completed
and
just
appreciated.

Wilmington
Police
Department
received
a
complaint
regarding
unreasonable
noise
at
the
property
located
at
557
South
dolma
Avenue
in
Bloomington
officer
Kylie
Jarrett
of
the
Wilmington
Police
Department,
who
is
here
on
Zoom
today,
responded
to
the
call
and
arrived
at
the
scene
at
approximately
3
26
pm
officer,
Scott
Reynolds
arrived
at
the
scene
to
assist
at
approximately
3
32
pm,
while
a
block
away
and
approaching
the
property
officer,
Jared
was
able
to
hear
loud,
music
playing
and
identified
that
the
sound
was
coming
from
the
property
she
arrived
at
the
scene
and
identified
two
large
speakers
on
the
property
that
were
amplifying
music
and
facing
west
into
the
apartment.

she's,
going
to
testify
to
those
facts.
Today
at
approximately

PM
officers,
Jared
and
Reynolds
made
contact
with
Joseph
Hardwick
Benjamin
Kim
and
Adam
Madonia,
who
are
the
talents
and
the
occupants
of
the
property.
Apparents
were
issued
a
ticket
each
for
unreasonable
noise
and
assessed
a
fine
of
50
each.

The
facts
establish
a
noise
violation
of
the
city
of
Wilmington
noise
ordinance
which
says
that
if
the
sound
persists
continuously
or
intermittently
for
a
period
of
at
least
15
minutes
and
can
be
heard
outside
the
immediate
premises
from
the
location
of
the
emitter
by
a
person
with
normal
hearing,
then
a
violation
has
occurred.
And
now
officer
Jared
is
going
to
testify
to
those
facts.

three
citations
for
the
same
address
and
all
three

three
of
the
individuals
issued
the
noise
violations
were
all
on
the
lease
for

apartment.

noise

who
owns
the
speakers

and

the
police.

reason
why
the

citations
were
issued.

was
based
on
the
noise
coming
from
the
apartment
or
at
the
outside
of
the
apartment,
where
the
speakers
were
located,
which
was
just
outside

door.

be

present
our
case.

So
as
you
all
aware,
this
was
little
500
weekend
in
Bloomington
and
so
in
the
spirit
of
little
five,
our
neighbors
wanted
to
throw
a
block
party
for
the
living
complex
where
we
lived
and
so
the
days
leading
up
to
this
event.
They
went
to
the
front
office
and
got
this
block
party
pre-approved
and
they
were
actually
able
to
go
to
every
other
door
on
our
living
complex
and
put
up
posters
for
this
block
party,
as
well
as
posters
in
the
front
office
and
on
the
shuttles
driving
to
and
from
campus.

So
a
lot
of
people
around
this
living
complex
knew
that
this
was
going
to
happen
and
it
was
scheduled
for
two
o'clock
on
this
Friday,
but
at
two
o'clock
it
started
to
rain
and
it
was
raining
really
hard
and
our
neighbors
didn't
want
their
speakers
to
get
wet.
So
they
asked
if
they
could
put
their
speakers
on
our
property
and
we
had
no
problem
with
the
neighbors
putting
their
speakers
in
front
of
our
place.

we
agreed
and
then
our
neighbors
were
the
ones
that
were
playing
the
music
but
then
fast
forward
an
hour
an
hour
and
a
half
when
the
cops
showed
up,
and
they
told
us
that,
because
of
the
speakers
were
in
front
of
our
property,
even
though
we
weren't
playing
the
music,
we
were
liable
for
all
the
noise
and
then
we
all
got
written
up
for
each
50
citation
each
speaking
that
this
was
on
a
Friday
at
three
to
four
o'clock.

then
the
officer
also
said
that
we
were
being
resistant
because
at
the
time
they
arrived,
I
was
at
my
neighbor's
house.
My
roommates
were
not
outside,
they
were
inside,
they
didn't
know
what
was
going
on,
and
so
she
told
me
that
I
had
to
give
her
my
ID
and
go
get
all
my
roommates.
So
I
went
inside
to
tell
my
roommates
that
the
cops
were
here
and
we
have
to
give
them
all
our
IDs
and
they
were
inside
watching
the
Cubs
game
at
the
time.

were
inside
for
a
while
calling
our
parents
before
we
did
finally
come
outside
to
confront
the
officers
that
were
at
the
scene.

