A
B
Well,
good
afternoon,
early
evening,
everybody
Welcome
to
our
January.
C
9Th
first
city
council
meeting
of
the.
B
Year,
I
want
to
welcome
everybody.
I
want
to
also
mention
that
I
believe
today.
Linda
isn't
National
law
enforcement
appreciation
day,
so
I
want
to
just
let
everybody
know
that,
and
we
have
a
a
lot
of
our
First
Responders.
C
C
All
right,
we
have
a
quick
item
I
in
every
year.
This
time
we
or
I
appoint
a
council
member
to
be
our
mayor,
Pro
tem,
and
this
year
I
would
like
to
appoint
councilmember
Connie
bozen
to
be
our
mayor.
Pro
Temp
for
2023.
D
E
C
item
32,
councilmember,
Shoemaker
votes,
no
item;
38a,
council
member
Shoemaker
votes,
no
item;
38,
B,
council
member
Shoemaker
votes;
no
in
item
38
d,
council,
member
mandelbaum
and
Shoemaker.
Both
vote
no.
C
This
evening,
just
so
everybody
knows
that
for
the
hearing
items
this
evening
we
have
one
vacation
hearing
two
conveyance
hearings,
one
license
agreement
hearing
and
three
zoning
hearings
and
four
public
Improvement
hearings
as
a
reminder
for
the
zoning
items.
Only
those
are
items
43,
44
and
45.
We
will
hear
from
the
parties
in
interest
first
and
then
from
the
general
public,
so
the
party's
in
interest
are
either
the
applicant
or
those
that
have
been
notified
within
250
feet
and
have
received
that
notification.
C
So
after
all
those
parties
and
interests
have
commented,
we're
going
to
then
open
it
up
to
the
general
public
and
I
will
need
to
say
that
we
don't
want
anybody
to
step
up
before
that,
because
we're
gonna
that'll
be
determined
as
disruptive,
and
we
don't
want
that
to
happen,
and
so
we'll
just
ask
that.
Please
do
not
do
it
because
you
will.
If
you
are
disruptive,
you
will
not
be
allowed
to
speak
the
rest
of
the
evening.
C
So
please
wait
until
we
call
for
the
general
comments,
especially
on
those
zoning
items,
for
the
other
hearings
this
evening.
Any
interested
person
may
make
Jermaine
comments
and
not
to
exceed
one
minute
per
person
to
a
maximum
of
five
minutes
per
hearing
unless
the
hearing
is
ended,
either
for
failure
to
make
Germaine
comments
or
public
comments
have
Have
Ended.
As
a
reminder
on
the
public
Improvement
hearings,
only
the
comments
as
to
the
plans,
those
specifications,
the
form
of
documents
and
the
engineer's
estimate
in
the
low
bidder
designation
will
be
considered
germane.
C
All
of
their
comments
will
not
be
considered
germane.
So
let's
go
ahead
and
get
started.
Item
40.
item
40
is
on
a
vacation
of
an
under
of
an
undeveloped
segment
of
East
Fulton
Drive
right
away
located
within
Stone
Park
at
2100,
South,
5th,
Street
and
dedication
of
such
property
and
a
segment
of
previously
vacated
East
Olinda
Avenue
lying
within
Stone

as
Parkland
a
is
the
first
consideration
in
the
ordinance
above
and
again
we'll
quickly
open
it
up
for
any
public
comment.

