On
all
matters
before
the
Commission
other
than
site
plans
and
preliminary
subdivision
platts,
the
Commission's
decision
to
approve
or
deny
a
site
plan
or
preliminary
subdivision
plot
is
the
final
decision.
Plat
I'm
sorry
is
the
final
decision
by
the
city.
Unless
the
applicant
appeals
to
City
Council
you'll
need
to
contact
the
city,
clerk
or
community
development
department
staff
for
details
on
those
council
hearings.
B
This
evening
the
applicant
will
be
given
ten
minutes
to
present
their
request
after
stats
presentation
proponents,
and
then
opponents
from
the
public
are
allowed
to
speak
in
that
order,
and
each
speaker
will
be
allowed
at
maximum
of
five
minutes.
The
hearing
will
then
be
closed.
I'm
sorry,
the
applicant
will
then
be
given
five
minutes
for
rebuttal.
The
hearing
will
then
be
closed
and
after
emotion,
the
Commission
will
discuss
and
vote
on
the
issue.
All
comments
are
to
be
germane
to
the
issue
under
consideration
and
speakers
are
to
maintain
a
courteous
manner.
B
Items
listed
on
the

for
an
agenda
will
not
be
individually
discussed
and
will
be
considered
for
approval
in
accords
with
recommendations,
staff
and
we'll
get
to
that
in
a
minute.
There's
one
on
on
that
item
right
now,
unless
an
individual
present
or
a
member
of
the
Commission
requested
the
item
be
removed
and
from
the
consent
agenda
and
considered
separately
under
the
public
hearing
agenda,
the

C
C
Members
Commission
jason
van
ness
at
the
planning
staff,
since
our
staff
record
I
went
out,
we've
had
some
discussions
with
the
applicant
had
basically
resolved
all
the
conditions.
There
is
one
that
we
would
like
to
offer
as
an
amendment
we'd
like
to
replace
the
wording
for
number
four
with
doing,
instead
of
continuing
the
fencing
around
a
spur
we
recently
proposed
and
getting
into
it
within
the
details
and
looking
this
through,
we
feel
a
better
option:
let's
do
a
landscape
feature
at
the
intersection
and
then
have
a
different
fence
style
as
proposed
in
second.
D
E
D
The
real
old-time
yeah
this
is
what
was
constructed.
I,
remember
the
one
tower
here
on
the
tallest
one,
but
a
real
old-timer
probably
could
have
remembered
more
of
the
building.
This
was
really
a
remarkable
structure
and
many
of
you
remember
it
I
think
it
was
designed
with
the
city
hall
in
Florence,
Italy
and
in
mind
and
I
applaud
the
reuse,
the
adaptive
reuse
of
this
building,
although
I
lament
the
loss
of
what
was
really
a
grand
structure.
B
Other
questions
or
comments
see
none.
Is
there
a
motion,
great
staff
consent,
any
discussion
seeing
none
all
those
in
favor,
please
signify
by
raising
your
right
hand,
follow
the
same
sign
acclamation
Kathy
it
passes.
Thank
you.
I
understand,
Jason,
that,
with
respect
to
item
number
two
there's
a
request
to
continue
this
to
August
fifteenth
direct.
C
B
That
one
is
a
request
from
Robert
mole,
mole
hill,
mole
hill
jr
for
rezoning,
a
property
located
1139
24th
street.
The
subject:
property
is
owned
by
ballard's,
glass
and
screen
service.
Is
there
anyone
here
to
speak
in
opposition
to
that
particular
item
that
would
like
to
have
an
opportunity
to
speak?
Anyone
here
to
speak
in
opposition.
B
B
It's
continued
into
august
15.
Thank
you.
Item
number
three
requests
from
first
equity
group,
LLC,
represented
by
an
cotta
review,
an
approval
of
a
site
plan;
CVS
pharmacy
store
number
10
329
on
property,
located
at
2303
merle
hay
road
to
allow
development
of
a
twelve
thousand
nine
hundred
square
feet
of
pharmacy
and
general
retail
store.
B
C
Thank
you,
sir
Chairman's
Commission
Jason
van
ness
and
with
the
planning
staff
aerial
identifies
the
subject
property
in
the
northeast
corner
of
merle
hay
and
Hickman
road.
This
was
you
saw
the
rezoning
this
to
a
pu
designation.
Earlier
in
the
year
it
was
approved
by
the
City
Council.
There
was
a
series
of
conditions
with
that
approval
and
condition
number
5.
A
zoning
condition
was
that
the
development
plan
come
back
to
you
for
final
review.
C
So
this
is
essentially
a
site
plan
review
zonings
in
place
that
the
concepts
of
the
development
ur
in
place-
and
so
it's
just
the
last
chance
to
look
at
that
site
plan
that
would
typically
would
have
been
reviewed
of
mr.
