A
A
A
A
So
the
public
hearing
item
number
two
is
a
request
from
Newberry
development
for
review
and
approval
of
a
site
plan
kind
of
lis
lots
under
design
guidelines
for
multifamily
dwellings
and
under
design
guidelines
and
c3b
districts
for
property
located
at
4:01,
South,
East,
sixth
Street
and
400
South
East
seventh
Street
to
allow
development
of
a
three-story
fifty-seven
unit.
Multi-Family
dwelling,
it's
my
understanding
that
the
applicant
is
an
agreement,
but
the
staff
recommendations
in
this
item
that.
A
Is
the
applicant
with
this
tonight
and
is
that
affirmative
that
you're,
an
agreement
great?
Is
there
anyone
in
the
audience,
however,
who
wished
to
hear
this
item
tonight
sing
on
anyone
on
the
Commission,
which
is
us
to
pull
this
or
not
move
this
item
to
consent
all
right
sing
man
is
there
motion
to
this
I,
don't
think
so
make.
A
A
Thank
you
item
number
four
is
a
request
to
rezone
property
located
at
28,
33
East,
Alcorn
Street,
and
the
determination
as
to
whether
to
proposed
rezoning
is
in
conformance
with
plan
de
Moines
and
rezone
property
from
a1
agricultural
district
to
are
181
family
residential
district
to
allow
subdivision
and
development
of
the
property
for
an
additional
single-family
dwelling
acreage
again,
it's
my
understanding
that
the
applicant
is
an
agreement
with
the
staff
recommendations.
Eric
is
that
true.
A
Right
we'll
leave
beside
him
on
the
public
hearing,
then
so
item
number
one
and
ID
number:
two,
our
consent
items
for
tonight.
Item
number:
one:
is
the
city
initiated
request
to
amend
plan
des
moines
to
adopt
the
market
district
of
the
East
Village
master
print
plan
as
an
element
which
we
just
heard
the
proposal
and
then
item
number
two
I
read
the
Newbery
development
is
their
motion
for
these
two
consent
items.
E
A
A
B
Madam
chair
members
of
the
Commission,
this
item
is
located
at
the
corner
of
Pleasant
View
Drive
in
southwest
ninth.
It
involves
right
now,
I
believe
there's
two
tax
parcels,
this
North
one
and
South
one
involved
in
the
request.
I
think
the
county
records
need
updated,
but
it
looked
like
the
original
deed
includes
a
little
portion
here
as
part
of
a
plat,
a
survey
that
incorporates
the
entire
building
that
there
appears
to
be
a
property
line
here.
But
everything
in
the
legal
description
of
the
deed
and
request
is
to
the
gold
boundary
that
you
see
there.
B
The
other
thing
about
c2
is
it
potentially
allows
them,
then,
to
request
a
conditional
use
to
allow
sale
about
the
hall
on
premise
consumption
this
tonight
would
not
whatever
you
would
do
this
evening-
would
not
allow
that
by
right.
It
would
have
to
be
done
through
the
Zoning
Board
of
Adjustment
if
they
pursued
that
provision.
I.
B
Think
that's
one
of
the
concerns
you're
gonna
hear
I
saw
that
in
the
cards
with
regard
to
the
request
from
the
staff
perspective,
we're
looking
at
it
from
how
this
is
addressed
in
plan
DSM,
which
is
right
now,
it's
shown
as
community
mixed-use
as
a
as
a
future
land
use.
But
as
we
look
at
the
projected
zoning
for
the
corridor,
its
oven
of
a
lower
level
of
commercial
along
the
corridor
which,
if
you
look
at
our
existing
zoning,
is
true
as
well.
B
For
the
most
part,
if
you
look
at
existing
zoning,
Southwest
9th
is
a
corridor
of
the
c1
type
commercial,
with
a
few
exceptions
here
and
there,
which
is
more
neighbourhood,
oriented
commercial
versus
highway,
oriented
commercial
in
the
in
the
projected
code,
which
is
pending
adoption.
At
this
point,
this
would
be
looked
at
it
rx1.
B
The
use
of
Thayer
asking
to
go
to
here,
though,
would
be
required
to
in
which
the
gameroom
use
would
require
what
would
be
mx3,
which
is
a
a
few
steps
actually
above
the
rx1.
If
you
look
at
the
hierarchy
of
commercial
zoning
classifications
in
the
proposed
ordinance.
So
when
we
were
looking
at
this
as
a
corridor
and
how
we
are
projecting
to
zone
the
corridor,
we
were
concerned
about
drawing
out
this
little
location
here
for
kind
of
the
some
more
intensive
commercial
activities.
B
F
B
The
concerns
you're
gonna
hear
are,
with
regard
to
the
use
of
the
use
as
a
conditional
use
potentially
for
sale
of
beer
wine
on
premise.
One
of
the
challenges
that
that
would
bring
about
would
be
the
separation
from
this
church,
so
if
they
were
gonna
go
to
the
Zoning
Board
of
Adjustment
to
make
that
request,
they
would
also
be
faced
with
a
variance
request
to
get
that
separation
removed
as
well
even
in
the
projected
code.
It
would
be
the
same
so
from
that
perspective.
B
I
think
you
need
to
understand
that
that
will
be
another
challenge
down
the
road
if
it
gets
zoned
as
they
requested
it.
Are
there
any
questions.
I'll
show
you
the
consent.
Map
I
passed
around
the
cards.
I
also
have
photos
if
you're
interested
to
get
it
Rick
if
you're
not
familiar
with
Southwest
9th
corridor.
These
are
the
buildings
that
we're
talking
about
in
this
area.
B
B
B
A
I
Hello,
ladies
and
riddling
I
draw
pictures
for
a
living,
so
I
apologize
if
I
don't
use
the
proper
decorum,
but
for
this
I
am
I
actually
own.
This
little
green
building
right
there,
and
if
you
see
from
the
picture
that
he
had
before
you
can
see
it's
loaded
with
cars,
I've
been
there
about
nine
years
doing
business
as
on
the
south
side,
my
wife,
Michelle
and
I
are
both
from
graduates
from
Lincoln
High
School
we're
both
South
siders.
