
think
it
shows
your
commitment
to
infrastructure
in
the
city,

certainly
with
the
engineering
design
underway
for
phase
two

you've
approved,

able
to
even
begin
to
go
further
in
looking
at
how
we
can
further
improve
sanitary
sewers
stormwater
for
future
phases.

point
out
going
back
to
the
Exim
road
that
one

projects

city,
staff
and

the
city
is
going
to
be
embarking

and
that
is

Bloomington

directions

move
ahead
with
that
project.
What
I'd,
like

begin
thinking
about
is,
as
just
with
the
extant

many
of
our
residents

home
buyers.

feel

there's

topic

looking
at

large
multifamily
development
projects,

addressing

quality

life

complexes
around

city
usually
are

lot
of
those
amenities
open
space,

finding

density
type

the

Plan