Italy,
so
I
will
go
ahead
and
walk
through
the
some
pictures
response,
mathlete
any
responses,
some
photographs
in
the
file,
so
this
is
looking
back
into
the
site
intersection
and
then
North.
Looking
at
merle
hay
looking
west
long,
Hickman.
C
Site
plan
showing
the
site
to
building
and
the
parking
configuration.
This
is
what
we
did
get
some
revisions
back
to
address
and
traffic
concerns
with
regard
to
the
entrances
and
I
can
show
you
that
image
that
those
have
been
addressed.
This
shows
the
kind
of
landscaping
plan
two
entrances
off
of
real,
hey
one
off
the
Hickman,
the
existing
building
strip
center,
just
the
tip
typical
elements,
site
elements,
building
elevations
the
these
in
turn
out.
C
And
then
this
is
that
new
diagram
that
we
receive.
You
can
see
that
larger
entrance
points
addressing
our
concerns
from
our
traffic
engineer,
and
she
has
reviewed
this
and
satisfied
with.
What's
going
to
propose,
the
I
could
read
through
the
the
staff
conditions,
but
just
to
save
every
time
we
have
gone
over
this
with
the
applicant.
They've
concurred
with
them
with
the
staff
recommended
conditions,
and
we
understand
that
the
neighbor
association
has
also
seen
the
staff
report
and
is
supportive
of
the
conditions
that
we
came
up
with
to.
C
E
Like
to
point
something
out,
this
particular
set
of
documents
is
signed
and
sealed
by
an
out-of-state
landscape
architect
and
their
seal
does
not
meet
the
Iowa
State.
Keep
architectural
review
boards
requirement
for
see.
It
says,
registered
landscape
architect,
not
professional
landscape,
architect.
If
they
would
like
a
copy
of
the
code,
I
have
a
copy
for.
F
B
G
Chairman
members
of
the
Commission,
my
name
is
Chris,
pose
I'm
an
attorney
office
address
at
317
sixth
avenue
suite
300
on
behalf
of
the
applicant.
Also
with
me,
is
Annie
Walters
CUDA
who's
with
first
equity
and
CBS,
who
designed
the
plan
we're
in
agreement
with
the
staff
recommendation
as
amended,
would
ask
your
urge
or
approval
of
the
request
happy
to
answer
any
questions.
Any.
B
H
And
address
mr.
chair
members
of
the
Commission
and
Jason
Pulliam
21-13
52nd
street
in
Des
Moines
I'm
with
the
merle
hay
Neighborhood
Association,
we're
here
to
speak
in
support
of
the
application,
the
site
plan.
We
have
sorted
out
our
questions
and
concerns
about
signage,
I,
think
the
applicant
indicated
they'd
work
through
the
questions
about
trees
and
landscaping
with
staff,
and
if
staff
and
commission
members
are
satisfied,
so
are
we
so
any.
I
Have
a
question
when
this
was
initially
in
front
of
the
Commission.
There
was
a
question
about
the
height
of
the
sign
and
I.
Have
you
and
the
developers
agreed
on
a
different
height,
then
the
council
approved,
or
what
was
originally
asked
for
because
I
think
it
what's
on
here
is
still
very
high.
I
think.
H
I
I
I
just
like
to
follow
with
one
more
comment
to
the
developer.
These
folks
are
your
customers,
and
they
have
worked
very
hard
to
get
their
neighborhood
upgraded
and
to
work
with
them
on
a
clan
which
is
developed
and
approved
by
the
council
by
by
the
county,
would
be
very
much
in
your
best
interest.
Okay,
thank
you.
B
Any
other
questions.
Thank
you.
Thank
you.
Anyone
here
anyone
else
here
to
speak
in
favor
the
application.
Please
come
forward,
seeing
none
anyone
here
to
speak
in
opposition.
Please
come
forward
likewise,
seeing
none!
Mr.
posed,
you
need
rebuttal
time.
Okay,
I,
didn't
suspect
you
would,
but
all
right,
I'm
gonna
go
ahead
and
close
public
hearing
I'm.
Looking
for
a
motion.
B
E
E
D
I
underlined
what
Greg
what
Greg
had
said.
This
really
isn't
a
monument
sign.
This
is
III,
don't
even
know
how
to
describe
but
I
mean
I,
don't
know
if
it's
going
to
be
12
foot
high.
If
it's
gonna
be
16
foot
high,
it's
overpowering,
it's
out
of
scale,
it
just
doesn't
blend
in
it
looks
very
excessively
commercial.
J
I
commented
in
our
previous
meeting
about
the
33
foot,
signs
that
are
15
feet
off
the
ground
and
hope
that
folks
wouldn't
be
confused
by
those
33
foot
signs
announcing
that
this
was
a
CVS
pharmacy
on
to
facades
and
wondered
if
they
needed
a
large,
whatever
kind
of
sign.
We
have
at
this
point
in
time.