I
We
needed
more
space,
so
we
bought
Jim's
appliance
I've,
looked
at
that
building
for
30
years
and
said
what
a
piece
of
crap
Alec
a
secret,
what
a
piece
of
crap
and
we
should
fix
it
up
and
we
should
expand
and
we
should
make
it
bigger.
We
should
make
it
nice.
Why
can't
the
south
side
had
things
to
do?
Why
can't
it
be
nice?
I
I
Maybe
we
should
do
an
arcade
I
like
video
games,
who
doesn't
like
video
games,
so
we
decided
to
move
forward
with
this
plan
I'm
just
sending
an
extra
spot
for
my
customers
to
go
and
their
kids
that
sometimes
come
in
to
tattoo
shops
to
go
next
door
and
play
some
games.
We
did
originally
when
we
were
sitting
this
plan
up.
We
thought
hey.
We
should
probably
maybe
we
should
sell
like
local
beer
or
something
like
that,
and
as
we've
put
this
plan
together
and
we
pushed
along,
that's
not
our
goal.
I
Our
goal
was
never
to
be
a
bar,
so
we
have
decided
to
take
that
out
completely.
We
did
that
weeks
ago,
before
or
I
think
we
even
sent
this
or
after
we
sent
this
in
then
we
will
not.
We
will
just
be
serving
like
fun
pops,
family,
ordering
oriented
stuff,
little
snacks,
things
like
that.
We're
not
looking
to
have
late
hours,
we're
looking
at
like
an
8
o'clock,
weekday,
closing,
maybe
a
10
o'clock
weekend
closing.
It
was
just
something
fun
that
we
could
put
in
here
for
4
Southsiders
to
do
I.
F
I
Know,
if
that's
a
that
we
can
put
in
the
little
sliver
of
this
and
we're
talking
2,000
square
feet,
arcade,
it's
very
small
I,
don't
know
if
we
can
put
that
as
a
precision
to
say:
hey,
we
promise
not
to
sell
alcohol,
we're
not
gonna
pursue
alcohol.
We
understand
that
we're
close
to
a
church
we're
actually
close
to
a
school,
we're
not
interested
in
pursuing
that
at
all.
I
I
We
did
have
a
neighborhood
meeting.
Two
individuals
showed
up
and
I
tried
to
rest
assured
that
I
understand
that
there
was
a
bike
club
that
owned
or
rented
this
property
before
we
owned
it,
and
that
there
was
noise
issues
with
motorcycles
and
bike
nights,
and
all
this
stuff
and
I
can
assure
you,
my
wife
right
there
like
she
will
not.
Let
me
get
on
a
motorcycle
whatsoever.
So
no
bike
nights,
no
motorcycles,
no
loud
we're
not
looking
for
a
club.
I
We
do
want
to
offer
at
some
point
down
the
line,
maybe
like
art
classes
for
kids,
I,
don't
know
if
you
guys
know
Egan,
Miller,
very
well,
we've
kind
of
put
stuff
together
for
we
do
airbrushing
for
kids
and
more
art
type
stuff.
There
then,
then,
like
the
bar
club
type
in
itself,
just
want
to
make
that
clear,
not
trying
to
do
any
kind
of
thing
like
that.
I
know
some
people
are
concerned
with
with
that.
But
rest
assured
I
promise,
fingers
grass
and
trying
just
to
make
this
outside
look
nicer.
What.
I
What
somebody
else
did
it
was
more
affecting
what
I
was
doing
again.
I
think
that
was
more
on
the
back
part
of
the
of
the
where
this
little
area
back
here
behind
the
building
was.
My
parking
is
on
the
other
side
of
the
building.
I,
don't
see
that
being
a
problem
right
now
we
had
do
have
a
problem
with
like
illegal
dumping
and
pretty
much
everybody's
kind
of
using
this
as
a
trash.
It's
a
trash
can
back
there
we're
gonna
try
to
tackle
that.
However,
we
can
to
get
it
cleaned
up.
I
I
Would
say:
I'm
not
looking
for
like
claw
games
or
things
like
that?
More
and
they're,
like
preteen
I,
have
a
leavener
old
son
he'd,
be
perfect,
I'd,
say
like
8
to
maybe
I,
don't
know
how
old
teenagers
like
play.
Video
standard
video
games
anymore,
but
it
would
be
in
that
range,
is
what
I'm
thinking
you
know
still
having
fun
still
have
like
the
idea
of
going
in
arcades
like
I,
did
when
I
was
in
the
90s
and
80s.
I
K
I
It's
been
almost
nine
years,
I
think
that
we've
been
there
and
we
haven't
had
any
problems
when
we
first
moved
the
neighbor
right
next
dose.
We
did
have
a
few
issues
that
we
had
to
work
with
as
far
as
like
you
know
how
we
keep
our
garbage
cans
and
how
we
park
and
things
like
that.
But
we've
you
know.
Actually
we
we
worked
with
her
so
much
that
now
she
sent
us
Christmas
cards
and
things
like
that.
We've
really
tried
to
make
Southwest
9th
better.
I
If
you
see
we
took
advantage
of
your
guys's
programmed
like
beautify
Southwest
night,
we
took
down
all
the
red
garbage
and
put
a
nice
siding
on
that
whole
bit.
We
took
advantage
of
that.
We
want
to
do
the
same
thing
here,
just
make
it
nice
and
a
candy
nice.
It's
got
beautiful
old
wood
floors
and
it's
been
around
since
the
30s.
It's
really
a
neat
building
inside
and
then
once
we
get
through
all
the
permit
process
which
I'm
slowly
swimming
through
now,
we
should
have
something
up
and
going
here
fairly,
hopefully
by
Christmas
fingers
crossed.
D
E
Appreciate
your
question:
I,
don't
know
that
I
want
to
hand,
strap
them
to
that,
because
I
look
at
the
success
of
what
happened
in
the
East
Village
with
the
uptown
with
their
with
their
arcades
right
and
then
you
have
actually
expanded
beyond
that
and
it's
a-you
know
and
they've
been
responsible,
they've
been
a
responsible
business
owners.
