background
on

how
this
was
kind
of
came
about.

think
it's
I've
been
open
about
the
fact
and
my
belief
that
many
years
ago
the
un
declared
housing
to
be
a
human
right,
and
I
firmly
believe
that
every
resident
within
our
city
should
be
able
to
realize
that,
and
I
think
that
passing
this
ordinance
will
help
move
us
towards
ensuring
that
everyone
and
tenants
within
our
city
will
have
a
safe
place
to
rest,
their
head
every
night
or
work
from
or
call
a
home
statistically,
and
this
isn't
a
surprise.

Statistics
from
rhode,
island,
kids
count,
2.8
percent
of
children
tested
entering
kindergarten
this
year
tested
positive
for
elevated,
live
levels,
elevated
levels
of
lead,
so
we
have
a
lead
issue
within
the
city.
We
also
have
issues
with
just
regular
maintenance
of
housing
code
and
ensuring
that
properties
are
up
to
state
and
local
codes.

saw
it
on
bluff
avenue
where
a
brick
facade
partially
collapsed.
We
saw
it
on
broad
street
where
a
second
floor
walkway
partially
collapsed,
and
that
has
a
serious
impact
on
people's
lives
and
including
in
those
examples,
displacing
them
and
I'll
be
honest.
Before
I
before
I
joined
the
council,
I'd
never
been
a
renter,
I
never
owned
property
or
never
rented
property
to
anyone
else.
So
I
was
ignorant
to
some
of
the
plight
that
tenants
may
face,
and
I
recognize
that.

Well,
if
the
unit
they're
living
in
is
out
of
code
law
says
that
they
can
they're
free
of
retaliation,
a
landlord
can't
retaliate
against
them
if
they
were
to
to
bring
up
any
issue,
and
about
two
months
into
my
first
term,
I
received
a
call
from
someone
in
the
arlington
neighborhood
who
had
concerns
about
their
this.
The
conditions
of
the
unit
that
they
were
living
in
the
heat
wasn't
working.
A
There
was
a
leaky
pipe.
They
were
concerned
about
water
damage
leading
to
mold
as
well
in
the
future,
and
my
gut
reaction
was
well.
Let's
call
the
inspections
department,
because
that's
that's
what
they're.
You
know,
that's
what
they're
there
for
and
she
I
mean
you
could
hear
the
trembling
in
her
voice.

Excuse

fee
and
that
certificate
would
be
good
for
three
years.
So
essentially,
if
you're
a
landlord
in
the
city
of
cranston.
Under
this
proposal,
you'd
pay
a
hundred
dollars
every
three
years

average
it
out
three
dollars
a
month,
you
have
to
make
sure
that
your
rental
unit
is
up
to
code,
which
you
already
have
to
do
and
if
any
lead
mitigation
law
applies
to
you,
you
got
to
have
your
lead
certification,
that's

apply
to
owner-occupied.
Single-Family
housing
doesn't
apply
to
owner-occupied
units
if
you're
a
landlord,
and
you
accept
vouchers-
it
also
doesn't
apply
to
you
and
then
the
point
behind
that

hopefully
also
incentivize
property
owners,
to
accept
more
vouchers
to
help
clear
the
back
lot
on
backlog
on
that
as
well
and
open
up
more
opportunities.

abundance

caution

full

have
rental
property
here
in
the
city
of
cranston.

moving

when

writing
up
what
I
wanted
to
say
that
councilman
donegan,
my
husband
and
I
bought
our
first
house
when
you
were
10..
So
I
thought
that
that
was
interesting.
So
my
husband
and
I
have
been
have
been
on
property
owners
landlords
for
about
21
years
now,
we've
had
two
multi-families
one
in
councilman,
donegan's,
ward
and
one
in
ward
one.

So
we
started
out
as
many
three
family
landlords
do
as
first-time
homebuyers
living
owner-occupied
in
a
house
that
passed
inspection
and
was
up
to
code
when
we
bought
it.
Many
three
fans,
so
I'm
speaking
mainly
on
multi-families
many
three
families
in
cranston
are
bought
by
young,
first-time
home
buyers
who
live
in
their
house
that
passed
inspection
and
had
no
code
violations.
O
I
think
we
need
to
step
back
and
take
a
closer
look
as
to
why
some
multis
aren't
up
to
current
code
and
address
those
issues
prior
to
passing
another
ordinance.
My
suggestions,
often
code
updates,
aren't
done
for
two
reasons.
As
I
said,
they're,
costly
and
also
no
one
knows
about
them
passing
another
ordinance
for
safety
sounds
good
in
theory,
but
landlords
need
to
know
what
is
already
expected
of
them.
Clicking
on
the
ordinance
link
and
trying
to
read
through
pages
of
city
ordinances
is
confusing.
O
I
learned
about
new
ordinances.
Only
through
word
of
mouth,
I
suggest
a
single
page
checklist
of
the
top
items
an
inspector
will
be
looking
for
by
knowing
ahead
of
time
which,
what
needs
to
be
done.
Landlords
can
work
on
these
items
prior
to
an
inspector
coming
with
hopes
that
the
apartment
will
pass
and
the
inspector
will
not
have
to
return
in
the
long
run
it
will
save
time
and
money.