K
I
I
have
zero
disagreement
about
the
sign
with
my
fellow
commission
members.
Although
I
appreciate
the
compromise
appreciate
the
fact
that
they
work
with
the
neighborhood
I
I
do
understand
the
need
for
the
sign
it's
part
of
their
business
model.
It's
its
revenue,
it's
part
of
what
they
do
so
I
get
it
I,
don't
like
the
sign
either,
but
I
appreciate
the
fact
that
they
that
they
compromised
and
work
with
the
neighborhood
on
it
and
so
I'd
support
it
and
I.
Don't
like
the
sign.
F
I
just
very
quickly,
if
you
would
indulge
me,
I
respect
the
opinions
of
the
Commission
greatly
you
diligently
looked
at
the
plan.
The
last
time
it
came
to
you
and
made
a
recommendation
of
the
Planning
Commission
her
to
the
council.
The
previous
sign
was
an
18-foot
tall
sign,
that's
what
the
applicant
was
proposing.
F
The
Commission's
condition
was
a
12-foot
sign
recommended
in
between
the
council
meeting
and
the
council
approval.
The
applicant
neighborhood
came
to
an
agreement
at
15
to
16
feet,
and
that
was
what
the
council
approved
I.
The
only
thing
that
I
would
just
comment
on
is
the
fact
that
normally
final
site
plans
do
not
come
back
to
the
plan
and
zoning
commission.
That
was
an
added
condition
that
that
the
Commission
placed
on
this
do
too.
F
So
I
respect
the
Commission's
opinions
about
the
signage
I'd
point
out
that
the
council
on
Monday
night
did
direct
a
review
of
the
sign
code.
It
was
brought
up
by
the
merle
hay
Neighborhood
Association,
as
well
as
the
beaverdale
Neighborhood
Association,
and
there
was
even
a
representative
from
the
Easter
Lake
Neighborhood
Association,
who
stood
up
and
spoke
in
favor
of
looking
at
that.
We
are
in
the
process
of.
F
J
I've
been
admonished
to
follow
the
code,
so
I
won't
stir
the
pot
anymore.
I
understand
that
city
planners
and
fathers
are
working
on
remedying
the
problems
that
we
see
with
this
signage.
My
drive
by
this
all
the
time.
The
whole
place
is
probably
gonna
look
much
better
than
it
does
now
and
well.
I
I
I
listened
to
Mike.
B
E
B
F
Second,
vice
chair
of
the
Commission,
and
so
with
that
you
would
probably
need
to
approve
a
slate
for
a
new
second
vice
chair
for
the
Commission
and
then
vote
on
that
at
your
next
meeting.
So
I
don't
know
if
you,
if
anyone
has
any
suggestions
or
motions
tonight
for
a
slight,
be
considered
at
a
future
meeting,
but
we
we
no
longer
have
a
second
vice
chair
at
this
point.
Cj.
B
B
F
Other
thing
on
Monday
afternoon
at
three:
thirty
from
3
30
25,
so
it's
Monday,
August
fifth
from
3
30
to
5
p.m.
at
the
MPO
office.
That's
located
at
420,
Watson,
Powell,
jr.,
parkway,
2nd
floor.
Jeff
speck
is
going
to
be
putting
our
presentation
on
place,
making
and
walkability
from
3
30
25
and
the
MPO
is
hosting
that
city
of
New
he's
going
to
be
here
earlier
in
the
day
talking
with
us
about
our
downtown
plan,
as
well
as
our
Walnut
Street
scape.
F
He
came
previously
this
year
and
provided
some
input
on
that
and
critiqued
the
design
and
and
he's
back
to
finalize
some
of
that
work,
but
they're
also
doing
a
public
presentation
from
3
30
25
again
on
Monday
this
coming
monday
at
the
MPL
office
right.
I
really
encourage
anyone
who
wants
to
attend
and
can
attend
to.
Please
do
that's.
F
Should
have
received
an
email
on
it
I
I
saw
one
going
around.
I
probably
gotten
at
six
different
times
today,
so
I
I'm
not
quite
certain
where
that
all
went
to,
but
I
will
send
out
the
invite
that
I
got
again
today
to
all
of
you,
either
tonight
or
tomorrow
morning.
But
if
you
can't
attend
Jeff
is
a
really
interesting
speaker
and
very
knowledgeable
on
the
subject,
so
I
really
encourage
you
to
attend.
Thank
you
did.
B
It
nothing
else
nope
one
of
the
things
that
came
up
with
counsel.
We
had
received
several
messages
from
the
merle
hay
neighbors
and
from
I
don't
remember,
I
think
I
remember
merle
hay
neighbors
and
was
sent
to
council
on
this
issue
with
the
signs,
and
I
suspect
that
once
it
goes
through
all
the
channels,
it'll
be
back
in
front
of
us
and
guess
what
Greg
so.