I.
Think
it's
a
good
model.
I!
Don't
want
to
keep
them
from
that
opportunity.
B
I
think,
what's
up
so
the
game
rooms
gonna
require
either
the
c2
under
the
current
code
or
the
mx3
under
the
future
code,
regardless
the
Commission
could
put
a
condition
on
it
that
the
owner
would
agree
to
in
writing
and
would
be
recorded
with
the
property
or
would
be
part
of
the
zoning
of
the
land.
That
would
could
restrict
that,
so
they
could
voluntarily
agree
to
that
condition.
F
L
Evening
I
will
ultimately
defer
to
Mike,
because
he
is
the
Guru
of
all
things
new
zoning
code.
But
yes,
there
could
be
a
condition
placed
now
with
the
rezoning
that
condition
will
no
longer
apply
as
of
the
as
of
December
16th.
So
one
discussion
that
we
had
had
was
that
they
deferred
the
rezoning
until
this
new
zoning
code
and
they
could
potentially
request
a
rezoning
to
mx3
with
conditions.
A
Any
requesters
before
we
go
to
audience
all
right
same
man
and
anyone
who
has
concerns
our
first
is
there.
Anybody
who
is
in
favor
of
the
proposal
I
would
like
to
speak
besides
the
applicant
all
right,
then,
if
anyone
has
concerns
or
is
against
the
project
once
again,
if
you
could
step
to
the
mic
or
first
sign
in
did
you
have
ma'am?
Are
you
gonna
speak
to.
N
Okay,
so
here
is
my
house,
and
my
daughter
also,
and
our
bedroom
windows
are
right
up
against
this
church
parking
lot.
There
is
no
way
around
any
sound
okay.
So
when
we
try
to
sleep
at
night
and
she
goes
to
bed
at
8
o'clock,
even
a
slamming
of
a
car
door
and
then
someone
you
know
honking
and
closing
it,
it's
obviously
going
to
wake
us
up
and
it
sounds
as
if
it's
right
in
our
bedroom.
If
you
can
imagine
a
bar
next
to
our
house,
she
would
get
no
sleep
now.
N
N
I
worked
really
hard
to
purchase
my
home
and
find
a
safe
place
for
my
daughter
to
live
a
safe,
quiet
neighborhood
in
her
school
district,
and
it
wasn't
easy
to
look
and
find
the
right
house
that
fit
my
budget
and
I
did
and
I'm
very
proud
of
my
home
I'm,
very
proud
of
my
neighbors
and
I.
Take
good
care
of
it
and
I
want
good,
safe
neighborhood
for
my
daughter
to
live
in
I.
Don't
want
to
look
outside
and
see.
N
I'm,
sorry,
I'm
sure,
there's
gonna
be
a
lot
of
very
nice
people
that
come
to
that
facility.
I'm
sure
there's
gonna
be
some
very
undesirables
that,
if
that
are
going
to
be
welcomed
into
the
neighborhood,
whether
adults
or
young,
teens
playing
arcades
at
an
arcade.
It's
just
it's
gonna,
be
a
mess.
There's
gonna
be
all
kinds:
I
mean
she's
out,
jumping
on
our
trampoline
in
her
backyard
she's
a
preteen
I,
don't
need
a
bunch
of
hug!
Sorry,
you
know
I'm
trying
to
use
the
right
words,
but
I
think
about
the
fears
as
a
mother.
N
N
What
lucky
gal
didn't
tell
the
neighbors
when
they
had
their
city
meeting
the
first
invitation
that
went
out,
and
we
are
so
very
much
against
we're
not
against
businesses,
we're
not
against
tattoos,
we're
not
against
motorcycles.
We're
not
against
you
know,
making
the
neighborhood
better,
but
anyone
who
moves
into
that
building
is
going
to
have
to
repaint
it
because
it's
it
needs
repainted.
So
it's
not
you.
N
Anyone
who
would
have
to
do
that
we
we
understand
that
and
that's
great.
We
are
all
four
and
we
have
had
no
problem
with
lucky
gal.
Either
we
haven't
with
them
doing
tattoos
with
an
arcade
in
a
bar.
Yes,
we
don't
want
the
rezoning
for
many
reasons,
because
all
of
the
neighbors
that
I
spoke
to
and
a
lot
of
them
have
come
together
and
have
asked
for
a
petition
to
be
started.
N
There
are
currently
one
two
three
four
or
five
there's
currently
six
names
and
thirteen
others
that
are
going
to
a
lot
of
the
people
that
receive
the
postcards
were
not
notified
of
the
alcohol
intention
or
the
hours
okay.
So
they
all
received
these
this
right
here.
First,
that's
what
the
neighbors
receive!
First,
okay,
it
says
nothing
about
alcohol.
It
says
nothing
about
the
hours
so
I'll.
Let
you
read
that
and
then
I'm
gonna
show
you
what
was
received
at
the
meeting.
N
Father
attended
the
meeting
out
of
concern
for
her
the
church.
The
Presbyterian
Church
made
very
bad
decisions
which
they
did
admit
to
and
apologize
to
us.
However,
we
don't
trust
that
they're
going
to
make
this.
You
know
I
mean
people
and
that's
in
that
parking
lot.
It's
going
to
affect
all
of
our
neighbors
there's.
N
M
N
Not
a
through
Street
right,
I
shouldn't
have
to
I
mean
accommodate
for
someone
to
make
more
money.
You
know,
I,
just
I
worked
really
hard
for
my
home
and
a
safe
place
for
her
to
live
in.
She
was
falling
asleep
in
school
when
the
church
rent
it
out
to
someone
else
previous.
They
would
literally
be
right
by
our
bedroom
windows,
and
you
cannot
tell
me
that
the
overflow
parking
isn't
going
to
be.
N
N
A
N
Have
started
yes,
we
can
provide
the
names
that
we
have
right
now
if
you'd,
like
the
postcards
that
went
out,
I,
think
a
lot
of
people
have
changed
their
minds
as
well.