I
also
suggest,
when
those
of
you
running
for
reelection
knock
on
doors
use
that
opportunity
to
pass
out
pamphlets
about
updated
ordinances
kind
of
a
did.
You
know
that
the
fire
code
changed.
Did
you
know
that
about
the
lead
issue,
certification
and
I
suggest
using
the
yearly
tax
letter
that
comes
from
the
mayor
as
a
time
to
send
out
information,
also
about
new
and
updated
ordinances?

can
be
sent
out
with
every
safety
certification
for
those
landlords
who
pass
the
first
inspection
without
having
to
make
changes,
give
them
a
break
and
say
the
next
inspection
will
be
in
five
years
instead
of
three
and
in
addition,
all
current
codes
for
single
family
houses
need
to
also
be
followed.
My
multi
needs
to
be
led
safe.

Yet
we
all
know
the
exteriors
of
many
family
home
single
family
homes
that
are
sanded
and
painted
with
no
lead
safe
precautions,
and
what
about
the
single
family
on
south
marion
that
had
multiple
complaints
prior
to
the
fire,
so
safe
home,
I
feel,
should
be
safe
home,
regardless
of
whether
or
not
it's
single
or
multi-family
and
as
always,
council.

not
want
this
ordinance
passed,
I
truly
appreciate
your
dedication

cranston.

briefly
elaborate
on
some
of
the
comments
that
I
offered
in
my
letter
of
april
12
2022,
which
I
believe
the
clerk
has
shared
with
the
committee
at
the
appropriate
time.
It
asked
that
my
letter
be
accepted
as
part
of
the
record
of
the
hearing,
I
want
to
first
acknowledge
an
error.

It
also
did
not
appear
on
the
website's
list
of
boards
and
commissions
and
is
now
listed
with
the
secretary
of
state's
office
under
their
public
body
list
for
cranston
councilman
donegan
last
night
was
nice
enough
to
approach
me
and
gently
point
me
to
section
15
of
the
code,
which
I
obviously
did
not
do
before
writing
my
letter
and
I
apologize
that
said,
I
know,
he's
put
a
lot
of
time
into
this
ordinance
with
the
co-sponsors
and
while
he
and
I
share
a
great
affection
for
providence
college
friars,
I
must
part
ways
on
the
intent
and
substance
of
this
ordinance.

Councilman
donegan
has
done
its
best
to
promote
this
ordinance
as
a
cranston-safe
occupancy
ordinance
with
some
nice
graphics
on
facebook,
and
I
told
them
that
last
night.
It
suggests
that
if
you're
not
supporting
this,
then
you
must
be
against
safe
occupancy
for
residents
and
tenants,
and
I
urge
you
not
to
follow
down
that
rabbit
hole.
Everyone
wants
safe
dwelling
units
and
I
suggest
that
most
housing
units
in
this
city
are
already
in
compliance.

I
represent
a
number
of
landlords
who
take
serious
seriously
their
responsibilities
to
provide
safe,
clean,
lawful
housing
in
the
city.
Are
there
people
who
do
not?
Absolutely,
if
you
say
no
to
this
form
of
this
ordinance
in
its
form,
you're,
not
saying
no
to
safe
housing.
You
would
be
saying
yes
in
all
honesty
to
less
intrusive
government,
yes
to
less
administrative
bureaucracy
for
residents
and
landlords,
and
no
to
adding
thousands
of
dollars
in
costs
to
the
city
and
no
on
imposing
increased
duties
on
an
overly
taxed
department
of
inspections.

Who
cannot
undertake
the
substantial
obligations
they
already
have.
This
is
not
as
simple
as
creating
a
new
administrative
structure
with
more
employees
and
charging
a
hundred
dollars
each
for
each
certificate
to
pay
for
it.
The
implementation
of
this
ordinance
has
far-reaching
impacts
from
requiring
personal
information
from
landlords
that
has
no
correlation
to
safe
housing
and
puts
in
the
public
domain
information
that
nobody
should
have
to
share.

It
is
paying
an
approved
outside
inspector
to
come
and
view
each
unit
covered.
It
could
mean
spending
hundreds
or
thousands
of
dollars
to
bring
a
property
up
to
the
latest
code
and
then
once
you
have
the
certificate
and
file
it
with
the
build
inspector,
they
must
conduct
an
inspection
of
each
unit
and
determine
that
one
that
each
one
is
not
in
violation
of
the
cranston
city
code.

What
does
that
mean?
Cranston-Specific
code
provisions
are
somewhat
outdated,
so
they
adopt
the
state
building
code,
which
code
applies
to
which
specific
property
are
there
any
grandfathered
units?
When
you
say
code,
are
we
also
talking
about
the
plumbing
electrical
and
fire
code,
all
required
separate
disciplines
and
different
inspectors?