43
item
43
is
on
a
request
from
Kerry
Dunn
who's,
the
owner
to
amend,
planned
DSM,
creating
our
tomorrow
plan
to
revise
the
future
land
use
classification
for
property
located
at
810
East
Euclid
Avenue
from
low
density
residential
within
a
community
node
to
community
mixed
use
within
a
community
node
and
to
rezone
the
property
from
N5
residential
district
to
limited
MX3
mixed
use.
District
to
allow
the
expansion
of
the
parking
lot
to
the
east,
which
is
get
and
go
a
is
the
first
consideration.
The
ordinance
above
B
is
the
final
consideration.
C
The
ordinance
above
the
waiver
is
requested
by
the
applicant
and
again
requires
six
votes.
First,
we'll
hear
from
the
parties
in
interest
again.
Those
are
either
that
applicant
or
anybody
living
within
250
feet
of
the
property
to
be
rezoned.
But
we'll
ask
the
applicant
if
they're
here
to
step
up
first
is
the
applicant
in
the
room,
not
any
parties
in
interest.
I
Good
afternoon,
honorable
mayor
council
members
all
right,
so
we
have
two
all
right,
very
good,
Thomas
More
for
representing
get
and
go
convenience
stores.
Our
interest
lies
in
the
purchase
of
the
property
after
the
rezoning,
2716
Indianola,
Ave
Des
Moines
I'm,
just
here
to
make
a
statement
in
regards
to
our
intentions
that
have
gone
through
pnz,
obviously
fully
unanimous
consent.
We
have
an
opportunity
to
show
any
exhibits.
I
We
go,
this
is
the
property
in
reference
810,
East,
Euclid,
directly
west
of
our
property
at
age,
16
that
we're
on
the
intersection
of
Euclid
and
Wright
Street
Kerry
Dunn
currently
owns
the
property.
Briefly,
he
was
addressed
by
the
city
in
regards
to
a
nuisance
issue
that
he's
going
to
have
to
remove
the
property.
I
A
little
hard
to
see
there,
but
the
property
in
green
is
the
the
residents
or
the
property
that
we're
referencing
now
and
by
that
green
designation.
It
is
on
the
schedule
to
be
demolished
at
his
cost
and
he
approached
me
in
a
request
to
purchase
the
property
it's
to
leave
him
a
cost
that
he
will
incur
directly
by
the
removal
of
the
property
and
then
the
future.
All
future
maintenance
of
property
I
have
just
one
more
exhibit.
I
That's
from
our
pre-app
Planning
and
Zoning
meeting
well,
we
I
had
37
invitees
with
just
one
that
attended,
and
that
was
a
Mr
Jerome
Reed
at
3610
Wright
Street,
which
is
directly
north
adjacent
property.
To
us
he
was
all
in
favor
of
it
no
complaints.
Again
he
was
the
only
attendant
at
the
pre-ap
meeting.
So
in
an
attempt
to
revitalize
our
neighborhood
and
the
location,
we
just
want
to
buy
the
property,
get
it
torn
down
because
it's
a
nuisance
for
not
only
the
neighborhood
but
us
as
well.
I
There's
nocturnal
animals
that
reside
there
and
we've
done
quite
a
bit
to
try
to
prevent
any
Congregation
of
people
around
the
store.
We
put
up
an
eight
foot
well:
six
and
a
half
foot
Security
Fence
to
restrain
people
from
going
around
the
back
of
the
properties
and
doing
what
we
can
in
an
effort
to
keep
the
neighborhood
beautiful.
Thank
you.
C
Don't
see
any
but
hang
out
just
in
case
something
comes
up.
Anyone
else,
parties
in
interest
notified
any
come
in
from
the
General
Public
any
comments,
seeing
none
Council
I.
G
I
do
have
some
comments
and
I
spoke
to
you
on
the
phone
I
sent
to
you
late
this
afternoon.
The
police
calls
the
concern
and
I
know
that
this
is
a
request
for
change
in
zoning,
so
this
doesn't
have
anything
to
do
with
the
complaints,
but
I
feel
in
the
neighborhood
feels
that
before
we
Grant
you
permission
to
buy
this
house
and
tear
it
down,
which
we
all
agree
would
be
an
improvement.
We
would
like
to
be
able
to
have
some
conversations
with
get
and
go.
The
neighbors
have
repeatedly
called
get
and
go.
G
The
police
I
pulled
the
reports.
We
have
double
the
number
of
police
calls
to
the
get
and
go
then
other
like
type
businesses
in
the
area,
so
it
is
a
detriment
to
the
neighborhood
when
we
have
that
many
police
calls
and
that
many
robberies
one
of
the
issues
is,
is
in
the
summertime,
the
whoever
is
at
the
store,
there's
some
partying
going
on
there's
loud.
The
neighbors
tell
me
that
it's
so
loud
that
their
Windows
rattle
from
The,
High,
music,
that's
being
played,
can't
wait.
G
Can't
you
be,
can
you
please
try
to
be
a
good
neighbor
and
have
some
conversations
about
what
we
can
do
to
to
make
the
relationship
with
the
neighborhood
and
the
get
and
go
better
I?
Don't
understand