So
a
lot
of
that,
yes,
as
you
received,
were
actually
kind
of
deceitful
because
they
were
not
notified
of
the
alcohol
or
the
hours.
So
I
can
give
you
this
petition
that
has
started
if
you
like.
If
you
want
that
now
they'll
be
fine,
you.
N
N
B
P
Go
Peggy
and
neighbors.
Thank
you
loud
and
slow.
Okay,
dear
neighbors,
thank
you
for
taking
the
time
to
read
this
letter.
So
the
old
James
apartment
building
is
now
bought
by
Lucky
darling.
They
want
to
make
it
an
arcade,
slash,
bars,
I'll,
just
slash
tattoo
parlor
and
in
that
building
that
used
to
be
another
renting
and
they
would
park.
Next.
To
my
to
me
and
my
mom
B's,
when
done,
they
would
wake
us
up
in
the
middle
of
the
night.
P
I
couldn't
rest
and
I
was
falling
asleep
in
class,
and
if
a
lot
of
people
come
to
that
to
come
to
the
arcade
place
and
part
from
next
to
my
window
and
wake
me
up
so
I
can't
get
rest
went
in.
My
mom
said
that
if
it
gets
bad,
didn't
you
know
how
to
move
and
I
don't
want
to
lose
all
my
friends.
So
please
vote.
No.
Thank
you.
Good.
A
M
Boy
singing
but
I
just
wanted
to
point
out
that
there's
there's
a
a
transitional
home
right
now
for
I,
believe
twelve
to
eighteen
year,
old
children
and
I
think
halfway
house
and
that's
positioned
at
the
corner
of
Park
and
10th
and
I
think
that's
been
open
for
maybe
maybe
three
years.
I
guess
I,
don't
remember
for
sure.
M
Don't
know
what
happens,
but
that
when
I
go
to
work
the
next
day,
there's
just
piles
of
garbage
fast
food
wrappers
they
throw
stuff
everywhere
and
I
had
an
idea.
I
thought
I
would
ask
that
neighbor,
that's
right
on
the
corner,
what
they
felt
about
that,
because
there
must
be
the
ones
picking
all
that
up.
But
my
concern
was
just
those
two
worlds:
meshing
where
those
kids
are
already
I.
Don't
know
if
they're
sneaking
out
I
really
don't,
but
my
concern
would
be.
That's.
That's
a
place.
They
would
really
want
to
go.
M
There's
already
kids
showing
up
at
the
transitional
facility
that
I,
don't
think
are
supposed
to
be.
You
know,
meshing,
I,
think
I,
guess
for
a
better
word.
I
would
be
worried,
I
guess
about
the
Protestant.
Just
for
that
reason,
I
guess
the
in
it
and
that's
not
a
lucky
gal
problem.
I
know
you
guys
are
a
good
business
and
you
guys
have
never
you
know
half
a
block
off
night,
there's
not
much
you
miss
and
the
wind
noise.
M
C
M
Is
the
people
that
are
driving
through
because
you
can't
take
a
left
off
of
Boulder,
so
that
seems
you
know,
scary
or
of
a
concern.
I
guess
I
wouldn't
want
anybody.
Did
it
or
anything
like
that
and
I
there's
no
way
around
that
people
have
but
just
learned
that
and
use
it
as
a
highway.
That
was
it.
That's
all
I
wanted
to
say
thank.
Q
Okay,
thank
you.
For
your
time.
My
name
is
Kim
church,
either
about
2,900
Southwest
night
I'm.
Here
to
tell
my
concerns
of
making
30
104
Southwest
9th
Street
into
a
c2
instead
of
the
c1.
It
is
now
I
understand,
lucky
gal
tattoo,
his
purchases
building
to
move
the
tattoo
shop
and,
to
also
add
a
video
arcade
at
this
location.
Many
neighbors
thought
great
place
for
the
kids
on
the
south
side
to
go
to
I.
Q
Had
a
few
questions,
so
I
called
and
talked
with
the
manager
of
the
lucky
gal
tattoo
asked
about
kaha
would
be
served
at
the
arcade
was
towed.
Yes,
they
were
working
on
getting
an
alcohol
license
to
serve
beer
because
it
would
be
limited.
So
this
is
no
longer
a
family
arcade
just
another
bar,
because
I
personally
feel
like
a
smokescreen
has
been
going
on
with
the
word
arcade
to
the
zoning
committee
into
the
neighborhood.
I
know
that
alcohol
permit
has
many
levels
and
cannot
be
issued
within
75
feet
of
a
church.
Q
I
am
wondering
if
this
is
why
the
lucky
gal
building
has
two
addresses
3108
and
3104,
and
they
are
only
requesting
3104
for
the
c2
status
on
leaving
3108
as
a
c1.
Since
lucky
Goff
has
been
opened,
there
has
been
33
case
numbers
requested
by
the
Des
Moines
police
department
at
this
location.
The
university
lucky
gal
has
requested
45
case
numbers
requested.
This
does
not
count
for
various
calls
with
no
charges
filed
so
they're,
getting
a
building
three
and
a
half
times
bigger
and
will
be
trying
to
add
beer
to
this
arcade.
Q
R
My
name
is
Ruth
Kenny
9/10,
Boulder,
Avenue,
Des,
Moines,
Iowa
and
I'm
nervous
as
hell.
Everybody
else
has
really
touched
all
the
bases
that
I
had
questions
about.
The
issue
that
I
have
is
Chris
said
we're
applying
for
a
beer.
The
other
gentleman
said:
no,
that's
off
we're
not
doing
that.
I
think
the
two
of
them
need
to
get
together
and
figure
it
out.
Okay,
the
beer
really
is
a
downer.
Thank
you.
Thank.
I
All
right,
well
I'll
tackle
this
one,
the
first
one,
that's
pretty
prevalent,
I'm
Chris,
I'm,
the
same
guy
I
just
shaved,
because
I'm
helping
a
friend
out
for
a
haunted
house.