Under
this
ordinance,
the
building
official
must
go
back
to
his
office
and
send
a
certified
letter
detailing
violations
and
a
date
for
corrective
action
respectfully.
Have
you
tried
lately
to
hire
any
tradespeople,
never
mind
the
supply
chain
issues
and
getting
the
right
or
proper
material
and
supplies?

The
ordinance
impacts,
commerce
and
real
estate
in
the
real
estate
industry
by
requiring
on
a
sale
that
the
former
owner
shall
transfer,
shall
transfer
to
the
to
the
new
owner
a
current
certificate,
and
then
the
new
owner
is
obligated
to
amend
the
information
within
30
days
of
its
transaction.
What
happens
if
they
don't
on
lines?

raise
violations,
it
mentions
violations
of
federal
state
and
local
building
zoning
and
housing
codes
as
cause
for
revocation
of
a
certificate.

we
introduce
the
zoning
official

process

the

inspectors

sending
renewal
notices
to
managing
operators,
resident
agents
and
trustees.
I
assume
it's
an
omission
that
you
don't
include
just
regular
property
owners
of
one.
You
know
a
two
family
house
or
a
three
family
house.

everybody,
has
a
property
manager.
The
enforcement
action
introduces
the
housing
border
review
into
this
process.
It
was
established
under
our
ordinance
as
an
appellate
board
for
property
owners
to
appeal
from
a
compliance
order
they
receive
in
this
ordinance.
It
is
set
up
as
an
enforcement
arm
of
the
building
official.

If
you
review
the
existing
housing
board,
ordinance,
which
technically
exists
only
on
paper,
a
person
brought
before
them
has
the
right
of
court
review
of
any
adverse
decisions
by
filing
a
rid
of
society
in
the
supreme
court.
The
lawyers
on
this
committee
can
explain
it
better
than
I,
but
if
you're
summoned
by
the
board
of
review
as
a
landlord,
your
only
appeal
is
by
a
discretionary
writ
to
the
state's
highest
court
and
they
may
or
may
not
allow
the
matter
to
be
heard.

In
my
written
correspondence,
I
provided
a
breakdown
from
the
tax
assessor
that
I
received
at
the
beginning
of
march
on
the
number
of
dwelling
units
in
cranston,
if
only
eight
to
ten
percent
of
the
twenty
thousand
single-family
homes
are
considered
eligible
under
this
ordinance,
because
now
that
you
know
people
own
single-family
homes
that
are
not
that
are
rented
to
other
people,
they
don't
necessarily
live
in
we're
potentially
looking
at.

In
my
opinion,
upwards
of
nine
to
ten
thousand
units
that
could
require
certificates
because
that
list
I
gave
you
you
know
if
it's
a
three
family
house,
there's
three
units.
So
it's
just
not
494
three-family
houses,
it's
1200
units,
most
property
owners-
I
respectfully
suggest-
are
doing
the
right
thing.

The
city
should
go
after
the
small
percentage
of
those
who
are
not.
The
approach
should
be
targeted
and
reflective
of
the
city's
ability
to
undertake
the
act.

effort

burdensome,
bureaucracy,

safety;

government
intrusion,

yes,
but
do
it
by
balancing
the
rights
of

law-abiding
property
owners.

the
infrastructure
that
something

would

to

be
administrative

making
those

calls.

cranston
will
be

barrier
to
attract
investors

think
it's
going
to
unreasonably
burden
the
resources,
certainly
in
the
given
these
requirements
in
inspections
and
in
perhaps
fire
with
that.

would
also
probably
be
unreasonably
financially
costly
to
the
city
that
those
considerations
must
come
into
play.

mayor
feels
that
the
you
know
current
laws,
regulations
of
many
many
facets,
but
the
federal
state
and
local
are
adequate,
addressing
the
fundamentals
of
safety
and
of
our
residents.

the

of

moretti
and
director
rodeo
actually
are
a
good
segue
into
what

was
going
to
bring
up.

think
when
this
was
on
last
month-
and
someone
could
correct

indicated
at
that
time
that,
procedurally,
that
the
ordinance
was
not
in
proper
form
because
of
the
absence
of
a
fiscal
node.

charter
clearly
requires
a
fiscal
note,

attached
to
any
ordinance

likely
or
reasonably
foreseen
to
have
a
financial
impact
on
the
city's
finances
and
based
on
what
I'm
reading
and
also
what
I've
heard
from
both
directors.

seems
pretty
obvious
that
in
also
mr
murray's
comments,
it
seems
pretty
obvious
that
the
if
there
are
in
fact
thousands
of
rental
units
that
translates
into
thousands
of
certificates
in
thousands
of
inspections
which
need
to
be
conducted
and
with
that
is
a
commensurate
increase
in
labor
hours,
personnel,
so
on
and
so
forth.

course,
we
all
know
that
translates
into
cost
to
the
city.
So

think
in
this
instance,
particularly
with
an
ordinance

as
far-reaching
as
this.

it's
pretty
obvious.

would
have

fairly

the

would

to
