2023,
meeting
of
the
city
of
Boise
ethics
Commission.
With
that
being
said,
we'll
take
a
roll
call
clerk
church.

that
being
said
minute

minutes,
approval
entertain
if
any
of
the
Commissioners
don't
have
any
changes
or
anything
to
the
minutes.
We
have
six
six
separate
meeting
minutes,
so
we
just
categorize
those
at
one
time
and
just
vote
on
all
of.

that

put

If

one
of
the
inquiries,
so
the
commission
has
looked
at
each
one
of
the
questions
as
it
pertains
to
the
first
question.
Is
it
ethical
for
a
sitting
Public
Works,
commissioner,
to
knowingly
make
false
statements?
The
first
point
is
that
this
is
a
Time
barred
issue.
The
facts
allege
relate
to
actions
that
occurred
on
June
20th
2021.
The
inquiry
was
filed
on
March
23
2023,
which
is
more
than
one
year
after
the
alleged
incident.

Pursuant
to
Boise
code
2-12-4,
the
ethics
commission
is
prohibited
from
accepting
inquiries
about
actions
that
took
place
more
than
one
year
prior
to
the
date
that
the
inquiry
was
filed.
The
inquiry
filed
on
March
23rd
of
2023
alleges
that
the
action
took
place
on
in
July
of
2021.
Therefore,
the
ethics
commission
has
no
jurisdiction
any
further
thoughts
on
this
commissioners.

Seeing
none
I
will
go
to
the
second
question
about
eroding
public
conflict
confidence.
The
facts
alleged
in
the
inquiry
indicate
that
the
commissioner
was
acting
on
a
personal
capacity
rather
than
as
an
official
commissioner,
and
does
not
support
the
findings
that
the
commissioner
violated
any
specific
provision
within
the
code
of
ethics.

To
the
third
question,
is
it
ethical
for
a
public
works,
commissioner
to
have
an
apparent
conflict
of
interest?
Looking
specifically
at
violation
of
city
code
1-8-4,
the
commission
found
that
the
inquiry
does
not
identify
any
specific
matter
in
which
the
commissioner,
in
His
official
capacity,
had
an
apparent
conflict
of
interest.
The
inquiry
asked
the
ethics
commission
to
presume
a
conflict
based
on
commissioner's
interactions
as
a
private
citizen
with
the
Harris
Ranch
Community
infrastructure,
District,
there's
no
basis
for
such
presumption
and
the
inquiry
is
not
identified.

therefore,
I
would
move
that
we
instruct
staff
to
draft
a
dismissal
of
this
inquiry
based
on
the
information
I
just
gave.

Mr
chairman
I'm,
just
going
to
report
out
on
the
ethics
commission,
email
activity
and
the
ethics
commission
hotline
activity.
There
is
nothing
to
report
on
either
of
those
outside
of
the
occasional
spam
email
that
is
not
Germaine
or
really
directed
at
the
ethics
commission
at
all,
and
then
some
travel
inquiries
as
well.

The
only
there
was
one
ethical
question
posed
by
a
Bay
City
employee
out
of
parks
that
potentially
may
come
forth
at
some
later
date
as
a
request
for
advisory
opinion,
but
that
was
not
made
in
advance
of
this
meeting
there.
There
was
a
little
bit
of
back
and
forth
on
the
email
account,
and
that
was
just
to
instruct
this
person
that,
if
they
wanted
to
have
this
question
answered
in
a
formal
capacity,
they
needed
to
bring
it
forward
as
a
request
for
advisory
opinion
outside
of
that.