That's
me
just
like
my
shave,
the
beard,
it's
yeah,
it's
an
Elvis
thing
anyway,
as
I
said
before,
when
I
started
this,
we
are
not
pursuing
the
beer,
still
not
pursuing
the
beer.
When
we
first
went
to
the
city
we
said
hey.
I
This
is
what
we
want
to
do:
we're
thinking
about
beer
butter,
that
what
are
the
steps
that
are
that
are
in
that
and
whenever
you
open
a
business,
you
go
through
changes
and
choices,
and
this
is
a
good
idea.
This
is
a
bad
idea
and
the
same
flyer
that
I
gave
at
the
meeting
for
the
neighborhood
is
the
same
flier
that
you
have,
it
does
say,
beer,
possibly
blah
blah
blah.
All
these
things.
I
Once
we
went
through
all
that,
we
decided
that's,
not
the
route
that
we
wanted
to
go
we're
not
interested
in
being
a
bar.
My
wife
is
gonna
interested
in
being
out
later
than
nine
o'clock,
so
we
took
that
out.
That's
not
part
of
our
business
plan
and
just
rest
assured.
That's
not
what
we're
doing
here.
Save
it
again.
There's
not
gonna
be
any
beer.
There
I
can't
control
what
you
think
that
I'll
do
with
it.
I
Five
years
from
now,
I
can't
control
how
you
feel
about
that
I
can
just
tell
you
I'm
not
going
to
do
it.
That's
all
I
can
do.
I
can
write
up.
We
can
write
a
provision
or
what
speaking
spear,
whatever
you
want
to
do,
I'm
not
doing
that
now
I
did
buy
the
building
the
tattoo
shop
is
already
moving.
So
it's
making
that
clear,
I
kind
of
felt
like
that
wasn't
gonna
happen.
That's
still
gonna
happen
are
some
of
them
that
undesirables
I'm,
maybe
I,
don't
know
them
personally.
I
I
just
had
to
them
and
I
treat
everybody
the
same,
no
matter
what
some
people
kind
of
look
at
me
isn't
undesirable,
I'm,
just
trying
my
best
just
like
everybody
else,
so
it
is
a
parking
lot.
The
parking
lot
does.
My
parking
lot
does
not
back
up
to
any
any
neighborhood.
That's
the
church's
parking
lot.
So
what
you
see
there?
That's
Church!
That's
not
me!
I
can
only
control
what
happens
in
my
parking
lot.
It's
a
very
small
arcade,
we're
looking
at
2,000
square
feet
tops
maybe
3040
machines.
I
I
I,
don't
know
about
the
case
numbers
sorry,
I've
had
a
couple
times.
I
got
broken
into
that's
about
it.
We
hadn't
had
any
police
come
there
for
any
reason.
No,
no!
No
spitting
on
the
floor.
No,
nothing
so
I'm,
not
exactly
sure
where
that's
coming
from
but
or
the
University.
We
bought
a
new
building
for
that
location
too,
and
moved
it
from
out
of
the
strip
mall
and
pretty
good.
So
far,
nine
years
so
and.
I
I
An
arcade
well
does
that
change
I
closed
early,
all
the
time,
I,
don't
really
set
to
a
to
an
hourly
type
thing.
I
closed
the
tattoo
shop
early
nobody's
there
I
have
an
11
year
old,
it
has
more
homework
than
I
can
even
get
through
I.
Don't
think
that
families
are
gonna,
bring
their
kids
out
if
they
stay
the
late,
that's
great,
but
really
it's
for
the
daytime.
S
I
I
This
is
where
they
had
all
I,
guess:
I,
don't
know
this
is
where
they
had
bike
night
right
here.
Might
the
actual
parking
lot
is
right
here
it's
on
this
side
of
the
building
back
here
there
looks
like
there
is
a
like
escape
route
decks
or
something
like
that.
It's
really
not
a
parking
lot.
That's
really
there.
The
churches
circle
drive
that
they
go
through
and
out.
Of
course,
all
this
is
gonna
change
to
because
of
the
green
space
that
the
city
is
asking
for.
I
So
really
the
parking
is
gonna,
be
a
little
different
around
the
corner.
I
can't
really
affect
what
happens
in
the
church.
I
know:
they're.
There
are
cars
there
that
Park,
that
they're,
not
mine,
they're,
semi
trucks
and
other
things
that
the
church
allows.
But
it's
not
on
my
property,
so
I
can't
really
affect
that.
K
A
I
Right:
here's
where
this
right,
here's
where
the
city
is
saying
that
has
to
close!
So
that's
a
driveway
right
now
they
want
that.
They
said
that
needs
to
go
so
there's
a
split
driveway
right
there,
a
little
tiny,
driveway
too,
and
then
there's
a
manhole
and
there's
this
big
long
driveway.
They
want
that
to
go,
and
their
idea
was
to
make
this
a
one-way
so
that
they
can
go
out
come
in
this
way
and
out
that
way.
So
then.
K
H
I
Right
here
there's
a
little
driveway
we
did.
We
have
a
shared
driveway
right
there.
This
is,
according
to
the
city,
there's
a
small
shared
driveway
they're
saying
this.
One
right
here
is
like
27
feet
and
that's
too
long
for
the
code,
and
they
are
asking
me
to
take
that
out
and
make
a
green
space
with
like
trees
and
how
will
you
get
in
there?
It
know
that
goes
bye-bye
all
the
way.
This
is
they're
saying
the
city
saying
this
shared
driveway
is
enough.
H
I
I
H
H
I
I
I
Now
the
hours
are
12
to
9
12
to
9:00
every
night.
Some
days
were
there
later
Sunday.
Were
there
not
so
later
it's
it's
that
kind
of
business,
all
most
of
my
folks,
guys
and
girls.
They
both
have
a
lot
of
families,
they
all
kids,
so
the
days
of
late
night,
tattoo
parlaying
sailors
at
3:00
in
the
morning
or
no
more.
That
doesn't
just
happen
anymore.
So
it's
more
of
like
a
studio
where
arts
created
and
we're
paint
draw
and.
I
Yep,
okay
and
then
we
have
two
other
locations.