why
they're
they're
dismissed,
Mr
Lowe
was
on
your
on
your
list.
He
has
made
multiple
multiple
calls
and
he
lives.
You
know
a
fair
distance
away,
but
he'll
call
me
and
say
it's
it's
so
loud
I
can't
my
windows
are
rattling
and
nobody
wants
to
to
be
responsible
to
that.
G
That's
all
right,
so
you
know
I'm
in
favor
of
of
tearing
down
the
house
I
get
that
but
I'm
not
willing
to
waive
the
second
and
third
reading
until
I
see
that
there's
been
some
action
with
getting
go
in
the
neighborhood
myself.
Whoever
that
wants
to
be
I
was
not
made
aware
of
any
neighborhood
meeting
and
I
represent
that
Ward
I
called
a
couple
of
the
people
that
I
know
because
they've
called
me
with
complaints.
They
said
they
too
did
not
receive
it
now.
I
know
it
just
comes
in
a
little
postcard.
G
I
In
a
rebuttal,
Mrs
Wesley
guard,
all
I
can
do
is
discuss
what
I'm
aware
of
in
regards
to
incidents
that
have
been
addressed
by
the
city
of
Des,
Moines,
Police
Department,
and
we
have
one
incident
on
record
and
three
of
22
March
of
22,
where
one
gentleman
was
taken
away
now
what
he
was
charged
with
I,
don't
I
don't
have
that
information,
and
my
only
rebuttal
to
the
complaint
that
was
stated
in
your
email
was
I'm.
Sorry,
who
was
that
gentleman
again
refreshment.
G
I
And
and
I
can't
argue
with
him-
I'm
not
here
to
argue
I'm
just
here
to
try
to
disclose
that
the
immediate
adjacent
adjoining
properties
are
in
favor
of
without
any
complaints
to
us
on
an
internal
way
or
anything
from
that
major.
So
that's
the
only
rebuttal
that
I
can
have
against
Mr
Lowe
statement.
I,
don't
I
can
say.
Maybe
he
doesn't
even
know
where
the
noise
is
stemming
from.
There
is
another
establishment
across
the
street
that
sells
liquor
now
yep.
G
G
I
Well,
I
can
address
the
this
simple
Act
of
robberies
and
the
congregation
of
people
cannot
be
controlled
by
me
or
any
establishment.
We
have
an
A-Tech
security
program
that
we've
used
for
30
years
at
every
store.
We
have
cameras,
you
know
exterior
interior
yeah.
We
do
our.
We
do
our
best
for
all
of
our
properties
that
are
immediately
adjoining
to
any
property
that
we
have
store
23
down
on
30th
and
I,
can't
recall
what
is
that
Hickman?
Yes,
both
adjoining
properties,
we
redid
their
driveways
free
of
their
charge.
I
G
I
My
only
argument
to
that
would
be
a
national
report
from
convenience
stores
that
will
will
argue
that,
having
more
than
one
employee
doesn't
deter,
robbery
or
theft.
D
They're
getting
robbed
more
I
guess
that
would
be
my
my
question
and
you
do
only
have
one
employee
that
works
typically
in
the
evening
at
all.
The
get-go's.
I
Typically,
not
all
of
them,
but
that
partly
councilman
Gatto
involves
the
labor
force.
It's
not
easy
to
find
people
the
way
it
is.
D
G
F
F
C
I
C
Okay,
Texas
item
44
item
44,
is
on
a
request
from
the
neighborhood
development
Corp
Debbie
Gilroy's,
the
officer
to
amend,
planned
DSM,
creating
our
tomorrow
plan
to
revise
the
future
land
use
classification
for
the
North
northernmost
portion
of
the
property
located
at
2211
University
Avenue
from
below
medium
density,
residential
within
a
neighborhood
node
to
Neighborhood
mixed
use
within
a
neighborhood
known
into
rezone
property
from
rx2
mixed
use.
District
2,
MX2
mixed
use,
District
to
allow
Redevelopment
of
a
site
with
a
new
three-story
mixed-use
building
using
the
storefront
building
type
A
is
the
first
consideration.
C
The
origins
above
B
is
the
final
consideration.
The
orange
above
the
way
was
requested
by
Mike
Ludwig,
our
interim
development
services
director
and
requires
six
votes.
So,
first
again,
let's
hear
from
the
applicant
and
other
parties
in
interest-
and
it
looks
like
the
applicant-
is
standing
right
up.
K
K
If
we
rezone
to
this,
we
are
lining
up
our
setbacks
with
the
property
directly
to
our
West.
We'll
continue
on.
So
that's
mostly
the
reasoning
for
it.
So
we're
do
or
we
continue
the
zoning
going
and
to
line
the
buildings
up.
We
did
have
a
neighborhood
meeting,
no
opposition
to
the
rezoning.
K
We
have
been
to
Planning
and
Zoning.
Obviously
so
I
haven't
heard
any
sort
of
opposition
to
this
zoning
from
anybody.
C
L
Seeing
none
I'll,
just
say:
I'm
excited
about
this
project,
getting
more
buildings
up
to
sidewalk
level,
getting
some
housing
put
in
where
there
previously
wasn't
very
excited
to
see
this
moving
forward.
So
I'll
move
44,
44A
and
44b
a.
F
C