I

just
like
to
take
this
opportunity

publicly
apologize

officer
Kylie
for
acting
confrontational
when
she
arrived
at
our
door
as
Mr
Madonia
stated,
I
was
in
time.

was
inside

the
entire.

duration
of
the
start
of
the
party
I
had
not
come
outside.

was
watching
the
Cubs
game,
I
believe
they
were
playing
the
Reds
at
Wrigley
and
as
Mr
Madonia
came
back
up
to
our
door,
he
opened
the
door
and
said:
hey.
There's
cops
here
that
need
our
IDs,
to
which
I
told
him
to
simply
just
shut
the
door.

were
basically
just
there
because
a
they
were
our
neighbors,
so
we
kind
of
had
to
be
involved
with
what
they
were
doing

technically
on
our
porch.
The
speakers
were
allowed
to
some
degree.

will
admit,

know
how
loud
they
were,
but
we
had
sort
of
made
points
like.

be

bit

waiting
until
people
start
to
show
up,
that
should
be
fine

we
just
wanted

sure
that

everything
wasn't
incredibly
loud,

it's

bit
harder

tell

inside
of
the
property

outside

interacted
with
the
police

this
situation

asked

three
lesses.

sounds
like,
and
so
that's,
but
it
certainly
sounds
like
an
officer
discretion
type
of
issue,
okay
and
that
they
chose
that
officer.
Jarrett
chose
to
issue
all
three
citations.

couple
other
comments.
If
you
don't
mind,
you
know
for
the
appellants,
you
know
whether
or
not
they
purchase
the
speakers
or
anything
else.
They
allowed
the
speakers
to
be
on
their
property,
making
the
noise
that
was
part
of
the
citation.
So
you
know
as
much
as
they
want
the
the
neighbors
were
hosting
the
party,
this,
the
noise
emanated
from
their
their
property,
so
that
is
where
the
citations
would
be
issued
per
standard
practice.

it

been
standard
practice
for
many
years
where,
during
little

weekend,
there's
not
a

if
the
apartment
manager
or
apartment
complex,
approves
a
party
on
their
site,
it
doesn't
mean
that
city
code
doesn't
need
to
be
followed.

sweaters
created

area
fabric
artists
on
City
trees
in
the
public
right-of-way.

that

promote

encourage

charity,

and
respect
will
help

heal
from
past

abuse

discrimination

move
forward

brighter

future

using
designs

sweaters
help

city
convey

beliefs

agreement
amount
is

couple
brief
updates
mentioned
earlier
in
our
work
session
about
these
first
we
have
Duke
Energy
had
a
scheduled
Sunday
workday
on
June
11th.
That
was
a
rain
day.
They
did
not
get
to
complete
the
work
they're
looking
to
move
that
to
this
coming
Sunday.
This
is
down
on
South
Rogers
Street,
so
staff
is
working
with
them
on
that
change
of
date.
For
that
just
a
couple
notes
from
Public
Works.

So
first
we
took
some
sanitation
rate
updates
to
the
city
council
last
week
and,
unfortunately,
a
final
decision
of
not
approving
the
rates
as
proposed,
so
that
vote
failed
with
the
council
after
some
deliberations
and
conversations
about
different
rate
model
structures,
so
we'll
be
going
working
throughout
the
month
of
July
to
work
with
the
Council
on
a
different
rate
package,
hoping
to
move
that
forward
in
Late
July
and
early
August
before
our
budget
process
and
then
just
another
update.

But
we
did
a
sidewalk
and
pavement
report
condition
report
to
the
city
council
and,
as
part
of
that,
we
often
get
used
Lane
miles
or
Center
Line
miles
or
miles
of
sidewalk
as
how
we
try
to
present
that
data
and
information
in
an
effort
to
try
to
provide
some
scope
and
some
you
know
different
perspective
on
what
that
actually
means.
In
terms
of
square
footage.
We
asked
our
consultant
and
our
contractor
to
provide
some
calculations
for
us.

was
a
major
error
on
those
calculations,
so
we're
working
on
a
formal
update
to
that
presentation
and
a
memo
to
the
Council
on
what
errors
were
present
in
the
report.
Why
they
existed
the
way
they
did
and
and
go
from
there
in
the
end
it
it
means
we
don't
have
7.7
billion
square
feet
of
sidewalks
in
the
community,
but
we're
working
towards
a
correction
official
correction
with
the
Council
on
that.
So
just
wanted
to
make
the
board
and
others
aware
of
that
one.