We
do
have
one
in
Ankeny
right
next
to
rocket
fizz,
which
has
worked
out
pretty
well,
they
sell
like
novelty
pops
and
things
this
is
kind
of
where
I
got
the
idea.
Is
they
have
that
same
kind
of
thing?
Kids
come
in
all
day
and
then
you
know
they've
come
their
families
come
in
and
get
piercings
and
what
the
kids
get
piercings
and
things
like
that,
but
yeah
same
thing,
but
with
video
games
so.
D
I
K
K
I
B
U
I
How
do
I
control
where
people
park
guess
I
asked
nicely
and
put
up
signs?
It
says
park
reader
supposed
to
park,
we
are
gonna,
put
an
extensive
security
system
on
this
whole
place.
I
will
have
cameras,
and
things
like
that
and
I
guarantee
that
this
will
be
an
adjustment
for
everybody
to
say,
hey,
but
I'm
willing
to
talk
and
fix
things
and
make
things
make
the
neighborhood
happy.
Ultimately,
I
want
the
neighborhood
to
come.
You
know
that's
what
I'm
doing
this
for
is
for
the
south
side
and
I
want
them
to
bring
their
families.
I
F
A
Q
They're
talking
about
the
driving
that
they'd
be
coming
in
the
back
and
exiting
out
the
front
I
live
on
Southwest
9th.
You
don't
go
anywhere
between
7
and
8
o'clock
during
the
day
in
the
morning.
There's
just
it's
impossible.
You
can't
get
out
of
your
driveway.
You
can't
go
from
2:30
to
3:30.
You
can't
get
out
of
the
driveway.
You
can't
go
from
5
o'clock
till
6:15
7
to
get
out
of
the
driveway,
and
you
think
everybody's
gonna
just
follow
that
little
rule.
I
G
Well,
I'll
move
the
staff
recommendation
and
the
reason
I'm
moving.
That
is
that
I
feel,
like
the
zoning
variance,
is
probably
the
right
way
to
go
for
the
arcade
of
switching
it
up
see,
especially
given
the
upcoming
zoning
change.
I
think
would
create
more
problems
than
well
I
I
feel
like
the
adjustment,
is
the
right
direction.
So
what
would
happen
there
would
be?
If
you
got
tonight
here,
then
you
could
take
it
to
the
Zoning
Board
of
Adjustment.
G
B
G
B
H
A
B
L
A
A
B
A
I
B
T
B
This
item
is
on
East
ACORN
Street,
which,
if,
if
I
could
zoom
out
it
would
be
south
east
of
the
interchange,
with
Iowa
five
highway
69
southeast
14
in
the
area
that
was
annexed
in
when
it
came
in
it
came
in
as
a1.
These
were
acreages
out
there,
the
lots
that
are
out
there
plaited
before
they
came
in
the
city.
So
they
have
there's
a
lot
of
large
lots
that
are
not
served
by
city
services
at
the
moment
or
have
public
street
access
as
an
example.
B
So
they
would
have
to
also
divide
this
at
some
point
in
order
to
develop
a
second
home
on
that
property
to
the
south,
and
they
they
did
demonstrate
their
intent
to
do
that
at
the
Zoning
Board
of
Adjustment,
in
all
likelihood,
depending
on
when
they
would
be
doing
that
they
would
either
be
going
back
to
the
Zoning
Board
of
adjustment
here
before
the
new
ordinance
goes
into
effect,
or
they
would
probably
be
in
front
of
you
with
a
type
to
design
exception,
to
be
able
to
do
that.
So
depending
on
the
timing,
I
guess
I'll.
B
Let
the
applicants
speak
to
whether
they
still
have
this
buyer
in
hand.
At
this
point,
ready
to
ready
to
go
on
a
project,
but
so
that,
depending
on
when
the
new,
effective
zoning
comes
into
play,
I
can
tell
you
that
the
proposed
code
has
this
as
n1a
designation,
which
so
it's
already
being
slated
to
become
a
single-family
designation
in
the
new
code.
B
The
plan
DSM
it's
designated
for
low-density
I-
think
our
biggest
concern
is
development
of
low
density.
Housing
does
need
to
be
in
a
fashion,
that's
orderly
in
accordance
with
provision
of
city
services
such
as
sanitary
sewer,
public
street
access,
public
water
mains
and
then
there's
a
number
of
design
elements
that
we
would
want
with
any
single-family
dwelling.
B
So
if
you
look
at
that
list
of
conditions,
staff
is
recommending
they're,
not
unlike
some,
that
you've
recently
recommended
on
other
reasonings
to
residential,
so
staff
is
recommending
that
it
be
found
in
conformance
and
that
you
rezone
it
in
accordance
with
those
conditions.
Are
there
any
specific
questions?
B
C
B
H
Any
specific
knowledge
so
Eric.
This
is
a
primary
reason
why
we
annexed
property
going
further
south,
so
we
would
have
review
authority
over
future
subdivisions
down
in
this
area.
This
is
a
subdivision
that
occurred
before
we
had
to
denial
extraterritorial
review.
That's
a
prime
reason
why
we
would
want
to
be
reviewing
that
when
you
plat
in
the
county,
you
plat
a
roadway
easement,
and
so
your
lot
line
goes
to
the
center.
H
What,
rather
than
planning
a
right-of-way
for
a
future
roadway
you
they
just
dedicate
an
easement
for
that
roadway
and
the
lot
line
still
goes
to
the
center
of
that
roadway
and
so
you'll
see
when
we
annex
out
in
the
county.
Previously
existing
roads
lot
lines
go
to
center
lines
in
those
situations,
and
so
when
properties,
rezone
and
things
like
that,
we
ask
for
right
away
to
be
dedicated
or
when
they
plant.
We
ask
for
right
away
to
be
dedicated
rather
than
the
roadways
right,
so
Eric
the
shared
driveway.
They
have
two,
the
two
houses.
B
H
What
this
photos
not
showing
is
off
to
the
left,
you'll
see
those
other
slots
on
the
far
left-hand
side
of
that
there's
another
basically
shared
lot
line
between
Lots
over
the
end
of
the
west.