those.
M
G
C
All
right,
let's
see
no
other
comments,
we'll
ask
if
there's
anybody
from
the
General
Public
who
would
like
to
make
comment
on
this.
N
We
should
be

of

of
catering
to

for
a

there's
there

Already
we
don't
need
another

could
be

something
it
could
there's
so
many
things
that
could
be.
It
shouldn't
be
that,
though,
thank
you.

for

this

under
the
public

item
the
agenda,
we
will
be
calling
only
on
those
who
have
registered
to
speak.
All
speakers
must
comply
with
the
rules
regarding
their
names
and
their
addresses,
or
they
will
not
be
recognized
to
speak.
Each
of
the
four
speakers
this
evening
will
receive
up
two
minutes
each
to
make
their
comments.
C
Please
keep
your

because
at
the
end
of
the

will
announce
time
and
the
speaker's

will
be
closed
and
we
will

move
to
the

speaker.
We
want
to
hear
from
our

and
we
encourage
the
residents
to
be
respectful
of

viewpoints.
It
may
be

let's
go
ahead

P
My
name
is
Jolene
Prescott
and
I
live
at
3013
3rd
Street.
Now
that
is
down
in
Highland
Park's
little
boot,
and
that
is
very,
very
close
to
our
Riverview
stage
over
there
and
I
want
to
read
you
what
I
wrote
on
Linda
westergard's
website
here
about
a
couple
weeks
ago.
Please
keep
in
mind.
Riverview
is
an
open
air
venue.
P
I
live
four
blocks
from
the
stage.
My
grandchildren
live
two
blocks
from
the
stage
when
children
are
present.
We
have
an
obligation
to
show
responsibility
personally,
I
feel
that
profanity
has
no
place
over
loudspeakers
at
Riverview
stage
or
any
other
stage
near
residential
areas
where
young
children
might
be
exposed,
whether
that
be
hip-hop
group,
stand-up
comedian,
a
country
band
or
whatever
does
using
profanity
in
the
presence
of
children
show
responsibility.
P
P
N
I
just
wanted
to
address
some
of
the
recent
comments
that
my
city,
councilor
Linda,
has
made
about
hip-hop
when
she
says
she
doesn't
think
that
hip-hop
is
appropriate
or
family
friendly.
What
she's
really
saying
is
that
she
doesn't
think
black
people
should
feel
welcome
or
comfortable
in
shared
public
spaces.
Hip-Hop
is
intrinsically
linked
with
poverty,
culture.
It
came
into
being
because
in
the
1980s
it
happened
to
be
cheaper
to
record
a
song
on
a
tape.
Deck
make
a
beat
and
talk
over
it
than
it
was
to
buy
a
musical
instrument.

city
of
Des,
Moines
and
Polk
County
have
been
using
public
officials
for
leverage
and
private
meetings
to
discriminate
against
black
artists,
while
I'm
talking
about
allegations
against
councilmember
westergard,
because
I'm
at
a
city
council,
meeting
others
outside
of
city
council,
were
the
meeting
as
well.
Well,
westergard
was
alone
representing
the
city.
In
these
meetings,
all
of
council
is
responsible
because
she
was
representing
the
city.
Q
Sorry
awesome
place
here
when
I
brought
up
this
issue,
councilmember
westergard
laughed
and
interrupted
my
comments
by
blaming
councilmember
Shoemaker,
the
only
black
council
member,
implying
that
my
comments
were
somehow
orchestrated
by
her,
as
if
speaking
out
against
anybody
speaking
out,
Against
Racism
must
be
a
conspiracy
about
Shoemaker,
then,
after
my
comments
wish
to
guard
shouted
at
me
that
I
didn't
have
the
facts
in
response
I'd
like
to
name
what
some
of
my
facts
are.
Q
One
is
that
the
accuser
was
pressured
to
resign
West
regard
to
confirmness
publicly
on
Facebook
that
the
accuser
was
asked
to
resigned
by
the
park.
Syria
Foundation
there's
been
an
explanation
for
the
pressured
resignation
other
than
the
accuser's
account
that
I'm
aware
of
publicly
from
West
regard
or
anyone
else.
Also
the
fact
that
there
were
no
hip-hop
acts
at
this
year's
round
of
your
review
Riverview
and
no
River
and
no
Riverview
Music
Festival.
That
was
majority
of
hip-hop,
while
westergard
claims.
The
accusation
is
simply
not
true
to
the
media.
Q
Also,
while
the
meeting
in
question
was
private
and
we
don't
have
a
recording
of
it.
West
regard
often
makes
racist
comments
in
these
public
meetings,
including
vote
against
the
interests
of
black
residents.
The
black
home
ownership
Gap
in
Des
Moines,
is
around
50.
That
means
disproportionate
rate
of
black
residents
rent
rather
than
on
their
homes.
So
issues
like
testing
LED
service
lines
for
rental
units,
disproportionately
implant
impacts,
black
residents,
westergard
and
others
have
sought
to
resolve
this
matter
of
public
racism
privately
needs
to
be
resolved
publicly.

said

went