We
do
not
show
them
those
drawings.
Would
you
point
to
him
that
he's
too
perfect
to
the
west
of
this
be
right,
so
those
lots
yeah.
H
B
Of
that
flat
flat
area
didn't
show
any,
we
would
want
them
to
retain
amusement
if
they
ever
got
this
divided.
For
this
lot
to
have
frontage,
they
would
need
to
preserve
an
easement
for
themselves.
I
can't
speak
to
what
what
Warren
County,
you
know
required
enzyme,
but
typically
they
would
have
had
at
least
Street
right,
aways
dedicated
at
the
time,
but
so.
F
B
H
Again
because
there
are
other
lots
remaining
south
of
this,
one
of
our
comments
has
been
to
request
that
there
be
public
infrastructure
and
roadway
extended
to
serve
those
properties.
Otherwise
we're
gonna
be
in
the
same
situation
again
when
the
next
person
wants
to
build
on
that
lot
down
there.
So
my
question
be:
are
our
staff
rec
is
saying
extension
of
a
public
right-of-way
and
utilities
south
from
acorn
Street
into
this
development
and.
H
For
right
now,
at
a
minimum,
we
would
want
the
right-of-way
dedicated
down
through
there
to
at
least
the
lot
that
is
being
developed
to
the
south
end
of
it.
So
it
can
be
extended
to
other
Lots
in
the
future
right
and
then
that
sewer,
because
it's
more
than
300
feet
from
a
public
sewer.
You
can't
force
them
to
connect
it
at
this
point.
C
C
B
C
B
F
V
T
L
T
T
All
these
other
lots
on
unpassed
me
and
on
this
other
side,
his
own
by
that
Southland,
Development,
Corporation
and
I'm
sure
when
they
go
to
develop
it
to
recoup
their
investment,
which
I
know
how
they
paid:
1.3
million
for
that
land,
that
they're
gonna
put
the
streets
and
sewer
sidewalks
and
all
that
in
the
one
person
I
did
have
my
lot
sold
to
he's
now
pulled
out,
and
it's
no
longer
interested
on
account
of
the
problems.
Getting
the
permit.
T
T
T
T
F
T
F
T
A
U
U
T
I'm,
not
agreement
with
that
I've
done
some
first
two
questions,
I
mean
I,
don't
I
think
yeah.
That
would
be
fine
when
they
go
to
develop
those
other
400
acres,
but
I
think
for
the
neighborhood
setting
that
I'm
in
I
think
I
think
this
conforms
I
had
the
guy
Brian
from
Des
Moines
waterworks
come
out
and
he
showed
me
likely
that
we
had
plenty
of
room
to
do
that.
20
foot
down
for
the
easement
access.
T
T
U
T
T
T
T
T
H
So
this
would
be
what
I
was
referring
to.
It
looks
like
there's
80
feet:
40
foot
easements
on
each
of
the
Lots
going
down
there.
That
would
be
the
access
area
on
the
plat.
So
what
we
would
be
asking
for
is
that
to
be
we
wouldn't
I
assume
need
80
feet
of
right-of-way
down
down
through
that
area.
Our
typical
residential
right,
aways,
I,
think
our
60-foot
right-of-ways
and
residential
subdivisions.
H
So
what
we
would
be
asking
for
is
60
feet
of
right
away
to
be
dedicated
centered
on
the
lot
line,
30
feet
on
each
side
to
be
dedicated
and
then,
if
there
were
agreements
for
future
street
construction
of
that,
that
would
be
up
to
the
council
in
our
engineering
department,
but
typically
would
be
a
local
Street
being
built
to
this,
to
the
South
watt
line
of
your
property
for
future
extension
to
the
subdivision
and
then
basically
a
dry
sewer
in
that
right-of-way.
That
could
be
connected
with
sewer
when
it's
available
in
the
future.
H
J
F
H
A
V
She
yeah
my
name's
rod,
Davison
I'm,
for
you
all
done
with
full
of
properties
of
mine
up
there
hurt,
but
in
the
ran
I
have
been.
Nothing
gets,
Fred
he's
good,
neighbor
and
everything,
but
when
I
bought
my
place
four-and-a-half
years
ago-
and
they
had
that
plot
that
he
had
there
to
where
they
had
planned
and
I
was
told
that
there
wouldn't
be
been
going
through
any
more
because
you
had
to
have
ten
acres
to
build
a
house
on
there.
V
My
side
of
the
lake
there
on
the
west
side,
there's
Wells
all
the
way
down
that
side.
They're,
not
gonna,
use
Wells.
If
they
do
that,
you
know
rebuilding
and
tear
that
timber
down.
I,
don't
know
on
the
other
side
by
Fred
after
his
lot.
That's
all
farmland.
Now
one
of
that
guy's
gonna
turn
that
in
the
lot
or
what
he's
gonna
do
or
whatever.
V
But
this
was
one
of
the
selling
points
when
I
bought
this
house
that
I
shouldn't
be
getting
anymore
neighbors
because
they
were
gonna
have
to
be
ten
acre
plots
and,
like
I
said
you
know
there,
everybody
is
on
septic.
You'd
have
to
hook
up
to
the
sewer.
The
way
it
reads
now
you
have
to
be
on
ACORN
Street
have
frontage
to
get
to
sewer
road
that
Fred
lives
off
of
right.
There
stops
right
there
by
his
house,
like
I,
said:
I
lived
there,
four
and
a
half
years.
Nothing's
happened,
there's
no
development
whatsoever.
V
H
V
It
whatever,
but
right
there
on
the
other
side,
got
light.
Color,
that's
farmland,
that's
crops
over
here
on
this
I
grew
up
beside
me.
That's
all
timber
and
I
mean
you
know.
Eventually
you
build
something
there
we're
gonna
give
up
the
animals
and
stuff.
My
dog
is
caught
a
bobcat
this
year.
There's
a
baby
one,
but
I
called
the
DNR.
We
go.
Everybody
seek
deer
every
day.
You
know
in
that
guy
stuff,
I'd
like
to
keep
that
as
long
as
possible.
V
Like
said,
I
haven't
got
nothing
against
Fred
I
just
came
to
put
my
word
in
because
that's
what
I
was
told
when
I
bought
the
place,
the
guy
right
across
from
there
bought
at
the
same
time,
I
did
he's
not
here
tonight.
So
I
don't
know
if
he
could
tell
you.
You
know
push
that
on
him
to
when
he
was
looking
at
that
house,
but
we
both
lived
there
for
less
than
five
years
and,
like
said,
there's
not
been
any
development
and
I
pay.
V
V
V
Like
I
said,
I
just
would
like
to
keep
it
the
way
it
is.
If
you
know
these
plans
have
been
in
the
works,
these
houses
were
built
early
90s.
My
house
had
built
91
same
guy
built
one
right
across
from
me.
They
almost
look
identical
and
since
then
there
hasn't
been
any
kind
of
development.
Anything
like
that.
V
V
Part
of
the
Lots
they
all
ran
into
the
lake
so
that
you
mean,
like
you,
know,
I'm
the
one
split
the
fish
in
there.
As
far
as
the
grass
eating
carp
and
all
that
kind
of
stuff,
I
really
don't
want
somebody
moving
in
to
catching
all
the
fish
taking
him
out
there.
You
know
we
put
them
all
back
when
we
catch
them.
V
T
L
T
End
the
grass
carp
yeah
after
810
years
of
grass
carp,
they
don't
do
their
job,
but
I
just
didn't
want
this
guy.
Getting
thinking
he's
the
one
that
made
that
lake
and
as
far
as
I,
would
rather
have
single-family
homes
in
that
area,
instead
of
all
those
16
flexes
and
stuff
that
Southland
will
build
out
there.
A
Step
so
there's
a
motion
to
move
the
staff
recommendation,
which
party
is
recommending
that
we
find
a
proposed
rezoning
in
conformance
with
plan
des
moines
part
b,
is
recommending
approval
the
rezoning
subject
to
the
following
conditions.
One
development
of
the
southern
parcel
is
prohibited
until
such
time
that
public
street
and
utilities,
including
but
not
limited
to
a
dry,
sir
and
mine,
is
extended
along
the
east
property
line
to
any
development
of
the
site
must
comply
with
the
tree
removal
mitigation
ordinance
contained
in
chapter
42,
article
10
of
the
city
code.
A
3
no
same
house
plan
shall
be
built
on
adjacent
lots
for
any
house
shall
have
a
full
basement
and,
let's
determine
infeasible
by
the
city's
building.
Official
and
planning
administrator
5
anyhow
shall
have
a
minimum
two-car
attached
garage,
6
the
front
side.
Hate
of
any
house
constructed,
must
contain
one
of
the
following
a
front
porch,
not
less
than
60
square
feet
or
stone
or
brick
masonry.
A
S
A
2-Story
house
shall
be
constructed
with
the
minimum
18
we're
feet
above
Griffin's
area,
12
exterior
material
for
any
house.
Construction
shall
be
masonry,
brick
or
stone,
vinyl
of
no
less
than
point
zero.
Four
to
forty
two
thickness
cedar
means
tonight
or
cement
fiber
board
and
thirteen
anything.
The
fence
shall
have
black
vinyl
cladding.
H
Just
update
Commission,
the
City
Council
did
vote
unanimously
to
approve
second
reading
of
the
new
zoning
ordinance.
The
third
reading
will
be
on
October
14th
at
their
meeting,
if
approved
on
the
14th.
That
ordinance
would
be
effective,
December,
15th
and
then
simultaneously,
staff
is
working
on
because
the
ordinance
and
the
notice
that
was
published
Council
and
ask
for
some
revisions
to
that
ordinance.
Those
were
outside
of
what
we
had
noticed
for
the
original
hearing
and
rather
than
start
the
whole
process
over
on
the
on
the
code.
H
As
far
as
the
hearings,
they
decide
to
go
ahead.
Close
the
hearing,
move
forward
with
that
and
then
on
a
parallel
track,
work
on
revisions.
So
a
November
7th
planet,
Zoning
Commission
meeting
you
will
be
considering
amendments
to
the
ordinance
and
then
those
would
go
to
the
council
with
the
intent
of
being
approved
by
council
and
effective
on
December
16th.
So
I
would
say
the
changes
are
fairly
minor
overall
relative
to
what,
where
we've
been
on
the
whole
ordinance.
So
I
wouldn't
worry
too
much
about.
H
You
know
there
being
a
lot
of
controversy
on
on
November
7th
by
any
means,
but
again
the
purpose
of
it
was
to
have
those
adopted
by
the
time
they.
The
code
goes
effective,
so
staff
right
now
was
working
on
getting
the
code
through
on
the
14th
we're
working
on
the
revisions.
Plus
there
is
a
lot
of
background
work
that
has
to
be
done
from
a
mapping
to
get
everything.
H
Application
forms,
updated
review
forms
everything
in
place,
so
we
can
administer
that
code
middle
of
December.
There
will
be
cases
that
will
come
to
you.
After
the
effective
date
of
the
code,
there
will
likely
be
Planned,
Unit
development
application
come
in
up
till
December
16th
that
the
coat
we
if
they
submit
it
prior
to
the
effective
date
of
the
new
code.
We
will
continue
to
process
those
PV
applications
so
into
January
February.
You
will
be
seeing
some
Planned
Unit
development
applications
being
processed
under
our
existing
regulations
for
Planned
Unit
development
light
as
well.
H
The
Board
of
Adjustment
will
see
some
or
case
applications
that
come
in
up
until
December
15th,
so
like
their
January
Board
of
Adjustment
meeting
will
probably
have
some
board
cases
asking
for
relief
under
their
previous
code.
So
that's
that's
just
how
we
have
to
process
everything
that's
going
through,
but
I
wanted
to
give
you
an
update
on
and
we
ran
on
it.
But
things
are
continuing
move
forward.
So
thank
you.
So
the
parallel.
